सा. का. नि. 92.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक और अनुच्छेद 148 की धारा ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारतीय लेखा परीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखापरीक्षक से परामर्श करने के पश्चात् केन्द्रीय सिविल ( अस्थायी सेवा ) नियमावली , 1965 में और आगे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. ( 1 ) इन नियमों का नाम केन्द्रीय सिविल सेवा ( अस्थायी सेवा ) संशोधन , नियमावली , 2004 है ।

(2) ये जनवरी 01 , 2004 को लागू होंगे । 2. केन्द्रीय सिविल सेवा ( अस्थायी सेवा ) नियमावली, 1965 केनियम 10 में-

(i) उप नियम ( 1 -क ) में " खण्ड ( क ) अथवा जैसा भी मामला हो , खण्ड ( ख ) का " शब्द विलोपित किए जाएँ;

(ii ) उप नियम ( ख) के पश्चात् निम्नलिखित उप नियम अन्तःस्थापित किया जाएगा अर्थात्:-

"(7) नियम 10 के उपबंध , दिसम्बर 31 , 2003 को अथवा इससे पहले नियुक्त सरकारी कर्मचारियों पर लागूहोंगे" ।

व्याख्यात्मक ज्ञापन

दिनांक जनवरी 01 , 2004 से सरकारी सेवा में भर्ती किए गए व्यक्तियों के संबंध परिभाषित अंशदान पर आधारित एक नई पेंशन योजना शुरू की गई है । चूँकि नई पेंशन योजना मौजूदा सरकारी कर्मचारियों पर लागू नहीं होगी , अतः इस संशोधन को भूतलक्ष्यी प्रभाव से लागू करने से मौजूदा कर्मचारियों के हित प्रतिकूल रूप से प्रभावित नहीं होंगे ।

(Department of Personnel and Training) New Delhi , the 12th March, 2004

G.S.R. 92. In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comp- troller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Temporary Service ) Rules . 1965 , namely:-

1. ( 1 ) These rules may be called the Central Civil Services ( Temporary Service ) Amendment Rules , 21X)4 .

(2 ) They shall be deemed to have come into force on the Ist day of January , 2004.

[PART II-SEC. 3(i ) ] 2. In the Central Civil Services ( Temporary Service) Rules , 1965, in rule 10,-

(i) in Sub -rule ( 1 -A ) , the words "clause (a ) or, as the case may be , clause (b ) , of" shall be omitted;

( ii ) after Sub -rule (b ) , the following Sub - rule shall be inserted, namely:-

" (7) The provisions of rule 10 shall apply to Government servants appointed on or before the 31stday ofDecember , 2003 " .

EXPLANATORY MEMORANDUM A New Pension System based on defined contribution has been introduced in respect of persons recruited to Government service from the 1st day of January , 2004. As the New Pension System shall not applicable to existing Government servants , the interest of the existing employees shall not be adversely affected by giving retrospective effect to the amendment .

सा. का. नि. 93.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय राजस्व नियंत्रण प्रयोगशाला ( समूह " ग " और समूह " घ " पद ) भर्ती नियम , 1991 को, उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोष किया गया है, केन्द्रीय राजस्व नियंत्रण प्रयोगशाला में समूह " ग " और समूह " घ " पदों पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय राजस्व अधिनस्थ रसायन सेवा ( समूह " ग " और समूह " घ" पद ) भर्ती नियम, 2004 हैं ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागूहोना: ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद-संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उनसे सम्बन्धित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. विशेष उपबंध . इन नियमों में किसी बात के होते हुए भी, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड: -

( क ) यदि वह ऐसा करना लोकहित में आवश्यक या समीचीन समझे और ऐसी शर्तों के अधीन रहते हुए जो वह मामले की परिस्थितियों को ध्यान में रखते हुए, विनिर्दिष्ट करें और उनके लिए जो कारण है उन्हें लेखबद्ध करके, केन्द्रीय राजस्व रसायन सेवा में ( समूह " ग " और समूह " घ" ) में किसी भी पद को, समान या तुल्य पद धारण किए हुए, किन्तु केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के अधीन किसी अन्य विभाग या कार्यालय के काडर के व्यक्तियों में से, आमेलन द्वारा भरे जाने के लिए आदेश कर सकता है , और

(ख ) यदि वह अनुकम्पा के आधार पर यह आवश्यक या समीचीन समझें और वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, यह आदेश कर सकता है कि केन्द्रीय राजस्व रसायन सेवा में ऐसा कोई पद जो इन नियमों के अधीन सीधी भर्ती द्वारा भरा जाना है, ऐसी शर्तों के अधीन रहते हुए जो वह मामले की परिस्थितियों को ध्यान में रखते हुए विनिदिष्ट करें, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के अधीन किसी अन्य विभाग या कार्यालय में से समान या तुल्य या उच्चतर पद धारण किये हुए व्यक्तियों के आमेलन या प्रतिनियुक्तिद्वारा भरा जाएगा ।

6. निरर्हता:-वह व्यक्ति-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति.- इन नियमों की कोई बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 456

टिप्पण: आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों (जो अंदमान और निकोबार द्वीप तथा लक्षद्वीप के अभ्यर्थियों से भिन्न हैं ) से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी। आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

(i ) किसी भारतीय विश्वविद्यालय से रसायन विज्ञान में एम. एस.सी. या उसके समतुल्य

G.S.R. 93. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Central Revenues Control Laobratory (Group " C " and Group " D " posts) Recruitment Rules , 1991 , except as things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to Group ' C' and Group 'D ' posts in the Central Revenues Control Laboratory, nainely

1. Short title and commencement .( i ) These rules may be called the Central Revenues Subordinate Chemical Service ( Group " C " and Group "D " Posts) Recruitment Rules , 2004 .

(ii ) They shall come into force on the date of their publication in the Official Gazette.

2. Application. These rules shall apply to the posts specified in column ( 1 ) of the Schedule annexed to these rules.

3. Number of posts , classification and scale of pay. The number of posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .

4. Method of recruitment , age limit, qualifications etc. The method of recruitment to the said posts , age limit, qualifications and other matters connected therewith shall be as specified in columns (5 ) to ( 14 ) of the Schedule annexed to these rules .

5. Special provisions . Notwithstanding anything contained in these rules, the Central Board of Excise & Customs may,

(a) if it considers it is necessary or expedient in the public interest so to do and subject to such conditions as it may specify having regard to the circumstances of the case and for reasons to be recorded in writing , order any post (Group "C" and Group " D" ) in the Central Revenues Chemicals Service to be filled by absorption from persons holding the same or comparablepost but belonging to the cadre of another department or office under the Central Board of Excise & Customs ; and

(b) if it considers it is necessary or expedient on compassionate grounds , order , for reasons to be recorded in writing, that a post in the Central Revenues Chemicals Service which is to be filled by direct recruitment under these rules shall be filled by absorption or deputation of a person holding the same or comparable or higher post from any other Department or Office under the Central Board of Excise & Customs , subject to such conditions as it may specify, having regard to the circumstances of the case .

6. Initial Constitution.-

(A) Laboratory Assistant Grade- II. ( i ) Any person , who holds a post of Upper Division Clerk (UDC) ( Stores ) (3 posts) and the Laboratory Attender (93 posts ) on regular basis at the commencement of these rules , shall be deemed to have been appointed as Laboratory Assistant Grade - II specified in Column ( 1 ) at Serial No. 8 of the Schedule annexed to these rules and the services so rendered by him before commencement of these rules shall be taken into account for deciding eligibility for promotion to the next higher grade .

(ii) UDC(Stores) (Rs . 4000-6000 ) shall be placed en -block senior followed by Laboratory Attenders (Rs . 3050-4590 ) .

(B) Laboratory Assistant Grade - III .-( i ) Any person who holds a post of Laboratory Clerk ( 17 posts ) and the Laboratory Attenders ( 100 posts ) on regular basis at the commencement of these rules, shall be deemed to have been appointed as Laboratory Assistant Grade - III specified in Column ( 1 ) at Serial No. 9 of the Schedule annexed to these rules and the services so rendered by him before commencement of these rules shall be taken into account for deciding eligibility for promotion to the next higher grade .

(ii ) Laboratory Clerks (Rs . 3200-4900) shall be placed en - block senior followed by Laboratory Attender (Rs. 3050-4590).

7. Disqualification.-No person

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the Personal Law applicable to such person and other party to the marriage and that there are other grounds for so doing, except any person from the operation ofthis rule.

8. Power to relax. -- Where the Central Government is of the opinion that it is necessary or expedient so do to, it may, by order , and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

9. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , Ex - Servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard.

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नतिके लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्तिजिसके अन्तर्गत अल्पकालिक संविदा भी है : केन्द्रीय सरकार/राज्य सरकार/संघ राज्य क्षेत्रों/पब्लिक सेक्टर उपक्रम/स्वायत्त/कानूनी निकायों और केन्द्रीय सरकार/राज्य सरकार संगठन के ऐसे अधिकारी:-

(क) ( i ) जो मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर/ विभाग में 5000-8000 रु. या समतुल्य वेतनमान में उस श्रेणी में नियमित आधार पर नियुक्ति के पश्चात् छह वर्ष सेवा की है; और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव है :

New Delhi , the 5th March , 2004

G.S.R. 94. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Scientific Assistant in the Central Drugs Testing Laboratory , Chennai , namely :-

1. Short title and commencement .---( 1 ) These rules may be called the Central Drugs Testing Laboratory, Chennai, Senior Scientific Assistant, Recruitment Rules , 2004 .

(2) They shall conte into force on the date of their publication in the Official Gazette .

2. Number of post, Classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto.

3. Method of recruitment, Age limit , qualificationsetc. The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living , has entered into or contracted a marriage with any other person , shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for such doing, exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, and for reasons to be recorded in writing , in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backwark Communities , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

परन्तु यदि केन्द्रीय सरकार का यह, समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन मे छूट दे सकेगी ।

6. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति: - इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Forward Markets Commission (Personal Assistant Stenographer Grade - II ) Recruitment Rules, 1992 and the Forward Markets Commission (Junior Research Assistant and Stenographer ) Recruitment Rules , 1987, in so far as they relate to the post of Stenographer Grade - III , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Stenographers (Grade- 1 , Grade- II and Grade - III , Group C) in the Forward Markets Commission , Mumbai , under the Ministry of Consumer Affairs , Food and Public Distribution, (Department of Consumer Affairs ) , namely :-

1. Short title and commencement ( 1 ) These rules may be called the Forward Markets Commission ( Stenographers Grade- 1 , Grade-II and Grade- III ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment, age limit and other qualifications ,etc .-- The method of recruitment to the said posts, age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

5. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so , doing exempt any person from the operation of this rule .

6. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category ofpersons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other backward classes, Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time inthis regard.

2. पद- संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

उक्त पद पर भर्ती पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य 3. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि बातें वे होंगी , जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता:- कोई व्यक्ति

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्तपद पर नियुक्ति का पात्र नहीं होगा:

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति:- इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( i ) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से रसायन या कृषि रसायन या मृदा विज्ञान में मास्टर डिग्री या समतुल्य ।

( ii ) भूजल विश्लेषण और भूजल रसायन में दो वर्ष का अनुभव ।

टिप्पण 1.- अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2:- अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसुचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है क्रि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

10. परिवीक्षा की अवधि, यदि कोई हो

दो वर्ष

सीधी भर्ती:

ऐसी रिक्तियां जो पदधारियों द्वारा प्रतिनियुक्ति या लम्बी रूग्णता या अध्ययन छुट्टी अथवा अन्य परिस्थतियों के अधीन एक वर्ष या अधिक की अवधि के लिए रिक्त हुई हैं , नियुक्ति प्राधिकारी द्वारा केन्द्रीय सरकार के निम्नलिखित अधिकारियों में से प्रतिनियुक्ति के आधार पर भरी जा सकेंगी-

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर/विभाग में नियमित आधार पर नियुक्ति के पश्चात्5500-9000 रुपए के या समतुल्य वेतनमान में तीन वर्ष सेवा की है; और

(ख) जिनके पास स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं । ( प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु आवेदन प्राप्त करने की अन्तिम तारीख को 50 वर्ष से अधिक नहीं होगी ) ।

टिप्पण: ज्येष्ठ तकनीकी सहायक ( रसायन ) के 1640-2900 रुपए ( पुनरीक्षण पूर्व ) समूह ' ग ' के नियमित पद धारकों की उपयुक्तता 6500-10500 रुपए ( पुनरीक्षित ) समूह ' ख ' के उन्नयित वेतनमान के पद पर नियुक्तिके लिए विभागीय प्रोन्नति समिति द्वारा प्रारम्भ में निर्धारित की जाएगी । यदि उसे उपयुक्त निर्धारित किया जाता है तो उसे पद पर प्रारम्भिक गठन पर नियुक्त किया गया समझा जाएगा । यदि उसे ' उपयुक्त नहीं ' निर्धारित किया जाता है तो वह 5000-9000 रुपए के पुनरीक्षित वेतनमान में बना रहेगा और समूह ' ग ' पद धारण करेगा तथा मामले का प्रत्येक वर्ष पुनर्विलोकन किया जाएगा । 493

टिप्पण: ज्येष्ठ तकनीकी सहायक ( रसायन ) के 1640-2900 रुपए (पुनरीक्षण पूर्व ) समूह ' ग ' के नियमित पद धारकों की उपयुक्तता 6500-10500 रुपए ( पुनरीक्षित ) समूह ' ख ' के उन्नयित वेतनमान के पद परनियुक्ति के लिए विभागीय प्रोन्नति समिति द्वारा प्रारम्भ में निर्धारित कीजाएगी । यदि उसे उपयुक्त निर्धारित किया जाता है तो उसे पद पर प्रारम्भिक गठन पर नियुक्त किया गया समझा जाएगा । यदि उसे ' उपयुक्त नहीं' निर्धारित किया जाता है तो वह 5000-9000 रुपए के पुनरीक्षित वेतनमान में बना रहेगा और समूह ' ग ' पद धारण करेगा तथा मामले का प्रत्येक वर्ष पुनर्विलोकन किया जाएगा ।

G. S. R. 97. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Ground Water Board, (Group C and Group D posts) Recruitment Rules , 1968 , in so far as they relate to the post of Senior Technical Assistant (Chemical ) except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Technical Assistant (Chemical ) in the Central Ground Water Board , Ministry of Water Resources , namely :--

1. Short title and commencement . ( 1 ) These rules may be called the Central Ground Water Board , Senior Technical Assistant (Chemical ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of said post , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit qualifications , etc. The method of recruitment to the said post, age limit, qualifications and matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule.

4. Disqualifications . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person;

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of such rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so todo, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , the Other Backward Classes, the Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Qualifications are relaxable at the discretion of the Union Public Service Commission in case of candidates otherwise well qualified.

Note 2 : The qualification regarding experience is/ are relaxable at the discretion of the Union Public Service Commission in the case of candidates belonging to Scheduled Castes or Scheduled Tribes ifat any stage of selection the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities' possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note : The suitability ofthe regular holders ofthe post of Senior Technical Assistant ( Chemical ) in the scale of Rs . 1640-2900 (pre - revised) Group 'C' will be initially assessed by the Departmental Promotion Committee for appointment to the upgraded post in the scale of Rs. 6500-10500 (revised) Group ' B ' post. If assessed suitable he/she will be deemed to have been appointed to the post at the initial constitution. If assessed ' Not suitable ' , he /she shall continue to be in the revised scale of Rs . 5500-9000 and hold Group ' C' post and the case would be reviewed every year .
