सा.का.नि. 378. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और स्वागत अधिकारी ( सचिवालय सुरक्षा संगठन ) भर्ती नियम, 1979 को अधिक्रांत करते हुए उन बातों के सिवाय जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है, गृह मंत्रालय के सचिवालय सुरक्षा संगठन में स्वागत अधिकारी के पदो पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

1. संक्षिप्त नाम और प्रारंभः ( 1 ) इन नियमों का संक्षिप्त नाम स्वागत अधिकारी (सचिवालय सुरक्षा संगठन) भर्ती नियम, 2004 है ।

2. ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमानः उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति, आयु- सीमा और अर्हताएं आदिः उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हताः वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है , उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगाः

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्तिः जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृतिः इन नियमों की कोई बात, ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनूसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के ऐसे अधिकारी-

( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हों; या

( ii ) जिसने लिपिकीय सेवा में 5000-150-8000/- रूपए के वेतनमान में तीन वर्ष तक नियमित सेवा की है, या

i ( iii ) जिसने लिपिकीय सेवा में 4500-125-7000/- रूपए के वेतनमान में छह वर्ष तक नियमित सेवा की है; या

(iv) जिसने लिपिकीय सेवा में 4000-100-6000/- रूपए के वेतनमान में उच्च श्रेणी लिपिक के रूप में न्यूनतम दस वर्ष तक नियमित सेवा की है ।

(प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारण तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

G.S.R. 378. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Reception Officers (Secretariat Security Organisation) Recruitment Rules , 1979 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Reception Officers in the Secretariat Security Organisation , Ministry of Home Affairs , namely:-

1. Short title and commencement .- ( 1 ) These rules may be called the Reception Officers (Secretariat Security Organisation ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2 . Number of posts , classification and scales of pay. The number of posts , thei clasation and the scales of pay attached thereto shall be as specified in

Stutens 2 to of the Schedule annexed hereto .

Method of recruitment , age limit and qualifications etc. The method of cruitment to the seid posts , age limit , qualifications and other matters connected Derewith she be as specified in columns 5 to 14 of the said Schedule .

Disqualification. - No person, - 4.

(a) who has entered into or contracted a marriage with any person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal iaw applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .

Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so todo , it may , by order , for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons or posts .

6. Saving. -Nothing in these rules shall affect reservations , relaxation of age limit, and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 381.- भारतीय प्रशासनिक सेवा ( संवर्ग ) नियमावली , 1954 के नियम 4 के उप - नियम ( 2 ) के साथ पठित, अखिल भारतीय सेवाएँ अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार कर्नाटक सरकार, के परामर्श से भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियमावली, 1955 में आगे और संशोधन करने के लिए एत‌द्वारा निम्नलिखित विनियम बनाती है, अर्थात्: - 1. ( i ) इन विनियमों का नाम भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) सप्तम संशोधन विनियमावली, 2004 है !

( ii) ये विनियम भारत के राजपत्र में इनके प्रकाशम की तारीख को प्रवृत्त होंगे ।

सा.का.नि. 382.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विज्ञान और प्रौद्योगिकी विभाग समूह ' क' राजपत्रित पद ( अननुसचिवीय, वैज्ञानिक और तकनीकी) नियम , 1984 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , विज्ञान और प्रौद्योगिकी विभाग में समूह ' क ' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम , प्रारंभ और लागू होना

(1 ) इन नियमों का संक्षिप्त नाम विज्ञान और प्रौद्योगिकी विभाग समूह ' क ' राजपत्रित पद (अननुसचिवीय, वैज्ञानिक और तकनीकी) नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

(3) ये वैज्ञानिक ' सी' , वैज्ञानिक ' डी' , वैज्ञानिक ' ई ' , वैज्ञानिक ' एफ ' और वैज्ञानिक ' जी ' के पदों को लागू होंगे ।

2. पदों की संख्या , वर्गीकरण और वेतनमान पदों की संख्या, उनका वर्गीकरण और उनसे संलग्न वेतनमान इस प्रकार होंगे : -

2143 3. भर्ती के मानदंड :- उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें इस प्रकार होंगी :-

(1) पद चयन पद हैं ।

(2) पदों को भर्ती के प्रयोजन के लिए संघ लोक सेवा आयोग के परिक्षेत्र से छूट दी गई है ।

(3) सीधी भर्ती तथा प्रोन्नत व्यक्तियों के लिए न्यूनतम शैक्षिक अर्हताएं विभिन्न पदों के लिए और अनुभव इस प्रकार होगा : -

(क) आवश्यक अर्हताएं :

किसी मान्यताप्राप्त विश्वविद्यालय से प्रकृति/ कृषि विज्ञान में मास्टर डिग्री या इंजीनियरी/प्रौद्योगिकी/ आयुर्विज्ञान में बैचलर डिग्री या समतुल्य ।

(ख) वांछनीय अर्हताएं :

किसी मान्यताप्राप्त विश्वविद्यालय से प्रकृति/ कृषि विज्ञान में डाक्टरेट डिग्री या इंजीनियरी /प्रौद्योगिकी/ आयुर्विज्ञान में मास्टर डिग्री ।

(ग) अनुभव :

क्रम पद का नाम भर्ती के लिए अपेक्षित न्यूनतम अनुभव

(1) वैज्ञानिक ' सी ' औद्योगिक और शैक्षणिक संस्थाओं और/ या विज्ञान और प्रौद्योगिकी संगठनों में अनुसंधान और विकास में चार वर्ष का अनुभव ।

(2) वैज्ञानिक ' डी' औद्योगिक और शैक्षणिक संस्थाओं और/ या विज्ञान और प्रौद्योगिकी संगठनों में अनुसंधान और विकास में आठ वर्ष का अनुभव । जिनमें से चार वर्ष का अनुभव विज्ञान और प्रौद्योगिकी, कार्यक्रम, योजना, विकास और समन्वय में होना चाहिए ।

(3) वैज्ञानिक ' ई' औद्योगिक और शैक्षणिक संस्थाओं और/ या विज्ञान और प्रौद्योगिकी संगठनों में अनुसंधान और विकास में दस वर्ष का अनुभव । जिनमें से पांच वर्ष का अनुभव विज्ञान और प्रौद्योगिकी , कार्यक्रम, योजना, विकास और समन्वय में होना चाहिए ।

(4) वैज्ञानिक

'एफ'

औद्योगिक और शैक्षणिक संस्थानों और/ या विज्ञान और प्रौद्योगिकी संगठनों में अनुसंधान और विकास में बारह वर्ष का अनुभव । जिनमें से छह वर्ष का अनुभव विज्ञान और प्रौद्योगिकी, कार्यक्रम, योजना, विकास और समन्वय में होना चाहिए ।

(5) वैज्ञानिक ' जी ' (i) औद्योगिक और शैक्षणिक संस्थाओं और/ या विज्ञान और प्रौद्योगिकी संगठनों में अनुसंधान और विकास में पंद्रह वर्ष का अनुभव । जिनमें से सात वर्ष का अनुभव विज्ञान के क्षेत्र में या उससे संबंधित क्षेत्रों में विज्ञान और प्रौद्योगिकी, कार्यक्रमों के प्रशासन, योजना, विकास और समन्वय में होना चाहिए ।

(ii) विज्ञान की किसी शाखा में मुख्य कार्यक्रमों को तैयार करने, उनका प्रबंध करने और निर्देश देने का अनुभव ।

(iii) उच्च स्तर का प्रकाशित अनुसंधान कार्य ।

टिप्पण : - जिस किसी के पास हिन्दी का ज्ञान नहीं होगा, उसे अपने एक वर्ष की परिवीक्षा की अवधि के दौरान हिन्दी का ज्ञान अर्जित करना आवश्यक है ।

[PART II- SEC. 3 (i) ] (4) भर्ती की पद्धति.- (क) भर्ती या तो सीधी भर्ती द्वारा या आमेलन या प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) के आधार पर की जाएगी और प्रत्येक पद के लिए भर्ती की विशिष्ट पद्धति का विनिश्चय सरकार द्वारा पद विज्ञापित करने से पूर्व उक्त पद के कार्य की अपेक्षाओं को दृष्टिगत रखते हुए, अपेक्षित शैक्षिक अर्हताओं और अनुभव को ध्यान में रखते हुए किया जाएगा ।

(ख) भूतपूर्व सैनिकों के लिए.- प्रतिनियुक्ति या पुनर्नियोजन के आधार पर ।

(ग) इस नियम के अधीन विनिर्दिष्ट भर्ती की पद्धतियां सचिव की सिफारिशों पर और विज्ञान और प्रौद्योगिकी विभाग के भारसाधक मंत्री के अनुमोदन से तय की जाएंगी ।

(5) छानबीन समिति. छानबीन समिति में एक अध्यक्ष और दो सदस्य होंगे जिन्हें विज्ञान और प्रौद्योगिकी विभाग के सचिव द्वारा नामनिर्देशित किया जाएगा । छानबीन समिति की सिफारिश का अनुमोदन प्राधिकारी विज्ञान और प्रौद्योगिकी विभाग का सचिव होगा ।

(6) सीधी भर्ती के लिए या नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति के लिए विभागीय समिति और उसकी संत्रचना

निर्धारण बोर्ड : -

अध्यक्ष : विज्ञान और प्रौद्योगिकी विभाग के सचिव द्वारा नामनिर्देशित किया जाएगा ।

सदस्य : (क) समुचित स्तर के एक या अधिक विभागीय अधिकारियों को विज्ञान और प्रौद्योगिकी विभाग के सचिव द्वारा नामनिर्देशित किया जाएगा ।

(ख) विज्ञान और प्रौद्योगिकी विभाग के सचिव द्वारा दो या अधिक बाहरी विशेषज्ञों को नामनिर्देशित किया जाएगा ।

(ग) विस्तारित अनुदेशों के अनुसार कार्मिक और प्रशिक्षण विभाग का नामनिर्देशिती ।

टिप्पप्ण : (1 ) बोर्ड के कुल सदस्यों के कम से कम पचास प्रतिशत सदस्य, जिनके अंतर्गत अध्यक्ष भी है, विभाग से बाहर के होने चाहिए ।

(2) ऊपर वर्णित सदस्य

उस स्तर से जिसके लिए व्यक्तियों के संबंध में चयन/प्रोन्नति के लिए विचार किया जाना है, एक स्तर ऊपर के होने चाहिए ।

(3) अध्यक्ष से भिन्न बोर्ड के किसी सदस्य की अनुपस्थिति से निर्धारण बोर्ड की कार्यवाहियां अविधिमान्य नहीं होंगी ।

(4) निर्धारण बोर्ड लिए गए साक्षात्कार और अभ्यर्थियों के पूर्व के कार्यपालन के मूल्यांकन के आधार पर अपनी सिफारिशें करेगा ।

(5) निर्धारण बोर्ड की सिफारिशें उस तारीख से प्रभावी होंगी जिसको नियुक्ति प्राधिकारी सिफारिशों का अनुमोदन करता है ।

(7) नियुक्ति प्राधिकारी:- वैज्ञानिक ' सी' , वैज्ञानिक ' डी' , वैज्ञानिक ' ई ' और वैज्ञानिक ' एफ ' के मामले में नियुक्ति प्राधिकारी भारसाधक मंत्री होगा और वैज्ञानिक ' जी ' के मामले में नियुक्ति प्राधिकारी मंत्रिमंडलीय नियुक्ति समिति (एसीसी) होगी ।

4. सीधी भर्ती.-

(i) ऐसे अभ्यर्थी जिनके पास नियम 3 (3) में विनिर्दिष्ट शैक्षिक अर्हताएं और अनुभव हो , सीधी भर्ती के लिए पात्र होंगे । [ भाग II- खण्ड 3 ( i ) ]

2145 (ii) चयन किए गए अभ्यर्थी एक वर्ष की अवधि के लिए परिवीक्षा पर होंगे जिसे प्रत्येक अवसर पर अधिकतम छह मास की अवधि के लिए दो बार बढ़ाया जा सकेगा ।

(iii) वैज्ञानिकों की पुष्टि के संबंध में विभागीय समिति द्वारा विचार किया जाएगा जिसमें एक अध्यक्ष और तीन सदस्य इस प्रकार होंगे :-

(i) अध्यक्ष सचिव, विज्ञान और प्रौद्योगिकी विभाग ।

(ii) सदस्य विज्ञान और प्रौद्योगिकी विभाग से दो वैज्ञानिक ' जी'

संयुक्त सचिव (प्रशासन, विज्ञान और प्रौद्योगिकी विभाग)

(iv) आयु सीमा - प्रत्येक प्रवर्ग के पदों पर सीधी भर्ती के लिए ऊपरी आयु सीमा इस प्रकार होगी : -

परंतु

(i) विभाग में नियमित आधार पर पहले से कार्यरत वैज्ञानिकों की बाबत कोई ऊपरी आयु सीमा नहीं होगी ।

( ii) अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों, शारीरिक रूप से विकलांगों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए ऊपरी आयु सीमा केन्द्रीय सरकार द्वारा समय समय पर इस संबंध में जारी किए गए आदेशों के अनुसार शिथिल की जा सकेगी ।

( iii) नियंत्रण प्राधिकारी विशिष्ट वैज्ञानिक क्षेत्रों में उच्च अनुभव रखने वाले अभ्यर्थियों के मामले में प्रत्येक प्रवर्ग के पदों के लिए ऊपरी आयु सीमा को शिथिल कर सकेगा ।

टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख , असम, मेघालय , अरूणाचल प्रदेश , मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के सिवाय, अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ।

5. आमेलन / प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है) .-

भारत में या विदेश में केन्द्रीय सरकार या राज्य सरकारों या विश्वविद्यालयों या मान्यताणप्त अनुसंधान संस्थाओं या अर्द्धसरकारी , कानूनी या स्वशासी संगठनों में कार्यरत वैज्ञानिकों या 2146

प्रौद्योगिकीविदों को, निम्नलिखित शर्तें पूरी करने के अधीन रहते हुए , आमेलन या प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) के आधार पर भर्ती किया जा सकेगा : -

(i) ऐसे वैज्ञानिक या प्रौद्योगिकीविद् जिनके पास नियम 3 (3 ) में यथाविनिर्दिष्ट न्यूनतम शैक्षिक अर्हताएं और अनुभव है ।

(ii ) ऐसे वैज्ञानिकों या प्रौद्योगिकीविदों को उस पद के सदृश पद धारण किए हुए होना चाहिए जिसके लिए उन्होंने आवेदन किया है या: -

(क) वैज्ञानिक ' सी' के लिए : - 8000-275-13500रु. के या समतुल्य वेतनमान में पद पर पांच वर्ष की सेवा ।

(ख ) वैज्ञानिक ' डी ' के लिए :- 10000-325-15200रु. के या समतुल्य वेतनमान में पद पर पांच वर्ष की सेवा ।

(ग ) वैज्ञानिक 'ई ' के लिए :- 12000-375-16500रु. के या समतुल्य वेतनमान में पद पर पांच वर्ष की सेवा या 10000-325-15200रु. के या समतुल्य वेतनमान में पद पर दस वर्ष की सेवा । (घ) वैज्ञानिक ' एफ ' के लिए:- 14300-400-18300रु. के या समतुल्य वेतनमान में पद पर दो वर्ष की सेवा गा 12000-375-16500रु. के या समतुल्य वेतनमान में पद पर सात वर्ष की सेवा । (ङ) वैज्ञानिक 'जी' के लिए :- 16400-450-20000रु. के या समतुल्य वेतनमान में पद पर दो वर्ष की सेवा या 14300-400-18300रु. के या समतुल्य वेतनमान में पद पर चार वर्ष की सेवा । ( iii ) प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी जिसे सक्षम प्राधिकारीके अनुमोदन से आगे बढ़ाया जा सकेगा ।

(iv ) पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए, सिवाय इस काडर बाह्य पर के लिए जिसके लिए वे पोषक श्रेणी के अधिकारी नहीं है, विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

(v) प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

6. नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति.-

(1 ) (क) नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति की पद्धति का वैज्ञानिक ' बी' , वैज्ञानिक ' सी' , वैज्ञानिक ' डी' , वैज्ञानिक ' ई ' , वैज्ञानिक ' एफ ' और वैज्ञानिक ' जी ' की श्रेणी में विभागीय अधिकारियों की प्रोन्नति के विषय में अनुसरण किया जाएगा । यदि निर्धारण बोर्ड किसी अधिकारी को वैज्ञानिक ' सी' , वैज्ञानिक. ' डी' , वैज्ञानिक ' ई ' , वैज्ञानिक ' एफ ' और वैज्ञानिक ' जी ' के पद पर स्वस्थाने प्रोन्नति के लिए उपयुक्त समझता है और ऐसे पद उस समय मंजूर किए गए पदों की संख्या के भीतर उपलब्ध नहीं है तो वैज्ञानिक ' बी' के पदों को वैज्ञानिक ' सी' , वैज्ञानिक ' सी ' 2147 भारत का राजपत्र : नवम्बर 6, 2004 /कार्तिक 15 , 1926

के पदों को वैज्ञानिक 'डी' , वैज्ञानिक ' डी' के पदों को वैज्ञानिक ' ई' , वैज्ञानिक ' ई' के पदों को वैज्ञानिक ' एफ ' और वैज्ञानिक ' एफ ' के पदों को वैज्ञानिक ' जी ' में उन्नत करके प्रोन्नति दी जा सकेगी ।

(ख) सिवाय इसके कि वैज्ञानिक ' बी' , वैज्ञानिक ' सी ', वैज्ञानिक ' डी' , वैज्ञानिक ' ई ' वैज्ञानिक ' एफ' और वैज्ञानिक ' जी ' के कुल स्वीकृत पदों की संख्या में कोई परिवर्तन नहीं होगा, किसी निर्बंधन के बिना एक दूसरे के स्थान पर रखा जा सकेगा।

(ग) विज्ञान और प्रौद्योगिकी विभाग विभिन्न वेतनमानों में पदों की संख्या में परिवर्तन करने के लिए स्वतंत्र होगा जिससे नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति के लिए कनिष्ठ वेतनमान से किसी अधिकारी को ज्येष्ठ वेतनमान में प्रोन्नत किया जा सके और इसके लिए अनुसंधान की गुणवत्ता और अभिलेख ही एकमात्र मानदंड होगा ।

(घ) नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नतियां संबद्ध अधिकारी के लिए व्यक्तिगत होंगी और उस आधार पर अवर श्रेणी में विनिर्दिष्ट रिक्ति कारित नहीं होगी । संबद्ध अधिकारी द्वारा वर्तमान में धारित पद स्वतः उन्नत हो जाएगा और स्वस्थाने प्रोन्नति के पद पर उसके बने रहने की अवधि के लिए उसके लिए वह व्यक्तिगत होगा । यदि उक्त अधिकारी सेवानिवृत्त होने पर या त्यागपत्र देने के कारण या अन्यथा उच्चतर पद को खाली करता है तो वह पद मूल स्तर में परिवर्तित हो जाएगा । (ङ) ऐसे व्यक्ति से भिन्न जिसके पास प्रकृति/ कृषि विज्ञान में कम से कम मास्टर डिग्री या इंजीनियरी या प्रौद्योगिकी या आयुर्विज्ञान में बैचलर डिग्री की आवश्यक शैक्षिक अर्हताएं हैं, कोई व्यक्ति नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति का पात्र नहीं होगा ।

(च) नम्य पूरकता स्कीम ऐसे वैज्ञानिकों और प्रौद्योगिकीविदों को ही लागू नहीं होगी जो वैज्ञानिक पद धारण किए हुए हैं और जो वैज्ञानिक कार्यकलापों और सेवाओं में लगे हुए हैं । नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नतियों के लिए निर्धारण मानदंड इस बात के साथ कठोर होंगे कि उसके वैज्ञानिक और तकनीकी ज्ञान के मूल्यांकन पर ही जोर दिया जाएगा जिससे केवल ऐसे वैज्ञानिकों की जिनके पास प्रशंसनीय उपलब्धियां या उच्च स्तर की तकनीकी गुणवत्ता है, नम्य पूरकता स्कीम के अधीन प्रोन्नति के लिए सिफारिश की जाएगी ।

(2) वे वेतनमान जिनको नम्य पूरकता स्कीम लागू होगी, अगली उच्चतर श्रेणी में स्वस्थाने प्रोन्नति के लिए कार्य पालन से जुड़ी न्यूनतम पदावास की अवधि, नम्य पूरकता स्कीम के अंतर्गत आने वाले वैज्ञानिक और तकनीकी पदों के एकरूप पदनाम वह होंगे जो नीचे सारणी में दिए गए हैं :-

PART 11-SEC. 3 ( 1 ) | परंतु एक बार उपाय के रूप में मुख्य वैज्ञानिक अधिकारियों पर जो अब वैज्ञानिक ' डी ' हैं जिनकी स्थिति 09.111998 को उस रूप में थी और पहले 3700-5000 रु. के वेतनमान (पूर्व पुनरीक्षण) से 5100-6300रु. (पूर्व पुनरीक्षण) की श्रेणी में प्रोन्नति के लिए विचार किया गया था, जैसा कि नियमों में जो संशोधन से पूर्व विद्यमान थे, विहित है, पांच वर्ष की पात्रता सेवा पूरी कर लेने के पश्चात् 16,400-29000रु. (पूर्व पुनरीक्षण 5100-6300 रु. ) की पुनरीक्षित श्रेणी में प्रोन्नति के लिए विचार किया जाता रहेगा । वैज्ञानिक ' डी' ( जो पूर्व में मुख्य वैज्ञानिक अधिकारी थे) के संबंध में 09.11.1998 से पूर्व प्रवृत्त नियमों में विहित पांच वर्ष की पात्रता सेवा पूरा कर लेने पर वैज्ञानिक ' एफ' की श्रेणी में सीधे प्रोन्नति के लिए विचार करते समय पुनरीक्षित निर्धारण मानदंडों के के प्रतिनिर्देश से ही निर्धारण किया जाना अपेक्षित है जो अन्य बातों के साथ, जैसा इस नियम के पैरा 3 में वर्णित है, । पहले अवसर पर प्रोन्नति के लिए छानबीन/निर्धारण के लिए न्यूनतम प्रतिशत 85 प्रतिशत अधिकथित करते हैं ।

जाने हेतु वार्षिक गोपनीय एसीआर का निर्धारण 10 ( 3 ) सभी अधिकारियों के बारे में पहले प्रोन्नति के लिए विचार किए रिपोर्टों ( एसीआर) की श्रेणियों के आधार पर छानबीन की जाएंगी पोआइंट मानक के आधार पर किया जाएगा जिनमें से "उत्कृष्ट" के लिए दस अंक ; "बहुत अच्छा " के लिए आठ अंक ; "अच्छा " के लिए छह अंक ; " औसत " के लिए चार अंक ; "निकृष्ट" के लिए शून्य अंक दिया जाना चाहिए और केवल ऐसे अधिकारियों की ही छानबीन की जाएगी जो उनके कार्यपालन से जुड़ी हुई न्यूनतम पदावास की अवधि को पूरा करते हों जैसा कि नीचे सारणी में उपदर्शित किया गया है : -

2149 टिप्पण 2 : अपवादिक रूप से सभी उत्कृष्ट श्रेणियां प्राप्त करने वाले सराहनीय अभ्यर्थियों के बारे में पदावास की अवधि में छूट देने के लिए विचार किया जा सकेगा और ऐसी शिथिलता एक बार में एक वर्ष से अधिक की नहीं होगी । ऐसी शिथिलता उनके संपूर्ण सेवा काल में अधिक से अधिक दो बार दी जा सकेगी ।

(4) ऐसे सभी अधिकारियों को जिनकी छानबीन की गई हो, साक्षात्कार के लिए बुलाया जाएगा । साक्षात्कार में उनके कार्यपालन को भी दस पोआइंट मानक पर उसी रूप में सारणीबद्ध किया जाएगा तथा प्रोन्नति के लिए पात्रता उन्हीं मानदंडों पर आधारित होगी जो ऊपर सारणी में दिए गए हैं ।

(5) अनुसंधान और विकास में कार्यक्षेत्र का अनुभव और ऐसी वैज्ञानिक परियोजनाओं के कार्यान्वयन में अनुभव ऐसे वैज्ञानिकों के प्रोन्नति के लिए अनिवार्य हैं जिन्हें मंत्रालयों/विभागों में नम्य पूरकता स्कीम के अधीन उच्चतर श्रेणियों में पदों पर भर्ती किया गया है । कम से कम क्रमशः दो वर्ष और पांच वर्ष का कार्यक्षेत्र का अनुभव वैज्ञानिक ' एफ ' और वैज्ञानिक ' जी ' श्रेणियों में प्रोन्नति के लिए आवश्यक होगा । तथापि, संक्रमणकाल के दौरान छानबीन समिति सराहनीय अभ्यर्थियों के मामले में इस अपेक्षा को शिथिल कर सकेगी ।

(6) नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति के लिए पूनर्विलोकन के दो भिन्न स्तर हैं । छानबीन/चयन समिति की संरचना/ गठन का ढंग वह होगा जो नीचे विनिर्दिष्ट है : -

(क) नियम 3 (5) में विनिर्दिष्ट रूप में सम्यक रूप से नियुक्त की गई छानबीन समिति द्वारा छानबीन की जाएगी । छानबीन समिति की सिफारिशों का अनुमोदन प्राधिकारी सचिव ( विज्ञान और प्रौद्योगिकी विभाग) होगा ।

(ख) ऐसे वैज्ञानिकों का जिन्होंने छानबीन प्रक्रिया उत्तीर्ण कर ली है, नियम 3 (6) में विनिर्दिष्ट रूप में सम्यक रूप से नियुक्त किए गए निर्धारण बोर्ड द्वारा साक्षात्कार । निर्धारण बोर्ड की सिफारिशें नियम 3 (7) में यथाविनिर्दिष्ट नियुक्ति प्राधिकारी को अर्थात् वैज्ञानिक ' एफ ' के स्तर तक के लिए विज्ञान और प्रौद्योगिकी के भारसाधक मंत्री और वैज्ञानिक ' जी ' के लिए एसीसी को प्रस्तुत की जाएंगी ।

7 (क) (i ) छानबीन समिति द्वारा प्रोन्नति के लिए पूनर्विलोकन एक वर्ष में दो बार प्रत्येक वर्ष 1 जनवरी और 1 जुलाई से पूर्व किया जाएगा ।

( ii ) ऐसे सभी अभ्यर्थियों का जिन्होंने पदावास की विहित अवधि पूरी कर ली है, निर्धारण बोर्ड द्वारा वर्ष में एक बार अर्थात् प्रत्येक वर्ष 1 जनवरी और 1 जुलाई के पूर्व प्रोन्नति के लिए पुनर्विलोकन किया जाएगा । इन अभ्यर्थियों पर जिन्होंने, यथास्थिति, 1 जनवरी या 1 जुलाई के पश्चात् तीन मास की अवधि के दौरान या तीन मास से पूर्व उस पद पर पदावास की अवधि पूरी कर ली है या कर लेंगे , अगली उच्चतर श्रेणी में प्रोन्नति के लिए पूनर्विलोकन के लिए उस तारीख को विचार किया जाएगा ।

( iii) जहां पर सक्षम प्राधिकारी, छानबीन समिति/निर्धारण बोर्ड की सिफारिशों पर विचार करने के पश्चात्, यह विनिश्चय करता है कि अभ्यर्थी प्रोन्नति के लिए अर्हित नहीं है तो उसका मामला छानबीन समिति के समक्ष एक वर्ष के पश्चात् रखा जाएगा ।

(ख) उन व्यक्तियों की प्रोन्नति की जिन्हें पात्र पाया गया है, प्रभावी तारीख वह तारीख होगी जो सक्षम प्राधिकारी (निर्धारण बोर्ड/ चयन बोर्ड / नियुक्ति प्राधिकारी /एसीसी) द्वारा नियत की जाए तथा किसी भी दशा में भूतलक्षी रूप से कोई भी प्रोन्नति अनुज्ञात नहीं की जाएगी । [PART II- SEC. 3 ( i ) ] 2150

(ग) जहां पात्र वैज्ञानिक विदेश सेवा/ अध्ययन छुट्टी पर भारत में या भारत से बाहर है तो भी उनके मामले पर विचार किया जाएगा और यदि उनका नम्य पूरकता स्कीम के अधीन अगली उच्चतर श्रेणी में स्वस्थाने प्रोन्नति के लिए अनुमोदन कर दिया गया है तो नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति की प्रभावी तारीख वह तारीख होगी जिसको वह विभाग में कर्तव्यभार संभालता है और उसी तारीख से उसे वित्तीय फायदे भी उपगत होंगे । साक्षात्कार में उपस्थित होने के लिए कोई भी यात्रा भत्ता/महंगाई भत्ता नहीं दिया जाएगा ।

(घ) भारत में या विदेश में प्रशिक्षण ले रहे अधिकारियों की दशा में (एफआर 51 के अधीन) उनके संबंध में नम्य पूरकता स्कीम के अधीन अगली उच्चतर श्रेणी में स्वस्थाने प्रोन्नति के लिए निम्नलिखित शर्तों के अधीन रहते हुए उस तारीख से विचार किया जाएगा जिसको वे न्यूनतम पदावास अवधि पूरा करते यदि वे प्रशिक्षण पर नहीं गए होते ।

(i ) ऐसे प्रशिक्षण की अवधि एफआर 9 (6 ) (ख) के अधीन डयूटी पर की अवधि मानी गई है और

(ii) उनका अगली उच्चतर श्रेणी में नम्य पूरकता स्कीम के अधीन स्वस्थाने प्रोन्नति के लिए अनुमोदन कर दिया गया है ।

(ङ) किसी अन्य वैज्ञानिक पद पर प्रतिनियुक्ति/विदेश सेवा पर व्यतीत की गई अवधि जो किसी वैज्ञानिक की भिन्न क्षेत्रों में वैज्ञानिक अनुभव अर्जित करने के लिए सहायता करती है और अब ज्येष्ठ वैज्ञानिक पदों पर प्रोन्नति के लिए आवश्यक कार्यक्षेत्र का अनुभव आज्ञापक कर दिया गया है, तथा शैक्षणिक प्रवीणताओं में सुधार करने के लिए अध्ययन छुट्टी/ किसी अन्य छुट्टी की अवधि, प्रसूति छुट्टी की अवधि, प्रसूति छुट्टी की निरंतरता में एक वर्ष की अधिकतम अवधि की छुट्टी तथा छुट्टी के नियमों के अनुसार एक बार में मंजूर की गई एक सौ अस्सी दिनों से अनधिक की अवधि की अर्जित छुट्टी अगली उच्चतर श्रेणी में प्रोन्नति के लिए अवर श्रेणी में आवश्यक रूप से अपेक्षित न्यूनतम पदावास की अवधि मद्दे गिनती में ली जाएगी । तथापि, गैर वैज्ञानिक पद पर प्रतिनियुक्ति/विदेश सेवा में व्यतीत की गई अवधि और चिकित्सा के आधार पर छुट्टी की अवधि, निजी आधारों पर ली गई असाधारण छुट्टी को न्यूनतम पदावास की अवधि मद्दे गिनती में नहीं लिया जाएगा ।

(च) किसी पद पर, तदर्थ सेवा / अनर्हक सेवा को छोड़कर की गई नियमित सेवाओं को नम्य पूरकता स्कीम के अधीन अगली उच्चतर श्रेणी में प्रोन्नति के लिए पूनर्विलोकन के प्रयोजन हेतु . गिनती में लिया जाएगा ।

निरर्हता : वह व्यक्ति -

(i) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ii) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

8. भर्ती किए गए जिन व्यक्तियों के पास इंजीनियरी की उपाधि है, उनका रक्षा सेवा में सेवा का दायित्व.- [भाग II- खण्ड 3 ( i) ]

इन नियमों के राजपत्र में प्रकाशन की तारीख से पूर्व, उसको या उसके पश्चात् उक्त पदों में से किसी पद पर नियुक्त कोई व्यक्ति जिसके पास इंजीनियरी की उपाधि है, यदि ऐसी अपेक्षा की जाए, किन्हीं रक्षा सेवाओं या भारत की रक्षा से संबंधित पदों पर चार वर्ष से अनधिक की अवधि के लिए, जिसके अंतर्गत प्रशिक्षण पर व्यतीत की गई अवधि है, यदि कोई हो, सेवा करनी होगी :

परन्तु यह कि ऐसे व्यक्ति से-

(क) नियुक्ति की तारीख से दस वर्ष की समाप्ति के पश्चात् इस प्रकार सेवा करने की ;

(ख) चालीस वर्ष की आयु प्राप्त करने के पश्चात् साधारणतया इस प्रकार सेवा करने की अपेक्षा नहीं की जाएगी ।

9. भारत में और भारत से बाहर सेवा करने का अधिकारियों का दायित्व :

(i) नियुक्त किए गए अधिकारी को भारत में और भारत से बाहर सेवा करनी होगी ।

(ii) नियुक्त किए गए अधिकारियों को ऐसा प्रशिक्षण लेना होगा और उन्हें प्रशिक्षण पाठ्यक्रम के लिए भारत में या विदेश में भेजा जाएगा, जो सरकार समय - समय पर विनिर्दिष्ट करे । किसी अधिकारी को जिसे ऐसे प्रशिक्षण या पाठ्यक्रम के लिए भेजा जाता है जिसकी अवधि छह मास या उससे अधिक है या किसी अधिकारी को जिसे भारत से बाहर या भारत में प्राइवेट फर्म या कारखानों में प्रशिक्षण के लिए भेजा जाता है, चाहे उस प्रशिक्षण की अवधि कुछ भी हो । यदि वह प्रशिक्षण के दौरान या ऐसे प्रशिक्षण के पूरा करने के पश्चात् तीन वर्ष की अवधि के भीतर अपनी सेवा समाप्त करना चाहता है, प्रशिक्षण का पूरा खर्च वापस करना होगा ।

10. सेवा निवृत्ति फायदे : -

( i) कोई अधिकारी जो इन नियमों के प्रारंभ के पूर्व पेंशन के लिए या अभिदायी भविष्य निधि फायदों का पात्र था ऐसे प्रारंभ से ठीक पहले उसको लागू नियमों द्वारा शासित होता रहेगा ।

(ii) इन नियमों के प्रारंभ पर या उसके पश्चात् पेंशन योग्य आधार पर भर्ती किया गया कोई अधिकारी समय - समय पर संशोधित केन्द्रीय सिविल सेवा (पेंशन) नियम, 1972 द्वारा शासित होगा । ( iii) समय - समय पर यथासंशोधित केन्द्रीय सिविल सेवा ( पेंशन) नियम , 1972 के नियम 30 के अधीन अनुज्ञेय सेवा के जोड़े गए वर्षों का फायदा इन नियमों के अंतर्गत आने वाले सभी पदों को लागू होगा ।

11. भारतीय प्रशासनिक सेवा, भारतीय विदेश सेवा और केन्द्रीय सेवाओं के लिए चिकित्सा विनियमों और चिकित्सा रिपोर्ट में यथा विनिर्दिष्ट चिकित्सा मानकों के प्रयोजनों के लिए सभी पद गैर तकनीकी पद समझे जाएंगे ।

12.. शिथिल करने की शक्ति:

जहां केन्द्रीय सरकार की यह राय हैं कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

13. व्यावृत्ति:

इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Science and Technology Group ' A ' Gazetted posts (Non Ministerial , Scientific and Technical) Rules , 1984, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the Group ' A' posts in the Department of Science and Technology, namely: -

Short-title, commencement and applications.- 1.

These rules may be called the Department of Science and Technology Group ' A ' Gazetted posts (non-ministerial , scientific and technical ) Rules , 2004. (1)

(2) They shall come into force on the date of their publication in the Official Gazette .

3. Recruitment norms.-

The method of recruitment to the said posts, age limit , qualifications and other matters connected therewith shall be as under : -

(1) The posts are selection posts .

(2) The posts are exempted from the purview of the Union Public Service Commission for the purpose of recruitment .

(3) The minimum educational qualifications for direct recruitment as well as promotee and experience for various posts shall be as under : -

(a) Essential Qualifications :

Master's Degree in Natural/Agricultural Sciences or Bachelor's degree in Engineering/Technology/Medicine from a recognised University or equivalent .

Desirable Qualifications :

( i) Experience of fifteen years in Research and Development in Industrial and Academic Institutions and/or Science and Technology Organisations , out of which seven years should be in adıninistering, planning, development or coordination of Science and Technology Programmes in the area of sciences or related areas .

( ii) Experience of evolving , managing and directing major Programmes under any branch of sciences.

(iii) Published research work of high standard .

Note:- Whoever does not have the knowledge of Hindi , he/she is required to acquire the same during his/her probation period of one year .

(4) Methods of recruitment . (a) The recruitment shall be made either by direct recruitment or absorption or deputation ( including short -term contract) basis and the particular method of recruitment for each post shall be decided by the Government in the light of the educational qualifications and the experience required for the particular post before advertising the post , keeping in view the job requirements of the same .

(b) For Ex- servicemen Deputation or re - employment basis .

( c) The methods of recruitment specified under this rule , shall be made on the recommendation of the Secretary and with the approval of Minister- in- charge , Department of Science and Technology.

(5) . Screening Committee.- Screening Committee will consist of one Chairman and two Members who will be nominated by the Secretary , Department of Science and Technology. The approving authority of the recommendation of the Screening Committee will be Secretary, Department of Science and Technology .

(6) Departmental Committee and its composition for direct recruitment or in - situ promotion under Flexible Complementing Scheme

Assessment Board : -

Chairman : To be nominated by the Secretary , Department of Science and Technology

Members : (a) One or more Departmental officers of appropriate status to be nominated by the Secretary, Department of Science and Technology .

(b) Two or more outside experts to be nominated by the Secretary , Department of Science and Technology .

Note : ( 1) At least fifty percent of total members of the board including Chairman should be from outside the Department.

(2) The members as mentioned above should be at least one level above the level for which the persons are to be considered for selection/promotion .

(3) The absence of a member of the board other than chairman shall not invalidate the proceedings of the Assessment Board .

(4) The Assessment Board shall make their recommendations on the basis of interview held and the evaluation of the past performance of the candidates.

(5) The recommendations of the Assessment Board shall be effective from the date on which the appointing authority approves the recommendations.

(7) Appointing Authority : - In the case of Scientist ' C' , Scientist ' D ' , Scientist ' E ' and Scientist ' F ' , the appointing authority will be Minister- in- charge and in case of Scientist 'G' appointing authority will be Appointment Committee of the Cabinet (ACC).

4. Direct recruitment. -

(i) The candidates possessing the educational qualifications and experience specified in Rule 3(3 ) shall be eligible for direct recruitment.

(ii) The selected candidates shall be on probation for a period of one year extendable twice by a period of 6 months maximum on each occasion .

(iii) The confirmation of the scientists shall be considered by the Departmental Committee consisting of one Chairman and three members as under: -

5 Absorption/Deputation ( including short- term contract).-

The Scientists or Technologists working in the Central or State Governments or Universities or Recognised Research Institutions or Semi Government, Statutory or Autonomous Organisations in India or abroad may be recruited on absorption or deputation (including short - term contract) basis subject to fulfillment of the following conditions : -

The Scientists or Technologists possess minimum educational qualifications and experience as specified in Rule 3 (3 ) . (i)

The Scientists or Technologists should be holding a post analogous to the post applied for or : - (ii)

(a) For Scientist ' C' : - with five years ' service in post in the scale of Rs . 8000-275- 13500/- or equivalent.

(b) For Scientist ' D ' :- with five years ' service in post in the scale of Rs . 10,000- 325-15,200 or equivalent .

(c) For Scientist 'E ' :- with five years ' service in post in the scale of Rs . 12,000- 375-16,500 or with 10 years ' service in post in the scale of Rs . 10,000-325-15,200 or equivalent .

(d) For Scientist ' F ' :- with two years ' service in post in the scale of Rs . 14,300- 400-18,300 or with seven years ' service in post in the scale of Rs . 12,000-375-16,500 or equivalent .

(e) For Scientist ' G' :- with two years ' service in post in the scale of Rs . 16,400- 450-20,000 or with four years ' service in post in the scale ofRs . 14,300-400-18,300 or equivalent .

(iii) The period of deputation , including the period of deputation in another ex - cadre post held immediately preceding this appointment in same or some other Organisation or Department of the Central Government, shall not ordinarily exceed three years , which may be extended further with the approval of the competent authority.

(iv) The departmental candidates in the feeder category , who are in the direct line of in- situ promotion under Flexible Complementing Scheme ( FCS ) shall not be eligible for consideration for appointment on deputation except for the ex- cadre post for which they are not the feeder grade officers . Similarly deputationist shall not be eligible for consideration for in- situ promotion under Flexible Complementing Scheme (FCS ) .

(v) The maximum age limit for appointment by deputation shall not exceed 56 years as on the closing date of receipt of application.

6. In-situ promotion under Flexible Complementing Scheme (FCS) .-

( 1) ( a) The system of in- situ promotion under Flexible Complementing Scheme (FCS ) shall be followed in the matter of promotion of departmental officers in the grade of Scientist ' B' , Scientist ' C' , Scientist ' D' , Scientist 'E ' , Scientist ' F ' and Scientist ' G' . If the Assessment Board finds an officer fit for in - situ promotion to the post of Scientist ' C ' , Scientist ' D' , Scientist ' E' , Scientist ' F ' and , Scientist ' G ' and such posts are not available within the sanctioned strength at that time, the promotion may be given by upgrading the posts of Scientist ' B ' to Scientist ' C' , those of Scientist ' C ' to Scientist ' D' , those of Scientist ' D ' to Scientist ' E' , those of Scientist ' E ' to Scientist ' F ' and those of Scientist ' F ' to Scientist ' G ' .

(b) There will be complete interchangeability without any restriction except that the total number of posts of Scientist ' B' , Scientist ' C' , Scientist ' D ' , scientist ' E ' , Scientist ' F ' and Scientist ' G ' put together should not exceed the total sanctioned strength .

(c) The Department of Science and Technology will be free to vary the number of posts in the different scales so as to ensure promotion of an officer from junior scale to senior scale for in - situ promotion under Flexible Complementing Scheme ( FCS ) and proven merit and record of research will be the only criteria .

(d) In- situ promotions under Flexible Complementing Scheme (FCS) will be personal to the officer concerned and would not result in specific vacancy in the lower grade on that account. The post being currently held by the concerned officer will be upgraded automatically and personal to him for the duration of his stay in the in - situ promotion post. The post will revert to the original level once the officer vacates the higher post by superannuation , resignation or otherwise .

(e) No person other than a person possessing the essential educational qualifications of at- least a Master's Degree in Natural/Agricultural Sciences or a Bachelor's Degree in Engineering or Technology or Medicine , shall be eligible for in - situ promotion under the Flexible Complementing Scheme .

(f) The Flexible Complementing Scheme shall be made applicable only to scientists and Technologists holding scientific posts and who are engaged in scientific activities and services . The assessment norms for in-situ promotions under Flexible Complementing Scheme shall be rigorous with due emphasis on evaluation of scientific and technical knowledge so that only the scientists who have to their credit demonstrable achievements or higher level of technical merit will be recommended for promotion under the Flexible Complementing Scheme .

(2) The scales of pay to which the Flexible Complementing Scheme(FCS ) shall apply, the minimum residency period linked to performance for in- situ promotion to the next higher grade and the uniform designations of the scientific and technical posts covered by the Flexible Complementing Scheme shall be as given in the table below: -

Provided that as a one time measure the Principal Scientific Officers ( PSOs ) now Scientist 'D' who were in position as such on 09.11.1998 and were earlier considered for promotion to the grade of Rs . 5100-6300 (pre- revised ) from the scale of pay of Rs.3700-5000 (pre - revised) directly will continue to be considered for promotion to the revised grade of Rs . 16,400-20,000 ( pre - revised Rs . 5100-6300) after completion of the eligibility service of five years as prescribed in the Rules that existed prior to amendment. The Scientist ' D ' ( formerly Principal Scientific Officers ) , while being considered for promotion directly to the grade of Scientist ' F ' on completion of the eligibility service of five years prescribed in the Rules in force prior to 09.11.1998 are required to be assessed only with reference to the revised assessment norms which inter alia, lay down as below para (3 ) of this Rule, the minimum percentage of 85 % for screening / assessment for promotion at the first opportunity.

(3) All officers will be first screened on the basis of gradings in the Annual Confidential Reports (ACRs) for consideration for promotion ; the ACRs should be assessed on a 10 point scale giving 10 marks for " outstanding " , 8 marks for " very good " , 6 marks for " good " , 4 marks for "average" and 0 marks for " poor " and only those officers who satisfy the minimum residency period linked to their performance as indicated in the table below be screened in: -

Note 2 : Exceptionally meritorious candidates with all outstanding gradings may be considered for relaxation in the residency period , the relaxation being not more than one . year on any single occasion . Such a relaxation will be limited to maximum of two occasions in their entire career .

(4) All officers who are screened in willbe called for an interview . The performance in the interview will also be graded similarly on a 10 point scale and the eligibility for promotion will be base on the same norms as in the Table above .

(5) Field experience in research and development and or experience in implementation of such scientific projects is compulsory for promotion of scientists recruited to the posts in the Ministries /Departments to higher grades under Flexible Complementing Scheme (FCS) . Field experience of at least two years and five years respectively will be essential for promotion to Scientist ' F ' and Scientist ' G ' grades respectively . However , during the transitional period , Screening Committee may relax this requirement in case of meritorious candidates .

(6) There are two distinct phases of Review for in - situ promotion under Flexible Complementing Scheme. The composition/ mode of constitution of the Screening /Selection shall be as specified below: -

(a) Screening by the duly appointed Screening Committee as specified in Rule 3(5) . The approving authority of the Screening Committee's recommendations will be Secretary (Department of Science and Technology).

(b) Interview by the duly appointed Assessment Board as specified in Rule 3(6) of those who qualify in the Screening procedure. The recommendations of Assessment Board shall be submitted to the Appointing Authority as specified in Rule 3(7) i.e. Minister- in- charge for Science and Technology upto the level of Scientist 'F ' and ACC for Scientist 'G ' .

(7) (a) (i) Review for promotion by the Screening Committee shall be done twice a year- before 1st January and 1st July of every year.

(ii) All candidates who have completed the prescribed period of residency will be reviewed for promotion by the Assessment Board twice a year i.e. before 1st January and 1st July of every year . Those who have completed or will complete the prescribed period of residency in a post during a period of three months before or three months after 1st January or 1st July, as the case may be , will be considered as on that date for review for promotion to the next higher grade.

( iii ) Where the competent authority , on consideration of the recommendations of the Screening Committee/ Assessment Board, decides that a candidate does not qualify for promotion, his /her case will be placed before the Screening Committee after one year .

(b) The effective date of promotion of those found eligible shall be date as fixed by the competent Authority (Assessment Board/ Selection Board/ Appointing Authority / ACC) and no promotion with retrospective effect shall be admissible in any case.

(c) Where eligible scientists are on foreign service/study leave in India or abroad , their case will be considered and if they have been approved for in- situ promotion under Flexible Complementing Scheme ( FCS ) to the next higher grade , the effective date of in - situ promotion under Flexible Complementing Scheme (FCS) will be from the date 3190 GI/04-5 [PART II-SEC. 3 (i ) ] 2160

of resumption of duty in the Department and financial benefit will accrue from the same date . No Travelling Allowance /Dearness Allowance will be provided to attend the interview .

(d) In case of officers undergoing training/study leave/deputation in India or abroad (under FR 51 ), they shallbe considered for in - situ promotion under Flexible Complementing Scheme ( FCS ) to the next higher grade with effect from the date they would have completed the minimum residency period had they not proceeded on training subject to the following conditions: -

(i) the period of such training is treated as on duty under FR 9 (6) (b) and

(ii) they have been approved for in - situ promotion under Flexible Complementing Scheme ( FCS ) to the next higher grade .

(e) The period spent on deputation/ foreign service to another Scientific post, which helps a Scientist to acquire Scientific experience in a diverse set and the necessary field experience now made mandatory for promotion to Sr. Scientific posts , as well as the period of study leave/ any other leave taken for improving the academic accomplishments , the period of Maternity leave , leave of a maximum period of one year in continuation of Maternity leave and Earned leave for a period not exceeding 180 days at a time sanctioned as per leave Rules, shall count towards the minimum residency period necessarily required to be put up in the lower grade for promotion to the next higher grade . However, the period spent on deputation / foreign service to a non - scientific post and the period of leave on medical ground, Extra Ordinary Leave etc. availed on personal grounds shall not count towards the minimum residency period .

(f) The regular services rendered , excluding ad - hoc service/non - qualifying service , in a post shall count for the purpose of review for promotion to the next higher grade under the Flexible Complementing Scheme (FCS ) .

7. Disqualification.- No person,

(i) who has entered into or contracted a marriage with a person having a spouse living; or ( ii ) who, having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to any of the said posts .

Provided that the Central Government, may , if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

8. Liability to serve in the Defence Services for recruits with Engineering degrees.-

Any person with a degree in Engineering appointed to any of the said posts before , on or after the date of publication of these rules in the Official Gazette, shall, if so required, be liable to serve in any Defence Service or posts connected with the Defence of India for a period not more than four years including the period , if any , spent on training :

Provided that such person shall not be required

(a) to serve as aforesaid after expiry of ten years from the date of appointment ;

(b ) ordinarily, to serve as aforesaid after attaining the age of forty years .

9. Liability of officers to serve In India and outside.

Officers appointed shall be liable to serve anywhere in India and outside .

14.

(ii) Officers appointed shall be liable to undergo such training and be detailed on courses of instruction in India or abroad as the Government may decide from time to time. An Officer detailed for training or course, the duration of which is six months or more or an officer detailed for training outside India or with private firms or factories in India, irrespective of the duration of the training, shall be liable to refund in full the cost of training, if, for any reason , during the training , or within a period of three years after the completion of such training , he chooses to discontinue his service.

10. Retirement benefits.-

(i) An officer who, before the commencement of these rules was eligible for pension or contributory Provident Fund benefits , shall continue to be governed by the rules applicable to him immediately before such commencement .

(ii) An officer recruited on or after the commencement of these rules, on pensionable basis, shall be governed by the Central Civil Service (Pension ) Rules , 1972 as amended from time to time .

( im) The benefit of added years of service admissible under Rule 30 of the Central Civil Service (Pension) Rules , 1972 as amended fromto time, shall be applicable to all the postscovered under these rules .

11. All posts shall be deemed to be non- technical posts for purposes of Medical standards as specified in the Medical Regulations and Medical Report for the Indian Administrative Service, Indian Foreign Service and the Central Services .

12. Power to relax.-

Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

13. Saving.-

Nothing in these rules shall affect reservations and other concessions required to be provided for Scheduled Castes and Scheduled Tribes , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

सा.का.नि. 383.- नागर विमानन मंत्रालय के तहत एक स्वायत्त संगठन , इंदिरा गांधी राष्ट्रीय उड़ान अकादमी ( इगुआ) के नियमों और विनियमों के नियम 9.1 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए , और निदेशक , इंदिरा गांधी राष्ट्रीय उड़ान अकादमी भर्ती नियम , 2003 का अधिक्रमण करते हुए , केन्द्र सरकार एतद् द्वारा निदेशक , इगुआ के पद पर भर्ती के तौर तरीकों को विनियमित करने वाले निम्नलिखित नियम बनाती है:

लघु शीर्षक एवं लागू होनाः 1.

(i ) इन नियमों को निदेशक , इन्दिरा गांधी राष्ट्रीय उड़ान अकादमी भर्ती नियम, 2004 कहा जाएगा ।

ये सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे। (ii )

2. पद संख्या , वर्गीकरण और वेतनमानः

उक्त पद की संख्या, इसका वर्गीकरण और इससे जुड़ा वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम 2 से 4 यथा विनिर्दिष्ट होंगे ।

3. भर्ती पद्धति, आयु- सीमा और अन्य अर्हताएं , आदिः

उक्त पद पर भर्ती की पद्धति, आयु- सीमा अर्हताएं और उनसे संबंधित अन्य मामले उक्त अनुसूची के कालम 5 से 14 में विनिर्दिष्ट होंगे ।

4. निरर्हताः वह व्यक्तिः-

5. शिथिल करने की शक्तिः जहाँ केन्द्रीय सरकार का यह मत है कि ऐसा करना आवश्यक था समीचीन है , वहां लिखित में रिकार्ड किये जाने वाले कारणों से , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग की बावत आदेश द्वारा शिथिल कर सकेगी । [ भाग II- खण्ड 3 (i ) ]

5. Power of relaxation: Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving Nothing in these rules shall affect reservations , relaxation of age limit and other concession required to be provided for the Scheduled Castes , Scheduled Tribes , the Other Backward Classes, Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
