का.नि.आ. 95.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक़ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय इंजीनियर रक्षा सेवा ( भर्ती और सेवा की शर्त ) नियम, 1991 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है; रक्षा मंत्रालय में भारतीय इंजीनियर रक्षा सेवा में नियुक्त व्यक्तियों की, सेवा की शर्तों का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्ः-
1. संक्षिप्त नाम और प्रारंम्भ:-( 1 ) इन नियमों का संक्षिप्त नाम भारतीय इंजीनियर रक्षा सेवा ( भर्ती और सेवा की शर्त) नियम, 2004 है । ( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं:- इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :
(क) " आयोग " से संघ लोक सेवा आयोग अभिप्रेत है;
(ख ) " नियंत्रण प्राधिकारी " से भारत सरकार, रक्षा मंत्रालय अभिप्रेत है;
(ग ) " विभागीय अभ्यर्थी " से ऐसा व्यक्ति अभिप्रेत है जिसे आयोग से परामर्श करने के पश्चात् या विभागीय प्रोन्नति समिति की सिफारिश पर नियमित आधार पर नियुक्त किया गया है;
(घ) " विभागीय प्रोन्नति समिति " से अनुसूची-4 में प्रत्येक पद के सामने उक्त पद पर प्रोन्नति या पुष्टि के संबंध में विचार करने के लिए विनिर्दिष्ट समिति अभिप्रेत है;

[PART II-SEC. 4] (ड) "ड्यूटी पद " से अनुसूची-1 के स्तम्भ-4 में विनिर्दिष्ट पद अभिप्रेत है;
(च) " परीक्षा " से सरकार द्वारा समय- समय पर यथा अधिसूचित विभिन्न इंजीनियरी सेवाओं और पदों पर भर्ती के लिए आयोग द्वारा संचालित कोई सम्मिलित प्रतियोगी परीक्षा अभिप्रेत है;
(छ) " सरकार " से भारत सरकार अभिप्रेत है;
( ज) " श्रेणी " से अनुसूची-1 के स्तम्भ 2 में विनिर्दिष्ट सेवा की श्रेणी अभिप्रेत है;
(झ) किसी श्रेणी से संबंधित " नियमित सेवा " से किसी श्रेणी में दीर्घ कालिक नियुक्ति के लिए सरकार द्वारा अधिकथित प्रक्रिया के अनुसार चयन के पश्चात् उस श्रेणी में की गई सेवा की अवधि अभिप्रेत है और जिसमें निम्नलिखित कोई अवधि या अवधियां सम्मिलित हैं :-
(1 ) सेवा के प्रारम्भिक गठन पर नियुक्त व्यक्तियों की दशा में ज्येष्ठता के प्रयोजनार्थ हिसाब में ली गई अवधि;
(II ) ऐसी अवधि जिसके दौरान कोई अधिकारी उस श्रेणी में ड्यूटी पद धारण किए हुए होता, यदि वह छुट्टी पर नहीं होता या अन्यथा ऐसा पद धारण करने के लिए उपलब्ध हुआ होता ।
" अनुसूची " से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत है ।
(ञ)
(ट ) अनुसूचित जातियों और अनुसूचित जनजातियों के वही अर्थ हैं जो संविधान के अनुच्छेद 366 के खण्ड ( 24 ) और खण्ड ( 25 ) मेंहैं ।
(ठ) " सेवा" से नियम 3 के अधीन गठित " भारतीय इंजीनियर रक्षा सेवा " अभिप्रेत है ।
3. भारतीय इंजीनियर रक्षा सेवा का गठन:- भारतीय इंजीनियर रक्षा सेवा के नाम से ज्ञात सेवा अनुसूची -1 में विनिर्दिष्ट पदों से मिलकर बनेगी ।
4. श्रेणी, प्राधिकृत संख्या और उनका पुनर्विलोकन:- ( 1 ) सेवा की विभिन्न श्रेणियों में सम्मिलित ड्यूटी पद, उनके नाम , संख्या और वेतनमान वह होंगे जो उन नियमों से उपाबद्ध अनुसूची-1 में विनिर्दिष्ट हैं ।
(2) सरकार, समय- समय पर जैसा आवश्यक समझे विभिन्न श्रेणियों में ड्यूटी पदों की संख्या में वृद्धि या कटौती कर सकेगी । (3) सरकार, आयोग के परामर्श से अनुसूची -1 में सम्मिलित पदों से भिन्न, सेवा के ऐसे पदों को, जो प्रास्थिति , श्रेणी , वेतनमान और वृत्तिक रूप से सेवा में सम्मिलित पदों के समतुल्य हों, सेना में सम्मिलित या सेवा से अपवर्जित कर सकेगी ।
(4) सरकार, आयोग के परामर्श से किसी ऐसे अधिकारी को, जिसका पद उप नियम ( 3 ) के अधीन सेवा की समुचित श्रेणी में सेवा में सम्मिलित किया गया है , अस्थायी हैसियत में या किसी अधिष्ठायी हैसियत में जैसा उचित समझे नियुक्त कर सकेगी और उस श्रेणी में उसकी ज्येष्ठता सरकार द्वारा इस बाबत समय - समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार नियत कर सकेगी ।
1 5. सेवा के सदस्य निम्नलिखित व्यक्ति सेवा के सदस्य होंगे , अर्थात्: -
(क) नियम 6 के अधीन सेवा में नियुक्त समझे गए व्यक्ति, और
(ख) नियम 7 के अधीन सेवा में नियुक्त व्यक्ति ।
6. आरंभिक गठन भारतीय इंजीनियर रक्षा सेवा नियम, 1991 के सभी सिविलियन अधिकारी जो समूह " क " पद नियमित आधार पर धारण किए हुए हैं , भारतीय इंजीनियर रक्षा सेवा नियम , 2004 में उनके आरंभिक गठन से श्रेणियों /पदों पर नियमित आधार पर तत्स्थानी पदों और श्रेणी में, यथास्थिति, अधिष्ठायी या स्थानापन्न हैसियत में नियुक्त किए गए समझे जाएंगे ।
7. सेवा का भावी अनुरक्षण: इन नियमों के आरम्भ के पश्चात् रिक्तियां इन नियमों से उपाबद्ध अनुसूची -2 , अनुसूची-3 और अनुसूची-4 में यथा उपबंधित रीति से भरी जाएंगी ।
8. ज्येष्ठता:-( 1 ) नियम 6 के अधीन किसी श्रेणी में नियुक्त समझे गए सेवा के सदस्यों की साक्षेप ज्येष्ठता इन नियमों के आरम्भ की तारीख उनकी साक्षेप ज्येष्ठता से शासित होगी :
परन्तु यदि उस तारीख को किसी सदस्य की ज्येष्ठता विशिष्टतः अवधारित नहीं की गई है तो उसे सरकार के अधीन समरूप सेवा के -सदस्यों को लागू नियमों के अनुसार सरकार द्वारा अवधारित किया जाएगा । 275 [ भाग II- खण्ड 4]

( 2 ) ऐसे अधिकारी जो इन नियमों के आरम्भ के पश्चात् किसी श्रेणी में सेवा में सम्मिलित होते हैं । नियम 6 के अधीन उस श्रेणी में नियुक्त समझे गए व्यक्तियों से पंक्ति में नीचे होंगे । सेवा में ऐसे व्यक्तियों की ज्येष्ठता जिनकी भर्ती आरम्भिक गठन के पश्चात्की जाती है, सरकार द्वारा इस बाबत समय- समय पर जारी किए गए साधारण अनुदेशों के अनुसार अवधारित की जाएगी । (3) ऊपर के उपबंधों के अंतर्गत नहीं आने वाले अधिकारियों की ज्येष्ठता, आयोग के परामर्श से सरकार द्वारा अवधारित की जाएगी । 9. परिवीक्षाः- ( 1 ) सेवा में नियुक्त प्रत्येक अधिकारी , चाहे वह परीक्षा के माध्यम से कनिष्ठ काल वेतनमान पर सीधी भर्ती द्वारा या सहायक इंजीनियर समूह " ख " पद से प्रोन्नति द्वारा नियुक्त हुआ हो, दो वर्ष की परिवीक्षा अवधि पर होगा।
परन्तु नियंत्रण प्राधिकारी इस बाबत सरकार द्वारा समय - समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार परिवीक्षा अवधि बढ़ा सकेगा।
परन्तु यह और कि परिवीक्षा अवधि बढ़ाने का कोई विनिश्चय परिवीक्षा की पूर्व अवधि की समाप्ति के पश्चात् साधारणतया आठ सप्ताह के भीतर किया जाएगा और सम्बद्ध अधिकारी को ऐसा करने के कारणों सहित उक्त अवधि के भीतर लिखित में विनिश्चय को संसूचित किया जाएगा ।
(2) परिवीक्षा अवधि के पूरा होने पर अधिकारियों को, यदि नियमित नियुक्ति के लिए उपयुक्त समझा जाता है तो उन्हें नियमित आधार पर अपनी नियुक्ति पर रखा जाएगा और उनकी सम्यक अनुक्रम में पुष्टि की जाएगी।
(3 ) यदि, उपनियम ( 1 ) में निर्दिष्ट, यथास्थिति, परिवीक्षा अवधि या उसकी बढ़ाई गई अवधि के दौरान सरकार की यह राय है कि कोई अधिकारी रखे जाने के लिए उपयुक्त नहीं है या यदि ऐसी परिवीक्षा की अवधि या उसकी बढ़ाई गई अवधि के दौरान किसी भी समय सरकार का यह समाधान हो जाता है कि अधिकारी ऐसी परिवीक्षा अवधि या बढ़ाई गई अवधि की समाप्ति के पश्चात् स्थायी नियुक्तिके लिए उपयुक्त नहीं होगा तो सरकार कारणों को लेखबद्ध करके उसे, यथास्थिति, सेवोन्मुक्त या उस पद पर जिसके वह परिवीक्षा से पूर्व वह धारण किए हुए था, उस पर प्रतिवर्तित या जैसा यह उचित समझे, आदेश जारी कर सकेगी ।
(4 ) परिवीक्षा अवधि के दौरान सरकार, उस अधिकारी से, परिवीक्षा अवधि को समाधानप्रद रूप में पूरा करने के प्रयोजन के लिए ऐसा प्रशिक्षण और अनुदेश पाठयक्रम पूरा करने और ऐसी परीक्षा और परीक्षणों को उत्तीर्ण करने की ( जिसमें हिन्दी परीक्षा सम्मिलित है) जैसा वह उपयुक्त समझें, अपेक्षा कर सकेगी ।
(5 ) परिवीक्षा की अवधि से संबंधित अन्य मामलों की बाबत सेवा के सदस्य इस बाबत सरकार द्वारा समय - समय पर जारी किए गए अनुदेशों या आदेशों द्वारा शासित होंगे।
10. सेवा का दायित्व ( 1 ) सेवा में नियुक्त अधिकारी भारत में या भारत से बाहर कहीं भी सेवा करने के दायित्वाधीन होगा । (2 ) सेवा में नियुक्त कोई भी व्यक्ति, यदि ऐसा अपेक्षित हो, भारत की रक्षा से संबंधित किसी पद पर चार वर्ष से अन्यून की अवधि के लिए जिसमें प्रशिक्षण में बितायी गयी अवधि, यदि कोई है, सम्मिलित है, सेवा करने का दायी होगा, परन्तु ऐसे व्यक्ति से, (क ) उसकी नियुक्ति की तारीख से दस वर्ष की अवधि की समाप्ति के पश्चात् उपरोक्त सेवा करने की अपेक्षा नहीं की जाएगी , या
(ख ) चालीस वर्ष की आयु होने के पश्चात् साधारणतया उपरोक्त सेवा करने की अपेक्षा नहीं की जाएगी ।
(3) सेवा का कोई सदस्य, जब उसे इसके लिए तैनात किया जाए, वृत्तिक पाठ्यक्रम करने का भी दायी होगा ।
(4 ) ऐसे मामलों की बाबत जिनके लिए इन नियमों में उपबंध नहीं किया गया है, सेवा के सदस्यों की सेवा शर्तें वहीं होंगी जो समय- समय पर केन्द्रीय सिविल सेवा के अधिकारियों को लागू होती हैं ।
11. निरर्हता:-वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी जीवित होते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्तिका पात्र नहीं होगा ।
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 276

[PART II- SEC. 4] 12. सेना अधिकारी पर लागू न होने वाले नियम:- ये नियम सेना इंजीनियरी सेवा ( सेवा कार्मिक ) विनियम, 1989 के अनुसार सेवावृत्ति के आधार पर नियुक्त सेना अधिकारियों को लागू नहीं होंगे , क्योंकि वे सेना अधिनियम , 1950 ( 1950 का 46 ) और तद्धीन बनाए गए नियमों द्वारा शासित होंगे ।
13. लागू होना:
- ( 1 ) ये नियम, इन नियमों से उपाबद्ध अनुसूची 1 के स्तंभ 2 में यथा विनिर्दिष्ट पदों को लागू होंगे ।
(2) अनुसूची 1 में विनिर्दिष्ट पदों को, भारतीय इंजीनियर रक्षा सेवा के सिविलियन अधिकारियों द्वारा भरा जाएगा और ये कभी भी जब तक कि सरकार लिखित में आदेश द्वारा ऐसे विनिश्चिय न करे, किसी अन्य व्यक्ति द्वारा धारित नहीं किए जा सकेंगे ।
14. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह इसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
15. व्यावृत्ति: ( 1 ) इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।
(2) इन नियमों के अधिसूचना से पूर्व समय- समय पर जारी किए गए स्थापन आदेशों के अधीन की गई सभी नियुक्तियां, प्रोन्नतियां या पुष्टि आयोग के परामर्श से इन नियमों के अधीन की गई समझी जाएंगी ।
16. निर्वचन: इन नियमों के निर्वचन से संबंधित यदि कोई प्रश्न उद्भूत होता है तो केन्द्रीय सरकार उसका विनिश्चय करेगी ।

( I ) कार्डर की संपूर्ण संख्या में कोई वृद्धि नहीं होगी ।
( 11 ) अकृत्यिक श्रेणी में [ रु. 12000-16500 ] में प्रचलित होने वाले पदों की संख्या 10000-15200 रु. के वेतन में उपलब्ध पदों की कुल संख्या से अधिक नहीं होगी ।

टिप्पण : ज्येष्ठतम् अपर महानिदेशक [ एच एजी स्तर ] महानिदेशक [ कार्मिक ] के रूप में पदाभिहित होगा जो एम ई एस सिविलियन अधिकारियों/अधीनस्थों से संबंधित कार्मिक मामलों की देखभाल करेगा । 277 [ भाग II- खण्ड 4]

संघ लोक सेवा आयोग द्वारा संचालित की जाने वाली परीक्षा के परिणाम पर भरे जाने वाले सहायक कार्यपालक इंजीनियर समूह " क" के पद पर सीधी भर्ती के लिए न्यूनतम शैक्षिक अर्हताएं और आयु सीमा-
अभ्यर्थी,
( i ) के पास भारत में केन्द्रीय या राज्य विधानमंडल के किसी अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संसद के किसी अधिनियम द्वारा स्थापित किसी अन्य शैक्षिक संस्था या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 ( 1956 का 3 ) की धारा 3 के अधीन सम विश्वविद्यालय के रूप में घोषित किसी विश्वविद्यालय से सिविल, यांत्रिकी या विद्युत इंजीनियरी में डिग्री या ऐसे विदेशी विश्वविद्यालयों, महाविद्यालयों या संस्थाओं में ऐसी शर्तों के अधीन जिन्हें समय - समय पर सरकार द्वारा मान्यता दी जाती है, इंजीनियरी में डिग्री या डिप्लोमा या ऐसी अर्हताएं जिन्हें सरकार द्वारा उपर्युक्त अर्हताओं के समतुल्य मान्यता दी गई हो, होनी चाहिए, और
(ii ) ने उस वर्ष, जिस वर्ष में परीक्षा ली जाती है, एक अगस्त को इक्कीस वर्ष की आयु प्राप्त कर ली है किन्तु तीस वर्ष की आयु प्राप्त नहीं कीहोनी चाहिए ।

[ख ] अनुसूची II में यथाविनिर्दिष्ट अर्हता रखता हो।

[क] ऐसा कार्यपालक इंजीनियर [ 10000- 15200 ] जिसने 9 वर्ष नियमित सेवा कार्यपालक इंजीनियर जिसमें नियमित सेवा सहित, यदि कोई हो, कार्यपालक इंजीनियर 12000-16500 के पदके लिए अकृत्यिक द्वितीय श्रेणी में की श्रेणियों मेंकीहो।
[ख ] अनुसूची II में यथाविनिर्दिष्ट अर्हता रखता हो। टिप्पण:- ऐसे अधिकारी जो 12000-16500 के विद्यमान कृत्यिक वेतनमान में अधीक्षण इंजीनियर के पद पर पहले से ही नियुक्त है, अधीक्षण इंजीनियर के रूप में बने रहेंगे और उपरोक्तके अनुसार 9 वर्ष की उनकी अर्हक सेवा की पूर्णता पर 14300-18300 की उन्नयित वेतनमान में रखे जाएगें ।
ऐसा कार्यकारी इंजीनियर जिसने उस श्रेणी में 5 वर्ष नियमित सेवा की है । प्लेसमेंट अधार पर नियुक्ति होगी और ज्येष्ठता मापदंड अनुपयुक्तता पर नामंजूरी के अध्यधीन होगी ।
ऐसा सहायक कार्यपालक इंजीनियर जिसने उस श्रेणी में 4 वर्ष नियमित सेवा की है साथ ही उसके पास किसी मान्यताप्राप्त विश्वविद्यालय/संस्थासे सिविल, यांत्रिक या विद्युत इंजीनियरी डिग्री या समतुल्यहै ।
[क ] ऐसा सहायक इंजीनियर जिसने उस श्रेणी में 8 वर्ष नियमित सेवा की है और जिसके पास किसी मान्यताप्राप्त विश्वविद्यालय/ संस्था से सिविल, यांत्रिक या विद्युत इंजीनियरी डिग्री या समतुल्यहै ।
[ख ] ऐसा सहायक इंजीनियर जिसने उस श्रेणी में 10 वर्ष नियमित सेवा की है और जिसके पास किसी मान्यताप्राप्त विश्वविद्यालय/ संस्था से सिविल , यांत्रिक याविद्युत इंजीनियरी डिप्लोमा या समतुल्यहै ।
पद संघ लोक सेवा आयोग द्वारा संचालित इंजीनियरी सेवा परीक्षा के माध्यम से सीधी भर्ती द्वारा भरे जाएंगे ।
-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसीअहीक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।.

S.R.O. 95. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of Indian Defence Service of Engineers (Recruitment and Conditions of Service) Rules , 1991 ; except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules, regulating the method of recruitment and the conditions of service of persons appointed to the INDIAN DEFENCE SERVICE OF ENGINEERS in Ministry ofDefence , namely:-
1. Short title and commencement.-( 1 ) These rules may be called the Indian Defence Service of Engineers (Recruitment and Conditions of Service) Rules , 2004.
(2) They shall come into force from the date ofpublication in the Official Gazette .
2. Definitions. In these rules , unless the context otherwise requires:
(a) Commission" means the Union Public Service Commission;
(b) Controlling Authority " means the Government of India in the Ministry ofDefence ;
(c) "Departmental Candidate " ineans a person who has been appointed on regular basis after consultation with the Commission or on the recommendations ofDepartmental Promotion Committee;
(d) "Departmental Promotion Committee" means a Committee specified against each post in Schedule IVto considerpromotion or confirmation in the said post;
(e) ' Duty Post" means any post specified in Column 2 of Schedule I ;
(1) Examination" means a Combined Competitive Examination conducted by the Commission for recruit- ment to various Engineering Services or posts às may be notified by the Government from time to time;
Government" means the Government of India; (g)
(h) " Grade" means a grade of service specified in Column 2.of Schedule I annexed to these rules ;
(1) " regular service" in relation to any grade means the period of service in the grade rendered after selection accordingtoprocedure laid down by the Government for long -term appointment to that grade and includes anyperiod or periods:-
(i) taken into account for purpose of seniority in the case of those appointed at the initial constitution of theservice;
(i) during which an officer would have held a duty post in the grade but for being on leave or otherwise not being available for holding such post; 17
(1 ) " Schedule" means a Schedule annexed to these rules;
(k) " Scheduled Castes" and " Scheduled Tribes " shall have the meanings respectively assigned to them under clause (24) and clause(25) of article 366 of the Constitution;

(1) " Service" means the INDIAN DEFENCE SERVICE OF ENGINEERS constituted under rule3 .
3. Constitution of Indian Defence Service of Engineers . The service known as the Indian Defence Service of Engineers shall consist of posts specified in Schedule 1.
4. Grades, Authorised Strength and its's Review . (1 ) The duty posts included in various grades of the service, their names , numbers and scales ofpay shall be as specified in Schedule I , annexed to these rules .
(2) The Government may make temporary additions to or reductions from the strength of the duty posts in various grades as it may deem necessary from time to time.
(3) The Government in consultation with the commission, include in or exclude from the service such posts as may be deemed to be equivalent to the posts included in the service , in status , grade , scale ofpay and professional content , other than those included in Schedule 1.
(4) The Government may, in consultation with the Commission appoint an officer whose post is included in the service under sub - rule (3 ) to the appropriate grade of the service in a temporary capacity or in a substantive capacity, as it may deem fit and fix his seniority in the grade in accordance with the general orders and instructions issued by the Government from time to time in this regard.
5. Members of the service. The following persons shall be members of the service , namely:-
(a) Persons deemed to have been appointed to service under rule 6 ; and
(b) Persons appointed to the service under rule7 .
6. Initial constitution. All the civilian officers in the Indian Defence Service of Engineers Rules , 1991 holding Group ' A' posts on regular, shall be deemed to have been appointed to the corresponding posts and grades in the service in the substantive or officiating capacity, as the case may be , from the date of their initial appointment to the grades /posts onregular basis, in the Indian Defence Service of Engineer Rules, 2004.
7. Future maintenance of the service. After commencement of these rules, the vacancies , shall be filled in the manner as provided in Schedule II, III and IV, annexed to these rules .
8. Seniority.( 1 ) The relative seniority, of members of the service deemed to have been appointed to any grade under rule 6, shall be governed by their relative seniority obtaining on the date of commencement of these rules :
Provided that if the seniority of a member has not been specifically determined on the said date, the same shall be determinedby the Government in accordance with the rules applicable to members of similar service under the Government. (2) Officers who join the service in any grade after the commencement of these rules, shall rank below those deemed to have been appointed to the service in that grade under rule 6. The seniority ofpersons recruited to the service after the initial constitution shall be determined in accordance with the general instructions issued by the Government from time to time inthis regard.
(3) Seniority of officers not covered by the above provisions , shall be determined by the Government in consultation with the commission .
9. Probation . ( 1 ) Every officer on appointment to the service either by direct recruitment to the Junior Time Scale through the examination or by promotion from Group ' B ' posts of Assistant Engineer shall be on a probation for a period of two years:
Provided that the Controlling Authority may extend the period of probation in accordance with the instructions ororders issuedby the Government from time to time in this regard:
Provided further that any decision for extension of the period of probation shall be taken ordinarily within eight weeks after the expiry of the previous period of probation and the decision in writing shall be communicated to the concerned officer together with the reasons for so doing within the said period.
(2)On completion of the period of probation, officers shall, if considered fit for regular appointment, retained in their appointment on regular basis and be confirmed in due course.
(3) If, during the period ofprobation referred to in sub - rule ( 1 ) or any extension thereof, as the case may be , the Government is of the opinion that an officer is not fit for retention or if, at any time during such period of probation , or extension thereof, the Government is satisfied that the officer will not be fit for permanent appointment on the expiration of such period of probation, or extension thereof, the Government may for reasons to be recorded in writing , discharge him from the service or revert him to the post which he has been holding before his promotion, as the case may be , or pass such orders as it may deem fit .
(4) During the period of probation, the officer may be required by the Governmentto undergo such courses of training and instructions and to pass such examination and tests (including an Examination in Hindi ) as it may deem fit for the purpose of satisfactory completion of period ofprobation .

(5) As regards other matters relating the period of probation, the members of the service shall be governed by the instructions or orders issued by the Government from time to time in this regard .
10. Liability for service. ( 1 ) The officers appointed to the service shall be liable to serve anywhere in India or outside .
(2) Any person appointed to the service, if so required, be liable to serve in connection with the Defence of India, for a period of not less than four years , including the period spent on training , if any , provided that such person- (a) shall not be required to serve as aforesaid after the expiry of ten years from the date of his appointment; or
(b) shall not ordinarily be required to serve as aforesaid after attaining the age of forty years .
(3) A member of the service shall also be liable to undergo professional courses as and when he is deputed for that .
(4) The conditions ofthe service of the members of the service in respect of matters for which no provision is made in these rules , shall be the same as are applicable to the officers of the Central Civil Services from time to time .
11. Disqualification. No person, --
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the posts specified in Schedule I:
Provided that the Government , may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from theoperation of this rule.
12. Rules not apply to Army Officers . These rules shall not apply to the Army Officers appointed on tenure basis in accordance with provisions of the Military Engineer Services (Army Personnel ) Regulations , 1989 , as they shall be governed by the Army Act , 1950 (46 of 1950 ) and the rules framed thereunder .
13. Application.-( 1 ) These rules shall apply to the posts as specified in column 2 of the Schedule I annexed to these rules .
(2) The posts specified in Schedule I are to be manned by Civilian Officers of Indian Defence Service ofEngineers and at no time can be held by another person unless Government so decides by specific orders in writing .
14. Power to relax.-Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing , and in consultation with the Commission , relax any of the provisions of these rules with respect to any class or category ofpersons .
15. Saving.-( 1 ) Nothing in these rules shall affect reservations, relaxation of age limits and other concessions required to be provided for the persons belonging to the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , Ex -servicemen and other special categories of persons in accordance with orders issued by the Government from time to time in this regard .
(2) Al appointments , promotions or confirmations , made in consultation with the Commission , under Establish- ment orders issued from time to time before notification of these rules shall be deemed to have been made under these rules .
16. Interpretation. If any question arises relating to the interpretation of these rules, it shall be decided by the Central Government.

Minimum educational qualification and age limits for direct recruits to the post of Assistant Executive Engineer Group ' A' to be filled on the results ofthe Examination to be conducted by the Union Public Service Commission .
A candidate must have :
(i) a degree in Civil, Mechanical or Electrical Engineering from a University incorporated by an Act of the Central or State Legislature in India or other educational Institutions established by an Act of Parliament or declared to be deemed as a University under Section 3 of University Grants Commission Act, 1956 ( 3 of 1956) or a degree or diploma in Engineering from such foreign Universities , Colleges or Institutions and under such conditions as may be recognised by the Government from time to time or possessing qualifications which have been recognised by the Government as equivalent to above qualifications ; and
(ii) attained the age of twenty one years but must not have attained the age of thirty years on the first day ofAugust of the year in which the examination is held.

Where juniors who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/ cligibility service by more than half of such qualifying/eligibility service or two years , whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have alrcady completed such qualifying/ eligibility service .

का.नि. आ. 101.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारतीय वायु सेना (आशुलिपिक श्रेणी-1 ) भर्ती नियम, 1989 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया है या किए जाने का लोप किया गया है, रक्षा मंत्रालय, भारतीय वायु सेना में आशुलिपिक श्रेणी-1 के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय वायु सेना ( आशुलिपिक श्रेणी -1 ) भर्ती नियम , 2004 है । (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं । 4. निरर्हता.- वह व्यक्ति, -
( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्तपद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि केअधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जोकारण हैं, उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों कीबाबत, आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्याक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति: केन्द्रीय सरकार के ऐसे अधिकारी: -
क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या
(
(ii) जिन्होंने 5000-150-8000 रु. या समतुल्य श्रेणी में तीन वर्ष नियमित
सेवाकी है;
(iii ) जिन्होंने 4500-7000 रु. की श्रेणी में छः वर्ष नियमित सेवा की है;
और
(ख) जिसके पास अंग्रेजी/हिन्दी आशुलिपि में 100 शब्द प्रति मिनट की
गतिहै ।
सशस्त्र बल कार्मिकोंके लिए-प्रतिनियुक्ति/पुनर्नियोजन:-जूनियर कमीशंड आफिसर रैंक के सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जोएक वर्ष कीअवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्तिके निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । ( सिविल पदों के प्रतिनिर्देश से अधिवर्षिता की आयु तक पुनर्नियोजन)
टिप्पणी: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसीअन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

S.R.O. 101.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession ofthe Indian Air Force (Stenographer Grade I) Recruitment Rules, 1989, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of (Stenographer Grade I) in the Indian Air Force, Ministry of Defence , namely :-
1. Short title and commencement.-( 1) These rules may be called the Indian Air Force (Stenographer Grade I) Recruitment Rules, 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette.
2.Number of posts , classification and scale of pay.-The number of said posts, their classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .
3.Method of recruitment , age limit and other qualifications etc. The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .
4. Disqualification. No person,-
(a)who has entered into or contracted a marriage with a person having a spouse living; or
(b) whohaving a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , and for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation , relaxation of the age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Such persons shall be given Deputation terms up to the date on which they are due for release from the Armed Forces ; thereafter they may be continued on re- employment. (Re -employment up the age of Superannua- tion with reference to Civil Posts).
Note: Period of deputation including period of deputation in another ex-cadre postheld immediately preceding this appointment in the same or some other organization/Department of the Central Government shall ordinarily not to exceed three years . The maximum age limit for appointment by Deputation shall be not exceeding 56 years as on the closing date of the receipt of applications.

का.नि.आ. 102.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रक्षा मंत्रालय , भारतीय नौसेना में प्रधान डिज़ाइन अधिकारी श्रेणी ( संनिर्माण ) पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय नौसेना प्रधान डिजाइन अधिकारी श्रेणी-1 ( समूह ' क ' पद ) भर्तीनियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि.-उक्त पदों पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरहीता. वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी
6. व्यावृत्ति- इन नियमों की कोई ब्रात . ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

-टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भीकम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है । अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

S.R.O. 102. In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to the post of Principal Design Officer Grade- I (Construction) in the Indian Navy, Ministry of Defence , namely:-
1. Short title and commencement.-( 1 ) These rules may be called the Indian Navy, Principal Design Officer Grade-I (Group ' A' post) Recruitment Rules, 2004 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, it's classification and scale of pay. The number of the said post, it's classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to, these rules .
3. Method of recruitment, age limit, qualifications etc. The method of recruitment to the said post, age limit, qualifications and other matters connected therewith shall be as specified in columns (5) to ( 14) of the said Schedule.
4. Disqualification.----No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category ofpersons .
6. Savings. Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
