भारत सरकार के मंत्रालयों ( रक्षा मंत्रालय को छोड़कर ) और केन्द्रीय अधिकारियों ( संघ राज्य क्षेत्र प्रशासनों को छोड़कर ) द्वारा विनि केअंतर्गत बनाए और जारी किए गए साधारण सांविधिक नियम ( जिनमें साधारण प्रकार के आदेश, उप- नियम आदि सम्मिलित हैं ) General Statutory Rules (Including Orders , Bye- laws etc. of a general character) issued by the Ministries of the Government of India (other than the Ministry of Defence) and by the Central Authorities (other than the Administrations of Union Territories)

सा.का.नि. 417.- केन्द्रीय सरकार सीमा सुरक्षा बल अधिनियम , 1968 (1968 का 47 ) की धारा 141 की उपधारा ( 2 ) के खंड ( ख) और ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सीमा सुरक्षा बल ( योधक ) पशु चिकित्सा अधिकारी भर्ती नियम , 2000 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल ( योधक ) पशुचिकित्सा अधिकारी भर्ती नियम, 2003है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. संख्या , वर्गीकरण और वेतनमान. उक्त पद/पदों की संख्या उसका उनका वर्गीकरण और उसका उनके वेतनमान वह होगा/होंगे, जो इससे/इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्तिका पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह संमाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के. अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

7. प्राइवेट प्रैक्टिस: इन नियमों के अधीन किसी भी पद पर नियुक्त किसी भी व्यक्ति को प्राइवेट प्रैक्टिस करने की जिसके अन्तर्गत परामर्श और प्रयोगशाला प्रैक्टिस भी सम्मिलित है , अनुज्ञा नहीं दी जाएगी ।

8. अधिवार्षिता: ( 1 ) इस काडर में पद धारण किए हुए किसी अधिकारिता की सेवानिवृत्ति उस मास के अन्तिम दिवस अपराह्न से प्रभावी होगी । जिसमें ऐसा अधिकारी साठ वर्ष की आयु का हो जाता है । जन्म की तारीख के मास के प्रथम दिन पड़ने की दशा में ऐसे अधिकारी की सेवानिवृत्ति उस मास के जिसमें वह अधिकारी साठ वर्ष की आयु का हो जाता है, पूर्ववर्ती मास के अन्तिम दिन के अपराहन से प्रभावी होगी ।

(2) किसी भी अधिकारी को साठ वर्ष की सेवानिवृत्ति की आयु से ऊपर सेवा का विस्तार नहीं किया जाएगा ।

9. सेवा की अन्य शर्तें: इस काडर में नियुक्त अधिकारी , सेवा की किसी अन्य शर्तों की बावत, जिनका इन नियमों में विनिर्दिष्ट रूप से उपबंध किया गया है, सीमा सुरक्षा बल अधिनियम, 1968 ( 1968 का 47 ) और सीमा सुरक्षा बल नियम, 1969 के अध्यधीन होगा:

परन्तु यह कि सीमा सुरक्षा बल में सहायक शल्य पशु चिकित्सक के रूप मे नियुक्ति के पश्चात् यदि वह दस वर्ष की अवधि के भीतर कहीं अन्यत्र कार्य स्वीकार करने के कारणों से भिन्न जिसके लिए काडर निर्वाधन दिया गया है सेवा से पद त्याग करता है। करती है जो वह त्याग पत्र देने की तारीख से पूर्व अपने द्वारा प्राप्त की गई तीन मास के वेतन और भत्ते के समतुल्य राशि या प्रशिक्षण प्रभार जो भी उच्च्चतर हो सरकार को प्रतिदाय करेगा/ करेगी ।

11. भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

: ( i ) ऐसा मुख्य पशुचिकित्सा अधिकारी की प्रोन्नति द्वारा जिसने उस श्रेणी में 2 वर्ष 12. प्रोन्नति/प्रतिनियुक्ति/ आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

नियमित सेवा की है साथ ही समुह " क " में कुल ( न्यूनतम ) 15 वर्ष सेवा.कीहै याजिसने समूह " क" और समूह " ख " राजपत्रित सेवा में 20 वर्ष की सम्मिलित सेवा की हो और जो चिकित्सा प्रवर्ग शेंप -1 में हो ।

(ii ) ऐसे अधिकारियों की प्रतिनियुक्ति द्वारा जो केन्द्रीय सरकार या राज्य सरकारों के पशुचिकित्सा विभाग में समतुल्य या सदृश पद धारण किए हुए हैं और जिनके पास निम्नलिखित न्यूनतम अर्हता है :

(क) पशुचिकित्सा विज्ञान और पशुपालन में बैचलर डिग्री साथ ही भारतीय पशुचिकित्सा परिषद् में रजिस्ट्रीकृत हो ।

(iii ) सेना पशु यातायात कोर के ऐसे अधिकारियों के पुर्ननियोजन द्वारा जो सेवानिवृति से पहले सदृश या समतुल्य पद धारण कर चुके हैं और जिनके पास उपरोक्त (ii ) (क) में यथाविहित अर्हताएं हैं ।

टिप्पण: प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के कस्से या किसी अन्यसंगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहींहोगी।

प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

12 : ( i ) सीमा सुरक्षा बल के ऐसा ज्येष्ठ पशुचिकित्सा अधिकारी की प्रोन्नति द्वारा जिसने उस श्रेणी में 2 वर्ष नियमित सेवा की है, और जिसने समूह " क " में कुल (न्यूनतम ) ग्यारह वर्ष सेवा की है या समूह " क " और समूह " ख " राजपत्रित सेवा में 16 वर्ष की सम्मिलित सेवा की हो और जो चिकित्सा प्रवर्ग शेप- I में हो ।

( ii ) ऐसे अधिकारियों की प्रतिनियुक्ति द्वारा जो केन्द्रीय सरकार या राज्य सरकारों के पशुपालन विभाग में समतुल्य या संदृश पद धारण किए हुए है और जिनके पास निम्नलिखित न्यूनतम अर्हता है :

केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों के लिए 5 वर्ष तक और अनुसूचित जाति/अनुसूचित जनजाति के लिए 5 वर्ष तक अन्य पिछड़े वर्गों के लिए 3 वर्ष तक शिथिल की जा सकती है । टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अन्तिम तारीख होगी जिस तक आवेदन प्राप्त किए जाने हैं । 8 : (क) भारतीय पशुचिकित्सा परिषद् अधिनियम, 1984 ( 1984 का 52 ) की पहली और दूसरी अनुसूची में यथा मान्यता प्राप्त पशुचिकित्सा विज्ञान और पशुपालन में बैचलर डिग्री । साथ ही भारतीय पशु चिकित्सा परिषद् में रजिस्ट्रीकृत हो । (ख) शारीरिकमान:

ऊंचाई 157.5 सें. मी. ( गोरखा, गढ़वाली , कुमांयुनी, डोगरा , मराठाओं के लिए 2 सें. मी. तक और आदिवासियों की बावत 3 सें. मी. तक और महिला अभ्यर्थियों के लिए 142 सें. मी. तक शिथिल की जा सकती है ) । सीना बिना फुलाए 77 सें. मी. और 82 सें. मी. फुलाने पर महिला के लिए भार- ऊंचाई, आयु के अनुपात में । सुविकसित

मानसिक और शारीरिक रूप से अच्छे स्वास्थ्य वाला और किसी शारीरिक विकृति से मुक्त होना चाहिए।

9 : लागूनहीं होता

10 : सीधे भर्ती किए जाने वाले व्यक्तियों के लिए और पुर्ननियोजित व्यक्तियों के लिए दो वर्ष ।

11 (i ) सीधी भर्ती द्वारा जिसके न हो सकने पर प्रतिनियुक्ति/आमेलन/पुनर्नियोजन द्वारा । :

: 12 (i ) ऐसे उपयुक्त व्यक्तियों की प्रतिनियुक्ति/आमेलन द्वारा जो केन्द्रीय सरकार/ राज्य सरकार के अधीन समतुल्य या सदृशं पद धारण किए हुए हैं और जिनके पास स्तम्भ 8 ( क) , ( ख ) में विहित अर्हता है ।

(ii) सेना पशुयातायात कोर में ऐसे अधिकारियों के पुनर्नियोजन द्वारा जिनके पास उपरोक्त स्तम्भ 8 ( क ) में विहित अर्हताएं हैं और प्रतिनियुक्ति के लिए आवेदन प्रस्तुत करने की अन्तिम तारीख को 56 वर्ष से अधिक का नहीं होगा ।

टिप्पण: प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति कौं अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । 2542

MINISTRY OF HOME AFFAIRS

NewDelhi , the 27th November, 2003

G.S.R. 417. In exercise of the powers conferred by clause (b) and (c ) of Sub- section (2) of Section 141 of the Border Security Force Act , 1968 ( 47 of 1968 ) , and in supersession of Border Security Force ( Combatised) Veterinary Officers Recruitment Rules , 2000 , except as respects things done or to be done before such supersession , the Central Government hereby makes the following rules , namely:-

1. Short title and commencement.--( 1 ) These rules may be called the Border Security Force (Combatised Veteri- nary Officers) Recruitment Rules, 2003. i

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number, classification and scale of pay :-The number of said posts, their classification and scales of pay shall be as specified in columns (2) to ( 4 ) of the schedule annexed to these rules .

3.Method of Recruitment , age limit, qualifications etc.-The Method of recruitment to the said posts , age limits , qualifications and other matters relating thereto shall be specified in columns ( 5) to ( 14 ) ofthe said Schedule .

4. Disqualification . No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person ;

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.-Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons , to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Třibes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders , issued by the Central Government from time to time .

7. Private Practice. No person appointed to any posts under these rules shall be permitted private practice including consultancy and laboratory practice.

8. Superannuation. ( 1 ) The retirement of an officer holding a post in the cadre shall take effect from the afternoon ofthe last day of the month in which such officer attain the age of sixty years . In case , the date of birth falls on the first day of the month, the retirement of such officer shall take effect from the afternoon ofthe last day of the month preceding the month in which such officer attains the age of sixty years .

(2) No officer shall be granted extension in service beyond the age of retirement of sixty years .

सा. का. नि. 418.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वित्त मंत्रालय ( राजस्व विभाग ) के अधीन [ तस्कर और विदेशी मुद्रा छल साधक ( सम्पति समपहरण ) अधिनियम, 1976 तथा स्वापक औषधि और मनः प्रभावी पदार्थ अधिनियम, 1985 ] के अधीन सक्षम प्राधिकारी के कार्यालय में समूह " क" और " ख " पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम वित्त मंत्रालय ( राजस्व विभाग ) सक्षम प्राधिकारी ( समूह " क " और "ख" पद ) भर्ती नियम , 2003 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वह होंगे, जो इससे उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जौ कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षण , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे ।

G.S.R. 418.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to Group ' A' and 'B' posts in the office of competent authority under the [ Smugglers and Foreign Exchange Manipulators (Forfeiture pf Property) Act, 1976 and Narcotic Drugs and Psychotropic Substances Act, 1985 ] under the Ministry of Finance (Department of Reveue) , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Finance (Department of Revenue) Competent Authority (Group ' A' and 'B ' posts) Recruitment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , its classification and scales of pay. The number of the posts, their classification and the scales of pay attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed hereto.

3. Method of recruitment, age- limit , qualification etc. The method of recruitment to the said posts , age- limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the Schedule aforesaid.

4. Disqualifications. No person,-

(b) who , having a spouse living has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said posts:

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

i सा. का. नि. 419.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और नागर विमानन विभाग ( वर्ग 1 एवं वर्ग 2 पदों ) भर्ती नियम, 1969 को जहां तक उनका संबंध उप - महानिदेशक पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , नागर विमानन मंत्रालय के नागर विमानन विभाग में उप- महानिदेशक पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम नागर विमानन विभाग ( उप - महानिदेशक ) भर्ती नियम्, 2003 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूचीके स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा और अन्यअर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्तिऔर विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रिवायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों अन्य पिछड़े वर्गों, भूतपूर्व सेनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 2557 [ भाग II- खण्ड 3 (i) ]

टिप्पण-1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण-2: प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी

G.S.R. 419. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Civil Aviation Department (Class I and Class II posts) Recruitment Rules , 1969 , in so far as they relate to the post ofDeputy Director General , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Director General in the Civil Aviation Department , Ministry of Civil Aviation , namely:

1. Short title and commencement .-( 1 ) These rules may be called the Civil Aviation Department ( Deputy Director General ) Recruitment Rules , 2003.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scales of pay. The number of the said posts , its classification anu the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Methodof recruitment , age limit and other qualifications etc .. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) ofthe said Schedule .

4. Disqualification . No person,-

(b) who , having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय खान ब्यूरो , निदेशक ( अयस्क प्रसाधन ) , मुख्य अयस्क प्रसाधन अधिकारी, अधीक्षण अधिकारी ( अयस्क प्रसाधन ) अयस्क प्रसाधन अधिकारी , उप अयस्क प्रसाधन अधिकारी, सहायक अयस्क प्रसाधन अधिकारी और सहायक अनुसंधान अधिकारी ( अयस्क प्रसाधन ) भर्ती नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा और अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधार हैं तो वहे किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्ग, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से भू-विज्ञान, अनुप्रयुक्त भू- विज्ञान या अयस्क प्रसाधन या रसायन शास्त्र या भौतिक शास्त्र में मास्टर डिग्री या समतुल्य; और (ii ) 15 वर्ष का निर्देशक अनुसंधान का अनुभव, जिसमें सुसज्जित -प्रयोगशाला या अयस्कप्रसाधन पायलेट संयंत्र का संचालन या खनिज सज्जीकरण या खनिज एग्लोमेरेशन मेंकार्य किया हो ।

टिप्पण 1.- अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग केविवेकानुसार शिथिल की जा सकती है ।

ऐसे विभागीय मुख्य अयस्क प्रसाधन अधिकारी की इस श्रेणी में दो वर्ष की नियमित सेवा, जिसके न हो सकने पर, मुख्य अयस्क प्रसाधन अधिकारी की इस श्रेणी में तीन वर्ष की नियमित सेवा और बाहरी व्यक्तियों के साथ अधीक्षण अधिकारी (अयस्क प्रसाधन ) को भी सम्मिलित रूप से साथ - साथ विचार किया जाएगा और यदि वह उस पद पर नियुक्ति के लिए चुना गया तो पद को प्रोन्नति द्वारा भरा गया माना जाएगा ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

11 : प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा ( अल्पकालिक संविदा सहित ) दोनों के न हो सकने पर सीधी भर्ती द्वारा । 12 : ऐसे अधीक्षण अधिकारी ( अयस्क प्रसाधन ) जिन्होंने नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में दो वर्ष सेवा की हो । टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है ।

प्रोन्नति/प्रतिनियुक्ति ( अल्पकालिक संविदा सहित ) केन्द्रीय सरकार या राज्य सरकार या लोक उपक्रमों या मान्यताप्राप्त संस्थानों या स्वायत निकायों या अर्द्ध सरकारी या कानूनी संगठनों के अधीन ऐसे अधिकारी:-

( क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हों; या

( ii ) जो मूल काडर या विभाग में 14300-400-18300 रु. के वेतनमान या इसके समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् इस श्रेणी में दो वर्ष सेवा की गई हो; और

(ख) स्तंभ (8 ) में सीधी भर्ती के लिए यथा विहित अनुभव और शैक्षिक अर्हताएं रखता हो ।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया 5 वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। 13 : समूह " क " विभागीय प्रोन्नति समिति ( प्रान्नति के लिए ) में निम्नलिखित होंगे :-

12 : प्रोन्नति: ऐसे अयस्कप्रसाधन अधिकारी जिन्होंने नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की हो जिसके न हो सकने पर ऐसे अयस्क प्रसाधन अधिकारी और उप अयस्क प्रसाधन अधिकारी जिन्होंने उस श्रेणी में सम्मिलित रूप से 10 वर्ष कीसेवा वाले अयस्क प्रसाधन अधिकारी के साथ में कम से कम तीन वर्ष की उस श्रेणी में तीन वर्ष की सेवा अयस्क प्रसाधन अधिकारी के साथ सम्मिलित रूप से की हो ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है । 2566

पोपक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R.420 .-In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Indian Bureau of Mines ( Group ' A' and Group ' B ' posts ) Recruitment Rules , 1964 , in so far they relate tothe posts ofDirector (Ore Dressing ) , Chief Ore Dressing Officer, Superintending Officer (Ore Dressing ) , Ore Dressing Officer, DeputyOre Dressing Officer, Assistant Ore Dressing Officer and Assistant Reserarch Officer (Ore Dressing ) except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director (Ore Dressing ) , Chief Ore Dressing Officer, Superintending Officer (Ore Dressing ) , Ore Dressing Officer, Deputy Ore Dressing Officer, Assistant Ore Dressing Officer and Assistant Research officer (Ore Dressing) in the Indian Bureau of Mines , namely :-

1. Short title and commencement. ( I ) These rules may be called the Indian Bureau ofMines , Director (Ore Dressing), Chief Ore Dressing Officer , Superintending Officer (Ore Dressing) , Ore Dressing Officer, Deputy Ore Dressing Officer, Assistant ore Dressing Officer and Assistant Research Officer (Ore Dressing) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay etc.--The number of posts , their classification and the scales ofpay attached thereto shall be as specified in columns (2) to ( 4 ) of the said Schedule.

Disqualification . No person,-

3. Method of recruitment , age limit , qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5 ) to ( 14) of the said schedule . 4.

(a) Who has entered into or contracted a marriage with a person having a spouse living ; or

(b) Who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such persons and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation ofthis rule.

5. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules, with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

(The departmental Officers in the feeder grade who are in direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion) .

सा.का.नि. 421.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सीमा सड़क संगठन, सड़क परिवहन और राजमार्ग मंत्रालय में ज्येष्ठ निजी सचिव , समूह " ख " ( राजपत्रित ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम साधारण रिजर्व इंजीनियर्स बल ( ज्येष्ठ निजी सचिव ) भर्ती नियम, 2003है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान - उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निर्हरता.-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.-केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. - इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय -समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से/ दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है ।

G.S.R. 421.-In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Private Secretary ofGroup 'B ' (Gazetted) in the Border Roads Organisation in the Ministry of Road Transport and Highways , namely:-

1. Short title and commencement . ( 1 ) These rules may be called the General Reserve Engineer Force ( Senior Private Secretary) Recruitment Rules , 2003.

(ii ) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, its classification and scales of pay. The number of the said posts , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications. The method of recruitment to he said posts , age limit, qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14 ) of the said Schedule.

4. Disqualification . No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living , has entered in or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the Personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Powers to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
