सा. का. नि. 66.-यतः वाणिज्य और उद्योग मंत्रालय ( केन्द्रीय बॉयलर बोर्ड ) भारत सरकार के दिनांक 29 सितम्बर, 2004 की अधिसूचना संख्या सा.का.नि. 341 के तहत इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव , उक्त अधिसूचना से संबंधित राजपत्र की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने तक मांगने के लिए भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 31 की उप - धारा ( 1 ) जो दिनांक 9 अक्तूबर, 2004 के भारत के राजपत्र में है, द्वारा यथा अपेक्षित भारतीय बॉयलर अधिनियम, 1950 में और संशोधन करने के लिए कुछ विनियमों के मसौदे प्रकाशित किये गये थे;

और जबकि उक्त राजपत्र की प्रतियां आम जनता को 25 अक्तूबर, 2004 को उपलब्ध करा दी गयी थी; और जबकि विनिर्दिष्ट अवधि के भीतर कोई आपत्तियां अथवा सुझाव प्राप्त नहीं हुए थे ; :

अतः अब भारतीय बॉयलर अधिनियम, 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड एत‌द्वारा भारतीय बॉयलर विनियम , 1950 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है, नामतः :-

इन विनियमों को भारतीय बायलर ( द्वितीय संशोधन ) विनियम , 2005 कहा जायेगा । (1 )

(2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बॉयलर विनियम, 1950 में विनियम 4 के खण्ड ( ग) में उप-खंड ( vi ) में टिप्पणी के लिए निम्नलिखित टिप्पणी प्रतिस्थापित की जाएगी, नामतः :-

" टिप्पणी:- जब तक ए.एस.एम.ई. अथवा बी.एस. अथवा ई. एन. कोड के प्रति स्वदेशी तौर पर उत्पादित मिश्रधातु स्टील के उत्थापित तापमान आंकड़े एकत्र करने हेतु नेशनल मैटालर्जिकल लेबोरेटरी अथवा भारत हैवी इलेक्ट्रिकल्स लिमिटेड की कार्पोरेट रिसर्च एंड डेवलपमेंट लेबोरेटरी द्वारा 33,000 घंटों के परीक्षण नहीं किए जाते, स्टील के ये ग्रेड स्वीकार किए जाएं और डिज़ाइन के उद्देश्य हेतु ए.एस.एम.ई. अथवा बी.एस. अथवा ई. एन. कोड में दिए गए दीर्घ समय उत्थापित तापमान गुण/अधिकतम अनुमेय तन्यता मान, जैसा मामला हो, प्रयोग किए जाएं, बशर्ते- ( i ) स्टील विनिर्माता द्वारा इस आशय का एक प्रमाणपत्र प्रस्तुत किया जाए कि स्टील का विनिर्माण सख्ती से ए.एस.एम.ई. अथवा बी.एस. अथवा ई.एन. कोड के अनुसार किया गया है, ताकि यह आश्वासन दिया जा सके कि क्रीप रप्चर अपेक्षाओं का पालन हो ।

(ii ) स्टील निर्माता यह आवश्यक प्रमाणपत्र प्रस्तुत करें कि स्टील, ए.एस.एम.ई. अथवा बी.एस. अथवा ई. एन. कोड में दिए गए, जैसा मामला हो , रासायनिक विश्लेषण , कमरे के तापमान व उत्थापित तापमान के यांत्रिक गुणों के अनुरूप है ।

(iii) यह जांच करने के लिए कि क्या स्टील विनिर्देशनों पर खरा उतरता है तथा यह सुनिश्चित करने के लिए भी कि स्टील ए.एस.एम.ई. अथवा बी. एस. अथवा ई. एन. कोड, जैसा मामला हो, में दिए गए दीर्घावधि फटन तनाव मानों/अधिकतम अनुमेय मानों को पूरा करने योग्य है, नीचे वर्णन किए गए अनुसार एन.एम. एल. स्टील प्लांटों द्वारा 1000 घंटों के लिए लघु अवधि तनाव- फाटन परीक्षण किए जाएं, और एन.एन.एल./स्टील प्लांट द्वारा इस प्रभाव का एम प्रमाणपत्र दिया जाए ।

(iv ) प्रत्येक ग्रेड के स्टील के लिए ट्यूबिंग अथवा पाइपिंग अथवा कास्टिंग अथवा प्लेट ग्रेडों के लिए, जब वे भट्टी और अथवा सुपरहीटर जोन में हों, सर्विस तापमान से 50 ° सेल्सियस ज्यादा तापमान पर 1000 घंटों के दो क्रीप रप्चर परीक्षण किए जाएंगे । लेकिन वाल्वों में उपयोग की जाने वाली फोर्जिंग का परीक्षण 550 ° सेल्सियस पर 1000 घंटों के लिए किया जाना चाहिए । उपर्युक्त तापमानों पर 1000 घंटों में फटन पैदा करने योग्य तनाव को-20 प्रतिशत लाइन के अनुरूप मास्टर कर्व से लिया जा सकता है । दोनों ही नमूनों को उपर्युक्त तनाव व तापमान पर 100 घंटे का परीक्षण पास करना चाहिए । इन नमूनों का चुनाव संबंधित राज्य के मुख्य बॉयलर निरीक्षक द्वारा अनियत रूप से किया जा सकता है । ये नमूने अर्द्ध- तैयार स्वरूप में हो सकते हैं जैसे कि 25 मि.मी. की फोर्ज की हुई छड़ें जिन्हें संगत विनिर्देशनों में यथा- निर्धारित ऊष्मा उपचार से गुजरना होगा । "

G.S.R. 66. Whereas certain draft regulations further to amend the Indian Boiler Regulations, 1950 were published, as requiredby sub-section ( 1 ) of Section 31 of the Indian Boilers Act, 1923 (5 of 1923) in the Gazette of India, dated the 9th October, 2004 vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) (Central Boilers Board) number G.S.R. 341 dated the 29th September, 2004, for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of forty -five days from the date on which the copies of the Gazette containing the said notification were made available to the public;

Andwhereas, the copies of the said Gazette were made available to the public on the 25th October , 2004;

And whereas, no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

Now, therefore, in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 , the Central BoilersBoard hereby makes the following regulations further to amend the Indian Boiler Regulations, 1950 , namely:-

1. ( 1) These regulations may be called the Indian Boiler ( Second Amendment) Regulations, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the IndianBoiler Regulations, 1950, in regulation4, in clause ( c) , in sub-clause (vi) , for the Note, the followingNote shall be substituted, namely :

[PART II-SEC. 3(i ) ] " NOTE :-Until , 33,000 hours tests are carried out by National Metallurgical Laboratory or Corporate Research and Development Laboratory of Bharat Heavy Electricals Limited for collecting elevated temperature data of alloy steel produced indigenously against ASME or BS or EN Code, these grades of steel may be accepted and long time elevated temperature properties / maximum allowable stress values given in ASME or BS or EN Code , as the case may be, may be used for the purpose of design , Provided that

(I) a certificate is furnished by the producer of the steel to the effect that the steel has been manufactured strictly in accordance with the technical requirements of the ASME or BS or EN Code to assure that the creep rupture requirements are complied with.

( II ) the Steel maker furnishes the necessary certificate that the steel conforms to the chemical analysis , room and elevated temperature mechanical properties given in ASME or BS or EN Code as the case may be .

(III ) the short - term stress - rupture tests for 1000 hours as described below are carried out by NML/ Steel Plants for the purpose of checking whether the steel is upto the specification and also to ensure that the Steel is capable of meeting the long- term rupture stress values/ maximum allowable stress values given in ASME or BS or EN Code, as the case may be , and a certificate is given by NML/ Steel plant to this effect.

(IV) two numbers of 1000 hour creep rupture tests shall be carried out at a temperature 50° C above the service temperature for each grade of steel for tubing or piping or castings or plates grades; when a furnace and/ or in superheater zone. However , the forging to be used in valves should be tested at 550 ° C for 1000 hours . The stress to cause rupture in 1000 hours at above temperatures may be taken from the master curve corresponding to- 20 % line. At this stress, a niinimum rupture life of 1000 hours is expected. Both the samples should pass 1000 hour tests at the above stress and temperature . These samples may be selected at random by the Chief Inspector ofBoilers of the respective State . The samples could be in the form of semi - finished products , say, forged bars of about 25 mm² which will undergo heat treatment as prescribed by the relevant specifications .

और जबकि रक्त राजपत्र की पतियां आम जनता को 5 नवम्बर, 2004 को तपलब्ध करा दी गयी थीं;

और जबकि विनिर्दिष्ट अवधि के भीतर कोई आपत्तियां अथवा सुझाव प्राप्त नहीं हुए थे ;

अतः अब भारतीय बॉयलर अधिनियम , 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड एत‌द्वारा भारतीय बायलर विनियम, 1950 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है , नामतः :-

1. ( 1 ) इन विनियमों को भारतीय बायलर ( तृतीय संशोधन ) विनियम, 2005 कहा जाएगा ।

(2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बायलर विनियम, 1950 में दूसरे पैरा के लिए विनियम 267 के उपनियम (ई ) में निम्नलिखित टिप्पणी प्रतिस्थापित की जाए:-

" जब तत्व के अभिलक्षण के अनुसार आवश्यकता हो, तब तनाव से उपयुक्त रूप से अवमुक्त होने के लिए विभिन्न तापमान अनिवार्य होंगे । जिस भाग को तनाव/मुक्त करना है, उसे धीरे - धीरे विशेष रूप से उल्लिखित तापमान तक लाया जाएगा तथा उस भाग की अधिकतम मोटाई के कम सेकम 2-1/2 मिनट प्रति मिलीमीटर के अनुपात में निर्धारित अवधि तक ( लगभग मोटाई का 25 मिमी. प्रति घंटा) उस तापमान पर रखा जाएगा एवं ठण्डाकरने के लिए ऐसी भट्टी पर रखा जाएगा जिसका तापमान 400° सेल्सियस से अधिक न हो । कार्बन स्टील एवं ऐसे मामलों में जब तनाव मुक्त करने का तापमान कम से कम 615 ± 20 सेल्सियस हो, तब 50 मिमी. तक सूखने का समय मोटाई का 2-1 / 2 मिनट मिलीमीटर होगा तथा 50 मिमी. से अधिक होने पर प्रति अतिरिक्त 25 मिमी. मोटाई के लिए 15 मिनट होगा तथा उसे ऐसी भट्टी पर ठण्डा किया जाएगा जिसका तापमान 400° सेल्सियससे अधिक न हो" ।

Whereas certain draft regulations further to amend the Indian Boiler Regulation, 1950 were published, as required by sub -section (1 ) of Section 31 of the Indian Boilers Act, 1923 (5 of 1923 ) in the Gazette of India, dated the 30th October, 2004 vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) (Central Boilers Board) number G.S.R. 377 dated the 25th October, 2004 , for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of forty- five days from the date on which the copies of the Gazette containing the said notification were made available to the public ;

Andwhereas, the copies of the said Gazette were made available to the public on the 5th November, 2004;

And whereas , no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

1. (1) These regulations may be called the Indian Boiler (Third Amendment ) Regulations, 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Boiler Regulations , 1950 , in regulation 267 , in Sub -regulation (e) , for the second paragraph, the following shall be substituted, namely:-

"When required by the characteristic of the material, different temperatures may be necessary to obtain proper stress relieving. The part to be stress relieved shall be brought up slowly to the specified temperature and held at that temperature for a period proportioned on the basis of at least 2½ minutes per millimeter of the maximum thickness ofthe part (approximately one hour per 25 mm of the thickness) and shall be left to cool in the furnace to a temperature not exceeding 400°C. Forcarbon steels and when stress relieving temperature is at least 615±20 ° C, the soaking time shall be 2½ minutes per mm ofthickness up to 50mm and 15 minutes for every additional 25mm thickness over 50mm and shall be left to cool in the furnaceto a temperature not exceeding 400 ° C" .

सा.का.नि. 68.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और कृषि और सहकारिता विभाग , तकनीकी सहायक ( डेयरी ) नियम, 1967 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है . कृषि मंत्रालय ( पशुपालन एवं डेयरी विभाग ) में तकनीकी सहायक ( डेयरी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम पशुपालन एवं डेयरी विभाग , तकनीकी सहायक ( डेयरी ) भर्ती नियम , 2005है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि-उक्त पद पर भर्ती की पद्धति, आयु सीमा और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

1 परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । [ भाग II- खण्ड 3(i) ]

In exercise of the powers conferredby the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Cooperation , Technical Assistant (Dairy) Rules , 1967, except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitmentto the post ofTechnical Assistant (Dairy) in the Ministry of Agriculture (Department of Animal Husbandry and Dairying) , namely :-

1. Short title and commencement ( 1 ) These rules may be called the Department of Animal Husbandry and Dairying, Technical Assistant (Dairy) Recruitment Rules, 2005.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Number of post , its classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications, etc. The method of recruitment , age - limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule aforesaid.

4. Disqualification .-No person,- (a) who has entered into or contracted a marnage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may,by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category ofpersons .

6. Saving. Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

८. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राग है कि ऐसा करना आवश्यक गा समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

7. व्यावृत्ति. इन नियमों की कोई भी बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

त्रुटियों का पता लगाने और चालन की लघु त्रुटियों को ठीक करने के योग्य होना

पुनर्नियोजनद्वारा

सशस्त्र बल के समतुल्यरैंक के कार्मिकों में से, जो सेवानिवृत हो गए हैं या एक वर्ष कीअवधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास मोटरकार चलाने के लिए वैध चालन अनुज्ञप्ति है और मोटर कार चालन का कम से कम तीन वर्ष का अनुभव हो । ऐसे व्यक्तियों को, जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं, उस तारीख तक प्रतिनियुक्तिके निर्बधनों पर रखा जाएगा, जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।

आमेलन द्वारा:-विद्युत मंत्रालय में ऐसे नियमित सवार हरकारों ( समूह' ग' ) में से, जिनके पास मोटरकार के लिए वैध चालन अनुज्ञप्ति और मोटर यांत्रिकी का ज्ञान और मोटर कार चालन का तीन वर्ष का अनुभव रखते हैं ।

G.S.R. 70,-In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in partial supersession of the Ministry of Irrigation and Power Class- III and Class - IV posts ) Recruitment Rules. 1965 so far as they relate to Class - III posts , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of (Staff Car Driver) in the Ministry of Power, namely:---

1. Short title and commencement .--( 1 ) These rules may be called the Ministry of Power ( Staff Car Driver ) Recruitment Rules, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette.

rules. 2. Application. These rules shall apply to the posts specified in column I of the Schedule annexed to these

3 3. Number of post , its classification and scale of pay. The number of posts , their classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment , age limit and other qualifications , etc.-The method of recruitinent , age- limit , quali- fications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule aforesaid.

5. Disqualification . No person ,-

(i) who has entered into or contracted a marriage with a person having a spouse living , or

(ii) who , having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied , that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing. exempt any person from the operation of this rule .

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories ofpersons in accordance with the orders issued by the Central Governinent from time to time in this regard .
