सा.का.नि. 186.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक और संविधान के अनुच्छेद 148 के खण्ड ( 5 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय लेखा परीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखापरीक्षक के साथ परामर्श करने के पश्चात् केन्द्रीय सिविल सेवाएँ ( छुट्टी ) नियम , 1972 में संशोधन करने के लिए एतद्वारा निम्नलिखित नियम और बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का नाम केन्द्रीय सिविल सेवाएँ ( छुट्टी ) संशोधन नियम , 2004 है ।

(2) ये नियम शासकीय राजपत्र में अपने प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. केन्द्रीय सिविल सेवाएँ ( छुट्टी ) नियम, 1972 में ( इसके आगे से इन्हें उपर्युक्त नियम कहा गया है )

(क) नियम 19 में उप नियम ( 1 ) के स्थान पर निम्नलिखित उप नियम प्रतिस्थापित किया जाए अर्थात्:-

" ( 1 ) डॉक्टरी प्रमाण- पत्र के आधार पर दिया गया छुट्टी का कोई आवेदन पत्र-

(i ) राजपत्रित सरकारी कर्मचारी, द्वारा दिया गया डॉक्टरी प्रमाण पत्र यदि ऐसा सरकारी कर्मचारी केन्द्रीय सरकार स्वास्थ्य योजना का लाभग्राही है तो केन्द्रीय सरकार स्वास्थ्य योजना के डॉक्टर द्वारा फार्म 3 में डॉक्टरी प्रमाण- पत्र संलग्न किया जाएगा अथवा यदि वह केन्द्रीय सरकार स्वास्थ्ययोजना का लाभग्राही नहीं है तो सरकारी अस्पताल अथवा प्राधिकृत चिकित्सा परिचालक द्वारा जारी किया गया डॉक्टरी प्रमाण- पत्र संलग्न किया जाएगा ; अथवा हृदय, कैन्सर इत्यादि जैसी विशेष प्रकार की बीमारियाँ जिनके इलाज के लिए संबंधित अस्पताल , स्वास्थ्य और परिवार कल्याण मंत्रालय से मान्यताप्राप्त है, के सबंध में, अस्पताल में रखे जाने में मामले अथवा अंतरंग विशिष्ट इलाज के मामले में केन्द्रीय सरकार स्वास्थ्ययोजना अथवा केन्द्रीय सेवाएँ ( चिकित्सा परिचर्या ) नियम, 1944 के अन्तर्गत मान्यताप्राप्त निजी अस्पताल के प्राधिकृत डॉक्टर द्वारा जारी किया गया डॉक्टरी प्रमाण- पत्र संलग्न किया जाएः

बशर्ते कि केन्द्रीय सरकार स्वास्थ्य योजना का लाभग्राही राजपत्रित सरकारी कर्मचारी , यदि बीमार पड़ने के समय केन्द्रीय सरकार स्वास्थ्य योजना के दायरे में आने वाले क्षेत्र से बाहर हो अथवा मुख्यालय से दूर ड्यूटी पर चला गया हो तो वह प्राधिकृत चिकित्सा परिचारक द्वारा फार्म 3 अथवा फार्म 5 जैसा भी मामला हो , में दिया गया डॉक्टरी प्रमाण- पत्र अथवा आरोग्यता प्रमाण- पत्र संलग्न करेगा;

( ii ) अराजपत्रित सरकारी कर्मचारी द्वारा दिया गया डॉक्टरी प्रमाण - पत्र यदि वह केन्द्रीय सरकार स्वास्थ्ययोजना का लाभग्राही है तो उसके आवेदन के साथ केन्द्रीय सरकार स्वास्थ्य योजना के डॉक्टर द्वारा फार्म 4 में दिया गया डॉक्टरी प्रमाण- पत्र संलग्न किया जाएगा अथवा यदि वह केन्द्रीय सरकार स्वास्थ्ययोजना का लाभग्राही नहीं है तो सरकारी अस्पताल अथवा प्राधिकृत चिकित्सा परिचारक द्वारा जारी किया गया डॉक्टरी प्रमाण- पत्र संलग्न किया जाए; अथवा हृदय कैन्सर इत्यादि जैसी विशेष प्रकार की बीमारियाँ जिनके इलाज के लिए संबंधित अस्पताल , स्वास्थ्य और परिवार कल्याण मंत्रालय से मान्यताप्राप्त है, के संबंध में सक्षम प्राधिकारी द्वारा यथावत रूप से अनुमोदित, अस्पताल में रखे जाने के मामले अथवा अंतरंग विशिष्ट इलाज के मामले में केन्द्रीय सरकार स्वास्थ्ययोजना अथवा केन्द्रीय सेवाएँ ( चिकित्सा परिचर्या ) , नियम, 1944 के अन्तर्गत मान्यताप्राप्त निजी अस्पताल के प्राधिकृत डॉक्टर द्वारा जारी किया गया डॉक्टरी प्रमाण- पत्र संलग्न किया जाएः

बशर्ते कि केन्द्रीय सरकार स्वास्थ्य योजना का लाभग्राही अराजपत्रित सरकारी कर्मचारी , यदि बीमार पड़ने के समय केन्द्रीय सरकार स्वास्थ्य योजना के दायरे में आने वाले क्षेत्र से बाहर हो अथवा मुख्यालय से दूर डयूटी पर चला गया हो तो वह प्राधिकृत चिकित्सा परिचारक द्वारा फार्म 4 अथवा 5 जैसा भी मामला हो, में दिया या डॉक्टरी प्रमाण- पत्र अथवा आरोग्यता प्रमाण-पत्र संलग्न करेगा अथवा यदि उसके आवास अथवा उसके मुख्यालय से दूर उसके रहने के अस्थायी स्थान की 8 किलोमीटर की परिधि में कोई प्राधिकृत चिकित्सा परिचालक नहीं है और ऐसे हालात में भी जब केन्द्रीय सरकार स्वास्थ्य योजना के डॉक्टर से अथवा किसी प्राधिकृत चिकित्सा परिचालक से डॉक्टरी प्रमाण- पत्र अथवा आरोग्यता प्रमाण- पत्र प्राप्त करना कठिन हो तो ऐसे हालात में पंजीकृत डॉक्टर द्वारा जारी किया गया डॉक्टरी प्रमाण- पत्र अथवा आरोग्यता प्रमाणपत्र संलग्न करेगा ;

तथा डॉक्टर, बीमारी के स्वरूप और सम्भावित अवधि को स्पष्ट रूप से परिभाषित करते हुए उपर्युक्त प्रमाण - पत्र जारी करेगा । उपर्युक्त नियमों के नियम 20 मे उप नियम ( 2 ) के स्थान पर निम्नलिखित उप नियम प्रतिस्थापित किया जाएगा, अर्थात्: - (ख)

" ( 2 ) कोई सरकारी कर्मचारी जिसे चिकित्सा प्राधिकारी ने और आगे की सेवा करने में पूर्णतया और स्थायी रूप से असमर्थ घोषित किया हो -

(क ) यदि वह ड्यूटी पर चल रहा हो तो उसे, अपनी सेवा की अवधि के दौरान सेवा के लिए अमान्य नहीं ठहराया जाए ;

( ख ) यदि वह पहले से ही छु‌ट्टी पर चल रहा हो तो छुट्टी की अवधि की समाप्ति पर अथवा उप नियम ( 1 ) के अन्तर्गत छुट्टी में की 1041 भारत का राजपत्र : जून 5 , 2004/ ज्येष्ठ 15 , 1926

गई बढ़ोतरी यदि कोई हो, की अवधि की समाप्ति पर उसे सेवा के लिए अमान्य नहीं ठहराया जाए। "

( ग ) उपर्युक्त नियमों के नियम 38 में " 240 दिन " अंकों और शब्द के स्थान पर 300 दिन " अंक और शब्द प्रतिस्थापित किए जाएंगे ;

( घ ) उपर्युक्त नियमों के नियम 56 के स्थान पर निम्नलिखित नियम प्रतिस्थापित किए जाएंगे, अर्थात्:- " 56 अध्ययन छुट्टी के दौरान छुट्टी वेतन,

(1) उप- नियम ( 6 ) में किए गए उपबन्ध के सिवाय , भारत से बाहर ली गई छुट्टी के दौरान सरकारी कर्मचारी ऐसे वेतन के समान छुट्टी वेतन लेगा जैसा कि वह ऐसी छुट्टी पर जाने से तत्काल पूर्व ड्यूटी पर रहते हुए ले रहा होगा और इसके अतिरिक्त नियम 57 से 60 के प्रावधानों के अनुसार अनुज्ञेय मंहगाई भत्ते, गृह किराए भत्ते और छु‌ट्टी भत्ते का आहरण करेगा ।

(2) उप- नियम (6 ) में किए उपबन्ध के सिवाय, भारत में रहकर ली गई छूट्टी के दौरान सरकारी कर्मचारी ऐसे वेतन के समान छुट्टी वेतन लेगा जैसा कि वह ऐसी छुट्टी पर जाने से तत्काल पूर्वड्यूटी पर रहते हुए ले रहा होगा और इसके अतिरिक्त नियम 60 के प्रावधानों के अनुसार अनुज्ञेय मंहगाई भत्ते, गृह किराए भत्ते का आहरण करेगा ।

(3 ) उप- नियम ( 2 ) के अन्तर्गत पूर्ण दर पर छुट्टी वेतन का भुगतान , सरकारी कर्मचारी द्वारा इस आशय का प्रमाण पत्र प्रस्तुत किए जाने के अध्यधीन होगा कि वह कोई अंशकालिक रोजगार करके किसी तरह की छात्रवृत्ति, वजीफा अथवा परिलब्धियां प्राप्त नहीं कर रहा है । (4) नियम 57 के उप - नियम ( 2 ) में परिकल्पित किसी भी प्रकार के अंशकालिक रोजगार के संबंध में छात्रवृत्ति अथवा वजीफा अथवा परिलब्धि के रूप में अध्ययन छुट्टी की अवधि के दौरान सरकारी कर्मचारी द्वारा प्राप्त राशि, यदि कोई हो, को इस उप- नियम के अन्तर्गत देय छुट्टी वेतन के स्थान पर इस शर्त पर समायोजित किया जाएगा कि छु‌ट्टी वेतन की राशि को , अर्द्ध छु‌ट्टी वेतन के दौरान छु‌ट्टी वेतन के रूप में देय राशि से कम नहीं किया जाएगा ।

( 5 ) भारत में अध्ययन पाठ्यक्रमों संबंधी अध्ययन छुट्टी अवधि के दौरान कोई अध्ययन भत्ता नहीं दिया जाएगा ।

(6 ) एक जनवरी , 1996 से अथवा इसके पश्चात् भारत में रहकर अथवा भारत से बाहर रहकर ली गई अध्ययन छुट्टी के दौरान, केन्द्रीय सरकार का कर्मचारी संशोधित वेतन दिए जाने की तारीख से संशोधित वेतन के अनुसार दी जाने वाली प्रसुविधाओं के अनुरूप वेतन का आहरण करेगा । (ङ) उपर्युक्त नियमों की दूसरी अनुसूची में, बांड फार्म 6, 7, 8 , 9 और 10 में " भारत सरकार बांड पर देय स्टाम्प शुल्क वहन करने के लिए सहमत हो गई है " शब्द विलोपित कर दिए जाएंगे ।

G.S.R. 186.- In exercise of the powers conferred by the proviso to article 309 of the Constitution and clause (5 ) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules , 1972, namely :-

1. (1) These rules may be called the Central Civil Services (Leave ) Amendment Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Inthe Central Civil Services ( Leave ) Rules , 1972, (hereinafter referred to as the said rules) ,

(A) in rule 19, for sub -rule ( 1 ) , the following sub -rule shall be substituted, namely:-

.) " ( 1) An application for leave on medical certificate made by,

(i ) a Gazetted Government servant, shall be accompanied by a medical certificate in Form 3 given by a doctor in a Central Government Health Scheme Dispensary if such a Government servant is a Central Government Health Scheme beneficiary or by a Government Hospital or by an Authorised Medical Attendant if he is not a Central Government Health Scheme beneficiary; and by an Authorised Doctor of the private hospital recognized under Central Government Health Scheme or Central Services (Medical Attendance) Rules , 1944, in case of hospitalization or indoor specialized treatment in respect of any particular kind of disease like heart disease , cancer , etc. for the treatment of which the concerned hospital has been recognized by the Ministry of Health and Family Welfare:

Provided that the Gazetted Government servant who is a Central Government Health Scheme beneficiary, ifat the time ofillness , is away from Central Government Health Scheme area or proceeds on duty outside the Headquarters will produce Medical Certificate or Fitness Certificate in Form 3 and Form 5 , as the case may be , given by an Authorised Medical Attendant;

(ii) a non - Gazetted Government servant, shall be accompanied by a medical certificate in Form 4 given by a Central Government Health Scheme Dispensary if such a Government servant is a Central Government Health Scheme beneficiary or by Government Hospital or by an Authorised Medical Attendant if he is not a Central Government Health Scheme beneficiary ; and by an Authorized Doctor of the private hospital, recognized under Central Government Health Scheme or Central Services (Medical Attendance ) Rules , 1944, in case of hospitalization or indoor specialized treatment duly approvedby the competent authority in respect ofparticular kind of disease like heart disease, cancer, etc. for the treatment of which the concerned hospital has been recognized by the Ministry of Health and Family Welfare:

Provided that the non - Gazetted Government servant who is a Central Government Health Scheme beneficiary, if at the time of illness is away from Central Government Health Scheme area or proceeds on duty outside the Headquarters 1632 G1/ 04-2 1044

[PART II-SEC. 3 (i)] will produce Medical Certificate or Fitness Certificate in Form 4 or Form 5, as the case may be, given by an Authorized Medical Attendant or by Registered Medical Practitioner if there is no Authorised Medical Attendant available within a radius of eight kilometers from his residence or place of temporary stay outside his Headquarters and also in the circumstances when he finds it difficult to obtain Medical Certificate or Fitness Certificate from a doctor in a Central Government Health Scheme Dispensary or an Authorized Medical Attendant ;

defining clearly the nature and probable duration of illness .

(B) in rule 20 of the said rules, for sub - rule ( 2) , the following sub - rule shall be substituted, namely :-

"(2) A Government servant who is declared by a medical authority to be completely and permanently incapacitated for further service shall-

(a) if he is on duty, not be invalidated from service during his service period;

(b) ifhe is already on leave, not be invalidated from service on the expiry of that leave or extension of leave, ifanygranted to him under sub -rule ( 1 ) ." ;

(C) in rule 38 of the said rules , for the figures and word " 240 days " , the figures and word " 300 days" shall be substituted;

(D) for rule 56 of the said rules , the following rules shall be substituted, namely :-

"56 Leave Salary during study leave,-

(1) Except as provided in sub - rule ( 6), during study leave availed of outside India , a Government servant shall draw leave salary equal to the pay that the Government servant drew while on duty with Government immediately before proceeding on such leave and in addition the dearness allowance, house rent allowance and study allowance as admissible in accordance with the provisions of rules 57 to 60 .

(2) Except as provided in sub -rule (6), during study leave availed of in India , a Government servant shall draw leave salary equal to the pay that the Government servant drew while on duty with Government immediately before proceeding on such leave and in addition the dearness allowance and house rent allowance as admissible in accordance with the provisions ofrule 60 .

(3) Payment of leave salary at full rate under sub -rule ( 2) shall be subject to furnishing of a certificate by the Government servant to the effect that he is not in receipt of any scholarship , stipend or remuneration in respect of any part-time employment .

(4) The amount, if any, received by a Government servant during the period of study leave as scholarship or stipend or remuneration in respect of any part -time employment as envisaged in sub - rule (2) of rule 57, shall be adjusted against the leave salary payable under this sub -rule subject to the condition that the leave salary shall not be reduced to an amount less than that payable as leave salary during half- pay leave .

(5) No study allowance shall be paid during study leave for courses of study in India.

(6) During the currency of study leave within or outside India on or after the 1st day of January, 1996 , a Central Government servant shall draw benefits of revised pay from the date such revision took place . " ; and

(E) in the Second Schedule to the said rules , in Bond Forms 6,7, 8, 9 and 10, the words " The Government of India have agreed to bear the stamp duty payable on the bond" , shall be omitted .

सा.का.नि. 187.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय राष्ट्रीय अभिलेखागार ( एकल समूह " ख " के पदों हेतु भर्ती ) नियम, 1982 , जहां तक उनका सम्बन्ध पुस्तकालयाध्यक्ष और भारतीय राष्ट्रीय अभिलेखागार (पुस्तकालय एवं सूचना अधिकारी ) भर्ती नियम, 1996 से है , जहां तक वे पुस्तकालय और सूचना अधिकारी के पद से सम्बन्धित हैं, वो उन बातों के [PART II- SEC. 3 (i ) ] 1046

सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है । भारतीय राष्ट्रीय अभिलेखागार में समूह " क " पुस्तकालय एवं सूचना अधिकारी और समूह " ख " सहायक पुस्तकालय एवं सूचना अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

v. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय राष्ट्रीय अभिलेखागार ( रसमूह " क " और समूह " ख " पदों पर भर्ती ) नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा , और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्तिका पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. -इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों भूतपूर्व सैनिकों, अन्य उपिछड़े वर्गों, और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पद्धति : भर्ती सीधे होनी है या प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति /प्रतिनियुक्ति/ आमेलन किया जाएगा

प्रोन्नति द्वारा या प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रतिनियुक्तिअथवा प्रोन्नति:-

प्रतिनियुक्ति अथवा प्रोन्नति

1. केन्द्रीय सरकार के अधीन ऐसे अधिकारी:

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण करते हों; अथवा

(ii ) जिन्होंने मूल काडर या विभाग में 8000-275-13500 रु० के या समतुल्य वेतनमान में नियुक्तिके बाद उस श्रेणी में नियमित आधार पर पांच वर्ष सेवा की हो; अथवा

(iii ) जिन्होंने मूल काडर या विभाग में 6500-200-10500 रु ० के या समतुल्य वेतनमान में नियुक्तिके बाद उस श्रेणी में नियमित आधार पर आठ वर्ष सेवा की हो; और

(ख ) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हैं :

(i ) किसी मान्यताप्राप्त विश्वविद्यालय की मास्टर डिग्री या समतुल्य,

(ii ) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान या समतुल्य से पुस्तकालय विज्ञान में मास्टर डिग्री या समतुल्य,

(iii ) किसी मान्यताप्राप्त पुस्तकालय में पांच वर्ष का अनुभव।

2. ऐसे सहायक पुस्तकालय एवं सूचना अधिकारी जिन्होंने उस श्रेणी में आठ वर्ष नियमित सेवा की हो और जिसके पास किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक डिग्री या समतुल्य से पुस्तकालय विज्ञान में स्नातक डिग्री हो और बाहर से आये अन्य प्रत्याशियों के साथ विचार किया जाएगा । पद पर नियुक्तिके लिए चयन की दंशा में वह प्रोन्नति द्वारा भरा गया समझा जाएगा ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है साधारणतया.तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी । )

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा यदिविभागीय प्रोन्नति समिति है तो उसकी संरचना

प्रोन्नतिजिसके न होने पर प्रतिनियुक्ति द्वारा

ऐसे पुस्तकालय और सूचना सहायक में से, जिन्होंने उस श्रेणी में छह वर्ष नियमित सेवा की है और जिनके पास किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक डिग्री या समतुल्य और किसी मान्यताप्राप्त विश्वविद्यालय से पुस्तकालय विज्ञान में स्नातक डिग्री या समतुल्य ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के सम्बन्ध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नतिके लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के सम्बन्ध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे, कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति:

1. केन्द्रीय सरकार के अधीन ऐसे अधिकारी:

(क) ( i) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण करते हों; अथवा

( ii ) जिन्होंने मूल काडर या विभाग में 5500-175-9000 रु ० के या समतुल्य वेतनमान वाले पदों पर नियुक्ति के पश्चात् नियमित आधार पर उस श्रेणी में तीन वर्ष सेवा कीहो; अथवा

(iii ) जिन्होंने मूल काडर या विभाग में 5000-150-8000 रु० या समतुल्य वेतनमान में नियुक्तिके पश्चात् छह वर्ष सेवा की हो; और

(ख) जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखता हो :

(i ) किसी मान्यताप्राप्त विश्वविद्यालय के स्नातक डिग्री या समतुल्य,

G.S.R. 187. -In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the National Archives of India (Recruitment to certain isolated Group ' B ' posts ) Rules 1982 so far as these relate to the post of Librarian and the National Archives of India (Library and Information Officer ) Recruitment Rules, 1996 so far as it relates to the post of Library & Information Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group ' A' post ofLibrary & Information Officer and Group 'B' post of Assistant Library & Information Officer in the National Archives of India, namely:-

1. Short title and commencement. ( i ) These rules may be called the National Archives of India (Recruitment to Group 'A' and Group 'B ' posts ) Rules , 2004 .

(ii) They shall come into force from the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of post , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , educational qualifications , etc. The method of recruitment age limit , educational qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification. No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b ) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointmentto the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxations of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen , the Other Backward Classes , and other special categories of persons in accordance with the orders issued by the Central Government from timeto time in this regard.

(TheDepartmental Officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

Period of deputation including period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years . सा.का.नि. 188.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केंद्रीय भूमिगत जल बोर्ड ( कम्प्यूटर प्रचालक) भर्ती नियम, 1985, को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है , जल संसाधन मंत्रालय के अधीन केंद्रीय भूमिगत जल बोर्ड में आकड़े प्रक्रमण सहायक, श्रेणी- क पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ.-( 1 ) इन नियमों का संक्षिप्त नाम केंद्रीय भूमिगत जल बोर्ड में आकड़े प्रक्रमण सहायक, श्रेणी- क भर्ती नियम, 2004है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान.. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु- सीमा, और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।
