सा. का. नि. 60.-राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय अपराध शास्त्र एवं विधि - विज्ञान संस्थान ( आशुलिपिक श्रेणी 3 ) भर्ती नियम , 1992 को उन बातों के सिवाय अधिक्रांत करते उन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , गृह मंत्रालय के अधीन लोकनायक जयप्रकाश नारायण राष्ट्रीय अपराध शास्त्र एवं विधि- विज्ञान संस्थान में आशुलिपिक श्रेणी " घ " के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम लोकनायक जयप्रकाश नारायण राष्ट्रीय अपराध शास्त्र एवं विधि- विज्ञान संस्थान में ( आशुलिपिक श्रेणी " घ " ) भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान यह होगा, की इस नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तंभ 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो उबत अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना ऑवश्यक या समीचीन है, वहां वह, उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाषेत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षण, आधु - सीमा में छूट और अन्छ रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । G

टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख कर्मचारी चयन आयोग द्वारा नियत की जाएगी।

8. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

9. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु तथा शैक्षिक अर्हताएं, प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

10. परिवीक्षा की अवधि, यदि कोई हो

: कर्मचारी चयन आयोग के माध्यम से सीधी भर्ती द्वारा ।

11. भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

टिप्पण: पदधारी के प्रतिनियुक्ति या लम्बी बीमारी या अध्ययन छुट्टी या किन्हीं अन्य परिस्थितियों में एक वर्ष या इससे अधिक अवधि के लिए बाहर रहने के कारण हुई रिक्तियां केन्द्रीय सरकार के ऐसे पदधारियों में से जो नियमित आधार पर सदृश पद धारण किए हुए है और जिनके पास सीधी भर्ती किए जाने वाले व्यक्तियों के लिए स्तंभ 8 में विहित अर्हताएं हैं, प्रतिनियुक्ति के आधार पर भरी जाएगी ।

G.S.R. 60.-In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the National Institute of Criminology and Forensic Science (Stenographer Grade III) Recruitment Rules, 1992 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulate the method of recruitment to the post of Stenographer Grade ' D ' in the Lok Nayak Jayaprakash Narayan National Institute of Criminology and Forensic Science under the Ministry ofHome Affairs , namely :-- 1. Short title and commencement .-( 1 ) These rules may be called the Lok Nayak Jayaprakash Narayan National Institute of Criminology and Forensic Science (Stenographer Grade ' D' ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of Posts , classification and scale of pay. The number of the post , its classification and the scale ofpay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications etc. The method of recruitment, age limit , qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so , exempt any person from the operation of this rule.

5. Power to relax,-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen and other special categories of persons in accordance with the orders Issued by the Central Government from time to time in this regard.

(क) ( i ) जो मूल काडर/ विभाग में सदृश पद धारण किए हुए हैं; या

(ii ) जिन्होंने 8000-13500 रु ० या समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में नियमित पांच वर्ष सेवा की है ; या

(iii ) जिन्होंने 6500-10500 रु० या समतुल्य वेतनमान में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में नियमित आठ वर्ष सेवा की है; और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हो:

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक या समतुल्य;

(ii ) स्थापना या प्रशासन से संबंधित मामलों में पांच वर्ष का अनुभव ।

प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है, साधारणतया 3 वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्तिके लिए अधिकतम आयु सीमा, आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby the makes the following rules regulating the method of recruitment to the post of Deputy Director in the Serious Fraud Investigation Office, Department of Company Affairs , namely:-

1. Short title and commencement . ( 1 ) These rules may be called the Serious Fraud Investigation Office, Department of Company Affairs, Deputy Director (Group ' A' Post ) Recruitment Rules, 2004.

(2) They shall come into force from the date oftheir publication in the Official Gazette.

2. Number of Post, classification and scale of pay. The number of post, its classification, and the scale of pay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit, educational qualificationsetc. The method of recruitment to the said post, age limit, educational qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification ,No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person,

सा. का. नि. 63.- राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सूचना और प्रसारण मंत्रालय स्टाफ कार ड्राइवर ( श्रेणी -1 , श्रेणी-2 और साधारण श्रेणी ) और सवार हरकारा भर्ती नियम, 1995 को उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , सूचना और प्रसारण मंत्रालय के मुख्य सचिवालय में स्टाफ कार ड्राइवर (विशेष श्रेणी , श्रेणी-1 , श्रेणी-2 और साधारण श्रेणी ) और सवार हरकारा के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम सूचना और प्रसारण मंत्रालय स्टाफ कार ड्राइवर (विशेष श्रेणी, श्रेणी-1, श्रेणी-2 और साधारण श्रेणी ) और सवार हरकारा भर्ती नियम , 2004 है ।

(2) ये 28 अगस्त , 2002 को प्रवृत्त हुए समझे जाएंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । 269 [ भाग II- खण्ड 3 (i) ]

3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विविध्क अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह रासः है। कि ऐसा करना आवश्यक याःसमीचीन है , वहां बह, उसके लिएजो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ते आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अम्म विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति/पुनर्नियोजन पर स्थानांतरण

सशस्त्र बल के ऐसे कार्मिक पर भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवा निवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अपेक्षित अर्हताएं और अनुभव है, पर विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस सरीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से बीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है, साधारणतयां तीन वर्ष से अधिक नहीं होगी ।

सशस्त्र बल कार्मिक के लिए प्रतिनियुक्ति/पुनर्नियोजन पर स्थानांतरण सशस्त्र बल के ऐसे कार्मिक जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और सीधी भर्ती के लिए अपेक्षित शैक्षिक अर्हताएं और अनुभव है पर विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है, तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।

स्पष्टीकारक ज्ञापन केन्द्रीय सरकार स्टाफ कार चालकों और विक्रम सिंह बनाम भारत संघ के मामले के ओ.ए. संख्या 2529/96 में माननीय केन्द्रीय प्रशासनिक अभिकरण प्रधान पीठ के निदेश के अनुसरण में कार्मिक और प्रशिक्षण विभाग ने केन्द्रीय सरकार के संगठनों के अधीन स्टाफकार चालकों के लिए विद्यमान श्रेणी ढांचे का उपांतरण करने के लिए अन्य बातों के साथ सम्मिलित प्रस्ताव की नई श्रेणी अर्थात्5000-8000 रु. वेतनमान में' विशेष श्रेणी' 08-11-1996 से भूतलक्षी प्रभाव के साथ कार्यालय ज्ञापन संख्या 43019/54/96- ईस्ट ( डी) तारीख 15-02-2001 को जारी किया ।

पदके उपलब्धता के अध्ययधीन योग्य अभ्यर्थियों के प्रोन्नति की ' विशेष श्रेणी' को 08-11-1996 से भूतलक्षी प्रभाव से बनाया जाएगा और ऐसे मामले में बकाया 08-11-1996 के प्रभाव से दिया जाएगा और काडरों के संबंध में, जहाँ स्टाफ कार चालकों की संख्या 10 और 19 के बीच में है, कार्मिक और प्रशिक्षण विभाग, ' विशेष श्रेणी ' में स्टाफ कार चालक के एक पद के नियोजन की मंजूरी विशेष मामले में सहमत होगा जिससे कुल संख्या की संगणना 5 प्रतिशत के पदों से 0.5 और अधिक से भिन्न प्रतिशत आता हो जिससे एक पूर्ण किया जा सके । लेकिन जहाँ काडर की संख्या 10 से कम है, वहाँ केन्द्रीय सरकार संगठन के अधीन स्टाफ कार चालकों के विभिन्न काडरों के संयोजन, अन्य उदारवादी उपाय के रूप में अनुज्ञेय है, जिसे मंत्रालय एक नोडल आधार पर प्रचालित कर सके । सूचना और प्रसारण मंत्रालय स्टाफ कार चालक के आठ पद विद्यमान हैं । प्रकाशन विभाग में सूचना और प्रसारण मंत्रालय के अधीन मीडिया एकक में स्टाफ कार चालक के चार पद विद्यमान हैं । सूचना और प्रसारण मंत्रालय और प्रकाशन विभाग में स्टाफ कार चालकों काडरों को 28-08-2002 से संयोजित करने का निर्णय लिया गया है। संयोजन के आधार पर चार श्रेणियों में 12 पदों 274

G.S.R. 63. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Information and Broadcasting Staff Car Drivers (Grade - I , Grade- II and Ordinary Grade) and Despatch Rider Recruitment Rules, 1995 , except as respects things donc or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Staff Car Drivers (Special Grade,Grade- I, Grade - II and Ordinary Grade) and Despatch Rider in the Main Secretariat of the Ministry of Information and Broadcasting namely:-

1. Short title and commencement .---( 1 ) These rules may be called the Ministry of Information and Broadcasting Staff CarDrivers (Special Grade, Grade- I, Grade- II and Ordinary Grade) and Despatch Rider Recruitment Rules, 2004.

(2) They shall be deemed to have come into force on 28th August, 2002.

2. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Method of Recruitment , age limit and qualifications , etc. The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualifications. No person,-

(a) Who has entered into or contracted a marriage with a person having a spouse living ; or

(b) Who , having a spouse living, has entered into or contracted a marriage with any person ; shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respectto any class or category of persons .

6. Saving:-Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Explanatory Memorandum: Pursuant to the directions of the Hon'ble Central Administrative Tribunal , Principle Bench in O.A. No. 2529/96 in the case of Central Government Staff Car Drivers and Bikram Singh Vs. Union of India the Department of Personnel and Training has issued on O.M. No. 43019/54/96-Estt. (D) dated 15-02-2001 for modification of the existing grade structure for the Staff Car Drivers under the Central Government organizations as under which inter - alia includes introduction of a new grade namely " Special Grade " in the scale of Pay ofRs . 5000-8000 with retrospective effect from 08-11-1996.

Promotion of eligible candidates to " Special Grade" , subject to availability ofpost , shall be made with retrospective effect to the w.e.f. 8-11-1996 and arrears in such cases shall be allowed with effect from 8-11-1996 . Further in respect of Cadres where the strength of Staff Car Drivers is between 10 and 19 the Department of Personnel and Training has agreed as a special case to allow placement of one post of Staff Car Driver in the " Special Grade " as the percentage fraction of post computed@5% of the total strength comes to 0.5 and above which may be rounded off to one . But where the Cadre strength is less than 10 , as a measure of further liberalisation the combination of different Cadres Staff Car Drivers under the Central Government organizations is permissible which the Ministry may operate on a nodal basis . In the Ministry of Information and Boardcasting 8 posts of Staff Car Driver exist. In the Publications Division, a media unit under the Ministry ofInformation and Broadcasting 4 posts of Staff Car Driver exist . It has been decided to combine the cadres of Staff Car Driver in the Ministry of Information and Broadcasting and the Publications Division w.e.f. 28-08-2002 . Based on combined strength of 12 posts have been created in the 4 Grades as per structure and percentage mentioned above w.e.f. 28-08-2002 . Accordingly in the combined cadre the promotion to newly created posts will be effective from 28-08-2002 or later . The retrospective effect to the Recruitment Rules in being given as a result of liberalisation. It is certified that the retrospective effect given to enforcement of these Rules will not effect any Section of Class of Government Servants adversely .

सा. का. नि. 64.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और लघु उद्योग संवर्धन अधिकारियों और अन्वेषकों ( लघु उद्योग संगठन ) भर्ती नियम, 1962 का जहां तक उनका संबंध लघु उद्योग संवर्धन अधिकारियों को अनुसूची III में क्रम संख्यांक 1 के विरुद्ध में विनिर्दिष्ट हो, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है, लघु उद्योग मंत्रालय में लघु उद्योग विकास संगठन के लघु उद्योग संवर्धन अधिकारी (अर्थशास्त्र अन्वेषक ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम लघु उद्योग मंत्रालय, लघु उद्योग विकास संगठन, लघु उद्योग संवर्धन अधिकारी ( अर्थशास्त्र अन्वेषक ) , समूह ' ख ' पद भर्ती नियम, 2004 है ।

(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण और वेतनमान उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट है । उक्त पदो की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से 3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.- उक्त पदो पर भर्ती की पद्धति, आयु- सीमा,अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 280

टिप्पण 2-अनुभव संबंधी अर्हताएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जासकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है । .

10. परिवीक्षा की अवधि, यदि कोई हो

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर लीहै , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ 281 [ भाग II- खण्ड 3 ( i) ]

पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें सेजो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर लीहै, जिन्होंने ऐसे अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति: केन्द्रीय सरकार के अधीन ऐसे अधिकारी:-

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हो; या

(ii) जिन्होंने मूल काडर या विभाग में 5500-9000/- रुपये या समतुल्यके वेतनमान में नियमित आधार परनियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष तक सेवा की है, या

(iii ) जिन्होंने मूल काडर या विभाग में 5000-8000/-रुपए या समतुल्य के वेतनमान में नियमिव असधार पर नियुक्ति के पश्चाव उस श्रेणी मेंछह वर्ष तकसेवा कीहै; और

(ख ) स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित अनुभव और शैक्षिक अर्हताएं रखताहै ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोम्मति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहींहोंगे।

(प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्यसंगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने कीअंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Small Scale Industries , Small Industries Development Organisation, Small Industry Promotion Officer (Economic Investigation) Group 'B ' Post, Recruit- ment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2.Number ofpost, classification and scale of pay. The number of said posts , its classification and scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Methodof recruitment, age limit , qualifications , etc. The method of recruitment , to the said post, age limit qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the Schedule.

4.Disqualification. No person.--

(a)who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving . Nothing in these rules shall affect reservations, relaxataage limit and other concessions required to be provided for Scheduled Castes, Scheduled Tribes , Ex- Servicemen, ande special categories of persons in accor- dance with the orders issued by the Central Government from time to time in this regard.

Deputation:Officers under the Central Government:

(a) ( i ) holding analogous posts on regular basis in the parent cadre ordepartment; or

(ii ) with three year's service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5500-9000 or equivalent in the parent cadre or department ; or

(iii) with six year's service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5000-8000 or equivalent in the parent cadre or department : and

(b) possessing the educational qualifications and experience prescribed for direct recruits under col . 8 .

The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly deputationist shall not be eligible for consideration for appointment by promotion .

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय जल और विद्युत अनुसंधान शाला पूणे, सुरक्षा गार्ड पद पर भर्ती नियम, 2004 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2: पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट है ।

सा. का. नि. 66.- केन्द्रीय सरकार, दिल्ली नगर कला आयोग अधिनियम , 1973 ( 1974 का 1 ) की धारा 26 की उपधारा ( 2 ) के खण्ड ( क) , ( ख ) तथा (ज ) के साथ पठित उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एत‌द्वारा दिल्ली नगर कला आयोग ( सेवा निबंधन और शर्तें) नियम, 1974 मे परवर्ती संशोधन के लिए निम्नलिखित नियम बनाती है, अर्थात्: -

1. ( 1 ) इन नियमों का संक्षिप्त नाम दिल्ली नगर कला आयोग ( सेवा निबंधन और शर्तें ) संशोधन नियम , 2004 होगा । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. दिल्ली नगर कला आयोग ( सेवा निबंधन और शर्तें ) नियम , 1974 के नियम 4 में:-

( i) उपनियम ( 1 ) में " पाँच हजार रुपये " शब्दों के लिए " सात हजार रुपये " शब्द प्रतिस्थापित किये जायेंगे । ( ii ) उपनियम (2 ) में " चार सौ रुपये " शब्दों के लिए " पाँच सौ रुपये " शब्द प्रतिस्थापित किये जायेंगे ।

G.S.R. 66. In exercise of the powers conferred by sub -section ( 1 ) ofSection 26 of the Delhi Urban Art Commission Act, 1973 ( 1 of 1974 ) , read with Clauses (a) , (b ) and (h) of sub -section (2 ) of that section, the Central Government hereby makes the following rules further to amend the Delhi Urban Art Commission (Terms and Conditions of Service) Rules , 1974, namely:-

1. (i) These rules may be called the Delhi Urban Art Commission (Terms and Conditions of Service) ( Amendment) Rules, 2004.

(ii) They shall come into force on the date of their publication in the Official Gazette .

2. In rule4 ofthe Delhi Urban Art Commission (Terms and Conditions of Service ) Rules , 1974 .

in sub-rule ( 1 ), for the words " rupees five thousand " , the words " rupees seven thousand" shall be substituted.

(ii) in sub - rule (2 ) , for the words " rupees four hundred" , the words " rupees five hundred" shall be substituted .
