सा. का. नि. 1.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और राजभाषा विभाग , आशुलिपिक श्रेणी ' घ ' ( हिन्दी ) ( केन्द्रीय हिन्दी प्रशिक्षण संस्थान/हिन्दी शिक्षण योजना ) भर्ती नियम, 1990 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, केन्द्रीय हिन्दी प्रशिक्षण संस्थान/हिन्दी शिक्षण योजना, राजभाषा विभाग, गृह मंत्रालय में पुनर्सस्थित आशुलिपिक श्रेणी -1, श्रेणी- II और श्रेणी- III के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय , राजभाषा विभाग , केन्द्रीय हिन्दी प्रशिक्षण संस्थान/ हिन्दी शिक्षण योजना, आशुलिपिक श्रेणी- I , श्रेणी- II और श्रेणी- III भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.-ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ में विनिर्दिष्ट पद/पदों को लागू होंगे ।

3. पद संख्या, वर्गीकरण और वेतनमान.- उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.- उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है,

या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा समूह " ख " वर्ग के पदों के संबंध में संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

: प्रोन्नति: ऐसा आशुलिपिक ( श्रेणी II ) जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है जिसके न हो सकने पर ऐसा आशुलिपिक ( श्रेणी- II ) जिसने आशुलिपिक (श्रेणी- II ) और आशुलिपिक ( श्रेणी III ) की श्रेणी में दस वर्ष नियमित सेवा कीहै ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु , यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी भारत का राजपत्र : जनवरी 3 , 2004/पौष 13 , 1925

कर ली है, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी करी ली है ।

प्रतिनियुक्ति: केन्द्रीय सरकार के अधीन ऐसे अधिकारी:-

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii ) जिन्होंने मूल काडर/ विभाग में रु. 5000-8000 या समतुल्य वेतनमान वाले पदों पर नियमित आधार पर नियुक्ति के पश्चात्, तीन वर्ष सेवा की है; और

(ख) हिन्दी आशुलिपि में जिनकी प्रतिमिनट 100 शब्द की गति है ।

(पोषक प्रवर्ग केऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु- सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी । )

(क) ( i ) जो मूल काडर में आशुलिपिक के रूप में नियमित आधार पर सदृश पद धारण किए हुए हैं; या (ii ) जिन्होंने रु. 4000-100-6000 या समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात्, उस श्रेणी में आठ वर्ष सेवा की है ।

(प्रतिनियुक्तिकी अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ) 4

टिप्पण: आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( उनसे भिन्न जो असम , मेघालय, अरुणाचल प्रदेश, मिजोरम , मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )

8 : (i ) मैट्रिकुलेशन या समतुल्य;

टिप्पण: पदधारी के प्रतिनियुक्ति या लम्बी बीमारी या अध्ययन छुट्टी या किन्हीं अन्य परिस्थितियों में एक वर्ष या इससे अधिक अवधिके लिए बाहर रहने के कारण हुई रिक्तियां केन्द्रीय सरकार के ऐसे अधिकारियों में से प्रतिनियुक्ति के आधार पर भरी जा सकेंगी जो नियमित आधार पर सदृश पद धारण किए हुए हैं और जिनके पास सीधे भर्ती किए जाने वाले व्यक्तियों के लिए स्तंभ 8 में विहित अर्हताएं हैं ।

G.S.R. 1. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Department of Official Language , Stenographer Grade " D " (Hindi) (Central Hindi Training Institute/Hindi Teaching Scheme) Recruitment Rules , 1990 except as respects things done or omitted to be done before such supersession the President hereby makes the following rules regulating the method of recruitment to the restructured posts of Stenographer Grade - I , Grade- II and Grade - III in the Central Hindi Training Institute/Hindi Teaching Scheme , Department of Official Language, Ministry ofHome Affairs , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Home Affairs , Department of Official Language , Central Hindi Training Institute/Hindi Teaching Scheme, Stenographer Grade -I , Grade- II and Grade- III Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application. These rules shall apply to the posts as specified in column 1 of the Schedule annexed to these rules.

3. Number of post, classification and scale of pay :-The number of said posts, their classification and scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

4.Method of Recruitment , age limit, qualifications , etc.-The method of recruitment to the said posts , age limit, qualifications and matters relating thereto shall be specified in columns 5 to 14 of the said Schedule .

5. Disqualifications . No person,-

(a) whohas entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission in respect of Group " B" posts , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex- Servicemen and other special categories ofpersons in accordance with the orders, issued by the Central Government from time to time in this regard.

(ii) with three years ' service in the grade rendered after appointment thereto on regular basis in posts in the scale of pay of Rs . 5000-8000 or equivalent in the parent cadre of department; and

(b) possessing a speed of 100 words per minute in Hindi stenography.

(Thedepartmental officer in the feeder category who are in the direct line of pormotion will not be eligible for consideration for appointment on deputation . Similarly deputationists shall not be eligible for consideration for appointment by promotion . Period of deputation including the period of deputation in another ex -cadre post held immediately preceding this appointment in the same or some other Organization or Department of the Central Government shall ordinarily not exceed three years . The maximum age- limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of application. )

1. ( 1 ) इन नियमों का नाम केन्द्रीय सिविल सेवा ( वर्गीकरण , नियंत्रण और अपील) संशोधन नियमावली, 2003 है ।

( 2) ये सरकारी राजपत्र में प्रकाशन की तारीख से नब्बे दिन पश्चात् प्रवृत्त होंगे ।

2. केन्द्रीय सिविल सेवा ( वर्गीकरण , नियंत्रण और अपील) नियमावली, 1965 में नियम 10 में उप नियम 5 के पश्चात्निम्नलिखित उप नियम अंतःस्थापित किए जाएंगे , अर्थात्:-

" ( 6 ) इस नियम के अंतर्गत किए गए अथवा किया हुआ समझे गए निलंबन के किसी आदेश की समीक्षा , इस आशय के लिए गठित समीक्षा- समिति की सिफ़ारिश पर निलंबन के आदेश की तारीख के नब्बे दिन के भीतर, निलंबन में संशोधन अथवा इसे रद्द करने वाले सक्षम प्राधिकारी द्वारा की जाएगी और निलंबन की अवधि को आगे बढ़ाने अथवा इसे रद्द किए जाने के आदेश जारी करेगा । बाद की समीक्षाएँ, निलंबन की बढ़ाई गई अवधि के समाप्त होने से पूर्व की जाएंगी । निलंबन की बढ़ाई जाने वाली अवधि एक समय में 180 दिन से अधिक नहीं होगी ।

(7 ) उप नियम 5 में विहित किसी बात के होने के बावजूद भी, इस नियम के उप नियम ( 1 ) अथवा ( 2 ) के अंतर्गत किया गया अथवा किया हुआ समझा गया निलंबन का कोई आदेश 90 दिन की अवधि के पश्चात् वैध नहीं होगा जब तक कि 90 दिन की समाप्ति से पूर्व, निलंबन की अवधि, समीक्षा किए जाने के पश्चात् आगे और बढ़ा नहीं दीजाए ।"

G.S.R. 2. In exercise of the powers conferred by theproviso toArticle 309 and clause (5) ofArticle 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification , Control and Appeal ) Rules, 1965, namely :-

1. (1 ) These rules may be called the Central Civil Services ( Classification , Control and Appeal ) Amendment Rules, 2003.

(2) They shall come into force on expiry of 90 days from the date of their publication in the Official Gazette.

2. In the Central Civil Services Classification, Control and Appeal Rules , 1965 , in rule 10, after sub -rule 5 ( e) , the following sub - rules shall be added , namely :-

"(6) An order of suspension made or deemed to have beenmade under this rule shall be reviewed by the authority which is competent to modify or revoke the suspension , before expiry of 90 days from the date of order ofsuspension on the recommendation of the Review Committee constituted for the purpose and pass orders either extending or revoking the suspension. Subsequent reviews shall be made before expiry of the extended period of suspension. Extension of suspension shall not be for a period exceeding 180 days at a time .

(7) Notwithstanding anything contained in sub - rule 5(a), an order of suspension made or deemed to have been made under sub -rules ( 1 ) of (2) of this rule shall not be valid after a period of 90 days unless it is extended after review, for a further period before the expiry of 90 days . "

3. नमक क्षेत्रों ( समूह ' ग ' पदों ) भर्ती नियम, 1985 में, नमक निरीक्षण और रसायनिक सहायक के पद और उससे संबंधित प्रविष्टियां क्रम संख्या 1 के लिए अनुसूची में क्रम संख्या और प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-

: 85 प्रतिशत सीधी भर्ती द्वारा और 15 प्रतिशत प्रोन्नति द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा/उच्च श्रेणी लिपिकों औरप्रयोगशाला सहायकों के लिए क्रमशः 5 : 1 के अनुपात में प्रोन्नति होगी । पर्याप्त अभ्यर्थियों की दशा में विहित अर्हता के साथ उच्च श्रेणी लिपिक में उपलब्ध नहीं है, तो कोटे का स्थानान्नतरण प्रयोगशाला सहायकों के काडर में किया जाएगा ।

: ऐसे उच्च श्रेणी लिपिकों की श्रेणी से विज्ञान स्नातक के साथ ( रसायन सहित) प्रोन्नति और प्रयोगशाला सहायक श्रेणी -1 दोनों में आठ वर्ष नियमित सेवा की है तथा प्रयोगशाला सहायक श्रेणी -2 की श्रेणी में क्रमशः बारह वर्ष नियमित सेवा । 11. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ,

या

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

G.S.R. 4. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Lady Harding Medical College and Smt. Sucheta Kriplani Hospital , New Delhi (Laundry Supervisor ) Recruitment Rulcs. 1989, except in respects of things done or omitted to be done before such supersession the President hereby makes the following rules regulating the method of recruitment to the post of Laundry Supervisor in the Lady Harding Medical College and Smt . Sucheta Kriplani Hospital , New Delhi , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Lady Harding Medical College and Smt . Sucheta Kriplani Hospital (Laundry Supervisor ) ( Group ' C ' Post ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. The number of posts , classification and scale of pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification .-No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Govemment may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any pcrson from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

या

किसी राज्य न्यायिक सेवा का सात वर्ष का सदस्य होना चाहिए ।

या

अर्हित विधि व्यवसायी, अर्थात् अधिवक्ता ( अधिवक्ता अधिनियम, 1961 के अर्थान्तर्गत ) होना चाहिए, जिसने सात वर्ष तक उस रूप में व्यवसाय किया हो । 22

टिप्पण 1 : -उस अवधि की गणना करने में, जिसके दौरान किसी व्यक्ति ने राज्य न्यायिक सेवा में या किसी राज्य के विधि विभाग में केंद्रीय सरकार के अधीन कोई पद धारण किया है, ऐसी कोई अवधि सम्मिलित की जाएगी , जिसके दौरान उसने उपरोक्त पदों से कोई अन्य पद धारण किया है या ऐसी कोई अवधि, जिसके दौरान वह विधि व्यवसायी रहा हो ।

टिप्पण 2 :- उस अवधि की गणना करने में, जिसके दौरान कोई व्यक्ति अर्हित विधि व्यवसायी रहा हो , कोई ऐसी अवधि सम्मिलित की जाएगी , जिसके दौरान उसने राज्य न्यायिक सेवा में कोई पद धारण किया है या किसी राज्य के विधि विभाग में कोई उच्चतर पद धारण किया है या विधि कार्य में अनुभव के साथ केन्द्रीय सरकार की सेवा में रहा है।

केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) , साधारणतया पांच वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) पर स्थानान्तरण द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी।

13. यदि विभागीय प्रोन्नति समिति है, तो उसकी सरंचना

Note 2 : In computing the period during which a person has been a qualified Legal Practitioner , there shall be included any period during which he has held any office in the State Judicial Service or has held a Superior post in the Legal Department of a State or has been in the Central Government Service having experience in Legal Affairs .

[Period of deputation ( including short - term contract) in another ex- cadrepost held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not exceed five years . The maximum age limit for appointment by transfer on deputation ( including short - term contract ) shall be not exceeding 56 years as on the closing date of receipt of applications ] .
