(ख) विनियम 41 में, उप विनियम ( 6 ) के लिए निम्नलिखित उप विनियम प्रतिस्थापित किया जाएगा:--

सं. 508 /एस.डब्ल्यू.डी./पेंशन बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम, 1970 ( 1970 का 5 ) की धारा 19 द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए सिंडिकेट बैंक का निदेशक मंडल भारतीय रिज़र्व बैंक से परामर्श करके तथा केन्द्र सरकार की पूर्व मंजूरी से सिंडिकेट बैंक ( कर्मचारी ) पेंशन विनियम , 1995 में और संशोधन करके एत‌द्वारा निम्नलिखित विनियम बनाता है, अर्थात:--

" (6 ) यदि कोई आवेदनकर्ता अभिवर्षिता पेंशन या स्वैच्छिक सेवा निवृत्ति पेंशन या अवधि पूर्व सेवा निवृत्ति पेंशन या अनिवार्य सेवा निवृत्ति पेंशन या अशक्त पेंशनं वा अनुकंपा भत्ते के लिए प्राधिकृत है तो वह इन विनियमों के अधीन अपने पेंशम के भाग के संराशीकरण के लिए हकदार होगा,

1. 1. ये विनियम सिंडिकेट बैंक ( कर्मचारी ) पेंशन ( संशोधन ) विनियम 2004कहलाएगें ।

2. ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।

2. सिंडिकेट बैंक ( कर्मचारी ) पेंशन विनियम 1995 में,

( क ) विनियम 2 के उपविनियम ' एस ' के खण्ड ( बी ) में उप खण्ड ( iii ) के बाद निम्मलिखित उप खण्ड शामिल किया जाएगा , अर्थात्: --

परंतु यह कि दिनांक 1.7.2003 को या से, यदि कोई आवेदनकर्ता जिसके मामले में, पेंशन का संराशीकृर्त मूल्य उसकी सेवानिवृत्ति के अगले दिन या संराशीकरण के ऑत्यंतिक होने की तारीख से देय हो जाता है , तो उक्त संराशीकरण के कारण पैशन की राशि में हुई कटौती प्रारंभ से ही प्रभावी होगी , फिर भी , यदि पेंशन के संराशिकरण मूल्य का संदाय , निवृत्ति की तारीख के बाद के प्रथम मास या संराशीकरण के आत्यंतिक बनने की तारीख के बाद के प्रथम मास , इनमें जो भी

सं. 666/20/पी/92-- बैंकाकारी कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम, 1980 ( 1980 का 40 ) को धारा 19 द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए आन्ध्रा बैंक के निदेशक मंडल ने भारतीय रिज़र्व बैंक के परामर्श तथा केन्द्र सरकार को पूर्व मंजूरी से , एत‌द्वारा आन्ध्रा बैंक ( कर्मचारी ) पेंशन विनियम, 1995 का संशोधन करने हेतु निम्नलिखित विनियम बनाता है , अर्थात्

1. ( 1 ) ये विनियम आम्ध्रा बैंक ( कर्मचारी ) पेंशन ( संशोधन ) विनियम 2004 नाम से जाने जाएंगे ।

( 2 ) सरकारी राजपत्र में प्रकाशन की तिथि से ये लागू होंगे । 2. आन्ध्रा बैंक ( इम्पलाईज ) पेंशन विनियम 1995 में (क ) विनियम 2 के उप विनियम ( एस ) में खंड ( ख ) में निम्नलिखित उप खण्ड सम्मिलित किया जाएगा ,

'( iv ) श्रृंखली ( नौरीज ) 1960-100 , में औद्योगिक कामगारों के लिए अदिल भारतीय औसत उपभोक्ता मूल्य सूची में सूची संख्या 1148 विभ्धुओं तक संगणित महंगाई भत्ता'

(ख) विनियम 41 में, उप विनियम ( ७ ) के लिए निम्न उप विभियम प्रतिस्थापित किया जाएगा, अर्थात् : --

' ( 6 ) जिस आवेदक को अधिवर्षिता पेंशन या स्वैच्छिक सेवानिवृत्ति पैशभ था कालपूर्व सेवानिवृत्ति पेंशन था अनिवार्य सेवानिवृत्ति पैशन घा अवैध पैशन या अनुकंपा भत्ता के लिए प्राधिकृत किया जाता है, बह इन विनिगमों के अंतर्गत अपने पेंशन का एक अंश संराशीकृत करने का पात्र है ।

बशर्तकि 1.7.2003 की एवं से, एक आर्थदक जिसके मामले में , पेंशन की संगशौकत मूल्य उसकी सेवानिवृत्ति की तिथि की परधर्ती

भाग III-खण्ड 4] तिथि को देय होता है या उसी तिथि, जबसे संराशीकरण निरपेक्ष हो जाता है, संराशीकरण के कारण पेंशन की राशि में कटौती इसके प्रारंभ से प्रवर्तनशील होगी । जहाँ, तथापि , पेंशन के संराशीकृत मूल्य का भुगतान सेवानिवृत्ति की तिथि के उपरांत प्रथम महीने के अंदर या उस तिथि, जबसे संराशीकरण निरपेक्ष हो जाता है, जैसा भी मामला ही, के प्रथम महीने के अंदर नहीं किया जा संका ती मासिक पेंशन एवं संराशीभूत पेंशन का अंतर सेवानिवृत्ति की तिथि की परवर्ती तिथि या उस तिथि, जबसे संघशीकरण निरपेक्ष हो जाता है , जैसा भी मामला हो, एवं पूर्ववती तिथि की तिथि से जबसे पेंशन का संराशीकृत मूल्य भुगतान किया गया माना जाता है , के बीच की अवधि के लिए भुगतान किया जाएगा'

( मुख्यालय ) द्वारा अधिसूचित क.रा.जी.भिगम मुख्य चिकित्सा अधिकारी ( आयुर्वेद ) भर्ती विनियम , 1998 और उनमें किए गए संशोधनों का अधिक्रमण करते हुए, ऐसे अधिक्रमण से पूर्व की गई अथवा करने से रह गई बातों के अलावा, निगम, एत‌द्वारा आयुर्वेदिक फिजीशियन के पद पर भर्ती पद्धति को विनियमित करते हुए निम्नलिखित विनियम बताता है, अर्थात्

1. संक्षिप्त नाम और प्रारम्भ :

1. ये विनियम कर्मचारी राज्य बीमा निगम ( आयुर्वेदिक पक्ष ) भर्ती (संशोधन ) विनियम 2004 कहलाएंगे । भात 111 -खण्ड 4)

2. ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे । 2. पदों की संख्या, अर्गीकरण और वेतनमान :

उक्त पदों की संख्या, उनका वर्गीकरण और उनसे संबद्ध बेतनमान इन विनियमों के साथ अनुबद्ध अनुसूचियों के कालम 2 से 4 में विनिर्दिष्ट अनुसार होंगे ।

3. भर्ती की पद्धति , आयु सीमा , अहंताएं और अन्य मामले आदि :

'उक्त पदों की भर्ती की पद्धति, आयु सीमा, अईताएं और अन्य संबंधित मामले उक्त अनुसूची के कालम 3 से 13 में विनिर्दिष्ट अनुसार होंगे ।

4. जिन पदों के लिए सीधी भर्ती बिहित की गई है उनके संबंध में चयन बोर्ग का गठन , चयन की प्रक्रिया आदि : - =

(क) चयन बोर्ड

( 1 ) अयन बोर्ड में निम्न शामिल होंगे : --

( क ) अंशकालिक अध्यक्ष, भारत सरकार के अपर सचिव अथवा सचित्र स्तर का होगा जिसे महानिदेशक, कर्मचारी राज्य बीमा निगम , अध्यक्ष, कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व- अनुमोदन से नियुक्त' कर सकेगा ।

(ख ) जिस विधा/विशेषज्ञ क्षेत्र ( फील्ड ) के संबंध में भर्ती की जानी है उससे संबंधित दो चिकित्सा विशेषज्ञ जिन्हें महानिदेशक , कर्मचारी राज्य बीमा निगम द्वारा इप्स प्रयोजन के लिए अनुरक्षित विशेषज्ञों के पैनल में से अध्यक्ष , चयन बोर्ड द्वारा, चुना जाएगा ।

( ग ) चिकित्सा आयुक्त , कर्मचारी राज्य बीमा निगम, विभागीय प्रतिनिधि होगा ।

( i ) अंशकालिक अध्यक्ष की पदावधि सामान्यतः चयन बोर्ड के गहन की तारीख से एक वर्ष के लिए होगी । परन्तु अध्यक्ष, कर्मचारी राज्य श्रीमा निगम के सुस्पष्ट पूर्व अनुमोदन से महानिदेशक द्वारा उनकी पदावधि कम की जा सकती है अथवा बढ़ाई जा सकती है ।

( ii ) अंशकालिक अध्यक्ष और चिकित्सा विशेषज्ञ , समय - समय पर महानिदेशक द्वारा , सरकार द्वारा निहित दरों को ध्यान में रखते हुए, नियत वरों पर यात्रा भत्ते, बैठक शुल्क आधि के पात्र होंगे ।

ख ) अधन की प्रक्रिया तथा रीति :

(क ) चिकित्सा अधिकारी ( आयुर्वेद ) के पद पर सीधी भर्ती सामान्यतः लिखित परीक्षा और तदुपरान्त पात्र और सफल उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी । साक्षात्कार के लिए आमंत्रित किए जाने वाले उम्मीदवारों की संख्या का निर्णय अध्यक्ष , अपन बोर्ड द्वारा रिक्तियों की संख्या और बिहित

2925 अपेक्षाओं की पूरा करने वाले अथवा लिखित परीक्षा में अहंक होने वाले आवेदकों की संख्या को ध्यान में रखते हुए किया जाएगा ।

(ख) आयु, अर्हकता, अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक की साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दाने का अधिकार प्राप्त नहीं हो जाता है ।

(ग ) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष , असन बोर्ड की प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक, कर्मचारी राज्य बीमा के कार्यालय द्वारा किया जाएगा ।

( घ ) चयन बोर्ड की आवश्यक सचिवीय सहायता, महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी ।

5. मिरर्हता

ऐसा कोई व्यक्ति : --

(क ) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का इकरार किया है जिसका विवाहिती जीवित है , अथवा ( ख ) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह करने का इकरार किया है उक्त पद पर नियुक्ति का पात्र नहीं होगा । परन्तु यदि निगम के महानिदेशक इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति या विवाह की दूसरी पार्टी पर लागू वैयक्तिक कानून के अन्तर्गत , अनुमेघ है या ऐसा करने से अभ्य आधार भी है तो से किसी व्यक्ति की इस नियम से छूट दे सकते हैं ।

6. डौल देने की शक्ति :

जहां निगम के महानिदेशक की राय में ऐसा करना अनिवार्य है या कालीचित है तो वे अध्यक्ष, कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन लेने के पश्चात, कारणों की लेखबद्ध करके, आवेश द्वारा किसी श्रेणी अथवा व्यक्तियों के वर्ग के लिए इस जिनियम के किसी उपक्रम्ध में डील दे सकेंगे ।

7. अपवाद :

इन विनियमों की कोई बात आरक्षणों, आयु सीमा में डौल और अम्प रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति , भूतपूर्व सैनिकों और व्यक्तिगों के अन्य विशेष बर्गों के लिए उपबन्ध कारमा अपेक्षित है ।

हमने 31 मार्च 2003 की स्थिति के अनुसार भारतीय विधिज्ञ परिषद् नई दिल्ली के संलग्न तुलमपत्र की और उससे संलग्न उस तारीख को सभाप्त वर्ष के आध-उध्य लेखा की जांच कर ली है । ये वित्तीय विवरण प्रबंध मंडल की जिम्मेदारी है । हमारा इत्तरदायित्व इन वित्तीय विवरणों पर अपनी लेखा परीक्षा पर आधारित राय व्यक्त करना है ।

हमने अपनी लेखा परीक्षा , भारत में सामान्यतः स्वीकृत लेखा परीक्षा संबंधी भानकों के अनुसार की है । उन मानकों में यह अपेक्षित है कि हम लेखा परीक्षा उसी ऐसी योजना बनाएं और उस हर प्रकार कार्यान्वित करें जिससे कि यह सुनिश्चित किया जा सके कि वित्तीय विवरण तात्विक गलत बयानी से मुक्त है । लेखा परीक्षा 'मैं वित्तीय विवरणों में बताई गई रकमों और प्रकटनों का समर्थन करने वाले साक्ष्य की , परीक्षण के आधार पर, परीक्षा करमा भी सम्मिलत है । लेखा परीक्षा में प्रबंध मंडल द्वारा अयुक्त किए गए लेखाकरण सिद्धांतों और किए गए महत्वपूर्ण प्राक्कलनों का निर्धारण करना और साथ ही प्रस्तुत किए संपूर्ण वित्तीय विवरण का मूल्यांकन करभा भी सम्मिलित है । हमारा विश्वास है कि हमारी लेखा परीक्षा हमारी राय की चुक्तियुक्त आधार प्रदान करती है ।

हमादी 'राब में और हमारी सर्वोत्तम जानकारी के अनुसार तथा हमें दिए गए स्पष्टीकरणों के अनुसार

1. आय और व्यय को उद्भूत होने के आधार पर माना जाता है किन्तु कल्याण निधि के लिए अभिदाय की गणना उनकी प्राप्ति के आधार पर किया जाता है ।

2. मुख्य निधि विधि महाविद्यालयों और अन्य से प्राप्त दान और भारतीय विधिज्ञ परिषद् का वार्षिक अधिशेष/ कमी को दर्शित करती है ।

1. दिल्ली नगर निगम से प्राप्त 31.3.2002 तक संपत्ति कर मद्धे 1,15,49,53 रु. की मांग को लेखाबद्ध नहीं किया गया क्योंकि इस मांग का परिषद् द्वारा विरोध किया जा रहा है ।

5. अनुसूचित बैंक के पास सावधि निक्षेपों में प्रतिभूति निक्षेप संबद्धता के रूप में विधि महाविद्यालयों से प्राप्त 2,04,00,000 / - रु . की रकम भी सम्मिलित है ।

6. कल्याण निधि का 20 %, प्रशासनिक व्यय की वसूली के रूप में , आय और व्यय लेखा में जमा किया जाता है । 7. पूर्व वर्ष के आंकड़ों को जहां कहीं आवश्यक समझा गया है, पुनः समूहीकृत/ पुनः वर्गीकृत किया गया है ।

8. दशमलव में बताई गई रकमों को निकटतम रुपए में पूर्णांकित किया गया है ।

1. (1 ) Thase Regulations may be called Andhra Bank (Employees' ) Pension ( Amendment ) Regulations , 2004.

2. In the Andhra Bank ( Employess ' ) Pension Regulations , 1995 ,

"( iv) dearness allowance calculated upto index number 1148 points in the All India Avarage Consumer Price Index for industrial workere in the serles 1960-100".

(b) In regulation 41 , for sub -regulation (6) the following sub - regulation shall be substituted namely:-

"(6) An applicant who is authorised a superannuation pansion or voluntary retirement pension or premature ratirement pension or compulsory retirement pension or invalid pension or compassionate allowance shall be eligible to commute a fraction of his pansion under these regulations.

Provided that on and from 1.7.2003 , in case of an applicant in whose casa , the commuted value of pension becomes payable on the day following the date of his retirement or from the date from which the commutation becomes absolute , the reduction in the amount of pansion on account of cosumutation shall become operative from its iception . Where, however, payment of commutad value of pension could not be made within the first month after the date of retirement or within the first month efter the date when the commutation becomes absolute as the case may be , the difference between the monthly pension and the commuted pension shall be paid for the period between the date following the date of retirement or the date when the commutation becomes absolute, as the case may be , and the date preceding the date on which commuted value of pension is deemed to have been paid" .

(1) Short title and commencement : --

( 1 ) These Regulations may be called the Employees ' State Insurance Corporation (Ayurvedie Posts) Recruitment ( Amendment) Regulations , 2004 .

(a) Direet recruitment to the post of Medical Officer (Ayurveda) shall ordinarily be made on the basis of a written examination followed by an interview of eligible and successful candidates. (d) The Selection Board will be provided necessary Secretarial Assistance by the office of the Director General , Employees ' State Insurance Corporation.

5.Disqualification

No person:---

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to said posts.

[PART III-SBC . 4 Provided that the Director General may, if satisfied that such marriage is permissible , under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of thisRule.

6. Power to relax:

Where the Director General of the Corporation is of opinion that it is necessary or expedient to do so , he may, by order, for reasons to be recorded in writing and after other obtaining specific prior approval of the Chairman , Employees ' State Insurance Corporation relax any of the provisions of this Regulation with respect to any class or category of persons .

7. Savings:

Nothing in these Regulations shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen and other special categories of persons in accordance with the orders issusd by the Central Govt . from time to time in this regard.

In partial modification of the Notification No. R- 12/ 19 / 1 / 8MB/98 - Ins.II dated 27.8.03 published in the Gazette of India No. 38 [ Part III - Section 4 ] dated September 20 to 26, 2003 at page No. 9324, the Director General, ESI Corporation has decided that the jurisdiction of the Medical Board shall now be the whole of the Punjab State instead of the areas mentioned in the said notification.

SIGNIFICANT ACCOUNTING POLICIES

1 . Income and expenditure are recognised on accrual hasis except contribution towards Welfare fund which is accounted for on receipt basis .

2. Corpus Fund represents donations received from Law Colleges and others and annual surplus/deficit of the Bar Council of Indla,

3. Interest pertaining to a specific fund has been credited to the respective fund account .

4. Depreciation on Fixed Assets is charged at the rates prescribed under the Income Tax Act, 1961 .

NOTES TO ACCOUNTS

1. Demand received from MCD amounting to Rs . 1,15,49,535/- towards property tax upto 31-3-2002 have not been accounted for since the same are being contested by Council .

2. Welfare Fund represents contribution received from Advocates in accordance with the Bar Council of India Rules .

3. Provident Fund is recognised under rule 3 ( 1) of the part -A ofthe IVth schedule of the Income Tax 1961 vide letter No. JP- 1 ( 6)/63/3332 dated 25-12-1965 ( order No. 1 of 1965-66 ) . However the fund is not recognised by the Regional Provident Fund Commissioner.

4. Gratuity Fund is recognised under the Income Tax Act 1961 , Bar Council of India contributes 8.33 % of the basic pay and dearness allowance of the employees .

5. Fixeddeposits with scheduled bank includes Rs . 2,04,00,000 received from iaw college as security deposit affiliation .

20% of Welfare Fund is credited to Income & Expenditure Account as recovery ofAdministrative Expenses . 6.

7. Previous year figures have been regrouped/reclassified wherever considered necessary.

8. The amounts in decimals have been rounded off to nearest rupee.
