सा. का. नि. 290.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और समपहृत संपत्ति अपील अधिकरण ( रजिस्ट्रार भर्ती नियम, 1981 तारीख 30-1-1982 के भारत के राजपत्र , भाग II , खंड 3 , उपखंड ( 1 ) सा.का.नि. संख्यांक 98 में प्रकाशित किया गया था और समपहृत संपत्ति अपील अधिकरण ( समूह ' ख ' पदों ) भर्ती नियम, 1982 तारीख 25-12-1982 के भारत के राजपत्र , भाग II , खंड 3, उपखंड ( 1 ) मा.का.नि. संख्यांक 1000 में प्रकाशित किया गया था, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , समपहृत संपत्ति अपील अधिकरण , समूह ' क' और समूह ' ख ' के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम समपहृत संपत्ति अपील अधिकरण ( समूह ' क ' और समूह ' ख ' ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना. ये नियम इससे उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद संख्या , वर्गीकरण और वेतनमान.- उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपावद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट है ।

[PART II -SEC . 3 (i ) ] 4. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है , और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.- इन नियमों की कोइ बात, ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगो , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 290. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Appellate Tribunal for Forfeited Property (Registrar) Recruitment Rules , 1981 published vide G.S.R. No. 98 dated 30-1-1982 in the Gazette of India in Part II , Section 3 , Sub - section ( i) and Appellate Tribunal for Forfeited Property ( Group B'posts) Recruitment Rules, 1982 published vide G.S.R. No. 1000 dated 25-12-1982 in the Gazette of India in Part - II , Section 3. Sub - section ( i) except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules to regulate the method of recruitment to Group 'A' and ' B ' posts in the Appellate Tribunal for Forfeited Property , namely :-

1. Short title and commencement .( 1 ) These rules may be called the Appellate Tribunal for Forfeited Property (Group ' A' and ' B ' Posts ) Recruitment Rules, 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application . These rules shall apply to the posts specified in Column 1 of the Schedule annexed hereto .

3. Number of posts , classification and scale of pay . The number of the said posts , their classification and scales of pay attached thereto , shall be as specified in columns 2 to 4 of the said Schedule.

4. Method of recruitment , age limit, qualification , etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the Schedule aforesaid.

5. Disqualifications . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do . it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes and other special categorics of persons in accordance with the orders issued by the Central Government from time to time in this regard.

4. निरर्हता.- वह व्यक्ति, -

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्तिका पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 291. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Space ( Group ' B ' Posts) Recruitment Rules , 2000 , in so far as they relate to the post of Section Officers and Assistants , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitinent to the posts of Section Officers , Project Assistants and Assistants in the Department of Space , namely:--

1. Short title and commencement . These rules may be called the Department of Space ( Section Officers , Project Assistants and Assistants ) Recruitinent Rules , 2003.

2. Number of posts , classification and scale of pay . The number of the said posts , their classification and scales of pay attached thereto shall be as specified in colununs 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications ,etc. The method of recruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in colunuis 5 to 14 of the said Schedule .

4. Disqualification . No person , --

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may. by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex- servicemen and other special categories of persons in accordance with the Orders issued by the Central Government from time to time in this regard .

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Space ( Group ' C ' posts ) Recruitment Rules , 2000 , in so far as they relate to the post of Upper Division Clerk , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerks in the Department of Space , namely:

1. Short title and commencement .-( 1 ) These rules may be called the Department of Space (Upper Division Clerks) Recruitment Rules , 2003.

2. Number of posts , classification and scales of pay. The number of the said posts , their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit, qualificationsetc. The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who , having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts:

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

सा०का०नि० 293.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा अन्तरिक्ष विभाग ( समूह ' घ ' पद) की भर्ती नियमावली, 2000 के अधिक्रमण में, ऐसे अधिक्रमण से पहले इस संबंध में की गई अथवा छोड़ी गयी बातों को छोड़कर, अन्तरिक्ष विभाग के ( समूह ' घ ' ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम अन्तरिक्ष विभाग ( समूह ' घ ' पद ) भर्ती नियम, 2003 है । 2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि. - उक्त पदों पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता . वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा;

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

1863 (b) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा०का ०नि०.294.- मखाना श्रेणीकरण और चिह्नांकन नियम, 2003 का निम्नलिखित प्रारूप, जिसे केन्द्रीय सरकार कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है , उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको इस अधिसूचना से युक्त भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।

ऐसाकोई व्यक्ति , जो उक्त प्रारूप नियमों के संबंध में कोई सुझाव देना या आक्षेप करना चाहता है , उन्हें वह विनिर्दिष्ट अवधि के भीतर कृषि विपणन सलाहकार, भारत सरकार, विपणन और निरीक्षण निदेशालय , नया सी.जी.ओ. भवन, एनएच -4, फरीदाबाद -121001 ( हरियाणा ) को केन्द्रीय सरकार के विचार करने के लिए भेज सकेगा ।

प्रारूप नियम

1. संक्षिप्त नाम, लागू होना और प्रारंभ:-

( 1 ) इन नियमों का संक्षिप्त नाम मखाना श्रेणीकरण और चिह्नांकन नियम, 2003 है ।

( 2) ये मखाना जिसके अंतर्गत मखाना चूर्ण और तला हुआ मखाना भी है , को लागू होंगे ।

(3 ) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं- इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

( 1 ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है;

( 2) " प्राधिकृत पैकर " से ऐसा व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया के अनुसार मखाना का श्रेणीकरण और उन्हें चिह्नांकन करने के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया गया है;

(3) " प्राधिकार प्रमाणपत्र " से किसी व्यक्ति या व्यक्तियों के किसी निकाय को, मखाना का श्रेणीकरण करने और उस पर श्रेणी अभिधान चिह्न लगाने के लिए प्राधिकृत करते हुए साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के उपबंधों के अधीन जारी किया गया प्रमाणपत्र अभिप्रेत है;

( 4) " साधारण श्रेणीकरण और चिह्नांकन नियम" से समय- समय पर यथा संशोधित कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम, 1937 ( 1937 का 1 ) को धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 अभिप्रेत है;

(5 ) " श्रेणी अभिधान चिह्न " से इन नियमों के नियम 5 में निर्दिष्ट " प्रतीक चिह्न " अभिप्रेत है ;

(6 ) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है;

3. श्रेणी अभिधान:- इन नियमों के प्रयोजन के लिए श्रेणी अभिधान उन श्रेणियों के नाम होंगे जो अनुसूची 2 , 3 और 4 के स्तंभ 1 के अधीन दी गई मखाना की क्वालिटी को उपदर्शित करते हैं ।

4. क्वालिटी की परिभाषा:- इन नियमों के प्रयोजन के लिए, क्वालिटी की परिभाषा और साधारण अपेक्षाएं वे होंगी जो अनुसूची 2 के स्तंभ 2 से 11 , अनुसूची-3 के स्तंभ 2 से 9 और अनुसूची-4 के स्तंभ 2 से 8 में प्रत्येक श्रेणी अभिधान के सामने दी गई है । 5. श्रेणीअभिधान चिह्न श्रेणी अभिधान चिह्न " प्रतीक चिह्न " से बनेगा जिसमें प्राधिकार प्रमाण- पत्र संख्या " एगमार्क " शब्द, वस्तु का नाम और श्रेणी अभिधान सहित डिजाइन होगी और जो अनुसूची 1 में उपवर्णित डिजाइन के सदृश होगा ।

6. पैक करने का ढंग :-

( 1 ) मखाना जिसके अंतर्गत चूर्ण और तला हुआ मखाना भी है ऐसी रीति में पैक किया जाएगा जो उत्पाद की स्वास्थ्यकारक, पोषण संबंधी, प्रौद्योगिक और इंद्रियग्राही क्वालिटी की रक्षा करेगी,

( 2 ) पैकेजिंग सामग्री मजबूत , स्वच्छ, शुष्क, नमीसह और कीट आकीर्णन या फफूंदी संदूषण से मुक्त होगी ।

( 3 ) पैकेजिंग सामग्री ऐसे पदार्थों से बनी होगी जो उनके आशयित उपयोग के लिए सुरक्षित और उपयुक्त हों जिसके अंतर्गत नए स्वच्छ पटसन के बैग , प्लास्टिक बैग , टिन प्लेट, आधान या कोई अन्य पैकिंग सामग्री जो कृषि विपणन सलाहकार द्वारा अनुमोदित हो परंतु यह कि पैकिंग सामग्री समय - समय पर यथा संशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन यथा अनुज्ञात खाद्य श्रेणी की समाग्री से विनिर्मित होगी ।

(4 ) मखाना समय - समय पर यथा संशोधित बाट और माप. मानक ( पैक की गईं वस्तुएं ) नियम, 1977 के उपबंधों के अधीन यथा विनिर्दिष्ट विभिन्न मात्राओं में पैक किया जाएगा ।

(5 ) प्रत्येक पैकेज में एक ही श्रेणी के मखाना होंगे ।

(6 ) प्रत्येक पैकेज सुरक्षित रूप से बंद और उपयुक्त रूप से मुहरबंद किया जाएगा ।

( 7 ) एक ही श्रेणी और एक ही लॉट/ बैच के उत्पादन से युक्त उपभोक्ता पैकों की उपयुक्त संख्या बड़े आधान में पैक की जा सकेगी ।

7. चिह्नांकन का ढंग :-

( 1 ) श्रेणी अभिधान चिह्न मखाना के प्रत्येक आधान पर कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में साधारण श्रेणीकरण और चिह्नांकन नियमों के नियम 11 के अनुसार सुरक्षित रूप से चिपकाया जाएगा या मुद्रित किया जाएगा;

(2) श्रेणी अभिधान चिह्न के अतिरिक्त प्रत्येक आधान पर निम्नलिखित विशिष्टियां स्पष्टतः और अमिट रूप में चिह्नांकित की जाएंगी:-

(क) उत्पादक देश का नाम;

(ख) विनिर्माता/प्राधिकृत पैकर का नाम और पता;

(ग ) पैक किए जाने का स्थान;

(घ) लॉट/बैच संख्या/कोड संख्या;

(ङ) पैक किए जाने की तारीख;

(च) शुद्ध वजन;

(छ) मास वर्ष से पूर्व उत्कृष्ट;

(ज ) अधिकतम खुदरा कीमत, सभी करों सहित;

( झ) ऐसी अन्य विशिष्टियां जो समय - समय पर कृषि विपणन सलाहकार द्वारा विनिर्दिष्ट की जाएं ।

(3 ) चिह्नांकन के लिए प्रयुक्त स्याही ऐसी क्वालिटी की होगी जो वस्तु को संदूषित न करे;

(4) प्राधिकृत पैकर, साधारण श्रेणीकरण और चिह्नांकन नियमों के नियम 11 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी का पूर्व अनुमोदन अभिप्राप्त करने के पश्चात्, आधानों पर अपना निजी व्यापार चिह्न चिह्नांकित कर सकेगा परन्तु यह तब जब कि निजी व्यापार चिह्न , वह इन नियमों के अनुसार आधानों पर लगाए गए श्रेणी अभिधान चिह्न द्वारा उपदर्शित से भिन्न वस्तु की क्वालिटी या श्रेणी उपदर्शित न करता हो ।

8. प्राधिकार प्रमाणपत्र अनुदत्त करने के लिए विशेष शर्तें:-

साधारण श्रेणीकरण और चिह्नाकन नियमों के नियम 3 के उपनियम ( 8 ) में विनिर्दिष्ट शर्तों के अतिरिक्त निम्नलिखित शर्तें इन नियमों के अधीन मखाना के श्रेणीकरण और चिह्नह्मांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त करने की अतिरिक्त शर्तें होंगी, अर्थात्:-

( i ) प्राधिकृत पैकर मखाना की क्वालिटी के परीक्षण के लिए कृषि विपणन सलाहकार अथवा उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा अनुमोदित किसी अर्हित रसायनज्ञ द्वारा सज्जित या तो स्वयं की प्रयोगशाला की स्थापना करेगा या इस प्रयोजन के लिए अनुमोदित किसी प्रयोगशाला तक पहुंच रखेगा;

(ii) प्रसंस्करण और पैकिंग के लिए परिसर पूर्ण स्वास्थ्य कारक और स्वच्छता की दशाओं में रखे जाएंगे ;

(iii ) इन संक्रियाओं में लगे कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी सांसर्गिक रोग से मुक्त होंगे ।

( 1 ) निम्फेसी फैमिली के, " यूरेल फैरोक्स " गोरगोन फल या फौक्स नट के परिपक्व, सूखे और ठोस बीजों से अभिप्राप्त उत्पाद होगा ।

(2 ) वस्तु के लक्षणों के अनुसार साफ, साबुत और सफेद या दूधिया रंग और अरोमा से युक्त होगा;

सामान्य अपेक्षाएं

मखाना चूर्ण:-

(1 ) मखाना को पीसकर तैयार किया जाएगा ;

( 2 ) वस्तु के लक्षणों के अनुसार साफ, साबुत और सफेद या दूधिया रंग और अरोमा से युक्त होगा;

(3) तीखे और सुरुचिकर अरोमा से युक्त अभिलक्षण और अरोमेटिक होगा;

(4) विकृत गंधी, स्वाद, मस्टी गंध और असामान्य सुवास से मुक्त होगा;

( 5 ) गंदगी , कृतंक रोम और मल, फफूंदी कीट ग्रसन , हानिकारक जीवाणु , कवक, मकड़जाल , योजित रंजक पदार्थ, विषैले पदार्थ, घृणित गंध और अनुसूची में यथा उपदर्शित सीमा के सिवाय अन्य अशुद्धियों से मुक्त होगा;

(6 ) अच्छी वाणिज्यिक दशा में और सभी प्रकार से मानव उपभोग के लिए उपयुक्त होगा;

(7) प्रति किलोग्राम एफलाटॉक्सिन की 30 माइक्रोग्राम सीमा से अधिक नहीं होगा;

(8) समय- समय पर यथा संशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन विहित फसल , संदूषक ( नियम 57 - क ) कीटनाशी और नाशक जीवमार अवशिष्ट ( नियम 65 ) जहरीले धातु ( नियम 57 ) के प्राकृतिक रूप से होने वाले विषैले पदार्थ (नियम 57 - ख ) और अन्य उपबंधों के विषय में निर्बंधनों का अनुपालन होगा ।

सामान्य अपेक्षाएं

मखाना ( तला हुआ): -

(1 ) खाद्य तलने वाले पदार्थ में मखाना को तलकर तैयार किया जाएगा और उपयुक्त रूप से लवणित, मधुरित मसालायुक्त मखाना या अन्यथा सुवासित किया जा सकेगा ।

(2 ) बेहतर स्वाद के लिए भुरभुरा किया जाएगा;

(3 ) विकृत गंधी, स्वाद, मस्टी गंध और असामान्य सुवास से मुक्त होगा;

(4) गंदगी , कृतंक रोम और मल, फफूंदी, कीट ग्रसन , हानिकारक जीवाणु, कवक, मकड़जाल, योजित रंजक पदार्थ, विषैले पदार्थ, घृणित गंध और अनुसूची में यथा उपदर्शित सीमा के सिवाय अन्य अशुद्धियों से मुक्त होगा;

( 5 ) अच्छी वाणिज्यिक दशा में और सभी प्रकार से मानव उपभोग के लिए उपयुक्त होगा;

(6) प्रति किलोग्राम एफलाटॉक्सिन की 30 माइक्रोग्राम सीमा से अधिक नहीं होगा;

( 7 ) समय - समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन विहित फसल , संदूषक ( नियम 57 - क ) कीटनाशी और नाशक जीवमार अवशिष्ट ( नियम 65 ) जहरीले धातु (नियम 57 ) प्राकृतिक रूप से होने वाले विषैले पदार्थ ( नियम 57 -ख ) और अन्य उपबंधों के विषय में निर्बंधनों का अनुपालन होगा ।

स्पष्टीकरण:-

1. अकार्बनिक बाह्य पदार्थ से बालू, पत्थर, धूल , गंदगी , मिट्टी की डेलियां, बजरी, कंकड़, मिट्टी और कीचड़ और धात्विक टुंकड़े अभिप्रेतहैं;

2. कार्बनिक बाह्य पदार्थ से खरपतवार बीज, भूसा , तना, तृण और पादप के अन्य वनस्पति पदार्थ;

3. कीट क्षतिग्रस्त-

से ऐसा मखाना ( भुना हुआ) अभिप्रेत है जो कीटों द्वारा आंशिक रूप से या पूर्ण रूप से छिद्रित या क्षतिग्रस्त हो;

4. क्षतिग्रस्त और अपवर्णित से ऊष्मा , रोगाणु, नमी या मौसम या अन्य कारणों से सुस्पष्ट रूप से या आंतरिक रूप से क्षतिग्रस्त साबुत याखंडित मखाना ( भुना हुआ ) अभिप्रेत है ।

G.S.R. 294. The following draft of the Makhana , Grading and Marking Rules , 2003 , which the Central Government proposes to make , in exercise of the powers conferredby Section 3 of the Agricultural Produce (Grading and Marking) Act , 1937 ( 1 of 1937 ), is hereby published as required by the said section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of fortyfive days from the date on which the copies of the Gazette of India containing this notification are made available to the public;

Any person desirous of making any suggestion or objection in respect of the said draft rules , may forward the same for the consideration of the Central Government, within the period so specified to the Agricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection , New CGO Building , N.H.IV, Faridabad - 121001 (Haryana) .

DRAFT RULES

1. Short title, application and commencement :-

( 1 ) These rules may be called the Makhana , Grading andMarking Rules , 2003 ;

(2) They shall apply to Makhana including Makhana powder and Makhana fried.

(3 ) They shall come into force from the date of theirpublication in the official Gazette.

2. Definition : In these rules , unless the context otherwise requires :-

(i ) " Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India ;

(ii) " authorised packer " means a person or a body of persons who has been granted a certificate of authorisation to grade and mark Makhana in accordance with the grade standards and procedure prescribed under these rules ;

(iii) " certificate of authorisation " means the certificate issued under provisions of the General Grading and Marking Rules , 1988 , authorising a person or a body of persons to grade and mark Makhana with the grade designations mark;

( iv) " General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under Section 3 of the Agricultural Produce (Grading and Marking ) Act , 1937 (1 of 1937) as amended from time to time;

(v) " grade designation mark " means the " Agmark Insignia" referred to in rule 5 of these rules .

(vi) " Schedule" means a schedule annexed to these rules.

3. Grade designations :- For the purpose ofthese rules , the grade designations shall be the name of grades which indicate the quality of Makhana as given under column 1 of Schedule - II , III and IV.

4. Definition of Quality : For the purpose ofthese rules , the definition of quality and general requirements shall be such as given against each grade designation in columns 2 to 11 ofSchedule -II , columns 2 to 9 of Schedule- III and columns 2 to 8 of Schedule- 1V.

5. Grade designation mark : The grade designation mark shall consist of " Agmark Insignia" consisting of a design incorporating the number of certificate of authorisation , the word, " AGMARK" , name of the commodity and grade designation resembling the design as set out in Schedule - I

6. Method of packing:-

(1 ) Makhana including powder and fried shall be packed in such a manner which will safeguard the hygienic , nutritional , technological and organoleptic qualities of the product .

(2) The packaging material shall be sound, clean, dry, moisture proof and free from insect infestation or fungal contamination .

(3) The packing material shall be made of substances which are safe and suitable for their intended use, including new clean jute bags , plastic bags, tin plate containers or any other packing material as approved by the Agricultural Marketing Adviser provided that the packing material shall be manufactured out of food grade material as permitted under Prevention of Food Adulteration rules , 1955 asamended from time to time .

(4) Makhana shall be packed in different quantities as specified under the provisions of the Standards of Weights and Measures (Packaged Commodities ) Rules , 1977 as amended from time to time .

(5) Each package shall contain Makhana of one grade only.

(6) Each package shall be securely closed and suitably sealed.

(7) Suitable number of consumers packs containing the product of the same grade and from the same lot/batch may be packed in a master container.

7. Method of Marking:-

( 1) A grade designation mark shall be securely affixed to or printed/stencilled on each container ofMakhana in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading and Marking Rules .

(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly ınarked on each container :-

( a) Name of the producing Country , (b) Name and address of the manufacturer/ authorised packer ,

(d) Lot/batch number/code number, (c) Date of packing,

(f) net weight ,

(g) Best before upto month and year , (1) Maximum retail price inclusive of all taxes , (i) Such other particulars as may be specified by the Agricultural Marketing Adviser from time to time .

(3) The ink used for marking shall be of such quality which does not contaminate the commodity;

[PART II- SEC . 3 ( i ) ] (4) The authorised packer may , after obtaining prior approval of the Agricultural Marketing Adviser or any other officer duly authorised by him in this behalf, in accordance with rule 11 of the General Grading and Marking Rules mark his private trade mark on the containers provided that the private trade mark does not represent quality or grade of the commodity different from that indicated by the grade in accordance with these rules .

8. Special conditions for grant of certificate of authorisation:-

In addition to the conditions specified in sub -rule (8) of rule 3 of the General Grading and Marking Rules the following shall be the additional conditions for grant of certificate of authorisation for Grading and Marking of Makhana under these rules , namely :-

(1 ) The authorised packer shall either set up his own laboratory manned by a qualified chemist approved by the Agircultural Marketing Adviser or any officer authorised by him in thisbehalf, for testing the quality of Makhana or has access to any approved laboratory for the purpose;

(ii) The premises for processing and packing shall be maintained in perfect hygienic and sanitary conditions;

(iii) The personnel engaged in these operations shall be in sound health and free, from any contagious disease .

(4) be free from rancid taste , musty odour and normal flavour;

(5) be free from filth, todent hair and excreta, mould growth, insect infestation , harmful bacteria , fungus , webs , added colouring matter , toxic substances , obnoxious smell and other impurities except to the extent as indicated in the schedule;

(6) be free from outer black covering as much as possible;

(7) be safe and suitable for processing for human consumption;

(8) be in sound merchantable condition and fit for human consumption in all respects ;

(9) not exceed the limit of 30 micrograms of aflatoxin perkilogram;

General requirements

Makhana ( fried) shall :---

(1) be prepared by frying Makhana in an edible frying medium and may be suitably salted, sweetened, spiced or otherwise flavoured ;

(2) be crispy for better taste;

(3) be free from rancid taste , musty odour and abnormal flavour,

(4) be free from filth, rodent hair and excreta , mouldgrowth, insect infestation , harmful bacteria , fungus , webs , added colouring matter, toxic substances , obnoxious smell and other impurities except to the extent as indicated in the Schedule;

(5) be in sound merchantable condition and fit for human consumption in all respects ;

(6) not exceed limit of30 micrograms of aflatoxin per kilogram;

(7) comply with the restrictions in regard to crop contaminants (rule 57 - A) , insecticides and pesticides residue (rule 65) , poisonous metals ( rule 57 ) , naturally occurring toxic substances ( rule 57 -B ) and other provisions prescribed under the Prevention of Food Adulteration Rules , 1955 as amended from time to time .

Explanation:

1. Inorganic extraneous matter - means sand, stones dust, dirt , lumps of earth, gravels , pebbles , clay and mud and metallic pieces;

2. Organic extraneous matter - means weed seeds , chaff, stem , straw and other vegetable matter of the plant;

3. Insect damaged - means makhana ( roasted) that are partially or wholly bored or damaged by insects ;

4. Damaged and discoloured - means makhana ( roasted) whole or broken, obviously or internally damaged due to heat , microbe , moisture or weather or other causes .
