1908( 1908 का 5 ) की पहली अनुसूची के आदेश 27 के नियम ४ख के खंड ( क ) के अनुसरण में और भारत सरकार के तत्कालीन विधि, न्याय और कंपनी कार्य मंत्रालय के विधि कार्य विभाग की अधिसूचना, जो भारत के राजपत्र, भाग II , खंड 3 , उपखंड ( i ) में सा. का. नि. 404 तारीख 4 अगस्त, 2001 के तहत प्रकाशित की गई थी, को उन बातों के सिवाय अधिक्रान्त करते हुए जो ऐसे अतिक्रमण से पूर्व की गई थी या किए जाने से जिनका लोप किया गया था, श्री दिनेश भारद्वाज , उप विधि सलाहकार को दिल्ली उच्च न्यायालय के लिए केन्द्रीय सरकार द्वारा या उसके विरूद्ध किसी सिविल वाद या अन्यथा के संबंध में उक्त आदेश के प्रयोजनों के लिए सरकारी प्लीडर नियुक्त करती है ।

R. 442.- In pursuance of clause (a) ofrule 8V of Order XXVII of the First Schedule to the Code ofCivil Procedure, 1908 ( 5 of 1908) and in supersession of the notification of the Government of India in the erstwhile Ministry ofLaw, Justice and Company Affairs, Department ofLegal Affairs , published in the Gazette of India , Part II Section 3 , sub - section (i ) , vide G.S.R. 404 dated the 4th August, 2001 , except as respects things done or omitted to be done before such supersession , the Central Government hereby appoints Shri Dinesh Bhardwaj , Deputy Legal Adviser , as Government Pleader in relation to any civil suit or otherwise by or against the Central Government for the High Court of Delhi , for the purposes of the said order.

सा. का. नि. 443. भारतीय प्रशासनिक सेवा ( संवर्ग ) नियमावली, 1954 के नियम 4 के उप नियम ( 2 ) के साथ पठित, अखिल भारतीय सेवाएं अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार झारखण्ड सरकार के परामर्श से, भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियमावली , 1955 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थात्:-

1. ( i) इन विनियमों का नाम भारतीय प्रशासनिक सेवा (संवर्ग पद संख्या का नियतन ) अष्टम संशोधन विनियमावली, 2004 है ।

(ii ) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियमावली, 1955 की अनुसूची में, " झारखण्ड" शीर्षक और उसके नीचे आने वाली प्रविष्टियों के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्: -

सा.०का० नि० 445 केन्द्रीय सरकार, कंपनी अधिनियम, 1956 ( 1956 का 1 ) की धारा 594 की उपधारा ( 1 ) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारत सरकार के तत्कालीन वित्त मंत्रालय ( कंपनी विधि प्रशासन विभाग ) की अधिसूचना सं०का०नि०आ ० 3216 तारीख 4 अक्तूबर, 1957 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है ) का आंशिक उपान्तरण करते हुए, यह निदेश करती है कि मैसर्स आगा खां फाउंडेशन, सरोजिनी हाऊस , दूसरा तल, 6 भगवान दास रोड, नई दिल्ली ( जिसे इसमें इसके पश्चात् कंपनी कहा गया है ) , जो एक विदेशी कंपनी है , के मामले में उक्तअधिसूचना द्वारा किसी विदेशी कम्पनी के लिए उनको लागूहोने में यथा उपांतरित उक्त धारा 594 की उपधारा ( 1 ) के खंड ( क) की अपेक्षाएं निम्नलिखित और अपवादों तथा उपांतरणों के अधीन रहते हुए लागूहोंगी , अर्थात्:-

धारा 594 की उपधारा ( 1 ) के खंड ( क ) के उपबंधों की पर्याप्त अनुपालना समझी जाएगी यदि कंपनी 1 जनवरी , 2003 से प्रारंभ होने वाली और 31 दिसंबर, 2003 को समाप्त होने वाली अवधि की बाबत अपने भारतीय कारबार लेखाओं की बाबत निम्नलिखित तीन प्रतियों में समुचित कंपनी रजिस्ट्रार को प्रस्तुत करती है : -

(i ) निम्नलिखित द्वारा प्रमाणित ऐसी कंपनी की भारतीय शाखाओं द्वारा प्राप्तियों और किए गए संदायों का विवरण 2366

(क) उक्त अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड (घ) के अधीन भारत में आदेशिका की तामील के प्रतिग्रहण के लिए प्राधिकृत व्यक्ति; और

(ख) भारत में व्यवसाय करने वाला चार्टर्ड एकाउंटेंट;

M/s . Aga Khan Foundation , Sarojini House , 2nd Floor , 6 Bhagawan Das Road, New Delhi (hereinafter referred to as the company) being a foreign company , the requirements of clause (a ) of Sub- section ( 1 ) of the said Section 594 as modified in their application to a foreign company by the said notification shall apply subject to the following further exceptions and modifications, namely:-

यह प्रमाणित करते हुए कि उक्त विवरण 1 जनवरी , 2003 से प्रारंभ होने वाली और 31 दिसंबर, 2003 को समाप्त होने वाली अवधि के लिए भारत में कंपनी की प्रप्तियों और संदायों का सही और ऋजु चित्र प्रस्तुत करता है;

(ii ) निम्नलिखित द्वारा प्रमाणित भारत में कंपनी की आस्तियों और दायित्वों का विवरण

Itshall be deemed to be sufficient compliance with the provisions of clause (a) of Sub- section ( I ) of the Section 594, if, in respect of the period commencing from the 1st day of January , 2003 and ending on the 31st day of December, 2003 , the company in respect of its Indian Business Accounts submits to the appropriate Registrar ofCompanies in India , in triplicate:-

(i) astatement of receipts and payments made by the Indian branches of such company, certified by-- (क) उक्त अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड (घ ) के अधीन भारत में आदेशिका की तामील के प्रतिग्रहण के लिए प्राधिकृत व्यक्ति; और

(ख ) भारत में व्यवसाय करने वाला चार्टर्ड एकाउंटेंट;

(a) a person authorised to accept service of process in India under clause (d) of Sub- section ( 1 ) of Section 592 of the said Act; and

(b) a Chartered Accountant practising in India:

यह प्रमाणित करते हुए कि उक्त विवरण 1 जनवरी, 2003 से प्रारंभ होने वाली और 31 दिसंबर, 2003 को समाप्त होने वाली अवधि कीसमाप्तिपर भारत में कंपनी के कार्यकलाप की स्थिति का सही और ऋजु चित्र प्रस्तुत करता है;

certifying that the said statement gives a true and fair view of the receipts and payments of the company in India for the period conintencing from the 1st day of January , 2003 and ending on the 31st day of December 2003 ;

(ii) a statement of the company's assets and liabilities inIndia certified by-

( iii ) अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड ( घ ) के अधीन भारत में आदेशिका की तामील के प्रतिग्रहण के लिए प्राधिकृत व्यक्ति द्वारा सम्यक् रूप से हस्ताक्षरित यह प्रमाणित करते हुए, एक प्रमाण पत्र कि 1 जनवरी , 2003 से प्रारंभ होने वाली और 31 दिसंबर, 2003को समाप्त होने वाली अवधि के दौरान भारत में कंपनी ने कोई व्यापारिक या विनिर्माण , वाणिज्यिक या औद्योगिक क्रियाकलाप नहीं किया है ।

(a) aperson authorised to accept service of process in India under clause ( d) of Sub- section ( 1 ) of Section 592 of the said Act ; and

(b) a Chartered Accountant practising in India:

सा. का. नि. 446.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और स्वास्थ्य और परिवार कल्याण मंत्रालय , स्वास्थ्य सेवा महानिदेशालय के अधीन खाद्य अनुसंधान और मानकीकरण प्रयोगशाला, गाजियाबाद में ( प्रयोगशाला सहायक ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम , स्वास्थ्य और परिवार कल्याण मंत्रालय, स्वास्थ्य सेवा महानिदेशालय के अधीन खाद्य अनुसंधान और मानकीकरण प्रयोगशाला, गाजियाबाद ( प्रयोगशाला सहायक ) समूह ' ग ' पद भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं । 4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किम्नी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. -इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 446. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to post of (Laboratory Assistant ) in Food Research and Standardisation Laboratory, Ghaziabad under the Directorate of General of Health Services, Ministry of Health and Family Welfare, namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Health and Family Welfare , Food Research and Standardisation Laboratory , Ghaziabad (Laboratory Assistant ) Group ' C ' post under the Directorate General ofHealth Services , Recruitment Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of the post , its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit, qualifications , etc.- The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any other person , shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient soto do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex - Servicemen , other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

किसी मान्यताप्राप्त संस्थान से ई.ई.जी. प्रयोगशाला प्रौद्यो- गिकी में डिप्लोमा ।

केन्द्रीय सरकार के विवेकानुसार अनुसूचित जातियों/अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर केन्द्रीय सरकार की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहींहै ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा ।

G.S.R. 448. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of E.E.G. Technician in the Jawaharlal Institute ofPost Graduate Medical Education and Research, Pondicherry , namely :-

1. Short title and commencement .--( I ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Education and Research , Pondicherry, E.E.G. Technician (Group ' C ' post), Recruitment Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications , etc.-The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Ex- Servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम कलावती सरन बाल चिकित्सालय , नई दिल्ली, ( वाक् चिकित्सक) ( समूहं " ग " पद) भर्ती नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हता और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता: वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं , विवाह किया है ,

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्तिं जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 450.- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Regional Leprosy Training and Research Institute , Gouripur, West Bengal (Administrative Officer) Group -B , Gazetted post, recruitment Rules, 2003 , namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Regional Leprosy Training and Research Institute , Gouripur, West Bengal (Administrative Officer ) Group -B , Gazetted post, recruitment (Amendment ) Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In rule 6 of the Regional Leprosy Training and Research Institute , Gouripur , West Bengal ( Administrative Officer) Group -B, Gazetted post , recruitment Rules , 2003 for rule 6, following rules shall be substituted , namely :-

"6. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do, it may , for reasons to be recorded in writing and in consultation with Union Public Service Commission , relax any of the provisions of these rules in respect of any class or category of persons .

सा. का. नि. 451.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्रादेशिक कुष्ठ प्रशिक्षण और अनुसंधान संस्थान , रायपुर में सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम, स्वास्थ्य और परिवार कल्याण मंत्रालय , प्रादेशिक कुष्ठ प्रशिक्षण और अनुसंधान संस्थान, रायपुर ( सहायक) , समूह ' ग ' पद, भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. - उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि.-उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 2382

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute, Raipur (Assistant ) , Group C post, Recruitment Rules, 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , Classification and Scale of Pay. The number of said post, its classification and scale of pay attached thereto , shall be as specified in column (2) to (4) of the Schedule annexed to these rules .

3. Method of Recruitment , age limit , qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in Columns (5) to (14) of the said Schedule.

4. Disqualification . No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post.

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so , to do it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Caste, the Scheduled Tribes , and other special categories of persons , in accordance withthe orders issued by the Central Government from time to time in this regard.

संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है (हैं ) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय , अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड , त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्यख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ।)

भर्ती की पद्धति: भर्ती सीधे होगी या

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

संयुक्त पद्धति ( प्रतिनियुक्तिऔर प्रोन्नति)

प्रतिनियुक्ति( जिसके अंर्तगत अल्पकालिक संविदा भी है ) या प्रोन्नति:

जिनके न हो सकने पर सीधी भर्ती द्वारा ।

( 1 ) केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या विश्वविद्यालयों या मान्यता- प्राप्त अनुसन्धान संस्थानों या पब्लिक सेक्टर के उपक्रमों या अर्ध सरकारी या कानूनी या स्वायत्तशासी संगठनों के अधीन ऐसे अधिकारियों से:

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए

हैं; या

( ii ) जिन्होंने मूल काडर/विभाग में 10,000-15,200 रुपये या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष सेवा की है; और (ख ) जिनके पास स्तम्भ ( 8 ) के अधीन सीधी भर्ती के लिए विहित शैक्षिक अर्हताएं और अनुभव हो ।

(2) 10,000-15,200 रु ० के वेतन विभागीय उप निदेशक ( प्रशासन ) , जिसने पांच वर्ष नियमित सेवा की हो, पर भी प्रतिनियुक्ति व्यक्तियों के साथ विचार किया जायेगा और यदि उसका उक्त पद पर चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा गया समझा जाएगा ।

पोषक वर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

(प्रतिनियुक्ति की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधिहै साधारणतया चार वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्तिद्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ) [ भाग II- खण्ड 3 (i ) ]

प्रोन्नति : 6500-10500 रु ० वेतनमान के ऐसे सहायक प्रशासनिक अधिकारी, जिसने उस श्रेणी में आठ वर्ष नियमित सेवा की है ।

प्रतिनियुक्ति (जिसके अंर्तगत अल्पकालिक संविदा भी है ) :

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , जिसके अंतर्गत अल्पकालिक संविदा भी है , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

पोषक वर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture , the Directorate of Extension, [ Vistar Nideshalaya) , Director ( Administration) , Recruitment Rules, 1984 and Deputy Director ( Administration) , Recruitment Rules, 1979, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Director (Administration) and Deputy Director (Administration ) in the Directorate of Extension under the Ministry of Agriculture (Department of Agriculture and Cooperation ) , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Agriculture , Directorate of Extension, Director (Administration) and Deputy Director (Administration) Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application. These rules shall apply to the posts as specified in column ( 1 ) of the Schedule annexed to these rules.

3. Number of post, classification and scale of pay. The number of the said post, their Classification and the scale ofpay attached thereto shall be as specified in columns (2) to ( 4 ) of the said schedule.

4. Method of recruitment , age limit and other qualifications , etc.-The method ofrecruitment , age limit, qualifica- tions and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said schedule .

5. Disqualification.-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, and for reasons to be recorded in writing , and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , the Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2004है। 1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम , कृषि और सहकारिता विभाग, ड्राफ्टसमैन ( ग्रेड-1 ) , भर्ती नियम, (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे

2. पद संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या, उनका वर्गीकरण और उनसे संबंधित वेतनमान वही होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा , और अन्य अर्हताएं. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

[PART II-SEC . 3 (i) ] परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिसका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

पोषक वर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिएविचार किए जाने के पात्र नहीं होंगे ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में

जिन्होंने अपनी अर्हक/ पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा, परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा का, अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है ।

3. Method of recruitment , age limit and other qualifications , etc.-The method of recruitment , to the said post age limit, qualifications and other matters relating thereto shall be as specified in columns ( 5 ) to ( 14 ) of the said schedule.

4. Disqualification.-No person-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any erson from the operation of this rule.

Power to relax.-Where the Central Government is of the opinion that it is necesary or expedient so to do, it may , by order , and for reasons to be recorded in writing , and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , the Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The departmental officers in the feeder categorywho are in the direct line ofpromotion shall not be eligible for consideration for appointment on deputation . Similarly , deputationists shall not be eligible for consideration for appointment by promotion . Note: Where Junior who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short ofthe requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years , whichever is less, and have successfully completed their probation period forpromotion to the next higher grade along with their juniors who have already completedsuch qualifying/ eligibility service.
