सा.का.नि. 48.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय अपराधशास्त्र एवं विधि-विज्ञान संस्थान आशुलिपिक श्रेणी 2 भर्ती नियम, 1993 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के अधीन लोकनायक जयप्रकाश नारायण राष्ट्रीय अपराध शास्त्र एवं विधि- विज्ञान संस्थान में आशुलिपिक श्रेणी " ग " पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम लोकनायक जयप्रकाश नारायण राष्ट्रीय अपराध शास्त्र एवं विधि- विज्ञान संस्थान, आशुलिपिक श्रेणी " ग " ( समूह " ग " ) भर्ती नियम , 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीम, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तःभ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

[PART II- SEC. 3 ( i) ] ( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. व्यावृत्ति.- इन नियमों की कोई वात, ऐमे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

परिवीक्षा की अवधि, यदिकोई हो सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्तिद्वारा या आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशवता

प्रोन्नति द्वारा, जिसके न हो सकने पर प्रतिनियुक्तिद्वारा

(क )प्रोन्नति: लोक नायक जय प्रकाश नारायन राष्ट्रीय अपराध शास्त्र एवं विधि विज्ञान संस्थान के ऐसे आशुलिपिकों श्रेणी ' घ ' से , प्रोन्नति द्वारा जिन्होंने उस श्रेणी में आठ वर्ष की नियमित सेवा कीहै।

(ख) प्रतिनियुक्ति: केन्द्रीय सरकार/राज्य सरकार के अधीन ऐसे अधिकारीः-

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए है ; या

(ii ) जिन्होंने 4000-6000 रु. के वेतनमान वाले पदों पर आठ वर्ष नियमित सेवा की हो ;

(ख) स्तंभ 8 के अधीन वर्णित अर्हताएं रखते हैं ।

टिप्पण 1 ( क ) पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यकि प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्वय पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

भर्ती करने में किन परिस्थितयों में संघ लोक सेवा आयोग से परामर्श किया यदिविभागीय प्रोन्नति समिति है, तो उसकी संरचना

जाएगा

लागू नहींहोता ।

G.S.R. 48. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the National Institute of Criminology and Forensic Seience Stenographer Grade II , Recruitment Rules, 1993 except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulatingthe method of recruitment to the post of Stenographer Grade ' C ' in the Lok Nayak Jayaprakash Narayan National Institute of Criminology and Forensic Science under the Ministry of Home Affairs , namely:-

1. Short title and commencement. ( 1) These rules may be called the Lok Nayak Jayaprakash Narayan National Institute ofCriminology and Forensic Science Stenographer Grade ' C ' ( Group ' C ' post ) Recruitment Rules , 2004 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay. The number of the post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualifications , etc. The method of recruitment age- limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification . No person, - (a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age -limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes , Ex - Servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time .

1. ( 1 ) इन विनियमों का नाम भारतीय प्रशासनिक सेवा (पदोन्नति द्वारा नियुक्ति) संशोधन विनियमावली, 2005 है । (2 ) ये, शासकीय राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय प्रशासनिक सेवा ( पदोन्नति द्वारा नियुक्ति) विनियमावली, 1955 ( इसके पश्चात् उपर्युक्त विनियमावली के रूप में संदर्भित ) के विनियम 3 के उप विनियम ( 1 ) के परन्तुक में मद संख्या ( i ) के पश्चात् निम्नलिखित अन्त स्थापित किया जाए, अर्थात्ः-

G.S.R. 49. In exercise of the powers conferredby Section 3 of the All India Services Act, 1951 (61 of 1951 ) and in pursuance of rule 8 of the Indian Administrative Service (Recruitment) Rules, 1954, the Central Goverment, in consultation with the State Governments and the Union Public ServiceCommission , hereby makes the following Regulations , namely :-

1. ( 1 ) These Regulations may be called the Indian Administrative Service ( Appointment by Promotion) Amendment Regulations , 2005.

(2) They shall come into force on the date of theirpublication in the Official Gazette.

2. In the IndianAdministrative Service (Appointment byPromotion) Regulations, 1955 (hereinafter referred to as the said regulations) , in regulation 3 , in sub -regulation(1) , intheproviso, after item ( i) , the following shall be inserted, namely:-

"(iA) the nominees ofthe Government of India shall not belong to the cadre of the state for which the meeting of the Committee is to be held" .

3. In the said regulations, for the Schedule, the following shall be substituted, namely:-

सा.का.नि. 50.- अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारतीय पुलिस सेवा ( भर्ती ) नियमावली, 1954 के नियम 9 के अनुसरण में केन्द्रीय सरकार, राज्य सरकारों तथा संघ लोक सेवा आयोग के परामर्श से एत‌द्वारा निम्नलिखित विनियम बनाती है , अर्थात्- 1. (1 ) इन विनियमों का नाम भारतीय पुलिस सेवा ( पदोन्नति द्वारा नियुक्ति) संशोधन विनियम, 2005 है । (2) ये विनियम शासकीय राजपत्र में इनके प्रकाशन की तारीख सेलागू होंगे ।

2. भारतीय पुलिस सेवा ( पदोन्नति द्वारा नियुक्ति ) विनियमावली, 1955 में, विनियम 3 के स्थान पर निम्नलिखित विनियम प्रति स्थापित किया जाएगा, अर्थात्:-

" 3. चयन करने के लिए समिति का गठन-( 1 ) अनुसूचीके कालम 2 में विनिर्दिष्ट किसी राज्य संवर्ग अथवा संयुक्त संवर्ग के लिए 31091/ 05-2

एक समिति गठित की जाएगी जिसमें आयोग के अध्यक्ष अथवा जहां अध्यक्ष इसमें शामिल नहीं हो सकता, वहां उनके प्रतिनिधि के रूप में आयोग का कोई अन्य कोई सदस्य तथा अनुसूची के कॉलम 3 में तदनुरूपी प्रविष्टि में विनिर्दिष्ट अन्य सदस्य शामिल होंगे:-

: परन्तु यह कि-

(i ) आयोग के अध्यक्ष अथवा सदस्य को छोड़कर किसी ऐसे व्यक्ति को समिति का सदस्य नियुक्त नहीं किया जाएगा जो कि अखिल भारतीय सेवा का सदस्य न हो;

( ii ) भारत सरकार का नामिती उस राज्य संवर्ग का नहीं होगा जिस राज्य के लिए समिति की बैठक की जानी है; और

( iii ) केन्द्र सरकार राज्य सरकार से परामर्श करने के पश्चात् अनुसूची संशोधन कर सकती है ।

3(2) आयोग का अध्यक्ष अथवा सदस्य ही समिति की उन सभी बैठकों की अध्यक्षता करेगा जिनमें वह स्वयं मौजूद है । 3 ( 3) आयोग के अध्यक्ष अथवा सदस्य को छोड़कर किसी भी सदस्यकी अनुपस्थिति से बैठक की कार्यवाही अमान्य नहीं ठहरायी जाएगी, यदि समिति के आधे से अधिक सदस्यों ने बैठक में भाग लिया हो"

3. उपर्युक्त विनियमावली में विनियम 10 के बाद निम्नलिखित अनुसूचीजोड़ी जाएगी, अर्थात्: -

1. (1) These Regulations maybe called the Indian Police Service (Appointment by Prometion) Amendment Regulations,2005.

(2) They shall come into force on the date of their publication in the official gazette.

2. In the Indian Police Service (Appointment by Promotion) Regulations, 1955 for regulation 3, the following regulation shall be substituted, namely :--

Constitution of the Committee to make selection.-( 1 ) There shall be constituted for State Cadre or a Joint Cadre specified in column 2 of the Schedule, a Committee consisting of the Chairman of the Commission orwhere the Chairman is unable to attend, any other member of the Commission representing it and other members specified in the corresponding entry of column 3 of the Schedule:

Provided that.-

(1) no member of the Committee other than the Chairman or the member of the Commission shall be a person who is not a member of anAll India Service;

(ii) the nominees of the Government of India shall not belong to the cadre of the State for which the meeting of the Committee is to be held: and

(ⅲ) the Central Government may after consultation with the State Government concerned . amend theSchedule.

3( 2 ) The Chairman or the member of the Commission shall preside at all meetings of the Committee in which he is present.

3 ( 3 ) The absence of a member, other than the Chairman or member of the Commission, shall not invalidate the proceedings of the Committee if more than half the members of the Committee had attended the meeting. " 3. In the said regulations , after regulation 10 , the following Schedule shall be added, namely:-

सा.का.नि. 51-अखिल भारतीय सेवा अधिनियम , 1951 (1951 का 61 ) कोचारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए

[PART II-SEC. 3 (1)] और भारतीय वन सेवा ( भर्ती ) नियमावली , 1954 के नियम 8 के अनुसरण में केन्द्र सरकार राज्य सरकारों और संघ लोक सेवा आयोग के परामर्श से एत‌द्वारा निम्नलिखित विनियम बनाती है, अर्थात्:-

1. ( 1 ) इन विनियमों का नाम भारतीय वन सेवा ( पदोन्नति द्वारा नियुक्ति) संशोधन विनियमावली, 2005 है । (2) ये, शासकीय राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय वन सेवा ( पदोन्नति द्वारा नियुक्ति) विनियमावली, 1966 में,-

(i ) विनियम उके लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाए, अर्थात्

" 3.चयन करने के लिए समिति का गठन-

( 1 ) अनुसूची के कालम 2 में विनिर्दिष्ट राज्य संवर्ग अथवा किसी संयुक्त संवर्ग के लिए एक समिति का गठन किया जाएगा जिसमें आयोग का अध्यक्ष अथवा जहाँ अध्यक्ष समिति की बैठक में भाग लेने में असमर्थ हो, वहां इसके प्रतिनिधि के रूप में आयोग का अन्य कोई सदस्य तथा उक्त अनुसूची के कॉलम 3 की तदनुरुपी प्रविष्टि में विनिर्दिष्ट अन्य सदस्य शामिल होंगे :-

बशर्ते कि-

( i ) आयोग के अध्यक्ष अथवा सदस्य के अलावा, किसी ऐसे व्यक्तिको समिति का सदस्य नियुक्त नहीं किया जाएगा जो कि किसी अखिल भारतीय सेवा का सदस्य न हो ;

( ii ) भारत सरकार द्वारा नामित अधिकारी उस राज्य के संवर्ग के नहीं होंगे जिस राज्य के लिए समिति की बैठक आयोजित की जानी है; और

( iii ) केन्द्र सरकार संबंधित राज्य सरकार से परामर्श के पश्चात् अनुसूची को संशोधित कर सकती है ।

3(2) आयोग का अध्यक्ष अथवा सदस्य समिति की उन बैठकों की अध्यक्षता करेगा जिनमें वह उपस्थित रहता है ।

3( 3) आयोग के अध्यक्ष अथवा सदस्य को छोड़कर किसी अन्य सदस्य की अनुपस्थिति से समिति की कार्यवाही अमान्य नहीं होगी यदि समिति के आधे से अधिक सदस्य इसको बैठकों में उपस्थित रहे हों ।"

( ii ) विनियम 10 के पश्चात् निम्नलिखित अनुसूची जोड़ी जाएगी , अर्थात्: -

G.S.R. 51. In exercise of the powers conferred by Section 3 of the All India Services Act, 1951 (61 of 1951) and in pursuance of Rule 8 of the Indian Forest Service (Recruitment) Rules , 1954, the Central Government, in consultation with the State Governments and the Union Public Service Commission , hereby makes the following Regulations , namely :-

1. (1) These Regulations may be call the Indian Forest Service (Appointment by Promotion) Amendment Regulations, 2005

(2) They shall come into force on the date of their publication in the official gazette.

2. In the Indian Forest Service ( Appointment by Promotion) Regulations , 1966-

(i) for Regulation 3, the following regulation shall be substituted, namely :-

" 3. Constitution of the Committee to make Selection.-( 1 ) There shall be constituted for State Cadre or a Joint Cadre specified in column 2 of Schedule , a 188

Committee consisting of the Chairman of the Commission or where the Chairman is unable to attend any other member of the Commission representing it and other members specified in the corresponding entry of column 3 of the said Schedule:

① no member of the Committee other than the Chairman or the member of the Commission shall be a person who is not a member of an All India Service;

(ii) the nominees of the Government of India shall not belong to the cadre for which the meeting of the Committee is to be held; and (ⅲ) the Central Government may after consultation with the State Government concerned , amend the Schedule .

3 (2) The Chairman or the Member of the Commission shall preside at all meetings of the Committee atwhich he is present .

(5) ( a) The Selection Committee shall grade the officers included in the eligibility list as " fit " or " unfit" for appointment to Principal Private Secretary Grade, on the basis of the benchmark grading "Good " as eligibility criterion.

2. भारतीय विदेश सेवा, शाखा' ख' ( आशुलिपिकों का संवर्ग , प्रधान निजी सचिव के पद ) भर्ती नियमावली, 1992 के नियम 7 में, और इसके तहत नोट में , निम्नलिखित को प्रतिस्थापित किया जाना चाहिए, अर्थात्:-

(b) The Selection Committee shall, after grading the officers under clause ( a) , draw up the select list of required number from amongst the officers graded as "fit " and arrange them in the order in which their names appear in the eligibility list and it shall be ensured that there is πο supersession of any officer graded as " fit " .

3. ( क) त्रयन समिति को पात्रता मानदण्डके रूप में " अच्छा " के बेंचमार्क श्रेणीयन के आधार पर, प्रधान निजी सचिव की में भर्ती के लिए पात्रता सूची में शामिल अधिकारियों को " योग्य या " अयोग्य" के रूप में श्रेणीबद्ध करना चाहिए ।

Note : While considering the cases of officers belonging to the Scheduled Castes or the Scheduled Tribes . the Selection Committee shall be guided by such instructions as may be issued by the Central Government from time to time.

सा.का.नि. 53.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए स्वास्थ्य और परिवार कल्याण मंत्रालय, जवाहरलाल स्नातकोत्तर चिकित्सा शिक्षा एवं अनुसंधान संस्थान , पांडिचेरी में सहायक ( पशु गृह ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम जवाहरलाल स्नातकोत्तर चिकित्सा शिक्षा एवं अनुसंधान संस्थान, पांडिचेरी सहायक ( पशु गृह ) समूह ' ग ' पद भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान - उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु - सीमा और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किमी पर नियुक्ति का पात्र नहींहोगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( 2 ) चिकित्सा या अनुसंधान संस्थान के किसी पशु गृह में पशुओं को रखने और प्रजनन करने में पांच वर्ष का अनुभव हो ।

टिप्पण 1: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिएनियत कीगई अंतिम तारीख होगी । (नकि वह अंतिम तारीख जो असम, मिजोरम , मणिपुर, नागालैंड, मेघालय , अरुणाचल प्रदेश, त्रिपुरा, सिक्किम , जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा-जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है।)

टिप्पण: 1. अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में केंद्रीय सरकार के विवेकानुसार शिथिल की जा सकती है । 2. अनुभव संबंधी अर्हता केंद्रीय सरकार के अनुसूचित जातियों या अनुसूचित जन- जातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर केंद्रीय सरकार की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरेजाने वाले पदों की प्रतिशतता

प्रोन्नति : ऐसे ज्येष्ठ परिचर ( पशु गृह ) में से प्रोन्नति , जिन्होंने उस श्रेणी में आठ वर्ष कीनियमित सेवा की है ।

प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

प्रतिनियुक्ति: केंद्रीय सरकार या राज्य सरकार या लोक उपक्रमों या स्वायत्त निकायों में नियोजित ऐसे अधिकारियों में से प्रतिनियुक्ति-

(क) ( i ) जो नियमित आधार पर मदृश पद धारण किए हुए है ; या

(ख) स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित अनुभव और शैक्षिक अर्हताएं रखता है।

टिप्पण: प्रतिनियुक्ति की अवधि जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 53. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant ( Animal House) in the Ministry of Health and Family Welfare , Jawaharlal Institute ofPost Graduate Medical Education and Research, Pondicherry. namely:-

1. Short title and commencement .-( 1 ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Eduction and Research, Pondicherry , Assistant (Animal House ) Group ' C' ' Post , Recruitment Rules, 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay . The number of post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person.-

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointinent to the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen and other special categorics of persons, inaccordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 54.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए जवाहरलाल स्नातकोतर चिकित्सीय और अनुसंधान संस्थान, पांडिचेरी, स्वास्थ्य और परिवार कल्याण मंत्रालय में संवेदनाहरण तकनीकी सहायक और संवेदनाहरण तकनीशियन के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ.-( 1 ) इन नियमों का संक्षिप्त नाम जवाहरलाल स्नातकोत्तर चिकित्सीय शिक्षा और अनुसंधान संस्थान, पांडिचेरी (संवेदनाहरण तकनीकी सहायक और संवेदनाहरण तकनीशियन ) ( समूह " ग " पद) भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद-संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु-सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. कारण हैं उन्हें लेखबद्ध करके , इनं नियमों के जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय -सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( ii ) जिन्होंने 4000-6000 रु. के वेतनमान में पांच वर्ष नियमित सेवा की हो; और

सा.का.नि. 55.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इस्पात और खान मंत्रालय (इस्पात विभाग ) ( समूह ' घ' ) भर्ती नियम, 1982 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , इस्पात मंत्रालय (समूह ' घ ' ) पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम इस्पात मंत्रालय ( समूह " घ " ) पद भर्ती नियम , 2005 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान-उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्तीकी पद्धति , आयु-सीमा और अहंताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु - सीमा, अर्हताएं और उक्त पद से संबंधित अम्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति ,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के अधीन ऐसे अधिकारियों से जो नियमित आधार पर सदृश पद धाराण किए हुए हैं या जिन्होंने 2,610-60-2910-65-3300-70-4000 रु. के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उक्त पद पर चार वर्ष सेवा की हो और जो गेस्टेटनर मशीन के प्रचालन में प्रवीण हो ।

G.S.R. 55. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Steel and Mines (Department of Steel ) (Group ' D' ) Recruitment Rules , 1982, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the group 'D' posts in the Ministry of Steel, namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Steel Group , 'D' posts Recruitment Rules, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of the said post, their classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) ofthe Schedule annexed to these rules.

3. Methodof recruitment, age limit and qualifications, etc. The method of recruitment, age- limit, qualifications and other matters relating to the said post, shall be as specified in columns (5 ) to ( 14) of the said Schedule.

4. Disqualification.-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage wi: any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so todo, it may, by order for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservation, relaxation of age -limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , the Ex-Servicemen and other special categories ofpersons, inaccordancewith the orders issued by the Central Government from time to time in this regard.

G.S.R. 56. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Government Test House , Calcutta Class III ( Non -Ministerial and Ministerial ) posts Recruitment Rules , 1964. in so for as they relate to the post of Lower Division Clerk except as respects things done or omitted to have been done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the the post of Lower Division Clerk in the National Test House under the Ministry of Consumer Affairs Food and Public Distribution ( Department of Consumer Affairs ) , nanicly :-

1 Short title and commencement . ( 1 ) These rules may be called the National Test House Kolkata (Lower Division Clerk ) Recruitment Rules , 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of the said posts, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications , etc .--The method of recruitment age - limit, qualifi- cations and other matters thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification.-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living . has entered into or contracted a marriage with any person, shall be cligible for appointment to the said post:

Provided that the Central Government may , if satisfied , that such marriage is permissible under the personal law applicable a such person and the party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , the Ex -Servicemen and other special categories of persons , in accordance with the orders/ instructions issued by the Central Government from time to time in this regard .

(1) Matriculation or equivalent from a recognized Board or University.

Note : The crucial date for determin- ing the age- limit shall be fixed by the Staff Selection Commission.

(ii) A typing speed of30 words per minute in English or 25 words perminute inHindi.

As stated in Column 11

(i ) 90% by direct recruitment through Staff Selection Commission.

( ii ) 5% of posts shall be filled up from amongst the Group D staff who possess Matriculation or equivalent qualifications and have rendered 5 years regular service in Grade D, on the basis of a Departmental qualifying examination. The maximum age limit for cligibility for examination is 45 years (50 years of age for the Scheduled Castes/ Scheduled Tribes) .

Note : (a) Unfilled posts pertaining to a particular year shall not be carried over.

(b) If more of such employees than the number of posts available under clause ( ii ) qualify at the said examination. such excess number of employces shall be considered for filling the posts arising in the subsequent years so that the employees qualifying at an earlier examination are considered before those who qualify at a later examination.

( c) 5% of the posts shall be filled on seniority-cum- fitness basis from Grade D employces who possess matriculation or equivalent qualification .

सा.का.नि. 57.- जबकि कर्मचारी राज्य बीमा ( केन्द्रीय ) नियमावली 1950 में संशोधन करने के लिए कर्मचारी राज्य बीमा अधिनियम, 1948 (1948 का 34 ) की धारा 95 की उपधारा ( 1 ) द्वारा अपेक्षित कतिपय मसौदा नियमों को, जो भारत के राजपत्र, भाग II, खण्ड-3 , उप- खण्ड ( ii ) दिनांक 16 अक्टूबर , 2004 में श्रम और रोजगार मंत्रालय संख्या सा० का ० नि० 2627 में भारत सरकार की अधिसूचना के द्वारा भारत के राजपत्र, जिसमें उक्त अधिसूचना प्रकाशित की गई थी, की प्रतियों की तिथि से पैंतालिस दिन की अवधि समाप्त होने तक, उससे प्रभावित होने वाले, किसी व्यक्ति से आपत्ति या सुझाव आमंत्रित करने के लिए प्रकाशित किए गए थे , जनता के लिए उपलब्ध कराया गया था ।

और जबकि उक्त राजपत्र की प्रतियां जनता को 16 अक्टूबर, 2004 को उपलब्ध करायी गयी थीं ।

और जबकि उससे प्रभावित होने वाले व्यक्तियों से प्राप्त आपत्तियों और सुझावों पर सरकार द्वारा विचार किया गया है । अतः अब केन्द्र सरकार उक्त अधिनियम की धारा 95 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए कर्मचारी राज्य बीमा निगम से परामर्श करने के बाद, कर्मचारी राज्य बीमा निगम ( केन्द्रीय ) नियम , 1950 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. ( 1 ) ये नियम कर्मचारी राज्य बीमा ( केन्द्रीय ) ( संशोधन ) नियम , 2005 कहलाएंगे ।

(2 ) ये सरकारी गजट में इनके प्रकाशन की तिथि से प्रभावी होंगे ।

2. कर्मचारी राज्य बीमा ( केन्द्रीय ) नियम 1950 में नियम 10, उप नियम ( 2 ) के लिए निम्नलिखित प्रतिस्थापित किया जाए:-

" ( 2) वित्तीय आयुक्त तथा महानिदेशक द्वारा विधिवत् अधिप्रमाणित स्थायी समिति द्वारा यथा अनुमोदित वित्त वर्ष से संबंधित वार्षिक लेखे लेखापरीक्षा के लिए भारत के नियंत्रक व महालेखा परीक्षक को प्रस्तुत किए जाएंगे और भारत के नियंत्रक व महालेखा परीक्षक की रिपोर्ट के साथ लेखापरीक्षित लेखे संबंधित वित्त वर्ष की समाप्ति के पश्चात् दस दिसम्बर से पूर्व आयोजित की जा रही निगम की बैठक में अंगीकार करने हेतु प्रस्तुत किए जायेंगे ।

बशर्ते कि भारत के नियंत्रक व महालेखा परीक्षक की रिपोर्ट संगत वर्ष की समाप्ति के बाद बीस नवम्बर तक प्राप्त हो जाए" ।

G.S.R. 57. Whereas certain draft Rules further to amend the Employees ' State Insurance (Central) Rules, 1950 were published as required by sub -section ( 1 ) of section 95 of the Employees' State Insurance Act, 1948 (34 of 1948) vide notification of the Government of India in the Ministry of Labour and Employment No. G.S.R. 2627 dated the 5th October, 2004. in the Gazette of India, Part - II, Section 3, Sub- section ( ii ) dated the 16th October, 2004 for inviting objection or suggestion from any persons likely to be affected thereby till the expiry of the period of forty-five days from the date on which the copies ofthe Gazette of India, in which the said notification was published, were made available to the public.

And whereas , the copies of the said Gazette were made available to the public on the 16th October, 2004. Andwhereas, objections and suggestions received from persons likely to be affected thereby have been considered by the Government .

Now, therefore, in exercise ofthe powers conferred by section 95 of the said Act, the Central Government , after consultation with Employees ' State Insurance Corporation hereby makes the following rules further to amend the Employees' State Insurance (Central ) Rules, 1950 , namely:---

1. ( 1 ) These Rules may be called the Employees' State Insurance ( Central ) ( Amendment) Rules, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Employees ' State Insurance ( Central) Rules , 1950, in rule 10, for sub -rule (2) the following shall be substituted namely:-

"(2) The Annual Accounts relating to a financial year duly authenticated by the Financial Commissioner and the DirectorGeneral and approved by the Standing Committee shall be submitted for audit to the Comptroller and Auditor General of India and the Audited Accounts together with the report of the Comptroller and Auditor General of India shall be placed for adoption at a meeting of the Corporation to be held before the tenth of December following the close of the financial year concerned.

'Providedthat the report of the Comptroller and Auditor General of India is received by the twentieth November, following the year to which it pertains . "
