पी. के . मित्रा महाप्रबन्धक सं. पेंशन/विविध/2004 बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण) अधिनियम , 1970 ( 1970 का 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पंजाब नैशनल बैंक का निदेशक मंडल , भारतीय रिज़र्व बैंक से परामर्श करके तथा केन्द्रीय सरकार की पूर्व मंजूरी से पंजाब नैशनल बैंक अधिकारी ( कर्मचारी ) पेंशन विनियम , 1995 में पुनः संशोधन हेतु एतद्‌द्वारा , निम्नलिखित विनियम बनाता है , अर्थात्:

इण्डियन ओवरसीज बैंक केन्द्रीय कार्यालय

1. ( 1) ये विनियम पंजाब नैशनल बैंक ( कर्मचारी ) पेंशन (संशोधन ) विनियम, 2004 ।

चेन्नई, दिनांक 30 जुलाई 2004 2. (2 ) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।

2. पंजाब नैशनल बैंक ( कर्मचारी ) पेंशन विनियम, 1955 में,

(क) विनियम 2 के उप - विनियम ( ध ) के लिए खण्ड ( ख ) में उप खण्ड ( ii ) के बाद निम्नलिखित उप - खण्ड शामिल किया जाएगा: अर्थात्:

सं. औ.सं.वि./184/125/2004-05--बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम, 1970 ( 1970 का 5 ) की धारा 12 की उप - धारा 2 के साथ पठित , धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इण्डियन ओवरसीज़ बैंक का निदेशक मण्डल , भारतीय रिज़र्व बैंक से परामर्श करके तथा केन्द्र सरकार की पूर्व मंजूरी से इण्डियन ओवरसीज़ बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम 1976 में संशोधन करने हेतु एत‌द्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-- "( iv) 1960 = 100 श्रृंखला में औद्योगिक कामगारों के लिए अखिल भारतीय औसत उपभोक्ता मूल्य सूचकांक में सूचकांक के 1148 अंकों तक परिकल्पित मंहगाई भत्ता,"

1. संक्षिप्त शीर्षक एवं प्रारम्भ ( 1 ) ये विनियम इण्डियन ओवरसीज़ बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) ( संशोधन ) विनियम, 2004 कहलाएंगे । ( 2 ) ये विनियम ' सरकारी राजपत्र ' में अपने प्रकाशन की तारीख से लागू होंगे ।

(ख) विनियम 41 में उप - विनियम ( 6 ) के लिए, निम्नलिखित उप- विनियम प्रतिस्थापित किया जाएगा,अर्थात्:

2. इण्डियन ओवरसीज़ बैंक अधिकारी कर्मचारी (अनुशासन एवं अपील) विनियम, 1976 में , विनियम 17 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, अर्थात्:--

" (6 ) जो आवेदक अधिवर्षिता पेंशन या स्वैच्छिक सेवानिवृत्ति पेंशन या समयपूर्व सेवानिवृत्ति पेंशन या अनिवार्य सेवानिवृत्ति पेंशन या अशक्त पेंशम या अनुकम्पा भत्ता के लिए प्राधिकृत है, वह इन विनियमों के अंतर्गत अपनी पेंशन के एक हिस्सेको संराशीकृत करने का पात्र होगा;

" 17 अपील ( 1 ) एक अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दण्ड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ, आदेश मिलने की तारीख से पैतालीस दिनों के भीतर अपील प्राधिकारी को अपील कर सकता है।

परन्तु, यदि अपील प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधिके समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है । परन्तु, 1.7.2003 को या से , जिस आवेदक के मामले में पेंशन का संराशीकृत मूल्य उसकी सेवानिवृत्ति की तारीख के अगले दिन या संराशीकरण पूर्ण होने की तारीख से देय होता है , संराशीकरण के कारण पेंशन की रकम में कमी उसके प्रारम्भ कीतारीख से ही लागू होगी । तथापि, जहां संराशीकृत पेंशन की रकम का भुगतान , यथास्थिति सेवानिवृत्ति की तारीख से पहले माह या संराशीकरण पूर्ण होने की तारीख से पहले माह के भीतर नहीं होता है वहां मासिक पेंशन और संराशीकृत पेंशन के अंतर का भुगतान, यथास्थिति, सेवानिवृत्ति की तारीख के अगले दिन से या संराशीकरण पूर्ण होने की तारीख से, जिस तारीख को संराशीकृत पेंशन को प्रदत्त मामा गया है, उससे पिछली तारीख तक किया जाएगा । "

(2 ) अपीलकर्ता द्वारा अपील प्राधिकारी को अपील प्रस्तुत की जाएगी, जिसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी, जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था । इस अपील में पूरी विवरण सामग्री एवं बहस के वे मुद्दे होंगे जिम पर अपीलकर्ता निर्भर करता है परन्तु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी ।

पाद टिप्पणी : मूल विनियम भारत के राजपत्र में दिनांक 29.9.1995 को ( असाधारण ) प्रकाशित हुए थे तथा परवर्ती संशोधन राजपत्र में निम्नानुसार प्रकाशित हुए :

( 3 ) निर्णय के विरुद्ध अपील करने का आदेश देने वाला प्राधिकारी अपीलकर्ता से अपील की प्राप्ति होने पर उसे, अपने टिप्पणियों और भाग III-खण्ड 4]

संबंधित रिकॉर्ड के साथ , अपील प्राप्त होने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अग्रेषित करेगा ।

(4 ) निर्णय के विरूद्ध अपील करने का आदेश देने वाले प्राधिकारी से मामले पर टिप्पणियां एवं रिकार्ड प्राप्त होने पर, अपील प्राधिकारी विचार करेगा कि क्या स्थगन आदेश/निष्कर्ष न्यायसंगत है या क्या दण्ड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेंगा । अपील प्राधिकारी दण्ड / निलंबन की पुष्टि करने , उसमें वृद्धि करने, कमी करने या उसे अलग रखने का आदेश पारित कर सकता है या मामले को, मामले की परिस्थितियों में उचित समझे गए निदेशों सहित , जिस अधिकारी ने दण्ड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।

परन्तु,

( i ) यदि बढ़ाया हुआ दण्ड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है , विनियम 4 के खंड ( च ) , ( छ) , ( ज) , (झ ) और ( अ ) में उल्लिखित अनुसार, कोई बड़ा दण्ड है और विनियम 6 में दिए गए अनुसार मामले में पहले कोई जांच नहीं की गई है तो अपील प्राधिकारी निदेश देगा कि विनियम 6 के प्रावधानों के अनुसार मामले की ऐसी जांच की जानी चाहिए और उसके पश्चात् जांच के रिकार्ड पर विचार-विमर्श करेगा तथा जैसा वह उचित समझे , आदेश पारित करेगा;

( ii ) यदि अपील प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परंतु विनियम 6 में दिए गए अनुसार जांच पहले ही की जा चुकी है, तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उस पर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो , को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।

(5 ) अपील प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर उसका निपटान करेगा :

परन्तु, इस विनियम में उल्लिखित समय- सीमा उन मामलों में लागू नहीं होगी जो सतर्कता से संबंधित हों और जहां अधिकारी कर्मचारी के विरूद्ध छोटी बड़ी दण्ड कार्रवाई, मामले की जांच कर रही पुलिस या केन्द्रीय जांच ब्यूरो या केन्द्रीय सतर्कता आयोग, जैसा भी मामला हो, द्वारा की गई सिफारिशों पर आरम्भ की गई हो । (6) 90 दिनों से अधिक समय तक लंबित मामलों की अपील प्राधिकारी द्वारा आवधिक रूप से समीक्षा की जाएगी और मामलों को निपटाए न जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

टिप्पणी : इण्डियन ओवरसीज बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम , 1976 में पहले किए गए संशोधन राजपत्र में निम्नलिखित विवरण के अनुसार प्रकाशित किए गए थे :

सं. 1281/पीडी: आइआरडी ( ओ )/0089/विनियम 17- बैंककारी कंपनी (उपक्रमों का अर्जन और अंतरण ) अधिनियम, 1970 ( 1970 का 5 ) की धारा 12 की उप- धारा 2 के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सिंडीकेट बैंक का निदेशक मण्डल, भारतीय रिज़र्व बैंक से परामर्श करके और केन्द्र सरकार की पूर्व मंजूरी से सिंडीकेट बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम 1976 में आगे संशोधन करने हेतु एत‌द्वारा निम्नलिखित विनियम बनाता है, अर्थात्: --

1. संक्षिप्त शीर्षक एवं प्रारम्भ ( 1 ) ये विनियम सिंडीकेट बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) ( संशोधन ) विनियम , 2004 कहलाएंगे ।

(2) ये विनियम ' सरकारी राजपत्र ' में अपने प्रकाशन की तारीख से लागू होंगे ।

2. सिंडीकेट बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम, 1976 में , विनियम 17 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्: --

" 17 अपील ( 1 ) एक अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए किसी भी दण्ड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ , आदेश मिलने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अपील कर सकता है।

परन्तु, यदि अपील प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है।

(2) अपीलकर्ता द्वाराअपील प्राधिकारी को अपील प्रस्तुत की जाएगी , जिसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी , जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था । इस अपील में पूरी विवरण सामग्री एवं बहस के वे मुद्दे होंगे जिन पर अपीलकर्ता निर्भर करता है परन्तु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी । 3788

क्षेत्रीय कार्यालय , कर्मचारी राज्य बीमा निगम ई. एस. आई. अस्पताल कॉम्पलैक्स सैक्टर-2 , परवाणू ( हि. प्र. ) परवाणू, दिनांक 27 जुलाई 2004 ( i ) यदि बढ़ाया हुआ दण्ड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है, विनियम 4 के खंड ( च ) , ( छ) , (ज ) , (झ) और ( अ ) में उल्लिखित अनुसार, कोई बड़ा दण्ड है और विनियम 6 में दिए गए अनुसार मामले में पहले कोई जांच नहीं की गई है तो अपील प्राधिकारी निदेश देगा कि विनियम 5 के प्रावधानों के अनुसार मामले की ऐसी जांच की जानी चाहिए और उसके पश्चात् जांच के रिकार्ड पर विचार- विमर्श करेगा तथा जैसा वह उचित समझे, आदेश पारित कहेगा;

सं. हि. प्र. 14.वी.34/ 13/ 1 /86 - प्रशा. कर्मचारी राज्य बीमा (सामान्य) विनियम 1950 के विनियम 10 -ए के अंतर्गत दी गई शक्तियों का प्रयोग करते हुए अध्यक्ष , क्षेत्रीय बोर्ड हिमाचल प्रदेश मे बरोटीवाला और बद्दी क्षेत्र ( जहां कर्मचारी राज्य बीमा अधिनियम 1948 का अध्याय 4 व 5 पहले से ही लागू हैं ) की स्थानीय समिति का गठन किया है । इस समिति में निम्नलिखित सदस्य होंगे । यह समिति अधिसूचना जारी होने की तारीख से प्रभावी होंगी ।

( ii ) यदि अपील प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परंतु विनियम 5 में दिए गए अनुसार जांच पहले ही की जा चुकी है, तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उस पर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन , यदि कोई हो , को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।

(b) In regulation 41 , for sub -regulation (6), the following sub -regulation shall be substituted, namely: -

"(6) An applicant who is anthorized a superannuation pension or voluntary retirement pension or premature retirement pensiion or compulsory retirement pension or invalid pension or compassionate allowance shall be eligible to commute a fraction of his pension under these regulations;

Provided that on and from 1.7.2003 , in case of an applicant in whose case, the commuted value of pension becomes payable on the day following the date ofhis retirement or from the date from which the commutation becomes absolute, the reduction in the amount ofpension on account of commutation shall become operative from its inception. Where , however, payment of commuted value of pension could not be made within the first month after the date of retirement or within the first month after the date when the commutation becomes absolute as the case may be , the difference between the monthly pension and the commuted pension shall be paid for the period between the date following the date of retirement or the date when the commutation becomes absolute , as the case may be , and the date preceding the date on which commuted value of pension is deemed to have been paid . (2) They shall come into force on the date of their publication in the Official Gazette .
