का०नि ०आ ० 106.-रक्षा संकर्म अधिनियम, 1903 ( 1903 का 7 ) की धारा 3 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए केन्द्र सरकार एतद्वारा घोषणा करती है कि नीचे दी गई अनुसूची में उल्लिखित भूमि जम्मू- कश्मीर राज्य में गांव फलियाना ( मुरादपुर ) , तहसील और जिला राजौरी में फील्ड पेट्रोलियम डिपो के निकट होने के कारण इसे भवनों तथा अन्य बाधाओं से मुक्त रखे जाने के उद्देश्य से इसके उपयोग तथा अधिभोग पर उपर्युक्त अधिनियम की धारा 7 के खंड ( ग ) में निर्दिष्ट प्रतिबंध लगाया जाना आवश्यक है ।

अनुसूची

जम्मू-कश्मीर राज्य में गांव फलियाना ( मुरादपुर ) , तहसील और जिला राजौरी में रक्षा संकर्म अर्थात् फील्ड पेट्रोलियम डिपो की बाहरी परिधि से 500 गज की दूरी के भीतर के क्षेत्र में आने वाली समस्त भूमि ।

2. उपर्युक्त भूमि से सम्बन्धित रेखाचित्र नक्शे का निरीक्षण उपायुक्त, जिला राजौरी , जम्मू- कश्मीर राज्य के कार्यालय में किया जा सकता है ।

In exercise of the powers conferred by Section 3 of the Works of Defence Act , 1903 (7 of 1903 ) the Central Government hereby declares that it is necessary to impose restrictions specified in clause ( c) of Section 7 of the said Act upon the use and enjoyment of the land described in the Schedule given below, being land lying in the vicinity of Field Petroleum Depot (FPD ) Rajouri at Village Phalyana (Muradpur) , Tehsil and District Rajouri in State of Jammu and Kashmir, in order that the said land may be kept free from buildings and other obstructions .

SCHEDULE

का० नि०आ० 107.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सैनिक इंजीनियरी सेवा, रक्षा मंत्रालय में ज्येष्ठ निजी सचिव पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सैनिक इंजीनियरी सेवा, ( ज्येष्ठ निजी सचिव ) भर्ती नियम , 2003 है । ( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु- सीमा और उससे सम्बन्धित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. - इन नियमों की कोई बात ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति

11. भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रति- नियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता । :

12. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे : श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा ।

प्रोन्नति: 6500-10500 रु. के वेतनम्नान में ऐसा निजी सचिव जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है ।

टिप्पणी : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेत्रा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसेज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु वह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हौ और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी करली हो ।

S.R.O. 107. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Private Secretary in Military Engineer Services , Ministry of Defence , namely:--

1. Short title and commencement.- ( 1 ) These rules may be called the Military Engineer Services ( Senior Private Secretary ) Recruitment Rules, 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classifications and scales of pay . The number of the said posts , its classifications and scales of pay attached thereto shall be as specified in columms 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications . etc .. The method of recruitment , age limit and other matters relating to the said post shall be as specified in columns 5 to 14 of the aforesaid Schedule .

4. Disqualifications . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be cligible for appointment to the said posts:

Provided that the Central Governinent may , if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedients so to do, it may by order and for reasons to be recorded in writing and in consultation with UPSC, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in this rule shali affect reservations, relaxation of age limit and other concessions required to be provided for Scheduled Castes, the Scheduled Tribes , the Other Backward Classes, Ex - servicemen and other special categories ofpersons , in accordance with the orders issued by the Central Government from time to time in this regard .

7450-11500 रु. के वेतनमान में ऐसा कनिष्ठ वैज्ञानिक, सहायक जिसने उस श्रेणी में दो वर्ष नियमित सेवा कर चुके हों ।

प्रारम्भिक गठन : पद को 7450-11500 रु ० के वेतनमान में ऐसे

कनिष्ठ वैज्ञानिक सहायक की प्रोन्नति द्वारा प्रारम्भ में भरा जा सकेगा जिन्होंने ज्येष्ठ वैज्ञानिक सहायक ( 7450-11500 रु ० ) और वैज्ञानिक सहायक I के 6500-10500 रु० के वेतनमान में तीन वर्ष सम्मिलित सेवाकीहो ।

S.R.O. 108. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Scientific Officer in the Indian AirForce , namely :-

1. Short title and commencement.- ( 1 ) These rules may be called the Indian Air Force Junior Scientific Officer Recruitment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columms 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications etc. The method of recruitment to the said post. age limit, qualification and other matters relating to the said post shall be as specified in colununs 5 to 14 of the said Schedule .

4. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living: or

(b) who , having a spouse living , has entered into or contracted a marriage with any person.

shall be eligible for appointmentto the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule .

5. Powerto relax .- Where the Central Government is of the opinion that it is necessary or expedients so to do , it may by order , and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings.-Nothing in these rules shall affect reservation , relaxation of the age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex- servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदें की संख्या , उसका वर्गीकरण और ठसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु - सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा और अन्य अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति, -

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेश के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

S. R. O. 110. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of the Defence Security Corps Group 'B ' Accounts and Administrative Officer ( Civilian Gazetted Officer ) Recruitment Rules . 1992 except as respects things done or omitted to be done , before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accounts and Administrative Officer (Civilian Gazetted Officer) in Defence Security Corps , namely :---

1. Short title and commencement.- ( 1 ) These rules may be called the Defence Security Corps Group B Accounts and Administrative Officer ( Civilian Gazetted Officer ) Recruitment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts .---- The number of the said posts . its classification and scale of pay attached thereto shall be as specified in columms 2 to 4 of the Schedule hereto annexed .

3. Method of recruitment , age limit and other qualifications. The method of recruitment age limit . qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification . No person .---

(a) who has entered into or contracted a marriage with a person having a spouse living : or

( b ) who , having a spouse living , has entered into or contracted a marriage with any person .

shall be eligible for appointment to the said post:

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so do to , it may by order for reasons to be recorded in writing and in consultation with the U.P.S. C. relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.-- Nothing in these rulcs shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes . Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : Where juniors who have completed their qualifying/ eligibility service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying/ cligibility service by more than half of such qualifying/ cligibility service or two years , whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ cligibility service.

DEPUTATION :

Officers of the Central Government:

(a ) ( i ) Holding analogous posts on a regular basis in the parent cadre/ department; or

(ii ) with three years service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5500-9000 or equivalent in the parent cadre/department ; or

(iii) with six years service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5000-8000 or equivalent; and

(b) possessing two years experience in establishment and accounts matters.

Note: Period of deputation inchiding period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/ department of the Central Government shall ordinarily not to exceed three years . The maximun age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of the receipt of applications .

का० नि० आ० 111.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय वायुसेना, ज्येष्ठ सिविलियन राजपत्रित अधिकारी ( प्रशासन ) भर्ती नियम , 1983 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण में पहले किया गया है या किए जाने का लोप किया गया है , वायुसेना में , ज्येष्ठ सिविलियन राजपत्रित अधिकारी ( प्रशासन ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय वायुसेना , ज्येष्ठ सिविलियन राजपत्रित अधिकारी ( प्रशासन ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों में उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा और अन्य अहंताएं और उनमे सम्बन्धित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति : ऐसे सिविलियन राजपत्रित अधिकारी ( प्रशासन ) जिन्होंमे उस श्रेणी में पांच वर्ष नियमित सेवा की है । टिप्पण: ऐसे वर्तमान पदधारी सिविलियन राजपत्रित अधिकारी ( प्रशासन) जोइन पुनरीक्षित नियमों की अधिसूचना की तारीख पर नियमित आधार पर उस श्रेणी में तीन वर्ष की नियमित सेवा की हो, लागू होगा ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा होवहां उनकेज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो बर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

1. Short title and commencement.- ( 1 ) These rules may be called the Indian Air Force . Senior Civilian Gazetted Officer ( Administration ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of posts , its classifications and scale of pay attached thereto shall be as specified in columuns 2 to 4 of the said Schedule .

3. Method of recruitment , age limit and qualifications etc.- The method of recruitment to the said posts. age limit . qualifications and ciher matters relating thereto shall be as specified in comuns 5 to 14 of the said Schedule .

का०नि०आ० 112.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सेना कमान प्रबंध सूचना प्रणाली सैल ( समूह ' ग ' पद ) भर्ती नियम , 1983 का उन बातों के सिवाय जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या किए जाने का लोप किया गया है , अधिक्रमण करते हुए, जनरल स्टाफ प्रणाली शाखा, मुख्यालय पूर्वी कमान, कोलकाता और मुख्यालय दक्षिणी कमान, पुणे में आंकड़ा प्रविष्टिप्रचालक श्रेणी' ग ' और आंकड़ा प्रविष्टि प्रचालक श्रेणी' ख' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात:-

1. संक्षिप्त नाम और प्रारम्भ. ( i ) इन नियमों का संक्षिप्त नाम जनरल स्टाफ प्रणाली शाखा, मुख्यालय पूर्वी कमान और दक्षिणी कमान, आंकड़ा प्रविष्टि प्रचालक श्रेणी ' ग ' और आंकड़ा प्रविष्टि प्रचालक श्रेणी ' ख' के समूह ' ग ' पद भर्ती नियम, 2003 है ।

( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि. उक्त पदों की भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. प्रारंभिक गठन.-इन नियमों में किसी बात के होते हुए भी, ऐसे आंकड़ा प्रविष्टि प्रचालक, श्रेणी ' ख' जो विद्यमान नियमों के अधीन आंकड़ा प्रविष्टि प्रचालक के पद धारण किए हुए हैं , को इन नियमों के प्रारंभ पर, भारत सरकार के रक्षा मंत्रालय पत्र सं. बी/00306 /एडीजी सिस्टम/एस एंड सी ( प्रशासन )/ 1314/डीओ/डी ( जीएस - Ⅰ ) तारीख 03 सितम्बर, 98 के क्रियान्वयन के अनुसरण में किए गए नियोजन के पश्चात् डाटा प्रविष्टि प्रचालक श्रेणी' ख' के पदों पर नियुक्त किया गया समझा जाएगा ।

5. निरर्हता. वह व्यक्ति,-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्च्तर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्तिः ( क ) केन्द्रीय सरकार के ऐसे अधिकारी जो-

(i ) नियमित आधार पर सदृश पद धारण किए हुए हैं , या

(ii ) 4500-7000 रु . के या समतुल्य वेतनमान वाले पदों पर तीन वर्ष नियमित सेवा की हो, और

(ख) निम्नलिखित शैक्षिक अर्हताएं रखते हैं :

( i ) किसी मान्यताप्राप्त विश्वविद्यालय या समतुल्य से गणित/ गणितीय सांख्यिकी/सांख्यिकी/इलैक्ट्रानिक्स/कम्प्यूटर विज्ञान सहित स्नातक की डिग्री ।

(ii ) 8000 - की डिप्रैशन प्रति घंटा की गति रखता हो ।

टिप्पण 1 : आंकड़ा प्रविष्टि कार्य के लिए 8000- की डिप्रैशन प्रति घंटा की गति का निर्णय किसी सक्षम प्राधिकारी द्वारा , यदि आवश्यक समझा जाए, इलैक्ट्रानिक आंकड़ा संसाधन मशीन पर गति परीक्षा संचालित करके किया जाएगा ।

टिप्पण 2 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में सक्षम प्राधिकारी के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 3 : पोपक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी । 442

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence, Army Command Management Information Systems Cells ( Group ' C ' ) Recruitment Rules 1983 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Data Entry Operator Grade ' C ' and Data Entry Operator Grade 'B ' in the General Staff Systems Branch , Headquarters Eastern Command, Kolkata and Headquarters Southern Command, Pune , namely :-

1. Short title and commencement.-(i) These rules may be called the General Staff Systems Branch, Headquarters Eastern Command and Southern Command Group ' C ' posts of Data Entry Operator Grade ' C ' and Data Entry Operator Grade 'B ' Recruitment Rules , 2003 .

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , and other qualifications etc. The method of recruitment, to the said posts , age limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the said Schedule aforesaid.

4. Initial Constitution. Notwithstanding anything contained in these rules, the Data Entry Operator Grade 'B ' who were holding the posts of Data Entry Operator under the existing rules shall be deemed to have been appointedto the posts of Data Entry Operator Grade 'B ' after placement made in pursuance to implementation of the Govt. of India , Ministry ofDefence letter No. B /00306/ ADG Sys/ S & C ( Adm )/ 1314/DO/ D ( GS - I ) dated 103 September , 98 on the commencement of these rules .

5. Disqualification .-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living , or (6) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other partyto the marriage and that there are other grounds for so doing except any person from the operation of this rule .

का० नि० आ० 116. छावनी अधिनियम, 1924 ( 1924 का 2 ) की धारा 13 की उपधारा ( 7 ) के अनुसरण में केन्द्रीय सरकार एत‌द्वारा अधिसूचित करती है कि स्टेशन कमांडर, इलाहाबाद ने उक्त अधिनियम की धारा 13 की उपधारा (3) के खण्ड ( च) में प्रदत्त शक्तियों का. प्रयोग करते हुए कर्नल आजाद सिंह को छावनी बोर्ड, इलाहाबाद का सदस्य मनोनीत किया है । यह मनोनयन कर्नल गिरिश प्रसाद के स्थान पर किया गया है जिनका त्यागपत्र स्वीकृत हो चुका है ।

S.R.O. 116. In pursuance of Sub-Section (7) of Section 13 of the Cantonment Act 1924 (2 of 1924) the Central Government hereby notifies that Col. Azad Singh has been nominated as a member of the Cantonment Board, Allahabad by the Station Commander, Allahabad in exercise of the powers conferred under clause ( e) of Sub - Section (3 ) of Section 13 of that Act vice Col. Girish Prasad whose resignation has been accepted.
