सा.का.नि. 388.- राष्ट्रपति, सविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सागर सम्पदा सैल, कोचीन (फिशिंग मास्टर ) भर्ती नियम , 1993 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , महासागर विकास विभाग में फिशिंग मास्टर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम महासागर विकास विभाग , फिशिंग गियर तकनीशिन भर्ती नियम, 2004 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से 14 में विनिर्दिष्ट हैं ।

4. निरर्हताएं. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए, किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. - इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2: अनुभव संबंधी अर्हता (अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

भर्ती की पद्धति: भर्ती सीधे होगी या

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति या प्रतिनियुक्ति/ आमेलन किया जाएगा

प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति या प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है )

प्रोन्नति या प्रतिनियुक्ति( जिसके अंतर्गत अल्पकालिक संविदा भी है ) जिसके न हो सकने पर सीधी भर्ती द्वारा ।

(क ) केन्द्रीय सरकार या राज्य सरकारों या पब्लिक सेक्टर के उपक्रमों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधान संस्थाओं या अर्ध सरकारी या कानूनी या स्वायत्त संगठनों के अधीन ऐसे अधिकारी: -

(क) ( i ) मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) जिन्होंने मूल काडर या विभाग में 8000-275-13500 रुपए या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में पांच वर्ष सेवा की हो; या

( iii ) जिन्होंने मूल काडर या विभाग में 6500-200-10500 रुपए या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में आठ वर्ष सेवा की हो; और

(ख) जो स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों:

ख ऐसे विभागीय फिशिंग मास्टर ( कनिष्ठ) जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की हो, पर भी बाहरी व्यक्तियों के साथ विचार किया जाएगा । यदि उस पद पर नियुक्तिके लिए उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा । (पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । ) प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति कीअवधि है साधारणतया चार वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहींहोगी । ) 2188

G.S.R. 388.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Sagar Sampada Cell , Cochin (Fishing Master ) , Recruitment Rules 1993 , cxcept as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method ofrecruitment to the post of Fishing Master in the Departinent of Ocean Development , namely:-

1. Short title and commencement.---( 1 ) These rules may be called the Department of Ocean Development , Fishing Master Recruitment Rules, 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment , age limit , qualification etc. The method of recruitment to the said post , age limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14) of the said Schedule .

4. Disqualification . No person,-- (a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, cxempt any person from the operation of this rulc.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class- or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes and Scheduled Tribcs , the Other Backward Classes , Ex -servicemen and other special categories of persons in accordance with the order issued by the Central Government from time to time in this regard .

Note 2 : The qualifications regarding experience are relaxable at the discretion of the Union Public Service Commission in the case of candidates belonging to Scheduled Castes and the Scheduled Tribes ifat any stage of selection the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the post reserved for them.

B. The Departmental Fishing Master ( Junior) with five years' regular service in the grade will also be considered along with outsiders. In case, he is selected for appointment to the post, it shall be deemed to have been filled by promotion.

The Departmental officers in the fceder category who are indirect line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationist shall not be eligible for consideration for appointment by promotion.

(Theperiod of deputation including the period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some otherOrganization or Department of the Central Government shall ordinarily not exceeding four years ) . The maximum age - limit for appointment on deputation shall be not exceeding 56 years as on the closing date of receipt ofapplications.)

ख 4500-125-7000 रु. के वेतनमान में ऐसे विभागीय फिशिंग हैंड जिसने उस श्रेणी में तेरह वर्ष नियमित सेवा की हो, और स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आवश्यक अर्हताएं और अनुभव रखता हो, भी पद के लिए आवेदन कर सकता है, उस पर भी बाहरी व्यक्तियों के साथ विचार किया जाएगा । यदि उस पद पर नियुक्ति के लिए उसका चयन हो जाता है तो वह प्रोन्नति द्वारा भरा गया समझा जाएगा ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in superscssion of the Sagar Sampada Cell , Cochin (Fishing Master) ( Junior) , Recruitment Rules , 1993 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Fishing Master ( Junior) in the Department of Ocean Development, namely: ---

1. Short title and commencement.-( 1 ) These rules may be called the Department of Ocean Developinent , Fishing Master ( Junior ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2.Number of posts , classification and scale of pay. The number of the post , its classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4) of the Schedule hereto annexed to these rules .

3.Method of recruitment , age limit , qualifications etc.The method of recruitment to the said post , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule .

4. Disqualifications . No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living has entered into or contracted a marriage with any person ,

shall be cligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. The Departmental Fishing Hand in the scale of Rs . 4500-125-7000 with thirteen years regular service in the grade and possessing the essential qualifications and experience prescribed for direct recruits under column ( 8 ) may also apply for the post . He will be considered along with outsiders . In case he is selected for appointmentto the post , it shall be deemed to have been filled by promotion.

The Departmental Officers in the feeder category who are in direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointmentby promotion .

सा.का.नि. 390.- राष्ट्रपति, सविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सागर सम्पदा सैल, कोचीन (फिशिंग गियर तकनीशियन ) भर्ती नियम, 1993 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , महासागर विकास विभाग में फिशिंग गियर तकनीशियन के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम महासागर विकास विभाग , फिशिंग गियर तकनीशियन भर्ती नियम, 2004है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान - उक्त पद की संख्या , उसका वर्गीकरण और उनका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हताएं. वह व्यक्ति, -

( क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

सा.का.नि. 391.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पूर्व इस्पात और खान मंत्रालय ( इस्पात विभाग ) ( समूह ग ) भर्ती नियम , 1986 को , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है, इस्पात मंत्रालय में स्टाफ कार ड्राइवर, ज्येष्ठ गेस्टेटनर प्रचालक और सवार हरकार ( समूह ग ) के पदों पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ.-( 1 ) इन नियमों का संक्षिप्त नाम इस्पात मंत्रालय ( समूह ' ग ' पद) भर्ती नियम, 2004 है । ( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान.- उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा और अर्हवाएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी , जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति ,-

(क) जिसने ऐसे व्यक्ति से जिसकी पत्नी/ पति जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा , शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

ऐसे कनिष्ठ गेस्टेटनर प्रचालक, जिसने नियमित आधार पर उस श्रेणी में दो वर्ष सेवा की है, जिसके न हो सकने पर ऐसे कनिष्ठ गेस्टेटनर प्रचालक द्वारा, जिसने कनिष्ठ गेस्टेटनर प्रचालक या दफ्तरी या जमादार की श्रेणियों में चार वर्ष की नियमित सम्मिलित सेवा की हो।

प्रतिनियुक्ति:

केन्द्रीय सरकार के अधीन ऐसे अधिकारी जो सदृश पद धारण किए हुए हैं या 2750-70- 3800-75-4400 रुपए के वेतनमान में कम से कम दो वर्ष नियमित सेवा के साथ गेस्टेटनर मशीन प्रचालन का अनुभव रखते हों ।

यदिविभागीय प्रोन्नति समिति है तो उसकी संरचना

टिप्पण: अनुभव संबंधी अर्हता ( सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जन जातियों के अभ्याथियों की दशा में तब शिथिल की जा सकती है । जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

आमेलन या प्रतिनियुक्ति :

आमेलन या पुनर्नियोजन या प्रतिनियुक्ति द्वारा, जिसके न हो सकने पर सीधी भर्ती द्वारा ।

इस्पात मंत्रालय ऐसे नियमित कर्मचारियों में से, जो नियमित आधार पर सवार हरकारा का. पद धारण किए हुए हैं और ऐसे नियमित समूह ' घ ' कर्मचारियों में से जो मोटर कार चलाने का निर्धारण के लिए चालन चलाने सक्ष्मता परीक्षण के आधार पर मोटर कार चलाने की विधिमान्य चालन अनुज्ञप्ति रखते हों, जिसके न हो सकने पर केन्द्रीय सरकार के किसी अन्य मंत्रालयों या विभागों में नियमित आधार पर नियुक्त किए गए ऐसे अधिकारियों में से जो सीधी भर्ती किए जाने वाले व्यक्ति के लिए अपेक्षित अर्हताएं और अनुभव पूरा करते हैं ।

सशस्त्र बल के भूतपूर्व सैनिकों के लिए ( आमेलन या प्रतिनियुक्ति)

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रतिनियुक्ति किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक अर्हताएं और अनुभव हैं, पर भी विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । 2203 भारत का राजपत्र : नवम्बर 20 , 2004/ कार्तिक 29 , 1926

G.S.R. 391. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Ministry of Steel and Mines ( Department of Steel ) ( Group ' D ' ) Recruitment Rules , 1982 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Staff Car Driver, Senior Gestetner Operator and Despatch Rider (Group ' C' ) in the Ministry of Steel , namely: ---

1. Short title and commencement. These rules may be called the Ministry of Steel ( Group ' C' ) posts Recruitment Rules , 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment age limit , qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns ( 5) to ( 14) of the said Schedule .

4. Disqualification. No person ,-

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - Serviceman and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 392.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्लास्टर कक्ष तकनीकी, कलावती सरन बाल चिकित्सालय , नई दिल्ली, के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम , कलावती सरन बाल चिकित्सालय, नई दिल्ली, प्लास्टर कक्ष तकनीकी, समूह ' ग ' पद भर्ती नियम, 2004 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा , शैक्षिक अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 392. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Plaster Room Technician in the Kalawati Saran Children Hospital, New Delhi , namely

1. Short title and commencement .-( 1 ) These rules may be called the Kalawati Saran Children Hospital , New Delhi, PlasterRoom Technician , Group ' C' posts , Recruitment Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit , qualifications , etc. The method of recruitment ,, age limit , qualifications and other matters relating to the said post shall be as specified in columns ( 5) to (14) of the said Schedule.

4. Disqualification . No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any other person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex- Servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

प्रोन्नति :- ऐसे ज्येष्ठ तकनीशियन ( 5500-9000 रुपए ) जिन्होंने नियमित आधार . पर उस श्रेणी में तीन वर्ष की नियमित सेवा की है ।

टिप्पण : -जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

G.S.R. 394. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Central Water and Power Research Station, Pune (Superintendent) Recruitment Rules, 1983 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Superintendent in the Central Water and Power Research Station , Pune under the Ministry of Water Resources , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Central Water and Power Research Station, Pune (Superintendent ) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scales of pay. The number of post , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment , age limit, and other qualifications etc.---The method of recruitment, to the said post, age limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to (14) of the said Schedule .

4. Disqualification. No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Governinent may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the other backward classes , the Ex - Serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
