सा. का. नि. 407.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विधि, न्याय और कंपनी कार्य मंत्रालय , विधायी विभाग , विधि साहित्य प्रकाशन ( समुह ख पद ) भर्ती नियम , 1982 और विधि, न्याय और कंपनी कार्य मंत्रालय, विधायी विभाग, विधि साहित्य प्रकाशन ( समूह ग पद ) भर्ती नियम, 1998 को, जहां तक उनका संबंध आशुलिपिक ( हिन्दी) और कारबार कार्मिक से है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , विधि साहित्य प्रकाशन, विधायी विभाग , विधि और न्याय मंत्रालय में समूह ' ख ' पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम विधि और न्याय मंत्रालय, विधायी विभाग, विधि साहित्य प्रकाशन , समूह 'ख ' पद भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. लागू होनाः-ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । 4. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं । 5. निरर्हता: वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु बंदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

6. शिथिल करने की शक्ति:-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हे लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृति:-इन नियमों की कोई बात , ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिकों और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

1. संयुक्त पद्धति ( प्रतिनियुक्ति और आमेलन ) केन्द्रीय या राज्य सरकारों या संघ राज्य क्षेत्रों के ऐसे अधिकारी:

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

( ii ) जिसने मूल काडर या विभाग में 5500-9000 रुपए के या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में तीन वर्ष सेवा की है; और

( ख ) जो निम्नलिखित शैक्षिक योग्यता और अनुभव रखते हैं, अर्थात्:-

( i ) वैकल्पिक या अनिवार्य हिन्दी विषय के रूप में किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक डिग्री या समतुल्य;

( ii ) किसी प्रकाशन घर या प्रिंटिंग प्रेस या प्रिंटिंग विभाग में तीन वर्ष काअनुभव ।

2. ऐसे विभागीय कारबार कार्मिक जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की है , बाह्य व्यक्तियों के साथ उन पर भी विचार किया जाएगा, और यदि वे चयनित हो जाते हैं तो पद प्रोन्नति द्वारा भरा हुआ समझा जाएगा।

टिप्पण 1 - पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 - प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहींहोगी।

टिप्पण 3 - प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

आवश्यक: -

सीधी भर्ती किए जाने वाले व्यक्तियों के लिए दो वर्ष

लागू नहीं होता

(i) किसी मान्यताप्राप्त विश्वविद्यालय सेविधिमें स्नातक डिग्री या समतुल्य;

(ii ) स्नातक डिग्री स्तर पर हिन्दी अनिवार्य या वैकल्पिक विषय के रूप में हो;

30 वर्ष से अधिक नहीं ( केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों के लिए 5 वर्ष तक शिथिल की जा सकती है । टिप्पण: आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय, अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा- जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )

( iii ) ( क ) अधिवक्ता के रूप में तीन वर्ष तक व्यवसाय किया हो; या (ख ) केन्द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्र में विलेखों, विधेयकों, नियमों, विनियमों या आदेशों आदि का हिन्दी में अनुवाद कार्य में तीन वर्ष का अनुभव; या (ग) उच्चतम न्यायालय या उच्च न्यायालय के निर्णयों का हिंदी में सम्पादन और अनुवाद कार्य का तीन वर्ष का अनुभव रखता हो । टिप्पण 1-अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जासकती है । टिप्पण 2- अनुभव संबंधी अर्हता (अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनु- सूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है । वांछनीय:-किसी मान्यताप्राप्त विश्व- विद्यालय से विधि में स्नातकोत्तर डिग्री ।

प्रतिनियुक्ति/आमेलन

(i ) पचास प्रतिशत ।

केन्द्रीय या राज्य सरकारों या संघ राज्य क्षेत्रों के ऐसे अधिकारी,- प्रोन्नति/ आमेलन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा ; और

(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii ) पचास प्रतिशत सीधी भर्ती द्वारा ।

(ख) जिनके पास स्तंभ 8 के अधीन सीधी भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं ।

टिप्पण 1-पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं [ भाग II- खण्ड 3 ( i) ]

होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2- प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य क्राडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहींहोगी ।.

टिप्पण 3 - प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । 13

समूह 'ख' विभागीय प्रोन्नति समिति ( पुष्टि पर विचार करने के लिए ) निम्नलिखित से मिलकर बनेगी:-

प्रोन्नति: ऐसा मुद्रण सहायक जिसने उस श्रेणी में छह वर्ष नियमित सेवा की हो । टिप्पण:-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा, के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम 'न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है।

प्रतिनियुक्ति: केन्द्रीय या राज्य सरकारों या संघ राज्य क्षेत्रों के ऐसे अधिकारी:

( क ) ( 1 ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(2) जिसने मूल काडर या विभाग में 5500-9000 रुपए या समतुल्य वेतनमान में नियुक्तिके पश्चात् नियमित आधार पर उस श्रेणी में तीन वर्ष सेवा की है; और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं:

( 1 ) स्नातक डिग्री स्तर पर हिन्दी वैकल्पिक या अनिवार्य विषय के रूप में हो ; और

(2) अधिनियमों, विधेयकों, नियमों, विनियमों या उच्चतम न्यायालय या उच्च न्यायालय के साथ निर्णयों का तीन वर्ष का अनुभव और प्रूफ रीडिंग का ज्ञान।

( ग) के निर्णयों का हिंदी में एडिटिंग और अनुवाद कार्य का तीन वर्ष का अनुभव।

टिप्पण 1-पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्तिपर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2- प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति के ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 3-प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

किसी अधिकारी को प्रतिनियुक्ति पर नियुक्त करते समय संघ लोक सेवा आयोग से परामर्श करना आवश्यक है । निम्नलिखित से मिलकर बनेगी:

प्रतिनियुक्ति/आमेलन:

(अ) (क) ( i ) केन्द्रीय सचिवालय सेवा के ऐसे सहायक जो नियमित आधार पर पद धारण किए हुए हैं; या

( ii ) केन्द्रीय सचिवालय लिपिकीय सेवा के ऐसे उच्च श्रेणी लिपिक जिन्होंने उस श्रेणी में नियमित आधार पर ' आठ वर्ष ' सेवा की है ; और

(ख ) जिन्होंने सचिवालय प्रशिक्षण और प्रबंध संस्थान मे रोकड़ और लेखा कार्य या समतुल्य में प्रशिक्षण प्राप्त किया है और रोकड़, लेखा और बजट कार्य का तीन वर्ष का अनुभव रखते हों;

जिसके न हो सकने पर

प्रतिनियुक्ति

(आ ) केन्द्रीय सरकार के ऐसे अधिकारी:

(क) ( 1 ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

( 2 ) जिसने मूल काडर या विभाग में 5000-8000 रुपए के या समतुल्य वेतनमान में नियुक्तिके पश्चात्नियमित आधार पर उस श्रेणी में तीन वर्ष सेवा की है; या

(3) जिसने मूल काडर या विभाग में 4500-7000 रुपए के या समतुल्य वेतनमान में नियुक्तिके पश्चात्नियमित आधार पर उस श्रेणी में छह वर्ष सेवा की है;

(4 ) जिसने मूल काडर या विभाग में 4000-6000 रुपए के या समतुल्य वेतनमान में नियुक्तिके पश्चात्नियमित आधार पर उस श्रेणी में आठ वर्ष सेवा कीहै;

(ख) जिन्होंने सचिवालय प्रशिक्षण और प्रबंध संस्थान में रोकड़ और लेखा कार्य या समतुल्यमें प्रशिक्षण प्राप्त किया है और रोकड़, लेखा और बजट कार्य का तीन वर्ष का अनुभव रखते हों; जिसके न हो सकने पर

(ग) अधीनस्थलेखा सेवा परीक्षा या केन्द्रीय सरकार के किसी लेखा विभाग द्वारा आयोजित समतुल्य परीक्षा उत्तीर्ण की हो ।

टिप्पण 1- पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति 'द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 407.-In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Ministry ofLaw, Justice and Company Affairs , Legislative Department , Vidhi Sahitya Prakashan(Group B posts) Recruitment Rules, 1982; and the Ministry of Law, Justice & Company Affairs , Legislative Department , Vidhi Sahitya Prakashan (Group ' C ' posts ) Recruitinent Rules, 1998, in so far as they relate to the posts of Stenographer (Hindi) and Business Excutive Except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of Recruitment to Group ' B ' posts in the Vidhi Sahitya Prakashan . Legislative Department, Ministry ofLaw and Justice , namely:-

1. Short title and Commencement.-( 1 ) These rules may be called the Ministry of Law and Justice , Legislative Department, Vidhi Sahitya Prakashan, Group 'B ' posts Recruitment Rules , 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application :-These rules shall apply to the posts specified in column 1 ofthe Schedule annexed to thesc rules.

3. Number of Posts , Classification and Scale of Pay: The number of the said posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of Recruitment , Age Limit , Qualifications , etc.:-The method of recruitment age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule .

5. Disqualification.-No person,--

(a) who has entered into or contracted a marriage , with a person having a spouse living; or (b) who , having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation ofthis rule.

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may. by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. $ aving. Nothing in these rules shall effect reservations , relaxation of age limit and other concessions required to be provided for Scheduled Castes , Scheduled Tribes , Ex-Servicemen and other special categories ofpersons, inaccordance with the orders issued by the Central Government from time to time in this regard .

सा. का. नि. 408- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, गृह मंत्रालय, सशस्त्र सीमा बल में पशु चिकित्सा काडर, समूह ' ग ' पद पर भर्ती की पद्धति का बिनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः- 1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय , सशस्त्र सीमा बल योद्यक परा पशु चिकित्सा काडर, समूह ' ग ' पद भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. लागू होनाः-ये नियम इससे उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होगा ।

3. पद - संख्या , वर्गीकरण और वेतनमानः उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदिः उक्त पद पर भर्ती की पद्धति, आयु सीमा, और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. निरर्हताः-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. अधिवर्षिताः- इन नियमों के अधीन नियुक्त कोई व्यक्ति सत्तावन वर्ष की आयु प्राप्त होने के मास की अंतिम दिन को अपराह्न में सेवा सेनिवृत्त होगा ।

परन्तु, कोई व्यक्ति जिसकी जन्म की तारीख किसी माह की पहली तारीख है वह 57 वर्ष की आयु प्राप्त होने के माह के पूर्ववर्ती माह की आखिरी तारीख को अपराह्न में सेवा से निवृत्त होगा ।

7. शिथिल करने की शक्तिः जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 8. व्यावृतिः - इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

9. सेवा का दायित्वः-इन नियमों के अधीन किसी उक्त पदों पर नियुक्त कोई व्यक्ति भारत में किसी भी जगह सभी के लिए सेवा के दायित्व के अधीन होगा ।

प्रोन्नति:-

( क ) ऐसे हेड कांस्टेबल ( पशु चिकित्सा ) जिन्होंने श्रेणी में पांच वर्ष नियमित सेवा की हो प्रोन्नति द्वारा , जिसके न होने पर प्रतिनियुक्ति/ आमेलन/पुनः नियोजन द्वारा ।

और किसी मान्यताप्राप्त संस्था से स्टाक सहायक का छह मास का पाठ्यक्रम किया हो।

टिप्पण.-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है। 1785 भारत का राजपत्र: दिसम्बर 3 , 2005/अग्रहायण 12 , 1927

प्रतिनियुक्त/आमेलन:

केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारी,

(क) जो नियमित आधार पर सदृश्य पद धारण करते हैं और किसी मान्यताप्राप्त संस्था से स्टाक सहायक पाठ्यक्रम सफलतापूर्वक पूरा किया हो,

या

( ख ) ऐसे हेड कांस्टेबल ( साधारण ड्यूटी ) जिन्होंने श्रेणी में नियमित आधार पर पांच वर्ष की सेवा की हो के साथ किसी मान्यताप्राप्त संस्था से छह मास का स्टाक सहायक पाठ्यक्रम सफलतापूर्वक पूरा किया हो,

या

(ग) रु. 3200-85-4900 वेतनमान में पांच वर्ष की नियमित सेवा की हो और किसी मान्यता प्राप्त संस्थान से छह माह का स्टाक सहायक पाठ्यक्रम सफलतापूर्वक पूरा किया हो । (पोषक प्रवर्ग के ऐसेविभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति परनियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधिजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । ( प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहींहोगी। )

भूतपूर्व सैनिकोंके लिए पुनर्नियोजन:

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्तिके निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल सेनिर्मुक्तकिया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है । यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

(ii ) किसी मान्यताप्राप्त बोर्ड या विश्वविद्यालय से मैट्रीकुलेशन पास हो ।

( 2 ) शारीरिक और चिकित्सीय मानक ( केवल पुरुष अभ्यर्थियों के लिए) अभ्यर्थी निम्नलिखित उपेक्षाओं को पूरा करेंगे:-

शारीरिकमानक:

( क) ऊंचाई : 170 सें.मी.

शिथिलनीय.- ( i ) गढ़वाल , कुमायुं, हिमाचल प्रदेश,

गोरखा, डोंगरा, मराठा, सिक्कमी, लेह और लद्दाख, कश्मीर घाटी और पूर्वोत्तर पहाड़ी क्षेत्रों के अभ्यर्थियों के लिए 5 सें.मी. तक

18-23 वर्ष के बीच आयु-सीमा अव- धारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश मिजोरम , मणिपुर , नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा- जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित कीगई है। )

(ii ) जनजाति/आदिवासी, जिसके अंतर्गत मिजो और नागा भी हैं को 7.5 सें.मी.

(ख) सीना:

(अनुसूचित जातियों और अनुसूचित जनजातियों की बाबत 45 वर्ष तक) रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्तिकी दशा में, आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

साधारण जनजाति/आदिवासी बिना फुलाए 80 सें.मी. 77 से.मी. , फुलाए 85 से.मी. 82 सें.मी. चिकित्सीय परीक्षण: ( क ) नेत्र दृष्टि ( बिना संशोधन के ) दूर दृष्टि: अच्छी आंख 6/6 या 6/9 खराब आंख 6/12 या 6/9 निकट दृष्टि (ग) अभ्यर्थियों को अंतर्जानु, सपाट पैर, स्फीत शिरा

या तिर्यक आंखों वाला और उच्चरंग दृष्टि का नहीं होना चाहिए । अभ्यर्थियों का इशाहरा के परीक्षण साथ ही एडरिच - ग्रीन लेनटर्न परीक्षण द्वारा रंग दृष्टि के लिए परीक्षण किया जाएगा । उन्हें अच्छे मानसिक और शारीरिक रूप से स्वास्थ्य का होना चाहिए और उन्हें किसी भी शारीरिक विकृति का नहीं होना चाहिएजिससे कर्तव्यों के पक्षपालन में व्यवधान उत्पन्नहो ।

( 3) पदधारक की नियुक्ति के पश्चात् उसे आधारिक भर्ती पाठ्यक्रम पास करना होगा और किसी मान्यता- प्राप्त संस्थाया संगठन से एक वर्ष की अवधि के

भीतर किसी मान्यताप्राप्त संस्था या संगठन से स्टाक सहायक पाठ्यक्रम पास करना होगा जिसमें असफल होने पर वह सेवा समाप्ति के लिए दायी होगा।

वांछनीय: किसी मान्यताप्राप्त पशु चिकित्सा में विभिन्न पदों के पशुओं की चिकित्सा में एक वर्ष का अनुभव।

आमेलन:

प्रोन्नति, जिसके न होने पर प्रतिनियुक्ति/ आमेलन/पुनः नियोजन द्वारा ।

कांस्टेबल [ साधारण ड्यूटी या फील्ड सहायक ( सहायक) ] जो स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित्त शैक्षिक अर्हताएं और शारीरिक माप रखते हों और सशस्त्र सीमा बल का आधारित भर्ती पाठ्यक्रम तथा किसी मान्यताप्राप्त संस्था से छह मास का स्टाक सहायक का पाठ्यक्रम किया हो ।

भूतपूर्व सैनिकोंके लिए पुनर्नियोजन:

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधिके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्तिके निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।

G.S.R. 408. In exercise of the powers conferred by the proviso to Article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to Group ' C ' Combatised Para -Veterinary Cadre posts in the Ministry of Home Affairs , Sashastra Seema Bal , namely:---

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Home Affairs , Sashastra Seema Bal Combatised Para -Veterinary Cadre , Group ' C ' Posts Recruitment Rules, 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. These rules shall apply to the posts specified in column 1 of the Schedule annexed to thesc rules.

3. Number of posts , classification and scale of pay. The number of the posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

4. Method of recruitment, age limit qualifications , etc.-The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule .

5. Disqualification.-- No person,-

(a) Who, having a spouse living, has entered into or contracted a marriage with any person; or (b) Who has entered into or contracted a marriage with a person having a spouse living , shall be eligible for appointmentto the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rules.

1789 7. Superannuation. A person appointed under these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty- seven years :

Provided that a person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty - seven years.

8. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

9. Savings. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the scheduled castes , the scheduled tribes , ex - servicemen and other special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

10. Liability of service. Any person appointed to the said posts under these rules shall be liable to serve anywhere in India.
