सा. का. नि. 381.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय उर्वरक क्वालिटीनियंत्रण और प्रशिक्षण संस्थान , फरीदाबाद ( समूह " ग" और " घ " पद ) भर्ती नियम, 1977 को जहां तक उनका संबंध उर्वरक निरीक्षक के समूह " ग " पद से है उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है कृषि मंत्रालय, कृषि और सहकारिता विभाग , केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थान, फरीदाबाद में उर्वरक निरीक्षक के समूह " ग " बद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ.-( 1 ) इन नियमों का संक्षिप्त नाम कृषि मंत्रालय, कृषि और सहकारिता विभाग, केन्द्रीय उर्वरक गंणवत्ता नियंत्रण और प्रशिक्षण संस्थान, फरीदाबाद ( उर्वरक निरीक्षक का समूह " ग " पद ) भर्ती नियम , 2003 है ।

(2) ये नवम्बर, 2002 के 9वें दिन से प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और बेतनमान. उक्त पदों की संख्या , उसका वर्गीकरण और उसके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अईवाएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संबंधित अम्य बातें वे होंगी, जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

[PART II-SEC. 3 (i) ] 4. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है , और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. - इन नियमों की कोई भी बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों से भिन्न । )

8. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

: आवश्यक:-किसी मान्यताप्राप्त विश्वविद्यालय से कृषि रसायन विज्ञान /मृदा विज्ञान/ रसायन विज्ञान में एम.एस.सी. डिग्री या समतुल्य।

वांछनीय : - उर्वरक संबंधित कार्य करने या उसका विश्लेषण करने का एक वर्ष का अनुभव।

टिप्पण 1 : अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में कर्मचारी चयन आयोग केविवेकानुसार शिथिल की जा सकती है । 2381 [ भाग II- खण्ड 3 (i ) ]

टिप्पण-2 : अनुभव संबंधी अर्हता ( अर्हताएं ) कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है (हैं ) जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

टिप्पण: पदधारी के प्रतिनियुक्ति या लम्बी बीमारी या अध्ययन छुट्टी या किन्हीं अन्य परिस्थितियों में एक वर्ष या इससे अधिक अवधि के लिए बाहर रहने के कारण हुई रिक्तियां केन्द्रीय सरकार के निम्नलिखित अधिकारियों में से प्रतिनियुक्तिके आधार पर भरी जा सकेंगी अर्थात्:-

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं, या

स्पष्टीकारक ज्ञापन

केन्द्रीय उर्वरक क्वालिटी नियंत्रण और प्रशिक्षण संस्थाम, फरीदाबाद ( समूह " ग " और समूह " ब" पद) भर्ती नियम, 1997 ( जिसमें इसमें इसके पश्चात्मूल नियम कहा गया है ) सा.का.नि. 398 तारीख 19 अप्रैल, 1983 के द्वारा संशोधित किए गए इसके अनुसार कतिपय पदों जिसमें उर्वरक निरीक्षक का समूह " ग " पद भी सम्मिलित है से संबंधित भर्ती नियमों को समाविष्ट किया गया । उर्वरक निरीक्षक के उक्त पद से संबंधित भर्ती नियमों को पुनरीक्षित करने के लिए केन्द्रीय उर्वरक गुणवत्ता नियंत्रण और प्रशिक्षण संस्थान , फरीदाबाद ( समूह " ग " और " घ " पद ) भर्ती संशोधन नियर्स, 2002 ( भारत के राजपत्र भाग, II खंड 3 उपखंड ( i ) में अधिसूचना संख्या सा.का.नि. 465 तारीख 24 अक्तूबर, 2002 द्वारा 9 नवम्बर, 2002 को प्रकाशित ) द्वारा मूल नियम संशोधित किए गए । जबकि लोक सभा सचिवालय द्वारा यह पाया गया कि अनुसूची के स्तंभ 8 में अनुभव की अवधि विनिर्दिष्ट नहीं हैं, और स्तंभ 6 और 7 की प्रविष्टियों में गड़बड़ी है , जांच पर यह पाया गया कि मूल नियम सा.का.नि. 465 तारीख 24-10-2002 के स्तंभ के शीर्ष मूल नियमों के स्तंभ के शीर्ष से टैली नहीं करती और इस प्रकार उक्त अधिसूचना तारीख 24-10-2002 का शुद्धिपत्र भी त्रुटि ठीक करने में असमर्थ रहा । इसलिए, मूल नियमों से उर्वरक निरीक्षक के पदों से संबंधित भर्ती नियमों को असंबद्ध करने के लिए है और भर्ती नियमों का अलग सेट भूतलक्षी प्रभाव से जिससे केन्द्रीय उर्वरक गुणवत्ता नियंत्रण और प्रशिक्षण संस्थान , फरीदाबाद समूह " ग " और " घ " भर्ती नियम, 2002 लागू हुआ था, जारी किया जाना प्रस्तावित है । यह प्रमाणित किया जाता है कि इन प्रस्तावित नियमों को भूतलक्षी प्रभाव देकर लाने से किसी पर भी कोई प्रतिकूल प्रभाव नहीं पड़ेगा ।

G.S.R. 381. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Fertilizer Quality Control and Training Institute , Faridabad ( Group C and D posts ) Recruitment Rules, 1977, in so far as they relate to the Group C post of Fertilizer Inspector, except as respects things done or omittedto be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the Group C post of Fertilizer Inspector in the Central Fertilizer Quality Control and Training Institute, Faridabad, Department ofAgriculture and Cooperation, Ministry ofAgriculture , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation , Central Fertilizer Quality Control and Training Institute , Faridabad (Group ' C' post of Fertilizer Inspector) Recruitment Rules, 2003.

(2) They shall be deemed to have come into force on the 9th day ofNovember, 2002 .

2. Number of Posts , its classification and the scale of pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3.Methodof Recruitment, age limit, qualifications, etc. The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be specified in columns (5) to ( 14 ) of the said Schedule.

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, itmay, by order, for reasons to be recorded in writing , relax any ofthe provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

Note 2 : The qualification regarding experience is relaxable at the discretion of the Staff Selection Commission/ competent authority in the case of candidates belonging to the Scheduled Castes or Scheduled Tribes if at any stage of selection the Staff Selection Commission/ competent authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them.

EXPLANATORY MEMORANDUM

The Central Fertilizer Control Laboratory, Faridabad ( Group ' C ' and Group ' D ' posts) Recruitment Rules , 1977 (hereafterreferred to as the principal rules) were amended vide G.S.R. 398 dated the 19th April , 1983 so as to incorpbrate therein the recruitment rules relating to certain posts including the Group ' C ' post of Fertilizer Inspector . The principal rules were amended by the Central Fertilizer Quality Control and Training Institutc, Faridabad (Group ' C' and ' D' posts) Recruitment Amendment Rules , 2002 [Published in the Gazette of India, Part II , Section 3 , Sub-section ( i ) dated the 9th November , 2002 , vide notification number G.S.R. 465 dated the 24th October, 2002 ] revising the recruitment rules relating to the aforesaid post of Fertilizer Inspector. However , it has been observed by the Lok Sabha Secretariat that in column 8 of the Schedule , the duration ofexperience has not been specified. Further the entries in columns 6 and 7 were jumbled. On examination , it has been found that the column headings of G.S.R. 465 dated 24-10-2002 do not tally with the column headings of the principal rules and hence a corrigendum to the said notification dated 24-10-2002 will not be able to rectify the mistakes. It is , therefore , proposed to delink the recruitment rules relating to the post of Fertilizer Inspector from the principal rules and issue a fresh set of recruitment rules with retrospective effect, that is from the date on which the Central Fertilizer Control Laboratory, Faridabad ( Group ' C ' and Group 'D ' posts ) Recruitment (Amendment ) Rules, 2002 came into force . It is certified that none will be adversely affected by bringing the proposed rules with retrospective effect .

सा.का.नि. 382.- संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रपति एत‌द्वारा आशुलिपिक ग्रेड-1 ( क्षेत्र संकार्य प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन ) भर्ती नियमवली , 2002 में संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: - ( i ) इन नियमों को आशुलिपिक ग्रेड- I ( क्षेत्र संकार्य प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन ) भर्ती नियमवली , 2003 कहा जाएगा । (ii ) ये सरकारी राजपत्र में इनके प्रकाशित किए जाने की तारीख से लागू होंगे ।

2. आशुलिपिक ग्रेड -1 ( क्षेत्र संकार्य प्रभाग , राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठन ) भर्ती नियमवली , 2002 में,

(i ) नियम 6 के पश्चात् शीर्षक" अनुबंध- सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्रालय में आशुलिपिक ग्रेड-1 के लिए भर्ती नियमावली ", हेतु" अनुसूची" शीर्षक को प्रतिस्थापित किया जाए;

( ii ) इस प्रकार प्रतिस्थापित अनुसूची शीर्षक के पश्चात् और उसके बाद की प्रविष्टियों , कोष्ठकों, शब्दों, अक्षरों और आंकड़ों " ( दिनांक 16-5-86 के का.ज्ञा. सं. एबी-14017/29/ 85 - स्था. ( आरआर ) ( पी.टी. ) हेतु अनुलग्नकों को) " हटा दिया जाए।

( iii) अनुबंध- II और उसके बाद की प्रविष्टियों को हटा दिया जाए ।

2. रेल दावा अधिकरण ( प्रक्रिया ) नियम, 1989 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) में, नियम 22 के स्थान पर, 9 जुलाई, 2001 से निम्नलिखित रखा जाएगा , अर्थात्: -

" 22. ( 1 ) यदि कार्यवाहियों के किसी पक्षकार द्वारा कोई आवेदन साक्षी को समन किए जाने के किए प्रस्तुत किया जाता है तो अधिकरण ऐसा करने के कारणों को अभिलिखित करते हुए ऐसे साक्षी को हाजिर होने के लिए समन जारी करेगा जब तक कि वह यह नहीं समझता है कि उसकी हाजिरी मामले में न्यायसंगत विनिश्चय के लिए आवश्यक नहीं है ।

(2) अधिकरण , जैसे ही साक्षी की परीक्षा अग्रसर होती है , प्रत्येक साक्षी के साक्ष्य के सारांश का संक्षिप्त ज्ञापन तैयार करेगा और ऐसा ज्ञापन अभिलेख का भाग होगा:

परन्तु यदि अधिकरण को ऐसा ज्ञापन तैयार करने से निवारित किया जाता है तो वह ऐसा करने में अपनी असमर्थता के कारणों कोअभिलिखित करेगा और ऐसे ज्ञापन को स्वयं बोलकर लिखवाएगा और उस पर हस्ताक्षर करेगा तथा ऐसा ज्ञापन अभिलेख का भाग होगा ।

( 3 ) जहां साक्ष्य देने या कोई दस्तावेज प्रस्तुत करने के लिए किसी साक्षी को अधिकरण द्वारा उपनियम ( 1 ) के अधीन समन जारी किए जाते हैं वहां इस प्रकार समन किया गया व्यक्ति, ऐसे यात्रा और दैनिक भत्ते का, जैसा रजिस्ट्रारं द्वारा अवधारित किया जाए और जो यात्रा एवं अन्य व्ययों को चुकाने के लिए पर्याप्त हो, हकदार होगा ।

3. उक्तनियमों की अनुसूची 1 में ,

(i ) क्रम सं. 11 के सामने स्तंभ ( 3 ) की प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-

" उत्तर प्रदेश के गोरखपुर, देवरिया, बलिया, गाजीपुर, आजमगढ़ , मऊ, बस्ती, सिद्धार्थनगर, मिर्जापुर, राऊबर्टसगंज , जौनपुर, फैजाबाद, गोंडा, बहराइच और वाराणसी जिले ।" ;

( ii ) क्रम सं. 12 के सामने स्तंभ ( 3 ) की प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: - " उत्तर प्रदेश के आगरा, बुलंदशहर, मुरादाबाद, बिजनौर, मथुरा , गाजियाबाद, मेरठ , अलीगढ़ और सहारनपुर तथा उत्तरांचल के हरिद्वार और देहरादून जिले। ";

1. (1) These rules may be called the Railway Claims Tribunal (Procedure ) Amendment Rules, 2003 .

(2) Save as otherwise provided, they shall come into force on the date of their publication in the Official Gazette .

2. In the Railway Claims Tribunal (Procedure ) Rules , 1989 ( hereinafter referred to as the said rules ) , for rule 22 the following rule shall be substituted with effect from the 9th July, 2001 , namely :---

"22( 1 ) . If an application is presented by any party to the proceedings for summoning of witness , the Tribunal shall issuc summons for the appearance of such witness with recording the reasons for doing so , unless it considers that his appearance is not necessary for the just decision of the case..

(2) The Tribunal shall make a brief memorandum of the substance of the evidence of every witness as the examination of the witness proceeds and such memorandum shall form part of the record:

Provided that if the Tribunal is prevented from making such memorandum , it shall record the reasons of its inability to do so and shall cause such memorandum to be made in writing from its dictation and shall sign the same, and such memorandum shall form part of the record .

(3) Where summons are issued by the Tribunal under sub- rule (1 ) to any witness to give evidence or to produce any document , the person so suminoned shall be entitled to such travelling and daily allowance, sufficient todefray the travelling and other expenses , as may be determined by the Registrar. "

3. In the said rules in Schedule I ,

(i) against serial number 11 , in column 3 , for the entrics , the following entry shall be substituted, namely :--- "Districts ofGorakhpur , Deoria, Ballia, Gazipur, Azamgarh, Mau, Basti , Siddarthnagar , Mirpur , Robertsganj , Jaunpur, Faizabad , Gonda, Behraich and Varanasi of Uttar Pradesh. " ;

(ii) against serial number 12 , in column 3 , for the entries, the following entry shall be substituted, namely:- "Districts of Agra, Bulandshahar, Moradabad, Bijnore , Mathura, Ghaziabad, Meerut, Aligarh and Saharanpur ofUttar Pradesh and district of Haridwar and Dehradun of Uttranchal . " ;

[PART II-SEC . 3 ( i ) ] सहायक अनुसंधान अधिकारी ( रसायन विज्ञान ) के पदों से है , और केन्द्रीय जल और विद्युत आयोग ( जल स्कंद ) वर्ग- II और वर्ग- III अराजपत्रित ( वैज्ञानिक ) पद भर्ती नियम , 1971 को जहां तक उनका संबंध ज्येष्ठ अनुसंधान सहायक ( रसायन विज्ञान ) और ज्येष्ठ अनुसंधान सहायक ( भौतिक विज्ञान ) के पदों से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, केन्द्रींय जल आयोग में अनुसंधान अधिकारी, सहायक अनुसंधान अधिकारी और अनुसंधान सहायक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय जल आयोग ( समूह ' क ' और समूह ' ख ' वैज्ञानिक ) पद भर्ती नियम, 2003 है ।

( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा , अर्हता आदि. उक्त पदों पर भर्ती की पद्धति, आयु - सीमा, अर्हताएं और उनसे सम्बन्धित अन्य बातें 'वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रबर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन विनियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

12. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा मेंवे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा

ऐसा सहायक अनुसंधान अधिकारी जिसने उस श्रेणी में पाँच वर्ष नियमित सेवा की है । टिप्पण :-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/ पात्रता सेबा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसीअर्हक/पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नतिके लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

1. प्रतिनियुक्ति: केन्द्रीय सरकार या राज्य सरकार के अधीन ऐसे अधिकारी:-

(क) ( i ) जो मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ii ) जिन्होंने मूल काडर/विभाग में 6500-10500/- रु. या समतुल्य वेतनमांन वाले पदों पर पाँच वर्ष नियमित सेवा की है ; और

(ख) ( i ) जिनके पास किसी मान्यताप्राप्त विश्वविद्यालय से रसायन विज्ञान में मास्टर डिग्री या समतुल्य है , और

( ii ) रसायन विज्ञान के अनुसंधान क्षेत्र में तीन वर्ष का व्यावहारिक अनुभव है ।

टिप्पण 1 : - प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर से बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 2 :-पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

टिप्पण 1 : अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल क। जा सकती है । टिप्पण 2 : अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचिंत जनजातियों के अभ्यर्थियों की दशा में तब शिंथिल की जा सकती है ( हैं ) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Central Water and Power Research Station , Poona , Class - I and Class - II (Engineering and Scientific) Posts Recruitment Rules , 1966 , in so far as they relate to the posts of Research Officer and Assistant Research Officer (Chemistry) and the Central Water and Power Commission ( Water Wing ) Class - II and Class - III , Non -Gazetted ( Scientific) Posts Recruitment Rules , 1971 in so far as they relate to the posts of Senior Research Assistant ( Chemistry ) and Senior Research Assistant ( Physics) , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Research Officer , Assistant Research Officer and Senior Research Assistant in the Central Water Commission, namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Central Water Commission ( Group ' A' andGroup ' B' Scientific) Posts Recruitment Rules , 2003.

= (2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , its classification and scale of pay. The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications. The method of recruitment to the said posts, age -limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification. No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(3) who , having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commisson, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.--Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

सा.का.नि. 386.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रशिक्षण निदेशालय (वर्ग- III ) पद भर्ती नियम, 1974 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, प्रशिक्षण महानिदेशालय महिला उपजीविका प्रशिक्षण को छोड़कर रोजगार और प्रशिक्षण महानिदेशालय में समूह ' ख' पदों पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम प्रशिक्षण महानिदेशालय, महिला उपजीविका प्रशिक्षण को छोड़कर रोजगार और प्रशिक्षण महानिदेशालय ( समूह " ख " गैर तकनीकी पद ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हवाएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्तिका पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय -समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ii ) जिन्होंने मूल काडर/ विभाग में 5000-8000 रुपए या समतुल्य वेतनमान में नियमित आधार पर उस श्रेणी में नियुक्ति के पश्चात् तीन वर्ष सेवा की है ; और जिनके पास प्रशासन रोकड़ और लेखा मामलों में दो वर्ष का अनुभव है ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में है प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति/संविदा की अवधि, जिस के अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहींहोगी। प्रतिनियुक्ति पर नियुक्ति ( जिस के अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्षसे अधिक नहींहोगी ।

G.S.R. 386. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Directorate of Training (Class III Posts) Recruitment Rules , 1974, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitmentto the Group B posts in the Directorate ofTraining (except Women Occupation Training) , Directorate General ofEmployment and Training , namely:-

1. Short title and commencement .( 1 ) These rules may be called the Directorate of Training (except Women OccupationTraining), Directorate General ofEmployment and Training ( GroupB, Non- Technical Posts) Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette.-

2. Number of posts , classification and scale of pay. The number of post , its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexedto these rules .

3. Method of recruitment , age limit and qualifications, etc. The method of recruitment, age limit, qualifications and other matters relating thereto the said post shall be specified in columns 5 to 14 of the said Schedule aforesaid.

4. Disqualification. No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who , having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Qualification ( s ) are relaxable at the discretion of the Staff Selection Commission in case of candidates otherwise well qualified.

Note 2: The qualification( s ) regarding experience is/ are relaxable at the discretion of the Staff Selection Commission in case of candidates belonging to the Scheduled Castes or Scheduled Tribes , if at any stage of selection , the Staff Selection Commission is of the opinion that sufficient number of candidates from these Comntunities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note : Wherejuniors who have completed their qualifying/ eligibility service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ cligibility service or two years, whichever is less , and have successfully com- pleted their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/ eligibility service .

Deputation :

Officers of the Central or State Governments or Union territories :

(i ) holding analogous posts on regular basis in the parent cadre/ departmerit; or

( ii ) with three years' service in the grade rendered after appointment thereto on regular basis in the pay scale of Rs . 5000-8000 or equivalent inthe parent cadre/ department ; and

possessing two years experience in administration , cash and accounts matters .

The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation . Similarly, deputationist shall not be eligible for consideration for appointment by promotion .

(Period of deputation including period of deputation an another ex- cadre post held immediately preceding this appointment in the same orsome other organization/department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications ) .
