भारत सरकार के मंत्रालयों ( रक्षा मंत्रालय को छोड़कर ) और केन्द्रीय अधिकारियों ( संघ राज्य क्षेत्र प्रशारानों को छोड़कर ) द्वारा विधि के अंतर्गत बनाए और जारी किए गए साधारण सांविधिक नियम ( जिनमें साधारण प्रकार के आदेश , उप- नियम आदि सम्मिलित हैं ) General Statutory Rules (Including Orders , Bye- laws etc. of a general character) issued by the Ministries of the Government of India (other than the Ministry of Defence ) and by the Central Authorities (other than the Administrations of Union Territories)

सा.का.नि. 24.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सीमा सुरक्षा बल में इलैक्ट्रोनिक आंकड़े प्रक्रमण समूह " ख " और समूह " ग " ( अराजपत्रित ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं ।

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल , इलैक्ट्रोनिक आंकडे प्रक्रमण समूह " ख " और समूह " ग " ( अराजपत्रित ) पद भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2.लागूहोना:-ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो उक्त अनुसूची के स्तंभ (2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि.- उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

PART II Scc. 3 (i )) 5. आरंभिक गठन: उक्त अनुसूची के स्तम्भ ( 1 ) में दर्शित पदों के ऐसे पदधारी जिनकी पद पर नियुक्ति इन नियमों के प्रारम्भ की तारीख से पहले हुई थी, इन नियमों के अधीन नियमित आधार पर नियुक्त समझे जाएंगे और उनके द्वारा उक्त प्रारम्भ से पहले उक्त पदों पर की गई सेवा अगली उच्चतर श्रेणी में प्रोन्नति के लिए उनकी पात्रता के विनिश्चय के लिए गणना में ली जाएगी ।

6. निरर्हता: वह व्यक्ति

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

8. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस सबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों भूतपूर्व सैनिकों और अन्य विशेप प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

9. अनुसूची के स्तम्भ ( 1 ) में उल्लिखित पदों पर आगे की सभी भर्तियाँ योधक पंक्ति में की जाएंगी ।

प्रोन्नति/प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रतिनियुक्ति:

प्रतिनियुक्ति

केन्द्रीय सरकार/ राज्य सरकारों के जिसके अन्तर्गत केन्द्रीय पुलिस संगठन/राज्य पुलिस संगठन भी है , अधीन ऐसे अधिकारी:-

क ) ( i ) जो मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या (

(ii) जिन्होंने मूल काडर/विभाग में 5000-8000 रु. या समतुल्य वेतनमान में नियमित आधार यानियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष सेवा की है ; या

(iii ) जिन्होंने मूल काडर/विभाग में 4500-7000 रु. या समतुल्य वेतनमान मेंनियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष सेवा की है ; और (ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं:-

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से कम्प्यूटर उपयोजन/कम्प्यूटर विज्ञान में मास्टर डिग्री या एम. टैक ( कम्प्यूटर उपयोजन में विशेषज्ञता सहित ) या कम्प्यूटर इंजीनियरी/कम्प्यूटर विज्ञान/कम्प्यूटर प्रोद्योगिकी में बी.ई. /बी. टैक या समतुल्य, या

(ii ) (क ) किसी मान्यताप्राप्त विश्वविद्यालय से कम्प्यूटर उपयोजन/ कम्प्यूटर विज्ञान में डिग्री या इलैक्ट्रोनिक और दूर संचार इंजीनियरी में डिग्री या समतुल्य।

(ख ) इलैक्ट्रोनिक आंकड़े प्रक्रमण कार्य जिसमें वास्तविक कार्यक्रमण भी सम्मिलित है, दोवर्ष का अनुभव, या

(iii ) ( क) किसी मान्यताप्राप्त विश्वविद्यालय से मास्टर डिग्री या समतुल्य या इंजीनियरी में डिग्री या समतुल्य ।

(ख) इलैक्ट्रोनिक आंकड़े प्रक्रमण कार्य जिसमें वास्तविक कार्यक्रमण भी सम्मिलित है , तीन वर्ष का अनुभव, या

( iv ) (क ) डी. ओ. ई. ए. सी. सी. कार्यक्रम के अधीन " ए " स्तर का डिप्लोमा या विश्वविद्यालय कार्यक्रमके अधीन प्रस्तावित कम्प्यूटर उपयोजन में स्नातकोत्तर डिप्लोमा राज्य तकनीकी शिक्षा परिषद् द्वारा प्रदत्त कम्प्यूटर उपयोजन में पोलिटेक्नीकोत्तर डिप्लोमा या समतुल्य।

(ख ) इलैक्ट्रोनिक आंकड़े प्रक्रमण कार्य जिसमें वास्तविक कार्यक्रमण भी सम्मिलित है, तीन नर्म का अनुभव!

(प्रतिनियुक्तिकी अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है ,

साधारणतया तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्तिद्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

यदिविभागीय प्रोन्नति समिति है तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

प्रतिनियुक्ति:-केन्द्रीय सरकार के ऐसे अधिकारी: -

(क

) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ii ) जिन्होंने 4500-7000/- रु. के वेतनमान वाले पदों पर तीन वर्ष नियमिते सेवा की है ; या

(111) जिन्होंने 4000-6000/- रु. के वेतनमान वाले पदों पर आठ वर्ष नियमित सेवा की है ; और

(ख) किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री या समतुल्य और आंकड़ा प्रविष्टि कार्य में प्रति

घंटा 8000 कुंजी अवनयन से कम की गति न हो ।

टिप्पण: आंकड़ा प्रविष्टि कार्य में प्रति घंटा 8000 कुंजी अवनयन की गति का निर्णय सक्षम प्राधिकारी द्वारा ईडीपी मशीन ( मशीनों ) पर गति परीक्षण का संचालन कर के किया जाएगा ।

(प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रप्तिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

(ख ) किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री या समतुल्य और आंकड़ा प्रविष्टि कार्य में प्रति घंटा 8000 कुंजी अवनयन की गति का निर्णय संक्षम प्राधिकारी द्वारा इलैक्ट्रोनिक आंकड़ा प्रसंस्करण मशीन ( मशीनों ) पर गति परीक्षण का संचालन करके किया जाएगा ।

निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त

ઃઃ ઃ છ સત્ય - સમય પર નારે किए गए अनुदेशों या आदेशों के अनुसार अनुसूचित जाति/ अनुसूचित जनजाति के लिए पाँच वर्ष तथा अन्य पिछड़े वर्गों के लिए 3 वर्ष तक शिथिल की जा सकती है । विभागीय अभ्यर्थियों के लिए, जिन्होंने तीन वर्ष निरंतर सेवा की है, ऊपरी आयु सीमा शिथिल करके 40 वर्ष तक की जा सकती है (अनुसूचित जाति/अनुसूचित जनजाति के अभ्यर्थियों की दशा में 45 वर्ष ) तथा जो खुली प्रतियोगिता से आए हुए अभ्यर्थियों के साथ प्रतिस्पर्धा में हैं । टिप्पण:- आयु- सीमा अवधारित करने के लिए करने के लिए नियत की गई अंतिम तारीख होगी। ( न

नागालैण्ड मेघालय , अरूणाचल प्रदेश, त्रिपुरा, सिक्किम , जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीती जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ।

(हैं ) जब चयन के किसी प्रक्रम पर महानिदेशक सीमा सुरक्षा बल की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उनु समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

टिप्पण: 3 आंकड़ा प्रविष्टि कार्य में प्रति

घंटा 8000 कुंजी अवनयन की गति का निर्णय , सक्षम प्राधिकारी द्वारा इलैक्ट्रानिक आंकड़ा प्रसंस्करण मशीन ( मशीनों ) पर गति परीक्षण का संचालन करके किया जाएगा ।

या किन्हीं अन्य परिस्थितियों में एक वर्ष या इससे अधिक अवधि के लिए बाहर रहने के कारण हुई रिक्तियाँ केन्द्रीय सरकार में ऐसे अधिकारियों से प्रतिनियुक्ति के आधार पर भरी आ सकेगी जो निवनित आधार पर सदृश पद धारण किए हुए हैं और जिनके पास सीधे भर्ती किए जाने वाले व्यक्तियों के लिए स्तम्भ ( 8 ) के अधीन विहित अर्हताएं हैं ।

2. भविष्य की भर्ती केवल योधक रैंकों में की जाएगी ।

G.S.R. 24. In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to the posts of Electronic Data Processing, Group 'B ' and Group ' C ' ( Non - Gazetted) in the Border Security Force, namely:-

1. Short title and commencement.-( 1 ) These rules may be called the Border Security Force , Electronic Data Processing . Group ' B ' and Group ' C ' (Non - Gazetted) posts Recruitment Rules, 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette .

4. Method of recruitment , age limit , qualification etc. The method of recruitment to the said posts, age limits, qualifications and other matters connected therewith shall be as specified in columns (5) to ( 14 ) of the said Schedule.

5. Initial Constitution. The incumbents of the posts shown in column ( 1 ) of the said Schedule who were appointed to the posts before the date of commencement of these rules shall be deemed to have been appointed under these rules on a regular basis and the services rendered by them in the said posts before the said commencement shall be taken into account for deciding their eligibility for promotion to the next higher grade.

6. Disqualification.-No person,-

( a) who has entered into or contracted a marriage with a person having a spouse living; or ( b) who , having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

7. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

8. Saving. सा.का.नि. 25.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और वित्त मंत्रालय, व्यय विभाग ( वित्त अगयोग प्रभाग ) सहायक पुस्तकालय और सूचना अधिकारी भर्ती नियम, 2000 को उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हेंऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , वित्त मंत्रालय , व्यय विभाग के वित्त आयोग प्रभाग में सहायक पुस्तकालय और सूचना अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम वित्त मंत्रालय , व्यय विभाग ( वित्त आयोग प्रभाग ) सहायक पुस्तकालय और सूचना अधिकारी भर्ती नियम, 2004 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान. उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान यह होगा , जो इन नियमों से 3. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

टिप्पण: -ज्येष्ठ पुस्तकालय और सूचना सहायक के पद को नियमित रूप से धारण करने वाले की उपयुक्तता 6500-200-10500 रुपए के वेतनमान में सहायक पुस्तकालय और सूचना अधिकारी के उच्च श्रेणी पद पर नियुक्ति के लिए विभागीय प्रोन्नति समिति द्वारा प्रारम्भ में निर्धारण किया जाएगा । यदि उपयुक्तता निर्धारित की गई है तो उसे प्रारंभिक गठन पर उस पद पर नियुक्त किया गया समझा जाएगा। यदि उच्च श्रेणीकृत वेतनमान में नियुक्तिके लिए उसे अनुपयुक्त निर्धारित किया जाता है तो वह 5500-9000 रुपए के वेतनमान में बना रहेगा और उसके मामले का प्रतिवर्ष पुनर्विलोकन कियाजाएगा।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Kalawati Saran Children's Hospital , New Delhi , ( Group ' D ' posts ) Recruitment Rules , 1979 , in so far as they relate to the post of Mali , except as respects things done or omitted to be done before such supersession the President hereby makes the following rules regulating the method of recruitment to the post of Mali in Kalawati Saran Children's Hospital , New Delhi , namely:

1. Short title and commencement.( 1 ) These rules may be called the Kalawati Saran Children's Hospital , New Delhi , (Mali ) (Group ' D ' post ) Recruitment Rules , 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit , qualification etc.--The method of recruitment, age limit , qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the said Schedule .

G.S.R. 28. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Central Sterilization Services Department Assistant in the Jawaharlal Institute of Post Graduate Medical Education and Research , Pondicherry, namely : ---

1. Short title and commencement . ( 1 ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry, Central Sterilization Services Department-Assistant , RecruitmentRules , 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay. The number of the said post , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3.Method of recruitment, age limit and qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification.--No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category or persons .

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम कलावती सरन बाल चिकित्सालय , नई दिल्ली एम्बुलेंस परिचर (समूह ' घ ' पद ) भर्ती नियम, 2005 है ।

पदोन्नति अथवा प्रतिनियुक्ति अथवा आमेलन द्वारा भर्ती भर्ती किए जाने की स्थिति में वे ग्रेड जिसे पदोन्नति अथवा प्रतिनियुक्ति अथवा आमेलन किया जाएगा प्रतिनियुक्ति द्वारा अथवा आमेलन द्वारा और विभिन्न पद्धतियों द्वारा भर्ती किए जाने वाले पदों

प्रतिनियुक्तिअथवा भूतपूर्व सैनिक पुनर्नियोजन

प्रतिनियुक्ति:

1. केन्द्रीय अथवा राज्य सरकारों अथवा संघ राज्य क्षेत्र के अधीन ऐसे अधिकारी

जो:-

(क ) ( i ) कूल काडर अथवा विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

( ii ) मूल काडर या विभाग में जिन्होंने 5500-9000 रुपये या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् इस श्रेणी में तीन वर्ष की सेवा की गई है; या

( iii ) मूल काडर या विभाग में जिन्होंने 5000-8000 रुपये या समतुल्य के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् इस श्रेणी में छह वर्ष की सेवाकी गई है; या

(iv) मूल काडर या विभाग में जिन्होंने 4500-7000 रुपये या समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् इस श्रेणी में आठ वर्ष की सेवा की गई है; और

(ख ) निम्नलिखित शैक्षिक अर्हताएं रखते हों :

1. किसी मान्यताप्राप्त विश्वविद्यालय से सिविलं अथवा सिंचाई इंजीनियरी अथवा सिंचाई और जल प्रबंधन/जल प्रौद्योगिकी और प्रबंधन अथवा जल विज्ञान में उपाधिअथवा समतुल्य के साथ वृहद सिंचाई और बहुउद्देशीय परियोजनाओं में योजना और निर्माण में दो वर्ष का अनुभव;

2. सिविल अथवा सिंचाई इंजीनियरी अथवा जल संसाधन इंजीनियरी में डिप्लोमा अथवा जल प्रौद्योगिकी और प्रबंधन में बी.एस.सी. के साथ वृहद सिंचाई और बहुउद्देशीय परियोजनाओं की आयोजना और निर्माण में 5 वर्षों का अनुभव।

केन्द्र सरकार के इसी अथवा किसी अन्य संगठन अथवा विभाग में इस नियुक्ति से पहले तत्काल धारित अन्य संवर्ग बाह्य पद में प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्त की अवधि सामान्यतः तीन वर्षों से अधिक नहीं होगी । आवेदनों के प्राप्त होने की अंतिम तिथि को प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा 56 वर्षों से अधिक नहीं होगी।

भूतपूर्व सैनिकोंके लिए:

कनिष्ठ कमीशंड अधिकारियों के रैंक से सेवानिवृत्त होने वाले अथवा एक वर्ष की सुरक्षित अवधिमें स्थानान्तरित किए जाने वाले और आवश्यक अनुभव तथा निर्धारित अर्हता रखने वाले सशस्त्र सेना के कार्मिक की प्रतिनियुक्ति अथवा पुनर्नियुक्ति पर भी विचार किया जायेगा । ऐसे व्यक्तियों को नियत तिथियों, जबसे उन्हें सशस्त्र सेना से छोड़ा जाना है, प्रतिनियुक्ति दी जायेगी, उसके बाद वे पुनः नियुक्तिपर बने रहेंगे ।

G.S.R. 30. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in partial supersession of the Sardar Sarovar Construction Advisory Committee (Group ' A' and Group ' B ' posts ) Recruitment Rules , 1981, in so far as they relate to the post of Assistant Engineer , except as respects things done or omitted to be done before such superscssion , the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Engineer in the Sardar Sarovar Construction Advisory Committee under the Ministry of Water Resources, namely:--

1. Short title and commencement. These rules may be called the Sardar Sarovar Construction Advisory Committee. Assistant Engineer , Recruitment Rules, 2004.

( 2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and the scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment , age limit , qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

II. Diploma in Civil or Irrigation Engineering orWater Resources Engineering or B.Sc. in Water Technology and Management with 5 years experience in planning and construction ofMajor Irrigation andMulti- purpose projects .

Period ofdeputation including the period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date ofthe receipt of the applications.

For Ex-Servicemen-

Deputation or re - employment of armed forces personnel of the rank of Junior Commissioned Officers due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered . Such persons wouldbe given deputation terms upto the dates on which they are due for release from the armed forces ; thereafter they may be continued on re -employment .
