पठित , धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सेन्ट्रल बैंक ऑफ इंडिया का निदेशक मण्डल , भारतीय रिज़र्व बैंक से परामर्श करके तथा केन्द्र सरकार की पूर्व मंजूरी से सेन्ट्रल बैंक ऑफ इंडिया ( अधिकारी) सेवा विनियमों में संशोधन करके एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्ः-

1. (1 ) ये विनियम सेन्ट्रल बैंक ऑफ इंडिया (अधिकारी ) सेवा (संशोधन) विनियम , 2003 कहलाएंगे । (2) इन विनियमों में अन्यथा उपलब्ध को छोड़कर , ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।

2. सेन्ट्रल बैंक ऑफ इंडिया (अधिकारी) सेवा विनियम , 1979 में, 7599 भाग III-खण्ड4]

(1) चिनियम 4 में, उप्प- विनियम (3) के लिए , निम्नलिखित उप - विनियम प्रतिस्थापित किए जाएंगे , अर्थात्ः-

"(3)" 1 अप्रैल , 1998 से , प्रत्येक श्रेणी के सामने उल्लिखित वेतनमान निम्मलिखित अनुसार होगा: -

(ক) उच्च कार्यपालक श्रेणी

टिप्पणी:

इस 31.3.1998 को लागू वेतनमानों द्वारा शासित होने वाले प्रत्येक अधिकारी का नियतन 1.4.1998 को उप- विनियम में निर्धारित वेतनमान में प्रक्रम- दर- प्रक्रम आधार पर किया जाएगा , अर्थात् पहले प्रक्रम से तदनुरूपी प्रक्रमों पर और वेतनवृद्धियाँ , अन्यथा उपथन्धित को छोड़कर , सामान्यतया अधिवर्षिता तारीख को होंगी ।

(4) उप-विनियम ( 1 ) , (2) और (3 ) की किसी बात का यह अर्थ नहीं लगाया जाएगा कि बैंक के लिए हर समय इम सभी श्रेणियों में अधिकारी रखना अपेक्षित है ।

विनियम 5 के लिए , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्ः- (ii)

"5. येतनवृद्धियां: विनियम 4 के उप- विनियम (3 ) के उपबंधों के अधीन , 1.4.1998 को और उस तारीख से, वेतनवृद्धियां निम्नलिखित उप- खंडों के अधीन मंजूर की जाएंगी:-

(क) विनियम 4 में उपवर्णित वेतनमानों में विनिर्दिष्ट वेतनवृद्धियां , सक्षम प्राधिकारी की मंजूरी के अध्यधीन वार्षिक आधार पर प्रोद्भूत होंगी और "वे जिस महीने में देय होती हैं उस महीने की पहली तारीख को दी जाएंगी।

(ख) वेतनमान और ।। के अधिकारियों को, अपने सम्बन्धित वेतनमानों के अधिकतम पर पहुंचने के एक वर्ष पश्चात् , अगले उच्च वेतनमान में अवरोध वेतनवृद्धि( यों ) सहित आगे की वेतनवृद्धियां नीचे ( ग ) में विनिर्दिष्ट आधार पर दी जाएंगी , बशर्ते कि वे दक्षतारोध को पार कर लें ।

(ग) ऊपर ( ख ) में उल्लिखित अधिकारियों सहित , मध्य प्रबंधन श्रेणी वेतनमानं ।। तथा ।।। के अधिकतम पर पहुंचने वाले अधिकारियों को, यथास्थिति, वेतनमान || तथा III के अंतिम प्रक्रम पर पहुंचने के पश्चात् प्रत्येक 3 वर्षों की सेवा पूरी होने पर अवरोध वेतनवृद्धि( यां) दी जाएगी/जाएंगी । वेतनमान ।। के अंतिम प्रक्रम पर पहुंच चुके अधिकारियों के मामले में रु .340/-की अधिक से अधिक दो चेतसवृद्धियां दी जाएंगी तथा वेतनमान ।।। के अंतिम प्रक्रम के अधिकारियों के मामले में .380/- की एक वेतनवृद्धि दी जाएगी ।

परंतु 01.11.1994 को और उसके बाद से , मूल वेतनमान ।।। के अधिकारियों को अर्थात् जो वेतनमान, II में भरती या पदोन्नत हुए हैं , दूसरी अवरोध वेतनवृद्धि पहली अवरोध बेलनवृद्धि पाने के तीन वर्ष पश्चात् प्रदान की जाएगी ।

टिप्पणी:

अगले उध्धतर वेतनमान में की गई ऐसी वेतनवृद्धियों को पदोन्नति नहीं माना जाएगा। ऐसी वेतनवृद्धियां पाने के पश्चात् भी अधिकारी को, यथास्थिति , उसके अपने मूल पद के वेतनमान ॥ तथा ।।। के ही विशेषाधिकार , परिलब्धियां , ड्यूटी, उत्तरदायित्त्व अथवा पद मिलेंगे ।

(2) सीएआइआइबी का भाग I/ भारतीय बैंकर संस्थान की जूनियर एसोसिएट तथा भाग II/ भारतीय बैंकर संस्थान की प्रमाणपत्रित एसोसिएट परीक्षा उत्तीर्ण करने पर वेतनमान में एक अतिरिक्त वेतनवृद्धि प्रदान की जाएगी ।

स्पष्टीकरण

(क) जिस अधिकारी ने नियत तारीख से पहले अधिकारी के रूप में भारतीय बैंकर संस्थान की प्रमाणपत्रित एसोसिएट (सी.ए.आई.आई. बी . ) परीक्षा का भाग I या भाग II उत्तीर्ण कर लिया हो , उसे नियत तारीख से , यथास्थिति , अतिरिक्त वेतनवृद्धि अथवा येतनवृद्धियां दी जाएंगी, बशर्ते कि उसने उक्त परीक्षा के दोनों भाग उत्तीर्ण करने पर कोई भाग III-खण्ड 4]

वेतनवृद्धि न ली हो अथवा केवल एक वेतनवृद्धि ली हो ।

(তা) 01.11.1987 को तथा उसके बाद से , वेतनमान के अधिकतम पर पहुंचने वाले अथवा पहुंच चुके ऐसे अधिकारियों को जो पदोन्नति पाए बिना और आगे नहीं जीं सकते , सरकारी दिशानिर्देशों के अधीन , यदि कोई हों, सी.ए.,आई.आई.बी. परीक्षा उत्तीर्ण करने के फलस्वरूप अतिरिक्त वेतनवृद्धियों के स्थान पर निम्नानुसार व्यावसायिक अर्हता भत्ता दिया जाएगाः

जिन्होंने सी.ए.आई.आई.बी. का केवल भाग । उत्तीर्ण किया है

( 1) एक वर्ष पश्चात् रु .100/- प्रति माह जिसमें से रु .75/- अधिवर्षिता लाभ के लिए गिने जाएंगे ।

(1 ) एक वर्ष पश्चात् रु .100/- प्रति माह जिसमें से रु .75/-अधिवर्षिता लाभ के लिए गिने जाएंगे ।

जिन्होंने सी.ए.आई.आई.बी. के दोनों भाग उत्तीर्ण कर लिए हैं

(ii ) दो वर्ष पश्चात् रु .250/- प्रति माह जिसमें से रु .200/- अधिवर्षिता लाभ के लिए गिने जाएंगे ।

)عل( 1.11.1994 को तथा उसके बाद से , अन्य बातें समान होने पर , व्यावसायिक अर्हता भत्ते की मात्रा निम्नानुसार पुनरीक्षित रहेंगी:

(1) वेतनमान के अधिकतम पर पहुंचने के एक वर्ष पश्चात् रु .120/- प्रति माह ।

जिन्होंने सी.ए.आई. आई बी . का केवल भाग । उत्तीर्ण किया है

जिन्होंने सी.ए.आई.आई.बी. दोनों भाग उत्तीर्ण कर लिए हैं

(1) वेतनमान के अधिकतम पर पहुंचने के एक वर्ष पश्चात् रु .120/- प्रति माह ।

(ii) वेतनमान के अधिकतम पर पहुंचने के दो वर्ष पश्चात् रु .300/- प्रति माह ।

परंतु, विनियम 5(3 ) (ख ) के अनुसार नियत वैयक्तिक भत्ता प्राप्त करने के पात्र अधिकारी , व्यावसायिक अर्हता भत्ता , यथास्थिति , क्रमशः भाग । या ॥ के लिए ऐसा नियत वैयक्तिक भत्ता पाने के एक/दो वर्ष पश्चात् प्राप्त कर सकेंगे ।

(घ) 1.11.1999 को और उसके बाद से , अन्य बातें समान होने पर , व्यावसायिक अर्हता भुगतान की मात्रा निम्नानुसार पुनरीक्षित रहेंगीः

(i ) वेतनमान के अधिकतम पर पहुंचने के एक वर्ष पश्चात् रु . 150/- प्रतिमाह ।

जिन्होंने जे.ए.आई.आई.बी. या सी ए आई आई बी का भाग [उत्तीर्ण किया है

(1 ) वेतनमान के अधिकतम पर पहुंचने के के एक वर्ष पश्चात् रु .150/- प्रतिमाह ।

जिन्होंने जे.ए.आई.आई.बी. और सी ए आई आई बी या सी ए आई आई बी के दोनों भाग उत्तीर्ण कर लिए हैं

(Ii ) वेतनमान के अधिकतम पर पहुंचने के दो वर्ष पश्चात् रु .360/- प्रतिमाह । [भाग III-खण्ड 4 7002

परंतु , जो अधिकारी वेतनमान । और वेतनमान । में हैं तथा उन्हें उप-विनियम ( 1 ) ( ख ) के अनुसार अगले उच्चतर वेतनमान में अतिरिक्त वेतनवृद्धियां मंजूर की गई हैं , ऐसे उच्चतर वेतनमान में अधिकतम पर पहुंचने के , यथास्थिति , एक/दो वर्ष पश्चात् व्यावसायिक अर्हता भुगतान प्राप्त करेंगे ।

टिप्पणी:

(i) यदि किसी ऐसे अधिकारी को जिसे व्यावसायिक अर्हता भुगतान मिल रहा है , अगले उच्चतर वेतनमान में पदोन्नत किया जाता है तो ऐसे उच्चतर वेतनमान में उसका वेतन निर्धारित करते समय उसे वेतनमान में उपलब्ध वेतनवृद्धियों की सीमा तक जे.ए.आई.आई. बी/ सी.ए.आई.आई .बी. की परीक्षा उत्तीर्ण करने पर अतिरिक्त वेतनवृद्धियां दी जाएंगी और यदि वेतनमान में कोई वेतनवृद्धियां उपलब्ध नहीं हैं तो अधिकारी वेतनवृद्धि( यों ) के एवज में व्यावसायिक अर्हता भुगतान पाने का पात्र होगा ।

(ii) 01.11.1994 को तथा उसके बाद से , यथास्थिति , व्यावसायिक अर्हता भत्ते या व्यावसायिक अर्हता भुगतान को महंगाई भत्ता , मकान किराया भत्ता तथा अधिवर्षिता लाभों के लिए गिना जाएगा । (3) (क) जो अधिकारी 01.11.1993 को बैंक की स्थायी सेवा में हैं उन्हें वेतनमान में एक अग्रिम वेतनवृद्धि दी जाएगी । जो अधिकारी 01.11.1993 को परिवीक्षा पर हैं उन्हें एक अग्रिम वेतनवृद्धि स्थायीकरण के एक वर्ष पश्चात् दी जाएगी ।

टिप्पणी

अग्रिम वेतनवृद्धि के कारण वार्षिक वेतनवृद्धि की तारीख में कोई परिवर्तन नहीं होगा ।

(ख) जो अधिकारी वेतनमान के अधिकतम पर पहुंच चुका है या जो 01.11.1993 को अवरोध वेतनवृद्धि(यां ) प्राप्त कर चुका है , यह 01.11.1993 से नियत वैयक्तिक भत्ता प्राप्त कर सकेगा जो अंतिम आहरित वेतनवृद्धि और उस पर 01.11.1993 को देय महंगाई भत्ता , तथा विनियम 22 के अनुसार लागू दरों पर मकान किराया भत्ते की मात्रा के बराबर होगा । यहां नीचे दिया गया नियत वैयक्तिक भत्ता तथा साथ ही साथ महंगाई भत्ता, यदि कोई हो, संपूर्ण अवधि के लिए अवरुद्ध कर दिया जाएगा । 7603 भारत का राजपत्र, जून 28 , 2003 ( आषाढ़ 7 , 1925)

टिप्पणी:

(1) खंड (ख ) और ( ग ) में कॉलम ( ग) के अंतर्गत निर्दिष्ट नियत वैयक्तिक भत्ता/नियत वैयक्तिक भुगतान उन अधिकारी कर्मचारियों को देय होगा जिन्हें बैंक का आवास उपलब्ध कराया गया हैं ।

(ii) मकान किराया भत्ते के लिए पात्र अधिकारियों को नियत वैयक्तिक भत्ता/नियत वैयक्तिक भुगतान विनियम 4 के उप- विनियम (2) और (3) में विनिर्दिष्टानुसार सम्बंधित वेतनमान की अंतिम वेतनवृद्धि प्राप्त कर लेने पर, (अ) (आ) सम्बद्ध अधिकारी कर्मचारियों द्वारा आहरित मकान किराया भत्ता होगा ।

(iii) 1 नवम्बर , 1999 को या उसके बाद से , नियत वैयक्तिक भुगताम देने के कारण उप- विनियम (2) के अधीन स्पष्टीकरण के अनुसार व्यावसायिक अर्हता भुगतान करने की अनुसूची में कोई परिवर्तन नहीं होगा।

परंतु , जहां व्यावसायिक अर्हता भुगतान भी कोई किस्त, जो पूर्व के प्रावधानों के कारण एक वर्ष तक बढ़ा दी गई थी और 1 नवम्बर , 1999 को या उसके बाद जारी की जाने वाली है , अधिकारी को इस तारीख को या से दी जाएगी और व्यावसायिक अर्हता भुगतान , यदि कोई हो,की दूसरी किस्त 1 नवम्बर , 2000 को दी जाएगी ।

[भाग III-खण्ड 4 (iv) नियत वैयक्तिक भत्ते/नियत वैयक्तिक भुगतान के वेतनवृद्धि घटक को अधिर्षिता लाभ के लिए गिना जाएगा ।

(घ) जिस अधिकारी को उपर्युक्त (क ) के अनुसार वेतनवृद्धि मिल चुकी है उसे ऊपर (ख) र (ग) में उल्लिखित नियत वैयक्तिक भत्ते/नियत वैयक्तिक भुगतान की प्रमात्रा , वेतनमान के अधिकतम पर पहुंचने के एक वर्ष पश्चात् प्राप्त होगी ।

(iii) विनियम 21 में , उप- विनियम (2) के पश्चात् , निम्नलिखित उप- विनियम जोका जाएगा , अर्थात्-

"(3) 01.04.1998 को तथा उसके बाद से , महंगाई भत्ता योजना इस प्रकार होगी -

(क ) महंगाई भत्ता अखिल भारतीय औसत श्रमिक वर्ग उपभोक्ता मूल्य सूचकांक सामान्य आधार 1960-100 की तिमाही औसत में 1684 अंकों के ऊपर 4 अंकों की प्रत्येक वृद्धि अथवा गिरावट के हिसाब से संदेय होगा ।

(ख) महंगाई भत्ता निम्मलिखित दरों पर संदेय होगा:

(1) रु .7100/- तक ' वेलन ' का 0.24 % तथा (+)

(II) रु.7100/- से अधिक परंतु रु .11300/- तक ' वेतन' का 0.20% तथा (+) ,

(iii) रु .11300/- से अधिक परंतु रु .12025/- तक ' वेतन' का0.12 % तथा (+) ,

(iv) रु .12025/- से ऊपर ' वेतन' का 0.06 %.

टिप्पणी:

(अ) महंगाई भत्ते के प्रयोजन हेतु ' वेलन ' से मूल वेतन तथा अवरोध येतनवृद्धियां अभिप्रेत हैं ।

(आ) विनियम 5 के उप- विनियम (2) के स्पष्टीकरण ( ग) और ( घ) में निर्दिष्टानुसार , व्यावसायिक अर्हता भत्ते/व्यावसायिक अर्हता भुगतान को महंगाई भत्ते के लिए गिना जाएगा । " ,

(iv) विभिराम 22 के लिए , निम्मलिखित विनियम प्रतिस्थापित किया जाएगा अर्थात्: "22 क्रण किराया भत्ता -

(" ( ) 01.11.1994 को या उसके बाद से, यदि किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान की जाती है तो उससे वह जिस वेतनमान में है उसके प्रथम प्रक्रम में मूल वेतन के 4 % के 7605 भाग III-खण्ड4]

बराबर रकम या आवास हेतु मानक किराया , जो भी कम हो, वसूल किया जाएगा ।

(ख) 01.11.1992 को या उसके बाद से , यदि किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान नहीं की जाती है तो वह निम्नलिखित दरों पर मकान किराया भत्ता पाने का पात्र होगा:

( ili ) क्षेत्र II तथा उपर्युक्त (1 ) और (ii) के अंतर्गत न आने वाले राज्यों तथा संघशासित क्षेत्रों की राजधानियां

वेतन का 9.5% प्रतिमाह

(lv) क्षेत्र III

परंतु , यदि कोई अधिकारी किराये की रसीद प्रस्तुत करता है तो उसे देय मकान किराया भत्ता , जिस वेतनमान में यह है उसके प्रथम प्रक्रम के 4 % से ऊपर , उसके द्वारा अपने आवास के लिए दिया गया वास्तविक किराया या ऊपर स्तंभ II के अनुसार देय मकान किराया भत्ते का 150 % , जो भी कम हो , होगा ।

(2) (क) 1 नवम्बर , 1999 को और उसके बाद से , यदि किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान की जाती है तो उससे वह जिस वेतनमान में है उससे प्रथम प्रक्रम में मूल वेलन के 2.5% के बराबर रकम या आवास हेतु मानक किराया , जो भी कम हो , वसूल किया जाएगा ।

(ख) 01.11.1999 को और उसके बाद से , यदि किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान नहीं की जाती है तो वह निम्नलिखित दरों पर मकान किराया भत्ता पाने का पात्र होगा । 7606

(i) मकान किराया भत्ते के प्रयोजन हेतु 'वेतन' तथा अवरोध वेतनवृद्धियां अभिप्रेत हैं ।

(ii) मकान किराया भत्ते के प्रयोजन हेतु , यथास्थिति, व्यावसायिक अर्हता भत्ते या व्यावसायिक अर्हता भुगतान को 01.11.1994 से प्रभावी गिना जाएगा ।

(3) यदि कोई अधिकारी अपने ही मकान में रहता है तो उसे उप- विनियम ( 1 ) (ख) और ( 2 ) ( ख ) में उल्लिखित परंतुक के आधार पर इस प्रकार मकान किराया भत्ता मिलेगा मानो वह नीचे ' अ' अथवा ' आ' में से उच्चतर के बारहवें भाग के बराबर मासिक किराया दे रहा हो ।

'अ'

निम्नलिखित का योग :

(i ) निवास स्थान के लिए देय नगरपालिका कर , और

(ii) भूमि की लागत सहित निवास स्थान की पूंजीगत लागल का 12% और यदि निवास स्थान किसी भवन का भाग है तो उतने भाग की भूमि के आनुपातिक हिस्से की पूंजीगत लागत , किंतु इसके अंतर्गत वातानुकूल जैसे विशेष जुड़नार शामिल नहीं होंगे; या 7607

निवास स्थान के लिए नगरपालिका कर निर्धारण हेतु आंका गया वार्षिक्क किराया मूल्य ।

स्पष्टीकरण

(1) इस विनियम के प्रयोजन हेतु मानक किराया' से अभिप्रेत है:

(क)

बैंक के स्वामित्व वाले निवास स्थानों के मामले में सरकार में ऐसे निवास स्थानों के संबंध में प्रचलित पद्धति के अनुसार आंका गया मानक किराया ,

(ख) जहां आवास बैंक द्वारा किराए पर लिया गया हो , बैंक द्वारा देय संविदागल किराया अथवा उपर्युक्त ( क ) में बताई गई कार्यविधि के अनुसार परिकलित किराया , इनमें से जो भी कम हो ।

( 2) इस विनियम में , उप- विनियम ( 1 ) के प्रयोजन हेतु , क्षेत्र । क्षेत्र ।। और क्षेत्र !!! से अभिप्राय है :

12 लाख से अधिक जनसंख्या वाले स्थान

क्षेत्र । -

क्षेत्र 11- ऊपर क्षेत्र । के अलावा अन्य सभी शहर जिनकी जनसंख्या 1 लाख और उससे अधिक है

क्षेत्र III - क्षेत्र । और क्षेत्र ।। में शामिल न किये गये अन्य सभी स्थान ।

(3) इस विनियम और विनियम 23 के उप- विनियम (2 ) के प्रयोजन हेतु , क्षेत्र । और क्षेत्र ॥ से निम्न अभिप्राय हैः-

क्षेत्र । 12 लाख से अधिक जनसंख्या वाले स्थान ।

क्षेत्र । वे सभी स्थान जो क्षेत्र में शामिल नहीं किए गए हैं; "

विनियम 23 में ,

(v)

खंड ( i ) के लिए , निम्नलिखित खंड प्रत्तिस्थापित किया जाएगा , अर्थात्ः- (क)

(1)..

01.11.1999 को और उसके बाद से , यदि अधिकारी निम्नलिखित सारणी के स्तंभ में उल्लिखित किसी स्थान में कार्यरत हो तो वह उस स्थान के सामने स्तंभ 2 में उल्लिखित दर पर नगर प्रतिकर भत्ता पाने का पात्र होगा:

(क)

5 लाख या उससे अधिक जनसंख्या वाले स्थान और राज्यों की राजधानियां तथा चंडीगढ़ , पांडिचेरी और पोर्टब्लेयर जो ऊपर (क) में नहीं आते ।

(ख) खंड (V) और (vi ) के लिए , निम्नलिखित खंड प्रतिस्थापित किए जाएंगे , अर्थात्ः-

"(v) 01.11.1999 को उसके बाद से , यदि किसी अधिकारी को बैंक से बाहर सेवा के लिए प्रतिनियुक्त किया जाता है तो वह प्रतिनियुक्ति के पद पर देय उन सभी परिलब्धियों को प्राप्त करने के लिए अपना विकल्प दे सकता है । विकल्पतः, वह अपने वेतन के अतिरिक्त 7.75% , अधिकतम रु .1000/- प्रतिमाह प्रतिनियुक्ति भत्ता और ऐसे अन्य भत्ते ले सकता है जो उसे उसी स्थान पर बैंक की सेवा में तैनात होने की स्थिति में मिलते ।

परंतु, यदि उसे उसकी प्रतिनियुक्ति से पूर्व उसकी तैनाती के स्थान पर ही स्थित किसी संगठन में प्रतिनियुक्त किया जाता है तो उसे उसके वेतन का 4 % , अधिकतम रु .500/- , प्रतिनियुक्ति भत्ता मिलेगा ।

परंतु यह भी कि जिस अधिकारी को बैंक के प्रशिक्षण संस्थान में संकाय सदस्य के रूप में , प्रतिनियुक्त किया जाता है , उसे उसके वेतन का 4% , अधिकतम रु .500/-, प्रतिनियुक्ति भत्ता मिलेगा ।

(vl) 01.11.1999 को और उसके बाद से , यदि अधिकारी से कम से कम 7 दिन लगातार या किसी कैलेण्डर महीने के दौरान कुल सात दिन किसी उच्चतर श्रेणी में किसी पद पर स्थानापन्न रूप में कार्य लिया जाता है तो उसे स्थानापन्न रूप में कार्य करने की अवधि के लिए , यथानुपात , उसके वेतन का 6 % स्थानापन्न भत्ता मिलेगा । स्थानापन्न भत्ते को भविष्य निधि/पेंशन के लिए हिसाब में लिया जाएगा किंतु अन्य प्रयोजनों के लिए नहीं ।

परंतु , यदि कोई अधिकारी विनियम 6 के अधीन पदों के प्रवर्गीकरण के मात्र पुनरीक्षण के परिणामस्वरूप उच्चतर वेतनमान में स्थानापन्न रूप में कार्य करता है तो उसे प्रवर्गीकरण के पुनरीक्षण के प्रभावी होने की तारीख से एक वर्ष की अवधि के लिए स्थानापन्न भत्ता नहीं मिलेगा । 7609

खंड ( x) के लिए , निम्नलिखित खंड प्रतिस्थापित किया जाएगा , अर्थात्ः- (ग)

"(x) 01.11.1999 को और उसके बाद से , यदि अधिकारी नीचे दी गई सारणी के स्तंभ । में उल्लिखित किसी स्थान पर सेवा कर रहा हो तो उसे स्तंभ 2 में उल्लिखित दर पर पर्वत तथा ईंधन भत्ता दिया जाएगा :

टिप्पणी:

(क) कम से कम 750 मीटर ऊंचाई पर स्थित स्थान जो उससे अधिक ऊंचाई वाले पर्वतों से घिरे हुए हों और जिन तक पहुंचने के लिए 1000 मीटर या उससे अधिक ऊंचाई पार करनी पड़ती हो, पर तैनात अधिकारियों को 1000 मीटर और उससे अधिक ऊंचाई चाले केन्द्रों के लिए देय दर पर पर्वत तथा ईंधन भत्ता दिया जाएगा ।

(ख ) उक्त वर्गीकरण के अंतर्गत म 'आने वाले किसी भी केन्द्र में फिलहाल दिए जाने वाले पर्वत और ईंधन भत्ते समाप्त कर दिए जाएंगे ।

परंतु , जो अधिकारी 1 मई , 1989 के पूर्व ऐसे केन्द्र पर तैनात था और उस तारीख के बाद भी उसी केन्द्र पर तैनात रहता है उसे 30 अप्रैल , 1989 को मिल रहे भत्ते की प्रमात्रा संरक्षित की जाएगी और उसी वेतनमान में उस केन्द्र में उसके तैनात रहने तक प्रतिमाह अदा की जाएगी ।

(vi) विनियम 24 में , उप विनियम ( 1 ) में

खंड (क ) के लिए , निम्मलिखित खंड प्रतिस्थापित किया जाएगां , अर्थात्ः (अ)

"क चिकित्सा व्ययः 01.11.1999 को और उसके बाद से, अधिकारी द्वारा अपने और अपने परिवार के लिए किए गए चिकित्सा व्यय की प्रतिपूर्ति नीचे स्तंभ 1 में विनिर्दिष्ट श्रेणी तथा स्तंभ 2 में विनिर्दिष्ट प्रतिपूर्ति सीमा के अध्यधीन की जाएगी । इसके लिए अधिकारी को अपनी ओर से ही प्रमाणपत्र देना होगा कि उसने यह व्यय किया है और दावा की गई राशि के समर्थन में उसे खर्च का विवरण देना होगा:

(!!).. चिकित्सा सहायता योजना के अधीन वर्ष 1999 के लिए चिकित्सा व्यय की प्रतिपूर्ति दो महीने , अर्थात् नवम्बर और दिसम्बर , 1999 के लिए यथानुपात बकाई जाएगी ।

(इ) खंड ( ख) में , पैराग्राफ (lii ) के बाद , निम्नलिखित पैराग्राफ जोड़ा जाएगा, अर्थातः-

(iv) 1 , नवम्बर , 1999 को और उसके बाद से , उपर्युक्त पैराग्राफ ( iii) में उल्लिखित बीमारियों के अलावा , निम्नलिखित बीमारियां भी घरेलू इलाज हेतु पात्र होंगी । अन्य शर्तों में कोई परिवर्तन नहीं हैः- हेपेटाइटिस- बी, हीमोफीलिया और माइस्थेनियाग्रेविस । ";

(vii) विनियम 25 के लिए , निम्नलिखितं विनियम प्रतिस्थापित किया जाएगा , अर्थात्ः-

"25 आवास व्यवस्था

(1) अधिकारी बैंक द्वारा आवास उपलब्ध कराये जाने के लिए साधिकार हकदार नहीं होगा ।

(2) किंतु , यदि बैंक चाहे तो यह अधिकारी को आवास उपलब्ध करा सकता है जिसके लिए अधिकारी 01.11.1999 को और उसके बाद से , अपने वेतमान के प्रथम प्रक्रम के 2.5 % के बराबर राशि या आवास के लिए मानक किराये का, जो भी कम हो , भुगतान करेगा ।

परंतु , जहां ऐसें आवास पर फर्नीचर उपलब्ध कराया जाता है , वहां बैंक द्वारा अधिकारी से उसके वेतनमान , जिसमें यह रखा गया है , के प्रथम प्रक्रम के 0.5 % के बराबर अतिरिक्त राशि वसूल की जाएगी ।

परंतु , जहां बैंक द्वारा ऐसी आवास व्यवस्था उपलब्ध कराई जाती है वहां बिजली , पौनी , गैस और सफाई प्रभार अधिकारी द्वारा वहन किए जाएंगे । 7611 भाग III-खण्ड4]

(viii) विनियम 35 में , निम्नलिखित परंतुक जोड़ा जाएगा , अर्थात् :

" परंतु , यदि बीमारी की अतिरिक्त छुट्टी 29 जून , 1999 को या उसके पश्चात् ली जाती है तो बीमारी की अतिरिक्त छुट्टी के संराशीकरण की अनुमति विनियम 34 के उप- विनियम (2 ) के अनुसार दी जाएगी ।

(ix) विनियम 36 के लिए , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्ः-

"36 प्रसूति छूट्टी

(1) 1 अप्रैल , 2000 को या उसके बाद से , प्रसूति छुट्टी के रूप में ; एक बार में 6 महीने तक की छुट्टी मंजूर की जा सकती है जिसके अंतर्गत प्रसूति के बाद की अवधि या गर्भस्त्राव या गर्भपात या गर्भावस्था की चिकित्सीय समाप्ति के समय की छुट्टी भी शामिल है :

परंतु , ऐसी छुट्टी अधिकारी की संपूर्ण सेवा अवधि के दौरान अधिक से अधिक 12 महीने की होगी ।

(2) निःसंतान महिला कर्मचारी को सेवाकाल के दौरान एक बार , एक वर्ष से कम उम्र के बच्चे को, एक वर्ष का होने तक , कानूनी रूप से गोद लेने के लिए भी छुट्टी मंजूर की जा सकती है जो निम्नलिखित निबंधनों एवं शर्तों के अधीन अधिकतम दो महीने की होगी :

(i) छुट्टी केवल एक बच्चे को गोद लेने के लिए मंजूर की जाएगी;

(ii) बच्चे को उचित कानूनी प्रक्रिया के जरिए गोद लिया जाना चाहिए और कर्मचारी को ऐसी छुट्टी मंजूर करने के लिए बैंक को दत्तक विलेख प्रस्तुत करना होगा । "

( x) विनियम 41 में , उप - विनियम (4) के लिए , निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात्: -

(4) ( क) विराम भत्ता

परंतु, यदि अनुपस्थिति की कुल अवधि 8 घंटे से कम , किंतु 4 घंटे से अधिक है तो ऊपर बताई गई दरों की आधी दर से विराम भत्ता देय होगा।

स्पष्टीकरण

विरामः भत्ते की संगणना के लिए ' प्रतिदिन' का अभिप्राय है 24 घंटे की अवधि या उसके बाद का कोई भी भाग , जिसकी गणना विमान यात्रा के मामले में रिपोर्ट करने के समय तथा अन्य मामलों में प्रस्थान के लिए नियत समय से लेकर पहुंचने के वास्तविक समय तक की जाएगी । यदि अनुपस्थिति की कुल अवधि 24 घंटे से कम है तो ' प्रतिदिन' से ऐसी अवधि अभिप्रेत है जो 8 घंटे से कम न हो।

(ख) खान-पान खर्च

नीचे दी गई सारणी के स्तंभ 1 में वर्णित श्रेणी/बेतनमान के अधिकारी को होटल के वास्तविक खर्च की प्रतिपूर्ति की जाएगी जो नीचे स्तंभ 2 में वर्णित तवमुरूपी स्टार श्रेणी के भारतीय पर्यटन विकास निगम (आइटीडीसी) होटलों में एकल आवास' कमरे के प्रभारों तक सीमित होगी।

अधिकारी उपर्युक्त उप- विनियम 4 (क ) में वर्णित दरों से दैनिक आवास ख६ का पात्र होगा।

(घ) यदि आधास की व्यवस्था बैंक की लागत पर या बैंक द्वारा की गयी है तो तीन फौथाई विराम भत्ता दिया जाएगा ।

(ङ) यो सोजन की व्यवस्था बैंक की लागत पर या बैंक द्वारा निाशुल्क की गई है सो आथा विराम भत्ता दिया जाएगा । भाग III-खण्ड4]

यदि आवास और भोजन की व्यवस्था बैंक की लागत पर या बैंक द्वारा की गई है तो चौथाई विराम भत्ता दिया जाएगा । लेकिन , यदि कोई अधिकारी ग्रास्तविक रूप में हुए खर्च के संबंध में बिल प्रस्तुत किए बिला, घोषणा के आधार पर आवास खर्च का दावा करता है तो उसे चौथाई थिपाम भत्ता महीं दिया जाएगा ।

(छ) सभी निरीक्षण अधिकारियों को मुख्यालय से बाहर निरीक्षण जयूटी पर विराम के प्रतिदिन के लिए रु .10/-का अनुपूरक दैनिक भत्ता दिया जा सकता है ।

(xi) विनियम 42 में , उप- धिनियम (2) के लिए , निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्:-

" (2) 01.04.1998 को और उसके भाव से स्थानांतरित अधिकारी को मालगाड़ी से अपने सामान के परिवहन के लिए निम्नलिखित सीमाओं के अनुसार प्रतिपूर्ति की जाएगी:-

1. संक्षिप्त शीर्षक एवं प्रारंभ

(1 ) . ये विनियम पंजाब एण्ड सिंध बैंक अधिकारी सेवा ( संशोधन ) अधिनियम , 2003 कहलाएंगे । (2) . ये विनियम सरकारी राजपत्र में प्रकाशन की तिथि से प्रभावी होंगे ।

2. पंजाब एण्ड सिंध बैंक अधिकारी सेवा अधिनियम 1982 के विनियम 38 के दूसरे अनुच्छेद के बाद निम्नलिखित अनुच्छेद जोडा जाएगा, अर्थातः

" परन्तु जो अधिकारी दिनांक 01.04.2001 को या उसके बाद पीएसबी( ओ ) एसआर-1982 के नियमन-20 में उप-विनियमन ( 2 ) के अनुसार उचित नोटिस देकर सेवा से त्यागपत्र देते हैं , उन्हें सेवा समाप्ति की तिथि को उनके खाते में जमा साधिकार छु‌ट्टियों की आधी परन्तु अधिकतम् 120 दिनों तक की परिलब्धियों के समान राशि का भुगतान किया जाए । "

In exercise of the powers conferred by section 19 , read with sub - section (2 ) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 ( 5 of 1970) , the Board of Directors of the Central Bank Of India in consultation with the Reserve Bank of India and with the previous sanction of the Central Government hereby makes the following regulations further to amend Central Bank Of India (Officers' ) Service Regulations , 1979 , namely:-

1. ( 1) These regulations may be called the Central Bank of India (Officers') Service (Amendment) Regulations , 2003 .

2) Save as otherwise provided in these regulations , they shall come into force on the date of their publication in the Official Gazette .

Note: Every officer who is governed by the scales of pay as in force as on 31.3.1998 shall be fitted in the scale of pay set out as in this suo -regulation as on 1.4.1908 on stage to stager is , ie , on corresponding stages from East stage onwards in the respective sales and the increments shall tall on the anniversary date as usual exće here provided otherwise .

(4) Nothing in sub - regulations ( i) , ( 2) and (3 ) shall be construed as requiring the Bank to have at all times , officers serving in all these grades . ";

(ii) for regulation 5 , the following regulator shall be substituted namely: -

"5. Increments .- ( 1 ) Subjectto the provisions of sub -regulation (3 ) of Regulation4, on and from 1.4.1998 , the increments shall be granted subject to the foliowing sub - clauses- 7622

[PART III- SEC . 4 ( a) The increments specified in the scales of pay set out in Regulation 4 shall , subject to the sanction of the Competent authority , accrue on an annual basis and shall be granted on the first day of the month in which these fall due ..

(b ) Officers in Scale I and Scale II , 1 year after reaching the maximum in their respective scales , shall be granted further increments including stagnation increment (s) in the next higher scale only as specified in ( c ) below subject to their crossing the efficiency bar as per guidelines of the Government .

( c) Officers including those referred to in ( b ) above who reach the maximum of the Middle Management Grade Scales II and III shall draw stagnation increment( s ) for every three completed years of service after reaching the last stage of the Scale II or Scale III as the case may be subject to a maximum of two such increments of Rs.340/- each for officers in the last stage of Scale II and one such increment of Rs.380/- for officers in the last stage of Scale III .

Provided that on and from 1.11.1994 officers in substantive Scale III i.e. those who are recruited in or promoted te Scale III shall be eligible for second stagnation increment three years after having received the first stagnation increment.

Note:

Grant of such increments in tis next higher scale shall not amount to promotion. Officers even after sot of such increments shall continue to get privileges , perquisites , duties , ponsibilizes or posts of their substantive Scale 1 or Seale its the casa mbe .

(2) An additional increment cach shall be granted me scale of pay for passing Part I of CAIB /Junior Associ Certified Aciates of the Indian of Bankers and Part 11 / Indian titute Bari.cas Excurination .

Explanation :

In the case of an officer who has passed Part I or Part 11 of Certified Associate of Indian Institute of Bankers Examination as an officer before the appointed date , the additional increment , or increments as the case may be , shall be given effect to from the appointed date provided that he has not 7623 PART III-SEC . 4]

received any increment or received only one increment , for passing both parts of the said Examination .

(b) On and from 1.11.1987 , officers who reach or have reached the maximum in the pay scale and are unable to move further except by way of promotion shall subject to Government guidelines , if any , be granted Professional Qualification Allowance in lieu of additional increments in consideration of passing CAIIB Examination as under: -

Those who have passed : only Part.1 of CAIIB

( i ) P.s.100/- p.m. after one year of which Rs.75/- shall rank for superannuation benefits .

Those who have passed : both Parts of CAIIB

( i) Rs.100/ - p.m. after one year, of which Rs.75/ - shall rank for superannuation benefits .

(ii) Rs.250/- p.n. after two years , ofwhich Rs.200/ -shall rank for superannuation benefits .

(c) On and from 1.11.1994 , other things being equal , the quantum of Professional Qualification Allowance shall stand revised as under : -

Those who have passed : ( i ) Rs.120/- p.m. after one year on reaching top of the scale.

(d) On and from 1.11.1999, other things being equal , the quantum of Professional Qualification Pay shall stand revised as under: -

Those who have passed JAIIB orPart I of CAIIB :

( i ) Rs.150/- p.m. after one year on reaching max . of the scale

( i) Rs.150/- p.in. fter one year on reaching max . of the scale

Those who have passed JAIIB and CAIIB or both parts of CAIIB:

(ii) Rs.360/-p.m . after two years on reaching max . of the scale .

[PART III SEC . 4 Provided that officers who are in Scale I and Scale II and are granted further increments in the next higher scale as in sub -regulation ( 1 )(b ) shall draw Professional Qualification Pay after one/two years , as the case may be, on reaching the maximum in such higher scales ."

Note :

( i) If an officer who is in receipt of Professional Qualification Pay is promoted to next higher scale , he shall be granted, on fitment in such higher scale, additional increment(s) for passing JAIIB /CAIIB to the extent increments are available in the scale and if no increments are available in the scale , the officer shall be eligible for Professional Qualification Pay in lieu of increment( s) .

(ii ) On and from 1.11.1994 Professional Qualification Allowance or Professional Qualification Pay, as the case may be , shall rank for Dearness Allowance , House Rent Allowance and Superannuation Benefits .

3 ( a) All officers who are in the bank's permanent service as on 1 " November, 1993 wili get one advance increment in the scale of pay. Officers who are on probation on 1 " November, 1993 will get one advance increment one year after confirmation.

Note:

There shall be no change in the date of annual increment because of advance increment .

(b) An officer who is at the maximum of the scale or who is in receipt ofstagnation increment (s ) as on 1st November , 1993 , will draw a Fixed Personal Allowance from 1 " November , 1993 which shall be equivalent to an amount of last increment drawn plus dearness allowance payable thereon as on 1 " November, 1993 , plus house rent allowance , at such rates as applicable in terms of Regulation 22. The Fixed Personal Allowance given hereunder together with House Rent Allowance , if any, shall remain frozen for the entire period of service:

Note:

(i). Fixed Personal Allowance/Fixed Personal Pay as indicated under Column (c) in clause (b ) and (c) shall be payable to those officer employees who are provided with bank's accommodation.

(ii) Fixed Personal Allowance./Fixed Personal Pay for officers eligible forHouse Rent Allowance shall be ( A)+ (B)+House Rent Allowance drawnby the concerned officer employees when the last increment of the relevant scale of pay as specified in sub - regulation (2 ) and (3 ) of Regulation 4 is earned.

( iii) On and from 1st November, 1999 there shall be no change in the schedule of release of Professional Qualification Pay as in Explanation ( c) under sub - regulation (2) on account of release of Fixed Personal Pay:

be released to the officer on and from this date and second instalment of Professional Qualification Pay , if any , shall be released on 15" November , 2000 .

(iv) The increment component of Fixed Personal Allowance/Fixed Personal Pay shall rank for superannuation benefits.

(d) An officer who has earned the advance increment as in (a ) above shall draw the quantum of Fixed Personal Allowance /Fixed Personal Pay as mentioned in (b ) or ( c ) above , one year after reaching the maximum of the scale . " ;

(iii) In regulation 21 , after sub - regulation (2 ) , the following sub - regulation shall be inserted, namely: -

"(3 ) On and from 1.4.1998 , Dearness Allowance Scheme shall be as under : -

(a) Dearness Allowance shall be payable for every rise or fall of4 points ever 1684 points in the quarterly average of the All India Average Working Class Consumer Price Index (General ) Base 1960-100 .

(b) Dearness Allowance shall be payable as per the following rates: -

(i) 0.24% of ' pay ' upto Rs.7100/- plus ,

( ii ) 0.20% of ' pay' above Rs.7100/- to Rs.11300 /- plus ,

(iii ) 0.12% of ' pay ' above Rs.11300/- to Rs . 12025 /- plus ,

( iv) 0.06% of ' pay' above Rs.12025/-

Note:

(A) ' Pay' for the purpose of Dearness Allowance shall mean basic pay including Stagnation Increments .

(B ) Professional Qualification Allowance/Professional Qualification Pay as specified in Explanation (c) and ( i) to sub- regulation (2 ) of Regulation 5 shall rank for dearness allowance ." ;

(iv) for Regulation 22, the following regulation shall be substituted , namely ,

4% of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation , whichever is less , will be recovered from him.

(b) Where an officer is not provided any residential accommodation by the Bank he shall be eligible on and from 1.11.1992 for House Rent Allowance at the following rates:

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him för his residential accommodation in excess over 4 % of the pay in the first stage of the scale of pay in which he is placed or 150% of the House Rent Allowance payable as per Column II above, whichever is lower .

(2)(a) On and from 1st November, 1999 where an officer is provided with residential accommodation by tha Bank, a sum equal to 2.5 % of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less , will be recovered from him.

(b ) Where an officer is not provided any residential accommodation by the Bank he shall be eligible on and from 1.11.1999 for House RentAllowance at the following rates: -

(3 ) Where an officer resides in his own accommodation he shall be eligible for a House Rent Allowance on the same basis as mentioned in proviso to sub- regulation ( 1 ) ( b ) and 2(b) as if he were paying by way of monthly rent a sum equal to one twelfth of the higher of A or B below: -

The aggregate of: -

i) Municipal taxes payable in respect of the accommodation ; and

The annual rental value taken for municipal assessment of the accommodation .

Explanation.- ( 1 ) For the purpose of this Regulation "standard rent" means: -

(a) Inthe case ofany accommodation owned by the Bank, the standard rent calculated inaccordance with the procedure for such calculation in vogue in the Government:

(b) Where accommodation has been hired by the bank, contractual rent payable by the bank or rent calculated in accordance with the procedure in (A) above, whichever is lower.

(2) In this Regulation , for the purpose of sub - regulation ( 1 ) , Area I , Arca II , and Area III shall mean as under:-

Area I - Places with a population of more than 12 lakhs .

Area II All Cities other than those included in Area I which have a population of 1 lakh or more.

Area III All places not included in Area I and Area II .

(3) For the purpose of sub-regulation (2) of this Regulation and Regulation 23 , Area I and Area II shall mean as under:-

(v) in regulation 23,

(a) for clause (i ), the following clause shall be substituted, namely:-

"(i ) On and from 1.11.1999, ifhe is serving in a place mentioned in column 1 oftheTable below, a City Compensatory Allowance at the rate mentioned in column 2 thereof against that place shall be payable:-

(b) for clause (v) and (vi ) , the following clauses shall be substituted , namely : - " (v) on and from 1.11.1999, if an officer is deputed to serve outside the bank, he may opt to receive the emoluments attached to the post to which he is deputed. Alternatively, he may in addition to his pay . draw a deputation allowance of 7.75% of pay subject to a maximum Rs.1000/- per month and such other allowances he would have drawn had he been posted in the bank's service at that place . fe

Provided that where he is deputed to an organisation which is located at the same place where he was posted immediately prior to his deputation, he shall received a deputation allowance equal to 4 % of his pay subject to a maximum Rs.500/- per month .

Provided further that an officer on deputation to the Training Establishment of the bank as a faculty member shall be eligible for deputation allowance at 4 % of his pay subject to a maximum Rs.500/- permonth.";

(vi) On and from 1.11.1999 if he is required to officiate in a post in a higher scale for a continuous period of not less than 7 days at a time or an aggregate of 7 days during a calendar month, he shall receive an officiating allowance equal to 6% of his pay , pro - rata for the period for which he officiates . Officiating allowance will rank as pay for purposes of Provident Fund/ Pension and not for other purposes.

allowance for a period of one year from the date on which the review ofthe categorization takes effect.";

"(x) On and from 1.11.1999 , if the officer is serving in a place mentioned in column I ofthe table below, he shall receive a hill and fuel allowance at the rate mentioned in column 2 thereof: -

(a) Officers posted at places with an altitude of not less than 750 metres andwhich are surrounded by hills with higher altitude which cannot be reached without crossing an altitude of 1000 metres or more, will be paid hill and fuel allowance at the same rate as is payable at centers with an altitude of 1000 metres and above .

(b) Hill and Fuel Allowance presently paid at any centre not coveredby the above classification shall stand withdrawn .

Provided that in respect of an officer who was posted in such a centre prior to Ist May, 1989 and remains posted at that centre even after that date, the quantum of allowance which he was drawing as at 30th April , 1989 shall be protected and paid to him every month till the time he remains posted at that centre in the same scale ofpay." ;

(vi ) in Regulation 24 , in sub - regulation ( 1 ) ,

(A) for clause (a) , the following clause shall be substituted, namely:-

" (a) Medical Expenses . On and from 1.11.1999 reimbursement of medical expenses to an officer in the grade specified in column 1 of 7632

(B) for Note ( ii ) , the following note shall be substituted, namely: -

"( ii ) For the year 1999 the reimbursement of medical expenses under the medical aid scheme shall be enhanced proportionately for two months , i.e. November and December, 1999. " ;

" ( iv) On and from 1st November, 1999 in addition to diseases mentioned in para ( iii) above, the following diseases shall also become eligible for domiciliary treatment, other conditions remaining unchanged:-

Hepatitis - B , Haemophilia and Myaestheniagravis ." ;

(vii) for regulation 25 , the following regulation shall be substituted, namely: -

"25. Residential Accommodation.- ( 1 ) No officer shall be entitled as of right to be provided with residential accommodation by the Bank.

(2) It shall , however, be open to the Bank to provide residential accommodation to an officer on payment by the officer , on and from 1st November, 1999, a sum equal to 2.5% of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation , whichever is less:

Provided that where the officer is provided with furniture at such resi ler xe, a further sum equal to 0.5% of basic pay in the first stage of the scale ofpay in which he is placed , will be recovered by the Bank from him .

Provided further that, where such residential accommodation is provided by the bank, the charges for electricity, water , gas and conservancy shall be borne by the officer. ";

(viii) in regulation 35 , the following proviso shall be inserted , namely; -

"Provided that in case of additional sick leave availed on or after 29th June , 1999 commutation of additional sick leave may be allowed in accordance with sub- regulation ( 2) of Regulation 34. " ;

(ix) for Regulation 36, the following regulation shall be substituted, namely: -

"36. Maternity Leave.- ( 1 ) On and from 1st day of April , 2000, leave upto a period of 6 months at a time may be granted by way of Maternity Leave including in respect ofpost-natal period or at the time of miscarriage or abortion or medical termination of pregnancy:

Provided that not more than 12 months of such leave shall be available during the entire period of service of the officer .

(2) Leave may also be granted once during service to a childless female employce for legally adopting a child which is below one year of age till it reaches the age of one year , subject to a maximum period of two months on the following terms and conditions : -

(1 ) Leave will be granted for adoption of only one child.

(ii ) The adoption of a child should be through a proper legal process and the employee should produce the adoption deed to the Bank for sanctioning such leave.";

(x) in regulation 41 , for sub-regulation (4) , the following shall be substituted, namely: - "(4)(a) Halting Allowance. On and from Ist day of June , 2001 an officer in the Grades/Scales set out in column 1 of the Table below shall be entitled to 7634

Provided that where the total period ofabsence is less than 8 hours but more than 4 hours , Halting Allowance at half the above rates shall be payable .

Explanation :

Forthe purpose of computing Halting allowance ' per diem' shall mean each period of 24 hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel and the scheduled time of departure in other cases , to the actual time of arrival . Where the total period of absence is less than 24 hours ' per diem' shall mean a period of not less than 8 hours .

(b) Lodging Expenses . An officer in the Grades /Scales set out in column 1 of the Table below may be reimbursed the actual hotel expenses , restrictingto single room accommodation charges in ITDC hotels of the corresponding star category set out in column 2 below:

7635 (d) Where lodgirig is provided at bank's cost or arranged through the bank free of cost, 3/ 4th of the Halting Allowance will be admissible .

( e) Where boarding is provided at bank's cost or arranged through the bank: free of cost , ½ of the Halting Allowance will be admissible .

(1) Where lodging and boarding are provided at bank's cost or arranged through the bank free of cost , 1 / 4th of the Haltin' Allowarice will be admissible :

Provided that , in the case of an officer claiming boarding expenses on a declaration basis without production of bills for actual expenses incurred , he shall not be eligible for 1 / 4th of the Halting Allowance .

(g) A supplementary diem allowance of Rs.10 / - per day of halt outside headquarters ori inspection duty may be paid to all inspecting officers" .

(xi) in regulation 42 , for sub - regulation (2) , the following shall be substituted namely: -

"(2) On and from the 1st day of April , 1998 an officer on transfer will be reimbursed his expenses for transporting his baggage by goods train upto the following limits: -

(1) These Regulations may be called Punjab & Sind Bank Officers ' Service (Amendment) Regulations, 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Punjab & Sind Bank Officers ' Service Regulations, 1982 for regulation 38 after second proviso , the following proviso shall be inserted, namely: -

"Provided also that where an officer leaves or discontinues his services by resignation on or after 1 April, 2001 after giving due notice under sub-regulation 2 of Regulation 20, he may be paid a sum equivalent to the emoluments in respect of the privilege leave to the extent of half of such leave to his credit on the date of cessation of service , subject to maximum of 120 days".

2. In the Screening Test Regulations, 2002, for regulation 10, the following regulation shall be substituted, namely: -

" 10. A candidate shall have to pass all the three papers in the same attempt. However there shall not be any restriction on the number of attempts to appear inthe test . "
