का.नि.आ. 28.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और ( 1 ) रक्षा मंत्रालय, सशस्त्र बल मुख्यालय और अंतर सेवा संगठन ( फोटोग्राफर) भर्ती नियम, 1988 , ( 2 ) रक्षा मंत्रालय, सशस्त्र बल मुख्यालय और अंतर सेवा संगठन ( डार्करूम सहायक) भर्ती नियम, 1989, ( 3 ) रक्षा मंत्रालय , सशस्त्र बल मुख्यालय और अंतर सेवा संगठन ( समूह घ पद ) भर्ती नियम, 1999, जहां तक उनका संबंध ग्लेजर/ट्रिमर के पदों से है, को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने सेलोप किया गया है, रक्षा मंत्रालय , सशस्त्र बल मुख्यालय और अंतर सेवा संगठन ( फोटोग्राफर ) ( समूह ग और घ पद ), भर्ती नियमों के पदों की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय, सशस्त्र बल मुख्यालय और अंतर सेवा संगठन (फोटोग्राफर) (समूह ग और घ ) पद भर्ती नियम , 2004 है,

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. प्रारंभिक गठन.- इन नियमों में अंतर्विष्ट किसी बात के होते हुए भी, निम्नलिखित सारणी के स्तंभ ( i ) में उल्लिखित निम्नलिखित पदों को धारित करने वाले अधिकारी इन नियमों के अधीन सारणी के स्तंभ ( ii ) में तत्स्थानी रूप से दर्शित पदों पर नियुक्त किए गए 'समझे जाएंगे । ज्येष्ठता सरकार द्वारा समय - समय पर अधिकथित ज्येष्ठता के सामान्य सिद्धांतों के अनुसार नियम की जाएगी ।

5. निरर्हता. वह व्यक्ति, -

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तुयदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्तिको इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति . इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट तथा अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

: प्रान्नति द्वारा । टिप्पण: सभी पात्रं अभ्यर्थियों को प्रोन्नति के प्रयोजन के लिए व्यवसायिक परीक्षण में अर्हता प्राप्त करना अपेक्षित होगा ।

11. भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

: प्रोन्नति: 4500-7000 रुपए के वेतनमान में ऐसा फोटोग्राफर श्रेणी -1 जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है ।

12. प्रोन्नति/प्रतिनियुक्ति/ आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा

टिप्पण 1 : पात्र सेवा इन नियमों की अधिसूचना की तारीख को नियमित आधार पर पद धारित करने वाले तत्कालीन फोटो कलाकार ( जिसे अब ज्येष्ठ फोटोग्राफर के साथ आमेलित कर लिया गया है और फोटोग्राफर के साथ आमेलित कर लिया गया है और फोटोग्राफर श्रेणी-1 के रूप में पुनः पदाभिहित कर दिया गया है ) के लिए दो वर्ष बनी रहेगी ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/ पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है ।

13. : समूह ' ग ' विभागीय प्रोन्नति समितिः

1. ज्येष्ठ प्रशासनिक अधिकारी

--अध्यक्ष संयुक्त सचिव और मुख्य प्रशासनिक अधिकारी का कार्यालय , रक्षा मंत्रालय

2. अवर सचिव, जो प्रशासनिक रूप से संबद्ध है , रक्षा मंत्रालय ( स्थापना प्रभाग/रक्षा मंत्रालय द्वारा नाम निर्दिष्ट किया जाएगा )

-सदस्य 3. सशस्त्र बल फिल्म और फोटो प्रभाग , रक्षा मंत्रालय से उप निदेशक या समतुल्य प्रास्थिति का एक अधिकारी

6. : 18 और 27 वर्ष के बीच। केन्द्रीय सरकार द्वारा जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों की दशा में 40 वर्ष तक (अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों के संबंध में 45 वर्ष तक ) शिथिल की जा सकती है । टिप्पणी: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ( न कि वह अंतिम तारीख जो असम, मेघालय , अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के विहित की गई है । ) 131

टिप्पण:- अनुभव संबधी अर्हता/अर्हताएं नियुक्ति प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर नियुक्ति प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहींहै ।

(किन्तुनियों की अधिसूचना की तारीख को नियमित अंधार पर पद धारित करने वाले डार्करूम सहायक और डार्करूम सहायक कनिष्ठ श्रेणीक विद्यमान पदधारी ( जिन्हें फोटो परिचर श्रेणी -1 के रूप में आमेलित और पुनः पदाभिहित कर दिया गया है ) को स्तंभ (8 ) ीन अर्हताएं रखने से छूट प्राप्त होगी ।

टिप्पण: सभी पात्र अभ्यर्थियों को प्रान्नति के प्रयोजन के लिए व्यवसायिक परीक्षण में अर्हता प्राप्त करना अपेक्षित होगा । 12. : प्रोन्नति: 3050-4590 रुपए के वेतनमान में ऐसा फोटो परिचर श्रेणी-1 जिसने उस श्रेणी में आठ वर्ष नियमित सेवा की है । टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, परंतु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित . उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

12. : प्रोन्नति: 2610-4000 रुपए के वेतनमान में ऐसा फोटो परिचर श्रेणी- II जिसने उस श्रेणी में चार वर्ष नियमित सेवा की है । टिपाण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, के अधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक /पात्रता सेवा पहती ही पूरी कर ली है ।

प्रतिनियुक्त: केन्द्रीय सरकार के अधीन ऐसे अधिकारीः ( क ) ( i ) जो मूल काडर/विभाग में नियमित आधर पर सदृश्य पद धारण कर रहे हैं या

(ii ) जिन्होंने मूल काडर/विभाग में 2610-4000 रुपए या समतुल्य के वेतनमान में चार वर्ष नियमित सेवा की है ।

(ख) जिनके पास निम्नलिखित अर्हताएं हैं

( i ) किसी मान्यताप्राप्त विद्यालय /संस्था से 8 वां उर्तीण प्रमाण पत्र

( ii ) किसी फोटोग्राफिक फर्म में दो वर्ष का अनुभव

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्त की अवधि है. साधारणतयां तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवदेन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

13. : समूह ' ग ' विभागीय प्रोन्नति/ समिति ( प्रोन्नति पुष्टि पर विचार करने के लिए ) :

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Defence , Armed Forces Headquarters and Inter Service Organisations (Photographers ) , (Group ' C ' and ' D ' posts ) Recruitment Rules , 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette .

3.Method of Recruitment, age limit and qualifications , etc. The method of recruitment , to the said post age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the Schedule .

4. Initial Constitution.--Notwithstanding anything contained in these rules , officers holding the following posts mentioned in column (i) of the following table shall be deemed to have been appointed to the posts correspondingly shown ir. column ( ii) of the table under these rules . Seniority shall be fixed according to the general principles of seniority laid down by the Government from time to time.

5. Disqualifications. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or categoryof persons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen . Other Backward Classes and other special categories of persons in accordance with the orders, issued by the Central Government from time to time in this regard.

Note 2 : Period of deputation including period ofdeputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization /department of the Central Government shall ordinarily not exceed three years . The maximum age - limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of applications .

2. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, और अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. आरंभिक गठन: इन नियमों के आरंभ से पूर्व अनुसूची में दर्शाए गए पद पर नियुक्त/ भर्ती किए गए ऐसे पदधारी , इन नियमों के अधीन नियुक्त किए गए समझे जाएंगे और इन नियमों से पूर्व उनके द्वारा नियमित आधार पर की गई सेवाएं आगामी उच्चतर श्रेणी में प्रोन्नति के प्रयोजन के लिए उनकी पात्रता का विनिश्चय करने के लिए गणना में ली जाएंगी ।

5. निरर्हता: - वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,.

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाहं के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

S.R.O. 30. In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to the post of Civilian Motor Drivers (Special Grade) in the Ministry of Defence , Department of Defence Production , Directorate of Quality Assurance ( Naval ) , namely :-

1. Short title and Commencement .--- ( 1 ) These rules may be called the Ministry of Defence, Department of Defence Production, Directorate of Quality Assurance (Naval ) , Civilian Motor Driver ( Special Grade) Group - ' C ' Non- gazetted post Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexued to these rules .

3.Method of recruitment, age limit , and qualifications ,etc. The method of recruitment to the said posts, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Initial Constitution . The incubments of the post shown in the Schedule who were recruited/ appointed beforethe commencement ofthese rules shall be deemed to have been appointed under these rules and service rendered by them before commencement of these rules on regular basis shall be taken into account for deciding their eligibility for promotion to the next higher grade .

5. Disqualificationes . No person,-

(a) Who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , and for reasons to be recorded in writing , and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex - Servicemen Other Backward Class and other special categories of persons , in accordance with the orders issuedby the Central Government from time to time in this regard.

2. दिल्ली और नई दिल्ली क्षेत्र से भिन्न स्टेशनों पर गुणवत्ता आश्वासन महानिदेशालय स्थापनों में कार्यरत सिविलियनों के लिए आवास स्थान के आबंटन के लिए नियम, 1996 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 11 के पश्चात् निम्नलिखित नियम जोड़ा जाएगा, अर्थात्:-

11. क. वे जिनके अधिभोग में सरकारी आवास हैं या वे जो मकान किराया भत्ते के पात्र नहीं हैं, सरकारी आवास के लिए इंकार करते हैं उन्हें मकान किराया भत्ता निम्नलिखित शर्तों के अध्यधीन अनुदत्त होगा:-

(1 ) उन सिविलियनों को , जो गुणवत्ता आश्वासन महानिदेशालय स्थापन में सेवारत हैं, सरकारी आवास के लिए पात्र हैं, भत्ते केवल तभी ग्राहृय होंगे यदि उन्होंने विहित प्रक्रिया के अनुसार ऐसे आवास के लिए आवेदन किया है किन्तु उन्हें यह उस स्थान पर जहां फालतू सरकारी आवास की उपलब्धता के कारण उपलब्ध कराया गया है, और गुणवत्ता आश्वासन महानिदेशालय मुख्यालय द्वारा समय- समय पर कर्मचारियों को यह आबद्ध करते हुए कि वे उसे अभिप्राप्त करें और उनके तैनाती के स्थान पर सरकारी आवास के संबंध में" आवास न होने " का प्रमाण पत्र प्रस्तुत करें ।

(2) ऐसे सिविलियन जो गुणवत्तां आश्वासन महानिदेशालय में सेवारत हैं और ऐसे अवस्थानों पर तैनात हैं जहां इस समय आश्वासन महानिदेशालय के स्वामित्वाधीन या उसके अध्यपेक्षा किए जाने पर साधारण पूल मेंआवासीय निवास उपलब्ध नहीं है उन्हें मकान किराया भत्ते के लिए पात्र होने के लिए सरकारी आवास के लिए आवेदन करने के लिए आवश्यकता नहीं है । किन्तु जहां गुणवत्ता आश्वासन महानिदेशालय के क्वार्टर विनिर्दिष्ट प्रवर्गों के कर्मचारिवृंद के लिए उपलब्ध हैं वहां दिल्ली और नई दिल्ली स्थिति केन्द्रों से भिन्न क्वालिटी आश्वासन महानिदेशालय के स्थापनों में सेवारत सिविलियनों को आवासीय निवास के लिए आवेदन की प्रक्रिया काविनियमन इन नियमों के अधीन किया जाएगा ।

1. ( 1 ) These rules maybe called the Rules for Allotment of Residential Accommodation to Civilians serving in Directorate General of Quality Assurance Establishments at Stations other than Delhi and New Delhi Area (Amendment ) Rules2004,

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Rules for Allotment of Residential Accommodation to Civilians serving in Directorate General of Quality Assurance Establishments at Stations other than Delhi and New Delhi Area- 1996 . (hereinafter referred to as the said rules ), after rule I the following rule shall be added , namely:-

11.A. Those occupying or refusing Government Accommodation not eligible for house rent allowance The grant of House Rent Allowance shall be subject to the following conditions :-

(1) To those civilians serving in Directorate General of Quality Assurance Establishments who are eligible for Government accommodation , the allowances will be admissible only if they have applied for such accommodation in accordance with the prescribed procedure but have not been provided with it , in places where due to availability of surplus Government accommodation , special orders are issued by the Directorate General ofQuality Assurance HQ from time to time making it obligatory for employees concerned to obtain and furnish ' no accommodation ' certificate in respect of Government residential accommodation at their place ofposting .

(2) Civilians serving in Directorate General of Quality Assurance Establishments posted in localities where there is at present no residential accommodation in the General Pool owned or requisitioned by Directorate General ofQuality Assurance for allotment to them , need not apply for Government residential accommodation in order to become eligible for House Rent Allowance . But where Directorate General of Quality Assurance quarters are available for the staff of specified categories the procedure for applying for accommodation will be regulated under the rules for allotment of Residential Accommodation to civilians serving in Directorate General of Quality Assurance Establishments at Stations other than Delhi and New Delhi .

3. In the said rules , in rule 7 , for the table , the following table shall be substituted, namely :-

1. संक्षिप्त नाम और प्रारंभ - ( 1 ) इन नियमों का संक्षिप्त नाम नौसेना ज्येष्ठ अनुवाद अधिकारी ( रुसी/अंग्रेजी ) समूह ' क ' भर्ती नियम, 2004है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो यहां उपाबद्ध अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता:- वह व्यक्ति, -

टिप्पण :-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा अपेक्षित के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलता पूर्वक पूरी कर ली हो ।

का.नि.आ. 33.-राष्ट्रपति, संविधान के अनुच्छेद 309 , के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और राष्ट्रीय भारतीय सैनिक कालेज ( सैक्शन मास्टर ' क' राजपत्रित ) भर्ती नियम, 1985 को जहां तक उनका संबंध सैक्शन मास्टर पद से है , उन बातों के सिवाय अधिक्रांत करते हुए, जो ऐसे अधिक्रमण से पहले किए गए है या करने का लोप किया गया हैं, राष्ट्रीय भारतीय सैनिक कालेज सैक्शन मास्टर पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय भारतीय सैनिक कालेज ( सैक्शन मास्टर समूह ' क ' राजपत्रित ) भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु - सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता . वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्तिका पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession ofthe Rashtriya Indian Military College (Section Master) Group ' A' Gazetted Recruitment Rules, 1985 in so far as they relate to the Posts of Section Master except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Section Master in the Rashtriya Indian Military College , namely:-

1. Short title and commencement.--( 1 ) These rules may be called the Rashtriya Indian Military College ( Section Master Group ' A' Gazetted) Recruitment Rules , 2004.

(2) These shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. --The number of the said posts , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Method of recruitment , age limit and other qualifications.--The method of recruitment, age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4.Disqualification. No person,-

(a)whohas entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

का.नि.आ. 40.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और राष्ट्रीय भारतीय सैनिक महाविद्यालय ( मास्टर ) भर्ती नियम , 1986 को उन बातों के सिवाय अधिक्रांत करते हुए, जो ऐसे अधिक्रमण से पहले किया गया है या करने का 155 [भाग II- खण्ड 4 ]

भारत का राजपत्र: मार्च 13, 2004/फाल्गुन 23 , 1925

लोप किया गया है, राष्ट्रीय भारतीय सैनिक महाविद्यालय में मास्टर के पद पर भर्ती की पद्धति का विनियमन करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय भारतीय सैनिक महाविद्यालय ( मास्टर ) भर्ती नियम, 2004 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु - सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से संबंधित विषय में मास्टर डिग्री यासमतुल्य।

( ii ) किसी मान्यताप्राप्त विश्वविद्यालय से अध्यापन में डिग्री या समतुल्य,

( iii ) किसी मान्यताप्राप्त शैक्षिक संस्थान से अध्यापन में तीन वर्ष का अनुभव।

टिप्पण- कंप्यूटर विज्ञान विद्या शाखा के लिए निम्नलिखित में से किसी को स्नात्तकोत्तर उपाधि के समतुल्य समझा जाएगा-

( क ) किसी मान्यताप्राप्त विश्वविद्यालय से कंप्यूटर विज्ञान में मास्टर डिग्री या समतुल्य ।

या

(ख ) किसी मान्यताप्राप्त विश्वविद्यालय से गणित/विज्ञान में कंप्यूटर एप्लीकेशन में स्नात्तकोत्तर डिप्लोमा सहित मास्टर डिग्री

या

(ग ) किसी मान्यताप्राप्त विश्वविद्यालय से गणित/विज्ञान में मास्टर डिग्री या समतुल्य इसके साथ ( कंप्यूटर विज्ञान ) में स्नात्तक हो ।

टिप्पण-कंप्यूटर विज्ञान की विहित शाखा के लिए अभ्यर्थी को अध्यापन मेंडिग्री रखना आवश्यक नहीं है ।

वांछनीय:

1. खेल/सांकृतिक क्रियाकलापों में दक्षता

2. अंग्रजी में मौखिक और लिखित में अत्कृष्ट संवाद क्षमता

3. कंप्यूटर साक्षरता

4. आवासीय विद्यालयों में अनुभव ।

टिप्पण 1- अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

S.R.O. 40. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Rashtriya Indian Military College (Master ) Recruitment Rules , 1986 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitmentto the post of Master in the Rashtriya Indian Military College, namely:-

1. Short title and commencement. ( i) These rules may be called the Rashtriya Indian Military College (Master) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number of post, classification and scale of pay : The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment , age limit , qualifications etc. The method of recruitment to the said post , age limit . qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14) of the Schedule.

4.Disqualification . No person,-

(a)who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person , 158

[PART II- SEC . 4 ] shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any ofthese rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
