सा. का. नि. 8.- राष्ट्रपति एतद्वारा संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, डाक विभाग के सर्किल डाक लेखा कार्यालयों में आशुलिपिक ग्रेड -1 के पदों पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों को संचार एवं सूचना प्रौद्योगिकी मंत्रालय , सर्किल डाक लेखा कार्यालय, आशुलिपिक ग्रेड-1 ग्रुप ' ख ' (अराजपत्रित ) भर्ती नियमावली , 2003 कहा जाएगा ।

(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पदों की संख्या , उनका वर्गीकरण और वेतनमान. इन पदों की संख्या, इनका वर्गीकरण और इनका वेतनमान वह होगा जो संलग्न अनुसूची के कालम ( 2 ) से (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, शैक्षिक और अन्य अर्हताएं आदि.- इन पदों पर भर्ती की पद्धति, आयु सीमा, शैक्षिक तथा अन्य अर्हताएं और उक्त पदों से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के कालम ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।

4. कार्यक्षेत्र एवं नियुक्ति प्राधिकारी:-आशुलिपिक ( ग्रेड-1 ) सर्किल संवर्ग का है तथा सर्किल के अंदर ही कहीं पर भी उन्हें स्थानान्तरित किया जा सकता है । सर्किल अध्यक्ष इस पद के लिए नियुक्ति प्राधिकारी होंगे ।

5. अनर्हताए.- वह व्यक्ति,

( 1 ) जिसने ऐसे व्यक्ति से , जिसका पति या पत्नी जीवित है, विवाह किया है अथवा विवाह का वचन दिया है , या

(2 ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है या विवाह का करार किया है, उपर्युक्त पदों में से किसी पर भी नियुक्ति का पात्र नहीं होगा:

परन्तुयदि केन्द्र सरकार का समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार पर लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. नियम शिथिल करने की शक्ति. जहां केन्द्र सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.- इन नियमों की कोई भी बात , ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्र सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

नोट : जहां भी ऐसे कनिष्ठ कर्मचारियों जिन्होंने अपनी अर्हक या योग्यता सेवा पूरी कर लीहै, तथा पदोन्नतिके लिए विचार किया जा रहा है वहां उनसे वरिष्ठ कर्मचारियों को भी पदोन्नत करने पर विचार किया जाएगा बशर्ते कि उनके पास वैसी अर्हक या पात्रता सेवाके आधे से अधिक या दो वर्ष की अपेक्षित अर्हक अथवा पात्रता सेवा, इनमें से जो भी कम हो, से कम की सेवा न हो तथा उन्होंने अपने से कनिष्ठ कर्मचारियों जो पहले ही ऐसी अर्हक या पात्रता सेवा पूरी कर चुके हैं, के साथ अगले उच्चतर ग्रेड में पदोन्नति पाने के लिए अपेक्षित परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो ।

G.S.R. 8. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade- I , in the Circle PostalAccounts Offices of the Department of Posts , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Communications and Informa- tion Technology, Circle Postal Accounts Offices , Stenographer Grade - I , Group ' B ' (Non -Gazetted) Recruitment Rules, 2003.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay.-The number of posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule annexed hereto.

3.Method of recruitment, age limit , educational and other qualifications, etc.-The method of recruitment, age limit, educational and other qualifications and other matters related thereto shall be as specified in columns ( 5) to ( 14) of schedule aforesaid.

4. Sphere of duty and appointing authority. The Stenographer (Grade I) shall constitute the circle cadre and their transfer liability will be limited within the circle . The appointing authority for the post shall be the Head of the Circle .

5.Disqualifications.--No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for the reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex -Servicemen and other special categories of persons in accordancewith the orders issued by the Central Government from time to time in this regard.

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्तिका पात्र नहीं होगा :

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम लेडी हार्डिंग मेडिकल कालेज और श्रीमती सुचेता कृपलानी अस्पताल (आर्थोप्टिशीयन ) ( समूह " ग " पद ) भर्ती नियम , 2003 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान - उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि.-उक्त. पद पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्तिको इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की हराय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उस लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम , मेघालय, अरूणाचल प्रदेश, मिजोरम , मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा-जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमाअवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

(i ) किसी मान्यताप्राप्त बोर्ड से 10 + 2 या समतुल्य अर्हता ।

( ii ) अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा मान्यताप्राप्त संस्थान से आर्थोपेटिक ( दो वर्षीय पाठ्यक्रम ) में डिप्लोमा ।

(iii ) ख्याति प्राप्त अस्पताल /संस्थान से वृत्तिक में 2 ( दो ) वर्ष का अनुभव । टिप्पणः- अनुभव संबंधी अर्हता (अर्हताएं ) सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है ( हैं ) जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है किउनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

G.S.R. 10.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Lady Hardinge Medical College and Smt . Sucheta Kriplani Hospital, New Delhi ( Group ' C ' posts ) Recruitment Rules , 1981 , in so far as they relate to the post of Orthoptician except as respect to things done or omitted to be done before such supersession the President hereby makes the following rules regulating the method of recruitment to the post ofOrthoptician namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Lady Hardinge Medical College and Smt . Sucheta Kriplani Hospital ( Orthoptician) (Group ' C ' post ) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment , age limit, qualification , etc. The method of recruitment , age limit , qualifications and her matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification. No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

1. ( 1 ) These rules may be called the Ministry of Human Resource Development (Department of Secondary and Higher Education ) Senior Systems Analyst and Programmer ( Amendment ) Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Ministry of Human Resource Development (Department of Secondary and Higher Education) Senior Systems Analyst and Programmer (Amendment ) Recruitment Rules, 2001 , against the post ofProgrammer in column 14, for the words " while making Direct Recruitment/Recruitment on deputation basis involving State Government employees or employees of Public Sector Undertakings " , the following shall be substituted, namely :-

सा. का. नि. 12.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय जल और विद्युत आयोग (जल स्कंध ) तृतीय श्रेणी ( स्टोर कीपर ) पद भर्ती नियम, 1970 को, जहां तक उनका संबंध स्टोर कीपर पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, केन्द्रीय जल आयोग के अधीनस्थ कार्यालय में स्टोर कीपर पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ.-( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय जल आयोग के अधीनस्थ कार्यालय में ( स्टोर कीपर ) भर्ती नियम, 2003 है ।

टिप्पण 2:- अनुभव संबंधी अर्हता ( अर्हताएं ) कर्मचारी चयन आयोग/सक्षम प्राधिकारी केविवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा मेंतब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग/ सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है । 38

(ख) स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित अनुभव और शैक्षिक अर्हता रखता है ।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति कीअवधि सहित साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी । )

G.S.R. 12. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofCentral Water and Power Commission ( Water Wing) Class- III (Store Keeper) Posts Recruitment Rules, 1970 , in so far as they relate to the post of Store Keeper , except as respect of things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Store Keeper in the Subordinate offices of the Central Water Commission, namely :-

1. Short title and commencement . ( 1 ) These rules maybe called the Central Water Commission, Subordinate Offices(Storekeeper) Recruitment Rules , 2003 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. The number of posts , classification and scale of pay. The number of the said post, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

39 3. Method of recruitment , age limit and other qualifications. The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so todo, it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

In respect of posts , the appointments to which are made through Employment Exchange, the crucial date for determining the age limit, in each case be the last date upto which the Employment Exchange is asked to submit the names .

Note 1 : Qualifications are relaxable at the discretion of the Staff Selection Commission/ Competent Authority in case of candidates otherwise well qualified.

Note 2 : The qualification(s ) regarding experience is/are relaxable at the discretion of the Staff Selection Commission/ Competent Authority in case of candidates belonging to the Scheduled Castes and the Scheduled Tribes if, at any stage of selection the Staff Selection Commission/Competent Authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

(b) Possessing the educational qualification and experience prescribed for direct recruits under column humber 8 .

(Period of deputation including period of deputation in another ex- cadrepost held immediately preceding this appointment in the same or some other Organization/Department ofthe Central Government shall ordinarily not exceed three years . The maximum age - limit for appointment on deputation shall not be exceeding 56 years as on the closing date for receipt of applications. )
