(iii) उक्त अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड (घ) के अधीन भारत में आदेशिका की तामील स्वीकार करने के लिए प्राधिकृत किसी व्यक्ति द्वारा सम्यक् रूप से हस्ताक्षरित प्रमाणपत्र यह प्रमाणित करते हुए कि कंपनी ने 1 जनवरी, 2004 से आरंभ होने वाली और 31 दिसंबर, 2004 को समाप्त होने वाली और 1 जनवरी, 2005 से आरंभ होने वाली और 31 दिसंबर, 2005 को समाप्त होने वाली अवधि के दौरान भारत में कोई व्यापार या विनिर्माण, वाणिज्यिक या औद्योगिक क्रियाकलाप नहींकिया है ।

MINISTRY OF COMPANY AFFAIRS सा. का. नि. 428.-केन्द्रीय सरकार, कंपनी अधिनियम, 1956 ( 1956 का 1 ) की धारा 594 की उप- धारा ( 1 ) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के तत्कालीन वित्त मंत्रालय ( कंपनी विधि प्रशासन अनुभाग ) की अधिसूचना सं. का.नि.आ. 3216 तारीख 4-10-1957 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है ) का आंशिक रूप से उपांतरण करते हुए, यह निदेश देती है कि मैसर्स आगा खां फाउंडेशन , सरोजनी हाऊस, दूसरा तल, 6 भगवान दास रोड, नई दिल्ली ( जिसे इसमें इसके पश्चात् कंपनी कहा गया है ) के मामले में, जो एक विदेशी कंपनी है , उक्त अधिसचूना द्वारा किसी विदेशी कंपनी को उनके आवेदनों में यथाउपांतरित उक्त धारा 594 की उपधारा ( 1 ) के खंड ( क ) की अपेक्षाएं निम्नलिखित और अपवादों और उपांतरणों के अधीन रहते हुए, लागू होंगी, अर्थात्:-

(i ) निम्नलिखित द्वारा ऐसी कंपनी की भारतीय शाखा द्वारा उसके साथ प्राप्तियों और संदायों का एक विवरण ,-

(क) उक्त अधिनियम की धारा 592 की उपधारा ( 1 ) के खंड ( घ ) के अधीन भारत में आदेशिका की तामील को स्वीकार करने के लिए प्राधिकृत कोई व्यक्ति;

(ख) भारत में व्यवसायरत कोई चार्टर्ड एकांउन्टेंट;

In exercise of the powers conferredby the proviso to sub- section ( 1 ) of Section 594 of the companies Act, 1956 ( 1 of 1956) and in partial modification ofthe notification of the Government of India, erstwhile Ministry of Finance (Department of Company Law Administration) Number S.R.O. 3216 dated the 4th October, 1957 (hereinafter referred to as the said notification) , the Central Government hereby directs that in the case ofM/s . Aga Khan Foundation , Sarojini House , 2nd floor, 6BhagawanDas Road , New Delhi (hereinafter referredto as the company) being a foreign company, the requirements ofclause (a) of sub -section ( 1) of the said Section 594 as modified in their application to a foreign company by the said notification shall apply subject to the following further exceptions and modifications , namely:-

Itshall be deemed to be sufficient compliance with theprovisions ofclause (a) of sub-section ( 1 ) of the Section 594, if, in respect of the period commencing from the Ist day of January, 2004 and ending on the 31st day of December, 2004 and from the 1st day of January, 2005 and ending on the 31st day of December 2005 , the company in respect of its Indian Business Accounts submits to the appropriate Registrar of Companies in India , in triplicate:-

(i )a statement of receipts and payments made by the Indian branches of such company certified by- (a) aperson authorised to accept service of- process in India under clause (d) of sub - section ( 1 ) of section 592 of the said Act; and

(b)a Chartered Accountant practising in India, certifying that the said statement gives a true and fair view of the receipts and payments of the company in India for the period commencing form the 1st day of January, 2004 and ending on the 3 Ist day of December, 2004 and from the Ist day of January, 2005 and ending on the 31st day ofDecember, 2005;

(ii) a statement ofthe company's assets and liabilities inIndia certifiedby-

[PART II-SEC. 3 ( i) ] (a) a person authorised to accept service of process in India under clause (d) of sub - section ( 1 ) of Section 592 ofthe said Act ; and

(b) a Chartered Accountant practising in India, certifying that the said statement gives a true and fair view of the state of affairs ofthe company in India as at the end of the period commencing from the Ist day of January, 2004 and ending on the 31st day of December , 2004 and from the 1st day of January, 2005 and ending on the 31st day ofDecember, 2005;

(iii) a certificate duly signed by a person authorised to accept service of process in India under clause ( d) of sub - section ( 1 ) of Section 592 of the Act certifying that the company did not carry out any trading or manufacturing , commercial or industrial activity in India during the period commencing from the 1st day of Jaunary 2004 and ending on the 31st day of December , 2004 and from the Ist day of January, 2005 and ending on the 31st day of December , 2005.

सा.का.नि. 429.- राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सूचना और प्रसारण मंत्रालय के फिल्म प्रभाग में ड्राईवर ( विशेष श्रेणी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ-( 1 ) इन नियमों का संक्षिप्त नाम फिल्म प्रभाग , ड्राईवर ( विशेष श्रेणी ) भर्ती नियम , 2005 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे । 2. पद-संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो उक्त अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा और अर्हतांए और उनसे संबंधित अन्य बातें वे होंगी जी उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं । 4. निरर्हता: वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेन है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय हैं कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डोलगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 1875 भारत का राजपत्र : दिसम्बर 31 , 2005/ पौष 10, 1927

1. Short title and commencement.-( 1 ) These rules may be called the Films Division, Driver (Special Grade) Recruitment Rules , 2005.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts, classification and scale of pay. The number of said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of Recruitment , age limit , qualification etc. The method of recruitment to the said post, age limit , qualification and other matter connected therewith shall be as specified in the columns ( 5) to ( 14) of the schedule aforesaid.

4. Disqualification. No person,-

(a) Who has entered into or contracted a marriage with a person having a spouse living; or (b) Who , having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from operation of this rule .

6. Saving-Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex-Servicemen , and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard .

II. 4000-6000 रुपए के वेतनमान में ऐसे विभागीय ज्येष्ठ प्रशीतन मैकेनिक जिसने उस श्रेणी में पांच वर्ष नियमित सेवा की हो, के संबंध में भी बाह्य व्यक्तियों के साथ विचार किया जाएगा । यदि पद पर नियुक्तिके लिए उसका चयन हो जाता हैं तो वह प्रोन्नति द्वारा भरा गया समझा जाएगा।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Jawaharlal Institute of Post- Graduate Medical Education, Pondicherry, (Group ' C' Posts ) Recruitment Rules , 1981 , in so far as it relates to the post of Foreman, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post ofForeman in the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry, namely:-

1. Short title and Commencement .-( i ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Education and Research , Pondicherry, Foreman ( Group ' C ' post) , Recruitment Rules , 2005 .

(ii ) They shall come into force on the date of their publication in the Official Gazette .

2. Number of Post , Classification and Scale of Pay. The number of said post , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

II . The Departmental Senior RefreigerationMechanic in the Pay scale of Rs . 4000-6000 with five years' regular service in the grade shall also be considered along with outsiders. In case he or she is selected for appointment tothe post, the same shall be deemed to have been filled bypromotion.

TheDeprtmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly deputationist shall not be eligible for condiseration for appointment by promotion.

(The period ofdeputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other Organization/ Department of the Central Government shall ordinarily not exceed three years . टिप्पण: अनुभव संबंधी अर्हताएं केन्द्रीय सरकार के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने कीसंभवना नहींहै ।

प्रतिनियुक्ति/आमेलन किया जाएगा

भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारियों में से प्रतिनियुक्ति या आमेलन:

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं; या

प्रतिनियुक्तिया आमेलन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा ।

(ii ) जिन्होंने 3200-4900 रुपए के वेतनमान वाले पदों पर पांच वर्ष नियमित सेवा की है; ( iii ) जिन्होंने 3050-4590 रुपए के वेतनमान वाले पदों पर आठ वर्ष नियमित सेवा की

है;और

(ख) जिनके पास स्तंभ 8 में सीधे भर्ती किए जाने वाले व्यक्तियों के लिए शैक्षणिक अर्हताएं और अनुभवहैं।

G.S.R. 431. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Medical College , Pondicherry (Class III and IV posts) Recruitment Rules , 1959 in so far as it relates to the post of Photographer and the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry (Class III posts ) Recruitment Rules, 1975 in so far as it relates to the post of Junior Photographer, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Photographer in the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry, namely:-

1. Short title and Commencement.-( i ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry, Photographer (Group ' C ' post) , Recruitment Rules,2005.

(ii ) They shall come into force on the date of their publication in the Official Gazette.

2. Number of Post , Classification and Scale of Pay. The number of said post , its classification and the scale pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of Recruitment, Age limit, Qualificationsetc. The method of recruitment, age limit , qualification (s ) and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule . of

4. Disqualification .--No person,-

(a) Who has entered into or contracted a marriage with a person having a spouse living ; or (b) Who, having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts .

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving-Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note.1 : The crucial date for determining the age- limit shall be the closing date for receipt ofapplications from candidates in India (and not the closing date prescribed for those in Assam , Mizoram,Manipur, Nagaland, Meghalaya, Arunachal Pradesh , Tripura, Sikkim, Ladakh Division ofJammu and Kashmir State, Lahaul and Spiti District and Pangi Sub -Division of Chamba District ofHimachal Pradesh , Andaman and Nicobar Islands orLakshadweep) .

Note 2 : Qualification(s ) regarding experience is relaxable at the discretion of Competent Authority in case of candidates belonging to the Scheduled Casts/ Scheduled Tribes if, at any stage of selection the Competent Authority is of the opinion that sufficient number of candidates belonging to these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

Note.2: The crucial date for determining the age limit in the caseofcandidates from Employ- ment Exchange shall be the last dateupto which the Employment Exchange is asked to submit the names .

Incase of recruitment by promotion/ deputation/absorption grade from which promotion/deputation/ absorption to be made.

Method of recruitment whether by direct recruitment or by promotion or by deputation/ absorption and percentage of the posts to be filled by various methods .

(iii) with eight years regular service in posts in the pay scale of Rs. 3050-4590; and

(b) Possessing the educational qualifications and experience prescribed for direct recruits under column 8.
