सा.का.नि. 199.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और गृह मंत्रालय, भारत के महारजिस्ट्रार का कार्यालय में ( मानचित्र विश्लेषक) भर्ती नियम , 2001 और भारत के महारजिस्ट्रार का कार्यालय ( मानचित्र विश्लेषक ) भर्ती (संशोधन) नियम, 2003 का अधिक्रमण करते हुए, अधिक्रमण से पहले इस संबंध में की गई या लोप की जाने वाली कार्यवाही को छोड़कर, भारत के महारजिस्ट्रार का कार्यालय में मानचित्र विश्लेषक के उक्त पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भः ( 1 ) इन नियमों का संक्षिप्त नाम भारत के महारजिस्ट्रार का कार्यालय ( मानचित्र विश्लेषक ) भर्ती नियम, 2004 होगा।

(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पदोंकी संख्या , वर्गीकरण और वेतनमान इन पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा जो इन नियमों से उपोबद्ध अनुसूची के कालम ( 2 ) से कालम ( 4 ) में विनिर्दिष्ट हैं ।.

3. भहीं की पद्धति, आयु सीमा, शैक्षिक अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, शैक्षिक अर्हताएं और उक्त पदा से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के कालम ( 5 ) से कालम ( 14 ) में विनिर्दिष्ट हैं । 1759GI/2004

[PART II-SEC. 3 (1)] 4. निरर्हताएं. वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से, जिसका पति या पत्नी जीवित है , विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए, किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

प्रन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह, उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों के बारे में, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई भी बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टिप्पणी: जहां प्रोन्नति के लिए ऐसे कनिष्ठों के नाम पर विचार किया जाता है जिन्होंने अर्हक/पात्रता सेवा पूर्ण कर ली है, ती उनसे वरिष्ठ कर्मचारियों के नाम पर भी विचार किया जाएगा बशर्ते .'किउन्होंने ऐसी अर्हक/पात्रता सेवा की आधे से अधिक अथवा दो वर्ष, जो भी कम हो, की अर्हक/पात्रता सेवा पूर्ण कर ली हो और उन्होंने अपने ऐसे कनिष्ठों जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूर्ण कर ली है , सहित अगले उच्चतर ग्रेड में प्रोन्नति के लिए सफलतापूर्वक अपनी परिवीक्षाअवधि पूर्ण कर ली हो । [भाग II- खण्ड 3( i) ]

प्रतिनियुक्ति(अल्पकालिक संविदा सहित ):

केन्द्र/राज्य सरकार/ संघ राज्यक्षेत्र/सार्वजनिक उपक्रम/विश्वविद्यालय/मान्यताप्राप्त अनुसंधान संस्थान/स्वायत्त/अर्ध सरकारी अथवा सांविधिक संगठनों में कार्यरत ऐसे कर्मचारी जो: -

(क) ( i ) मूल संवर्ग/विभाग में नियमित आधार पर सदृश पद धारण किए हों; अथवा

(ii ) मूल संवर्ग/विभाग में 6500-10500 रुपये अथवा समकक्ष वेतनमान वाले पद परनियमित आधार पर नियुक्ति के पश्चात् ग्रेड में तीन वर्ष की सेवा पूर्ण कर चुके हों; और

(ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों:

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से भूगोल में स्नातकोत्तर डिग्री अथवा समकक्ष;

(ii ) अनुप्रयुक्त मानचित्रकारी में दो वर्ष का अनुभव।

(फीडर वर्ग के वे विभागीय कर्मचारी , जो प्रोन्नति की सीधी लाइन में हैं, प्रतिनियुक्ति पर नियुक्तिके लिएविचार के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्ति पर नियुक्त कर्मचारी प्रोन्नति पर नियुक्तिके लिएविचार के पात्र नहीं होंगे । केन्द्रीय सरकार के उसी अथवा अन्य संगठन/विभाग में इस नियुक्ति से तुरंत पहले धारित किसी अन्य संवर्ग - बाह्य पद पर प्रतिनियुक्ति/संविदा की अवधि सहित प्रतिनियुक्ति/ संविदा की अवधि सामान्यतः तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति ( अल्पकालिक संविदा सहित ) द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त होने की अन्तिम तारीख को 56 वर्ष सेअधिक नहीं होगी। )

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Home Affairs , Office of the Registrar General, India (Map Analyst) Recruitment Rules, 2001, and the Office of the Registrar General, India (Map Analyst) Recruitment (Amendment ) Rules, 2003 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitmentto the said posts of Map Analyst in the Office of the Registrar General , Indiá, namely 1. Short title and commencement-( 1 ) These rules may be called the Office of the Registrar General, India (Map Analyst) Recruitment Rules, 2004.

i (2) They shall come into force on the date of their publication in the Official Gazette.

2. Number ofposts, Classification and scale of pay. The number of said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

[PART II-SEC. 3(1)] 3. Method of recruitment , age limit, educational qualifications , etc.-The method of recruitment, age limit, cducational qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualifications. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any personfromthe operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax anyofthe provisions of these rules with respect to any class or category ofpersons.

6. Savings . Nothing in these rules shall affect reservations, relaxation of age limit, and other concessions requiredto be provided for the candidates belonging to Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex-servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

(b) possessing the following educational qualifications and experience :

(1) Master's Degree in Geography of a recognised University or equivalent;

(ii) Two years ' experience in applied Cartography .

[Thedepartmental officers in the feeder category who are in the direct line ofpromotion shall not be eligible for consideration for appointment on deputation . Similarly , deputationists shall not be eligible for consideration for appointment by promotion. Period ofdeputation/ contract including period of deputation/contract in another ex- cadre post held immediately preceding this appointment in the same or some other Organization/Department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation ( including short-term contract) shall not exceed 56 years as on the closing date of receipt of applications] .

सा.का.नि. 201.-यतः वाणिज्य एवं उद्योग मंत्रालय ( औद्योगिक नीति एवं संवर्धन विभाग ) (केन्द्रीय बायलर बोर्ड ) भारत सरकार, के दित्तांक 21 अक्तूबर , 2003 की अधिसूचना संख्या सा. का. नि. 380 के तहत इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव उक्त अधिसूचना से संबंधित राजपत्र की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने तक मांगने के लिए भारतीय बायलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 31 की उप- धारा ( 1 ) , जो दिनांक 25 अक्तूबर, 2003 के भारत के राजपत्र के भाग II, खण्ड 3 , उपखण्ड ( i ) में है , द्वारा यथा अपेक्षित भारतीय बायलर विनियम, 1950 में और संशोधन करने के लिये कतिपय मसौदा विनियम प्रकाशित किये गये थे;

और जबकि उक्त अधिसूचना वाले राजपत्र की प्रतियां आम जनता को 7 नवम्बर, 2003 को उपलब्ध करा दी गई थीं;

और जबकि विनिर्दिष्ट अवधि के भीतर इस अधिसूचना में निहित संशोधनों के बारे में कोई भी आपत्तियां अथवा सुझाव प्राप्त नहीं हुए;

अतः अब भारतीय बायलर अधिनियम, 1923 की धारा 28 में प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय बायलर बोर्ड, एत‌द्वारा भारतीय बायलरविनियम , 1950 में और संशोधन करने हेतु निम्नलिखित विनियम बनाता है. नामत:-

1. ( 1 ) इन विनियमों को भारतीय बायलर ( संशोधन ) विनियम, 2004 कहा जायेगा ।

(2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बायलर विनियम , 1950 में विनियम 4ङ में " तीन वर्ष " शब्दों के स्थान पर शब्द" पांच वर्ष " प्रतिस्थापित किये जाएंगे ।

Whereas certain draft regulations further to amend the Indian Boiler Regulations, 1950 were published, as required by Sub-section ( 1 ) of Section 31 of the Indian Boilders Act, 1923 (5 of 1923 ) , vide notification of the Govemment ofIndiainthe Ministry ofCommerce and Industry (Department of Industrial Policy and Promotion) (Central BoilersBoard) number G.S.R. 380 , dated the 21st October, 2003 , in Part II, Section 3 , Sub- section (i ) of the Gazette of India, dated the 25th October, 2003 , for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of forty- five days from the date on which copies of the Gazette containing the said notification were made available to the public;

Andwhereas the copies of the said Gazette containing the notification were made available to the public on the 7th November, 2003;

And whereas no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

Now, therefore , in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely:-- 1. (1 ) These regulations may be called the Indian Boiler (Amendment ) Regulations, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Boiler Regulations, 1950, in regulation 4E, in sub -regulation (a) , for the words " three years" , the words " five years " shall be substituted.

No. 118 dated 24th March , 2004, published in the Gazette of India, Part II, Section 3, Sub -section ( i ) dated 10th April, 2004, namely:-

सा.का.नि. 203.- यतः वाणिज्य एवं उद्योग मंत्रालय ( औद्योगिक नीति एवं संवर्धन विभाग ) ( केन्द्रीय बॉयलर बोर्ड ) भारत सरकार, के दिनांक 21 अक्तूबर, 2003 की अधिसूचना संख्या सा. का. नि. 378 के तहत इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव उक्त अधिसूचना से संबंधित राजपत्र की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने तक मांगने के लिए भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 31 की उप- धारा ( 1 ) , जो दिनांक 25 अक्तूबर , 2003 के भारत के राजपत्र के भाग II, खण्ड 3 , उपखण्ड ( i ) में है , द्वारा यथा अपेक्षित भारतीय बॉयलर विनियम, 1950 में और संशोधन करने के लिये कतिपय मसौदा विनियम प्रकाशित. किये गये थे;

और जबकि उक्त अधिसूचना वाले राजपत्र की प्रतियां आम जनता को 7 नवम्बर, 2003 को उपलब्ध करा दी गई थी;

अतः अब भारतीय बॉयलर अधिनियम, 1923 की धारा 28 में प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड, एत‌द्वारा भारतीय व्दॉयलर विनियम, 1950 में और संशोधन करने हेतु निम्नलिखित विनियम बनाता है , नामतः-

... 1. ( 1 ) इन विनियमों को भारतीय बॉयलर ( द्वितीय संशोधन ) विनियम, 2004 कहा जायेगा ।

i (2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बॉयलर विनियम, 1950 ( जिसे इसके पश्चात् उक्त विनियम कहा जायेगा ) में विनियम 392 के लिए निम्नलिखित विनियम प्रतिस्थापित किया जायेगा, नामतः:-

" 392. बायलरों तथा स्टीम पाइपों की मरम्मत.-( 1 ) बायलरों के खोलों, अग्नि डिब्बों तथा अंत प्लेटों पर गलित वैल्डयुक्त अथवा रिवेटयुक्त चिप्पियों तथा इन विनियमों के अधीन अनुमत बॉयलरों के बेकार हिस्सों का व्यापक निर्माण , भट्टियों तथा अंत प्लेटों, खोल के हिस्सों, अग्निः डिब्बों, गर्डरों व स्टीम पाइपों के नवीकरण आदि जैसे मुख्य मरम्मत कार्य ऐसे फर्म को सौंपे जायेंगे जो इन विनियमों के अधीन एक मान्यताप्राप्त मरम्मतकर्ता हैं ।

(2) मान्यता का अनुरोध करने वाली फर्म को एक बायलर मरम्मतकर्ता के रूप में मान्यता लेने के लिए उस राज्य के मुख्य बायलर निरीक्षक को आवेदन प्रस्तुत किया जायेगा जिस राज्य में मान्यता मांगी गयी है ।

(3 ) बायलर मरम्मतकर्ता के रूप में मान्यता का अनुरोध करने वाली फर्म को बायलर की श्रेणी के अनुसार निम्नलिखित अपेक्षाओं की पूर्ति करनी होगी, अर्थात्: -

( i ) श्रेणी 1 बायलर मरम्मतकर्ता- यांत्रिक अथवा वैद्युत अभियांत्रिकी में डिग्री और बायलरों के अंशांकन, स्थापन, मरम्मत या अनुरक्षण तथा गुणवत्ता नियंत्रण में पांच वर्ष का अनुभव और इन विनियमों के उपबंधों के अनुसार योग्य व स्थायी रूप से नियोजित वेल्डर;

(ii) श्रेणी 2 बायलर मरम्मतकर्ता- यांत्रिक अथवा वैद्युत अभियांत्रिकी में डिप्लोमा और बायलरों के अंशांकन, मरम्मत तथा अनुरक्षण में तीन वर्ष का अनुभव;

( iii ) श्रेणी 3 बायलर मरम्मतकर्ता- बॉयलर की मरम्मत, अनुरक्षण , प्रचालन, स्थापना अथवा निरीक्षण कार्य का पांच वर्ष का अनुभव।

( iv) (क) जहां स्वामी अपने स्वयं के बायलरों की मरम्मत के लिए आवेदन करता है , तब उस मामले में उसके पास सभी आंतरिक सुविधाएं होनी चाहिए और उसे इन विनियमों के अनुसार स्वयं के बायलरों की मरम्मत करने की अनुमति के लिए राज्य के मुख्य बायलर निरीक्षक को आवेदन देना चाहिए।

(ख) बायलर की मरम्मत के लिए अनुमति हेतु आवेदन प्राप्त होने पर राज्य का मुख्य बायलर निरीक्षक आवेदन प्राप्त होने पर राज्य का मुख्य बायलर निरीक्षक आवेदन प्राप्त होने के पन्द्रह दिन की अवधि के भीतर आवेदन का उत्तर देगा । (4) उप विनियम 3 के अधीन आवेदन प्राप्त होने पर मुख्य निरीक्षक फार्म 18 में आवेदनकर्ता को एक प्रश्नावली फार्म भेजेगा । (5 ) मुख्य निरीक्षक प्रश्नावली के उत्तरों के साथ - साथ आवेदन की जांच और मूल्यांकन करेगा तथा स्वयं को यह संतुष्ट करने के बाद किनिम्नलिखित अपेक्षाएं पूरी हो गयी हैं, फर्म को उस श्रेणी के मरम्मतकर्ता के रूप में मान्यता दे देगा जिसके लिए आवेदन किया गया है:-

(i ) कि उसके पास रैक्टिफायर अथवा जेनरेटर, ग्राइंडर सामान्य या व उपकरण, रंग प्रवेशकारी किट, विस्तारकारी तथा मापन औजार हैं;

( ii ) कि मरम्मत करने के लिए उसके इलैक्ट्रिक आर्क या ओक्सी- एसीटीलीन सैट और अन्य सभी औजार व संयंत्र आरंभ किए गए कार्य के लिए उपयुक्त हैं;

iii ) कि प्रयुक्त सामग्री की गुणवत्ता निर्धारित विनिर्देशों के अनुरूप है;

(

(iv ) कि उसके द्वारा नियोजित पर्यवेक्षी तथा प्रचालन कर्मचारियों के पास कार्य आरंभ करने के लिए अपेक्षित प्रशिक्षण और अनुभव हैं;

(v ) कि उसके द्वारा नियोजित सभी वेल्डरों के पास इन विनियमों के अध्याय 13 के अधीन की गयी अपेक्षानुसार जारी किए गए प्रमाणपत्र हैं;

(vi ) कार्य उच्च स्तर का होना चाहिए तथा मुख्य निरीक्षक द्वारा निर्धारित की जाने वाली सभी अपेक्षाओं तथा जांच का अनुपालन किया जाना चाहिए ।

(6 ) एक मरम्मतकर्ता के रूप में फर्म की मान्यता दो वर्ष की अवधि के लिए होगी, तत्पश्चात् उन्हें अपनी मान्यता की समाप्ति से कम से कम दो महीने पूर्व अपनी मान्यता के नवीकरण हेतु आवेदन करना होगा।

(7) यदि मरम्मतकर्ता जानबूझकर अथवा अनजाने में अधिनियम या विनियमों के उपबंधों का उल्लंघन करने में लिप्त पाया जाता है तो उसके फर्म को दोषियों की सूची में सूचीबद्ध किया जायेगा, जिसकी सूचना सभी राज्यों या संघ शासित प्रदेशों के मुख्य निरीक्षकों या बॉयलर निदेशकों को दी जायेगी और किसी सभी हाल में नवीकरण नहीं किया जा सकेगा ।

" 392 क. मरम्मत की पद्धति.-( 1 ) मरम्मत कार्य निरीक्षक की देखरेख में किया जायेगा और जब लोकोमोटिव ट्यूब बायलरों की अग्नि पेटियों और धुएं की ट्यूबों को निकाला जाना होगा तंब आंतरिक हिस्से - पुर्जों, जो अन्यथा रूप में गहन निरीक्षण हेतु पहुंच में नहीं होते हैं, का निरीक्षण निरीक्षक को करना होगा ।

( 2 ) बॉयलर शेलों की मरम्मत चिप्पी लगाकर अथवा टूटी पट्टी अथवा क्षतिग्रस्त प्लेट को हटाकर और लंबाई में कुंदे के सिरे के ऊपर कवर पट्टी के साथ नई पत्ती लगाकर की जाएगी, रिविट लगे जोड़ की मजबूती शेल की लंबाई वाले जोड़ों से कम नहीं होगी ।

(3 ) ( i ) अग्नि विगापित प्लेटों की चिप्पियां किसी निरुपण जोड़ों के बिना धातु से धातु पर लगानी होगी ।

( ii ) प्रभावित हिस्से को काटना होगा और छिद्र के कार्नर गोलाईयुक्त रखने होंगे ।

( iii ) जहां तक संभव हो सके, चिप्पियां उचित विस्तार के रिविटों से सुरक्षित की जायेंगी, जिसमें रिषिट द्विद्र के किनारे और प्लेर्ट की किनारी के बीच कम से कम रिविट के व्यास के बराबर की मोटाई होनी चाहिए ।

( iv ) जहां रिविट लगाना व्यावहारिक नहीं होता है, प्लेट को पेचदार कील लगाकर सुरक्षित करना होगा ।

(4) चिप्पी प्लेट की मोटाई पहले प्रयुक्त की गई प्लेट की मूल मोटाई से कम नहीं होगी ।

(5) यदि उभरा अथवा विकृत भाग बहुत बड़ा नहीं है तो उभरे अथवा विकृत भट्टी अथवा गोलाकार भाग को पीछे को दबा कर आकार दिया जा सकता है ।

(6 ) जो विकृत हो गये हैं उन समानांतर बॉयलर के गोलाकार भट्टों को उचित रूप में पुनः लगाया जा सकता है ।

(7) ( i ) पात- रोधी छल्ले पर्याप्त अंश के होंगे जो 22 मि.मी. से अधिक व्यास के और लगभग 178 मि. मी. चूड़ी के ठहरांवों से कोण के सपाट के जरिये पीछे से बोल्ट युक्त एक या दो कोणों में होंगे और भट्ट में पेच से जुड़े होंगे ।

(ii ) इनके शिरे आग की तरफ या तो गोलाई लिए हुए या रिविट लगे हों और दूसरी ओर नट से जोड़े गये हों ।

( 8 ) बॉयलर के किसी भाग की मरम्मत के लिए वेल्डिग करना स्वाकार्य नहीं होगा, जिसके लिए इन विनियमों के अधीन नये बॉयलर में वेल्डिंगकरने की मनाही है और बॉयलर शेलों की मरम्मत थोड़े पथक घिसे हुए अथवा द्विद्रित भाग की भराई करने अथवा खुले खराब किनारियों को बनाने के अतिरिक्त वैल्डिंग करके नहीं करनी होगी ।

( 9 ) गोलाकार शेलों की तवा - कार सिरों में अथवा समतल प्लेटों के शिरे में अथवा परिधीय दिशा में भ‌ट्टों के कोरों के मोड़ों में दरारों अथवा सन्धियों को समाप्त किया जा सकता है और वैल्ड किया जा सकता है ।

( 10 ) गोलाकारी भट्टों और अग्नि पेटियों और आयताकार अग्नि पेटियों और कम्बस्टन चैम्बरों में यथा अग्नि विगोपित प्लेटों के खराब हिस्सों को काट कर निकाला जा सकता है और नये टुकड़ों को जोड़ कर उन्हें बदला जा सकता है अथवा वैल्डिंग करके उनको विनिर्मित किया जा सकताहै ।

(11 ) गोलाकारी भ‌ट्टों और अग्नि पेटियों में लम्बवत् सन्धियों को और आयताकार अग्नि पेटियों व कम्बस्टन चैम्बरों की सन्धियों की वैल्डिंग की जा सकती है ।

(12) ठहराव छड़ों की वैल्डिग नहीं की जायेगी ।

( 13) धुएं के ट्यबों की सिराओं की वैल्डिग की जा सकती है जो या तो गलन वैल्डिंग या प्रवाहन वैल्डिंग या आक्सी- एसीटिलीन वैल्डिग से की जायेगी और इनकी जांच मुख्य बायलर निरीक्षक के विवेकानुसार जलप्रवाह करके की जानी होगी ।

(3 ) उक्त विनियमों में प्रारूप -17 के बाद, निम्नलिखित जोड़ा जायेगा; अर्थात्:-

भारतीय बॉयलर विनियम, 1950 के तहत बॉयलों/इकॉनोमाइजर/स्टीम लाइन/ फीड वाटर लाइन आदि की मरम्मतकर्ता के लिए प्रश्नावली - प्रपत्र ।.

1. फर्म का पंजीकृत नाम और इसका स्थाई पता

4. फर्म द्वारा पहले किस किस्म के कार्य किए गये हैं, जिसमें उनके द्वारा किया गया अधिकतम कार्यभार, तापमान और अंतर्ग्रस्त सामग्री का विशेष उल्लेख किया जाए और साथ ही लिखित साक्ष्य प्रस्तुत किए जाएं ।

5. क्या फर्म को किसी बॉयलर निदेशालय/निरीक्षणालय द्वारा कभी कोई स्वीकृति दी गई है ? यदि हां, तो कृपयाब्यौरा दें ।

6. क्याआपके पास विनियम 392 (5 ) ( i ) के तहत कोई रेक्टिफायर/ जनरेटर, ग्राइंडर, सामान्य टूल व टैकल , डाई पेनीट्रेंट किट, एक्सपैंडर तथा मापने का उपकरण अथवा कोई अन्य टूल व टैकल हैं ?

7. तकनीकी कार्मिकों की विस्तृत सूची साथ ही फर्म में स्थाई रूप से नियोजित वैल्डरों के वर्तमान प्रमाणपत्रों जो उक्त विनियम के तहत जारी किये गये हैं की फोटो कापी

8. फर्म कितने कार्यस्थलों का एक ही समय में उपयोग कर सकेगा, उसका उल्लेख करें ।

9. क्याफर्म विनियमों के अनुरूप सख्ताई से कार्य को पूरा करने तथा कार्य का उच्च दर्जा बनाये रखने के लिए तैयार है ?

10. क्या फर्म किये गये कार्य हेतु पूर्ण उत्तरदायित्व स्वीकार करने के लिए तैयार है और यदि आवश्यक हो तो किसी विवादास्पद मामले के बारे में स्पष्टीकरण देने के लिए तैयार है ?

11. क्या फर्म जरूरत पड़ने पर समुचित जांच प्रमाण पत्र सहित तथा अपेक्षित विनिर्देशन के अनुसार सामग्री की आपूर्ति करने की स्थिति में है ?

12. क्या फर्म के पास उनकी अपनी स्वयं की आंतरिक गुणवत्ता नियंत्रण प्रणाली है ? यदि हां, तो कृपया ब्यौरा दें

फर्म के अधिकृत हस्ताक्षरधारी के 13. नियोजन कार्मिकों की योग्यता/ अनुभव दिनांक स्थान:

हस्ताक्षर और मुहर टिप्पण: 1. एक मरम्मतकर्ता के रूप में फर्म की मान्यता दो वर्ष की अवधि के लिए होगी । तत्पश्चात् उन्हें अपनी मान्यता की समाप्ति से कम से कम दो महीने पूर्व अपनी मान्यता के नवीकरण हेतु आवेदन करना होगा ।

G.S.R. 203. Whereas certain draft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by Sub -section (1 ) ofSection 31 of the Indian Boilers Act, 1923 (5 of 1923),vide notification of the Govemment ofIndia in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) (Central Boilers Board) number G.S.R. 378 , dated the 21st October , 2003 , published in the Gazette of India, Part II , Section 3 , Sub -section (i ) dated the 25th October, 2003 , for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of forty- five days from the date on which copies ofthe Gazette containing the said notification were made available to the public;

Andwhereas the copies ofthe said Gazette containing the notification were made available to the public on the 7th November , 2003 ;

And whereas no objections or suggestions have been received within the specified period in respect of the amendments contained in the said notification;

Now, therefore, in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950, namely:-

1. (1 ) These regulations may be called the Indian Boiler (Amendment) Regulations, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Boiler Regulations, 1950 (hereinafter referred to as the said regulations ) , for regulation 392, the following regulation shall be substituted , namely:-

"392. Repairs to boilers and steam pipes ( 1 ) Major repairs such as fusion welded or riveted patches to shells, fire boxes and end plates of boilers and extensive building up of wasted parts of boilers permitted under these regulations, the renewal of furnaces and end plates , parts of shell , fire boxes , girders and steam -pipes ,etc. shall onlybe entrusted to a firm who is recognised as a repairer under these regulations .

(2) Any firm seeking recognition shall apply to Chief Inspector of Boilers of the State in which the recognition is sought.

(3) A firm seeking recognition as a repairer shall meet the following requirements depending upon the class of boilers , namely:

(1) Class I boiler repairer- The owner of the firm himself shall have a degree in mechanical or electrical engineering or the firm shall have on its rolls a permanently employed engineer having a degree in mechanical or electrical engineering with the firm having at least five years ' experience in fabrication , erection, repair or maintenance and quality control of boilers , and qualified and permanently employed welders as per the provisions of these regulations;

(ii) Class II boiler repairer-The owner of the firm himself shall have a diploma in mechanical or electrical engineering or the firm shall have on its rolls a permanently employed engineer having a diploma in mechanical or electrical engineering with the firm having at least three years ' experience in fabrication, repair and maintenance ofboilers;

(iii) Class III boiler repairer- The Firm shall have the experience of five years in repair , maintenance , operation , erection or inspection ofboiler,

(iv) (a) Where the power stations , fertilizer plants, chemical and petrochemical plants or refineries apply for repair of their own boilers , they shall have all the facilities in -house and may apply to the Chief Inspector of Boilers of the State for permission to repair their own boilers in accordance with these regulations .

(b)On receipt ofthe application for permission to repair to a boiler , the Chief Inspector of Boilers of the State shall reply to the request within a period of fifteen days of the receipt of the application .

(4) On receipt of the application under sub - regulation (3 ) , the Chief Inspector shall send a questionnaire in 'Form XVIII' to the applicant.

(5) The Chief Inspector will scrutinize and evaluate the application along with the replies to the questionnaire and after satisfying himself that the following requirements are fulfilled, shall recognise the firm as a repairer in the category applied for, namely :-

(1) that the firm possesses rectifier or generator, grinder , general tools and tackles , dye -penetrant kit, expander and measuring instruments ;

(ii) that the electric arc or oxy - acetylene welding sets and all other tools and plant in his possession for carrying out repairs are suitable for the work undertaken;

(iii) that the quality of material used conforms to the specifications prescribed in these regulations;

(iv) that the supervisory and operational staff employed by the firm possesses the necessary training and experience for the work undertaken;

(v) that all welders employed by the firm possess certificates issued as required under Chapter XIII of these regulations;

(vi) standard of work should be of high order and comply with all the requirements and test that may be prescribed by the Chief Inspector.

(6)The recognition ofthe firm as a repairer shall be for a period oftwo years . Thereafter they shall apply for renewal of their recognition at least two months before the expiry of said period.

(7) In case the repairer is found indulging in violating the provisions of the Act/Regulations knowingly or unknowingly , the firm shall be blacklisted under intimation to Chief Inspector or Director of Boilers of all the States /Union territories and renewal shall not be done in any case .

392A. Procedure for repairs .-( 1 ) The repair work shall be carried out under the supervision of Inspector, and when the fireboxes and smoke tubes of locomotive tube boilers are withdrawn, the internal parts , which are otherwise inaccessible to close inspection, shall be inspected by the Inspector.

(2) Repair to boiler shells shall be carried out by patching or by removing a strip of worn or damaged plate and inserting the new strip with covering straps over the longitudinal butt ends , the strength of the riveted joints to be not less than that of the longitudinal joints of the shell .

(3) (a) Patches for fire exposed plates shall be fitted metal to metal without joint of any description.

(b) The affected part shall be cut out, leaving the corners of the hole wellrounded.

(c) Patches shall be secured, wherever possible, properly spaced rivets with a width ofplate at least equal to the diameter of rivet between the edge of the rivet hole and the edge of the plate.

(d) Where riveting is impracticable, the plate shall be securedby welt fitting countersunk headed screw pins.

to shape. (5) Bulged or distorted furnaces or circular section may, if the bulge or distortion is not too great, be pressed back (6) Circular furnaces of horizontal boilers that have become distorted may be suitably reinforced .

(7) (a) Anti -collapse rings shall be of substantial section either of single or double angles bolted back to back with screw stays not less than 22mm in diameter and about 178 mm in pitch passed through flat of angle and screwed into the furnace , the ends being either rounded or riveted over on the fire side and fitted with nuts at the other .

(b) The staybolts shall be fitted with ferrules not less than 1 inch in depth between furnace and angle ring.

(8) Welding shall not be accepted for the repair of any part of a boiler for which welding is forbidden for a new boiler under these regulations and boiler shells shall not be repaired by welding beyond the filling up of a small isolated corroded or pitted part or the making up of wasted edges of openings .

(9) Cracks or grooving in dished or flat end plates of cylinderical shells or in the bends of furnace flanges in a circumferential direction may be weed out and welded.

(10) Wasted parts of circular furnaces and fire -boxes and fire exposed flat plates as in rectangular fire -boxes and combustion chambers may be cut out and be replaced by new pieces welded in or they may be built up by welding .

(11) Longitudinal cracks in circular furnaces and fire-boxes and cracks in rectangular fire -boxes and combustion chambers may be welded.

(12) No stay bar shall be welded.

(13) Smoke tubes may be butt welded either by fusion welding , flush welding or oxy -acetylene welding, and these may be tested hydraulically at the discretion of the Chief Inspector ." .

3. In the said Regulations , after Form XVII, the following form shall be inserted, namely :-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम निदेशक और उप- निदेशक होम्योपैथी फारमोकोपिया प्रयोगशाला, गाजियाबाद ( समूह क तकनीकी पद) भर्ती नियम , 2003 हैं ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग के परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.-इन नियमों की कोई बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 2 : अनुभव संबंधी अर्हता (अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल हो सकती है (हैं ) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने कीसंभावना नहीं है ।

वांछनीय: ( i ) संबंधित विषय में डाक्टरेट की उपाधि या औषधियों पर वैज्ञानिक लेख का प्रकाशन

(ii) अधिमानतः अनुसंधान या विश्लेषण प्रयोगशाला में प्रशासनिक अनुभव और इसके साथ प्रयोगशाला स्थापित करने/चलाने तथा विभिन्न शाखाओं के क्रियाकलापों में समन्वय रखने का अनुभव हो ।

( iii ) होम्योपैथी औषधियों पर कार्य करने का अनुभव।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति, जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा होम्योपैथी फारमोकोपिया प्रयोगशाला , गाजियाबाद में 10,000-15,200 रु. के वेतनमान में ऐसे उप निदेशक जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की हो ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नतिके लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवाके आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

प्रतिनियुक्तिकी अवधि, ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया चार वर्ष से अधिक नहीं होगी।

Note 1 : Qualifications are relaxable at the discretion ofthe Union Public Service Commission, in case of candidates otherwise wellqualified.

Note 2 : The qualification(s) regarding experience is/are relaxable at the discretion ofthe Union Public Service Commission in case of candidates belonging to scheduled castes or scheduled tribes . If at any stage of selection the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely tobe available to fill up the posts reserved for them.

Note 1 : The eligibility list for promotion shall be prepared with reference to the dateof completion by the officers of prescribed qualifying service in the respective grade/post.

Note 2 : Where Juniors who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/eligibility service by more thanhalf of such qualifying/eligibility service or two years , whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ eligibility service.

1. These Rules may be called the Employees ' State surance (Central ) ( 1st amendment) Rules, 2004.

2. Inthe Employees ' State Insurance (Central ) Rules , the present text of Rule 51 shall be substituted by the following:--

सा.का.नि. 212. केन्द्रीय सरकार, कर्मचारी राज्य बीमा अधिनियम, 1948 ( 1948 का 34 ) की धारा 95 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कर्मचारी राज्य बीमा निगम के साथ विचार -विमर्श करनेके पश्चात् कर्मचारी राज्य बीमा ( केन्द्रीय ) नियमावली, 1950 में संशोधन करने के लिए निम्नलिखित प्रारूप नियम उक्त धारा की उप- धारा ( 1 ) द्वारा अपेक्षित उन सभी व्यक्तियों की सूचना के लिए जिनकी उससे प्रभावित होने की संभावना है, प्रकाशित करने का प्रस्ताव करती है तथा एतद्वारा नोटिस दिया जाता है कि उक्त प्रारूप नियमों पर सरकारी राजपत्र में प्रकाशित होने की तारीख के पैंतालीस दिन के बाद विचार किया जाएगा ।

" 51. Rate of Contribution . नई दिल्ली, 17 जून, 2004 1. इन नियमों को कर्मचारी राज्य बीमा ( केन्द्रीय ) ( पहला संशोधन ) नियम, 2004 कहा जाए ।

2. कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम में, नियम 51 के वर्तमान पाठ के स्थान पर निम्नलिखित को प्रतिस्थापित किया जाएगा: -

सा.का.नि. 213.- केन्द्रीय सरकार मूल नियमों के नियम 45 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सरकारी निवास- स्थान आबंटन (दिल्ली में साधारण पूल ) नियम , 1963 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: - " 51. अंशदान की दरें. किसी मजदूरी अवधि के लिए अंशदान की राशिनिम्नलिखित के संबंध में होगी-

1. ( 1 ) इन नियमों का संक्षिप्त नाम सरकारी निवास- स्थान आबंटन ( दिल्ली में साधारण पूल ) दूसरा संशोधन नियम्, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । (क) नियोक्ता का अंशदान, किसी कर्मचारी को देय मजदूरी के 4-3/4 प्रतिशत के बराबर राशि (अगले रुपये तक पूर्णांकित कीगयी) ; और

(ख ) कर्मचारी का अंशदान, किसी कर्मचारी को देय मजदूरी के 1-3/4 प्रतिशत के बराबर राशि ( अगले रुपये तक पूर्णाकित कीगयी) । "

2. सरकारी निवास स्थान आबंटन ( दिल्ली में साधारण पूल ) नियम, 1963 में, निवास की बदली से संबंधित अनुपूरक नियम 317- ख-15 के उप- नियम ( 2 ) के स्थान पर निम्नलिखित उप- नियम रखा जाएगा, अर्थात्: -

The following draft Rules furtherto amend theEmployees' State Insurance (Central ) Rules, 1950 which the Central Government after consultation with the Employees ' State Insurance Corporation proposes to make in exercise of thepowers conferred by Section of the Employees ' Insurance Act, 1948 (34 of 1948 ), is hereby published as required by Sub- section (1) of the said Section for information of all persons likely to be affected thereby and notice is hereby given that the said draft Rules will be taken into consideration after 45 days from thedate ofpublication in the Official Gazette.

" ( 2) कोई अधिकारी जिसका आशय पहले से उसे आबंटित आवास में बदली का है वह संपदा निदेशालय को विहित प्ररूप मेंआवेदन करेगा, और तत्पश्चात् उस अधिकारी का नाम संबंधित प्रतीक्षा सूची में सम्मिलित किया जाएगा और ऐसे अधिकारी की टाईप 1 से टाईप 4 के आवास और होस्टल के लिए आवास की संबंधित प्रतीक्षा सूची में पारस्परिक स्थिति ऐसी प्रतीक्षा सूची में संपदा निदेशालय में ऐसे आवेदन की प्राप्ति की तारीख के आधार पर उसी क्रम में अवधारित की जाएगी और टाईप 4 (विशेष ) तथा उच्चतर टाइपों और होस्टल आवास के लिए आवास की बदली का आशय रखने वाले अधिकारियों की संबंधित प्रतीक्षा सूची में पारस्परिक स्थिति का अवधारण यथास्थिति टाईप-4 (विशेष ) और उच्चतर टाईपों तथा होस्टल आवास के आबंटन केसंबंध में संबंधित अधिकारी की उस पूर्विक्ता की तारीख के आधार पर किया जाएगा, जिसके लिए वह अनुपूरक नियम 317-ख -5 के उपबंधों के अधीन पात्र है । " .

"(2) An officer , who intends to change the accommodation already allotted to him shall make an application in the prescribed formto theDirectorate of Estates , and thereafter, the name of such officer shall be included in the waiting list concerned and inter se position of such officer in such waiting list for accommodationof Typel to Type IV shall be determined on the basis of the date of receipt of such application to the Directorate of Estates in such order and for accommodation ofType IV ( Special ) and higher types and hostel accommodation, the inter se position in the waiting list concerned of officers intending to change the accommodation shall bedetermined on the basis of priority date of the officer concerned in relation to allotment of type IV ( Special ) and higher types and hostel accommodation, as the case may be , to which he is eligible under the provisions ofSR 317 -B -5 . "
