सा. का. नि. 241. केन्द्रीय सरकार संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, गृह मंत्रालय , सशस्त्रसीमा बल में समूह ' क' योधक ( साधारण ड्यूटी ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ:-( 1 ) इन नियमों का संक्षिप्त नाम सशस्त्र सीमा बल, समूह ' क' योधक ( साधारण ड्यूटी ) अधिकारी भर्ती नियम, 2004 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना :-ये नियम इससे उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतनमान :- उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो पूर्वोक्त अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. आरंभिक गठन : -( 1 ) इन नियमों के प्रारंभ से ठीक पूर्व नियमित आधार पर योधक साधारण ड्यूटी के पदों को धारण करने वाले अधिकारियों के विषय में यह समझा जाएगा कि वे इन नियमों के उपबंधों के अनुसार नियुक्त किए गए हैं ।

(2) इन नियमों के प्रारंभ से ठीक पूर्व संबंधित पदों में उपनियम में निर्दिष्ट अधिकारियों की नियमित और निरंतर सेवा, परिवीक्षा , प्रोन्नति के लिए अर्हक सेवा की पुष्टिकरण और पेंशन के प्रयोजन के लिए संगणित की जाएगी ।

6. चिकित्सक दृष्टया योग्यता:-केवल ऐसे अधिकारी जो शेप -1 की चिकित्सीय श्रेणी में हैं, वे इन नियमों के अधीन प्रोन्नति और प्रतिनियुक्ति पर नियुक्ति के लिए पात्र होंगे ।

स्पष्टीकरण:-इन नियमों के प्रयोजनों के लिए " शेप -1 " स्पष्टीकरण का अर्थ केन्द्रीय सरकार द्वारा समय - समय पर अधिकथित शारीरिक और मानसिक कृत्यकारी क्षमता से होगा , जो संख्यांक 1 से 5 द्वारा सूचित किया जाएगा जो निम्नानुसार है , अर्थात्: -

एस- मनोवैज्ञानिक

एच- श्रवण शक्ति

ए-संलग्नक

पी-शारीरिक क्षमता

ई- दृष्टि

7. दायित्व:-इन नियमों के अधीन पदों के किसी प्रवर्ग में नियुक्ति किसी व्यक्ति का, भारत में या विदेश में किसी भी स्थान पर सेवा करने का दायित्व होगा ।

8. निरर्हता :- वह व्यक्ति -

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

4 परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

9. अधिवर्षिता :-कमांडेंट से उच्चतर रैंक का पद धारण करने वाला कोई अधिकारी उस मास की अंतिम तारीख के अपराह्न को, जिसमें वह साठ वर्ष की आयु प्राप्त कर लेता है , सेवानिवृत्त होगा । अन्यरैंक के अधिकारी जिनके अंतर्गत कमांडेंट भी है, उस मास की अंतिम तारीख के अपराह्न को, जिसमें वह सत्तावन वर्ष की आयु प्राप्त कर लेता है, सेवानिवृत्त होंगे ।

परन्तुयह कि वह अधिकारी जिसके जन्म की तारीख किसी मास की पहली तारीख है, यथास्थिति, साठ वर्ष या सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराहन में सेवानिवृत्त होगा ।

10. शिथिल करने की शक्ति-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 1475 [ भाग II-खंड 3 ( i ) ]

11. व्यावृत्ति: -इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ख) महानिदेशक द्वारा समय - समय पर विहित प्रोन्नति संबंधी पाठ्यक्रम पूरा कर लिया है ।

(ग ) चिकित्सीय प्रवर्ग शेप-1 का होना चाहिए ।

प्रतिनियुक्ति:-ऐसे भारतीय पुलिस अधिकारियों की प्रतिनियुक्ति जिन्होंने केन्द्र या राज्य सरकार में, पुलिस उप - महानिरीक्षक का या समतुल्य पद धारण किया है या केन्द्र सरकार के ऐसे अधिकारी की दशा में, जिन्हें उप- महानिरीक्षक का पद धारण करने के लिए पैनलित किया गया है ।

G.S.R. 241. In exercise of the powers conferred by Article 309 of the Constitution, the Central Government hereby makes the following rules regulating the method of recruitment to the Group ' A' Combatised ( General Duty) posts in the Sashastra Seema Bal in the Ministry of Home Affairs , namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Sashastra Seema Bal Group ' A' Combatised (General Duty) Officers Recruitment Rules . 2004.

(2) They shall come into force on the date of their publication in the Gazette .

2. Application :-These rules shall apply to the posts specified in Column ( 1 ) of the Schedule annexed hereto .

3 Number of post , classification and scale of pay.---The number of posts . their classification and the scales of pay attached thereto shall be as specified in columns (2) to (4) of the schedule aforesaid.

4. Method of recruitment , age limit, qualification etc. The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the Schedule aforesaid.

5. Initial Constitution :-

( 1) Officers holding the Coinbatised General Duty posts immediately before the commencement of these rules on regular basis shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular and continuous service of the Officers referred to in sub rule ( 1 ) in the respective posts immediately before commencement of these rules shall be counted for the purpose of probation , qualifying service for promotion , confirmation and pension .

6. Medical Fitness :-Only Officers who are in the medical category of SHAPE - 1 shall be eligible for appointment on promotion and deputation under these rules .

7. Liability. Any person appointed to any category of posts under these rules shall be liable to serve anywhere inIndia and abroad.

8. Disqualification. No person,

(a) who has entered into or contracted a marriage with person having a spouse living ; or

(b) who having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment under these rules:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other grounds for se doing so, exempt any person from the operation of these rules.

9. Superannuation. An officer holding the post higher than the rank of Commandants shall retire from service.on the afternoon of the last day of the month in which he attains the age of sixty years. Officers of other ranks including Commandant shall retire from service on the afternoon of the last day of the month in which they attain the age of fifty - seven years:

Provided that an officer whose date of birth is the first of a month shall retire from service on the afternoon of thelast dayof the preceding month on attaining the age of sixty years or fifty - seven years as the case may be.

10. Powerstormchan Where the Central Government is of the opinion that it is necessary or expedient-so-to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to nay class on catagory of persons.

11. Savings Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, the Other Backward Classes , the Ex- servicemen and other special.catagories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

1. संक्षिप्त नाम और प्रारंभ इन नियमों का संक्षिप्त नाम अन्तरिक्ष विभाग ( नियंत्रक, एल. पी. एस. सी. , उन्नत आँकड़ा संसाधन अनुसंधान संस्थान और विशेष कार्य अधिकारी, राष्ट्रीय प्राकृतिक संसाधन प्रबन्ध प्रणाली ) भर्ती नियम , 2004 है ।

2. पद-संख्या, वर्गीकरण और वेतनमान:- उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । [ भाग II-खंड 3 ( i ) ]

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति:- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा, शिथिल कर सकेगी । 6. व्यावृत्ति:-इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in partial modification of the Department of Space ( Controller in Indian Space Research Organisation Centres, Registrar , Advanced Data Processing Research Institute and Officer on Special Duty, National Natural Resources Management Systems) Recruitment Rules , 2001 , in so far as they relate to the post of Controller, Liquid Propulsion Systems Centre , Registrar, Advanced Data Processing Research Institute and Officer on Special Duty , National Natural Resources Management Systems except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Controller , Liquid Propulsion Systems Centre, Registrar, Advanced Data Processing Research Institute and Officer on Special Duty , National Natural ResourcesManagement Systems in the Department of Space , namely :-

1. Short title and commencement. These rules may be called the Department of Space (Controller, Liquid Propulsion Systems Centre, Registrar , Advanced Data Processing Research Institute and Officer on Special Duty, National Natural Resources Management Systems ) Recruitment Rules , 2004.

सा. का. नि. 243.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए कृषि मंत्रालय , वनस्पति संरक्षण निदेशालय , करंतीन और भंडारण में आशुलिपिक श्रेणी -1 के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ -( 1 ) इन नियमों का संक्षिप्त नाम पौधा संरक्षण निदेशालय , करंतीन और भंडारण, आशुलिपिक श्रेणी-1 भर्ती नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि:- उक्त पद पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी , जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता:-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है किं ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति:-इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( iii ) जिन्होंने 4000-6000 रु. के या समतुल्य वेतनमान में दस वर्ष नियमित सेवा की है; या

(ख ) जिनके पास आशुलिपि ( अंग्रेजी/हिन्दी ) में 100 शब्द प्रति मिनट की गति है ।

टिप्पण:-प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाहय पद पर प्रतिनियुक्तिकी अवधि है साधारणतया 2 वर्ष से अधिक नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना

G.S.R. 243. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade- I in the Ministry ofAgriculture, Directorate of Plant Protection, Quarantine and Storage , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Directorate of Plant Protection, Quarantine and Storage , Stenographer Grade - I Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said post, its classification and scale ofpay attached thereto shall be as specified in columns (2 ) to ( 4) of the schedule annexed to these rules .

3. Method of recruitment , age limit , other qualifications ,etc.-Method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13 ) ofthe said Schedule .

4. Disqualification. No person ,

(a) who , has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category ofpersons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes and Scheduled Tribes , Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

सा. का. नि. 244.- मखाना श्रेणीकरण और चिह्नांकन नियम, 2003 का एक प्रारूप, भारत के राजपत्र, भाग -2 , खण्ड 3 , उपखण्ड ( i ) तारीख 16 अगस्त, 2003 में पृष्ठ 1868-1877 पर सा. का. नि. 294, तारीख 29 जुलाई, 2003 द्वारा प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से आक्षेप और सुझाव मांगे गए थे जिनके उससे प्रभावित होने की संभावना है;

और उक्त राजपत्र की प्रतियां जनता को 19 सितम्बर, 2003 को उपलब्ध करा दी गई थीं;

और उक्त प्रारूप के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार ने सम्यक् रूप से विचार कर लिया है ;

अतः , अब, केन्द्रीय सरकार, कृषि उपज ( श्रेणीकरण और चिह्नांकन अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है, अर्थात्:-

नियम

1. संक्षिप्त नाम, लागूहोना और प्रारंभ:-

(1 ) इन नियमों का संक्षिप्त नाम मखाना श्रेणीकरण और चिह्नांकन नियम, 2004 है ।

( 2) ये मखाना जिसके अंतर्गत मखाना चूर्ण और तला हुआ मखाना भी है, को लागू होंगे।

(3) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे । 1495

2. परिभाषाएं-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(i ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है;

(ii ) " प्राधिकृत पैकर " से ऐसा व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया केअनुसार मखाना का श्रेणीकरण और उन्हें चिह्ननांकन करने के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया गया है;

(iii ) " प्राधिकार प्रमाणपत्र " से किसी व्यक्ति या व्यक्तियों के किसी निकाय को, मखाना का श्रेणीकरण करने और उस पर श्रेणी अभिधान चिह्न लगाने के लिए प्राधिकृत करते हुए साधारण श्रेणीकरण और चिह्नह्मांकन नियम, 1988 के उपबंधों के अधीन जारी किया गया प्रमाणपत्र अभिप्रेत है;

(iv ) " साधारण श्रेणीकरण और चिह्नांकन नियम " से समय - समय पर यथासंशोधित कृषि उपज ( श्रेणीकरण और चिह्नांकन) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 अभिप्रेत है;

(v ) " श्रेणी अभिधान चिह्न " से इन नियमों के नियम 5 में निर्दिष्ट " प्रतीक चिह्न " अभिप्रेत है;

(vi) " अनुसूची" से इन नियमों से संलग्न अनुसूची अभिप्रेत है;

3. श्रेणी अभिधान-इन नियमों के प्रयोजन के लिए श्रेणी अभिधान उन श्रेणियों के नाम होंगे जो अनुसूची 2 , 3 और 4 के स्तंभ 1 के अधीन दी गई मखाना की क्वालिटी को उपदर्शित करते हैं ।

4. क्वालिटी की परिभाषा-इन नियमों के प्रयोजन के लिए, क्वालिटी की परिभाषा और साधारण अपेक्षाएं वे होंगी जो अनुसूची 2 के स्तंभ 2 से 11 , अनुसूची -3 के स्तंभ 2 से 9 और अनुसूची-4 के स्तंभ 2 से 8 में प्रत्येक श्रेणी अभिधान के सामने दी गई है ।

5. श्रेणी अभिधान चिह्न- श्रेणी अभिधान चिह्न " प्रतीक चिन्ह " से मिलकर बनेगा जिसमें प्राधिकार प्रमाण- पत्र संख्या " एगमार्क" शब्द, वस्तु का नाम और श्रेणी अभिधान सहित डिजाइन होगी और जो अनुसूची 1 में उपवर्णित डिजाइन के सदृश होगा।

6. पैक करने का ढंग-

( 1 ) मखाना जिसके अंतर्गत चूर्ण और तला हुआ मखाना भी है ऐसी रीति में पैक किया जाएगा जो उत्पाद की स्वास्थ्यकारक, पोषण संबंधी, प्रौद्योगिक और इंद्रियग्राही क्वालिटी की रक्षा करेगी,

(2) पैकेजिंग सामग्री मजबूत , स्वच्छ, शुष्क, नमीसह और कीट आकीर्णन या फफूंदी संदूषण से मुक्त होगी।

(3 ) पैकेजिंग सामग्री ऐसे पदार्थों से बनी होगी जो उनके आशयित उपयोग के लिए सुरक्षित और उपयुक्त हों जिसके अंतर्गत नए स्वच्छ पटसन के बैग, प्लास्टिक बैग , टिन प्लेट, आधान या कोई अन्य पैकिंग सामग्री जो कृषि विपणन सलाहकार द्वारा अनुमोदित हो परंतु यह कि पैकिंग सामग्री समय - समय पर यथासंशोधित खाद्य अपमिश्रण निवारण नियम, 1955 के अधीन यथाअनुज्ञात खाद्य श्रेणी की सामग्री से विनिर्मित होगी ।

(4) मखाना समय -समय पर यथासंशोधित बाट और माप मानक ( पैक की गई वस्तुएं ) नियम , 1977 के उपबंधों के अधीन यथा- विनिर्दिष्ट विभिन्न मात्राओं में पैक किया जाएगा ।

(5 ) प्रत्येक पैकेज में एक ही श्रेणी के मखाना होंगे।

(6 ) प्रत्येक पैकेज सुरक्षित रूप से बंद और उपयुक्त रूप से मुहरबंद किया जाएगा ।

(7 ) एक ही श्रेणी और एक ही लॉट/ बैच के उत्पाद से युक्त उपभोक्ता पैकों की उपयुक्त संख्या बड़े आधान में पैक की जा सकेगी। 7. चिह्नांकन का ढंग -

( 1 ) श्रेणी अभिधान चिह्न मखाना के प्रत्येक आधान पर कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में साधारण श्रेणीकरण और चिह्नांकन नियमों के नियम 11 के अनुसार सुरक्षित रूप से चिपकाया जाएगा या मुद्रित किया जाएगा:

(2 ) श्रेणी अभिधान चिह्न के अतिरिक्त प्रत्येक आधान पर निम्नलिखित विशिष्टियां स्पष्टतः और अमिट रूप से चिह्नांकित की जाएंगी । (क) उत्पादक देश का नाम;

(ख ) विनिर्माता/प्राधिकृत पैकर का नाम और पता;

(घ) लॉट/बैच्च संख्या, कोड संख्या;

(ङ) पैक किए जाने की तारीख *;

(च) शुद्ध वजन;

(छ) वर्ष और मास से पूर्व उत्कृष्ट;

(ज) अधिकतम खुदरा कीमत , सभी करों सहित;

(झ ) ऐसी अन्य विशिष्टियां जो समय - समय पर कृषि विपणन सलाहकार द्वारा विनिर्दिष्ट की जाएं ।

*पैक करने की तारीख वह तारीख होगी जब नमूनों का विश्लेषण पूरा होता है ।

(3 ) चिह्नांकन के लिए प्रयुक्त स्याही ऐसी क्वालिटी की होगी जो वस्तु को संदूषित न करे;

(4) प्राधिकृत पैकर, साधारण श्रेणीकरण और चिन्हांकन नियमों के नियम 11 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी का पूर्व अनुमोदन अभिप्राप्त करने के पश्चात्, आधानों पर अपना निजी व्यापार चिह्न चिह्नांकित कर सकेगा परन्तु यह तब जब कि निजी व्यापार चिह्न, वह इन नियमों के अनुसार आधानों पर लगाए गए श्रेणी अभिधान चिह्न द्वारा उपदर्शित से भिन्न वस्तु की क्वालिटी या श्रेणी उपदर्शित न करता हो ।

8. प्राधिकार प्रमाणपत्र अनुदत्त करने के लिए विशेष शर्तें:-साधारण श्रेणीकरण और चिह्नांकन नियमों के नियम 3 के उपनियम ( 8 ) में विनिर्दिष्ट शर्तों के अतिरिक्त निम्नलिखित शर्तें इन नियमों के अधीन मखाना के श्रेणीकरण और चिह्नांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त करने की अतिरिक्त शर्तें होंगी , अर्थात्ः-

( i ) साधारण श्रेणीकरण एवम् चिन्हांकन नियम के नियम 9 के अनुसार , प्राधिकृत पैकर, मखाना की क्वालिटी के परीक्षण के लिए कृषि विपणन सलाहकार अथवा उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी द्वारा अनुमोदित किसी अर्हित रसायनज्ञ द्वारा सञ्जित या तो स्वयं की प्रयोगशाला की स्थापना करेगा या इस प्रयोजन के लिए अनुमोदित किसी प्रयोगशाला तक पहुंच रखेगा;

( ii ) प्रसंस्करण और पैकिंग के लिए परिसर पूर्ण स्वास्थ्यकारक और स्वच्छता की दशाओं में रखे जाएंगे;

( iii ) इन संक्रियाओं में लगे कार्मिकों का स्वास्थ्य अच्छा होगा और वे किसी सांसर्गिक रोग से मुक्त होंगे ।

(11) मखाना:-

( 1 ) निम्फेसी फैमिली के, " यूरेल फैरोक्स ", गोरगोन फल या फौक्स के परिपक्व, सूखे और ठोस बीजों से अभिप्राप्त उत्पाद होगा;

( 2 ) वस्तु के लक्षणों के अनुसार साफ, साबुत और सफेद या दूधिया रंग का और अरोमा से युक्त होगा;

मखाना ( तला हुआ ):-

( 1 ) खाद्य तलने वाले पदार्थ में मखाना को तलकर तैयार किया जाएगा और उपयुक्त रूप से लवणित, मधुरित, मसालायुक्त मखाना या अन्यथा सुवासित किया जा सकेगा ।

(2 ) बेहतर स्वाद के लिए भुरभुरा होगा;

(3 ) विकृत गंधी , स्वाद, मस्की गंध और असामान्य सुवास से मुक्त होगा;

(4 ) गंदगी , कृंतक रोम और मल, फफूंदी , कीट ग्रसन , हानिकारक जीवाणु, कवक, मकड़जाल , योजित रंजक पदार्थ, विषैले पदार्थ, घृणित गंध और अनुसूची में यथा उपदर्शित सीमा के सिवाय अन्य अशुद्धियों से मुक्त होगा;

( 5 ) अच्छी विपणन दशा में और सभी प्रकार से मानव उपभोग के लिए उपयुक्त होगा;

1. अकार्बनिक बाह्य पदार्थ-से बालू, पत्थर, धूल , गंदगी , मिट्टी की डेलियां, बजरी , कंकड़, मिट्टी और कीचड़ और धात्विक टुकड़े अभिप्रेत हैं ।

2. कार्बनिक बाह्य पदार्थ- से खरपतवार बीज, भूसा, तना, तृण और पादप के अन्य वनस्पति पदार्थ;

3. कीट क्षतिग्रस्त- से ऐसा मखाना ( भुना हुआ) अभिप्रेत है जो कीटों द्वारा आंशिक रूप से या पूर्ण रूप से छिद्रित या क्षतिग्रस्त हो;

4. क्षतिग्रस्त और अपवर्णित- से ऊष्मा, रोगाणु, नमी या मौसम या अन्य कारणों से सुस्पष्ट रूप से या आंतरिक रूप से क्षतिग्रस्त साबुतःया खंडित मखाना ( भुना हुआ) अभिप्रेत है ।

G.S.R. 244. Whereas a draft of the Makhana Grading and Marking Rules , 2003 was published at pages 1868-1877 of the Gazette of India, Part II , Section 3 , sub-section ( i)' dated the 16th August, 2003 vide GSR 294, dated 29th July, 2003 for inviting objections and suggestions from all persons likely to be affected thereby, Andwhereas copies of the said Gazette were made available to the public on 19th September, 2003;

And whereas, the objections and suggestions received from the public in respect of the said draft rules have beenduly considered by the Central Government ;

Now, therefore, in exercise of the powers conferred by the Section 3 of the Agricultural Produce (Grading and Marking ) Act , 1937 ( 1 of 1937 ) , the Central Government hereby makes the following rules, namely:-

RULES

1. Short title , application and commencement. ( 1 ) These rules may be called the Makhana Grading and Marking Rules , 2004;

(2) They shall apply to Makhana including Makhana powder and Makhana fried.

(3) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions . In these rules , unless the context otherwise requires,-

(i ) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;

(ii ) " authorised packer " means a person or a body ofpersons who has been granted a certificate of authorisation to grade and mark Makhana, Makhana powder and Makhana fried in accordance with the provisions of these rules;

(iii) " certificate of authorisation " means the certificate issued under the provisions of the General Grading and Marking Rules , 1988, authorising a person or a body of persons to grade and mark Makhana , Makhana powder and Makhana fried with the grade designations mark ;

(iv) "General Grading and Marking Rules " means the General Grading and Marking Rules , 1988 made under Section 3 of the Agricultural Produce (Grading and Marking ) Act , 1937 ( 1 of 1937) ;

(v) " grade designation mark " means the " Agmark Insignia " referred to in rule 5 of these rules ;

(vi ) " Schedule " means a schedule annexed to these rules .

3. Grade designations . For the purposes of these rules , the grade designations shall be the name of grades which indicate the quality of Makhana , Makhana powder and Makhana fried as given under column 1 of Schedules - II , III and IV respectively.

4. Definition of Quality. For the purposes of these rules , the definition of quality and general requirements shall be such as given against each grade designation in columns 2 to 11 of Schedule - II , columns 2 to 9 of Schedule - III and columns 2 to 8 of Schedule - IV.

5. Grade designation mark. The grade designation mark shall consist of " Agmark Insignia " consisting of a design incorporating the number of certificate of authorisation, the word , " AGMARK " , name of the commodity and grade designation resembling the design as set out in schedule- I .

6. Method of packing.-

(1 ) Makhana including power and fried shall be packed in such a manner which shall safeguard the hygienic , nutritional , technological and organoleptic qualities of the product .

(2) The packaging material shall be sound, clean, dry, moisture proof and free from insect infestation or fungal contamination.

(3) The packing material shall be made of substances which are safe and suitable for their intended use, including new clean jute bags, plastic bags , tin plate containers or any other packing material as approved by theAgricultural Marketing Adviser provided that the packing material shall be manufactured out of foodgrade material as permitted under Prevention of Food Adulteration Rules, 1955.

(4) Makhana or Makhana powder or Makhana fried shall be packed in pack sizes in a manner approvedby the Agricultural Marketing Adviser.

(5) Each package shall contain Makhana or Makhana powder or Makhana fried of one grade only.

(6) Each package shall be securely closed and suitably sealed.

(7) Suitable number of consumer packs containing the product of the same grade and from the same lot or batch may be packed in a master container.

7. Method of Marking:-

(1 ) The grade designation mark shall be securely affixed to or printed or stencilled on each container of Makhana, Makhana powder or Makhana fried in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 ofthe General Grading and Marking Rules .

(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked on each container:--

(a) Name of the producing Country,

(b) Name and address of the manufacturer or authorised packer,

(d) Lot or batch number or code number;

*(e) Date of packing ,

(f) Net weight,

(g) Best before . upto month and year,

(h) Maximum retail price (inclusive of all taxes ) ,

(i) Such other particlulars as may be specified by the Agricultural Marketing Adviser from time to time.

*Date of packing shall be date of completion of analysis of samples .

(3) The ink used for marking shall be of such quality which does not contaminate the commodity;

(4) The authorised packer may , after obtaining prior approval of the Agricultural Marketing Adviser or any other officer duly authorised by him in this behalf, in accordance with rule 11 of the General Grading and Marking Rules , mark his private trade mark on the containers provided that the private trade mark does not represent quality or grade of the commodity different from that indicated by the grade designation mark affixed to the container in accordance with these rules.

[PART II- SEC . 3 ( i ) ] 8. Special conditions for grant of certificate of authorisation. In addition to the general conditions specified in sub - rule (8 ) of rule 3 of the General Grading and Marking Rules the following shall be the additional conditions for grant of certificate of authorisation for Grading and Marking of Makhana under these rules, namely :-

(i ) The authorised packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or any officer authorised by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules , for testing the quality of Makhana , Makhana powder and Makhana fried or has access to any approved laboratory for the purpose .

(ii) The premises for processing and packing shall be maintained in perfect hygienic and sanitary conditions;

( iii) The personnel engaged in these operations shall be in sound health and free from any contagious disease .

Makhana shall :-

(1) be the product, derived from mature , dried and sound seeds of the gorgon fruit or fox nut ; "Euryale ferox " of family Nimphacaeae.

(2) be clean, wholesome and of white or cream colour and aroma according to the characteristics of the commodity;

(3) have characteristic and aromatic flavour with sharp and sweet pleasant aroma;

(4) be free from rancid taste , musty odour and normal flavour ;

(5) be free from filth, rodent hair and excreta , mould growth, insect infestation , harmful bacteria, fungus , webs , added colouring matter, toxic substances , obnoxious smell and other impurities except to the extent as indicated in the schedule ;

(6) be free from outer black covering as much as possible;

(7) be safe and suitable for processing for human consumption ;

(8) be in sound merchantable condition and fit for human consumption in all respects ;

(9) not exceed the limit of 30 micrograms of aflatoxin per kilogram;

(10) comply with the restrictions in regard to poisonous metals ( rule 57) , crop contaminants ( rule 57 -A) , naturally occurring toxic substances ( rule 57 -B ) , insecticides and pesticides residue ( rule 65 ) and other provisions prescribed under the Prevention of Food Adulteration Rules , 1955.

Makhana (fried) shall :-

(1 ) be prepared by frying Makhana in an edible frying medium and may be suitably salted, sweetened, spiced or otherwise flavoured;

(2) be crispy for better taste;

(3) be free from rancid taste, musty odour and abnormal flavour;

(4) be free from filth, rodent hair and excreta, mould growth , insect infestation, harmful bacteria, fungus, webs , added colouring matter, toxic substances , obnoxious smell and other impurities except to the extent as indicated inthe schedule;

(5) be in sound merchantable condition and fit for human consumption in all respects;

(6) not exceed limit of 30 micrograms of aflatoxin per kilogram;

Explanation :-

1. Inorganic extraneous matter- means sand, stones , dust , dirt , lumps of earth, gravels, pebbles , clay and mud and metallic pieces .

2. Organic extraneous matter -means weed seeds , chaff, stem , straw and other vegetable matter of the plant .

3. Insect damaged means Makhanacoasted) that are partially or wholly bored or damaged by insects.

4. Damaged and discoloured- means Makhana (roasted) whole or broken, obviously or internally damaged due to heat, microbe, moisture or weather or other causes .

G.S.R. 245. In exercise of the powers conferred by Section 21 of the Railway Protection Force Act , 1957 (23 of 1957 ) , the Central Government hereby makes the following rules further to amend the Railway Protection Force Rules , 1987 , namely :-

1. ( 1 ) These rules may be called the Railway Protection Force ( Amendment ) Rules , 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. (1 ) In the Railway Protection Force Rules , 1987 , hereinafter referred to as the said rules in rule 16, in sub- rule 16.1 , clause ( iii ) shall be omitted.

3. Rule 19 of the said rules shall be omitted.

4. In the Schedule IV to the said rules, the following orders shall be omitted, namely :--

सा. का. नि. 246.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और निम्नलिखित को, सिवाए उन बातों के , जो ऐसे अधिक्रमण से पूर्व की गई हैं या जिनके करने का लोप किया गया है , अधिक्रांत करते हुए, -

(1 ) प्रशिक्षण निदेशालय (अनुदेशकों के लिए केन्द्रीय प्रशिक्षण संस्थान का एकक और उससे संबद्ध आदर्श प्रशिक्षण संस्थान; प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय ; और उन्नत प्रशिक्षण संस्थान , मद्रास ) वर्ग 3 पद भर्ती नियम, 1974 ;

(2) प्रशिक्षण निदेशालय ( अनुदेशकों के लिए केन्द्रीय प्रशिक्षण संस्थान , हैदराबाद का एकक और उससे संबद्ध आदर्श प्रशिक्षण संस्थान ) वर्ग 3 पद भर्ती नियम, 1974;

(6 ) प्रशिक्षण निदेशालय ( अनुदेशकों के लिए केन्द्रीय प्रशिक्षण संस्थान का एकक और उससे संबद्ध आदर्श प्रशिक्षण संस्थान; और प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , कानपुर ) वर्ग 3 पद भर्ती नियम , 1974;

(7 ) प्रशिक्षण निदेशालय ( अनुदेशकों के लिए केन्द्रीय प्रशिक्षण संस्थान का एकक और उससे संबद्ध आदर्श प्रशिक्षण संस्थान; केन्द्रीय कर्मचारीवृंद प्रशिक्षण और अनुसंधान संस्थान; और प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय, कलकत्ता ) वर्ग 3 पद भर्ती नियम , 1974;

(8 ) प्रशिक्षण निदेशालय ( मुख्यालय में वर्ग 3 अननुसचिवीय पद) भर्ती नियम, 1974;

(१ ) प्रशिक्षण निदेशालय , इलैक्ट्रानिकी और प्रक्रिया यंत्रीकरण उन्नत प्रशिक्षण संस्थान ( उत्तरी क्षेत्र ) , देहरादून ( समूह ' ग ' पद ) भर्ती नियम, 1984; और

( 10 ) प्रशिक्षण निदेशालय ( फौरमैन प्रशिक्षण संस्थान, जमशेदपुर का एकक ) समूह ' ग ' पद भर्ती नियम , 1984; जहां तक वे ज्येष्ठ नक्शानवीस, कनिष्ठ नक्शानवीस, कनिष्ठ अनुरक्षण मैकेनिक, कुशल कर्मकार, फोटोग्राफर, सहायक भंडारी/ औजार स्टोर प्रभारी, सिनेमा-सह - पुस्तकालय परिचर, वर्क्सशाप परिचर/औजार स्टोर परिचर, फिटर/ टर्नर/पेंटर/ बढ़ई/मिस्त्री/प्रिंटिंग मशीन परिचर/ मैकेनिस्ट/कंपोजिटर/ बुक बाइंडर/मोडल मेकर/ प्रोजेक्टर परिचर/ वेल्डर, फैरो प्रिंटर और अर्द्धकुशल कर्मकार के पदों से संबंधित हैं ।

श्रम मंत्रालय के रोजगार और प्रशिक्षण महानिदेशालय में कतिपय समूह ' ग ' तकनीकी पदों पर भर्ती की पद्धति को विनियमित करने के लिए, निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्तनाम, विस्तार और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम श्रम मंत्रालय, रोजगार और प्रशिक्षण महानिदेशालय ( समूह ' ग ' तकनीकी पद) भर्ती नियम, 2004 है ।

( 2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

(3) इन नियमों का विस्तार निम्नलिखित एककों पर है , अर्थात्:-

( i ) चेन्नई एकक, जिसमें उन्नत प्रशिक्षण संस्थान, चेन्नई ; केन्द्रीय प्रशिक्षण संस्थान्, चेन्नई; प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , चेन्नई और आदर्श औद्योगिक प्रशिक्षण संस्थान, कालीकट समाविष्ट है ;

( ii ) हैदराबाद एकक , जिसमें उन्नत प्रशिक्षण संस्थान, हैदराबाद; प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , हैदराबाद और इलैक्ट्रानिकी और प्रक्रिया यंत्रीकरण उन्नत प्रशिक्षण संस्थान, हैदराबाद समाविष्ट हैं ;

( iii ) बंगलौर एकक, जिसमें फोरमैन प्रशिक्षण संस्थान, बंगलौर और अपैक्स हाई- टैक संस्थान, बंगलौर समाविष्ट हैं ;

(iv ) मुबई एकक, जिसमें उन्नत प्रशिक्षण संस्थान, मुंबई; और प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , मुंबई समाविष्ट हैं;

(v ) लुधियाना एकक, जिसमें उन्नत प्रशिक्षण संस्थान, लुधियाना; प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , फरीदाबाद और आदर्श औद्योगिक प्रशिक्षण संस्थान , हलद्वानी समाविष्ट हैं ;

(vi ) कानपुर एकक, जिसमें उन्नत प्रशिक्षण संस्थान, कानपुर; प्रादेशिक शिक्षुता प्रशिक्षण निदेशालय , कानपुर और आदर्श औद्योगिक प्रशिक्षण संस्थान, जोधपुर समाविष्ट हैं ;

(vii ) मुख्यालय एकक, जिसमें रोजगार और प्रशिक्षण महानिदेशालय ( मुख्यालय ), नई दिल्ली समाविष्ट है;

(viii ) देहरादून एकक, जिसमें इलैक्ट्रानिकी और प्रक्रिया यंत्रीकरण उन्नत प्रशिक्षण संस्थान, देहरादून समाविष्ट है;

( ix) जमशेदपुर एकक, जिसमें फोरमैन प्रशिक्षण संस्थान, जमशेदपुर समाविष्ट है;

(x ) कोलकाता एकक, जिसमें उन्नत प्रशिक्षण संस्थान, हावड़ा; प्रादेशिक शिक्षुता प्रशिक्षणे निदेशालय , कोलकाता; केंद्रीय कर्मचारिवृंद प्रशिक्षण और अनुसंधान संस्थान , कोलकाता और आदर्श औद्योगिक प्रशिक्षण संस्थान चोडवाड़ ( उड़ीसा) समाविष्ट है;

2. पद- संख्या, वर्गीकरण और वेतनमान उक्त पदों की संख्या, उनका वर्गीकरण और उनसे संबंधित वेतनमान, इन नियमों से संलग्न अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में यथाविनिर्दिष्ट के अनुसार होंगे ।

3. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में यथाविनिर्दिष्ट के अनुसार होंगी ।

4. निरर्हता: वह व्यक्ति-

(क) जिसने ऐस्ने व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा;

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां पर उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रिवायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

परंतु यह कि इस प्रकार अधिक्रांत किए गए नियमों के अधीन की गई कोई बात या कार्रवाई, इन नियमों के अधीन की गई समझी जाएगी । 1510

1. Short title , extent and commencement-( 1 ) These Rules may be called the Ministry ofLabour, Directorate General of Employment and Training ( Group 'C ' Technical Posts) Recruitment Rules , 2004 .

(2) They shall come into force on the date of their publication in Official Gazette .

(3) They shall be applicable to the following units, namely :

( i) Chennai Unit comprising Advanced Training Institute, Chennai ; Central Training Institute , Chennai : Regional Directorate of Apprenticeship Training , Chennai and Model Industrial Training Institute , Calicut.

(ii ) Hyderabad Unit comprising Advanced Training Institute, Hyderabad Regional Directorate of Apprenticeship Training , Hyderabad and Advanced Training Institute for Electronic and Process Instrumentation , Hyderabad .

(iii) Bangalore Unit comprising Foremen Training Institute , Bangalore and Apex Hi -Tech Institute, Bangalore .

( iv) Mumbai Unit comprising Advanced Training Institute , Mumbai and Regional Directorate of Apprenticeship Training , Mumbai .

2. Number of posts , classification and scale of pay ( 1 ) The number of posts , the classification and the scale of pay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said posts , shall be as specified in columns (5) to ( 14 ) of the said Schedule.

4. Disqualification No person-

(a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said posts :

5. Power to relax-Where the Central Government is of opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving Nothing in these rules shall affect reservation , relaxation of the age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- serviemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Provided that anything done or action taken under the rules so superseded, shall be deemed to have been done or taken under these rules .

सा. का. नि. 247.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारत सरकार लेखन सामग्री कार्यालय और प्रादेशिक लेखन सामग्री डिपो ( वर्ग III पद ) भर्ती नियम, 1974 को , जहां तक वे आशुलिपिक के पद से संबंधित हैं, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है, शहरी विकास और गरीबी उन्मूलन मंत्रालय, भारत सरकार लेखन सामग्री कार्यालय और प्रादेशिक लेखन सामग्री डिपो में आशुलिपिक ( श्रेणी III ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम , भारत सरकार लेखन सामग्ग्री कार्यालय और प्रादेशिक लेखन सामग्री डिपो आशुलिपिक ( श्रेणी III ) भर्ती नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

2. पद संख्या, वर्गीकरण और वेतनमान:- उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध

उक्त पद पर भर्ती की पद्धति , आयु सीमा, अर्हताएं और उनसे 3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. शिथिल करने की शक्ति:-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति: - इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 247. In exercise of the powers conferred by the provisoto Article 309 of the Constitution and in supersession of the Government of India Stationery Office and Regional Stationery Depot ( Class III posts ) Recruitment Rulcs , 1974 , in so far as they relate to the post of Stenographer, except as respects thingsdone or omitted to be done before such supersession , the President hereby makes the following rules régulating the method of recruitment to the postof Stenographer ( Grade III ) in the Government of India Stationery Office and Regional Stationery Depots , Ministry of Urban Development and Poverty Alleviation , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Government of India Stationery Office and Regional Stationery Depots Stenographer (Grade III) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of posts , its classification and the scale of pay attached thereto shall be as specified in columns ( 2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications , etc. The method of recruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14 ) of the said Schedule.

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post .

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so todo, it may. by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard .
