सा. का. नि. 309.-केन्द्रीय सरकार, सीमा सुरक्षा बल अधिनियम, 1968 ( 1968 का 47 ) की धारा 141 की उप - धारा ( 2 ) के खंड ( ख ) और खंड ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती नियम , 2000 का संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: --

1. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती संशोधन नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती नियम, 2000 में ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) , नियम 6 के स्थान पर निम्नलिखत नियम रखा जाएगा , अर्थात्: -

" 6. नियुक्ति- ऐसे अधिकारियों पर जिन्होंने इन नियमों से उपाबद्ध अनुसूचियों में अन्तर्विष्ट अपनी अर्हक/पात्रता सेवा पूरी कर ली है यदि वे चिकित्सा प्रवर्ग की शेप-1 में हैं तो काडर में विभिन्न श्रेणी ( श्रेणियों ) के लिए प्रोन्नति पर नियुक्ति के लिए विचार किया जाएगा । 3. उक्त नियमों के नियम 8 में " छह सप्ताह " शब्दों के स्थान पर " नौ सप्ताह " शब्द रखे जाएंगे ।

G.S.R. 309. In exercise of the powers conferred by clauses (b) and (c) of sub- section (2) of Section 141 of the BorderSecurity Force Act, 1968 (47 of 1968 ) , the Central Government hereby makes the following rules to amend the Border Security Force (Engineering Officers ) Recruitment Rules , 2000 , namely :-

1. (i) These rules shall be called the Border Security Force (Engineering Officers ) Recruitment Amendment Rules , 2003.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the Border Security Force ( Engineering Officers ) Recruitment Rules , 2000 , ( hereinafter referred to as the said rules), for rule 6, the following shall be substituted namely :-

"6.Appointment. The officers who have completed their qualifying eligibility service as contained in the Schedules annexed to these rules shall only be considered for appointment on promotion to various grade (s ) in the cadre if they are in medical category SHAPE- I " .

3. In the said rules , in rule 8 , for the words " six weeks " , the words " nine weeks " shall be substituted.

सा. का. नि. 310.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कार्मिक, लोक - शिकायत तथा पेंशन मंत्रालय , कार्मिक और प्रशिक्षण विभाग, लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी , मसूरी में ज्येष्ठ निजी सचिव के पद पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम कार्मिक, लोक शिकायत तथा पेंशन मंत्रालय, कार्मिक और प्रशिक्षण विभाग , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी , ज्येष्ठ निजी सचिव, समूह ' ख ' पद भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हताएं-वह व्यक्ति: -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय हैं कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग के परामर्श से इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । [PART II-SEC . 3 (i ) ] THE GAZETTE OF INDIA: SEPTEMBER 6 , 2003 /BHADRA 15 , 1925

6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(क) ( i ) मूल काडर/विभाग में समतुल्य पद नियमित आधार पर धारण किए हुए हों, या

(ii ) जिन्होंने मूल काडर/विभाग में 7450-11500 रुपए या समतुल्य वेतनमान में नियुक्ति के बाद नियमित आधार पर उस श्रेणी में दो वर्ष सेवा की है , या

(iii ) जिन्होंने मूल काडर/ विभाग में 6500-10500 रुपए या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के बाद उस श्रेणी में तीन वर्ष सेवा की है, और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं:-

( i ) किसी मान्यता प्राप्त बोर्ड से मैट्रिक या समतुल्य परीक्षा उत्तीर्ण हो; और

(ii ) हिंदी या अंग्रेजी आशुलिपिक के रूप में पांच वर्ष का अनुभव ।

2. ऐसा विभागीय निजी सचिव जिसने उस श्रेणी में तीन वर्ष की नियमित सेवा की है , पर भी बाहरी व्यक्तियों के साथ विचार किया जाएगा और यदि पद पर नियुक्ति के लिए उसका चयन कर लिया जाता है तो उक्त पद प्रोन्नति द्वारा भरा गया समझा जाएगा । 1927

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति के सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्ति व्यक्तिप्रोत्रति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ) ।

प्रतिनियुक्ति/संविदा की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्यसंगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति पर नियुक्ति( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी। लागूनहींहोता।

13. यदि विभागीय प्रोन्नति समिति है , तो उसकी सरंचना

संघ लोक सेवा आयोग से परामर्श करना आवश्यक है ।

R. 310.- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Private Secretary in the Ministry of Personnel , Public Grievances and Pensions , Department of Personnel and Training , Lal Bahadur Shastri National Academy of Administration , Mussoorie , namely:-

1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Personnel, Public Grievances and Pensions , Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration Senior Private Secretary Group ' B ' Post Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method ofrecruitment, age limit and other qualifications. The method of recruitment, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification.- No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b ) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so , exempt any person from the operation of this rule.

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may , by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit, and other concessions required tobe provided forthe Scheduled Castes , the Scheduled Tribes , the ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(i) passed the matriculation or equivalent examination from a recognized board or equivalent ; and

(ii) five years ' experience as Hindi or English stenographer .

2. The departmental Private Secretary with three years ' regular service in the grade shall also be considered alongwith outsider and in case he is selected for appointment to the post the same shall be deemed to have been filled by promotion .

(The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment ondeputation.

Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

सा. का. नि. 311.- भारतीय प्रशासनिक सेवा ( संवर्ग ) नियमावली, 1954 के नियम 4 के उप- नियम ( 2 ) के साथ पठित अखिल भारतीय सेवा अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा राज्य सरकार के परामर्श से भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियम, 1955 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थात्: -

1. ( 1 ) इन विनियमों का नाम भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन )-संशोधन विनियम, 2003 है । (2 ) ये नियम शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

सा. का. नि. 312.- केन्द्र सरकार, भारतीय प्रशासनिक सेवा ( वेतन ) नियमावली, 1954 के नियम 11 के साथ पठित, अखिल भारतीय सेवा अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा राज्य सरकार के परामर्श से , भारतीय प्रशासनिक सेवा ( वेतन ) नियमावली , 1954 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्:-

1. (i ) इन नियमों का नाम भारतीय प्रशासनिक सेवा ( वेतन ) संशोधन नियमावली, 2003 है ।

(ii ) ये नियम शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे ।

2. भारतीय प्रशासनिक सेवा ( वेतन ) नियमावली , 1954 । (क) अनुसूची III- क में " राज्य सरकारों के अधीन भारतीय प्रशासनिक सेवा में समय वेतनमान से ऊपर के वेतन वाले पदों " तालिका में प्रथम कॉलम में आने वाली प्रविष्टि " हरियाणा " तथा दूसरे और तीसरे कॉलम में अपने वाली तद्‌नुरूपी प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्: -

In exercise ofthe powers conferred by Sub- section ( 1 ) of Section 3 ofthe All India Services Act, 1951 ( LXI of 1951 ) read with sub - rules ( 1 ) and (2 ) of Rule 4 of the Indian Police Service ( Cadre ) Rules , 1954, the Central Government , in consultation with the Government of Madhya Pradesh hereby makes the following regulations further to amend the Indian Police Service (Fixation of Cadre Strength ) Regulations , 1955 , namely :---

1. (i) These rules may be called the Indian Police Service ( Fixation of Cadre Strength ) Second Amendment Regulations, 2003 .

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Indian Police Service (Fixation of Cadre Strength ) Regulations , 1955 , under the heading "Madhya Pradesh " for the entries occurring thereunder, the following shall be substituted namely :--

सा०का ०नि० 314.- भारतीय पुलिस सेवा ( वेतन ) नियमावली, 1954 के नियम 11 के साथ पठित अखिल भारतीय सेवा अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार मध्य प्रदेश सरकार के परामर्श से भारतीय पुलिस सेवा ( वेतन ) नियमावली , 1954 में आगे और संशोधन के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थात्:-

1. ( i ) इन नियमों का नाम भारतीय पुलिस सेवा ( वेतन )- दूसरा संशोधन, नियमावली , 2003 है।

(ii ) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. ( 1 ) " तालिका की अनुसूची III- क " में राज्य सरकार के अधीन भारतीय पुलिस सेवा के समय वेतनमान से ऊपर के पदों में प्रथम कॉलम की " मध्य प्रदेश " प्रविष्टि और दूसरे तथा तीसरे कॉलमों में तद्‌नुरूपी प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्:-

सा०का ०नि० 315.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और और केन्द्रीय भूमिगत जल बोर्ड ( क्लीनर ) भर्ती नियम, 1980 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गयाहै , जल संसाधन मंत्रालय, केन्द्रीय भूमिगत जल बोर्ड में क्लीनर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

2003है । 1. संक्षिप्त नाम और प्रारम्भ. ( i ) इन नियमों का संक्षिप्त नाम केन्द्रीय भूमिगत जल बोर्ड ( क्लीनर ) समूह ' घ ' पद भर्ती नियम, ( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इससे उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा, अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु - सीमा अर्हताएं और उससे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4.. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । [ भाग II- खण्ड 3 ( i ) ]

1949 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

[आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ( न कि वह अंतिम तारीख जो असम, मेघालय , अरुणाचल प्रदेश, मिजोरम , मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बाजिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । ) ]

: आवश्यक: ( i ) 8वीं कक्षा उत्तीर्ण ।

( ii ) क्लीनर के रूप में कार्य करने का दो वर्ष का अनुभव होना चाहिए ।

वांछनीय: ( i ) मैट्रिकुलेशन या समतुल्य ।

( ii ) भारी वाहन के लिए विधिमान्य मोटर चालन अनुज्ञप्तिधारक हो ।

टिप्पण: अनुभव संबंधी अर्हता (अर्हताएं) सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है ( हैं ) जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

G.S.R. 315. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in spersession of the Central Ground Water Board ( Cleaner) Recruitment Rules , 1980 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment for the post of Cleaner in the Central Ground Water Board, Ministry of Water Resources , namely :-

1. Short title and commencement .-( i ) These rules may be called the Central Ground Water Board ( Cleaner ) Group 'D' posts Recruitment Rules, 2003 .

(ii) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said posts, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment, to the said post, age limit, qualifications and matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualifications .-- No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing except any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.--Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

नियम

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम सिवैंया, मैकरोनी और मोटी सेंवई ( श्रेणीकरण और चिन्हांकन ) नियम, 2003 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को लागू होंगे । सा०का ०नि० 317. सिवैंया, मैकरोनी और मोटी सेंवई ( श्रेणीकरण और चिन्हांकन नियम ) , 2002 का एक प्रारूप , कृषि उपज ( श्रेणीकरण एवं चिन्हांकन) अधिनियम, 1937 की धारा 3 की अपेक्षानुसार भारत के राजपत्र , भाग II , खण्ड 3 , उपखण्ड ( i ) तारीख 4 जनवरी, 2003 के पृष्ट 3 से 11 पर सा० का ० नि० सं ० 6 तारीख 18 दिसम्बर, 2002 द्वारा ऐसे सभी व्यक्तियों से आक्षेप और सुझाव आमंत्रित करते हुए जिनके उससे प्रभावित होने की संभावना थी, प्रकाशित किया गया था ।

2. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,

और उक्त राजपत्र की प्रतियां जनता को 11 जनवरी , 2003 को उपलब्ध करा दी गई थीं;

(क) " कृषि विपणन सलाहकार " से भारत सरकार कृषि विपणन सलाहकार अभिप्रेत है;

और केन्द्रीय सरकार ने, उक्त प्रारूप नियमों की बाबत जनता से प्राप्त आक्षेपों और सुझावों पर सम्यक् रूप से विचार कर लिया है;

(ख) " प्राधिकृत पैकर " से अभिप्रेत है ऐसे व्यक्ति या व्यक्तियों का निकाय जिसे इन नियमों के उपबंधों के अनुसार सिवैयां, मैकरोनी 1953 भारत का राजपत्र : सितम्बर 6 , 2003/ भाद्र 15 , 1925

और मोटी सेंवई का श्रेणीकरण और चिन्हांकन करने के लिए प्राधिकार प्रमाण- पत्र अनुदत्त किया गया है ;

(4 ) आधान स्वच्छ, मजबूत और नए होंगे । ये पूर्णतः या अंशतः किसी ऐसे विषैले या हानिकारक पदार्थों से संरचित नहीं होंगे जो अन्तर्वस्तु कोस्वास्थ्यके लिए अहितकर बनाते हैं ।

(ग ) " प्राधिकार प्रमाण- पत्र" से साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के अधीन जारी किया गया प्रमाण- पत्र अभिप्रेत है;

(5 ) आधान उत्पाद की स्वच्छता संबंधी, पोषण संबंधी, प्रौद्योगिकीय और इंद्रीयग्राही गुणवत्ताओं को सुरक्षित रखेंगे ।

(6 ) आधान कीट ग्रसन, कवक, संदूषण या किसी घृणाजनक और अवांछनीय गंध से भी मुक्त होंगे ।

(7 ) उत्पाद कृषि विपणन सलाहकार के द्वारा समय- समय पर जारी किए गये अनुदेशों के अनुसार पैक आकारों में पैक किया जाएगा ।

(8 ) एक ही लॉट/बैच से एक ही श्रेणी अभिधान की श्रेणीकृत सामग्री वाले उपभोक्ता पैकों की उपयुक्त संख्या को किसी कागज या पोलिथिन या प्रोपिलीन स्तरित मजबूत कार्ड बोर्ड बाक्स जैसे बड़े आधान में रखा जाए और सुरक्षित रूप से सील बंद किया जाए । मास्टर आधान के अंदर पैक किये गये पैकजों की संख्या और आकारों की विशिष्टियों का भी अन्य अपेक्षित सूचना के साथ उस पर उल्लेख किया जाएगा। (घ) " सिवैंया मैकरोनी और मोटी सेंवई " से जैसे खाद्य मूंगफली आटा, खाद्य टैपियोका आटा, सोया आटा, दुग्ध पाउडर ( सम्पूर्ण और मलाई युक्त दोनों ) , मसाले, विटामिनों, खनिजों, खाद्य केसीन, खाद्य तिलहन आटा, ग्लूटेन, वनस्पति या वनस्पति उत्पादों, फलों या फल उत्पादों ( परिरक्षित, निर्जलीकृत या लुगदी) के तत्वों को किसी आकार या रूप में मिलाकर यां बिना मिलाए सूजी या मैदा से अभिप्राप्त उत्पाद अभिप्रेत है । यह उत्पाद ऐसी कच्ची सामग्री और ऐसी क्वालिटी के तत्वों से प्राप्त किया जाएगा जो खाद्य अपमिश्रण निवारण नियम, 1954 (1954का 37 ) और खाद्य अपमिश्रण निवारण अधिनियम , 1955 की आज्ञापक अपेक्षाओं को पूरा करते हों;

(ङ) " श्रेणीकरण और चिन्हांकन नियमों " से कृषि उत्पाद ( श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 केअधीन बनाए गये साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 ( समय - समय पर यथा संशोधित ) अभिप्रेत है;

7. चिन्हांकन की रीति ( 1 ) श्रेणी अभिधान चिन्ह श्रेणीकरण और चिन्हांकन नियम, के नियम 11 के अनुसार कृषि विपणन सलाहकार या उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में प्रत्येक पैकेज/आधान पर सुरक्षित रूप से चिपकाया जाएगा या स्पष्ट रूप से और अमिट रूप से मुद्रित किया जाएगा । (च ) " अनुसूची" से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत है ।

(2) श्रेणी अभिधान के अतिरिक्त निम्नलिखित विशिष्टियां प्रत्येक पैकेज/आधान पर स्पष्ट और अमिट रूप से चिन्हित की जाएंगी, अर्थात्: -

(क) प्राधिकृत पैकर का नाम और पता;

3. श्रेणी अभिधान:- सिवैया, मैकरोनी और मोटी सेंवई की क्वालिटी उपदर्शित करने के लिए वे श्रेणी अभिधान होंगे जो अनुसूची 2 केस्तम्भ 1 में दिए गयें हैं ।

(ख) *पैकिंग का स्थान/विनिर्माता का पता;

(ग ) पैकिंग की तारीख;

4. क्वालिटी की परिभाषा : ऐसे श्रेणी अभिधान द्वारा उपदर्शित क्वालिटी वह होगी जो अनुसूची 2 के स्तम्भ 2 से 9 तक में प्रत्येक श्रेणी अभिधान के सामने दी गई है ।

(घ) मास और वर्ष के भीतर, से पूर्व सर्वोत्तम;

(ङ) लॉट/बैच संख्यांक;

(च) शुद्ध भार ( जब पैक किया गया हो ) ;

5. श्रेणी अभिधान चिन्ह: श्रेणी अभिधान चिन्ह में " एगमार्क प्रतीक" होगा जिसमें प्राधिकार प्रमाणपत्र का संख्यांक " एगमार्क " AGMARK शब्द, वस्तु का नाम और श्रेणी अभिधान होगा जो अनुसूची-1 में यथा- उपवर्णित डिजाइन के सदृश होगा ।

(छ) अधिकतम फुटकर कीमत ( सभी करों सहित ) ;

(ज ) भार के आधार पर सम्मिश्रण के अवरोही क्रम में उत्पाद में उपयोग में लाए गए तत्वों के नाम;

(झ) उपयोग में लाए गये खाद्य तेल का नाम , यदि उपयोग में लाया गयाहै;

(ञ) कुकिंग अनुदेश;

6. पैक करने की रीति ( 1 ) सिवैंया, मैकरोनी और मोटी सेंवई बहुपरत या एक परत पोलीथिलीन /पोली प्रोपिलीन या धात्विक या कागज स्तरित सामग्री की ऐसी खाद्य श्रेणी फिल्मों से बने लचीले ताप सुनम्य आधानों में या नमी रोधी कागज की थैलियों में पैक की जाएंगी, जो श्रेणीकरण और चिन्हांकन नियम , के नियम, 11 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित हों ।

(ट) समय- समय पर यथा संशोधित बाट और माप मानक ( पैकेज में रखी गई वस्तुएं ) नियम , 1977 और खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन अपेक्षित कोई अन्य ब्यौरे;

(2) लचीले तापसुनम्य आधान को नाइट्रोजन फ्लशिंग के सहित या उसके बिना तापसुनम्यतापूर्वक सुरक्षित रूप से तापीय सील बंद किया जाएगा।

(ठ ) यदि मसाले मिलाए गये हैं तो ' मसालायुक्त ' शब्द लेबल पर दिया जाए ।

* पैकिंग की तारीख नमूनों के विश्लेषण के समापन की तारीख होगी।

(3) पैकिंग सामग्री खाद्य क्वालिटी की इतनी मजबूत होगी कि वह उसके उपभोक्ता तक पहुंचने तक अन्तर्वस्तु के वजन, उसके परिवहन प्रभाव और उठाई - धराई को प्रतिसहन कर सके । 1954

(छ ) परिसर में कृन्तक संदूषण और कीट ग्रसन से मुक्त पर्याप्त भंडारण सुविधा होगी ।

( 3 ) यह सुनिश्चित करने के लिए समुचित ध्यान रखा जाएगा किचिन्हांकन के लिए उपयोग में लाई गई स्याही ऐसी क्वालिटी की होगी जो वस्तु या उत्पाद को संदूषित नहीं करती ।

(2) उपस्कर और बर्तन-

(क ) सभी उपस्कर और बर्तन स्टेनलैस स्टील या खाद्य सम्पर्क उपयोजनोंके लिए उपयुक्त संक्षारक प्रतिरोधक सामग्री के बने होंगे, और

(ख ) वे जंग या संक्षारक पदार्थों या किसी अन्य धात्विक और विषालु संदूषणों से मुक्त होने चाहिएं ।

(4 ) प्राधिकृत पैकर, कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी के पूर्व अनुमोदन प्राप्त करने के पश्चात् श्रेणीकरण और चिन्हांकन नियम , के नियम 11 के अनुसार श्रेणीकृत पैकेजों पर अपना प्राइवेट व्यापार चिन्ह या व्यापार ब्रांड लगा सकेगा परन्तु यह तब जब कि प्राइवेट व्यापार चिन्ह या व्यापार ब्रांड इन नियमों के अनुसार श्रेणीकृत पैकेजों या आधानों पर लगाए गए श्रेणी अभिधान चिन्ह द्वारा उपदर्शित से भिन्न उत्पाद की क्वालिटी या श्रेणी उपदर्शित नहीं करता है ।

(3) नमूना लेने की पद्धति, विश्लेषण, सीलबंद करने, पैकजों के चिन्हांकन, अभिलेख रखने और विवरणियां आदि प्रस्तुत करने के बारे में सभी अनुदेशों का, जो कृषि विपणन सलाहकार या उसके द्वारा सम्यक रूप से प्राधिकृत किसी अधिकारी द्वारा समय - समय पर जारी किये जा सकेंगे , प्राधिकृत पैकर और अनुमोदित रसायनज्ञ द्वारा कठोरतापूर्वक पालन किया जाएगा ।

8. प्राधिकार प्रमाण-पत्र प्रदान करने के लिए विशेष शर्तें:- श्रेणीकरण और चिन्हांकन नियम, के नियम 3 के उप- नियम ( 8 ) में विनिर्दिष्ट साधारण शर्तों के अतिरिक्त सिवैंया , मैकरोनी और मोटी सेंवई के श्रेणीकरण और चिन्हांकन के लिए प्राधिकार प्रमाण-पत्र की मंजूरी के लिए अतिरिक्त शर्तें निम्नलिखित होंगी, अर्थात्:-

9. प्राधिकार प्रमाण- पत्र का निलम्बन या रद्दीकरण : - श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 7 में विनिर्दिष्ट शर्तों के अतिरिक्त प्राधिकार प्रमाण- पत्र को निलंबित या रद्द किया जाएगा यदि कोई उसका धारक निम्नलिखित शर्तों का पालन करने में असफल रहता है- ( 1 ) प्राधिकृत पैकर, श्रेणीकरण और चिन्हांकन नियम , के नियम 9 के अनुसार सिवैंया , मैकरोनी और मोटी सेंवई की क्वालिटी के परिक्षण के लिए कृषि विपणन सलाहकार या उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा संचालित अपनी प्रयोगशाला की स्थापना करेगा या इस प्रयोजन के लिए राज्य श्रेणीकरण प्रयोगशाला या अनुमोदित प्राइवेट वाणिज्यक प्रयोगशाला में पहुंच रखेगा ।

( i ) परिसर और उपस्कर समय- समय पर रोगाणुनाशित होने चाहिएं ताकि स्वास्थ्यप्रद और स्वच्छता संबंधी परिस्थितियों को उच्च दशा में रखा जा सके जिसका स्थानीय स्वास्थ्य प्राधिकारियों द्वारा कालिकतः निरीक्षण कराया जाएगा और एक प्रमाण- पत्र अभिप्राप्त किया जा सकेगा;

( ii ) ग्रिन्डर और अन्य उपस्कर कालिकतः साफ किये जाने चाहिए;

( 2 ) प्राधिकृत पैकर सिवैंया, मैकरोनी और मोटी सेंवई के श्रेणीकरण और चिन्हांकन में स्वास्थ्यप्रद और स्वच्छता की निम्नलिखित अपेक्षाओं का अनुपालन सुनिश्चित करेगा, अर्थात्:-

( 1 ) साधारण स्वास्थ्यकर परिस्थितियां-

( iii ) कोई भी विषैली या अनुज्ञेय से भिन्न अविषालु सामग्री प्राधिकृत परिसर में भंडारित नहीं की जाएगी;

( क ) प्रसंस्करण और पैकिंग के लिए परिसर स्वच्छ, पक्के फर्स वाले, पर्याप्त रूप से प्रकाश वाले और अच्छे रोशनदान वाले होंगे ।

(iv ) रेजिन लेपित बर्तनों की दशा में पुनर्लेपन प्रत्येक 3 वर्षों के पश्चात् किया जाएगा और पैकर को इस आशय का एक प्रमाण- पत्र देना पड़ेगा;

( ख ) आस- पास का क्षेत्र या वातावरण आपत्तिजनक दुर्गन्ध, धुंआ, धूल या वायु उत्पन्न विकृतिजन्य संदूषणों से मुक्त होगा ।

( v ) उत्पाद के प्रसंस्करण और पैकिंग में लगे हुए कार्मिक के स्वास्थ्य कीचिकित्सीय जांच वर्ष में कम से कम एक बार कराई जानी चाहिए;

(ग ) बिल्डिंग स्थायी संरचना की होगी जिसकी दीवारें अच्छी सीमेंट से युक्त या टाईल वाली होंगी और जिसकी फर्श आसानी से धुलाई योग्य बिना क्रीविसेस होंगी ।

(घ ) दरवाजों और खिड़कियों में मक्खी और कीट प्रुफ, तार की जाली लगी होगी और डोर क्लोजर लगे दरवाजों को वरीयता दी जासकेगी ।

(vi ) प्राधिकृत पैकर सिर्वैया, मैकरोनी और सेंवई के विश्लेषण और श्रेणीकरण और चिन्हांकन के निष्पादन के लिए अनुमोदित रसायनज्ञ को सभी आवश्यक सुविधाएं और सहायता उपलब्ध कराएगा;

( ङ ) जहां भी प्रसंस्करण में पानी का उपयोग किया जाता है यह सुनिश्चित किया जाएगा कि वह शुद्ध और पेय है तथा किसी विकृतिजन्य सूक्ष्म जीवों से मुक्त हैं ।

( च ) परिसर में अगृहीत पानी के बहाव के लिए उचित जल निकास की व्यवस्था होगी जो पूर्णतः ढकी हुई होगी और प्रायः साफ होती रहेगी । नाली से कोई खराब गंध नहीं आएगी । नाली का निक्रास दूर मल पाइपों या सिस्टम में मिला दिया जाएगा ।

(vii ) प्राधिकृत पैकर और अनुमोदित रसायनज्ञ उत्पाद प्रसंस्करण में प्रयुक्त कच्ची सामग्री और उनके विश्लेषण का उचित अभिलेख रखेगा। वह श्रेणीकरण और चिन्हांकन नियम के नियम 3 (8 ) के अनुसार कृषि विपणन सलाहकार द्वारा जारी सुसंगत श्रेणीकरण और चिन्हांकन अनुदेशों में विहित प्रोफार्मा मेंविपणन और निरीक्षण निदेशालय को कालिकतः विवरणी भी भेजेगा । 1955

खनिजों, खाद्य केसीन, खाद्य तिलहन आटा, ग्लूटेन , वनस्पति या वनस्पति उत्पादों, फलों और फल उत्पादों के तत्वों का किसी आकार या रूप में गुंधी सूजी या मैदा में गूंधकर और यथाशक्ति मिलाकर या बिना मिलाए सूजी या मैदा से अभिप्राप्त उत्पाद अभि- प्रेत हैं । यह मिलाए गये रंग , गंदगी , धूल, कीट, डिम्बक और अशुद्धियों या किसी अन्य बाह्य पदार्थ से मुक्त होगा ।

स्वाद या गंध से मुक्त होगी। यह अशुद्धियों, किसी बाह्य पदार्थ डिम्बक गंदगी, कृंतक रोग , उत्सर्ग कीट खंड, जीवित या मृत, दरारों , फलां, फफूंदी, कीट ग्रसन या अन्यखराबी से भी मुक्त होगी । सामग्री अपना स्वरूप बनाये रखेगी और बिखराव के कोई चिन्ह दर्शित नहीं करेगी और जब अधिक उबलते हुए पानी में डाल दी जाती है तो काफी फूल जाती है जब 10 मिनट के लिए उबाली जाती है । पकने की मक्क्र अच्छी होगी और बिनां आक्षेपणीय स्वाद और गंध के होगी ।

सिवैंया, मैकरोनी और मोटी सेंवई के रूप और विस्तार नीचे दिये गये अनुसार होने चाहिए : -

सामग्री छूने में सिन्ध होगी और उसमें कोई मिलाए गये रंजित पदार्थ नहीं होंगे ।

1. सिवैयाः - यह सामग्री 0.5 और 1.25 मी.मी. व्यास के ठोस राईस के रूप में होनी चाहिए ।

2. मैकरोनी:- सामग्री दो किस्म की हो सकेगी, अर्थात् लम्बा ( 2 ) समृद्धि: सामान या कर्तित सामान;

क्रेता और आपूर्तिकर्ता के बीच करार के अधीन रहते हुए सामग्री की निम्नलिखित में से एक या अधिक से प्रबलीकृत किया जा सकेगा-

(का) खनिज-कैल्शियम , फासफोरस और लोहा ।

(ख ) विटामिन ए, बी कम्पलैक्स और डी ।

( क ) लम्बा सामान , नलिकाकार राड्स, सिंध या नालीदार के रूप में होने चाहिए । इनके बाहरी व्यास की परिमाप 3 और 5 मि.मी. और जिसकी भित्ती की मोटाई लगभग 1 मि.मी. होनी चाहिए ।

(ख) कर्तित सामान बहिर्वेधन द्वारा अभिप्राप्त किया जाना चाहिए और कोहनी, ट्यूब शैल्स, अक्षरों, अंकों, सितारों, पहियों , अंगूठियों, चावल, तरबूज के बीजों के रूप में जैसा क्रेता और आपूर्तिकर्ता के बीच सहमति अनुसार हो सकेगा ।

3. उत्पाद ऐसी कच्ची सामग्री और ऐसी क्वालिटी के तत्वों से अभिप्राप्त किया जाएगा जो समय- समय पर यथा- संशोधित खाद्य अपमिश्रण निवारण अधिनियम , 1954 और खाद्य अपमिश्रण निवारण नियंम, 1955 की आज्ञापक अपेक्षाओं को पूरी करता है ।

मोटी सेंवई:- 3.

4. उत्पाद का अपना प्राकृतिक रंग होगा ।

यह सामग्री 1 मि.मी. के ठोस राईस के रूप में होनी चाहिए । 5. उत्पाद में एफलाटांक्सिन प्रति किलो 30 माइक्रोग्राम से अधिक नहीं होगी।

6. उत्पाद खाद्य अपमिश्रण निचारंण नियम , 1955 और समय- समय पर उसके संशीधन के अनुसार प्राकृतिक रूप से उसमें मिले विषाक्त पदार्थों (नियम 57 - ख) , कीटनाशी और नाशक जीवमार अवशिष्ट (नियम 65 ) था जहरीली भातुओं ( नियम 57 ) के संबंध में निर्बंधनों कापालन करेगा ।

G.S.R.317 : Whereas a draft of the Vermicelli , Macaroni and Spaghetti ( Grading and Marking) Rules, 2002 was published as requiredby Section 3 of the Agricultural Produce (Grading and Marking ) Act , 1937 at pages 3 to 11 of the Gazette of India , Part II, section 3 , sub - section ( i )

And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government ;

Now therefore , in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act , 1937 , ( 1 of 1937 ) , the Central Government hereby makes the following rules , namely:--

RULES

1. Short title and commencement. ( 1 ) These rules may be called the Vermicelli. Macaroni and Spaghetti (Grading and Marking ) Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions . In these rules, unless the context otherwise requires.-

(a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;

(b) " Authorised Packer " means a person or a body ofpersons who has been granted a certificate of authorisation to grade and mark Vermicelli , Macaroni and Spaghetti in accordance with the provisions of these rules;

(d) " Vermicelli , Macaroni and Spaghetti " means the products obtained from Suji or Maida with or without the addition of ingredients like edible groundnut flour, edible tapioca flour , soya flour , milk powder (both whole and skimmed) , spices , vitamins , minerals , edible casein , edible oilseeds flour , gluten, vegetable or vegetable products , fruit or fruit products (preserved, dehydrated or pulp) in any shape and form . The product shall be derived from raw materials and ingredients quality ofwhich meets the mandatory requirements of Prevention of Food Adulteration Act, 1954 ( 37 of1954 ) and Prevention of Food Adulteration Rules , 1955;

( e) " Grading and Marking Rules" means the General Grading and Marking Rules , 1988 ( as amended from time to time) made under section 3 of the Agricultural Produce ( Grading and Marking) Act, 1937 ( 1 of 1937) ;

(f) " Schedule" means a Schedule appended to these rules .

3. Grade designations . The grade designations to indicate the qulaity of Vermicelli , Macaroni and Spaghetti shall be as set out in column 1 of Schedule- II .

4. Definition of quality. The quality indicated by such grade designation shall be as set out against each grade designation in columns 2 to 9 of the Schedule - II.

1957 5. Grade designation mark . The grade designa- tion mark shall consist of " AGMARK insignia" consisting ofa design incorporating the certificate of authorisation number, the word " AGMARK" , name of the commodity and grade designation resembling the design as set out inSchedule - I .

6.Method of packing. ( 1 ) Vermicelli , Macaroni and Spaghetti shall be packed in flexible thermoplastic containers made up of food grade films of multi - layer or mono - layer polythene/ polypropylene or metallic or paper laminated materials or moisture proof paper bags as approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf as per rule 11 of the Grading and marking Rules .

(2) The flexible container or thermoplastic shall be securely heat sealed with or without nitrogen flushing ;

(3) The packing material shall be of food grade quality, strong enough to withstand the weight of the contents , trasnsit impact and handling, till itreaches the consumers;

(4) The containers shall be clean , sound and new. These shall not be composed wholly or partly of any poisonous or deleterious substances which renders the content injurious to health ;

(5) The containers shall safeguard the hygienic, nutritional , technological and organoleptic qualities of the product ;

(6) The containers shall also be free from insect infestation , fungus contamination or any obnoxious and undersirable smell;

(7) The product shall be packed in the pack sizes asper instructions of Agricultural Marketing Adviser issued from time to time .

8. Suitable number of consumer packs containing graded material of the same grade designation from the same lot/batch may be packed in master container such as paper or polythene or polypropylene lined strong cardboard box and be securely closed and sealed. The particulars of number and sizes of the packages packed inside the master contrainer be mentioned thereon alongwith other required informations .

7. Method of Marking ( 1 ) The grade designa- tionmark shall be securely affixed to or clearly and indelibly printed on each package/ container in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 oftheGrading and Marking Rules .

(2) In addition to the grade designation mark , the following particulars shall be clearly and indelibly marked on each package/container , namely:---

(a) Name and address of the authorised packer;

(b) Place of packing/ address of Manufacturer;

(d) Best before within ... month and... year ;

(e) Lot /batch number;

(f) Net mass (when packed);

(g) Maximum retail price ( inclusive of all taxes) ;

(h) Names of ingredients used in the product in descending order of composition by weight;

(i) Name of the edible oil used , ifused;

(j ) Cooking instructions ;

(k) Any other details required under the Standards of Weights and Measures (Packaged Commodities) Rules , 1977 and Prevention of FoodAdulteration Rules , 1955 as amended from time to time;

(1) If spices have been added , the word ' spiced' tobe given on the label .

* Date of packing shall be date of completion of analysis of the samples .

(3) Proper care shall be taken to ensure that the ink used for marking shall be of such quality which does not Contaminate the commodity or the product.

(4) An authorised packer may, after obtaining prior approval of the Agricultural Marketing Adviser or anofficer authorised by him in this behalf, in accordance with rule 11 of the Grading and Marking Rules , affix his private trade inark or trade brand on the graded packages provided that the same does not indicate quality or grade of the product other than that indicated by the grade designation mark affixedto the graded packages or containers in accordance with these rules .

8. Special conditions for grant of certificate of authorisation . In addition to the general conditions specified in sub -rule (8) of rule 3 ofthe Grading and Marking Rules , the following shall be the additional conditions for grant ofcertificate of authorisation for Grading and Marking ofVermicelli , Macaroni and Spaghetti, namely: - (1) The authorised packer shall either set up his own laboratory manned by the qualified chemist approved by theAgricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 9 of the Grading and Marking Rules , for testing the quality of Vermicelli , Macaroni and Spaghetti or have access to the state Grading Laboratory or private commercial laboratory approved for the purpose;

(2) The authorised packer shall ensure the compliance ofthe following requirements of hygiene and sanitation in grading and marking of the Vermicelli , Macaroni and Spaghetti , namely: -

(i ) General hygienic conditions:-

(a) The premises for processing and packing shall be clean, pucca floor , adequately lighted and well ventilated ;

(b) The surrounding area or environment shall be free from objectionable odours , smoke , dust or air borne pathological contaminations;

(c) The building shall be of a permanent structure with well cemented or tiled walls and easily washable floors without any crevices ;

(d) The doors and windows shall be fitted with fly and insect proof wire mesh and the doors may preferably be fitted with automatic door closers;

(e) Wherever water is used in processing, it shall be ensured that it is pure , potable and free from any pathological micro organisms ;

(f) The premises shall have proper drainage system for flow of refuse water and the same must be fully covered and be cleaned often. No foul smell shall emanate from the drains . The drain out lets shall lead to distant sewer pipes or system .

(g) The premises shall have an adequate storage facility free from rodent contamination and insect infestation .

(ii) Equipments and utensils : ----

(a) All equipments and utensils shall be made of stainless steel or corrosive resistant material suitable for food contact applications ; and (b) They should be free from rust , corrosive substances or any other metallic and toxic contamination

(3)All instructions regarding the method of sampling, analysis , sealing , marking of packages , maintenance of records and submission of returns etc. , which may be issued from time to time by the Agricultural Marketing Adviser or any Officer duly authorised by him , shall be strictly observed by the authorised packer and approved Chemist .

9. Suspension or cancellation of certificate of authorisation: --In addition to the conditions specified in rule 7 of the Grading and Marking Rules , the Certificate ofAuthorisation shall be suspended or cancelled , if a holder of the same , fails to comply with the following conditions:--

(i ) The premises and the equipments should be oftendisinfected so as to maintain high order ofhygienic and sanitary conditions which may be got inspected periodically by the local Health Authorities and a certificate be obtained;

(ii) The grinders and other equipments must be cleaned periodically;

(iii) No toxic or non toxic material other than those permissible shall be stored in the authorised premises;

(iv) In the case of resin -coated utensils, recoating will be done after every three years and the packer shall have to furnish certificate to this effect ;

(v) The personnel engaged in processing and packing of the product should be got medically checked up at least once in a year ;

(vi) The authorised packer shall provide all necessary facilities and assistance to the

approved chemist for carrying out the analysis and grading and marking of Vermicelli , Macaroni and Spaghetti ;

(vii) The authorised packer and approved chemist shallMaintain proper record of raw materials used in processing the product and their analysis . He shall also submit the periodical returns to the Directorate of Marketing and Inspection in the proforma prescribed in the relevant grading and marking instructions issued by the Agricultural Marketing adviser as per rule 3 (8 ) of the Grading and Marking Rules.

[PART II- SEC . 3 ( i) ] Description

General requirements

Vermicelli , Macaroni and Spaghetti means the products obtained from suji or Maida with or without addition of ingredients like edible ground nut flour, tapioca flour, soya flour, milk powder, spices , vitamins , minerals , edible casein, edible oil seed flour, gluten , vegetable or vegetable products , fruits and fruit productsby kneading the dough and extending it to any shape and form. It shall be free from added colour, dirt , dust , insects , larvae and impurities or any other extraneous matter;

(1) Vermicelli , Macaroni and spaghetti shall be of good characteristic colours , flavour and odour and shall be free from rancidity, mustiness, bitterness or any other unde- sirable taste or odour. It shall also be free from impurities , larvae, dirt, dust , rodent hair and excreta , insect gragments, live or dead insects foreign matter, cracks , flaws , mould, insect infestation or other spoilage. The material shall retain its shape and show no signs of disintegration and shall swell appreciable when plunged into vigorously boiling water and kept boiled for 10 minutes . The flavour of the cooking shall be good and without objectionable taste and odour.

The forms and dimensions of Vermicelli , Macaroni and Spaghetti should be as given below;

(1) Vermicelli

The material shall be smooth to touch and shall not contain any added colouring matter.

The material should be in the form of solid rods of (liameter between 0.5 and 1.25 mm .

(2) Macaroni

2.Enrichment .

The material may be of two types , namely, long goods or cut goods:

Subject to the agreement between the purchaser and the supplier, the material may be fortified with one or more of the following:-

(a)Mineral -clacium , phosphorus and iron.

(b) Vitamins -A, B -Complex andD.

( a) The long goods should be in the form of tubular rods , smooth or corrugated. These should have the outer diameter ranging between 3 and 5mm and of wall thickness ofabout 1 mm.

3. The product shall be derived from raw materials and ingredients quality of which meets the- mandatory requirements under the Prevention of Food Adulteration Act, 1954 and Prevention of Food Adulteration Rules , 1955

asamended from time to time.

4. The product shall have its natural colour.

(b ) The cut goods should be obtained by extrusion and may be in the form of elbows , tubes , shells , alphabets , numerals , stars , wheels rings , rice , melon seeds as agreed to between the purchaser and the supplier .

5. The product shall not contain aflatoxin more than

(3) Spaghetti

30 micrograms per kg.

The material should be in the form of solid rods of diameter 1mm.

6. The product shall comply with restrictions in regard to Naturally occuring toxic substances ( rule 57 -B ) , Insecticides and Pesticides residue ( rule 65) and Poisonous metals (rule 57 ) as per Prevention of Food Adulteration Rules , 1955 and its amendment from time to time.
