का.नि.आ. 124.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय आर्डिनेंस फैक्टरी समूह ' ग ' और ' घ ', अनौद्योगिक कर्मचारी काडर ( भर्ती और सेवा शर्तें ) नियम, 1989 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, पद पर भर्ती की पद्धति का विनियमन करने के लिये निम्मलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय आर्डिनेंस फैक्टरी पर्ववैक्षक ( भंडार ) और भण्डारी ( समूह ' ग ' और अनौद्योगिक काडर ) ( भर्ती और सेवा की शर्तें ) भर्ती नियम, 2003 है। (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. लागू होना. ये इन नियमों से संलग्न अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद संख्या, वर्गीकरण और वेतनमान - उक्त पद की संख्या, उनका वर्गीकरण और उनके वेतनमान वै होंगें , जी उक्त अनुसूची के स्तंभ 2, 3 और 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ (5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, बिबाह किया है , या

(ख ) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी।

6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति -इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रिवायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्यं विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 ---स्तंभ 2 में उपदर्शित पदों की संख्या में कार्यभार के आधार पर परिवर्तन किया जा सकता है और केन्द्रीय सरकार द्वारा पदों की और मंजूरी के या केन्द्रीय सरकार या आर्डेनेंस फैक्टरी बोर्ड द्वारा पदों के किसी समायोजन के आधार पर परिवर्तन किया जा सकता है । 328

JPART II- SEC. 4] टिप्पण 2- स्तंभ 7 के अधीन उपद‌र्शित आयु सीमा भारत सरकार द्वारा जारी किए गए अनुदेशों या आदेशों के अनुसार सभी सरकारी सेवकों के लिए शिथिल की जा सकती है ।

टिप्पण 3 -जहां मानत्र शक्ति के पुनर्नियोजन आवश्यक हो चाहे कृत्यिक अपेक्षाओं के कारण या बहुकुशलता या किसी अन्य कारणों से जिन्हें लिखित में निर्दिष्ट किया जाए वहां अध्यक्ष, आर्डिनेंस फैक्टरी बोर्ड को पुनर्नियोजन की पद्धति द्वारा ऐसे पुनर्नियोजन के समतुल्य रूप में पद घोषित किए जाने के लिए अधिकृत किया जाता है ।

टिप्पण 4- इस अनुसूची के स्तंभ 12 में अधिकथित प्रतियोगिता परीक्षण/परीक्षा , परीक्षा/परीक्षण को संचालित करने के प्रकार महाप्रबंधक, फैक्टरी या आर्डिनेंस फैक्टरी बोर्ड द्वारा विहित किया जाएगा ।

टिप्पण 5- इस अनुसूची के स्तंभ 12 में उपदर्शित प्रोन्नति स्तंभ 12 में उपदर्शित पोषक प्रवर्ग से ही होगी लेकिन जहां आर्डिनेंस फैक्टरी बोर्ड द्वारा दो या अधिक श्रेणियों " पोषक प्रवर्ग " घोषित किए गए हों वहां चयन या प्रोन्नति पोषक प्रवर्ग के पात्र व्यक्तियों की समान ज्येष्ठता सूची से किया जाएगा । टिप्पण 6- इन नियमों में " समतुल्य पद " शब्द या इसके पदों से उसी या समरूप वेतनमान में कोई पद उसी या किसी अन्य प्रवर्ग से अभिप्रेत है । पदों को आर्डिनेंस फैक्टरी बोर्ड द्वारा " समतुल्य " के रूप में विशिष्टतया घोषित किया जाना चाहिए ।

टिप्पण 7- इस अनुसूची के स्तंभ 8 के अधीन विहित अर्हताओं के संबंध में इस प्रश्न का विनिश्चय कि क्या कोई अर्हता किसी पद के लिए विहित अर्हता के समतुल्य है आर्डिनेंस फैक्टरी बोर्ड द्वारा किया जाएगा ।

टिप्पण 8- इस अनुसूची के स्तंभ 8 के अधीन विहित अर्हताओं के संबंध में कोई प्रश्न कि क्या किसी के लिए अर्हता निहित अर्हता के समतुल्य है का विनिश्चय आर्डिनेंस फैक्टरी बोर्ड द्वारा किया जाएगा ।

टिप्पण 9- इन नियमों के प्रयोजनों के लिए, आर्डिनेंस फैक्टरी बोर्ड उसके ओर से किसी या सभी शक्तियों का प्रयोग करने के लिए बोर्ड के किसी सदस्य या आर्डिनेंस फैक्टरी का अपर महाप्रबंधक, को प्राधिकृत कर सकता है और ऐसी शक्तियों का प्रयोग उक्त बोर्ड द्वारा किया गया समझा जाएगा । टिप्पण 10- इन नियमों में " फैक्टरी का महाप्रबंधक " पद और इसके रूपभेदों के अन्तर्गत ज्येष्ठ महाप्रबंधक, अपर महाप्रबंधक और निदेशक स्टाफ कालेज तथा अन्य स्थापनों के अध्यक्ष भी हैं, जिन्हें आर्डनेंस फैक्टरी बोर्ड द्वारा फैक्टरी के महाप्रबंधक के समतुल्य घोषित किया गया है । टिप्पण 11- जहां किसी श्रेणी/ श्रेणियों के समूहों में पदों की संख्या कृत्यिक आधार पर अपेक्षित है वहां आर्डिनेंस फैक्टरी बोर्ड द्वारा उन्हें विभिन्न व्यवसायों में बांटा जा सकता है । विभिन्न व्यवसायों की भर्ती/प्रोन्नति के लिए अर्हताओं की पहचान और अन्य पात्रता मानदंड आर्डिनेंस फैक्टरी बोर्ड द्वारा बनाया जाएगा । जहां पदों को विभिन्न व्यवसायों में पदानुक्रम , प्रोन्नति में बंटा हुआ है वहां आर्डिनेंस फैक्टरी बोर्ड द्वारा व्यवसाय बार स्तर विनिश्चित किया जाएगा

टिप्पण 12- एक ही वेतनमान में कुल पदों की संख्या में बोर्ड द्वारा समय - समय पर कार्यभार में परिवर्तन और कृत्यिक अपेक्षाओं के आधार पर विभिन्न पदाभिधानों और नामों या किसी वेतनमान के अधीन पदों में वृद्धि और कमी की जा सकती है ।

टिप्पण 13- इस अनुसूची के स्तंभ 7 में जहां आयु सीमा अधिकथित है, वहाँ आयु- सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से ( उनसे भिन्न जो अंदमान और निकोबार द्वीप तथा लक्षद्वीप में है ) आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ऐसे पदों की बाबत जिस पर नियुक्ति रोजगार कार्यालयों के माध्यम से की जाती है आयु- सीमा अवधारित करने के लिए निर्णायक तारीख प्रत्येक मामले में वह अंतिम होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा जाता है ।

टिप्पण 14-अनुसूची में उपनिर्दिष्ट पद फैक्टरी /यूनिट आधारित पद हैं और सभी प्रोन्नतियां /फैक्टरी के पोषक श्रेणियों/ आधारित ज्येष्ठता से की जाएंगी। अनुसूची उपनिर्दिष्ट पदों के पदधारी , आर्डिनेंस फैक्टरी संगठन के समान फैक्टरी या कार्यालय में सेवा करने के लिए सामान्यतया दायित्वाधीन होंगे, किन्तु इससे प्रबंधन कि इस अधिकार पर कि वह लोकहित में, उन्हें आर्डिनेंस फैक्टरी संगठन के किसी फैक्टरी या कार्यालय में समतुल्य पदों पर स्थानांतरित कर सकता है, प्रतिकूल प्रभाव नहीं पड़ेगा ।

टिप्पण 15- सीमित विभागीय प्रतियोगिता परीक्षा ( सीमित विभागीय प्रतियोगिता परीक्षा ) पद केवल फास्ट ट्रैक प्रोन्नति की पद्धति है । इस प्रभार सीमित विभागीय प्रतियोगिता परीक्षा के माध्यम से की गई नियुक्ति सभी प्रयोजनों के लिए प्रोन्नति के रूप में समझी जाएगी ।

S.R.O. 124. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in super- session of the Indian Ordnance Factories Group ' C ' and ' D ' Non - industrial Employees Cadre (Recruitment and Conditions of Service) Rules , 1989 except as respect thing done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Supervisor ( Stores ) and Store Keeper belonging to the Non - industrial cadre in Ordnance and Ordnance Equipment Factories and other offices and Establishment under the Ordnance Factories Organisation, except the Ordnance Factory Board Head Quarter Establishment .

1. Short title and commencement.-( 1 ) These rules may be called the " Ordnance Factories , Supervisor (Stores) and Store Keeper ( Group ' C ' Non - industrial Cadre ) (Recruitment and Conditions of Service) Rules , 2003 "

(2) They shall come into force on the date of their Publication in the Official Gazette.

2. Application. These rules shall apply to the posts specified in column 1 ofthe schedule annexed to these rules .

3. Number, classification and scale of pay. The number of the said posts , their classification and the scale of payattached thereto are indicated in columns 2 , 3 and 4 respectively of the said schedule .

4. Method of appointment , age limit , qualification etc. The method of appointment to the said posts , age limit, qualifications and other matters connected therewith shall be as specified in Columns 5 to 14 of the said schedule.

5.Disqualification.- No person, -

(a) Who has entered into or contracted a marriage with a person having a spouse living; or

(b) Who having a spouse living , has entered into or contracted a marriage with a person ,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that the marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these Rules .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of the age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- servicemen , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The tests may include written, practical examination, aptitude test etc. as prescribed by General Manager/ Ordnance Factory Board.

Note5:Promotion indicated in Col. 12 of this schedule will only be from feeder (s) grade indicated in Col. 12. But where two ormore feeder grades are declared to be " feeder grades " by Ordnance Factory Board , selection or promotion will be made from common seniority list of eligible persons in the feeder grades .

Note 6 : The words ' equivalent posts ' and its variants in these rules will mean any post in same or identical scale of pay as another post in the same or another category. The post have to be specifically declared as 'Equivalent ' by Ordnance FactoryBoard.

Note 7 : In relation to prescribed qualifications under Column 8 of this Schedule the question whether a qualification is equivalent to the prescribed qualification for any post shall be decided by the Ordnance Factory Board.

Note8: Ordnance Factory Board shall issue suitable clarifications regarding interpretations of provisions of rules and shall also issue suitable guidelines and instructions for proper implementation of provisions of rules .

Note 9 : For the purpose of these rules, the Ordnance Factories Board may authorize any Member of the Board or an Additional Director General Ordnance Factories to exercise any or all of its powers on its behalf and it shall be deemed to have been exercised by the said Board.

Note10: In these rules the term " General Manager of the Factory" and its variations shall include Senior General Manager, Additional General Manager and Heads of other establishments declared by Ordnance Factories Board to be equivalent to General Manager of Factory.

Note 11 : Wherever required on functional grounds the number of posts in any grade/group of grades can be divided in different trades by Ordnance Factory Board . Identification of qualification and other eligibility criteria for recruitment/ promotion to different trades shall be made by Ordnance Factory Board . Where posts are divided in different trades in a hierarchy, promotions will be made trade wise to the level decided by Ordnance Factory Board.

Note 12 : In the exigencies of the service within the total number of posts in the same scale of pay, the Ordnance Factories Board may add to the categories or sub -divide or merge any category or add to and reduce number of posts in different categories on same scale of pay, from time to time , on the basis of changes in functional requirements . Ordnance Factory Board may also add number of posts in the lower pay scale by reducing same number of posts in the higher scale .

[PART II- SEC . 4] Note 13 : Wherever any age limit is laid down in Col. 7 of this schedule the crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India (other than from Andaman and Nicobar Islands and Lakshadweep). का.नि.आ. 129.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सैनिक इंजीनियर सेवा (सहायक, उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक ) भर्ती नियम , 1999 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , सैनिक इंजीनियर सेवा ( सहायक , उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिये निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सैनिक इंजीनियर सेवा ( समूह ' ग ' सहायक, उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक) भर्ती नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.-ये नियम इससे उपाबद्ध अनुसूची में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 2. ऐसे आशुलिपिक श्रेणी III ( 4000-6000 रु. ) के संबंध में भी, जिन्होंने उस श्रेणी में सात वर्ष नियमित सेवा की है और जिन्होंने पहले नियत तारीख अर्थात् 29 मार्च, 1985 तक लिपिकीय काडर के लिए विकल्प किया था, तब तक प्रत्येक समय पर 10 प्रतिशत रिक्त पदों के लिए विचार किया जाएगा, जब तक कि ऐसे सभी विकल्पकर्ता प्रोन्नत नहीं हो जाते । तथापि रक्षा मंत्रालय के पत्र सं. 85601 /16/.. V/सी.पी.सी./5/सी.एस.सी.सी. /1374/डी( वर्क्स ) तारीख 15 अप्रैल, 1998 और सं. 85601 / 16/V/सी.पी.सी./5/सी.एस.सी.सी. /721/डी( वर्क्स ) तारीख 16 फरवरी, 1999 द्वारा एकल अध्युपाय के रूप में समान संख्या में उच्च श्रेणी लिपिक के पदों के उन्नयन द्वारा सृजित 418 पदों के प्रारंभ में भरे जाने के समय 10 प्रतिशत कोटा आशुलिपिक श्रेणी III को उपलब्ध नहीं होगा ।

रक्षा सेवा के, जिसके अंतर्गत रक्षा मंत्रालय का मुख्य सचिवालय भी है सिविल पदों में समरूप, समतुल्य या उच्चतर श्रेणियों में कार्यरत ऐसे व्यक्ति जिनके पास स्तंभ 8 में सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं हैं।

विभागीय अर्हता परीक्षा के माध्यम से 10 प्रतिशत समूह ' घ ' मैट्रिकुलेट अनौद्योगिक कर्मचारियों के लिए प्रोन्नति द्वारा , जिसके न हो सकने पर आमेलन द्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

10 प्रतिशत भूतपूर्व सैनिक ( केन्द्रीय सेवा और पदों में पुनर्नियोजन ) नियम, 1979 के अनुसार प्रतिनियुक्ति/ पुनर्नियोजन द्वारा ( भूतपूर्व सैनिक के लिए ) , जिसके न हो सकने पर आमेलन द्वारा , दोनों के न हो सकने परसीधी भर्ती द्वारा ।

5 प्रतिशत समूह ' घ ' मैट्रिकुलेट अनौद्योगिक कर्मचारियों के लिए प्रोन्नति द्वारा , जिसके न हो सकने पर आमेलन द्वारा, दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

सशस्त्र बल कार्मिकों के लिए:

प्रतिनियुक्ति/पुनर्नियोजन ( 10 प्रतिशत )

सशस्त्र बल के ऐसे कार्मिक जिसमें इंजीनियर कोर के योधक सम्मिलित हैं, की पंक्तिके कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधिके भीतर सेवानिवृत्त होने वाले हैं या रिज़र्व में स्थानांतरित किए जाने वाले हैं और जिनके पास स्तंभ 8 के अधीन विहित अपेक्षित शैक्षिक अर्हताएं और अनुभव हैं, परविचार किया जाएगा। यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र [PART. बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । उसके पश्चात् 3050-4590 रु . के आरंभिक श्रेणी के सिविलियन कर्मचारियों के रूप में पुनर्नियोजित किया जा सकता है ।

टिप्पण 1. अनौद्योगिक समूह ' घ ' कर्मचारियों में प्रोन्नति द्वारा भर्ती किसी वर्ष में होने वाले अवर श्रेणी लिपिक के काडर में के रिक्त पदों के 15 प्रतिशत से अधिक नहींहोगी भरी न गई रिक्तियां अग्रनीत नहीं की जाएंगी । ऐसे रिक्त पद आमेलन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा भरे जाएंगे ।

टिप्पण 2. जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा है वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर लीहो ।

S.R.O. 129. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Military Engineer Services (Assistant , Upper Division Clerk and Lower Division Clerk ) Recruitment Rules 1999 , except as respect thing done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment for the post of Assistant, Upper Division Clerk and Lower Division Clerk in theMilitary Engineer Services , namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Military Engineer Services Group C (Assistant, Upper Division Clerk and Lower Division Clerk ), Recruitment Rules , 2004.

(2) They shall come into force on the date of their Publication in the Official Gazette.

2. Application. These rules shall be applicable to the post ( s ) as specified in the Schedule annexed to these rules .

3. Number of post , classification and scale of pay.- The number of the said posts , their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

4. Method of Recruitment , age limit and other qualifications , etc.-The method of recruitment , age limit and other matters relating to the said posts shall be as specified in Columns 5 to 14 of the Schedule aforesaid .

5. Disqualification. No person,-

339 (a) Who has entered into or contracted a marriage with a person having a spouse living ; or

(6) Who having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that the marriage is permissible under the Personal Law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these Rules.

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations, relaxation of the age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , the Other Backward Classes , Ex- servicemen, and other special categories of persons in accordance with the orders issuedby the Central Government from time to time in this regard.

का.नि.आ. 130.-केन्द्रीय सरकार, तटरक्षक अधिनियम , 1978 ( 1978 का 30 ) की धारा 123 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तटरक्षक ( साधारण ) नियम , 1986 कां और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्ः-

1. ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक ( साधारण ) संशोधन नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. तटरक्षक (साधारण ) नियम, 1986 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 7 में,-

(1) खंड ( क) में- ( i ) मद ( iv ) के पश्चात् निम्नलिखित मद अंतःस्थापित की जाएगी, अर्थात्: -

" (v) कमांडेंट ( कनिष्ठ श्रेणी) ;"

(ii) इस प्रकार अंतःस्थापित मद ( v ) के पश्चात् शेष मदों को क्रमशः " ( vi ) " और " (vii) " के रूप में पुनः संख्यांकित किया जाएगा;

(2) खंड ( ख ) में, मद ( iii ) के स्थान पर निम्नलिखित मद अंतःस्थापित की जाएगी, अर्थात्: -

" ( iii ) अधिकारी/सहायक इंजीनियर/प्रधान यांत्रिक; "

(3 ) खंड ( ग ) में, मद ( i ) के स्थान पर निम्नलिखित मद अंतःस्थापित की जाएगी, अर्थात्: -

"( i ) प्रधान नाविक; "

3. उक्त नियमों के नियम 9 की सारणी में, खंड ( ख ) के सामने " विशेषज्ञता " से संबंधित स्तंभ ( 2 ) में,-

(1) मद ( 1 ) में, " नाविक " और " मैकेनिक " शब्दों के बीच " पूर्ति सहायक " शब्दअंतःस्थापित किए जाएंगे ।

(2) मद ( ii ) में, " पूर्ति सहायक " शब्दों का लोप किया जाएगा ।

4. उक्त नियमों के नियम 21 की, सारणी में " सक्षम प्राधिकारी " से संबंधित स्तंभ 1 में " महानिरीक्षक " शब्दों के स्थान पर " उप महानिदेशक" शब्द रखे जाएंगे ।

5. उक्त नियमों के नियम 23 में-

(1) उपनियम ( 1 ) , उपनियम ( 3 ) , उपनियम (4 ) और उपनियम ( 5 ) में आने वाले " तटरक्षक मुख्यालय में महानिरीक्षक " शब्दों के स्थान पर " तटरक्षक मुख्यालय में उप महानिदेशक " शब्द रखे जाएंगे ।

(2) उपनियम (5) में हिंदी में कोई त्रुटि नहीं है ।

6. उक्त नियमों के नियम 24 के उपनियम ( 1 ) और उपनियम ( 3 ) में " तटरक्षक मुख्यालय में महानिरीक्षक " शब्दों के स्थान पर " तटरक्षक मुख्यालय में उप महानिदेशक " शब्द रखे जाएंगे ।

7. नियम 25 " तटरक्षक मुख्यालय में महानिरीक्षक " शब्दों के स्थान पर " तटरक्षक मुख्यालय में उप महानिदेशक " शब्द रखे जाएंगे । 8. उक्त नियमों के नियम 28 के उपनियम ( 4 ) और उपनियम ( 5 ) में " तटरक्षक मुख्यालय में महानिरीक्षक" शब्दों के स्थान पर " तटरक्षक मुख्यालय में उप महानिदेशक " शब्द रखे जाएंगे ।

9. उक्त नियमों के नियम 27 में-

(1) उपनियम (2 ) में, -

(i ) " केन्द्रीय सरकार " शब्दों के पश्चात् " या उप महानिदेशक " शब्द जोड़े जाएंगे

(i ) " केन्द्रीय सरकार के विवेक " शब्दों के स्थान पर " यथास्थिति केन्द्रीय सरकार या उप महानिदेशक के विवेक " शब्द रखे जाएंगे । [ भाग II - खण्ड 4 ]

(2) उपनियम ( 3 ) में " तटरक्षक मुख्यालय में महानिरीक्षक " शब्दों के स्थान पर " तटरक्षक मुख्यालय में उप महानिदेशक " शब्द रखे जाऐंगे ।

(3) उपनियम (4) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्: -

" (4 ) अनुकंपा के आधार पर सेवोन्मुक्ति, सेवा से निर्मुक्ति या सेवानिवृत्ति के आवेदन को कमान अधिकारी द्वारा क्षेत्रीय कमांडर के माध्यम से तटरक्षक मुख्यालय को और आवश्यक कार्रवाई के लिए अग्रेषित किया जाएगा । "

10. उक्त नियमों के नियम 27 के पश्चात् निम्नलिखित नए नियम अंतःस्थापित किए जाएंगे, अर्थात्: -

" 27क पद त्याग-( 1 ) अधिनियम के अध्यधीन किसी व्यक्ति को अपनी नियुक्ति से त्याग पत्र देने या अपनी नियुक्ति के कर्तव्यों से स्वयं को वापस लेने का अधिकार नहीं होगा । किंतु इस संबंध में वह तटरक्षक मुख्यालय में यथास्थिति उप महानिदेशक या महानिदेशक या केन्द्रीय सरकार को उचित माध्यम से एक आवेदन प्रस्तुत कर सकेगा । उसे उसके कर्तव्यों से तब तक निर्मुक्त नहीं किया जाएगा जब तक कि केन्द्रीय सरकार या केन्द्रीय सरकार द्वारा सशक्त प्राधिकारी ने उसका त्यागपत्र स्वीकार न कर लिया हो । ( 2 ) तटरक्षक का कोई सदस्य विहित प्राधिकारी द्वारा उसके त्यागपत्र के आवेदन को स्वीकार किए जाने से पूर्व अपने आवेदन पत्र की वापसी के लिए आवेदन कर सकेगा । केन्द्रीय सरकार या केन्द्रीय सरकार द्वारा सशक्त प्राधिकारी अपने विवेक पर ऐसे आवेदन पत्र की वापसी अनुदत्त कर सकेगा ।

" 27ख. सेवोन्मुक्ति प्रमाण पत्र ( 1 ) इस अधिनियम की धारा 12 के उपबंधों के अधीन प्रस्तुत किए जाने के लिए अपेक्षित किसी प्रमाणपत्र को इसमें इसके पश्चात् सेवोन्मुक्ति प्रमाण पत्र कहा गया है ।

( 2 ) सेवोन्मुक्ति प्रमाण पत्र कमान अधिकारी द्वारा या उसकी ओर से ऐसे अभ्यावेशित व्यक्ति को, जो तटरक्षक से सेवानिवृत्त होता है या सेवोन्मुक्त होता है.या निर्मुक्त होता है या हटाया जाता है या पदच्युत होता है या जिसे त्यागपत्र देने के लिए अनुज्ञा दी गई है , व्यक्तिगत रूप से परिदत्त करके या उस व्यक्ति को रजिस्ट्रीकृत डाक द्वारा संप्रेषित करके प्रस्तुत किया जा सकेगा । " 11. उक्त नियमों के नियम 28 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

" 28. तटरक्षक न्यायालय के दंडादेश द्वारा या अधिनियम की धारा 57 के अधीन से अन्यथा वह तारीख जिससे सेवानिवृत्ति, पदच्युति, सेवा से हटाया जाना, पद त्याग, सेवोन्मुक्ति या निर्मुक्ति प्रभावी हो-( 1 ) अधिनियम के अधीन रहते हुए किसी व्यक्ति की सेवानिवृत्ति, पदच्युति , सेवा से हटाया जाना, पदत्याग, सेषोन्मुक्ति किसी व्यक्ति की सेवानिवृत्ति, पदच्युति, सेवा से हटाया जाना, पदत्याग , या निर्मुक्ति के आदेश में विनिर्दिष्ट तारीख से प्रभावी होगी ।

(2) ऊपर उपनियम ( 1 ) में वर्णित तारीख भूतलक्षी नहीं होगी । "

12. उक्तनियमों के नियम 29 की सारणी में " विहित प्राधिकारी " से संबंधित स्तंभ 4 में, -

( 1 ) क्रम संख्या 9 के सामने मद 1 और मद 2 के स्थान पर निम्नलिखित मदें रखी जाएंगी , अर्थात्:-

(3) उप कमांडेंट

( i ) अभ्यावेशित व्यक्तियों के 72 घंटे तक के लिए छुट्टी भंग करने के प्रथम अपराध के लिए वेतन और भत्तों का अपकर्तन ।

( ii ) नाविकों को 7 दिन से अनधिक अवधिके लिए अतिरिक्त कार्य और कवायद ( ड्रिल ) ।

( iii ) अभ्यावेशित सभी व्यक्तियों की 15 दिन से अनधिक अवधि के लिए छुट्टी का रोका जाना ।

( iv) अभ्यावेशित सभी व्यक्तियों की भर्त्सना ।

(4 ) सहायक कमांडेंट

( i ) नाविकों को 7 दिन से अनधिक अवधि के लिए

( ii ) अधीनस्थअधिकारियों से भिन्न अभ्यावेशित सभी व्यक्तियों

की 15 दिन से अनधिक अवधि के लिए छु‌ट्टी का रोका जाना ।

( iii ) अधीनस्थअधिकारियों से भिन्न अभ्यावेशित सभी व्यक्तियों की भर्त्सना ।

14. उक्त नियमों के नियम 31 में, " शपथ/प्रतिज्ञान का प्ररुप " शीर्षक के अधीन " मै. क. ख. " शब्द, कोमा , अक्षरों और विराम के स्थान " शब्द और रिक्त स्थान रखे जाएंगे ।

15. उक्त नियमों के नियम 34 में,-

(1 ) उपनियम ( 3 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा , अर्थात्: -

" ( 3 ) मौखिक या लिखित में कोई परिवाद करना अच्छी व्यवस्था और तटरक्षक अनुशासन के विरुद्ध एक अपराध होगा, जिसके अंतर्गत तथ्य का ऐसा कथन भी है जो प्रतिवादी के ज्ञान में असत्य है "

(2 ) उपनियम ( 3 ) के पश्चात् निम्नलिखित उपनियम अंतःस्थापित किया जाएगा , अर्थात्: -

"( 4 ) उन शब्दों में जिनमें ऐसी भाषा या टिप्पणियां समाविष्ट हैं, जहां तक ऐसी भाषा या टिप्पणियां जो तथ्यों के पर्याप्त कथन के लिए आवश्यक हैं , के सिवाय, जो अपमानजनक या अनदीनता अनुशासन की ध्वंशक हैं , कोई परिवाद करना अच्छी व्यवस्था और तटरक्षक अनुशासन के विरुद्ध एक अपराध होगा,"

16. उक्तनियमों के नियम 39 में उपनियम ( 6 ) के पश्चात् पर निम्नलिखित नियम अंतःस्थापित किए जाएंगे , अर्थात्: - [ भाग II- खण्ड -4]

347 " ( 7 ) किसी काउंसेल या विधि व्यवसायी को जांच बोर्ड के समक्ष उपसंजात होने के लिए अनुज्ञात नहीं किया जाएगा । (8 ) बोर्ड किसी साक्षी से किसी उस साक्ष्य की सत्यता या शुद्धता का परीक्षण करने के लिए जो उसने दिया है अन्यथा सत्य का पता लगाने के लिए ऐसे प्रश्न पूछ सकेगा , जिन्हें वह ठीक समझे।

(१ ) कोई बोर्ड, जब तक कि बुलाए जाने वाले प्राधिकारी द्वारा अन्यथा आदेश न दिया जाए, बंद कमरे में बैठेगा । " 17. उक्त नियमों के नियम 42 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्: -

" 42. कतिपय व्यक्तियों का कथनों पर दस्तावेजों की प्रतियां लेने का अधिकार. ( 1 ) ऐसा कोई व्यक्ति जिसका तटरक्षक न्यायालय द्वारा विचारण किया जाता है वह जांच बोर्ड की कार्यवाहियों में अंतर्विष्ट ऐसे कथनों और दस्तावेजों की प्रतियों का हकदार होगा, जो उसके विचारण में उसके अभियोजन या प्रतिरक्षा के लिए सुसंगत हैं ।

(2) जब तक कि महानिदेशक लेखबद्ध किए जाने वाले कारणों से अन्यथा आदेश न दे, ऐसा कोई व्यक्ति जिसका चरित्र या ख्याति किसी जांच बोर्ड के समक्ष साक्ष्य से प्रभावित होती है ऐसे कथनों और दस्तावेजों की प्रतियों का, जो यथा पूर्वोक्त उसके चरित्र या ख्याति से संबंधित हैं, हकदार होगा । "

18. उक्त नियमों के उपाबंध में , पैरा 6 के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्: -

" 6. आप तटरक्षक ( साधारण ) नियम, 1986 के अध्याय 7 के उपबंधों और इस विषय पर जारी तटरक्षक आदेश द्वारा मार्गदर्शित होंगे ।"

New Delhi , the 11th August, 2004

S.R.O. 130. In exercise of the powers conferred by Sub- section ( 1 ) of Section 123 ofthe Coast Guard Act , 1978 (30 of 1978), the Central Government hereby makes the following rules, further, to amend the Coast Guard ( General ) Rules , 1986 , namely :-

1. ( 1) These Rules shall be called the Coast Guard ( General ) Amendment Rules , 2004.

(2) They shall come into force on the date of publication in the Official Gazette.

2. Inthe Coast Guard (General ) Rules , 1986 (hereinafter refer to as the said rules ), in rule 7,- (1) in clause ( a) ( i) after item ( iv), following item shall be inserted namely: - "(v) Commandant ( Junior Grade) ; "

(ii) after item (v) so inserted , the remaining items shall be renumbered as " (vi ) " and " (vii ) " , respec- tively;

(2) in clause (b) , for item ( iii ) the following item shall be inserted namely :-

"( iii) Adhikari/ Sahayak Engineer /Pradhan Yantrik; "

(3) in clause (c) , for item ( i) the following item shall be substituted ; namely :---

"(i) Pradhan Navik; "

3. in rule 9 of the said rules, in the Table against clause (b) in column 2 relating to " Specialisation ",- (1) in item ( i) between the words " Seaman " and " Mechanics " , words " Supply Assistants " , shall be inserted.

(2) in item ( iii ) words " Supply Assistants" shall be omitted.

4. Inrule 21 ofthe said rules , in the Table , column 1 relating to " Competent Authority " , for the words " Inspector General" the words , " Deputy Director General " shall be substituted.

5. In rule 23 of the said rules, -

(1 ) for the words " Inspector General in the Coast Guard Headquarters " , occurring in sub-rules ( 1 ) , (3 ) , (4) and (5) the words, "Deputy Director General in the Coast Guard Headquarters " shall be substituted:

(2) in sub - rule ( 5) , for the word " on " occurring before the word " gratuity " ( he word " or " shall be substituted .

6. In rule 24 ofthe said rules , in sub- rules ( 1 ) and (3 ) , for the words, " the luspector General in the Coast Guard Headquarters " , the words , " the Deputy Director General in the Coast Guard Headquarters " shall be substituted.

In zule 25 of the said rules , for the words, " the Inspector General in the Coast Guard Headquarters " , the words , " the Deputy Director General in the Coast Guard Headquarters " shall be substituted . 7.

8. In rule 26 of the said rules, in sub - rules (4) and ( 5) , for the words , " the Inspector General in the Coast Guard Headquarters ", the words, " the Deputy Director General in the Coast Guard Headquarters " shall be substituted.

9. In rule 27 of the said rules ,

(1) in sub -rule ( 2)-

(1) after the words , "The Central Government " , the words " or the Deputy Director General , " shall be added;

(ii) after the words, " discretion of the Central Government " , the words " or the Deputy Director General as the case may be , " shall be added;

(2) in sub - rule ( 3 ) the words , " Inspector General in the Coast Guard Headquarters " , the words , " Deputy Director General in the Coast Guard Headquarters " shall be substituted:

(3) for sub - rule (4) , following sub- rule shall be substituted namely:-

"(4 ) Application for discharge , release or retirement on compassionate grounds shall be forwarded by the Commanding Officer, through the Regional Conımander, to Coast Guard Headquarters for further necessary action. "

10. After rule 27 of the said rules , the following new rules shall be inserted , namely :---

" 27A Resignation-( 1 ) No person subject to the Act shall have a right to resign his appointment or withdraw himself from the duties of his appointment. But in this regard, he may submit an application through proper channel to the Deputy Director General or the Director Generalat Coast Guard Headquarters or to the Central Government , as the case maybe . He shall not be relieved of his duties until the Central Government or the authority empowered by the Central Government has accepted his resignation .

(2) Amember ofthe Coast Guard before his application to resign being accepted by the prescribed authority may apply for withdrawal of his application . The Central Government or the authority empowered by Central Government may at its discretion, grant withdrawal of such application .

27B. Discharge Certificate ( 1 ) A certificate required to be furnished under provisions of Section 12 of the Act is hereinafter called a Discharge Certificate .

(2)A Discharge Certificate may be furnished either by personal delivery thereof by, or on behalf of the CommandingOfficer to the enrolled person who retires , or is discharged , released, removed or dismissed from the Coast Guard , or is permitted to resign , or by the transmission of the same to such person by registered post, "

11. In the said rules , for rule 28 the following rule shall be substituted, namely: ---

"28. Date from which retirement , dismissal , removal , resignation , discharge or release otherwise than by sentence of a Coast Guard Court or under Section 57 of the Act takes effect ( 1 ) The retirement, dismissal , removal , resignation, discharge or release of a person subject to the Act shall take effect from the date specified in the order for such retirement , dismissal , removal , resignation , discharge or release.

(2) The date mentioned in sub rule ( 1 ) above shall not be retrospective . "

12. IN rule 29 of the said rules , in the Table in column 4 relating to " Prescribed authority " ,-

(1) against Section 9 , for items 1 and 2 the following items shall be substituted , namely:-

14. In rule 31 of the said rules under the heading , " FORM OF OATH/ AFFIRMATION " , for the letters, comma and full stop " I , A.B. the letter and blank space " I ... " shall be substituted.

15. In rule 34 of the said rules, --

(1) for sub -rule (3 ) , the following sub -rule shall be substituted, namely:-

"(3) It shall be an offence against good order and the Coast Guard discipline to make a complaint, either oral orwritten, which includes a statement of fact which is untrue to the knowledge of the complainant . " (2) after sub - rule (3 ) , the following sub - rule shall be insered, namely:-

"(4) 11 shall be an offence against good order and the Coast Guard discipline to make a complaint in terms which comprise language or comments that are disrespectful or insubordinate or subversive ofdiscipline , except inso far as such language or comments are necessary for an adequate statement of the facts. " 16. In rule 39 of the said rules, after sub - rule ( 6 ) , the following sub - rules shall be inserted , namely :-

"(7) No counsel , or legal practitioner shall be permitted to appear before a Board of Inquiry.

(8) The Board may put such questions to a witness as it thinks desirable for testing the truth or accuracy of any evidence he has given and otherwise for eliciting the truth .

(9) A Board shail , unless otherwise ordered by the convening authority, sit within closed doors. " 17. In the said rules , for rule 42, the following rule shall be substituted , namely :-

"42.Right of certain persons to copies of statements and documents .-( 1 ) Any person who is tried by a CoastGuard Court shall be entitled to copies of such statements and documents contained in the proceed- ings of a Board of Inquiry, as are relevant to his prosecution or defence at his trial .

(2)Any person whose character or reputation is affected by the evidence before a Board of Inquiry shall be entitled to copies of such statements and documents as have a bearing on his character or reputation as aforesaid unless the Director General for reasons recorded by him in writing , orders otherwise ."

18. In the Annexure to the said rules , for para 6 , the following para shall be substituted, namely:-

"6. You are to be guided by provisions of Chapter VII of the Coast Guard ( General ) Rules, 1986 and the Coast Guard Order issued on the subject . "

का.नि.आ. 131.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और तटरक्षक विधिक सहायक भर्ती नियम, 1988 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्रालय के अधीन तटरक्षक संगठन विधिक सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिये निम्मलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक विधिक सहायक भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

( ख ) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्तिका पात्र नहीं होगा:

351 परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति . इन नियमों की कोई बात , ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय/राज्य सरकारों/संघ राज्य क्षेत्रों/स्वायत्त संगठनों/विश्वविद्यालयों/पब्लिक सेक्टर के उपक्रमों/अनुसंधान संस्थानों के अधीन ऐसे अधिकारी: --

प्रतिनियुक्ति ( आई एस टी सी ) जिसके न हो सकने पर सीधी भर्ती द्वारा सशस्त्र बल कार्मिकों के लिए प्रतिनियुक्ति/पुर्ननियोजन

(क) ( 1 ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण करते हों; या

(2) जिन्होंने मूल काडर/ विभाग में 5500-9000 रुपये के वेतनमान या समतुल्य वेतनमान में उस पर नियुक्ति के पश्चात् नियमित आधार पर तीन वर्ष की सेवा कर चुके हों; और

(ख) जो स्तंभ 8 के अधीन सीधी भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों ।

टिप्पण: प्रतिनियुक्ति की अवधि, ( आई एस टी सी ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है ( आई एस टी सी ) साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति ( आई एस टी सी ) द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहींहोगी ।

सशस्त्र बलों के कार्मिक के लिए:

पुनर्नियोजन:-

सशस्त्र बलों के ऐसे कार्मिक जो मास्टर चीफ पेटि आफिसर/ चीफ पेटि आफिसर रैंक के हों या थल सेना, जल सेना या वायु सेना में समतुल्य रैंक के हों और 5500- 9000 रु. के वेतनमान में हों तथा वे जिनके पास किसी मान्यता प्राप्त विश्वविद्यालय सेविधिमें डिग्री हो और एक वर्ष की अवधि के भीतर सेवा निवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित होने वाले हैं , पर भी विचार किया जाएगा । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा । जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है, तत्पश्चात् वे पुनर्नियोजन पर बने रहेंगे । [ भाग II- खण्ड 4 ]

S.R.O. 131. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Coast Guard Legal Assistant Recruitment Rules 1988 , except in respect of things done or omitted to bedone before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Legal Assistant in Coast Guard Organisation under the Ministry of Defence , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Coast Guard Legal Assistant Recruitment Rules, 2004 .

(2) They shall come into force on the date of their Publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4) of the schedule annexed to these rules .

3.Method of recruitment , age limit and qualifications, etc. The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns ( 5 ) to ( 14 ) of the schedule.

4. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who , having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect of any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- servicemen, other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

The maximum age limit for appointment by deputation ( ISTC) shall be not exceeding 56 years as on the closing date ofthe receipt of applications .

For Armed Forces Personnel :

Re-employment :

The armed forces personnel holding the rank of Master Chief Petty Officer/ ChiefPetty Officer or equivalent in the Army, Navy or Air Force holding analogous pay scale or in the pay scale of Rs . 5500-9000 and possessing degree in law from a recognized University who are due to retire or who are to betransferredto reserve within a period of one year shall also be considered. Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces , thereafter they may be continued onre-employment .
