सा.का.नि. 423.- यतः वाणिज्य और उद्योग मंत्रालय ( केन्द्रीय बॉयलर बोर्ड ) भारत सरकार के दिनांक 16 मई, 2005 की अधिसूचना संख्या सा.का.नि. 170 के साथ इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव, उक्त राजपत्र अधिसूचना की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने से पहले मांगने के लिए भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5) की धारा 31 की उप - धारा ( 1 ) जो दिनांक 21 मई, 2005 के भारत के राजपत्र के भाग II, खंड 3 , उप- खंड ( i ) में है , द्वारा यथा अपेक्षित भारतीय बॉयलर अधिनियम, 1950 में और संशोधन करने के लिए कुछ विनियमों के मसौदे प्रकाशित किये गये थे;
और जबकि उक्त राजपत्र की प्रतियां आम जनता को 13 जून, 2005 को उपलब्ध करा दी गयी थीं;
और जबकि उक्त मसौदे में विनिर्दिष्ट अवधि के भीतर किसी भी व्यक्ति से ऐसे मसौदों के संबंध में कोई आपत्तियां अथवा सुझाव प्राप्त नहीं हुए थे;

[PART II-SEC. 3 (i) ] अतः अब भारतीय बॉयलर अधिनियम , 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड एतद्वारा भारतीय बॉयलर विनियम, 1950 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है, नामतः-
1. ( 1 ) इन विनियमों को भारतीय बॉयलर ( चौथा संशोधन ) विनियम, 2005 कहा जायेगा ।
(2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।
2. भारतीय बायलर विनियम, 1950 ( इसे इसके पश्चात् मुख्य विनियम कहा जाएगा ) , विनियम 376 में, खंड ( च ) के पश्चात् निम्नलिखित खंड जोड़ा जाएगा, नामत :-
"(चच ) 50 कि.ग्रा. /सेंमी अथवा अधिक दाब पर कार्य कर रहे और अनन्य रूप से विद्युत शक्ति के जनित्रण के लिए प्रयोग किए जाने वाले बॉयलारों के लिए परिशिष्ट ' जेए ' के उपबंधों के अनुसार निरीक्षण किया जाएगा। "
3. मुख्यविनियम में, विनियम 377 के स्थान पर निम्नलिखित विनियम प्रतिस्थापित किया जाएगा नामत:-
377." पंजीकरण हेतुबॉयलरों का हाइड्रालिक ( द्रवचालित ) परीक्षणः-
(क) प्रत्येक बॉयलर का एक निरीक्षक की उपस्थिति में द्रवचालित परीक्षण किया जाएगा ।

(ख ) 50 कि. ग्रा. /सेंमी अथवा अधिक दाब पर कार्य कर रहे और अनन्य रूप से विद्युत शक्ति के जनित्रण हेतु प्रयोग किए जाने वाले बॉयलरों के मामले में , प्रत्येक वर्ष प्रमाण पत्र जारी करने के लिए द्रवचालित परीक्षा करने की आवश्यकता नहीं होगी, बशर्ते ऐसे बॉयलरों का निरीक्षण विनियम 376 के उपबंधों के अनुसार किया जाए । "

मुख्यविनियम में, फार्म XVIII के पश्चात् निम्नलिखित फार्म जोड़ा जाएगा, नामत:-

"अनुबन्ध'जेए'
[ कृपया विनियम 376 ( चच ) देखें]
(क) 50 कि.ग्रा./सें.मी अथवा अधिक के दवाब पर तथा 20 वर्ष से अधिक से काम कर रहे बिजली उपयोगी बॉयलर । ( 1 ) बिजली उत्पादन के लिए भाप का सर्जन करने वाले बायॅलरों का, जो 50 कि.ग्रा ./सें.मी² अथवा अधिक के दबाव पर तथा 20 वर्ष की अवधितक से काम कर रहे हैं, पूर्ण निरीक्षण की तारीख से 12 माह की अवधि समाप्त हो जाने पर नीचे दिए गए ब्यौरे के अनुसार निरीक्षण होना चाहिए और निम्नलिखित रिकार्डों के निरीक्षण द्वारा , जो मुख्य निरीक्षक अथवा बॉयलर निदेशक को वर्तमान समय में लागू सर्टिफिकेट की मान्यता समाप्त होने केकम से कम तीस दिन पहले उपलब्ध करा दिए जाने चाहिएँ, मुख्य निरीक्षक अथवा राज्य बॉयलर निदेशक द्वारा फिटनेस सर्टिफिकेट जारी कर देने चाहिएँ बशर्ते कि वह इस बात के प्रति संतुष्ट है कि बॉयलर को आगे 12 माह तक और काम करने की अनुमति दी जा सकती है । -( क) डेटा एक्वीजीशन सिस्टम ( डी ए एस ) के आउटपुट से सुपरहीटर और रीहीटर तापमान अनियमितताओं के लिए संचालन ऑकड़े । ( ख ) पिछले वर्षों के दौरान हुए शट डाउन का इतिहास उनके कारणों तथा की गई कार्रवाई के साथ ।
( ग ) वर्ष के दौरान बॉयलर दाब हिस्सों पर किए गए किसी भी अविध्वंसक परीक्षण के रिकार्ड ।
( घ ) बॉयलर की जरूरत के अनुसार उसके लिए जल की गुणवत्ता बनाए रखी जाए और गुणवत्ता के आँकड़े ऑनलाइन उपलब्ध कराए जाएं ।
( ड. ) बॉयलर की नली फेल होने के रिकार्ड ( स्थान, मरम्मत की गई/बदली गई नलियों की संख्या)
2. जैसा कि विनियम 390 में व्यवस्था है, चौबीस माह की अवधि समाप्त हो जाने पर मुख्य निरीक्षक अथवा बॉयलर निदेशक द्वारा पूर्ण निरीक्षण किया जाना चाहिए । तथापि, यदि सर्टिफिकेट प्रदान करने की अवधि के समाप्त होने से पहले और सर्टिफिकेट प्रदान करने के छः माह बाद किसी भी समय पंद्रह दिन अथवा उससे अधिक की अवधि के लिए शटडाउन की योजना बनाई गई है, तो ऐसे मामले में मुख्य निरीक्षक अथवा बॉयलर निदेशक को उचित रूप से सूचित किया जाना चाहिए, ताकि उक्त शटडाउन की अवधि के दौरान पूर्ण निरीक्षण की योजना बनाई जा सके । (ख) 50 कि.ग्रा. /सें.मी तक के दबाव पर तथा 20 वर्ष तक की अवधि से काम कर रहे बॉयलर ।
(1 ) बिजली उत्पादन के लिए भाप का सर्जन करने वाले बॉयलरों का जो 50 कि.ग्रा. /सें.मी तक के दबाव पर तथा 20 वर्ष तक की अवधि से काम कर रहे हैं , पूर्ण निरीक्षण और मुख्य निरीक्षक अथवा राज्य बॉयलर निदेशक द्वारा फिटनेस सर्टिफिकेट प्राप्त होने की तारीख से बारह माह की अवधिसमाप्त होने पर कार्य करने वाले दबाव के समतुल्य दबाव पर हायड्रोलिक परीक्षण किया जाना चाहिए और पैराग्राफ क में दिए गए संचालन रिकार्ड से संतुष्ट हो जाने पर, उन्हें आगे बारह माह की अवधि तक और काम करने की अनुमति प्रदान की जानी चाहिए ।
(2 ) चौबीस माह की अवधि समाप्त होने पर मुख्य निरीक्षक अथवा बॉयलर निदेशक द्वारा पूर्ण निरीक्षण किया जाना चाहिए । तथापि, यदि सर्टिफिकेट प्रदान करने की अवधि समाप्त होने के पहले और सर्टिफिकेट प्रदान करने के छः माह बाद किसी भी समय पंद्रह दिन अथवा उससे अधिक की अवधि के लिए शटडाउन की योजना बनाई गई है , तो मुख्य निरीक्षक अथवा बॉयलर निदेशक को इसकी उचित रूप से सूचना दी जानी चाहिए, ताकि उक्त शटडाउन की अवधि के दौरान निरीक्षण की योजना बनाई जा सके ।
(ग) 50 कि.ग्रा. /सें.मी अथवा अधिक के दबाव पर तथा 20 वर्ष से अधिक की अवधि से काम कर रहे बॉयलर :-
( 1 ) बिजली उत्पादन के लिए भाप का सर्जन करने वाले बॉयलरों का, जो 50 कि.ग्रा. /सें.मी अथवा अधिक के दबाव पर तथा 20 वर्ष से अधिक की अवधि से काम कर रहे हैं , पूर्ण निरीक्षण तथा मुख्य निरीक्षक अथवा राज्य बॉयलर निदेशक से फिटनेस सर्टिफिकेट प्राप्त होने की तारीख से बारह माह की अवधि समाप्त होने पर काम करने के दबाव से 1.25 गुना अधिक दबाव पर हायड्रोलिक परीक्षण किया जाना चाहिए तथा पैराग्राफ क में उल्लिखित स्थितियों एवं आवश्यकताओं के प्रति संतुष्ट हो जाने पर, उन्हे आगे बारह माह तक और काम करने की अनुमति दे दी जानी चाहिए । ( 2 ) चौबीस माह की अवधि समाप्त हो जाने पर मुख्य निरीक्षक अथवा बॉयलर निदेशक द्वारा पूर्ण निरीक्षण किया जाना चाहिए । तथापि , यदि सर्टिफिकेट प्रदान करने की अवधि समाप्त होने के पहले तथा सर्टिफिकेट प्रदान करने के छः माह बाद किसी भी समय पंद्रह दिन अथवा उससे अधिक समय के लिए शटडाउन की योजना है , तो इसके विषय में मुख्य निरीक्षक अथवा बॉयलर निदेशक को उचित रूप से सूचित किया जाना चाहिए, ताकि उक्त शटडाउन की अवधि के दौरान निरीक्षण की योजना बनाई जा सके ।
(घ) 50 कि.ग्रा. /सें.मी अथवा अधिक तक के दबाव पर तथा 20 वर्ष से अधिक की अवधि से काम कर रहे बॉयलर :
50 कि.ग्रा./सें.मी² अथवा अधिक तक के दबाव पर तथा 20 वर्ष से अधिक की अवधि से काम कर रहे बॉयलरों का बॉयलर निरीक्षक की संतुष्टिके अनुसार प्रतिवर्ष पूर्ण निरीक्षण जारी रखा जाना चाहिए । "

G.S.R. 423. Whereas certain draft regulations further to amend the Indian Boiler Regulations, 1950 were published, as required by sub - section (1 ) of Section 31 ofthe Indian Boilers Act , 1923 (5 of 1923) , in the Gazette of India, dated the 21st May, 2005 with the notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) ( Central Boilers Board) , number G.S.R. 170 , dated the 16th May, 2005 for inviting objections and suggestions from all the persons likely to be affected thereby before the expiry of the period of forty -five days from the date on which the copies of the said Gazette notification were made available to the public;
Andwhereas the copies of the said Gazette were made available to the public on the 13th June , 2005;
And whereas no objections or suggestions have been received from any person in respect to such drafts within the time period specified in the said draft;
Now, therefore , in exercise of the powers conferred by Section 28 of the Indian Boilers Act , 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely: - 1. ( 1 ) These regulations may be called the IndianBoiler (Fourth Amendment ) Regulations, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Indian Boiler Regulations , 1950, (hereinafter referred to as the principal regulations ) , in regulation 376 , after clause (f) , the following clause shall be inserted , namely:-
"(ff) For boilers working at a pressure 50kg/ cm² or more , and used exclusively for electric power generation , the inspection shall be carried out in accordance with the provisions of Appendix JA. " .

[PART II - SEC . 3 (i ) ] 3 In the principal regulations , for regulation 377, the following regulations shall be substituted, namely: ---
"377. Hydraulic test of boilers for registration.--(a) Every boiler shall be hydraulically tested in the presence of an Inspector.
(b) Boiler working at a pressure 50kg/ cm² or more , and used exclusively for electric power generation need not be hydraulically tested for issue of certificate every year , provided that the inspection of such boiler is carried out as per the provisions of regulation 376. "
4. In the principal regulations , after Form XVIII, the following Form shall be inserted , namely:-

5. In the principal regulations , after Appendix J , the following Appendix shall be inserted , namely: -
"APPENDIX JA

A. Power Utility Boilers working at a pressure 50kg/ cm² or more and up to 20 years of age
(1 ) The boilers working at a pressure 50 kg /cm² or more and up to 20 years of age, generating steam for power generation shallbe inspected as detailed below after the expiry of twelve months form the date of full inspection and certification of fitness shall be issued by the Chief Inspector or Director of Boilers of State , through inspection of the following records which shall be made available to the Chief Inspector or Director of Boilers at least thirty days before the expiry of the operating certificate , provided he is satisfied that the boiler can be allowed to be operated for a further period of twelve months .

(a) Operation data for superheater and reheater temperature excursions from the output of Data Acquisition System (DAS).

(2) Full inspection shall be carried out by the Chief Inspector or Director of Boilers at the expiry of twenty - four months as provided in regulation 390. However, in case shutdown of fifteen days or more is planned any time before expiry ofthe certification period and after six months of the certification, the Chief Inspector or Director of Boilers shall be duly informed so that complete inspection can be scheduled during the said shutdown period .
B. Boiler working at a pressure up to 50kg/ cm² and up to 20 years of age.
(1) The boilers working at a pressure up to 50kg/cm² and up to 20 years of age generating steam for power generation shall be subjected to Hydraulic Test at pressure equivalent to the working pressure at the expiry of twelve months from the date of full inspection and certification offitness by the Chief Inspector or Director of Boilers ofthe State, and having satisfied with the operation records as at paragraph A, shall be allowed for running for another period oftwelve months .
(2) Full inspection shall be carried out by Chief Inspector or Director ofBoilers at the expiry of twenty - four months . However, if shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months of the certification, Chief Inspector or Director of Boilers shall be duly informed so that inspection can be scheduled during the said shut down period.
(C.) Boilers working at a pressure 50 kg/ cm² or more , and more than 20 years of age .
(1) Boiler working at a pressure 50kg/ cm² or more and more than 20 years of age , generating steam for power generation, shall be subjected to Hydraulic test at a pressure 1.25 times the working pressure at the expiry oftwelve months from the date of full inspection and certification of fitness by the Chief Inspector or Director of Boilers of the State, and having satisfied the conditions and requirements as at paragraph A, shall be allowed running for another period of twelve months .
(2) Full inspection shall be carried outby Chief Inspector or Director of Boilers at the expiry of twenty - four months. However, if shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months of the certification. Chief Inspector or Director of Boilers shall be duly informed so that inspection can be scheduled during the said shut down period.
D.Bojler working at a pressure up to 50kg/cm² and more than 20 years of age:
Boiler working at a pressure up to 50kg / cm² and more than 20 years of age shall continue to be subjected to full inspection every year to the satisfaction of Boiler Inspector . " .

सा. का. नि. 424.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और साधारण केन्द्रीय सेवाएं वर्ग 3 और वर्ग 4 ( अतिरिक्त ) पद (दिल्ली दुग्ध योजना, नई दिल्ली ) भर्ती नियम , 1964 को जहां तक इनका संबंध विश्लेषक पद से है, उन बातों के सिवाय अधिक्रमण करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, कृषि मंत्रालय में पशुपालन , डेयरी और मत्स्यपालन विभाग के अधीन दिल्ली दुग्ध योजना में विश्लेषक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम दिल्ली दुग्ध योजना , ( विश्लेषक ) भर्ती नियम, 2005 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान:- उक्त पद की संख्या , उनका वर्गीकरण और उनका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु- सीमा , और अन्य अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अहर्ताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता:- वह व्यक्ति, -
( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या
( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्तिका पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृति:- इन नियमों की कोई बात , ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्यविशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पणी: 3. आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ( न कि वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड, त्रिपुरा, सिक्किम , जम्मूएवं कश्मीर राज्य का लद्दाख खंड, हिमाचल प्रदेश के लाहौल तथा स्पीती जिले और चम्बा जिले के पांगी उप खंड, अंडमान एवं निकोबार द्वीप अथवा लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ) ।

G.S.R. 424. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the General Central Services Class III and Class IV(Additional ) posts (Delhi Milk Scheme , New Delhi ) Recruitment Rules, 1964, in so far as they relate to the post of Analyst, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post ofAnalyst in the Delhi Milk Scheme under the Department of Animal Husbandry, Dairying and Fisheries in the Ministry of Agriculture, namely:-
1. Short title and commencement . - ( 1 ) These rules may be called the Delhi Milk Scheme (Analyst ) Recruitment Rules, 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number ofposts , classification and scale of a pay. The number of the said post , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit and other qualifications , etc.-The method of recruitment to the said post , age limit , qualifications and other matters relating thereto shall be as a specified in columns (5 ) to ( 14) of the said Schedule.
4. Disqualification.- No person,---
(a) who has entered into or eontracted a marriage with a person having a spouse living ; or
(b) who, having a spouse living , has entered into or contracted as marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .
6. Power to relax.-Where the Central Government is ofthe opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any ofthe provisions of these rules with respect to any class or category of persons .
7. Saving:-Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and otherspecial categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 425. राष्ट्रपति संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और साधारण केन्द्रीय सेवाएं वर्ग 3 और वर्ग 4 ( अतिरक्ति ) पद ( दिल्ली दुग्ध योजना, नई दिल्ली ) भर्ती नियम, 1964 को जहां तक इनका संबंध बैक्टेरिआलोजिकल सहायक पद सेहै, उन बातों के सिवाय अधिक्रमण करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , कृषि मंत्रालय में पशुपालन, डेयरी और मत्स्यपालन विभाग के अधीन दिल्ली दुग्ध योजना में बैक्टेरिआलोजिकल सहायक के पद पर भर्ती की पद्धती का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्ः-
है। 1. संक्षिप्तनाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम दिल्ली दुग्ध योजना, बैक्टेरिआलोजिकल सहायक भर्ती नियम , 2005 (2) से राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. पद संख्या , वर्गीकरण और वेतनमान:-उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता:-वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है। और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । [ भाग II- खण्ड 3 (i) ]

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृतिः-इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

लागूनहींहोता केन्द्रीय सरकार द्वारा समय पर जारी किए गए अनुदेशों अथवा आदेशों के अनुसार सरकारी कर्मचारियों के लिए शिथिल करके 40 वर्ष तक ( अनुसूचित जातियों/अनुसूचित जनजातियों के मामले में शिथिल करके 45 वर्ष तक) की जा सकती है । टिप्पणी 1:-अनुसूचित जाति/अनुसूचित जनजाति/अन्य पिछड़ी जातियों तथा अन्य कतिपय वर्गों के लिए शिथिलनीय जैसा कि केन्द्रीय सरकार द्वारा समय- समय पर
अधिसूचित किया गया है ।
टिप्पणी 2:- अनुसूचित जाति/अनुसूचित जनताति/अन्य पिछड़े वर्गों के लिए उम्र में कोई अन्य छूट के साथ संचयी रूप से शिथिलनीय।
टिप्पणी 3:-आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ( न कि वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू एवं कश्मीर राज्य का लद्दाख खंड,
सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Bacteriological Assistant in the Delhi Milk Scheme under the Department of Animal Husbandry, Dairying andFisheries in the Ministry of Agriculture , namely:-
1. Short title and commencement .---( 1 ) These rules may be called the Delhi Milk Scheme Bacteriological AssistantRecruitment Rules, 2005.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts , classification and scale of pay. The number of the said post , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit and other qualifications , etc. The method of recruitment to the saidpost, age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 14) ofthe said Schedule.
4.Disqualification. No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
6. Power to relax.-- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving:- Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.
