सा.का.नि. 264.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रधान मंत्री कार्यालय , लेखाकार भर्ती नियम, 1991 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , प्रधान मंत्री कार्यालय में लेखाकार के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: - 1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम प्रधान मंत्री कार्यालय, लेखाकार ( समूह " ख " ) भर्ती नियम , 2003 है।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान. अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट है । उक्त पद की संख्या, उसका वर्गीकरण और उसका बेतनमान वह होगा , जो इससे उपाबद्ध 3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

[PART II-SEC . 3 ( i) ] उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति.-इन नियमों की कोई बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ii ) केन्द्रीय सचिवालय लिपिक सेवा के ऐसे उच्च श्रेणी लिपिक जिन्होंने उस श्रेणी में आठ वर्ष नियमित सेवा की है; और
(ख) जिन्होंने सचिवालय प्रशिक्षण और प्रबन्धन संस्थान में रोकड़ और लेखा कार्य में प्रशिक्षण या समतुल्य प्राप्त किया है और जिनके पास रोकड़, लेखा और बजट कार्य करने का तीन वर्ष का अनुभव है , जिसके न हो सकने पर, [ भाग II- खण्ड 3 (i) ]

केन्द्रीय सरकार के अधीन ऐसे अधिकारी:-
(i ) मूलकाडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या
(ii ) जिन्होंने मूलकाडर/ विभाग में 5000-150-8000 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष सेवा की है , या
( iii ) जिन्होंने मूलकाडर/विभाग में 4500-7000 रु. के या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष सेवा की है; और
(ख) जिन्होंने सचिवालय प्रशिक्षण तथा प्रबन्ध संस्थान में रोकड़ और लेखा कार्य में प्रशिक्षण या समतुल्य प्राप्त किया है और जिनके पास रोकड़ लेखा और बजट संबंधी कार्य करने का तीन वर्ष का अनुभव है , या जो केन्द्रीय सरकार के किसी संगठित लेखा विभाग द्वारा संचालित अधीनस्थ लेखा सेवा या समतुल्य परीक्षा उत्तीर्ण हैं ।
( प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी।
प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

G.S.R. 264. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Prime Minister's Office . Accountant Recruitment Rules . 1991 , except as respects things done or on itted to be done before such supersession . the President hereby makes the following rules regulating the method of recreatment to the post of Accountant in the Prime Minister's Office , namely:--
1. Short title and commencement .-( 1 ) These rules may be called : the Prime Minister's Office , Accountant (Group B ) Recruitment Rules . 2003
( 2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification , and scale of pay . The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to there rules .
3. Method of recruitment , age limit , qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shali be as specified in columns 5 to 14 of the said Schedule.
4. Disqualification . No person.-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who. having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said posts :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving .--Nothing in these rules shall affect reservations , relaxation age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

(b) who have undergone training in cash and accounts work in the Institute of Secretariat Training and Management or equivalent and possesses three years ' experience of cash , accounts and budget work; or, a pass in the Subordinate Accounts Service or equivalent examination conducted by any or the organised Accounts Department ofthe Central Government .
(Period ofdeputation including period of deputation in another ex- cadre post held immediately preceeding this appointment in the same or some other organisation/ Department of the central Government shall ordinarily not to exceed three years . The maximum age limit for appointment by transfer deputation shall be not exceeding 56 years as on the closing date of receipt of applications. )

(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Schedule to the Lal Bahadur Shastri National Academy of Administration Electrician Recruitment Rules , 2001, under column 11 , for the figures, sign and words " 100 % by direct recruitment through the regional Employment Exchange", the following shall be substituted , namely:-

सा. का. नि. 266. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी विधि के प्रोफेसर भर्ती नियमावली, 1986 के अधिक्रमण में, उन बातों के सिवाय जिन्हें इस अधिक्रमण से पूर्व किया मया है या करने कालोप किया गया है, राष्ट्रपति एतद्वारा कार्मिक, लोक- शिकायत तथा पेंशन मंत्रालय, कार्मिक और प्रशिक्षण विभाग , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी मसूरी में विधि के प्रोफेसर के पद की भर्ती की पद्धति को विनियमित करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्: - 1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का नाम कार्मिक, लोक- शिकायत तथा पेंशन मंत्रालय, कार्मिक और प्रशिक्षण विभाग, लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी विधि के प्रोफेसर, समूह " क " भर्तीनियमावली , 2003 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पदों की संख्या, वर्गीकरण तथा वेतनमान - उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतनमान इन नियमों के साथ संलग्न उक्त अनुसूची के कालम ( 2 ) से ( 4 ) तक में निर्दिष्ट किए के अनुसार होंगे ।
3. भर्ती की पद्धति , आयु- सीमा , तथा अन्य अर्हताएं. - भर्ती की पद्धति, आयु सीमा, तथा अन्य अर्हताएं और उक्त पदों से संबंधित अन्य बातें उक्त अनुसूची में कालम ( 5 ) से ( 14 ) तक में निर्दिष्ट किए के अनुसार होंगी ।
4. निरर्हताएं. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है उक्त सेवा में नियुक्ति के लिए पात्र नहीं होगा:
परन्तु यदिकेन्द्रीय सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. नियम शिथिल करने की शक्ति जहां केन्द्र। य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है , वहां वह, उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों से किसी उपबंध को किसी वर्ग या प्रवर्ग के यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों में किया गया कोई भी प्रावधान ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगा जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारो किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टिप्पणी :
आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त होने की अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो विहित की गई है ) । असम, मेघालय , अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ) ।

8. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक तथा अन्य अर्हताएं 1. ( i ) किसी मान्यता प्राप्त विश्वविद्यालय से विधि में मास्टर डिग्री अथवा इसके समकक्ष,
(ii ) प्रशिक्षण प्रदान अथवा अध्यापन अथवा विधिक कार्यों में अनुसंधान अथवा प्रशासन अथवा न्यायिक सेवा में दस वर्ष का अनुभव अथवा बार में अधिवक्ता के रूप में दस वर्ष का व्यावहारिक अनुभव जिसमें तीन वर्ष किसी उच्च न्यायालय में वरिष्ठ अधिवक्ताके रूप में होने चाहिए ।

2 ( i ) किसी मान्यताप्राप्त विश्वविद्यालय की विधि में डिग्री अथवा इसके समकक्ष;
( ii ) किसी राज्य न्यायिक सेवा में बारह वर्ष का अनुभव जिसमें पांच वर्ष अपर जिला न्यायाधीश और सेशन न्यायाधीश अथवा उससे ऊपर के स्तर पर होने चाहिए ।

बार में बारह वर्ष का व्यावहारिक अनुभव जिसमें पांच वर्ष किसी उच्च न्यायालय में वरिष्ठ अधिवक्ताके रूप में होने चाहिए ।

प्रशिक्षण प्रदान करने अथवा अध्यापन अथवा विधिक कार्यों में अनुसंधान अथवा प्रशासन में बारह वर्ष का अनुभव ।

9. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु तथा शैक्षिक अर्हताएं, पदोन्नत व्यक्तियों के संबंध में लागू होंगी या नहीं

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in 6, suppression ofthe Lal Bahadur Shastri National Academy of Administration , Professor of Law Recruitment Rule except as respects things done or omitted to be done before such supersession , the President hereby makes the fowing rules regulating the method of recruitment to the post of Professor of Law in the Ministry of Personnel , Public ances and Pensions, Department of Personnel and Training , the Lal Bahadur Shastri National Academy of Adm ation, Mussoorie , namely :-
1. Short title and commencement .( i) These rules may be called , the Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training . the Lal Bahadur Shastri National Academy of Administration , Professor of Law Group'A ' Post Recruitment Rules , 2003.
(ii) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , classification and scale of pay . The number of posts , its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .
3. Method of recruitment , age limit and other qualifications . The method of recruitment age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .
4. Disqualification . No person.-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living , has entered into or contracted a niarriage with any person ,
shall be eligible for appointment to the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay , by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit, and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 267.-केन्द्रीय सरकार, राज्य वित्तीय निगम अधिनियम, 1951 ( 1951 का 83 ) की धारा 5 की उपधारा ( 5 ) और धारा 48 ख द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ:-( 1 ) इन नियमों का संक्षिप्त नाम राज्य वित्तीय निगम ( केन्द्रीय सरकार को अपील ) नियम, 2003 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो-
( क) " अधिनियम" से राज्य वित्तीय निगम अधिनियम, 1951 ( 1951 का 63 ) अभिप्रेत है;
( ख ) " अपीलार्थी " से अधिनियम की धारा 5 की उप- धारा ( 4 ) के अधीन किए गए बोर्ड के इंकार के आदेश के विरुद्ध व्यथित और अधिनियम की धारा 5 ( 5 ) के निबंधनों के अनुसार अपील करने वाला कोई व्यक्ति अभिप्रेत है;
( ग ) " प्राधिकृत प्रतिनिधि" से अपीलार्थी या बोर्ड या अपील के कोई अन्य पक्षकार द्वारा , केन्द्रीय सरकार के समक्ष क्रमशः उनकी ओर से यथास्थिति उपसंजात होने,
अभिवाक् करने और कार्य करने , या अपील या जवाब या कोई सूचना या दस्तावेज फाइल करने के लिए सम्यक् रूप से प्राधिकृत व्यक्ति अभिप्रेत है;
( घ ) " प्ररूप " से इससे संलग्न प्ररूप अभिप्रेत है;
(ङ) " पक्षकार " से अपीलार्थी, या अपील का कोई अन्य विरोधी पक्षकार जिसके अंतर्गत बोर्ड, या कोई अन्य व्यक्ति जो अपील में अन्यथा विरोधी पक्षकार है अभिप्रेत है , और जिसके अंतर्गत क्रमशः उनका प्राधिकृत प्रतिनिधि भी है;
( च) इन नियमों में प्रयुक्त सभी अन्य पदों के, जो परिभाषित नहीं है, किन्तु अधिनियम में परिभाषित हैं वही अर्थ होंगे जो उनके क्रमशः अधिनियम में हैं ।
3. अपील फाइल करने के लिए प्रक्रिया. ( 1 ) अधिनियम की धारा 5 की उपधारा ( 5 ) के अधीन प्रत्येक अपील अपीलार्थी या उसके प्राधिकृत प्रतिनिधि द्वारा केन्द्रीय सरकार को जहां तक संभव हो प्ररूप में की जाएगी ।
(2) उपनियम ( 1 ) के अधीन अपील केन्द्रीय सरकार को उस तारीख को की गई समझी जाएगी जिसको वह आर्थिक कार्य की बाबत विभाग में भारत सरकार के सचिव के कार्यालय नई दिल्ली में प्राप्त होती है ।
4. समय जिसके भीतर अपील की जानी है-अपील अधिनियम की धारा 5 की उपधारा (4 ) के अधीन किए गए बोर्ड के इंकार के आदेश की प्राप्ति की तारीख से तीस दिन की अवधि के भीतर अपीलार्थी द्वारा की जाएगी ;
परंतु यह है कि केन्द्रीय सरकार तीस दिन की उक्त अवधि की समाप्ति के पश्चात् अपील पर ग्रहण कर सकेगी यदि अभिलेख पर उपलब्ध विश्वासप्रद ऐसी सामग्री के आधार पर उसका यह समाधान हो जाता है कि उस अवधि के भीतर अपील न करने के लिए पर्याप्त कारण था । 5. फीस का संदाय. ( 1 ) अपील के प्रत्येक ज्ञापन के साथ 500 रुपए की फीस होगी ।
( 2) फीस की रकम भुगतान और लेखा अधिकारी ( बैंकिंग ) के पक्ष में आहरित एक बैंक ड्राफ्ट के माध्यम से भारतीय स्टेट बैंक की संसद मार्ग शाखा, नई दिल्ली में निम्नलिखित मुख्य शीर्ष के अधीन जमा की जाएगी

6. अपील कीविषय वस्तु. ( 1 ) नियम 3 के अधीन फाइल की गई प्रत्येक अपील अंग्रेजी या हिंदी में लिखी जाएगी जिसके साथ बोर्ड के इंकार के उस ओदश की, जिसके विरुद्ध अपील की गई है प्रमाणित प्रति और प्राधिकृत प्रतिनिधि का प्राधिकार होगा और संक्षिप्त रूप में, सुस्पष्ट शोर्पकोंके अधीन अपील के आधार दिए जाएंगे जो क्रम से संख्याकिंत होंगे और उसके समर्थक दस्तावेज या उपाबंधों के साथ अपील का संपूर्ण ज्ञापन सम्यक शपथ पत्र पर होगा और अपील के अन्य पक्षकार को अपील की प्रति तामील की जाएगी और अपील के ज्ञापन के साथ उसकी अभिस्वीकृति फाइल की जाएगी । [ भाग II- खण्ड 3 (i ) ]

(2 ) कोई अपील , निर्देश , आवेदन , अभ्यावेदन, दस्तावेज या अन्य विषय जो अंग्रेजी या हिंदी से भिन्न किसी भाषा में होंगे केन्द्रीय सरकार द्वारा तब तक स्वीकृत नहीं किए जाएंगे जब तक अंग्रेजी या हिंदी में उसका प्रमाणित सही अनुवाद उसके साथ नहीं लगा होगा ।
7. सूचना या दस्तावेजों का दिया जाना.-केन्द्रीय सरकार अपील पर विचार करते समय अपील के किसी पक्षकार से जैसा वह आवश्यक समझे ऐसे समय के भीतर जो केन्द्रीय सरकार द्वारा मंजूर किया जाए, ऐसी और सूचना या दस्तावेज प्रस्तुत करने की अपेक्षा कर सकेगी ।
8. अपील की सुनवाई की तारीख और स्थान की संसूचना दिया जाना. केन्द्रीय सरकार अपील पर विचार करते समय संबद्ध पक्षकारों को अपील की सुनवाई की तारीख और स्थान संसूचित करेगी ।
9. अपील की सुनवाई.-( 1 ) केन्द्रीय सरकार अपील के पक्षकारों को सुनवाई का अवसर दिए जाने और नियत दिन को अपील की सुनवाई करने के ण्ण्चात् या किसी अन्य दिन को जिसको सुनवाई स्थगित की जाए, उस पर ऐसा आदेश पारित कर सकेगी जो न्याय का उद्देश्य पूरा करने के लिए वह ठीक समझती है ।
( 2 ) जब अपीलार्थी अपील की सुनवाई के लिए बुलाया जाता है, तब वह स्वयं या प्राधिकृत प्रतिनिधि के माध्यम से उपसंजात नहीं होता है तो केन्द्रीय सरकार अपील को या तो व्यतिक्रम के लिए खारिज कर सकेगी या एकपक्षीय रूप से गुणागुण के आधार पर अपील का निपटान कर सकेगी:
परंतु यह है कि यदि अपीलार्थी आवेदन पर केन्द्रीय सरकार का यह समाधान कर देता है कि उसके उपसंजात न होने का पर्याप्त कारण था, जब अपील की सुनवाई के लिए उसे बुलाया गया था , केन्द्रीय सरकार एकपक्षीय आदेश को अपास्त करने का आदेश कर देगी और अपील को प्रत्यावर्तित कर देगी ।
(3) उपनियम ( 1 ) और ( 2 ) के अधीन पारित आदेश लिखित में होगा और तारीख के साथ हस्ताक्षरित होगा और पक्षकारों को संसूचित किया जाएगा ।

New Delhi , the 17th July, 2003
G.S.R. 267. In exercise of the powers conferred by Sub- section ( 5 ) of Section 5 and Section 48B of the State Financial Corporations Act , 1951 (63 of 1951 ) , the Central Government hereby makes the following rules , namely:-
1. Short title and commencement.- ( 1 ) These rules may be called the State Financial Corporations ( Appeal to the Central Government) Rules, 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2.
Definitions . --In these rules , unless the context otherwise requires ,
(a) "Act" means the State Financial Corporations Act, 1951 (63 of 1951 );
(b) " appellant " means any person aggrieved against the order of refusal of the Board made under Sub - section (4) of Section 5 of the Act and preferring appeal in terms of Section 5 (5 ) of the Act ;
(c) "Authorized representative " means a person duly authorised by the appellant or the Board or any other party to the appeal to appear , plead and act, or to file the appeal or reply or any information or document , as the case may be, on their respective behalf before the Central Government ;

(d) " Form" means a form appended hereto;
(e) " party " means the appellant , or any other opposite party to the appeal including the Board, or any other person who is otherwise opposite party to the appeal , and includes their respective authorised representa- tive;
(f) All other expressions used but not defined in these rules , but defined in the Act shall have the meanings respectively assigned to them in the Act .
3.Procedure for filing appeal .-( 1 ) Every appeal under sub - section (5 ) of Section 5 of the Act shall be preferred by the appellant or his authorised representative to the Central Government as nearly as possible in Form .
(2) An appeal under sub -rule ( 1 ) shall be deemed to have been preferred to the Central Government on the date on which it is received in the office of the Secretary to the Government of India in the department dealing with Economic Affairs , New Delhi .
4. Time within which appeal is to be preferred .- An appeal shall be preferred by the appellant within a period of thirty days from the date of receipt of the order of refusal of the Board made under sub - section (4 ) of Section 5 of the Act:
Provided that the Central Government may entertain an appeal after the expiry of the said period of thirty days if itissatisfied, based on such cogent materials on record, that there was sufficient cause for not preferring appeal within that period.
5. Payment of fees . ( 1 ) Every memorandum of appcal shall be accompanied by a fee of Rs.500/- .
(2) The amount of fees shall be deposited by means of a Bank Draft drawn in favour of Pay & Accounts Officer (Banking) and deposited with State Bank of India, Parliament Street , New Delhi under the Major Head:

6. Contents of appeal . -( 1 ) Every appeal filed under Rule 3 shall be written in English or Hindi accompanied by the certified copy of the order of refusal of the Board appealed against and authority ofthe authorised representative and shall set forth concisely, under distinct heads , the grounds of appcal which shall be numbered consecutively and whole memo- randum of appeal along with supporting documents or annexures thereof shall be on due affidavit and copy of the appeal shall be served on the other party to the appeal and acknowledgement thereof filed with the memorandum of appeal .
(2) No appeal , reference , application, representation , document or other matters contained in any language other than English or Hindi shall be accepted by the Central Government , unless the same is accompanied by a certified true translation thereof in English or Hindi.
7. Furnishing of information or documents .- The Central Government may, while considering the appeal ,require any party to the appeal , to furnish such further information and documents , as it considers necessary within such time as may be granted by the Central Government .
8. Date and place of hearing of appeal to be communicated. The Central Government shall communicate , while considering the appeal , to the parties concerned , the date and place of the hearing of the appeal .
9. Hearing of appeal . - ( 1 ) The Central Government may, after giving the parties to the appeal , an opportunity of being heard and, hearing the appeal on the day fixed or any other day to which the hearing may be adjourned, pass such orders thereon as it thinks fit to meet the ends ofjustice .
(2) In case the appellant does not appear in person or through an authorised representative when the appeal is called for hearing, the Central Government may either dismiss the appeal for default or dispose of the appeal on merits ex-parte:
Provided that if the appellant on an application satisfies the Central Government that there was sufficient cause for his non - appearance , when the appeal was called for hearing, the Central Government shall make an order setting aside the ex-parte order and restore the appeal .
(3) The order passed under sub -rules ( 1 ) and (2 ) shall be in writing and shall be signed and dated and shall be communicated to the parties .

सा.का.नि. 268.- केन्द्रीय सरकार, भारतीय लघु उद्योग विकास बैंक अधिनियम, 1989 ( 1989 का 39 ) की धारा 20 घ की उपधारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात्: -
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त भारतीय लघु उद्योग विकास बैंक ( केन्द्रीय सरकार को अपील ) नियम, 2003 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं.-इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,- 1741 [ भाग II- खण्ड 3 (i) ]

(क) " अधिनियम " से भारतीय लघु उद्योग विकास बैंक अधिनियम, 1989 ( 1989 का 39 ) अभिप्रेत है;
(ख) " प्राधिकृत प्रतिनिधि " से-
( i ) अपीलार्थी के संबंध में अपीलार्थी द्वारा उसकी ओर से केन्द्रीय सरकार को कोई अपील उपस्थित करने के लिए सम्यक् रूप से प्राधिकृत कोई व्यक्तिअभिप्रेत है;
( ii ) बोर्ड के संबंध में, बोर्ड द्वारा , बोर्ड की ओर से संकल्प द्वारा इन नियमों के अधीन किसी अपील में प्राधिकृत प्रतिनिधि के रूप में उपसंजात होने, अभिवाक करने और कार्य करने के लिए सम्यक् रूप में नियुक्त कोई व्यक्ति अभिप्रेत है;
( iii ) अपील के किसी अन्य पक्षकार के संबंध में, ऐसे पक्षकार द्वारा उसकी ओर से उपसंजात होने, अभिवाक करने और कार्य करने के लिए सम्यक् रूप से प्राधिकृत कोई व्यक्तिअभिप्रेत है;
(ग) " बोर्ड" से अधिनियम की धारा 3 की उपधारा ( 1 ) के अधीन गठित लघु उद्योग बैंक का निदेशक बोर्ड अभिप्रेत है;
(घ) " लघु उद्योग बैंक " से अधिनियम की धारा 3 के अधीन स्थापित भारतीय लघु उद्योग विकास बैंक अभिप्रेत है;
(ङ) " प्ररूप " से इन नियमों से संलग्न प्ररूप अभिप्रेत है;
(च ) " पक्षकार " से कोई ऐसा व्यक्ति जो केन्द्रीय सरकार के समक्ष कोई अपील फाइल करता है , और प्रत्यर्थी अभिप्रेत है;
(छ) " नियम " से अधिनियम के अधीन बनाए गए नियम अभिप्रेत हैं ;
(ज ) अन्य पदों के, जिन्हें यहां परिभाषित नहीं किया गया है, वही अर्थ होंगे जो उनके क्रमशः अधिनियम में हैं ।
3. अपील का प्ररूप. अधिनियम की धारा 20घ की उपधारा ( 3 ) के अधीन प्रत्येक अपील अधिनियम की धारा 20 घ की उपधारा ( 2) के अधीन किए गए बोर्ड के इंकार आदेश से व्यथित व्यक्ति द्वारा केन्द्रीय सरकार को की जाएगी ।
4. वह अवधिजिसके भीतर अपील की जानी है . ( 1 ) किसी व्यथित व्यक्ति द्वास कोई अपील अधिनियम की धारा 20घ की उपधारा (2 ) के अधीन किए गए बोर्ड के इंकार आदेश के उसको संसूचित किए जाने की तारीख से तीस दिन की अवधि के भीतर कौ जाएगी । (2) जब उपनियम ( 1 ) में विनिर्दिष्ट तीस दिन की अवधि के अवसान के पश्चात् कोई अपील की जाती है , इसके साथ किसी शपथ पत्र से समर्थित जिसमें वे तथ्य जिन पर अपीलार्थी निर्भर करता है केन्द्रीय सरकार का यह समाधन करते हुए कि उसके पास उक्त तीस दिन की अवधि के भीतर अपील न किए जाने के पर्याप्त कारण थे , एक आवेदन लगा होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि अपीलार्थी के पास पूर्वोक्त अवधि के भीतर अपील न किए जाने के पर्याप्त कारण हैं, वह लेखबद्ध किए जाने वाले कारणों से, पूर्वोक्त अवधि के अवसान के पश्चात् किन्तु उसे बोर्ड का इंकार आदेश संसूचित किए जाने की तारीख से पैंतालीस दिन की अवधि के अवसान के पूर्व अपील ग्रहण कर सकेगी ।
1 ) अपील के प्रत्येक ज्ञापन के साथ 500 रू. की फीस होगी ।
5. फीस का संदाय. (
(2 ) फीस की रकम भुगतान और लेखा अधिकारी ( बैंकिंग ) के पक्ष में आहरित एक बैंक ड्राफ्ट के माध्यम से भारतीय स्टेट बैंक की संसद मार्ग शाखा, नई दिल्ली में निम्नलिखित मुख्य शीर्ष के अधीन जमा की जाएगीः-
" 0070- अन्य प्रशासनिक सेवाएं"
" 502- सेवा एवं सेवा शुल्क"
6. अपील कीविषय वस्तु. ( 1 ) नियम 3 के अधीन फाइल की गई प्रत्येक अपील अंग्रेजी या हिंदी में लिखी जाएगी और सुभिन्न शीर्षों के अधीन संक्षिप्ततः अपील के आधार दिए जाएंगे जिन्हें क्रमशः संख्यांकित किया जाएगा ।
(2 ) प्रत्येक अपील प्ररूप में दो प्रतियों में फाइल की जाएगी और उसके साथ बोर्ड के इंकार किए जाने के उस आदेश की एक सत्यापित प्रति, जिसके विरूद्ध अपील की गई है, शपथ पत्र और अपील के आधारों के समर्थन में अन्य दस्तावेज होंगे ।
7. प्रतिनिधित्व करने का अधिकार. ( 1 ) अपीलार्थी औरअपील का प्रत्येक अन्य पक्षकार केन्द्रीय सरकार के समक्ष व्यक्तिगत रूप सेया अपने प्राधिकृत प्रतिनिधियों के माध्यम से उपसंजात हो सकेंगे ।
प्रतिनिधि के माध्यम से किया जाएगा ।
(2) केन्द्रीय सरकार के समक्ष बोर्ड का प्रतिनिधित्व उसके प्राधिकृत
(3) अपील की सुनवाई आरम्भ होनें से पूर्व किसी व्यक्ति को किसी प्राधिकृत प्रतिनिधि के रूप में कार्य करने के लिए सशक्त बनाते हुए प्राधिकार केन्द्रीय सरकार के पास फाइल किया जाएगा ।
8. अपील फाइल करने की प्रक्रिया. ( 1 ) केन्द्रीय सरकार को कोई अपील, या तो अपीलार्थी द्वारा व्यक्तिगत रूप में या उसके प्राधिकृत प्रतिनिधि द्वारा की जाएगी और उसे सचिव, भारत सरकार, आर्थिक कार्य विभाग, वित्त और कम्पनी कार्य मंत्रालय, नई दिल्ली को रजिस्ट्रीकृत डाक द्वारा भेजा जाएगा । 1932 G1 /2003-3 1/42

[PART II-SEC . 3 ( i) ] ( 2) उपनियम ( 1 ) के अधीन कोई अपील केन्द्रीय सरकार को उस तारीख को की गई समझी जाएगी जिसको वह सचिव, भारत सरकार, आर्थिक कार्य विभाग , वित्त और कम्पनी कार्य मंत्रालय, नई दिल्ली के कार्यालय में प्राप्त हो जाती है ।
9. सूचना या दस्तावेजों का प्रस्तुत किया जाना. ( 1 ) केन्द्रीय सरकार, अपील पर विचार करने से पूर्व , अपील के किसी पक्षकार से ऐसी सूचना या दस्तावेज, जो आवश्यक समझे, प्रस्तुत करने की अपेक्षा कर सकेगी ।
( 2 ) पक्षकार, ऐसे आदेश से तीस दिन के भीतर या ऐसी अवधि के भीतर जो केन्द्रीय सरकार द्वारा अनुदत्त की जाए, ऐसी सूचना और दस्तावेज प्रस्तुत करेंगे ।
10. अपील की सुनवाई की तारीख और स्थान का संसूचित किया जाना.-केन्द्रीय सरकार, अपील पर विचार करने से पूर्व, संबद्ध पक्षकारों को अपील की सुनवाई की तारीख और स्थान संसूचित करेगी और बोर्ड को ऐसी संसूचना के पूर्व या उसके साथ अपील की सूचना भी भेजेगी । 11. अपील की सुनवाई. ( 1 ) नियत की गई तारीख को या किसी ऐसी अन्य तारीख को जिसको सुनवाई आस्थगित की जा सकेगी, अपीलार्थी की अपील के समर्थन में सुनवाई की जाएगी । केन्द्रीय सरकार फिर, यदि आवश्यक हो, बोर्ड के प्राधिकृत प्रतिनिधि और अपील के किसी पक्षकार की सुनवाई करेगी और उस दशा में अपीलार्थी उत्तर देने का हकदार होगा ।
(2) जब अपील की सुनवाई के लिए बुलाया गया है , अपीलार्थी व्यक्तिगत रूप से या किसी प्राधिकृत प्रतिनिधि के माध्यम से उपसंजात नहीं होता है , उस दशा में केन्द्रीय सरकार अपील को व्यतिक्रम के लिए खारिज कर सकेगी:
परन्तु यदि ऐसा अपीलार्थी या ऐसा प्राधिकृत प्रतिनिधि किसी आवेदन पर केन्द्रीय सरकार का यह समाधान कर देता है कि उसके उपसंजात न होने के पर्याप्त कारण हैं, जब अपील की सुनवाई के लिए बुलाया गया है , तब केन्द्रीय सरकार एकतरफा खारिज किए जाने को अपास्त करते हुए आदेश पारित कर सकेगी और अपील को बहाल कर सकेगी ।
12. केन्द्रीय सरकार द्वारा आदेश.- ( 1 ) केन्द्रीय सरकार, अपील की सुनवाई करने और ऐसी और जांच करने के पश्चात्, जिसे वह आवश्यक समझे , या तो अपील को खारिज कर सकेगी, या
(क) यह निदेश देते हुए कोई आदेश पारित कर सकेगी कि शेयरों का अन्तरण बोर्ड द्वारा रजिस्ट्रीकृत किया जाएगा और बोर्ड आदेश प्राप्ति के तीस दिन के भीतर ऐसे आदेश का अनुपालन करेगा; या
(ख ) लघु उद्योग बैंक के शेयर धारकों के रजिस्टर का अनुसमर्थन का निदेश देते हुए कोई आदेश पारित कर सकेगी;
( ग) अपने स्वविवेकाधिकार से, ऐसा अन्य आदेश पारित कर सकेगी जिसे वह ठीक और उचित समझे।
( 2 ) उपर्युक्त उपनियम ( 1 ) के अधीन पारित आदेश लिखित में, हस्ताक्षरित और तारीख सहित होगा और सम्बद्ध पक्षकारों को संसूचित किया जाएगा ।

(2) They shall come into force on the date of their publication in the Official Gazette.

(a) " Act" means the Small Industries Development Bank of India Act , 1989 (39 of 1989) ;
(b) " authorized representative " means-
(i) in relation to an appellant, a person duly authorized by the appellant to present an appeal on his behalf to the Central Government ;
(ii) in relation to the Board , a person duly appointed by the Board by resolution as authorized representative to appear, plead and act on behalf of the Board in any appeal under these rules ;
(iii) in relation to any other party to the appeal , a person duly authorized by such party to appear picad and act on his behalf,
(c) "Board" means the Board of Directors of the Small Industries Bank constituted under Sub -section ( 1 ) of section 3 of the Act ;
(d) "Small Industries Bank " means the small Industries Development Bank of India established under Section 3 of the Act;
(e) " Form " means the form appended to these rules ;
(f) " party " means a person who files an appeal before the Central Government and the respondent;
(g) " rules" means the rules made under the Act ;
(h) other expressions , which are not defined here , shall have the meaning respectively assigned to them in the Act .
3. Form of Appeal :-Every appeal under Sub - section ( 3 ) of Section 20D of the Act shall be preferred by any person aggrieved by an Order of refusal of the Board made under Sub - section (2 ) of Section ( 2) of Section 20D to the Cen Government in the Form,
4. Time within which appeal is to be preferred.-( 1 ) An appeal shall be preferred by the aggrieved person within a period of thirty days from the date of communication to him of the order of refusal of the Board made under subsc (2) of section 20D of the Act .

(2) When the appeal is preferred after the expiry of the period of thirty days specified in sub - rule ( 1 ) , it shall be accompanied by an application supported by an affidavit setting forth the facts on which the appellant relies to satisfy the Central Government that he had sufficient cause for not preferring the appeal within the said period of thirty days ;
Provided that ifthe Central Government is satisfied that the appellant had sufficient cause for not preferring the appeal within the aforesaid period , it may, for reasons to be recorded in writing , admit the appeal after the expiry of the aforesaid period but before the expiry of forty five days from the date of communication to him of the order of refusal of the Board.
Payment of fees. ( 1 ) Every memorandum of appeal shall be accompanied by a fee of Rs . 500/ - 5.
(2) The amount of fees shall be deposited through a Bank Draft drawn in favour of Pay & Accounts Officer (Banking) and deposited with the State Bank of India, Parliament Street , New Delhi under the Major head- "0070 "-Other administrative services"

(2) Every appeal shall be filed in the Form in duplicate and shall be accompanied by a certified copy of the order of refusal of the Board appealed against , affidavit and other documents to support the grounds of appeal .
7. Right to representation. ( 1 ) An appellant and every other party to the appeal may appear before the Central Government in person or through their authorized representatives ..
(2) The Board shall be represented before the Central Government through its authorized representative .
(3 ) Authorisation empowering a person to act as an authorized representative shall be filed with the Central Government before the commencement of the hearing ofthe appeal .
8. Procedure for filing appeal. ( 1 ) An appeal shall be preferred either by the appellant in person or his autho- rized representative to the Central Government and the same shall be addressed to the Secretary to the Government of India, Department of Economic Affairs , Ministry of Finance and Company Affairs, New Delhi by registered post.
(2) An appeal under sub -rule ( 1 ) shall be deemed to have been preferred to the Central Government on the date on which it is received in the office of the Secretary to the Government of India, Department of Economic Affairs, Ministry of Finance and Company Affairs , New Delhi .

9. Furnishing of information or documents . ( 1 ) The Central Government may, before considering the appeal , require any party to the appeal , to furnish such further information and documents as it considers necessary.
(2) The parties shall furnish such information and documents within thirty days of such order or such further period as may be granted by the Central Government.
10. Date and place of hearing of appeal to be communicated. The Central Government shall communicate , before considering the appeal , to the parties concerned, the date and place of the hearing of the appeal and shall also send a notice ofthe appeal to the Board either before or with such communication.
11. Hearing of appeal. ( 1 ) On the days fixed or on any other day to which the hearing may be adjourned , the appellant shall be heard in support of the appeal. The Central Government shall then, if necessary, hear the authorized representative of the Board and any other party to the appeal and in such case the appellant shall be entitled to reply.
(2) In case the appellant does not appear in person or through an authorized representative when the appeal is called for hearing , Central Government may dismiss the appeal for default:
Provided that if such appellant or such authorized representative on an application satisfy the Central Government that there was sufficient cause for his non - appearance , when the appeal was called for hearing, the Central Government may make an order setting aside the ex - parte dismissal and restore the appeal .

12. Orders by the Central Government . ( 1 ) The Central Government may after considering the appeal and making such further enquiry as it considers necessary, either dismiss the appeal ; or

सा. का. नि. 269. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और दिल्ली दुग्ध योजना, हिन्दी अधिकारी ( समूह " ख " पद ) भर्ती नियम , 1994 को उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , कृषि मंत्रालय , पशुपालन और डेयरी विभाग के अधीन दिल्ली दुग्ध योजना में हिन्दी अधिकारी के पद पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम दिल्ली दुग्ध योजना, हिन्दी अधिकारी ( समूह " ख " ) भर्ती नियम, 2003है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता.- वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

सकने पर हिन्दी अनुवादक तथा कनिष्ठ हिन्दी अनुवादक के रूप में मिलाकर छः वर्ष नियमित सेवा की है के संबंध में भी अन्य व्यक्तियों के साथ विचार किया जाएगा तथा यदि उसका उस पद पर नियुक्तिके लिए चयन हो जाता है तो यह पद प्रोन्नति द्वारा भरा जाएगा ।
पोषक प्रवर्ग केऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।
प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु- सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Delhi Milk Scheme, Hindi Officer (Group ' B ' post ) Recruitment Rules , 1994, except as respect things done or omitted to be done before such supersession , the president hereby makes the following rules regulating the method of recruitment to the post of Hindi Officer in Delhi Milk Scheme under the Department of Animal Husbandry and Dairying inthe Minisry of Agriculture , namely:
1. Short title and commencement . ( i ) These rules may be called , the Delhi Milk Scheme, Hindi Officer (Group 'B' post) Recruitment Rules , 2003 .
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to this rulers .
3. Method of recruitment , age limit , qualifications . The method of recruitment to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule .
4. Disqualification .-No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes and Other Backward Classes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. Short title and commencement .-( 1 ) These rules may be called the Grant of Loans to Licensed Salt Manufacturers ' (Repeal) Rules , 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Repeal . The grants of loans to Licensed Salt Manufacturers ; Rules , 1990 are hereby repealed .
3. Saving. Notwithstanding such repeal , the Central Government shall have the right to recover the full amount of the Loan or unpaid balance thereof together with interest accrued on such loan as per the terms and conditions of the loansanctioned or granted under the repealed rules .

G.S.R. 271. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession ofthe Ministry of Water Resources , Central Soil and Materials Research Station, New Delhi , Group ' C' , non- Ministerial Recruitment Rules , 1988 and Central Soil and Materials Research Station, New Delhi (Ancillary Services ) Recruitment Rules , 1984 , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Laboratory Helper Grade I, Laboratory Helper Grade II and Laboratory Helper Grade III in the Central Soil and Materials Research Station, New Delhi , under the Ministry of Water Resources , namely :-
1. Short title and commencement .-( 1 ) These rules may be called, the Central Soil and Materials Research Station , New Delhi , (Laboratory Helpers ) Recruitment Rules , 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts , classification and scale of pay. The number of posts , its classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the schedule annexed to these rules .
3. Method of recruitment , age limit, and other qualifications etc. The method of recruitment to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.
4. Disqualification . No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, itmay, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes, the Scheduled Tribes and Other Backward classes, the ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

[National Trade Certificate ( Industrial Training Institute) qualifiedpersons will be considered with 2 years of experience . ]
Note : The qualification regarding experience is relaxable at the discretion of the Staff Selection Commission/ Competent Authority in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selction the Staff Selection Commission/ Competent Authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely tobe available to fill up the vacancy reserved for them .

आवश्यक :
( i ) किसी मान्यता प्राप्त विश्वविद्यालय से सिविल इंजीनियरिंग में डिग्री या समतुल्य।
( ii) जल स्रोत के क्षेत्र में उसके सभी विविध पहलुओं जैसे नदी घाटी परियोजनाओं , जल संसाधन विकास , कमांड क्षेत्र विकास , बाढ़ नियंत्रण , जल और जल अपशिष्ट का प्रबंध, जल निकास, जल प्रदाय , व्ययन, कम लागत की स्वच्छता, ठोस अपशिष्ट प्रबंधन आदि में अनुसंधान/ विकास योजना/मानीटर करना और मूल्यांकन/निष्पादन का 12 वर्ष काअनुभव ।
वांछनीय:
(i ) सिविल/जल वैज्ञानिक/जल संसाधन इंजीनियरिंग/जल विज्ञान /लोक स्वास्थ्यइंजीनियरिंग में मास्टर डिग्री । ( ii ) आलोचनात्मक समीक्षा/रिपोर्ट आंकन/अनुसंधान रिपोर्ट आदि को तैयार करने आदि का अनुभव, प्रकाशनों द्वारा साक्ष्यदिया गया हो। "
(ii) क्रम संख्यांक 14 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-
" 14. संयुक्त सलाहकार ( ग्रामोद्योग और लघु उद्योग ) :
आवश्यक :
( i ) किसी मान्यता प्राप्त विश्वविद्यालय से इंजीनियरिंग या प्रौद्यौगिकी में डिग्री या समतुल्य या भौतिकी रसायन/कारोबार प्रशासन में मास्टर डिग्री ।
( ii) उद्योग/औद्योगिक विकास/लघु उद्योग/ग्रामोद्योग और लघु उद्योग के क्षेत्र में राष्ट्रीय स्तर की योजना/विकास/संप्रवर्तन/ निष्पादन के क्षेत्र में 12 वर्ष का अनुभव ।
वांछनीय:
(i) विज्ञान के सुसंगत क्षेत्र में डाक्टरेट की डिग्री या इंजीनियरिंग में मास्टर डिग्री ।
(ii) विकास/ग्राम संप्रवर्तन और लघु उद्योग का अनुभव ।
(iii ) विकास/ग्राम संप्रवर्तन और लघु उद्योग के संबंध में सरकारी नीतियों/विनियमनों की जानकारी ।
( iv ) ग्रामोद्योग और लघु उद्योग के अन्य क्षेत्रों जैसे उद्योगों का खंड और औद्योगिक क्षेत्र आदि के साथ उसकी अंतरापृष्ठ समस्याओं का ज्ञान/जानकारी या उनके संबंध में कार्यवाही करने का अनुभव ।
(v ) ग्रामोद्योग और लघु उद्योग के क्षेत्र में मूल्यांकन/नीतियां बनाने /परियोजना/कार्यक्रम/स्कीम/दस्तावेज योजना का अनुभव।"
(iii) क्रम संख्यांक 16 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: - " 16. संयुक्त सलाहकार ( पर्यावरण और वन ) :
आवश्यक:
( i ) किसी मान्यता प्राप्त विश्वविद्यालय से पर्यावरणीय विज्ञान/कार्बनिक रसायन/ भौतिकी/जीवविज्ञान में मास्टर डिग्री या रसायनिक इंजीनियरिंग/सिविल इंजीनियरिंग/यांत्रिक इंजीनियरिंग/ धातुकर्म इंजीनियरिंग में डिग्री या समतुल्य । ( ii ) पर्यावरण प्रबंधन, योजना प्रक्रिया, कार्यक्रमों की योजना बनाने और विशिष्ट नीतियों के अभिदर्शन या संबंधित अनुसंधान कार्य के क्षेत्र में 12 वर्ष का अनुभव ।
वांछनीय:
किसी मान्यता प्राप्त विश्वविद्यालय या संस्थान से पर्यावरणीय विज्ञान, कार्बनिक रसायनिक, भौतिक, जीवविज्ञान में डाक्टरेट या पर्यावरणीय इंजीनियरिंग , रसायनिक इंजीनियरिंग , सिविल इंजीनियरिंग , धातुकर्म इंजीनियरिक स्नातकोत्तर डिग्री या कारबार प्रशासन में मास्टर डिग्री या पर्यावरणीय, वन विज्ञान या वन जीव प्रबंधन में स्नातकोत्तर डिप्लोमा । "

G.S.R. 272. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Planning Commission ( Joint Adviser ) Recruitment Rules , 2000 , namely :-
1. ( 1 ) These rules may be called, the Planning Commission ( Joint Adviser ) Recruitment (Amendment ) Rules , 2003.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Planning Commission (Joint Adviser ) Recruitment Rules, 2000,
(a) in column 1, for the entry, the following entry shall be substituted , namely :-

(i) Master's Degree in Civil/Hydraulic/ Water Resources Engineering/Hydrology /Public Health Engineering.
(ii) Experience of preparing critial reviews , appraisal reports , research reports , etc. as evidenced by publications ." ;

" 14. JOINT ADVISER (VILLAGE AND SMALL INDUSTRIES) :
Essential:
(i) Degree in Engineering or Technology from a recognised University or equivalent , or Master's Degree in Physics/Chemistry/Business Administration .
(ii ) Twelve years ' experience in planning at national level /development/ promotion/ execution in the area ofindustry/ industrial development/small scale industries /village and small industries sectors .
Desirable :
(i) Dectorate Degree in the relevant areas of science or Master's Degree in Engineering .
(ii ) Experience of developing/promotion of village and small industries.
(iii) Knowledge of government policies/regulations in regard to development/promotion of village and small industries.
(iv) Knowledge/awareness or experience in dealing with problems of village and small industries and its interface with other segments of industires/industrial sector, etc.
(v) Experience in evaluation /formulation of policies/ projects /programmes/ schemes /plan documents in the field ofVillage and Small Industries sector. " ;

Essential:

(ii) Twelve years ' experience in planning process , formulation of plan programmes and policies with particular exposure in the field of environment management or such related research work.

सा. का. नि. 273.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत के राजपत्र , भाग II , खंड 3 , उपखंड ( i ) में सा० का०नि० सं. 526 तारीख 26 जून , 1986 द्वारा प्रकाशित योजना आयोग ( मुख्य पुस्तकालयाध्यक्ष एवं प्रलेखीकरण अधिकारी ) भर्ती नियम , 1986 को उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, योजना आयोग में मुख्य पुस्तकालयाध्यक्ष एवं- प्रलेखीकरण अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त योजना आयोग ( मुख्य पुस्तकालयाध्यक्ष- एवं- प्रलेखीकरण अधिकारी ) भर्ती नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट है ।
3. भर्ती की पद्धति, आयु- सीमा और अन्यअर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति , आयु- सीमा , अर्हताएं और उससे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।
4. निरर्हता.- वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपन्नी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है , और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण है उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों के बाबत, आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति.- इन नियमों की कोई भी बात, ऐसे आरक्षण आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिसका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( iii ) किसी पुस्तकालय में बारह वर्ष का अनुभव जिसमें प्रलेखीकरण और संदर्भ सूची कार्य का अनुभव सम्मिलित है ।
टिप्पण 1 : अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।
टिप्पण 2 : अनुभव संबंधी अर्हता ( अर्हताएं) में संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायोंके अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध हाने की संभावना नहीं है ।
वांछनीय:
(i ) किसी मान्यताप्राप्त विश्वविद्यालय से पुस्तकालय विज्ञान में स्नातकोत्तर डिग्री या समतुल्य ।
( ii ) पत्रिकाओं में प्रकाशित कार्य ( साक्ष्य प्रस्तुत करना होगा ) ।
(iii ) अंग्रेजी से भिन्न किसी एक यूरोपीय भाषा का कार्य साधक ज्ञान ।
: लागू नहीं होता
9. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागूहोंगी या नहीं ।

10. परिवीक्षा की अवधि, यदि कोई हो ।
सीधे भर्ती किए जाने वाले व्यक्तियों के लिए एक वर्ष ।

संस्थाओं/विश्वविद्यालयों/लोक उपक्रम के अधीन ऐसे अधिकारी- 12. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा
(क ) ( i ) जो मूल काडर/विभाग में सदृश पद धारण किए हुए हैं ; या
(ii ) जिन्होंने मूल काडर/विभाग में रु. 10000-15200 रु. या समतुल्य वेतनमान में उस श्रेणी में नियमित आधार पर नियुक्ति के पश्चात् पांच वर्ष नियमित सेवा की है; और
(ख ) जिनके पास स्तंभ ( 8 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं । [ भाग II- खण्ड 3( i ) ]

प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति/ संविदा की अवधि है साधारणतया चार वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है) द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Planning Commission ( Chief Librarian -Cum -Documentation Officer ) Recruitment Rules , 1986 published vide G.S.R. 526 dated 26th June , 1986 in the Gazetted of India Part II Section 3 , Sub - section ( i ) , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method ofrecruitment to the post ofChief Librarian-Cum-Documentation Officer in the Planning Commission , namely:---
1. Short title and commencement- ( 1 ) These rules may be called the Planning Commission ( Chief Librarian- Cum-Documentation Officer) Recruitment Rules, 2003 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post classification and scale of pay, The number of the said post, its classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto.
3. Method of recruitment , age limit, qualifications , etc. The method of recruitment to the said post, age limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the Schedule aforesaid.
4. Disqualification .---No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shallbe eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so , doing exempt any person from the operation of this rule.

Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission , relax any of the provisions of these rules in respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required tobe provided for candidates belonging to the Scheduled Castes, the Scheduled Tribes , the Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा० का ० नि० 274.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय सर्वेक्षण विभाग में निदेशक ( प्रशासन और वित्त ) भर्ती नियम, 1977 को, उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, विज्ञान और प्रौद्योगिकी विभाग के अधीन भारतीय सर्वेक्षण विभाग में निदेशक ( प्रशासन और वित्त ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय सर्वेक्षण विभाग में निदेशक ( प्रशासन और वित्त ) भर्ती नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान.- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट है ।

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकारको लागू स्वीय विधि के अधीन अनुज्ञेय है , और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्तिः- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों के बाबत, आदेश द्वारा शिथिल कर सकेगी ।

G. S. R. 274.- In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of Survey of India, (Director , Administration and Finance) Recruitment Rules , 1977 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director ( Administration and Finance ) in the Survey of India under the Department of Science and Technology, namely :-
1. Short title and commencement.- ( 1 ) These rules may be called the Survey of India , Director, (Administration and Finance) Recruitment Rules, 2003 ;
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of Posts , classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Scheduled annexed to these rules .
3. Method of recruitment , age limit and other qualification. The method of recruitment age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .
4. Disqualification.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .
5.
