का.नि.आ. 124.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रक्षा मंत्रालय , रक्षा अनुसंधान और विकास विभाग , उच्च प्रौद्योगिकी जलयान प्रोग्राम, ( सिविलियन एम. टी. ड्राइवर ) भर्ती नियम, 1999 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) रक्षा मंत्रालय, रक्षा अनुसंधान और विकास विभाग, उच्च प्रौद्योगिकी जलयान प्रोग्राम ( सिविलियन मैकेनिकल ट्रान्सपोर्ट ड्राइवर ) भर्ती संशोधन नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. रक्षा मंत्रालय, रक्षा अनुसंधान एवं विकास विभाग , उच्च प्रौद्योगिकी जलयान प्रोग्राम ( सिविलियन मैकेनिकल ट्रान्सपोर्ट ड्राइवर ) भर्ती नियम, 1999 में, अनुसूची के स्थान पर निम्नलिखित अनुसूची रखी जाएगी , अर्थात्: -

भारी यानों के चालन की विधिमान्य अनुज्ञप्ति रखता हो । भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/ आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

(क) 50 प्रतिशत सीधी भर्ती द्वारा ।
(ख ) सशस्त्र बल कार्मिकों के प्रतिनियुक्ति/पुनिर्नियोजन पर 25 प्रतिशतं आमेलन द्वारा । ऐसा न हो सकने पर सीधी भर्ती द्वारा ।
(ग) 25 प्रतिशत उच्च तकनीकी जलयान प्रोग्राम में कार्यरत समूह ' घ' कर्मचारियों की पदोन्नति द्वारा । ऐसा न हो सकने पर भूतपूर्व सैनिकों की प्रतिनियुक्ति तथा पुनर्नियोजन तथा उसके भी न हो सकने पर सीधी भर्ती द्वारा ।

टिप्पण-आयु-सीमा अवधारित करने के लिए निर्णायक तारीख अभ्यर्थियों से ( अंदमान निकोबार और लक्षद्वीप सहित ) आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ।
रोजगार कार्यालयों के माध्यम से की जाने वाली भर्ती की दशा में , आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गयाहै ।
परिवीक्षा की अवधि, यदि कोई हो ।
सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागूहोंगी या नहीं ।

सशस्त्र बल कार्मिकों की प्रतिनियुक्ति या पुनर्नियोजन के आधार पर सिपाही, नायक तथा हवलदार और समतुल्य रैंक के सशस्त्र बलों के कार्मिक जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या जो एक वर्ष की अवधि के भीतर रिजर्व प्रवर्ग में स्थानांतरित किये जाने वाले हैं और जिनके पास अनुसूची के स्तंभ 8 के अधीन दी गई शैक्षिक अर्हताएं तथा अनुभव हो, ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति की शर्त दी जाएगी जिस तारीख तक उन्हें सशस्त्र सेनाओं से निर्मुक्त किया जाना है तत्पश्चात् उन्हें पुनर्नियोजन के आधार पर ।
पदोन्नति:
उच्च तकनीकी जलयान कार्यक्रम में कार्यरत ऐसे समूह ' घ ' कर्मचारी जिन्होंने उस श्रेणी में पांच वर्ष की नियमित सेवा की हो तथा जिनके पास अनुसूची के स्तंभ 8 में दी गई शैक्षिक अर्हताएं तथा अपेक्षित अनुभव हो तथा जो व्यवसाय परीक्षण में उत्र्तीर्ण हो । [भाग II- खण्ड 4 ]

In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Defence , Department of Defence Research and Development , the Advanced Technology Vessels Programme ( Civilian Mechanical Transport Drivers ) Recruitment Rules , 1999 , namely :-
1. Short title and commencement .-( 1 ) These rules may be called the Ministry of Defence , Department of Defence Research and Development the Advanced Technology Vessels Programme ( Civilian Mechanical Transport 2) They shall come into force on the date of their publication in the Official Gazette .

का.नि.आ. 125.- रक्षा संकर्म अधिनियम , 1903 ( 1903 की 7 ) की धारा 3 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए, केन्द्र सरकार एतद्वारा घोषणा करती है कि नींचे दी गई अनुसूची में उल्लिखित भूमि हिमाचल प्रदेश राज्य के जिला किनौर में गोलाबारूद स्थल 36 सेक्टर आयुध रखरखाव प्लाटून कि निकट होने के कारण इसे भवनों तथा अन्य बाधाओं से मुक्त रखे जाने के उद्देश्य से इसके उपयोग तथा अधिभोग पर उपयुक्त अधिनियम की धारा 7 में इस अधिसूचना को सरकारी राजपत्र में प्रकाशित करने की तारीख से निर्दिष्ट प्रतिबंध लगाया जाना आवश्यक है । 2. उपर्युक्त भूमि की योजना से संबंधित रेखाचित्र नक्शे का निरीक्षण उपायुक्त, जिला किनौर, हिमाचल प्रदेश राज्य के कार्यालय में किया जासकता है ।

In exercise of the powers conferred by Section 3 of the Works of Defence Act, 1903 (7 of 1903 ), the Central Government hereby declares that it is necessary to impose the restrictions specified in Section 7 of said Act upon the use and enjoyment of the land described in the Schedule below, being land lying in the vicinity of Ammunition Point , 36 Sector Ordnance Maintenance Platoon (OMP) , District Kinnaur in the State of Himachal Pradesh, in order that the said land may be kept free from building and other obstructions , from the date of publication of this notification .
2. A Sketch plan of the said land may be inspected in the office of Deputy Commissioner, Kinnaur in the State of Himachal Pradesh .

All the land comprised in the area lying within the distance of one thousand two hundred yards from the periphery of the works of defence , namely, Ammunition Point , 36 Sector Ordnance Maintenance Platoon ( OMP) , Dist . Kinnaur in the state of Himachal Pradesh.

का.नि.आ. 127.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और आर्डनेंस कारखाना बोर्ड ( समूह ' ग ' अनौद्योगिक पद ) भर्ती नियम, 1991 जहां तक उनका संबंध स्टाफ कार ड्राईवर श्रेणी-1 और स्टाफ कार ड्राईवर श्रेणी -2 के पद से है उन बातों के सिवास अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है कतिपय समूह ' ग ' पद जहां तक उनका संबंध आर्डनेंस कारखाना बोर्ड ( जिसके अंतर्गत आर्डिनेंस उपस्कर कारखाना समूह मुख्यालय, कानपुर आर्मड यान मुख्यालय , आवड़ी, आर्डनेंस कारखाना सेल , नई दिल्ली और आर्डनेंस कारखाना बोर्ड मुख्यालय कोलकाता भी है ) में स्टाफ कार ट्राईवर विशेष श्रेणी , स्टाफ कार ड्राईवर श्रेणी-1 , स्टाफ कार ड्राईवर श्रेणी 2 , स्टाफ कार ड्राईवर सामान्य श्रेणी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

[PART II- SEC . 4 ] 2005है। 1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम आर्डनेंस कारखाना बोर्ड ( समूह ' ग ' अनौद्योगिक पद ) भर्ती नियम, (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना:-ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होंगे ।
3. पद संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो उक्त अनुसूची के स्तम्भ (2) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अहर्ताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
5. निरर्हता: वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पदों पर नियुक्ति का पात्र नहीं होगा:
परन्तु, यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृति: इन नियमों की कोई बात , ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

S.R.O. 127. In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Ordnance Factory Board (Group ' C' Non - Ministerial Posts Recruitment Rules , 1991 , in so far as they relate to the post of Staff Car Driver Grade I and Staff Car Driver Grade II, except as respects things done or omitted to be done before such supersession the President hereby makes the following rules regulating the method of recruitment to certain Group C' posts in so far as they relate to the post of Staff Car Driver Special Grade , Staff Car Driver Grade I , Staff CarDriver Grade II, Staff Car Driver Ordinary Grade, in the Ordnance Factory Board ( including Ordnance Equipment Factories Group Headquarters , Kanpur, Armoured Vehicles Headquarters , Avadi , Ordnance Factories Cell , New Delhi and Ordnance Factory Board Headquarters , Kolkata ) , namely :-
1. Short title and commencement-( 1 ) These rules may be called the Ordnance Factory Board ( Group ' C' Non- Ministerial Posts) Recruitment Rules , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application . These rules shall apply to the posts specified in column ( 1 ) of the Schedule annexed to these rules.
3. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale ofpay attached thereto shall be as specified in Column No. (2) to (4) of the said Schedule .
4. Method of recruitment , age limit and qualifications etc. The method of recruitment to the said posts, age limit, qualifications and other matters connected therewith, shall be as specified in Column (5) to ( 14) of the Schedule.
5. Disqualification. No person
(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to any of the said posts :
Provided that the Central Government may, if satisfied that the marriage in permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons or posts .
7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in thisregard.
