भारत सरकार के राजपत्र में 20 अप्रैल 1946 को प्रकाशित तथा 29 अप्रैल 1954 की अधिसूचना सं. एफ. ( 8 ) 70/बी 52 और भारत सरकार के दिनांक 21 फरवरी , 1990 के असाधारण राजपत्र सं . 67 के अंतर्गत यथा संशोधित लोक ऋण अधिनियम 1944 की धारा 28 के अंतर्गत भारत सरकार द्वारा बनाए गए लोक ऋण नियमावली 1946 के नियम 18 के अनुसरण अप्रैल 2004 को समाप्त माह के लिए निम्नलिखित सूची खो गई आदि ऐसी प्रतिभूतियों के बारे में एतद्वारा विज्ञापित की जाती है, जिसके संबंध में इस बात का विश्वास करने के लिए प्रथम दृष्ट्या आधार मौजूद है कि प्रतिभूतियां खो गयी हैं और आवेदकों का दावा न्यायोचित है । नीचे लिखे गये संबंधित दावेदारों से इतर सभी व्यक्ति जिनका प्रतिभूतियों पर किसी प्रकार का दावा हो, तत्काल महाप्रबंधक , भारतीय रिज़र्व बैंक केन्द्रीय कार्यालय, सरकारी और बैंक लेखा विभाग, केन्द्रीय ऋण प्रभाग , मुंबई -400 008 को संसूचित करें ।

सूची दो भागों में विभाजित की गई है । भाग ' क ' में अभी पहली बार विज्ञापित प्रतिभूतियां शामिल की गई हैं और भाग ' ख ' में पूर्व विज्ञापित प्रतिभूतियों की सूची दी गई है ।

अधिसूचना सं. डीएनबीएस. 178 / सीजीएम ( डीएसएन ) - 2004 दिनांक : 22 जून 2004 भारतीय रिज़र्व बैंक, जनहित में इसे आवश्यक मान कर और इस बात से संतुष्ट होकर कि देश के हित के लिए ऋण प्रणाली को विनियमित करने हेतु रिजर्व बैंक को समर्थ बनाने के लिए अवशिष्ट गैर बैंकिंग कंपनी ( रिज़र्व बैंक ) निदेशावली , 1987 में संशोधन करना आवश्यक है, भारतीय रिज़र्व बैंक अधिनियम , 1934 ( 1934 का 2 ) की धारा 45 ञ,45 ञक , 45 ट और 45 ठ द्वारा प्रदत्त अधिकारों का तथा इस संबंध में सभी समर्थकारी अधिकारों का प्रयोग करते हुए एतद्वारा यह निदेश देता है कि दिनांक 15 मई 1987 की अधिसूचना सं . डीएफसी. 55 / डीजी ( ओ ) -87 में निहित उक्त निदेशावली तत्काल प्रभाव से निम्नलिखित रूप में संशोधित हो जायेगी , अर्थात् -

6. 1 जुलाई 2004 को और उस दिनांक से -

( 1 ) प्रत्येक अवशिष्ट गैर बैंकिंग कंपनी, भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 1934 ) की धारा 45 झ ख के अंतर्गत आस्तियों में निवेश की गई राशि सहित , उन प्रतिभूतियों में यह अन्य प्रकार के लिखतों में , जो भार रहित हों और जिनका मूल्यन चालू बाजार मूल्य से अधिक नहीं किया जाए, एक धनराशि , जो 30 सितंबर 2004 को समाप्त तिमाही के किसी दिन और उसके बाद प्रत्येक तिमाही के किसी दिन, दूसरी पूर्वगामी तिमाही के अंतिम कार्य दिवस को कारोबार की समाप्ति पर जमाकर्ताओं के प्रति बकाया देयताओं की कुल राशि ( चाहे ऐसी राशियां देय हो गई हों अथवा नहीं ) से कम नहीं होगी , निम्नलिखित प्रकार निवेश करेगी और करना जारी रखेगी , अर्थात्, -

( क ) जमाकर्ताओं के प्रति देयताओं की कुल राशि का न्यूनतम 10 प्रतिशत अनुसूचित वाणिज्य बैंकों की मियादी जमाराशियों / जमाह प्रमाणपत्रों में ; अथवा विनिर्दिष्ट वित्तीय संस्थाओं के जमा प्रमाणपत्रों में बशर्ते उक्त जमा प्रमाणपत्रों का किसी अनुमोदित साख निर्धारण एजेंसी द्वारा ए ए + रूप में या उसके समकक्ष साख निर्धारण किया गया हो या आंशिक रूप से इन मियादी जमाराशियों / इस प्रकार साख निर्धारित जमा प्रमाण पत्रों में से किसी में ;

( ख ) जमाकर्ताओं के प्रति देयताओं की उक्त कुल राशि का न्यूनतम 70 प्रतिशत अपने बाजार उधारी कार्यक्रम के दौरान किसी राज्य सरकार या केंद्र सरकार द्वारा जारी की गई प्रतिभूतियों में ; या कंपनी अधिनियम, 1956 ( 1956 का 1 ) के 3034

अंतर्गत निगमित किसी अन्य कंपनी के बांडों या डिबेंचरों ( किसी अनुमोदित साख निर्धारण एजेंसी द्वारा न्यूनतम ए ए + रूप में या उसके समकक्ष साख निर्धारित और किसी मान्यता प्राप्त स्टॉक एक्सचेंज में सूचीबद्ध ) में या खंड ( क ) में उल्लिखित रूप में या म्युचुअल फंडों की ऋण उन्मुख योजनाओं में ; परंतु यह निवेश इन शर्तों के अंतर्गत किया जाएगा कि

(i) जमाकर्ताओं के प्रति देयताओं की कुल राशि का न्यूनतम 15 प्रतिशत बाजार उधारी कार्यक्रम के दौरान जारी की गई किसी राज्य सरकार या केंद्र सरकार की प्रतिभूतियों में निवेश किया जाएगा;

(ii) जमाकर्ताओं के प्रति देयताओं की कुल राशि का अधिकतम 2 प्रतिशत किसी एक ऋण उन्मुख म्युचुअल फंड में निवेश किया जाएगा, जो भारतीय प्रतिभूति और एक्सचेंज बोर्ड ( म्युचुअल फंड ) नियमावली, 1996 द्वारा नियंत्रित हो तथा ऐसा कुल निवेश जमाकर्ताओं के प्रति देयताओं की कुल राशि के 10 प्रतिशत से अधिक नहीं होगा :

बशर्ते कि कोई अवशिष्ट गैर बैंकिंग कंपनी जो उपर्युक्त अपेक्षा को पूरा नहीं करती हो , वह जब तक इस श्रेणी के निवेशों में कमी को पूरा करे तब तक अन्य प्रतिभूतियों में निवेश नहीं करेगी ।

बशर्ते कि किसी बांड या डिबेंचर का साख निर्धारण निर्धारित से निम्न श्रेणी में आ जाने की स्थिति में उक्त बांड या डिबेंचर उपर्युक्त अपेक्षा का अनुपालन करने के लिए अपात्र हो जाएगा और साख के इस प्रकार निम्न श्रेणी में आ जा जाने के कारण उपर्युक्त पैराग्राफ के अनुपालन में यदि कोई कमी हो तो खंड ( ग ) या ( घ ) में उपबंधित प्रतिभूतियों में आगे कोई निवेश करने से पूर्व उसे पूरा किया जाएगा । "

परंतु शर्त यह है कि नियंत्रक कंपनी / सहायक कंपनी / एक ही समूह की कंपनी द्वारा जारी किए गए डिबेंचर / बांड ऐसे निवेश के लिए अर्ह नहीं होंगे ।

( ग ) 31 मार्च 2005 से पहले की अवधि के लिए , जमाकर्ताओं के प्रति देयताओं की कुल राशि का अधितम 20 प्रतिशत या उक्त कंपनी की निवल स्वाधिकृत निधि का 10 गुना, जो भी कम हो , किसी प्रकार से निवेश किया जा सकता है, जो कंपनी के निदेशक मंडल के अनुमोदन के अनुसार कंपनी की राय में सुरक्षित हो;

( घ ) 1 अप्रैल 2005 को और उस दिनांक से जमाकर्ताओं के प्रति देयताओं की कुल राशि का अधिकतम 10 प्रतिशत या उक्त कंपनी की निवल स्वाधिकृत निधि का 1 गुना, जो भी कम हो, किसी प्रकार से निवेश किया जा सकता है, जो कंपनी के निदेशक मंडल के अनुमोदन के अनुसार कंपनी की राय में सुरक्षित हो;

( ङ ) 1 अप्रैल 2006 को और उस दिनांक से जमाकर्ताओं के प्रति देयताओं की कुल राशि केवल उप पैराग्राफ ( क ) या उप पैराग्राफ ( ख ) के अनुसार निवेश की जाएगी । "

2. पैराग्राफ 6 में स्पष्टीकरण के स्थान पर निम्नलिखित स्पष्टीकरण जोड़ा जाएगा , अर्थात्: "स्पष्टीकरण

(i) ' निवल स्वाधिकृत निधि ' का अर्थ भारतीय रिजर्व बैंक अधिनियम, 1934 ( 1934 का 2 ) की धारा 45 - झ क के अंतर्गत यथा परिभाषित निवल स्वाधिकृत निधि से है, जिसमें वे चुकता अधिमान शेयर शामिल हैं, जो अनिवार्यतः ईक्विटी में परिवर्तनीय हैं ।

(ii) " देयताओं की कुल राशि " का अर्थ , संविदा की शर्तों के अनुसार जमा राशि पर उपचित हुई ब्याज, प्रीमियम , बोनस या किसी भी नाम के अन्य लाभ सहित स्वीकार की गई जमाराशियों की कुल राशि से होगा ।

(iii) " तिमाही " का अर्थ मार्च , जून , सितंबर या दिसंबर के अंतिम दिवस को समाप्त तीन महीनों की अवधि से होगा ।

( iv) "अनुमोदित साख निर्धारण एजेंसियों " से आशय

( क) क्रेडिट रेटिंग इन्फोरमेशन सर्विसेस ऑफ इंडिया लि. ( क्रिसिल )

( ख ) इन्वेस्टमेंट इन्फोरमेशन एंड क्रेडिट रेटिंग एजेंसी ऑफ इंडिया लि. ( इकरा ) ( ग ) क्रेडिट एनालिसिस एंड रिसर्च लि. ( केयर )

( घ ) एफ आई टी सी एच रेटिंग इंडिया प्राइवेट लिमिटेड ( फिच इंडिया ) से है । (v) ' अनुसूचित वाणिज्य बैंक ' से अर्थ किसी क्षेत्रीय ग्रामीण बैंक या किसी सहकारी बैंक को छोड़कर , भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 1934 का 2 ) की दूसरी अनुसूची में शामिल किसी बैंक से है ।

(vi) ' सरकारी कंपनी ' से अर्थ कंपनी अधिनियम, 1956 ( 1956 का 1 ) की धारा 617 के अंतर्गत यथा परिभाषित किसी कंपनी से है ।

(vii) ' विनिर्दिष्ट वित्तीय संस्था' से अर्थ इस अधिसूचना की अनुसूची " घ " में सूची- बद्ध संस्थाओं से है ।

(viii) ' नियंत्रक कंपनी' , ' सहायक कंपनी ' , ' एक ही समूह की कंपनी ' शब्दों का वही अर्थ होगा, जो उन्हें कंपनी अधिनियम , 1956 के अंतर्गत दिया गया है । "

& सं एक्ज़िम/सेवा/2004 भारतीय निर्यात-आयात बैंक अधिनियम , 1981 ( 1981 का संख्यांक 28) की धारा 27 की उप- धारा ( 3) के साथ पठित धारा 39 , की उप-धारा (2 ) के खण्ड ( घ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय निर्यात-आयात बैंक , का निदेशक मंडल , निर्यात-आयात बैंक अधिकारी सेवा विनियमावली 1982 में संशोधन करने के लिए केन्द्रीय सरकार की पूर्व मंजूरी से , एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात:

1. (1 ) ये विनियम "निर्यात -आयात बैंक अधिकारी सेवा ( संशोधन) विनियमावली , 2004 " कहलाएंगे ;

(2) यह विनियमावली इसमें अन्यथा स्पष्टतः उपबंधित स्थिति को छोड़कर , शासकीय राजपत्र में इसके प्रकाशन की तारीख को लागू होगी ।

2. निर्यात- आयात बैंक अधिकारी सेवा विनियमावली , 1982 ( जिसका यहाँ इसके बाद मूल विनियमावली के रूप में उल्लेख किया गया है ) , के विनियम 4 के उप-विनियम ( 1 ) , के लिए निम्नलिखित उप -विनियम प्रतिस्थापित किया जाएगा और यह समझा जाएगा कि यह अप्रैल 1998 की पहली तारीख से प्रभावी प्रतिस्थापित कर दिया गया है , अर्थात: -

( 19 (6 ) 3. मूल विनियमावली के विनियम 11 के उप विनियम ( 1 ) केके लिए निम्नलिखित विनियमविनियम प्रतिस्थापित किया जाएगा और इसेइसे नवम्बर 2002 की 9 वीं तारीख से प्रतिस्थापित मानों जाएंगा, अर्थात

"(1 ) (क) विनियम 8 के उप -विनियम 3 के अधीन, जहाँ बैंक संतुष्ट है कि किसी अधिकारी का कार्य निष्पादन असंतोषजनक या अपर्याप्त है या उसकी सत्यनिष्ठा के बारे में वास्तविक संदेह है या बैंक की सेवा में उसका बने रहना , बैंक के हितों के प्रतिकूल होगा और जहाँ अनुशासनिक, प्रक्रिया के अनुसार उसके विरुद्ध कार्रवाई करना संभव या इष्टकार नहीं है , बैंक सरकार दवारा समय- समय पर जारी दिशानिर्देशों के अनुसार उसे तीन महीने का नोटिस देकर या उसके बदले परिलब्धियाँ देकर उसकी सेवाएँ समाप्त कर सकता है ।

(ख ) इस विनियम के अंतर्गत सेवा-समापन्न का आदेश तब तक जारी नहीं किया जाएगा जब तक अधिकारी को प्रस्तावित आदेश के विरुद्ध अभ्यावेदन करने का उपयुक्य अवसर नाहीं दिया जाता है।

(ग) ऊपर उप-विनियम ( क) के अधीन किसी अधिकारी या कर्मचारी की सेवाएं समाप्त करने का निर्णय सिर्फ अध्यक्ष एवं प्रबंध निदेशक द्वारा लिया जाएगा ।

(घ) अधिकारी कर्मचारी बैंक के निदेशक मंडमंडल को 15 दिन के भीतर अपील कर उपर्युक्त उप-विनियम (क) के अंतर्गत पारित किसी आदेश के विरुद्ध अपील करने के लिए हकदार होगा । यदि अपील की अनुमति दी जाती है , तो ऐसी स्थिति में उप- विनियम (क) के अंतर्गत आदेश रद्द हो जाएगा ।

(ङ) जहाँ कोई अधिकारी कर्मचारी , जिसकी सेवाएं समाप्त की गई हैं और जिसे नोटिस के बदले तीन महीने की परिलब्धियों की राशि अदा की गई है और अपील पर उसकी सेवा समाप्ति रद्द कर दी गई है , नोटिस के बदले उसे अदा की गई राशि उसके द्वारा अर्जित किये जाने वाले वेतन के सम्मुख समायोजित की जाएगी , मानों कि उसकी सेवाएं समाप्त नहीं की गई हैं और वह बैंक के रोजगार में उन्हीं निबंधनों एवं शर्तों पर जारी रहेगा मानों कि समापन आदेश बिल्कुल ही पारित नहीं किया गया है ।

(च) अधिकारी कर्मचारी 'जिसकी सेवाएं अगरअगर उक्तउक्त उप-विनियम ( क) के अंतर्गत समाप्त की गई हैं, तो " उसे प्रदान की गई सेवा के वर्षों पर ध्यान दिये बिना नियमानुसार उपदान (मैच्युटी) , नियोक्ता अंशदान सहित भविष्य निधि और उसे स्वीकार्य अन्य समाप्त देयराशियाँ अदा की जाएंगी ।

(छ) उपर्युक्त निहित कोई भी बात विनियम 10 ( 1 ) के अंधींन किसी अधिकारी कर्मचारी को सेवा निवृत्त करने के बैंक के अधिकार को प्रभाक्ति नहीं करेगी

4. मूल विनियमावली के विनियम 11 के उप-विनियम (2 ) , के बाद निम्नलिखित उप विनियम प्रतिस्थापित किया जाएगा और उसे नवम्बर 2002 की 9 वीं तारीख से सम्मिलित किया गया माना जाएगा, अफि

" (3 ) ( 1) अधिकारी जिसके विरुद्ध अनुशासनिक कार्रवाई लम्बित है , सक्षम प्राधिकानने के लिखित रूप में पूर्व अनुमोदन के बिना बैंक से अपनी सेवा नहीं छोड़ेगा या बन्द नहीं करेगा या त्यागपत्र नहीं देगा और अनुशासनिक कार्यवाही से पूर्व या के दौरान ऐसे अधिकारी द्वारः दिया गया कोई नोटिस या त्यागपत्र तब तक प्रभावी नहीं होगा जब तक कि सक्षम

प्राधिकारी ‌द्वारा उसे स्वीकार नहीं किया जाता है ।

क ) यदि किसी कर्मचारी को निलंबित्त किया गया है या उसे यह कारण बताने के लिए कोई नानी के नोटिस जारी किया गया है कि उसके विरुद्ध अनुशासनिक कार्रवाई हो न शुरु की जाए

तो इसः विनियम के प्रयोजनार्थ कर्मचारी के विरुद्ध अनुशासनिक कार्न गई लंबित मानी जाएगी और तब तक लंबित मानी जाएगी जब तक सक्षम प्राधिकारी र अंतिम आदेश पारित नहीं किये जाते हैं ।

(iii) जिस अधिकारी के विरुद्ध अनुशासनिक कार्रवाई शुरू की गई है , वह अधिवर्षिता की तारीख को सेवा में नहीं रह पाएगा और अनुशासनिक कार्रवाई जारी रहेगी भानों कि वह तब तक सेवा में था जब तक कार्यवाही पूरी नहीं हो जाती है और उसके सबंध में अंतिम आदेश पारित नहीं कर दिया जाता है । संबंधित अधिकारी को अधिवार्षिता की तारीख के बाद कोई वेतन या भत्ता नहीं मिलेगा । वह अंशदायी भविष्य निधि में अपने स्वयं के अंशदान को छोड़कर किसी अन्य सेवानिवृत्ति लाभ के भुगतान के लिए तब तक हकदार नहीं होगा जब तक कार्रवाई पूरी नहीं हो जाती है और उस पर अंतिम आदेश जारी नहीं जो जाता है । 3040

[भाग III- खण्ड 4 5. मूल विनियमावली के विनियम 12 के लिए , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा और उसे अप्रैल 1998 की पहली तारीख से प्रतिस्थापित माना जाएगाः अर्थात

" 12 किसी अधिकारी को मँहगाई भत्ता निम्नलिखित रूप में देय होगा ।

ⅰ ) महंगाई भत्ता, अखिल भारतीय कामगार उपभोक्ता मूल्य सूचकांक ( सामान्य) (आधार 1960=100) से संबंधित होगा ।

ii ) महंगाई भत्ता तभी देय होगा जब औसत सूचकांक उपभोक्ता मूल्य सूचकांक 1684 से ऊपर है ।

1684 अंक के ऊपर ( अखिल भारतीय औसत उपभोक्ता मूल्य सूचकांक ( सामान्य) 1960=100) चार अंक की वृद्धि या कमी के प्रत्येक चक्र के लिए तिमाही औसत , तिमाही समायोजन:-

पहला स्लैब

0.24% जमा

7100/- रुपये तक मूल वेतन पर

0.20% जमा

दूसरा स्लैब 7100/- रुपये से अधिक और 11,300/- रुपये तक मूल वेतन के हिस्से पर

तीसरा स्लैब

11300/- रुपये से अधिक और 12025/- रुपये

0.12% जमा

चौथा स्लैब

0.06%"

12025/- रुपये से अधिक मूल वेतन के हिस्से पर

6. मूल विनियमावली के विनियम 13 के उप -विनियम ( 1 ) तथा (2 ) के लिए निम्नलिखत उप -विनियम

प्रतिस्थापित किये जाएंगे और उन्हें नवम्बर 1999 की पहली तारीख से प्रतिस्थापित माना जाएगाः अर्थातः- " 13 ( 1 ) जहाँ किसी अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान की गई है , अधिकारी बैंक द्वारा उसे प्रदान की गयी असज्जित आवासीय सुविधा के लिए वेतनमान , जिसमें उसे रखा गया है , के पहले चरण में मूल वेतन का 2.5% या मानक किराया इनमें , जो भी कम हो , बैंक को अदा करेगा और बैंक द्वारा उसे प्रदान किये गये फर्नीचर तथा । या फर्निशिंग , यदि कोई है , के लिए उस वेतनमान, जिसमें उसे रखा गया है , के पहले चरण में मूल वेतन का 0.50% अतिरिक्त भी अदा करेगा ।

3041 (2) जहाँ अधिकारी को बैंक द्वारा आवासीय सुविधा प्रदान नहीं की गई है , अधिकारी तैनाती स्थल के आधार पर प्रति माह निम्नलिखित रूप में मकान किराया भत्ता के लिए पात्र होगा :

(1 )

वेतन का 9%

'ए' श्रेणी के प्रमुख शहर

(नई दिल्ली , मुंबई , कोलकाता , चेन्नै, हैदराबाद , बैंगलोर , अहमदाबाद), तथा समूह ए में परियोजना क्षेत्र केंद्र

(ii)

वेतन का 8%

क्षेत्र I में अन्य स्थान ( 12 लाख तथा इससे अधिक जनसंख्या ) और समूह बी में परियोजना क्षेत्र केन्द्र

अन्य स्थान

(iii)

वेतन का 7%

( समूह ए तथा समूह बी में परियोजना क्षेत्र केन्द्र बैंकिंग क्षेत्र में वर्गीकरण के अनुसार होंगे):

बशर्ते कि यदि अधिकारी किराये के मकान में रहता है और किराया रसीद प्रस्तुत करता है , उसे देय मकान किराया भत्ता अपनी आवासीय सुविधा के लिए वेतनमान, जिसमें उसे रखा गया है , के पहले चरण में वेतन के 2.50 % से अधिक उसके द्वारा प्रदत्त वास्तविक किराया या उपर्युक्त रूप में देय मकान किराया भत्ता का 150% इनमें से जो भी कम हो , होगा ।

टिप्पणी: मकान किराया भत्ता के प्रयोजनार्थ 'वेतन ' का अर्थ अप्रैल 1998 की पहली तारीख को संशोधित वेतनमान के अनुसार अवरोध वेतनवृद्धियों सहित मूल वेतन होगा । "

7. मूल विनियमावली के विनियम 14 के लिए निम्नलिखित विनियम प्रतिस्थापित किया जाएगा और उसे नवम्बर 1999 की पहली तारीख से प्रतिस्थापित माना जाएगा , अर्थात: -

" 14 कोई भी अधिकारी बैंक द्वारा उपलब्ध कराए जानेवाले आवास को अपना अधिकार नहीं समझेगा । तथापि असज्जित आवास के लिए अधिकारी द्वारा प्रथम चरण के वेतनमान जिसमें वह रखा गया हो का 2.5 % की अदायगी और सज्जित आवास के लिए प्रथम चरण के वेतनमान जिसमें उसे रखा गया हो के 3 % की अदायगी या मानक किराया में से जो भी कम हो की अदायगी पर बैंक आवास उपलब्ध कराने के लिए स्वंतत्र होगा । जब बैंक द्वारा इस तरह का सज्जित या असज्जित आवास उपलब्ध कराया जाए तो बिजली , पानी , गैस एवं संरक्षण प्रभार अधिकारी द्वारा वहन किए जाएंगे न कि बैंक द्वारा । " [भाग III-खण्ड4 30428

किया गया माता जाण्याची काहीच की free " 15 ए (1 ) सभी अधिकारी जो 1.11.1993 को बैंक की स्थायी सेवा में हों उन्हें यथा 1.11.1993 को कम्प्यूटरीकरण के कारण वेतनमान के अधिकतम पर पहुँचने के एक वर्ष बाद वेतनमान में एक अग्रिम वेतनवृ‌द्धि दी जायगी और वह नियत व्यक्तिगत भत्ता प्राप्त करेगा । ऐसे अधिकारी जो 1.11.1993 को अपने वेतनमान के अधिकतम पर हो वे उस दिनांक अर्थात 1.11.1993 से नियत व्यक्तिगत भत्ता आहरित करेंगे ।

ऐसे किसी अधिकारी कर्मचारी के मामले में जिसे , बैंक का आवास नहीं दिया गया है , नियत व्यक्तिगत भत्ता का माकाम किराया भत्ता घटक , संबंधित अधिकारी कर्मचारी दवारा आंहरित मकान किराया भत्ता की मात्रा उस समय बढ़ जाएगी जब उल्लिखित संबंधित वेतन मान की अंतिम वेतनवृदधि अर्जित की जाती है । $8043 भाग III-खण्ड 4]

भारत सरकार के वित्त मंत्रालय के आर्थिक कार्य विभाग ( बैंकिंग प्रभाग ) ने अपने परिपत्र एफ सं. 26/2/2000- बीओआई दिनांक 9 मई , 2000 में बैंकों और वित्तीय संस्थानों के निदेशक मंडल में निदेशकों को निदेशक मंडल और समितियों की बैठकों में भाग लेने के लिए संदेय वर्तमान 'फीस की दरों को संशोधित कर के क्रमशः 1,000/ -रुपए एवं 500/ -रुपए कर दिया है । कथित पुनरीक्षण को राष्ट्रीय आवास बैंक सामान्य विनियमन, 1988का संशोधन 9 मई, 2000 से प्रभावी बनाता है ।

मई २४ , २००४ इस्लामिक ऐजूकेशन अकादमी तथा अन्य वनाम कर्नाटक राज्य तथा अन्य के मामले में माननीय सर्वोच्च न्यायालय के १४ अगस्त २००३ को दिये गये निर्णय जो कि TMA पाई फाउन्डेशन तथा अन्य बनाम कर्नाटक राज्य तथा अन्य के मामले में सर्वोच्च न्यायालय की संविधान पीठ ने ३१ अक्टूबर, २००२ के बहुमत के निर्णय के साथ पठनीय है , और प्रवेश परीक्षाओं की बहुतता के कारण छात्रों को होने वाली मानसिक , शारिरिक और वित्तीय समस्याओं को ध्यान में रखते हुए विश्वविद्यालय अनुतान आयोग अपने अधिनियम की धारी २६ की उपधारा(I ) (जी) के अन्र्तगत प्रदत्त शक्तियों का प्रयोग करते हुए और अंतरिम विनिमय संख्या १-६ / २००३ (सी० पी० पी० II) दिनांक १० जून , २००३ के अधिक्रमण में देश में २००४-२००५ के दौरान विनिदिष्ट व्यावयायिक पाठ्यक्रमों में प्रवेश के अंतरिम विनियमों में संशोधन के लिए निम्नलिखित विनिमय बनता है ।

१) लघु शीर्षक आवेदन और प्रारम्भ

(i) ये विनिमय विश्वविद्यालय अनुदान आयोग (विनिर्दिष्ट व्यावसयिक शिक्षा कार्यक्रम में प्रवेश) (पहला संशोधन) अंतरिम विनिमय , २००३.

(ii) ये केंद्रीय अधिनियम अथवा प्रान्तीय अधिनियम अथवा राज्य अधिनियम अथवा उसके अंतर्गत सीीपित या निर्गमित विश्वविद्यालयों और उनसे संबद्ध सभी संस्थानों,विश्वविद्यालय अनुदान आयोग एक्ट की धारा ३ के अंतर्गत उन सभी मानिक विश्वविद्यालयों पर लागू होंगे जो विनिर्दिष्ट व्यावसायिक पाठ्यक्रम चला रहें हैं ।

( iii) ये वर्ष २००४-२००५ के दौरान विनिर्दिष्ट व्यावसायिक पाठ्यक्रम में प्रवेश के लिए लागू होंगे ।

विश्वविद्यालय अनुदान आयोग (विनिर्दिष्ट व्यावसयिक शिक्षा कार्यक्रमों में प्रवेश) अंतरिम विनिमय , २००३ के पैरा ५ प्रवाधान कोटा के अंत. में निम्नलिखित पंक्ति जोडी जायेगी।

५ . "स्ववित्तपोषित मानित विश्वविद्यालयों में विनिर्दिष्ट व्यवसायिक पाठ्यक्रमों के लिए प्रबन्धन कोटा १५% होगा ।"

अध्यादेश (1 )

प्रोफेसर/रीडर/लेक्चरार पदों पर नियुक्ति हेतु प्रक्रिया एवं नियम

विश्वविद्यालय क़ानून की धारा 27 ( 1 ) (एन) के अंतर्गत प्राप्त अधिकारों के अनुसार कार्यकारी परिषद ने मौलाना आज़ाद नेशनल उर्दू यूनिवर्सिटी हैदराबाद में प्रोफेसर/ रीडर/लेक्चरार पदों पर नियुक्ति हेतु नियम एवं प्रक्रिया का निम्न अध्यादेश निर्धारित किया है ।

1. प्रोफेसर रीडर एवं लेक्वरार के पद केंद्र सरकार के नियमों के अनुसार प्रथम श्रेणी में वर्गीकृत होंगे ।

2. विश्वविद्यालय इन सभी पदों के लिएविज्ञापन देगा और इन पर नियुक्तियाँ क़ानून 19 (2 ) के अंतर्गत गठित चयन समिति की सिफारिशों के अनुसार अखिल भारतीय स्तर पर होंगी ।

3. चयन समिति की बैठक में अध्यक्ष को मत का अधिकार होगा और वह बराबरी के समय अपना मत देगा ।

4. चयन समिति की सिफारिशों को कार्यकारी परिषद को सौंपा जाएगा एवं कार्यकारी समिति की स्वीकृति के बाद नियुक्तिआदेश जारी किये जाएँगे । आपातकालीन समय में क़ानून 13 (2) (ii) केअंतर्गत कुलपति भी चयन समिति की सिफारिशों के अनुसार नियुक्ति आदेश जारी करेंगे और उन्हें विश्वविद्यालय क़ानून 11 (3 ) के अनुसार इन नियुक्तियों की रिपोर्ट अभिपुष्टि के लिए कार्यकारी परिषद की अगली बैठक में रखना होगा ।

5. न्यूनतम योग्यता संबंधी शर्तें तथा यूजीसी द्वारा 24-12-1998 को जारी अधिसूचना नं . एफ . 3-1 /94 (पीएस ) में शामिल शर्तें और अन्य शर्तें, जो यूजीसी द्वारा समय- समय पर जारी की जाएंगी , अमल में लायी जाएंगी । पद पर नियुक्ति के लिए कुलपति किसी विशेष स्थिति में विभागाध्यक्ष या डीन से परामर्श करसकता है ।

6. विश्वविद्यालय कानून 4 के अनुसार विश्वविद्यालय का शिक्षण माध्यम उर्दूहै । इसलिए यह आम नीति है कि उम्मीदवार को उर्दू में अध्यापन ( वह स्पष्ट रूप से उर्दू भाषा में पढ़ने , लिखने , समझने और अध्यापन करने कीयोग्यता रखता हो ) की योग्यता प्राप्त हो । जिसकी जाँच साक्षात्कार के समय चयन समिति करेगी । विज्ञापन में निर्धारित सभी प्रकार की योग्यता संबंधी शर्तें अनिवार्य होंगी ।

7 . निर्धारित योग्यता एवं अनुभव न्यूनतम होगा । इस निजी योग्यता के चलते वह साक्षात्कार को बुलाने का अधिकारी नहीं होगा , बल्किविश्वविद्यालय उम्मीदवारों की संख्या को सीमित करने का अधिकार रखता है , जो साक्षात्कार के लिए बुलाये जाएँगे । वह संख्या न्यूनतम योग्यता एवं अनुभव से अधिक पर भी हो सकती है ।

8. कार्यकारी परिषद क़ानून 20 ( 1 ) के अनुसार ऐसे उचित उम्मीदवारों को भी नियुक्त कर सकती है, जिन्होंने आवेदन- पत्र दाखिल नहीं किया है ।

9. आरक्षण श्रेणियों में विश्वविद्यालय क़ानून 7 के अंतर्गत केंद्र सरकार द्वारा निर्धारित नियम एवं प्रक्रिया परः अमल किया जाएगा । आरक्षण श्रेणी में उचित उम्मीदवारों के न मिलने पर अनारक्षित प्रावधानों पर विचार किया जाएगा । उम्मीदवारों को जाति प्रमाण- पत्र मंडल राजस्व अधिकारी द्वारा प्राप्त कर प्रस्तुत करना होगा।

11 . यदि दो उम्मीदवारों का चयन होता है , तो चयनित उम्मीदवारों को मेरिट के आधार पर देखा जाएगा । 12. भविष्य में किसी प्रकार की अनहोनी पर सिफारिश नहीं होगी , इसका प्रमाण संलग्न करना होगा ।

13. चयन समिति प्रोफेसर या रीडर के रूप में चयनित उम्मीदवार को यदि राय बनती है तो उस उम्मीदवार को अगला उचित निम्न पद इच्छानुसार प्राप्त करने की सिफारिश की जा सकती है ।

14. विश्वविद्यालय को यह अधिकार है कि वह उर्दू भाषा के ज्ञान से संबंधित नियम 6 को छोड़ कर योग्यता एवं आयु संबंधी मामलों में कुछ राहत सभी पदों पर चयन समिति की सिफारिशों के अनुसार दे सकती है ।

15. आयु , न्यूनतम योग्यता तथा अनुभव संबंधी छूट का प्रावधान अनुसूचित जाति जन जाति श्रेणी के उम्मीदवारों केलिएहोगी ।

16. यदि चयन समिति की सिफारिश के अनुसार योग्यता , आयु एवं अनुभव संबंधी शर्तों में नियुक्ति के लिए छूट दी जाती है , तो उसका उल्लेख रिकार्ड में मौजूद होगा ।

17. जब चयन समिति किसी उम्मीदवार को प्रारंभिक उच्च वेतन या अग्रिम वेतन वृद्धि के योग्य मानती है तो उसके कारण का उल्लेख किया जाए ।

18. विज्ञापन में दी गयी पदों की संख्या अस्थायी भी हो सकती है । विश्वविद्यालय इस संख्या को चयन या नियुक्तिके समय घटाने/बढ़ाने का अधिकार रखता है ।

19. सेवा में मौजूद उम्मीदवारों को भी प्रक्रिया के अनुसार आवेदन करना होगा ।

20 अनुसूचित जाति/जनजाति से संबंधित बाहरी उम्मीदवारों को टिकट नम्बर/प्रमाण दाखिल करने पर वापसी का एकल द्वितीय श्रेणी का रेल किराया दिया जाएगा ।

21. उम्मीदवार की ओर से किसी के द्वारा किसी प्रकार का पक्ष लिये जाने पर उम्मीदवार को अयोग्य क़रार दिया जाएगा ।

अब वह वर्तमान गवाह और पार्टियाँ निम्न लिखित अनुसार क्रमशः सहमत होगी ।

1. पहले भाग की पार्टी को विश्वविद्यालय और विश्वविद्यालय के अधीन प्राधिकरण के द्वारा समयानुसार जारी किये गये आदेश के अंतर्गत आवेदन दाखिल करना होगा और यह सेवा स्वीकार करने की तिथि से सेवा में बना रहेगा । नियम एवं शर्तें जो इस प्रकार हैं-

पहले भाग की पार्टी का स्तर शिक्षक/अधिकारी श्रेणी का होना चाहिए और उसका 3. दर्जा .(पद) में.. .(विभाग)

4. पहले भाग की पार्टीको इस तिथि से रु .. ..( मूल वेतन ग्रेड रु .. .. ) वह विश्वविद्यालय द्वारा नियमों के अनुसार प्राप्त सुविधाएं भी प्राप्त कर पाएगा ।

5. पहले भाग की पार्टी इस अनुबंध के दौरान उसको लागू होने वाले नियमों के अनुसार अर्जित अवकाश ले पाएगी । 6. यदिपहले भाग कीपार्टी को विश्वविद्यालय सेवा के अंतर्गत यात्रा करनी पड़ती है, तो वह उसके अधिकारी श्रेणी का अनुसार यात्रा भत्ता लेने का अधिकारी होगा ।

7. यह अनुबंध किसी भी समय सेवा निवर्तन/पार्टी द्वारा अथवा तीन महीने का लिखित नोटिस देकर समाप्त कर दिया जाएगा । हमेशा 3 महीने पूर्व लिखित नोटिस दी जाएगी अथवा पार्टी छुट्टी पर भी हो तो तीन महीने वेतन के समानुकुल रक़म दीजाएगी।

8. पहले भाग की पार्टी यूनिवर्सिटी नियमों केअनुर'र प्रोविडेंट फंड/पेंशन के लिए योग्य होगी ।

14) यदि किसी उम्मीदवार के चयन हेतु चयन समिति की सिफारिशों के आधार पर योग्यता, अनुभव एवं आयु में छूट दी जाती है तो उसका उल्लेख किया जाना चाहिए।

15) जब चयन समिति चयनित उम्मीदवार को उच्च वेतन और अग्रिम वेतन वृद्धि की सिफारिश करेगी, तो उसके कारण बताने होंगे ।

16) विज्ञापित पदों की संख्या अस्थायी समझी जाएगी । विश्वविद्यालय को चयन एवं नियुक्तियों के समय उन पदों की संख्या में कटौती/बढ़ोत्तरी करने का अधिकार होगा ।

17) निर्धारित योग्यता एवं अनुभव न्यूनतम होगा और यह आवश्यक नहीं है कि इस के आधार पर उम्मीदवार साक्षात्कार के लिए आमंत्रित करने का अधिकारी हो । विश्वविद्यालय साक्षात्कार के लिए बुलाये जाने वाले उम्मीदवारों की संख्या को सीमित करने एवं न्यूनतम से अधिक योग्य उम्मीदवारों को बुलाने के लिए भी अधिकृत है।

The Reserve Bank of India, having considered it necessary in the public interest and being satisfied that, for the purpose of enabling the Bank to regulate the credit system to the advantage of the country, it is necessary to amend the Residuary Non- Banking Companies (Reserve Bank) Directions , 1987, hereby , in exercise of the powers conferredby Sections 45J , 45JA, 45K and 45L of the Reserve Bank of India Act , 1934 (2 of 1934) and all the powers enabling it in this behaif, directs that the said Directions contained in Notification No.DFC.55 /DG (0 )-87 dated the 15th May 1987 shall , with immediate effect, be amended as follows , namely : -

1. Forsub - paragraph ( 1 ) of paragraph 6, the following sub - paragraph shall be substituted, namely, -

"6. On and from July 1, 2004 -

(1) Every residuary non - banking company shall invest and continue to invest an amount including the amount invested in assets under Section 45- IB of the Reserve Bank of India Act, 1934 (2 of 1934) , which at the close of business on any day of the quarter ending September 30, 2004 and thereafter, on any day of each quarter shall not be less than the aggregate amounts of the liabilities to the depositors , outstanding at the close of business on the last working day of the second preceding quarter (whether or not such amounts have become payable ) in securities or in other types of investments which are unencumbered and valued at a price not exceeding the current market price, in the following manner , namely , -

(a) not less than 10 percent of the aggregate amount of liabilities to depositors in fixed deposits/ certificates of deposit of scheduled commercial banks; or in certificates of deposit of specified financial institutions , provided the certificates are rated not less than AA+ or its equivalent by an approved credit rating agency , or partiy in any of these Fixed Deposits/Certificates of Deposit so rated;

(b) not less than 70 percent of the aggregate amount of liabilities to depositors in securities of any State Government or Central Government Issued by them in the course of their merket borrowing programme, or in bonds or debentures ( rated not less than AA + or equivalent by an approved credit rating agency and listed on a recognized stock exchange ) of any other PART III--SEC . 4]

company incorporated under the Companies Act, 1956 (1 of 1956) or in the manner at clause (a) or in the debt oriented schemes of mutual funds subject, however, to the conditions that

(i) not less than 15 per cent of the aggregate amount of the liabilities to the depositors shall be invested in any securities of any State Government or Central Government issued in the course of market borrowing programme;

(ii) not more than two percent of the aggregate amount of the jiabilities to the depositors shall be invested in any one debt oriented Mutual Fund which is governed by the Securities and Exchange Board of India (Mutual Funds) Regulations , 1996 and the aggregate of such investment shall not exceed ten per cent of the aggregate amount of liabilities to the depositors:

Provided that on and from July 1 , 2004, a residuary non -banking company which does not comply with the above requirement , shall not make any investment in other securities till the shortfall in this category of investments ismadegood.

Provided that in the event of downgrading of credit rating below the prescribed grade of any bond or debenture , the bond or debenture shall becorne ineligible for compliance with the above requirement and shortfall , if any, in the compliance with the above paragraph arising from such downgrading of the rating shall be made good before making any further investments in the securities as provided for in clause (c) or (d ) . "

Provided that debenture/bonds issued by holding company/subsidiary company/company in the same group shall not qualify for such investment .

(c) for the period prior to March 31, 2005, not more than 20 percent of the aggregate amount of liabilities to the depositors or ten times the net owned fund of the company, whichever is less , may be invested in any manner which in the opinion of the company is safe as per the approval of the board of directors of the company;

(d) on and from April 1 , 2005 not more than ten percent of the aggregate amount of liabilities to the depositors or one time the net owned fund of the company, whichever is less, may be invested in any manner which in the opinion of the company is safe as per the approval of the board of directors of the company;

(e) on and from April 1 , 2006 the aggregate amount of liabilities to the depositors shall be invested in accordance with sub- paragraph (a) or sub- paragraph (b ) only . " [PART III-SEC. 4 3072

2. For the Explanation to paragraph 6, the following Explanation shall be substituted , namely:

"Explanation

(i) net owned fund' means net owned fund as defined under section 45- IA of the Reserve Bank of India Act , 1934 (2 of 1934) including the paid up preference shares which are compulsorily convertible into equity ;

(ii) " aggregate amounts of liabilities" shall mean total amount of deposits received together with interest, premium , bonus or other advantage by whatever name called , accrued on the amount of deposits according to the terms of contract.

(iii) "quarter" means the period of three months , ending on the last day of March , June , September or December.

(iv) "approved credit rating agencies " mean

(a) The Credit Rating Information Services of IndiaLtd. (CRISIL) .

(b) Investment Information and Credit Rating Agency of India Ltd. (ICRA)

(d) FITCH Ratings India Private Ltd. ( Fitch India ) "

(v) ' scheduled commercial bank' means a bank included in the Second Schedule to the Reserve Bank of India Act, 1934 (2 of 1934) excluding a regional rural bank or a co - operative bank.

(vi ) 'Government company' means a company as defined under section 617 of the Companies Act , 1956 ( 1 of 1956) .

(vii) ' specified financial institution' means institutions listed in the schedule "D" to this Notification .

(viii ) The words ' holding company' , ' subsidiary company', ' company in the same group' shall have the same meaning as assigned to them in the Companies Act, 1956. "

1. (1) These regulations may be called the Export- Import Bank Officers ' Service(Amendment ) Regulations, 2004.

2) Save as otherwise expressly provided in these regulations, these regulations shall come into force on the date of their publication in the Official Gazette.

2. In the Export- Import Bank Officers ' Service Regulations, 1982 (hereinafter referred to as the principal regulations) , in regulation 4, for sub-regulation ( 1 ) the following sub- regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st day of April, 1998, namely : - PART III-SEC. 4]

Rs.7100-340-12540 " 3. In regulation 11 of the principal regulations , for sub-regulation (1 ) the following sub- regulation shall be substituted and shall be deemed to have been substituted with effect from the 9th Day of November 2002, namely: -

"( 1 )(a) Subject to sub -regulation 3 of regulation 8 , where the Bank is satisfied that the performance of an officer is unsatisfactory or inadequate or there is a bonafide suspicion about his integrity or his retention in the Bank's service would be prejudicial to the interests of the Bank , and where it is not possible or expedient to proceed against him as per the disciplinary procedure, the bank may terminate his services on giving him three months notice or emoluments in lieu thereof in accordance with the guidelines issued by the Government from time to time.

(b) Order of termination under this sub - regulation shall not be made unless such officer has been given a reasonable opportunity of making a representation to theBank against the proposed order.

(c) The decision to terminate the services of an officer or employee under sub- regulation (a) above will be taken only by the Chairman and Managing Director.

(d) The officer employee shall be entitled to appeal against any order passed under sub - regulation ( a) above by preferring an appeal within 15 days to the Board of Directors of the Bank . If the appeal is allowed, the order under sub- regulation (a) shall stand cancelled.

( e) Where an officer employee whose services have been terminated and who have been paid an amount of three months emoluments in lieu of notice and on appeal his termination is cancelled, the amount paid to him in lieu of notice shall be adjusted against the salary that he would have earned, had his services not been terminated and he shall continue in the bank's employment on same terms and conditions as if the order of termination had not been passed at all .

(f) An officer employee whose services are terminated under sub -regulation ( a) above shall be paid Gratuity, Provident Fund including employer's contribution and all other dues that may be admissible to him as per rules notwithstanding the years of service rendered.

(g) Nothing contained hereinabove will affect the Bank's right to retire an officer employee under Regulation 10( 1 ) . "

4. In regulation 11 of the principal regulations , after sub - regulation (2 ), the following sub- regulation shall be inserted and shall be deemed to have been inserted with effect from the 9th Day ofNovember 2002, namely : -

"(3)(1 ) An officer against whom disciplinary proceedings are pending shall not leave or discontinue or resign from his service in the bank without the prior approval in writing of competent authority and any notice or resignation given by such an officer before or during the disciplinary proceedings shall not take effect unless it is accepted by the Competent Authority.

(ii) Disciplinary proceedings shall be deemed to be pending against any employee for the propose of this regulation if he has been placed under suspension or any notice has been issued to him to show cause why disciplinary proceedings shall not be instituted against him and will be deemed to be pending until final orders are passed by the Competent Authority.

iii) The officer against whom disciplinary proceedings have been initiated will cease to be in service on the date of superannuation but the disciplinary proceedings will continue as if he was in service until the proceedings are concluded and final order is passed in respect thereof. The concerned officer will not receive any pay and or allowance after the date of superannuation . He will also not be entitled for the payment of retirement benefits till the 3077 PART III--SEC . 4]

proceedings are completed and final order is passed thereon except his own contributions to CPF . "

5. For regulation 12 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of April 1998 , namely : -

" 12. Dearness Allowance ( D.A. ) shall be payable to an officer on the following lines : - i) D.A. will be liked to the All India Average Working Class Consumer Price Index (General ) ( Base 1960-100 ) .

ii) D.A. will be payable only when the Average Index is above CPI 1684 .

Above 1684 points (All India Average Consumer Price Index ( General ) 1960-100 ) , for each 4 point cycle , rise or fa !! , quarterly average , quarterly adjustments :-

6. In regulation 13 of the principal regulations , for sub- regulations (1 ) and (2) the following sub - regulations shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of November 1999 , namely : -

" 13 ( 1 ) Where an Officer is provided with residential accommodation by the Bank , the Officer should pay to the Bank , every month 2.5 % of the Basic Pay at the first stage of the scale of pay in which he is placed or the standard rent , whichever is less for the unfurnished accommodation provided to him by the Bank , and shall also pay additional 0.50 % of the Basic Pay at the first stage of the scale of pay in which he is placed towards the furniture and /or furnishing , if any , provided to him by the Bank .

(2)Where an officer is not provided with residential accommodation by the Bank, the officer shall be eligible for a House Rent Allowance(HRA) per month , depending on place of posting, as under :

Provided that if an officer resides in a rented accommodation and produces a rent receipt , the house rent allowance payable to him shall be the actual rent paid by him for his residential accommodation in excess over 2.50% of the pay in the first stage of the scale of pay in which he is placed or 150% of the House Rent Allowance payable as above , whichever is lower.

Note : ' Pay' for the purpose of House Rent Allowance shall mean basic pay including stagnation increments in terms of revised pay scales as on the 1st Day of April 1998. "

7. For regulation 14 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of November 1999 , namely : -

" 14. No officer shall be entitled as of right to be provided with residential accommodation by the Bank. It shall , however, be open to the Bank to provide residential accommodation on payment by the officer of 2.5 % of the basic pay at the first stage of the scale of pay in which he is placed for unfumished accommodation and 3 % of the basic pay at the first stage of the scale of pay in which he is placed for furnished accommodation or the standard rent , whichever is less for such accommodation . Where such fumished or unfurnished residential accommodation is provided by the Bank, the charges for electricity, water, gas and conservancy shall be bome by the officer and not by the Bank. 8. For regulation 15 of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of November 1999, namely: -

"15. An officer shall be eligible for City Compensatory Allowance , depending on place ofposting, as under:

9 . For regulation 15A of the principal regulations , the following regulation shall be substituted and shall be deemed to have been substituted with effect from the 1st Day of November 1999, namely : -

( 1 ) Officers who are in service as on 1.11.1993 and are granted an advance increment on account of computerisation as on 1.11.1993 shall draw the Fixed Personal Allowance(F.P.A. ) one year after reaching the maximum . The Officers who are at the maximum of scale of pay as on 1.11.1993 shall draw FPA as from that date , i.e. 1.11.1993 .

In respect of Officer employees who are not provided with Bank's accommodation , the HRA component of FPA shall be the increase in quantum of HRA drawn by the concerned Officer employees when the last increment of the relevant scale of pay as specified is earned.

National Housing Bank EXPLANATORY MEMORANDUM

Government of India, Ministry of Finance, Department of Economic Affairs (Banking Division) vide its circular F.No. 26/2/2000- B.O.1 . dated 9th May, 2000 had revised the rates of sitting fee payable to the directors on the board of banks and financial institutions for attending the Board and Committee meetings to Rs . 1000/ - and Rs.500 /-respectively . The amendment to the National Housing Bank General Regulations , 1988 is to give effect to the said revision with effect from 9th May, 2000.

1. Short title, application and commencement:

(1) These Regulations may be called the University Grants Commission (Admissionto specified professional programmes) (1st Amendment) Interim Regulations, 2003.

(2) They shall apply to every university established or incorporated by or under a Central Act, a Provincial Act or a State Act, including all institutions recognized by or affiliated to them and every Institution deemed tobe University under Section 3 of the UGC Act , 1956 conducting specified professional programmes.

(3) They shall come into force for all admissions to the specified programmes during the year 2004-2005.

In the UGC (Admission to Specified Professional programmes ) Interim Regulation , 2003 , the following line shall be added in the end of para 5: Management Quota .

5. "The management quota for the specified professionai programmes in self-financing deemed university shallbe 15% ."

ORDINANCE NO . 1

PROCEDURE AND NORMS FOR APPOINTMENT TO THE POSTS OF PROFESSOR/ READER/LECTURER

In exercise of the powers vested in Section 27 ( 1 ) ( n) of the University Act, the Executive Council hereby makes the following Ordinance prescribing the norms and procedure for appointment to the postsofProfessor/Reader/Lecturer in Maulana Azad National Urdu University, Hyderabad .

1. The post of Professor, Reader and Lecturer will be categorised as Group A posts as per Central Govt . rules .

2. The University will advertise the above posts and make appointments there - to on all India basis on the recommendations of the Selection Committee constituted in Statute 19(2).

3. The Chairman shall be entitled to vote at the Selection Committee meeting and shall have an exercise to cast a vote in the case ofa tic.

4. The recommendations of the Selection Committee shall be submitted to the Executive Council and orders of appointment shall be issued after the approval ofthe Executive Council in accordance with Statute 13 (2)(ii) provided in an emergency, the Vice- Chancellor may issue orders of appointment as recommended by the Selection. Committee and report the matter to the Executive Council at its next meeting for ratification as provided for in Section 11 (3) of the UniversityAct.

5. The terms and conditions with regard to the minimum qualifications and other terms and conditions as prescribed by the UGC in its Notification No. F.3-1/94 (PS) dated 24.12.1998 and any other Notifications, issued or will be issued by the UGC, from time to time, shall be followed. The Vice-Chancellor may prescribe in consultation with the concemed Dean and Head of the Department, such specification or any other condition as required for the post tobe filled up.

6. As per Section 4 of the University Act, the medium of instructions in this University isUrdu. Therefore, as a general policy, it shall be compulsory that the candidates should posses the ability to teach should be able to clearly demonstrate his knowledge of reading, writing, understanding and teaching in Urdu language") in Urdu medium, which shall be judged by the Selection Committee at the time of Interview. This condition shall invariably be mentioned in each Advertisement, under the qualifications required.

7. The prescribed qualification and experience will be minimum, and the mere fact that a candidate possessing the same, will not entitie him for being called for interview. The University will have the right to restrict the number of candidates to be called for interview, to a reasonable number on the basis of qualifications and experience higher than the minimum prescribed or by any other condition that may deem fit.

8. It would be open to the Executive Council to offer appointment to suitable persons who may not have applied in accordance with Statute 20( 1) .

9. The rules and procedures prescribed by the Govt . of India in respect of the Reserved categories shall be followed as provided in Section 7 of the University Act, with the provisions prescribed for de - reservation, in case of non - availability of the suitable candidates under Reserved categories . The candidates will have to produce Caste Certificate from Mandal Revenue Officer concerned.

[PART III-SEC. 4 10. The Selection Committee may decide its own method of evaluating the performance of the candidates .

11. If two or more candidates are selected, the recommendations shall invariably be made in order of merit of the selected candidates .

12. No recommendations should be made with a condition attached to the occurrence of the future events,

13. The Selection Committee, after considering a candidate for the post of Professor or Reader, may, if it is of the opinion that he or she will be suitable choice for the next lower post, can make such recommendation.

14. The University will have the right to relax any of the qualifications, experience and age excepting those relating to the knowledge ofUrdu as given in Section ( 6) , etc. , in deserving cases for all the posts on the recommendations of the Selection Committee.

15. The statutory provision for relaxing of age , minimum qualification, experience etc.prescribed in case of the candidates belonging to SC/ ST categories will be made applicable to them.

16. If any candidate is recommended by the Selection Committee for appointment in relaxation of any of the prescribed conditions relating to qualifications, age, experience etc, it shall be so stated and recorded.

17. When the Selection Committee considers it fit to recommend a higher initial pay or advance increments to be offered to a selected candidate , it may do so giving reasons there- for.

18. No. of posts advertised may be treated as tentative. The University shall have the right to increase/decrease the number of posts at the time of selection and make appointments accordingly .

19.The in- service candidates should apply through Proper Chamel.

20.Outstation candidates belonging to SC/ST categories called for interview will be paid equivalent to return single second class railway fare towards journey, expenses on production ofTicket numbers / proof.

21. Canvassing in any form on behalf of any candidate will disqualify such candidate

22. The Chairman shall have the power to lay-down the procedure in respect of anymatter not mentioned in the Act / Statute / Ordinance .

23.The Selection Committee's recommendations , when approved by the Executive Council / by the Vice-Chancellor on behalf or Executive Council, shall remain valid for a period of one year from the date of such approval.

24. The application forms will be sold and registration fee collected at the rates prescribed by the University from time to time. The SC/ ST/Physically Handicapped candidates need not pay Registration Fee.

As stipulated in Section 31 ( 1 ) of the University Act and in accordance with the Statute No. 23 (2) of the Statutes of the University, the Executive Council hereby makes the following ordinance with regard to the written contract of appointments .

"As required in Statute No. 23 ( 2 ) , every teacher and member of the academic staff of the University shall be appointed on a written contract , the form of which is hereby prescribed and appended to this ordinance . "

8. The party of the first part shall be eligible to the benefit of the University Provident Fund/Pension according to the rules .

9. In regard to any matter in respect of which no provision has been made in this agreement, the provision of the rules made or deemed to have been made under Article 309 B & 313 of the constitution of India , the provisions ofany Act or Rule made by the University in regard to the employees borne in the category of the Teacher /Officer in the University service shall apply to the extent to which they are applicable to the service of the party of the first part under this agreement and the decision of the University as to their applicability shall be final. c) The candidates will be picked-up for interview on the basis of marks obtained in the written test, in order of merit, in the ratio of 10: 1 of the vacancies tobe filled up.

5) In addition to the qualifications and other conditions prescribed, the proficiency in Urdu writing, reading and speaking will be essential / preferable , for appointment of all the categories.

6) The Chairman will be entitled to vote at the meeting and shall have an exercise 10 cast a vote in case of a tie.

7) a) The recommendations of the Selection Committee in respect of the posts of groups A &B will be submitted to the Executive Council and orders of appointments will be issued only after the approval of the Executive Council except in case of emergency wherein in Vice-Chancellor may issue orders as per the recommendations of the Selection Committee and report the matter to the Executive Council at its next meeting for ratification .

b) The Vice -Chancellor may be authorized to make appointments on the basis of the recommendations of the Selection Committee to the posts of groups C & D

8) a) The rules and procedure laid down by the Govt. of India in regard to Reserved Categories shall be followed. The candidates will have to produce the Caste Certificate from the concerned authorities . In case suitable candidates are not available, the prescribed procedure for the de- reservation of the post will be followed.

b) The rules ofGovt. of India in regard to Pay & Allowances , Leave , Pension and P.F. shall be followed subject to amendments if any, from time to time.
