सा. का. नि. 413.-केन्द्रीय सरकार, केन्द्रीय औद्योगिक सुरक्षा बल नियम, 2001 के नियम 3, 4 , 19 और 20 के साथ पठित केन्द्रीय औद्योगिक सुरक्षा बल अधिनियम , 1968 ( 1968 का 50 ) की धारा 22 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय औद्योगिक सुरक्षा बल में सहायक कमांडेट ( कनिष्ठ प्रशासनिक अधिकारी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय औद्योगिक सुरक्षा बल , सहायक कमांडेट ( कनिष्ठ प्रशासनिक अधिकारी) भर्ती नियम 2003 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद- संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें 3. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. आरंभिक गठन: इन नियमों के आरंभ की तारीख पर केन्द्रीय औद्योगिक सुरुक्षा बल में नियमित या दीर्घ निबंधन के आधार पर महायक कमांडेंट ( कनिष्ठ प्रशासनिक अधिकारी ) का पद धारण करने वाले व्यक्ति इन नियमों में उपबंधों के अनुसरण में नियुक्त हुए समझे जाएंगे । 5. निरर्हता : वह व्यक्ति
( क) जिसने ऐसे व्यक्ति से जिमका पति या जिसकी पत्नी जीवित हैं , विवाह किया है, या
( ग्त्र ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है .
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राह है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखवद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बावत, आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षणों. आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व मैनिकों और अन्य विशेप प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित हैं ।

1 ) अस्सी प्रतिशत ऐसे निरीक्षक ( अनुसच्चिषीय/लेखा ) से जिसने उस श्रेणी में तीम वर्ष नियमित सेवा की है और जो किसी मान्यताप्राप्त बोर्ड से मैट्रिक परीक्षा या समतुल्य उत्तीर्ण हो और चिकित्सा प्रवर्ग शेप-1 में हैं । ) 1
(2 ) बीस प्रतिशत ऐसे निरीक्षक ( आशुलिपिक ) से जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है और जो किसी मान्यताप्राप्त बोर्ड से मैट्रिक परीक्षा या समतुल्य उत्तीर्ण ही और चिकित्सा प्रवर्ग शेप -1 में हैं ।
टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षिक अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
टिप्पण 2 : प्रोन्नति की पात्रता सूची अपनी श्रेणी या पद पर विहित पात्रता सेवा को अधिकारियों द्वारा पूरी करने की तारीख के प्रतिनिर्देश से तैयार की जाएगी ।

G.S.R. 413. In exercise of the powers conferred by Section 22 of the Central Industrial Security Force Act, 1968 ( 50 of 1968 ) read with rules 3, 4, 19 and 20 of the Central Industrial Security Force Rules , 2001 , the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Commandant (Junior Administrative Officer) in the Central Industrial Security Force , namely:-
1. Short title and commencement. ( 1 ) These rules may be called the Central Industrial Security Force, Assistant Commandant ( Junior Administrative Officer ) , Recruitment Rules , 2003.
(2 ) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , classification and scale of pay - The number of posts , classification and scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment , age- limit, qualifications etc. The method of recruitment, age - limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule .
4. Initial constitution .-Persons holding the post of Assistant Commandant ( Junior Administrative Officer ) on a regular or long term basis in the Central Industrial Security Force on the date of commencement of these rules shall be deemed to have been appointed in accordance with the provisions of these rules
5. Disqualification-No person.-
( a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who . having a spouse living , has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post:
Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order. for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any of the class or category of persons .
7. Savings. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes . Ex - servicemen and othe special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard .

Note 2 : Theeligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post .

सा. का. नि. 414. राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और असम राइफल्सः आशुलिपिक ( श्रेणी-1 ) भर्ती नियम , 1983 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व क्रिया गया है या करने से लीप किया गया है , असम राइफल्स, गृह मंत्रालय में ज्येष्ठ निजी सचिव और आशुलिपिक श्रेणी-1 के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

आशुलिपिक श्रेणी -1 ( जिसे अब ज्येष्ठ निजी सचिव के रूप में पुनः पदाभिहित किया गया है ) के पद के नियमित धारक की 650-1040 रु . के ( पूर्व पुनरीक्षित ) वेतनमान में इस पद के 7500-12000 रु. के ( पुनरीक्षित ) वेतनमान में उन्नयन से पूर्व उपयुक्तता, उन्नयित पद पर नियुक्ति के लिए स्तम्भ 13 में उल्लिखित विभागीय प्रोन्नति समिति द्वारा प्रारंभिक रूप से निर्धारित की जाएगी और यदि उसे उपयुक्त निर्धारित किया जाता है तो वह उक्त पद के प्रारंभिक गठन के समय नियुक्त किया गया समझा जाएगा । यदि उसे उन्नयित वेतनमान में नियुक्ति के लिए अनुपयुक्त निर्धारित किया जाता है तो वह 6500-10500 रु . के पुनरीक्षित वेतनमान में बना रहेगाऔर उसके मामले का प्रत्येक वर्ष पुनर्विलोकन किया जाएगा। 1
12: प्रोन्नति: ऐसा आशुलिपिक श्रेणी- जिसने उस श्रेणी में सात वर्ष नियमित सेवा की है जिसके न हो सकने पर ऐसा आशुलिपिक श्रेणी- । जिसने आशुलिपिक श्रेणी -1 ( 5500-9000 ) और 1400-2600 ( पूर्व पुनरीक्षित ) के पूर्व पुनरीक्षित वेतनमान में आशुलिपिक श्रेणी- II में नौ वर्ष की सम्मिलित नियमित सेवा की हो जिसमें आशुलिपिक श्रेणी की श्रेणी में दो वर्ष नियमित सेवा भी है । 2517 [ भाग 1 ] -खंड 3 ( i ) ]

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
प्रतिनियुक्ति: केन्द्रीय सरकार और राज्य सरकार/ संघ राज्य क्षेत्र के अधीन ऐसे अधिकारी-
( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हैं, या
(क)
(ii) जिन्होंने मूल काडर/ विभाग में 5500-9000 रु. या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात उस श्रेणी में तीन वर्ष सेवा की है , या

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supercession of the Assam Rifles Stenographer (Grade 1 ) Recruitment Rules, 1983 , except as respects things done or omitted to be done before such supercession , the President hereby makes the following rules regulating the method of recruitmentto the posts of Senior Private Secretary and Stenographer Grade I in the Ministry of Home Affairs, Assam Rifles , namely: ----
1. Short Title and Commencement .---( 1 ) These rules may be called the Assam Rifles Stenographer (Group 'B ' Posts) Recruitment Rules , 2003 .
( 2 ) They shall come into force on the date of their publication in the Official Gazette.

2. Number of Posts , Classification and scale of pay . The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns ( 2 ) to (4 ) of the Schedule annexed to these rules .
3. Method of recruitment , age limit and other qualification . The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule .
4. Disqualification-No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living , has entered into or contracted a marriage with any person ;
shall be eligible for appointment to the said posts;
Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such persön and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The suitability of the regular holder of the post of Stenographer Grade I ( since redesigrated as Senior Private Secretary) in the pay scale of Rs . 650-1040 (Pre - revised ) prior to upgradation of this post in the scale ofRs .7500-12000 (revised) shall be initially assessed by the Departmental Promotion Committee mentioned in column 13 for appointment to the upgraded post, and if assesed suitable , he shall be deemed to have been appointed at the initial constitution of the post. If assessed not suitable for appointment to the upgraded scale ofpay he shall continue to be in the revised scale of Rs . 6500-10500 and his case would be reviewed every year .
12 : Promotion: Stenographer Grade I with seven years regular sérvice in the grade failing which combined regular service of nine years as Stenographer Grade- I (Rs . 5500-9000 ) and Stenographer Grade - II in the pre- revised pay scale of Rs. 1400-2600 (pre - revised) including two years regular service in the Grade of StenographerGrade-I .
Note: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

सा. का. नि. 415.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अखिल भारतीय स्वास्थ्य विज्ञान एवं जन स्वास्थ्य संस्थान , कोलकाता में ( श्रेणी 1 और श्रेणी 2 के पद ) नियमावली , 1975 को , जहां तक उनका संबंध सहायक अनुसंधान अधिकारी ( बायोलाजिस्ट) के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , अखिल भारतीय स्वास्थ्य विज्ञान एवं जन स्वास्थ्य संस्थान, कोलकाता में सहायक अनुसंधान अधिकारी ( जीव विज्ञामी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए मिम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम अखिल भारतीय स्वास्थ्य विज्ञान एवं जन स्वास्थ्य संस्थान कोलकाता, सहायक अनुसंधान अधिकारी ( जीव विज्ञानी ) ( समूह " ख " राजपत्रित ) भर्ती नियम, 2003 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों को उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु- सीमाऔर अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राह है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति:-इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य स्विायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित क्रनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।
टिप्पण 2: अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जासकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

(ii) जिन्होंने मूल काडर/विभाग में 5500-9000 रु. या समतुल्य वेतनमान में उस पद पर नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष सेवा कीहै, ग्रा
(iii ) जिन्होंने मूल काडर/ विभाग में 5000-8000 रु . या समतुल्य वेतनमान में इस पदपर नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष सेवा कीहै, और
(ख) जिनके पास स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हता और अनुभव है ।
(प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद'पर प्रतिनियुक्ति/संविदा की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति (जिसके अंतर्गत अल्पावधि संविदा भी है ) द्वारा नियुक्ति के लिए अधिकतम आयु सीमा प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

G.S.R. 415. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution and in supersession of the All India Institute of Hygiene and Public Health, Kolkata (Class I and II posts) Rules, 1975 in so far as they relateto the post of Assistant Research Officer (Biologist ) , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods ofrecruitment to the post ofAssistant Research Officer (Biologist) in All India Institute ofHygiene and Public Health, Kolkata, namely:----
1. Short Title and Commencement ( 1 ) These rules may be called the All India Institute ofHygiene andPublic Health. Assistant Research Officer (Biologist ) (Group ' B ' Gazetted ) Recruitment Rules, 2003.
( 2 ) They shall come into force on the date of their publication in the Official Gazette.
2. Number of Post, Classification and scale of pay. The number of said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.
3. Method of recruitment , age- limit and other qualificationsetc. The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.
4. Disqualification-No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post;
Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules .
5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions ofthese rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation, relaxation ofage - limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes the Other Backward Classes , Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा. का. नि. 416.- आम की खटाई और अमचूर श्रेणीकरण और चिन्हांकन नियम, 2003 का प्रारूप , कृषि उत्पाद ( श्रेणीकरण और चिन्हांकन) अधिनियम 1937 ( 1937 का 1 ) की धारा 3 के अपेक्षानुसार भारत के राजपत्र भाग II , खंड 3, उपखंड ( i ) तारीख 22 फरवरी, 2003 के पृष्ठ435 से 444 पर सा. का. नि. सं. 82 तारीख 10 फरवरी, 2003 द्वारा प्रकाशित किया गया था और ऐने व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां जनता को 11 मार्च, 2003 को उपलब्ध करा दी गई थीं;
और, केन्द्रीय सरकार ने , उक्त प्रारूप की बाबत , जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है;
अतः अब, केन्द्रीय सरकार, कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और आम की खटाई और अमचूर श्रेणीकरण और चिन्हांकन नियम, 1981 को, उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , निम्नलिखित नियम बनाती है, अर्थात्:-
1. संक्षिप्तनाम, प्रारम्भ और लागू होना:-
( 1 ) इन नियमों का संक्षिप्त नाम आम की खटाई और अमचूर श्रेणीकरण और चिन्हांकन नियम, 2003 है;
(2) ये राजपत्र में उनके अन्तिम प्रकाशन की तारीख को प्रवृत्त होंगे ;

2. परिभाषाएं: -
इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो:-
( i) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन का सलाहकार अभिप्रेत है;
( ii ) " प्राधिकृत पैकर " से ऐसा व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है, जिसे इन नियमों में विनिर्दिष्ट श्रेणी मानक और प्रक्रिया के अनुसार आम की खटाई और अमचूर का श्रेणीकरण और चिन्हांकन करने के लिए प्राधिकार प्रमाण- पत्र अनुदत्त किया गया है ;
(iii) " प्राधिकृत प्रमाण - पत्र " से सांधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के उपबंधों के अधीन श्रेणी अभिधान चिन्ह से आम कीखटाई और अमचूर का श्रेणीकरण और चिन्हांकन करने के लिए किसी व्यक्ति या व्यक्तियों के निकाय को प्राधिकृत करते हुए जारी किया गया प्रमाण- पत्र अभिप्रेत है;
( iv ) " साधारण श्रेणीकरण और चिन्हांकन नियम " से कृषि उत्पाद ( श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 अभिप्रेत है;
(v ) " अनुमोदित रसायनज्ञ " से आम की फांकों और अमचूर आदि का एगमार्क श्रेणीकरण, परीक्षण करने के लिए सक्षम प्राधिकारी द्वारा अनुमोदित रसायनज्ञ अभिप्रेत है;
(vi ) " अनुमोदित प्रयोगशाला " से एगमार्क श्रेणीकरण के लिए कच्चे आम की फांकों और अमचूर के परीक्षण के लिए सक्षम प्राधिकारी द्वारा अनुमोदित प्रयोगशाला अभिप्रत है;
(vii ) " श्रेणी अभिधान चिन्ह" से नियम 5 में निर्दिष्ट एगमार्क अधिकार चिन्ह अभिप्रेत है;
(viii) " अनुसूची" से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।
3. श्रेणी अभिधान:-
आम की खटाई और अमचूर की क्वालिटी उपदर्शित करने के लिए श्रेणी अभिधान अनुसूची 2 और अनुसूची 3 के स्तम्भ 1 में यथावर्णित अनुसार होगा ।
4. क्वालिटी की परिभाषा:-
ऐसे श्रेणी अभिधान और साधारण लक्षणों द्वारा उपदर्शित क्वालिटी अनुसूची 2 के स्तंभ 2 से 8 और अनुसूची 3 के स्तंभ 2 से 7 में प्रत्येक श्रेणी अभिधान के सामने उपवर्णित प्रकार की होगी ।
5. श्रेणी अभिधान चिन्ह: -
श्रेणी अभिधान चिन्ह में " एगमार्क अधिकार चिन्ह " होगा जो अनुसूची 1 में दिए गए डिजाइन के अनुरूप होगा जिसमें प्राधिकारी प्रमाण-पत्र संख्यांक, शब्द" एगमार्क ", वस्तु का नाम और श्रेणी अभिधान समाविष्ट होंगे।
6. पैकिंग की रीति: -
( i ) श्रेणीकृत वस्तु ठोस , स्वच्छ और सूखे आधानों में पैक की जाएगी जो 200 गेज के उच्च घनत्व अस्त्र वाले कागज, कपड़े, पॉलीपाउचों, जूट के थैलों, टिन प्लेटों के बने हों और जिनमें पालिथिलीन , कांच की बोतल , प्लास्टिक आधान, पॉलीवोवन या किसी अन्य पैकिंग सामग्री के बने हों जो क्रेता द्वारा अपेक्षित हो या कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत अन्य अधिकारी द्वारा साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 11 के अनुसार अनमोदित की जाएगी , परंतु पैकिंग सामग्री खाद्य अपमिश्रण निवारण नियम , 1955 के अधीन अनुज्ञात खाद्य श्रेणी क्वालिटी की बनाई जाएगी;
(ii ) आधान कीटग्रसन, फफूंदी संदूषण और किसी अवांछनीय गंध से मुक्त होगा;
(iii ) एक ही श्रेणी अभिधान और एक ही लाट/ बैच की श्रेणीकृत सामग्री वाले उपभोक्ता पैकेटों को उपयुक्त संख्या में एक बड़े आधान में जैसे लकड़ीके मंजुषों, गत्तों के डिब्बों आदि में पैक किया जाएगा;

[PART II- SEC . 3 (i) ] ( iv ) प्रत्येक आधान को, कृषि विपणन सलाहकार द्वारा अनुमोदित रीति से सुरक्षित रूप से बंद किया जाएगा और यथोचित रूप से सीलबंद किया जाएगा;
(v ) आम की खटाई या अमचूर ऐसे आधानों में पैक किया जाएगा जो उत्पाद की स्वास्थ्यकर, पौष्टिक, प्रौद्योगिकीय और इंद्रिय ग्राह्य क्वालिटी की सुरक्षा करेंगे;
( vi ) प्रत्येक पैकेज में केवल एक ही श्रेणी अभिधान की आम की खटाई या अमचूर होगा;
(vii ) आम की खटाई या अमचूर समय - समय पर कृषि विपणन सलाहकार द्वारा जारी अनुदेशों के अनुसार पैक आकारों में पैक किए जाएंगे ।
7. चिन्हांकन की पद्धति:-
( i ) श्रेणी अभिधान चिन्ह कृषि विपणन सलाहकार या उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 11 के अनुसार अनुमोदित रीति में मजबूती से आम की खटाई और अमचूर के प्रत्येक आधान पर चिपकाया जाएगा या स्पष्ट रूप से और अमिट रूप से मुद्रित किया जाएगा;
( ii ) श्रेणी अभिधान चिन्ह के अतिरिक्त प्रत्येक आधान पर निम्नलिखित विशिष्टियां स्पष्ट और अमिट रूप से चिन्हांकित की जाएंगी :
( क ) प्राधिकृत पैकर का नाम और पता;
( ख ) पैकिंग का स्थान;
(ग ) पैकिंग की तारीख;
( घ ) लॉट/बैच संख्यांक;
(ङ) शुद्ध वजन;
( च ) कीमत ( सभी करों सहित ) ;
(छ) मास वर्ष से पूर्व सर्वोत्तमः
(ज) खाद्य अपमिश्रण निवारण नियम, 1955 या बाट और माप मानक ( पैक की हुई वस्तु) नियम, 1977 के अधीन कोई अन्य अपेक्षाएं।
( iii ) यह सुनिश्चित करने के लिए उचित ध्यान दिया जाएगा कि चिन्हांकन के लिए प्रयुक्त स्याही उत्पाद को संदूषित न करे;
( iv ) प्राधिकृत पैकर कृषि विपणन सलाहकार या उसके द्वारा इस निमित्त सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी से पूर्व अनुमोदन अभिप्राप्त करने के पश्चात्, साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम , 11 के अनुसार श्रेणीकृत पैकेजों पर अपना प्राइवेट व्यापार चिन्ह या व्यापार ब्रांड लेबल चिपकाएगा, परंतु इससे श्रेणीकृत पैकेजों पर चिपकाए गए श्रेणी अभिधान चिन्ह से भिन्न वस्तु की क्वालिटी या श्रेणी उपदर्शित नहीं हो ।
8. प्राधिकृत प्रमाण पत्र की मंजूरी के लिए विशेष शर्तें:-
साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के नियम 3 के उपनियम ( 8 ) में विनिर्दिष्ट शर्तों के अतिरिक्त आम की खटाई और अमचूर के श्रेणीकरण और चिन्हांकन के लिए प्राधिकार प्रमाण- पत्र के अनुदान के लिए निम्नलिखित अतिरिक्त शर्तें होंगी :
(i ) प्राधिकृत पैकर, आम की खटाई और अमचूर की क्वालिटी के परीक्षण के लिए कृषि विपणन सलाहकार द्वारा या उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अहिंत रसायनज्ञ द्वारा साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के नियम 9 के अनुसार चलाई जाने वाली अपनी प्रयोगशाला स्थापित करेगा या राज्य श्रेणीकरण प्रयोगशाला में या इस प्रयोजन के लिए अनुमोदित प्राइवेट वाणिज्यिक प्रयोगशाला में पहुंच रखेगा;
( ii ) प्रसंस्करण, प्रेषण और पैकिंग के लिए परिसर को पूर्णतया स्वास्थ्यप्रद, स्वच्छ दशाओं में उचित हवादार और सही प्रकाशमय व्यवस्थाके साथ रखेगा;

(iii) इन संक्रियाओं में लगे कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संक्रामक, संचारी और सांसर्गिक रोगों से मुक्त होंगे;
(iv) नमूने लेने, अन्वेषण करने, सीलबंद करने , पैकजों पर चिन्हांकन करने, अभिलेख का रख - रखाव और विवरणी आदि को प्रस्तुत करने की पद्धति से संबंधित ऐसे सभी अनुदेशों का जो सभी कृषि विपणन सलाहकार या उसके द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी द्वारा समय - समय पर जारी किए जाएं, प्राधिकृत पैकर और अनुमोदित रसायनज्ञ द्वारा कळीरता से अनुपालन किया जाएगा;
(v ) परिसर में पक्के फर्श के साथ पर्याप्त भंडारण सुविधाएं होंगी और वे कृन्तक और कीटग्रसन से मुक्त होंगे ।

[PART II- SEC . 3 (i )] स्पष्टीकरण:
( 1 ) बाह्य पदार्थ :-
( i ) अकार्बनिक बाह्य पदार्थ में धात्विक टुकड़े, मिट्टी कण , धूल, पत्थर, मिट्टी के कण , चिकनी मिट्टी और कीचड़ समाविष्ट होगा ।
( ii ) कार्बनिक बाह्य पदार्थ जैसे भूसी , डंठल और घास फूस ।
(2) 15 मि.मी. से कम लंबी फांक-15 मि.मी. से कम लंबी फांकों को फांक के एक कोने से दूसरे कोने तक मापा जाएगा । (3) बीज आवरण- बीज आवरण बीज का बाहरी आवरण होगा ।
(4 ) क्षतिग्रस्त और रंगहीन फांकों से ऐसी फांकें अभिग्रस्त हैं जो घुनों या अन्य कीटों द्वारा खाई गई हैं और इसके अंतर्गत फफूंदी, नमी या तापन द्वारा भीतर से क्षतिग्रस्त फांकें भी हैं ।

आम की खटाई: -
( 1 ) बाहरी छिलके के साथ या उसके बिना कच्चे आम के फल का पूर्ण रूप से या उसके खाद्य भाग को सुखाया जाएगा ।
( 2 ) उचित रूप से सुखाया जाएगा, फफूंदी, कीट संक्रमण , कृन्तक संदूषण , जीवित या मृत कृन्तकों, मिलाए गए रंजक पदार्थां , क्षयकारी पदार्थ और ऐसे अन्य नुकसानदायक पदार्थ से मुक्त होगा जो स्वास्थ्य के लिए हानिकारक है ।
(3 ) इसकें खाद्य सामान्य नमक जिसे शुष्क रूप में भार के अनुसार 5 प्रतिशत की सीमा तक मिलाया जा सकेगा, के सिवाय कोई परिरक्षी नहीं होगा । (4) स्वाद तथा सुगंधित लक्षणों से युक्त होगा।
( 5 ) यह विषैली धातु ( नियम 57 ) , प्राकृतिक रूप से होने वाले विषैले पदार्थों ( नियम 57 ख ) , कीटनाशी/नाशक जीव मार अवशिष्ट (नियम-65 ) और कोई अन्य अपेक्षाएं जो समय- समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम , 1955 के आदेशात्मक उपबंधों के अधीन अधिकथित की जाएं, की सीमा के अनुरूप होगा ।
(6) 30 माइक्रोग्राम प्रति किलोग्राम से अधिक अफलाटॉक्सिन नहीं होगा ।
( 7) निम्नलिखित सूक्ष्म जैविक अपेक्षाओं के अनुरूप होगा:-

धूप में सुखाए गए कच्चे आम काअमचूर:-
( 1 ) स्वच्छ और शुष्क सुखाए गए कच्चे आम की फांकों के पेषण द्वारा अभिप्राप्त चूर्ण होगा जो स्वाद और सुगंध के लक्षणों से युक्त होगा । (2 ) बासी गंध , अप्रीतिकर गंध, कृन्तक संदूषण, फफूंद और कीट संक्रमण, बाह्य पदार्थ और मिलाए गए रंजक और वासक पदार्थ से मुक्त होगा । ( 3 ) मिलाए गए स्टार्च, क्षयकारी पदार्थों तथा ऐसे किसी अन्य नुकसानदायक पदार्थ से मुक्त होगा जो स्वास्थ्यके लिए हानिकारक हैं । (4 ) स्थूल कणों से मुक्त होगा और समाग्री का 97 प्रतिशत 700 आई.एस. माइक्रोन छलनी से निकाला जाएगा।
(5 ) इसमें खाद्य सामान्य नमक जिसे शुष्क रूप में भार के अनुसार 5 प्रतिशत की सीमा तक मिलाया जा सकेगा, के सिवाय कोई परिरक्षी नहीं होगा । (6) 30 माइक्रोग्राम प्रति किलोग्राम से अधिक अफ्लाटॉक्सिन नहीं होगा ।
(7 ) उत्पाद विषैली धातु ( नियम 57 ) , नाशक जीवमार और कीटनाशी अवशिष्ट ( नियम 65 ) , प्राकृतिक रूप से होने वाले विषैले पदार्थ ( नियम 57- ख ) और समय- समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम , 1955 के आदेशात्मक उपबंधों के अधीन अधिकथित किन्हीं अन्य अपेक्षाओं की सीमा के अनुरूप होगा ।
(8 ) निम्न प्रकार अधिकथित माइक्रोबायोलोजिकल अपेक्षाओं के अनुरूप होगा:-

G.S.R. 416.-Whereas the draft of Sundried Raw Mango Slices and Powder Grading and Marking Rules , 2003 were published as required by Section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937 ( 1 of 1937) , at pages 435 to 444 of the Gazette of India, Part II , Section 3 , Sub- section (i ) dated 22nd February, 2003 vide G.S.R. 82 , dated 10th February, 2003 inviting objections and suggestions from all persons likely to be affected;
Andwhereas copies of the said Gazette were made available to the public on 11th March, 2003;
Andwhereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 3 of the Agricultural Produced (Grading and Marking) Act, 1937 (1 of 1937) and in supersession of Sundried Raw Mango Slices and Powder Grading and Marking Rules , 1981, the Central Government hereby makes the following rules , namely:-
RULES
1. Short title and application:-
(i ) These rules maybe called Sundried Raw Mango Slices and Powder Grading and Marking Rules , 2003;
(ii ) They shall apply to Sundried Raw Mango Slices and Powder;
(iii) They shall come into force on the date of their final publication in the Official Gazette.

[PART II-SEC. 3(i ) ] 2. Definitions : -
In these rules, unless the context otherwise requires:-
(i ) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;
( ii) "Authorised packer" means a person or a body of persons who has been granted a certificate of authorisation to grade and mark the Sundried Raw Mango Slices and Powder in accordance with the grade standards and procedure specified in these rules;
(iii) "Certificate of Authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Sundried Raw Mango Slices and Powder with the grade designations mark;
( iv ) "General Grading and Marking Rules" means the General Grading and Marking Rules , 1988 ( as amended from time to time) made under Section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937 (1 of1937);
(v) "Approved Chemist " means chemist approved by the competent authority to undertake Agmark Grading, testing of the Mango Slices and Powder etc.;
(vi) "Approved Laboratory " means laboratory approved by the competent authority for testing of Raw Mango Slices and Powder for Agmark Grading;
( vii ) "Grade designation mark " means the agmark insignia referred to in Rule-5;
( viii ) " Schedule " means schedules appended to these rules.
3. Grade designation :-
The grade designation to indicate the quality of Sundried Raw Mango Slices and Powder shall be as set out in Column I of Schedule II and III.
4. Definition ofQuality:
The quality indicated by such grade designations and general characteristics shall be as set out against each grade designation in columns 2 to 9 of Schedule II and 2 to 7 of the schedule III .
5. Grade designation mark: -
The grade designation marks shall consist of" AGMARK INSIGNIA " consisting of the design incorporating the certificate of authorisation number, the word " AGMARK " , name of the commodity and grade designation resembling the design as set out in Schedule I.
6.Method of packing :---
(i ) The graded article shall be packed in sound, clean and dry containers made of paper, cloth, poly pouches, Jute bags , tin plates with inner lining of 200 guage high density polyethylene, glass bottle, plastic container, polywoven or any other packing material as may be required by the buyer and approved by the Agricultural Markcting Adviser or any officer authorised by him in this behalf as per rule 11 of the General Grading and Marking Rules , 1988 provided that the packing material is made of food grade quality as permitted under prevention of Food Adulteration Rules , 1955 .
( ii ) The container shall be free from any insect infestation , fungus contamination and free from any undesirable smell ;

( iii) Suitable number of consumer packets containing graded material of the same grade designation and from the same lot/batch may be packed in a master container such as wooden cases , card board cartons etc.; ( iv) Each container shall be securely closed and suitably sealed in the manner approved by the Agricultural Marketing Adviser .
( v) Sundried Raw Mango Slices or Powder shall be packed in containers which will safeguard the hygienic, nutritional , technological and organoleptic qualities ofthe product:
( vi ) Each package shall contain Raw Mango Slices or Powder of one grade designation only:

( vii) The Sundried Raw mango slices or powder shall be packed in the pack sizes as per instructions ofAgricultural Marketing Adviser issued from time to time.
7.Method ofMarking:-
(i) A grade designation mark shall be securely affixed to or clearly and indelibly printed on each container, Sundried Raw mango slices and powder, in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading & Marking Rules, 1988;
(ii) In addition to the grade designation mark, the following particulars shall also be clearly and indelibly marked on each container :
(a) Name and address of the authorised packer;
(b) Place ofpacking,
(c) Date ofpacking,
(d) Lot/batch number,
(e) Net weight ,
(f) Price ( inclusive of all taxes) ,
(g) Best before within. month and year,
(h) Any other requirements given under the Prevention ofFood Adulteration Rules , 1955 or the Standards ofWeight andMeasures (Packaged Commodities ) Rules, 1977.
(iii) Proper care shall be taken to ensure that the ink used for marking does not contarminate the product;
(iv) The authorised packer may, after obtaining prior approval of the Agricultural Marketing Adviser or any other officer duly authorised by him in this behalf, in accordance with the rule 11 ofthe General Grading and Marking Rules, 1988 , affix his private trade mark or trade brand label on the graded packages , provided that the same does not indicate quality or grade of the commodity different from the grade designation mark affixed to the graded packages .
8.Special conditions for grant of Certificate of Authorisation :-
In addition to the General conditions specified in sub- rule (8) ofrule 3 ofthe General Grading and Marking Rules , 1988, the following shall be additional conditions for grant of certificate of authorisation for Gracling and Marking of Sundried RawMango Slices and Powder :-
(i) The authorised packer shall either set up their own laboratory manned by a qualified chemist approved by theAgricultural Marketing Adviser or any officer authorised by him in this behalf in accordance with rule 9 ofthe General Grading and Marking Rules, 1988 for testing the quality of Sundried Raw Mango Slices and Powder or have access to the State Grading Laboratory or private commercial laboratory approved for the purpose;
(ii ) The premises for processing , grinding and packing shall be maintained in perfect hygienic , sanitary conditions with proper ventilation and well lighted arrangement .
(iii) The personnel engaged in these operations shall be in sound health and free from any infectious, communicable and contagious diseases .
(iv) Allinstructions regarding the method of sampling, analysis , sealing , marking of packages , maintenance of records and submission of returns etc. which may be issued from time to time by the Agricultural Marketing advise or any other officer duly authorised by him , shall be strictly observed by the authorised packer and the approved chemist .
(v ) The premises shall have adequate storage facilities with pucca floor and free from rodent and insect infestation.

Sundried Raw Mango Slices (Khatai ) shall--
( 1) be dried wholesome , edible part of raw mango fruit with or without the outer skin ,
(2) be reasonably dried, free from fungus, insect infestation , rodent contamination, living and dead insects , added colouring matter, flavouring matter deleterious substance and any other harmful substance which are injurious tohealth,
(3) not contain any preservative except edible common salt which may be added to the extent of 5%by weight on dry basis ,
(4) have characteristic taste and flavour,
(5) conform to the limit for poisonous metals ( rule-57) , naturally occurring toxic substances (rule 57 -B ) , insecticides/ pesticides residue ( rule -65 ) , and any other requirements as laid down under the mandatory provisions of the Prevention of Food Adulteration Rules , 1955 as amended from time to time ,
(6) not have aflatoxin more than 30 microgram/kg,
(7) conform to the microbilogical requirements as laid down below:--

Sundried raw mango powder (Amchur ) shall--
( 1 ) be the powder obtained by grinding clean and dried raw mango slices having characteristics taste & flavour, (2) be free from musty odour, objectionable flavour, rodent contamination, fungus & insect infestation , extraneous matter , added colouring and flavouring matter,
(3) be free from added starch, deleterious substance and any other harmful substance which are injurious to health.
(4) be free from coarse particles and 97 per cent of the material shall pass through 700 IS Micron sieve , (5) not contain any preservation except edible common salt which may be added to the extent of5 % by weight on dry basis,
(6) not have aflatoxin more than 30 microgram/kg,
(7) conform to the limit for poisonous metals ( rule- 57) , Pesticides and Insectisides resilie ( rule -65 ) , naturally occurring toxic substances ( rule- 57 B) , and any other requirements as laid down under the mandatory provisions of the Prevention of Food Adulteration Rules , 1955 as amended from time to time,
