का.नि.आ. 23.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए आयुध कारखाना संगठन ( विद्यालय स्थापन के वर्ग ' क' और ' ख ' पद ) भर्ती नियम, 1977, का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. (i ) इन नियमों का संक्षिप्त नाम आयुध कारखाना संगठन ( विद्यालय स्थापन के वर्ग ' क ' और ' ख ' पद ) भर्ती ( संशोधन ) नियम, 2003है,

( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. आयुध कारखाना संगठन ( विद्यालय स्थापन के वर्ग ' क' और ' ख ' पद ) भर्ती नियम , 1977 , की अनुसूची में

(क ) स्तंभ 1 में क्रममांक संख्या 1 पर ' प्रधानाचार्य , हायर सेकेण्डरी स्कूल ' शब्दों के स्थान पर ' प्रधानाचार्य, श्रेणी ।' शब्द रखे जाएंगे । ( ख ) स्तंभ 1 में क्रमांक संख्या 2 पर ' हेड मास्टर हाई स्कूल ' शब्दों के स्थान पर' प्रधानाचार्य श्रेणी- II ' शब्द रखे जाएंगे । 3. उपाबंध- III में स्तंभ 1 पर ' स्नातकोत्तर अध्यापक' ( समूह ' ग ' ) शब्दों के स्थान पर सा ०का० नि ० 91/95 के अनुसार ' स्नातकोत्तर अध्यापक' समूह ' ख ' अराजपत्रित शब्द रखे जाएंगे ।

S.R.Q. 23. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President of India hereby makes the following rules to amend the Ordnance Factories Organization (Group " A " & "B " Posts of School Establishment ) Recruitment Rules, 1977 as follows , namely :---

1. ( i ) These rules may be called the Ordnance Factories Organization ( Group "A " and "B " posts of School Establishment ) Recruitment ( Amendment ) Rules , 2004.

( ii ) They shall come into force on the date ofpublication in the Official Gazette.

2. In Schedule to the Ordnance Factories Organization (Group " A" and " B " posts of School Establishment ) Recruitment Rules, 1977 :--

(a) In column 1, at serial No. 1, for the words "Principal Higher Secondary School " " Principal Grade - 1 " shall be substituted .

(b) In column 1 at serial No. 2 , for the words "Headmaster , High School " the words " Principal Grade - II " shall be substituted .

3. In Annexure- III at column 1 for the word " Post Graduate Teacher " (Group " C " ) as per SRO 91/95 , the word Post Graduate Teacher " shall be substituted as Group "B " Non - Gazetted .

का०नि०आ० 25.- छावनी अधिनियम, 1924 ( 1924 का 2 ) की धारा 13 की उपधारा ( 7 ) के अनुसरण में केन्द्रीय सरकार एतद्वारा अधिसूचित करती है कि स्टेशन कमांडर, सुबाथू ने उक्त अधिनियम की धारा 13 की उपधारा ( 3 ) के खण्ड ( च ) में प्रदत्त शक्तियों का प्रयोग करते हुए मेजर मनोज ठाकुर को छावनी बोर्ड, सुबाथू का सदस्य मनोनीत किया है । यह मनोनयन मेजर अनिल शार्म के स्थान पर किया गया है जिनका त्यागपत्र स्वीकृत हो चुका है ।

का.नि.आ. 26.- संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रपति भारतीय वायुसेना अनौद्योगिक समूह ' घ ' पद, भर्ती नियम , 1989 में एतद्वारा निम्नलिखित संशोधन करते हैं, अर्थात्: -

1. इन नियमों को भारतीय वायुसेना अनौद्योगिक समूह ' घ ' पद भर्ती ( संशोधन ) नियम, 2004 कहा जाएगा ।

2. ये सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

3. भारतीय वायुसेना अनौद्योगिक समूह ' घ ' पद, भर्ती नियम, 1989 में, अनुसूचियों के स्थान पर निम्नलिखित अनुसूचियां रखी जाएंगी, अर्थात्:-

टिप्पणी: आयु- सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ( न किवह अंतिम तारीख जो असम, मेघालय, अरूणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीपसमूह और लक्षद्वीप के. अभ्यर्थियों के लिए विहित की गई है । ) रोजगार कार्यालय के माध्यम से की जाने वाली भर्ती के मामले में, आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा गया है । 96

*. सीधे भर्ती किर जाने वाले व्यक्तियों के लिए विलित आयु और शैक्षिक अर्हताएं, प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

10. परिवीक्षा की अवधि, यदि कोई हो

केवल सीधे भर्ती किए जाने वाले व्यक्तियों के लिए दो वर्ष भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा या :

11. प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

आमेलन द्वारा जिसके न हो सकने पर प्रतिनियुक्ति/पुनर्नियोजन द्वारा ( भूतपूर्व सैनिकों के लिए ) , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

12. प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किंयाजाएगा

आमेलन: ऐसे व्यक्ति जो रक्षा सेवाओं के निम्न फार्मेशनों में समरूप , समतुल्य या उच्च श्रेणी में कार्य कर रहे हैं और जिनके पास कॉलम 8 में विनिर्दिष्ट अर्हताएं हैं ।

प्रतिनियुक्ति/पुनर्नियोजन ( भूतपूर्व सैनिकों के लिए ): सशस्त्र सेना के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिसके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र सेना से निर्मुक्त किया जाना है, तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । टिप्पण 1 : फीडर वर्ग के विभागीय अभ्यर्थी प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्तिकी अवधि , जिसके अंतर्गत केन्द्रीय सरकारी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले

किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि भी शामित साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति लिएअधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख क 56 वर्ष से अधिक नहीं होगी ।

13. यदि विभागीय पदोन्नति समिति है , तो उसकी संरचना :

समूह ' घ ' विभागीय प्रोन्नति समिति ( केवल पुष्टि के लिए ) जिसमें निम्नलिखित शामिल होंगे :-

3. कमीशन प्राप्त अफसर जो उस अनुभाग से सम्बद्ध - सदस्य न हो जहां प्रोन्नतियां/पुष्टियां की जानी हैं ।

14. भर्ती करने में किन परिस्थितियों में संघ लोक मेवा आयोग से परामर्श किया जाएगा

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो , वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, बशर्ते कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है ।
