सा०का० नि० 78.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, संसदीय कार्य मंत्रालय, संयुक्त सचिव भर्ती नियम , 2002 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. (1 ) इन नियमों का संक्षिप्त नाम संसदीय कार्य मंत्रालय, संयुक्त सचिव भर्ती ( संशोधन ) नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

G.S. R. 78. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Parliamentary Affairs , Joint Secretary Recruitment Rules ,2002, namely:-

1. ( 1 ) These rules may be called the Ministry of Parliamentary Affairs , Joint Secretary Recruitment (Amendment) Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Ministry of Parliamentary Affairs , Joint Secretary Recruitment Rules , 2002, in the Schedule, under column 5, for the words " Selection by merit " the word " Selection " shall be substituted.

सा.का.नि. 85.- केन्द्रीय सरकार, सीमा सुरक्षा बल अधिनियम, 1968 ( 1968 का 47 ) की धारा 141 की उप- धारा ( 2 ) के खंड (ख) और खंड ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सीमा सुरक्षा बल के जल स्कंध में समूह ' ग ' पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

2005है। 1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल, जल स्कंध, समूह ' ग ' पद पर भर्ती नियम , (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागूहोना.-ये नियम इससे उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होंगे ।

3. पदोंकी संख्या, वर्गीकरण और वेतनमान - उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमोंसे उपाबद्ध अनुसूची के स्तम्भ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु सीमा, अहंताएं आदि-उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. निरर्हताएं. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए, किसी व्यक्ति से विवाह किया है, 284

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

[PART II-SEC . 3 ( i )] परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. अधिवार्षिता.-( 1 ) इन नियमों के अधीन नियुक्त किया गया व्यक्ति, उस मास के, जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है, अंतिम दिवस के अपराह्न में सेवानिवृत्त होगा :

परन्तु वह व्यक्ति जिसकी जन्म की तारीख किसी माह के प्रथम दिन की है तो वह सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती माह के अन्तिम दिवस के अपराह्न में सेवानिवृत्त होगा ।

( 2 ) किसी भी व्यक्ति का, उपनियम ( 1 ) में यथा विनिर्दिष्ट अधिवार्षिता की आयु के अतिरिक्त, सेवा में विस्तारण स्वीकृत नहीं होगा। 7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबद, आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृत्ति.-इन नियमों की कोई बात ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेंगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उगबंध करना अपेक्षित है । पद का नाम

4. चिकित्सा मानदण्ड

(क) दृष्टि:-बिना संशोधन के दोनों आंखों की न्यूनतम दूर शक्ति 6/6 और 6/9 ( अर्थात्बिना चश्मा पहने ) ;

(ख) उच्च दृष्टि की रंग दृष्टि

(ग) संघट्ट जानुओं , सपाट पैर, या आंखों में भेंगापन, या ऐसी कोई त्रुटि या विरूपता जिससे सेना के कर्तव्यों के सक्षम निर्वहन में वाधा पड़ सकती हो, नहीं होना चाहिए;

5. सीमा सुरक्षा बल की प्रशिक्षण निर्देशिका में यथा विनिर्दिष्ट शारीरिक दक्षता परीक्षण , लिखित परीक्षण, व्यवसाय परीक्षण और साक्षात्कार में अर्हित होना चाहिए ।

हैड कांस्टेबल ( मास्टर ) ,

( क) जिसने उस श्रेणी में 10 वर्ष नियमित सेवा की है; या

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए दो वर्ष ।

( i ) पचहत्तर प्रतिशत प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति/ पुर्ननियोजन द्वारा (जिसमें अल्प कालिक संविदा भी सम्मिलित है ) ; और

( ख ) जिसने हैड कांस्टेबल ( मास्टर ) की श्रेणी में 5 वर्ष नियमित सेषा के साथ उस श्रेणी में और किसी अन्य श्रेणी में संयुक्त रूप से 18 वर्ष नियमित सेवा की है ; और

(ii ) पच्चीस प्रतिशत सीधी भर्ती द्वारा

(ग ) जो निम्नलिखित वृत्तिक और तकनीकी अर्हताएं रखता है:-

( i ) सीमा सुरक्षा बल निर्देशिका में विनिर्दिष्ट बुनियादी प्रशिक्षण और पाठ्यक्रमों को सफलतापूर्वक पूर्ण किया है;

(ii) प्रथम श्रेणी का मास्टर प्रमाण पत्र रखता है ; और

(iii ) सीमा सुरक्षा बल निर्देशिका जिल्द IX में यथा विनिर्दिष्ट शेप- चिकित्सा प्रवर्ग ।

प्रतिनियुक्ति

केन्द्रीय सरकार या राज्य सरकार के ऐसे ऑफिसर :-

( i) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ है ; या

(ⅱ ) जिन्होंने 4000-6000 रु. के वेतनमान में उस पद पर दस वर्ष नियमित सेवा की है; और

( iii ) जो प्रथम श्रेणी मास्टर प्रमाण पत्र रखते हैं ।

पुर्ननियोजन ( भूतपूर्व सैनिकों के लिए )

सशस्त्र बल को ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और स्तंभ 8 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं हैं पर विचार किया जाएगा। यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है, तत्पश्चात् उन्हें पुनर्नियोजन सत्तावन की आयु तक बने रहने दिया जा सकता है ।

(ऐसे विभागीय अधिकारी, जो प्रोन्नति को सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

प्रतिनियुक्ति ( संविदा की अवधि ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्यसंगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति पर स्थानान्तरण द्वारा नियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भीहै ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । )

(i ) प्रथम श्रेणी इंजन चालक प्रमाण पत्र अभिप्राप्त करने के पश्चात् दो वर्ष के अनुभव के साथ प्रथम श्रेणी इंजन चालक प्रमाण पत्र रखता हो;

(iii ) सीमा सुरक्षा बल निर्देशिका जिल्द IX में यथा विनिर्दिष्ट चिकित्सा प्रवर्ग शेप-1 ।

प्रतिनियुक्ति:

केन्द्रीय सरकार या राज्य सरकार के ऐसे ऑफिसर: -

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अषधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और स्तंभ 6 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं हैं पर विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन सत्तावन की आयु तक बने रहने दिया जा सकता है । [ भाग II- खण्ड 3 (i) ]

5. चिकित्सा मानदण्ड

6. सीमा सुरक्षा बल की प्रशिक्षण निर्देशिका में यथा विनिर्दिष्ट शारीरिक दक्षता परीक्षण, लिखित परीक्षण व्यवसाय परीक्षण और साक्षात्कार में अर्हित होना चाहिए ।

प्रोन्नति:

(i ) बालीस प्रतिशत प्रोन्नति द्वारा जिसके न हो सकने पर सीधी भर्ती/प्रतिनियुक्ति/ पुर्ननियोजन द्वारा ( जिसके अंतर्गत अल्पकालिक संविदा भी सम्मिलित है ) ; और

हैड कांस्टेबल ( कर्मीदल ) जिन्होंने उस श्रेणी में 8 वर्ष नियमित सेवा की हो और जो निम्नलिखित वृत्तिक और तकनीकी अर्हताएं रखता हो:-

(ii ) साठ प्रतिशत सीधी भर्ती द्वारा ।

(ख ) जो सारंग प्रमाण पत्र रखता हो ।

( ग ) सीमा सुरक्षा बल निर्देशिका जिल्द IX में यथा विनिर्दिष्ट चिकित्सा प्रवर्ग शेप- I ।

केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारी ....

(i) जो नियमित आधार पर सदृश पद धारण किया हुआ है ; या

( ii ) द्वितीय श्रेणी इंजन ड्राइवर प्रमाण - पत्र अभिप्राप्त करने के पश्चात् एक वर्ष के अनुभव के साथ द्वितीय श्रेणी इंजन ड्राइवर प्रमाण- पत्र रखता हो;

पुनर्नियोजन ( भूतपूर्व सैनिकों के लिए ):-

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं. और स्तंभ 6 के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं हैंपर विचार किया जाएगा । यदि चयन कर लिया जाता है तो ऐसे अधिकारियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है , तत्पश्चात् उन्हें पुनर्नियोजन सत्तावन की आयु तक बने रहने दिया जा सकता है ।

(ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

प्रतिनियुक्ति ( संविदा की अवधि) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति संविदा की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी।

प्रतिनियुक्ति पर स्थानान्तरण द्वारा नियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । ) 298

G.S.R. 85. In exercise of the powers conferred by the clauses (b) and (c ) of Sub -section (2) of section 141 of theBorder Security force Act, 1968 (47 of 1968) , the Central Government hereby makes the following rules regulating the method of recruitment to Group ' C' posts in the Water Wing ofBorder Security Force , namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Border Security Force Water Wing Group 'C' Posts Recruitment Rules, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application . These rules shall apply to the posts specified in column lof the Schedule annexed to these rules .

3. Number ofposts , classification and scale of pay.-- The number of the posts, their classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment, age limit qualifications , etc.--The method of recruitment age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Disqualification .---No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicableto such person and there are other grounds for so doing , exempt any person from the operation of this rule. 6. Superannuation. ( 1 ) The person apointed under those rules shall retire from service on the afternoon ofthe last day of the month in which he attains the age of fifty seven years :

Provided that the person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty seven years .

rule(1). (2) No persons shall be granted extension in service beyond the age of superannuation as specified in sub- 7. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may,by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect of any class or category of persons .

8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Ex -servicemen and other Special Categories of persons in accordance with the orders , issued by the Central Government from time to time in this regard.

सा.का.नि. 88. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय डाक और दूर संचार, लेखा और वित्त सेवा समूह ' क' भर्ती नियम, 2001 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( i ) इन नियमों का संक्षिप्त नाम भारतीय डाक और दूर संचार, लेखा और वित्त सेवा समूह " क " भर्ती ( संशोधन ) नियम, 2005 है । (ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय डाक और दूर संचार, लेखा और वित्त सेवा समूह ' क " भर्ती नियम, 2001 में,-

(क) नियम 8 में, " पद को प्रतिनियुक्ति " शब्दोंके पश्चात् " जिसके अंतर्गत अल्पकालिक संविदा भी है " शब्द अंतःस्थापित किए जाएंगे;

[PART II-SEC. 3 ( i ) ] (ख ) अनुसूची-1 में , " श्रेणी " शीर्षक के अधीन " कार्यभार के आधार पर पदों की संख्या में परिवर्तन किया जा सकता है " पद के पश्चात् अंत में निम्नलिखित जोड़ा जाएगा, अर्थात्:-

"टिप्पण: कनिष्ठ प्रशासनिक श्रेणी ( आकृत्यिक चयन श्रेणी- रु. 14300-18300/- ) एक अकृत्थिक पद है और इस श्रेणी में पदों की अधिकतम संख्या, ज्येष्ठ बाध्यता पदों ( अर्थात्, ज्येष्ठ काल वेतनमान और सेवा से ऊपर के स्तर के सभी बाध्यता पदों ) के 30 प्रतिशत के बराबर होगा और अकृत्यिक चयन श्रेणी के पदों की अधिकतम संख्या, कनिष्ठ प्रशासनिक श्रेणी में मंजूर किए गए पदों की कुल संख्या से अधिक नहीं होगी ।"

G.S. R. 88.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Indian Posts and Telecommunications , Accounts and Finance Service Group ' A' Recruitment Rules , 2001 , namely:--

1. (1 ) These rules may be called the Indian Posts and Telecommunications , Accounts and Finance Services Group' A' Recruitment (Amendment) Rules , 2005.

(2) They shall come in force on the date of their publication in the Official Gazette .

2. In the Indian Posts and Telecommunications , Accounts and Finance Service Group ' A' Recruitment Rules, 2001 ,

(a) in rule 8 after the words " may appoint on deputation " , the words including short - term contract " shall be inserted;

(b) in Schedule - I , under the heading ' Grade ' , after the expression * number of posts variable depending on workload ' , the following shall be added at the end namely: -

"Note: The Junior Administrative Grade (Non - Functional Selection Grade -Rs. 14300-18300/-) is a non - functional post and the maximum number of the posts in this grade shall be equal to 30 % of the senior duty posts ( i.e. all duty posts at the level of Senior Time Scale and above in the service) and the maximum number of posts to the Non -Functional Selection Grade shall not exceed the total number of sanctioned posts in Junior Administrative Grade . "
