सा.का.नि. 457.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पुलिस अनुसंधान और विकास ब्यूरो , सहायक निदेशक ( विधि एकक ) और विधि सहायक भर्ती नियम, 1985 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. ( 1 ) इन नियमों का नाम पुलिस अनुसंधान और विकास ब्यूरो , सहायक निदेशक ( विधि एकक) और विधि सहायक भर्ती (संशोधन ) नियम, 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पुलिस अनुसंधान और विकास ब्यूरो, सहायक निदेशक ( विधि एकक) और विधि सहायक भर्ती नियम, 1985 की अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगा , अर्थात्: -

11. भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा यः प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

: प्रतिनियुक्तिः

12. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

केन्द्रीय सरकार और राज्य सरकारों जिसमें केंद्रीय पुलिस और राज्य पुलिस संगठन भी हैं के ऐसे अधिकारी: -

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर/ विभाग में 8000-13500 रु. या समतुल्य वेतनमान वाले पदों पर नियुक्ति के पश्चात् नियमित अधार पर उस श्रेणी में पांच वर्ष की सेवा की है; या

( iii ) जन्होंने मूल काडर/ विभाग में 6500-10500 रु. के या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में आठ वर्ष की सेवा की है ; और

( ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं:-

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से विधि में स्नातक डिग्री या समतुल्य ।

( ii ) विधि कार्य में पांच वर्ष का अनुभव ।

सशस्त्र बल कार्मिकों के लिए:-

प्रतिनियुक्ति/पुनर्नियोजन

सशस्त्रबल के ऐसे कैप्टन या समतुल्य की पंक्ति के कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किये जाने वाले हैं और जिनके पास प्रतिनियुक्ति किए जाने वाले व्यक्तिों के लिए अपेक्षित शैक्षिक अर्हताएं और अनुभव हैं पर विचार किया जएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । यदि ऐसा उपयुक्त अधिकारी पद पर वास्तविक चयन किए जाने से पूर्व सेवानिवृत्त हो गया है या उसे रिजर्व में स्थानांतरित कर दिया गया है उसकी नियुक्ति पुनर्नियोजन आधार पर होगी ( सिविल पदों के प्रतिनिदेश से अधिवर्षिता की आयु तक) 2765 भारत का राजपत्र : दिसम्बर 27 , 2003/ पौष 6, 1925

( प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि साधारणतया 3 वर्ष से अधिक नहीं होगी ) । प्रतिनियुक्तिद्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

: किसी अधिकारी की प्रतिनियुक्ति/ पुनर्नियोजन पर नियुक्ति और पुनर्नियुक्ति इन भर्ती नियमों के किसी उपबंधों पर संशोधन में शिथिलता के लिए संघ लोक सेवा आयोग से परामर्श करना आवश्यक है ।

सशस्त्र बल कार्मिकों के लिए:-

सशस्त्र बल के ऐसे कनिष्ठ कमीशन आफिसर की पंक्ति के कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किये जाने वाले हैं और जिनके पास प्रतिनियुक्ति किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक अर्हताएं और अनुभव हैं पर विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को THE GAZETTE OF INDIA : DECEMBER 27 , 2003 /PAUSA 6 , 1925

[PART II-SEC. 3 (i ) ] उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुर्नार्नयोजन पर बने रहने दिया जा सकता है । यदि ऐसा उपयुक्त अधिकारी पद पर वास्तविक चयन किए जाने से पूर्व सेवानिवृत्त हो गया है या उसे रिजर्व में स्थानांतरित कर दिया गया है उसकी नियुक्ति पुनर्नियोजन आधार पर होगी ( सिविल पदों के प्रतिनिदेश से अधिवर्षिता की आयु तक) ।

G.S.R. 457 -In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President b. makes the following rules further to amend the Bureau of Police Research and Developinent Assistant Director al Unit) and Legal Assistant Recruitment Rules, 1985 , namely :-

1 ( 1 ) These rules may be called the Bureau of Police Research and Development Assistant Director (Legal Unit ) pal Assistant Recruitment ( Amendment ) Rules , 2003 .

(2 They shall come into force on the date of their publication in the Official Gazette .

2. For the Schedule to the Bureau of Police Research and Development Assistant Director ( Legal Unit ) and Legal wut Recruitment Rules 1985, the following Schedule shall be substituted, namely :-

(a) ( i ) holding analogous post on regular basis in the parent cadre/ Department; or

(ii) with five years ' service in the grade rendered after appointment thereto on regular basis in post in the scale of pay of Rs . 8000-13500 or equivalent in the parent cadre/ Department ; or

(iii) with eight years ' service in the grade rendered after appointment thereto on regular basis in post in the scale of pay of Rs . 6500-10500 or equivalent in the parent cadre/ Department: and

(b) possessing the following educational qualifications and experience: --

(i) Bachelor's degree in Law from a recognised university or equivalent:

(ii) Five years ' experience in legal work .

ForArmed Forces Personnel Deputation/Re -employment :----

TheArmed Forces Personnel of the rank of Captain or equivalent who are due to retire or to be transferred to reserve within a period of one year and possessing the educational qualifications and experience prescribed for deputationists shall also be considered . If selected, such officers will be given deputation terms upto the date on which they are due for release from the Arined Forces . Thereafter they may be continued on re -employment terms . In case such eligible officers have been retired or have been transferred to reserve before the actual selection to the post is made , their appointment will be on re -employment basis . ( Re -employment upto the age of superannuation with reference to civil posts ) .

(Period of deputation including period of deputation in another ex-cadre post held inmediately preceding this appointment in the same or some other organization/department of the Central Govt. shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of applications ) .

सा.का.नि. 458.- राष्ट्रपति, एत‌द्वारा संविधान के अनुच्छेद 148 के खंड ( 5 ) तथा अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारतीय लेखा तथा लेखापरीक्षा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक तथा महालेखापरीक्षक के परामर्श से केन्द्रीय सिविल सेवा ( आचरण ) नियमावली, 1964 में आगे और संशोधन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. ( 1) इन नियमों का नाम केन्द्रीय सिविल सेवा ( आचरण ) संशोधन नियमावली, 2003 होगा।

(2) ये सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. केन्द्रीय सिविल सेवा ( आचरण ) नियमावली, 1964 में:-

( क ) नियम 13 के उप नियम ( 2 ) में, खंड ( i ) से ( iv ) के लिए निम्नलिखित खंड प्रतिस्थापित होंगे अर्थात्: -

(i ) समूह ' क ' के किसी पद को धारित सरकारी कर्मचारी के मामले में सात हजार रुपए;

( ii ) समूह ' ख ' के किसी पद को धारित सरकारी कर्मचारी के मामले में चार हजार रुपए;

(iii ) समूह ' ग ' के किसी पद को धारित सरकारी कर्मचारी के मामले में दो हजार रुपए; और

(iv) समूह ' घ' के किसी पद को धारित सरकारी कर्मचारी के मामले में एक हजार रुपए । " ;

(ख) नियम 13 के उप नियम ( 3 ) में, खंड ( i ) और ( ii ) के लिए निम्नलिखित खंड प्रतिस्थापित किए जाएंगे:-

" ( i ) समूह ' क' अथवा समूह ' ख ' के किसी पद को धारित सरकारी कर्मचारियों के मामले में एक हजार पाँच सौ रुपए; और ( ii ) समूह ' ग ' अथवा समूह ' घ' के किसी पद को धारित सरकारी कर्मचारियों के मामले में पाँच सौ रुपए । ";

(ग) नियम 18 के उप नियम ( 3 ) में, " 15000/- रुपए " और " 10,000/- रुपए" शब्दों और अंकों के लिए, क्रमशः " बीस हजार रुपए" और " पन्द्रह हजार रुपए " शब्द प्रतिस्थापित किए जाएंगे:-

G.S.R. 458. In exercise of the powers conferred by the proviso to article 309 and clause (5 ) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the IndianAudit and Accounts Department , the President hereby makes the following rules further to amend the Central Civil Services Conduct ) Rules . 1964. namely:-

1. ( 1 ) These rules may be called the Central Civil Services ( Conduct) Amendment Rules , 2003 .

( 2 ) They shall come into force on the date of their publication in the Official Gazette .

2. In the Central Civil Services ( Conduct ) Rules, 1964.--

( a) in rule 13. in sub - rule (2 ) for clauses ( i ) to ( iv) , the following clauses shall be substituted, namely : - "( i ) rupees seven thousand in the case of a Government servant holding any Group 'A' post:

( ii ) rupees four thousand in the case of a Government servant holding any Group ' B' post;

( iii ) rupees two thousand in the case of a Government servant holding any Group ' C ' post ; and ( iv ) rupees one thousand in the case of a Governnient servant holding any Group 'D ' post . " ;

सा. का. नि. 459.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और फिल्म प्रभाग ( समूह " क " पद ) भर्ती नियम , 1988 , का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम, फिल्म प्रभाग ( समूह " क " पद ) भर्ती ( संशोधन ) नियम, 2003 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. फिल्म प्रभाग ( समूह " क " पद ) भर्ती नियम, 1988 की अनुसूची में क्रम संख्यांक 14 से संबंधित भार साधक अधिकारी वितरण और उसमे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: -

द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

12. प्रोन्नति/प्रतिनियुक्ति/ आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा

फिल्म प्रभाग के ज्येष्ठ शाखा प्रबंधक जिन्होंने 7500-12000 रु. के वेतनमान नियमित आधार पर उस श्रेणी. में पांच वर्ष सेवा की है, जिसके न हो सकने पर ऐसे ज्येष्ठ शाखा प्रबंधक जिन्होंने आठ वर्ष ज्येष्ठ शाखा प्रबंधक और शाखा प्रबंधक ( 6500-10500 रु. ) के रूप में सम्मिलित नियमित सेवा की है, जिसमें से ज्येष्ठ शाखा प्रबंधक के रूप में तीन वर्ष नियमित सेवा की है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षिक अर्हक पात्रता सेवा के आधे से अधिक या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर 2773

श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति ( अल्पकालिक संविदा भी है ) :

1. केन्द्रीय/ राज्य/संघ राज्य क्षेत्र सरकार/ विश्वविद्यालयों/मान्यता प्राप्त अनुसंधान संस्थानों/ पब्लिकसेक्टर उपक्रमों/अर्द्धसरकारी विभाग/ कानूनी या स्वशासी संगठनों के अधीन ऐसे अधिकारी: -

(क) ( i ) जो मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए गए हैं; या

(ii ) मूल काडर/विभाग में जिन्होंने 7500-12000 रु . या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर पांच वर्ष सेवा की है; या

(iii) मूल काडर/ विभाग में जिन्होंने 6500-10500 रु. या समतुल्य वेतनमान में नियुक्ति के पश्चात् नियमित आधार पर आठ वर्ष की सेवा की हो; और

(ख) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हैं: -

(i ) किसी मान्यता प्राप्त विश्वविद्यालय से डिग्री या समतुल्य;

( ii ) किसी मान्यता प्राप्त विश्वविद्यालय/ संस्था से विपणन प्रबंधन में डिप्लोमा यासमतुल्य।

(iii ) फिल्म उद्योग से संबंधित फिल्म वितरण या व्यापारिक अनुभव और/या वाणिज्यिक व्यापार में प्रशासनिक अनुभव या सरकारी कार्यालय में स्थिति पर्यवेक्षण का पांच वर्ष का अनुभव ।

टिप्पणः पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्यसंगठन /विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि भी है, साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु- सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । 13. यदिविभागीय प्रोन्नति समिति है, तो उसकी संरचना : समूह " क " विभागीय प्रोन्नति समिति में प्रोन्नति के लिए निम्नलिखित होगे:

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रतासेवा, अपेक्षिक अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से 2778

जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है ।

टिप्पण 2 : प्रोन्नति के लिए पात्रता सूची अपनी अपनी श्रेणी या पद पर अधिकारियों द्वारा विहित अर्हता सेवा के पूरी करने की तारीख के प्रति निदेश से तैयार की "जायेगी।

प्रतिनियुक्ति.-केन्द्रीय सरकार के ऐसे अधिकारी

( क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुएहैं; या

( ii ) जिन्होंने मूल काडर या विभाग में 5000-8000 रुपये या समतुल्य वेतनमान मेंनियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में 3 वर्ष सेवा की है; और

(ख) प्रशासन या स्थापन और/या रोकड़ बजट और लेखा से संबंधित कार्य में दो वर्षकाअनुभव ।

प्रतिनियुक्तिकी अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति कीअवधिहै, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 461. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in partial supersession of the Commission of Railway Safety, Circle Offices ( Group ' C ' and Group ' D ' posts ) Recruitment Rules . 1988 in so far as they relate to the posts of Office Superintendents and Commission of Railway Safety, Technical Wing ( Group ' C ' and Group ' D' posts ) Recruitment Rules, 1988 in so far as they relate to the one post of Stenographer except in respect of things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the Group ' B ' (Non Gazetted ) posts , Office Superintendents in Circle Offices and Stenographer in the Technical Wing , of the Commission of Railway Safety in the Ministry of Civil Aviation , namely

1. Short title and commencement .-( i ) These rules may be called the Ministry of Civil Aviation , Commission of Railway Safety Group ' B ' (Non- Gazetted posts ) Recruitment Rules 2003.

( ii) They shall come into force on the date of their publication in the Official Gazette .

2.Application . These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules .

3. Number, Classification and scale of pay . The number of posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule aforesaid .

4.Method of Recruitment , age limit , and other qualification . The method of recruitment to the said posts . age- limits . qualifications and other matters connected thereto shall be as spécified in columns 5 to 14 of the said Schedule .

5. Disqualifications . No person,-

(a ) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who having a spouse living , has entered into or contracted a marriage with any person .

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do. it may by order, for reasons to be recorded in writing , relax any of the provisions of these rules in respect of any class or category of person or posts .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limits and other concessions re- quired to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from timeto time in this regard..

eligibility service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next grade alongwith theirjuniors who have already completed such qualifying or eligibility service .

Note 2 : The eligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post .

Deputation : Officers of the Central Government :--

(a) (i ) holding analogous post on regular basis in the parent grade ordepartment : or

(ii) with three years service in the grade rendered after appointment thereto on regular basis in the scale of pay of Rs . 5000-8000 or equivalent in the parent cadre or department ; and

(b) two years experience in work relating to administration or establishment and/or cash , budget and accounts .

सा. का. नि. 462.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत में पत्तन और वायुपत्तन स्वास्थ्य संगठन ( श्रेणी III और श्रेणी IV के पद भर्ती नियम 1959 ; जहां तक कि उनका संबंध सैनिट्री इंस्पैक्टर के पद से है; के अधिक्रमण में; ऐसे अधिक्रमण से पहले किये गए अथवा करने से छोड़े गए कार्य से संबंधित कार्या को छोड़कर, भारत में पत्तन और वायु पत्तन स्वास्थ्य संगठनों में सैनिटी इंस्पेक्टर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारत में पत्तन और वायु पत्तन स्वास्थ्यसंगठन ( समूह ख ) भर्ती ( संशोधन) नियम, 2003 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उसका वर्गीकरण और उनसे संबंधित वेतनमान वे होंगे , जो इन नियमां से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य भात व होगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Port and Airport Health Organisation in India (Class III and IV Post ) Recruitment Rules, 1959 in so far as they relate to the post of Sanitary Inspector, except as respects things done or omitted to be done before such supersession the President hereby makes the following Rules regulating the method of recruitment to the Post of Sanitary Inspector in the Port and Airport Health Organisations in India.

1. Short title and commencement.-( 1 ) These rules may be called the Port and Airport Health Organisations in India ( Group B. ) Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of Post , Classification and Scale of Pay. The number of said post , its classification and scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment , age limit , qualifications etc.--The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the said scheduled.

4. Disqualification. No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person , shall be cligible for appointment to the said posts:

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules , with respect to any class or category of persons .

6. Saving.--Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

[ भाग II- खण्ड 3 ( i ) ]

महानिदेशक पोत परिवहन के पद से है , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है, पोत परिवहन मंत्रालय के पोत परिवहन महानिदेशालय में सहायक महानिदेशक पोत परिवहन के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम पोत परिवहन महानिदेशालय और क्षेत्रीय कार्यालय (पाल जहाज) समूह क और ख ( असमुद्री ) पद भर्ती नियम, 2003 है ।

( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान.. •उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करने के पश्चात् इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों कीबाबत, आदेश द्वारा शिथिल कर सकेगी । 1

6. व्यावृत्ति. -इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्ण सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग केविवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 : अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल कीजा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलबध होने की संभावना नहीं है ।

11. भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

40 प्रतिशत प्रतिनियुक्ति द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा 40 प्रतिशत सीधी भर्ती द्वारा ।

प्रोन्नति:

ऐसे कार्यपालक अधिकारी ( 7450-225-11500 रु. ) वेतनमान में जिसने उस श्रेणी में सात वर्ष नियमित सेवा की है ।

12. प्रोन्नति/ प्रतिनियुक्ति/ आमेलन द्वारा भर्ती की दशा : मेंवे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, आपेक्षित अर्हका पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति-केन्द्रीय सरकार के ऐसे अधिकारी-

(क) ( i ) नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

( ii ) जिन्होंने 8000-275-13500 रु. या समतुल्य वेतनमान वाले पदों पर पांच वर्षसेवा कीहै; या

( iii ) जिन्होंने 7500-250-12000 रु. या समतुल्य वेतनमान वाले पदों पर छह वर्ष की सेवा की हो; और

(iv) जिन्होंने 7450-225-11500 रु. या समतुल्य वेतनमान वाले पदों पर सात वर्ष की सेवा की हो; और 2789 भारत का राजपत्र: दिसम्बर 27 , 2003/पौष 6, 1925

[ भाग II - खण्ड 3 ( i ) ]

(ख) जिनके पास सीधे भर्ती किए जाने वाले व्यक्तियों के लिए स्तंभ 8 के अधीन विहित शैक्षिक अर्हताएं और अनुभव हैं । (पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्तव्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे । ) ( प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकारके उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

13. यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना : समूह " क" विभागीय प्रोन्नति समिति में प्रोन्नति के लिए निम्नलिखित होगे :

1 G.S.R. 464. In exercise of the powers conferred by the proviso to article 309 of the Constitution and the supersession of the Directorate General of Shipping and Regional Offices ( Sails ) Group A and B ( Non - Technical Posts) Recruitment Rules . 2001, in so far as they relate to the posts of Assistant Director General of Shipping except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director General of Shipping in the Directorate General of Shipping in the Ministry of Shipping, namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Directorate General of Shipping and Regional Offices ( Sails ) Group ' A' and ' B ' ( Non -Technical Posts ) Recruitment Rules , 2003.

(2 ) They shall come into force on the date of their publication in the Official Gazette .

[PART II-SEC . 3 ( i ) ] 2. Number, classification and scale of pay.-- The number of said posts , their classification and the scales of pay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications etc .-- The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said scheduled .

4. Disqualification . No person ,-

(a) has entered into or contracted a marriage with a person having a spouse living ; or

(b) having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Power to rel x.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reas to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.--Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the candidates Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

The crucial date for determining the age - linut shallbe the closing date for receipt of applications from candidates in India ( and not the closing date prescribed for those in Assain , Meghalaya , Arunachal Pradesh , Mizoram, Manipur, Nagaland, Tripura, Sikkim , Ladakh Division ofJammu and Kashmir State , Lahaul and Spiti district and Pangi Sub - Division of Chamba District of Himachal Pradesh , Andaman and Nicobar Islands orLakshdweep.

(i) Degree of a recognised University of equivalent .

(ii) 5years experience in Administration and establishment matters .

Desirable :

1.Degree in Law.

2. Knowledge of Merchant Shipping laws and work connected with regulation of sailing vessels and traffic under sails.

Note 1: Qualifications are relaxable at the discretion of Union Public Service Commission in case of candidates otherwise well qualified.

Note 2 : The qulification (s ) regarding experience is/ are relaxable at the discretion of the Union Public Service Commission in the case of candidates belonging to Scheduled Castes or Scheduled Tribes, if, at any stage of selection, the Union Public Service Commission is of the opinionthat sufficient number of candidates from these communities possessing the required experience are not likely to be available to fill up the posts reserved for them .

: One year for direct recruits and promotees .

Promotion:

Executive Officer ( in the scale of Rs . 7450-225-11500 ) with seven years regular service in the grade .

12. In case of recruitment by promotion/ deputation/absorption grades from which promotion /deputation/absorption to be made

Note :-Where Juniors who have completed their qualifying/eligibi- lity service are being considered for promotion , their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/ eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade, alongwith their juniors who have already completed such qualifying/ eligibility service .

Deputation:

Officers of the Central Government

(a) (i ) holding analogous posts on regular basis; or

(ii) with 5 years regular service in posts in the scale of Rs. 8000-275- 13500 or equivalent ; or

(iii) with 6 regular service in posts in the scale of Rs. 7500-250-12000 or equivalent , or

(iv) with 7 years regular service in posts in the sale of Rs . 7450-225-

11500 or equivalent , and

(b) having the educational qualifications and experience prescribed for direct recruits under coluinn 8 .

Note: Period ofdeputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same organisation/department shall not ordinarily exceed four years .

The maximum age Imit for appointment for deputation shall not be exceeding 56 years as on the closing date of receipt of applications .

The Department Officers in the feeder category who are in direct line of promotion shall not be eligible for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.
