Section 21 of the General Clauses Act, 1897 ( 10 of 1897) , the President hereby rescinds the recruitment rules regulating the method of appointment to the above post as published in the Gazette of India dated 24-30 August, 2003 , Part - II Section 3 , Sub- section ( i) , vide G. S. R. No. 301 , dated the 12th August, 2003 (pages 1903 to 1908) with immediate effect ; such rescission shall not effect any thing done or omitted to be done under the said rules before said notification .

R. 27 .--Whereas the draft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by Sub- section ( 1 ) of Section 31 of the IndianBoilers Act, 1923 (5 of 1923) , in the Garzette of India, dated the 29th October, 2005 , vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) (Central Boilers Board) , Number G. S. R. 382 , dated the 24th October , 2005 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry ofthe period of forty - five days from the date on which the copies of the said Gazette notification were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 18th November , 2005;

And whereas no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

Now, therefore, in exercise of the powers conferred by section 28 of the Indian Boilers Act, 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely:-

1. ( 1 ) These regulations may be called the Indian Boiler(Amendment) Regulations , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Indian Boiler Regulations , 1950 , in regulation 4A, in sub - regulation(4) , the following shall be added at the end, namely :--

"The certificate of recognition shall be from the date ofthe visit of the plant by the Evaluation Committee and shall be for a period of five years . In the case of renewal of the recognition, if the application is received for renewal alongwith the required fee as per the regulations , the firm may be recognised after following the procedure laid done in the regulations and the certificate shall be issued for a further period of five years . "

सा. का. नि. 28.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए स्वास्थ्य और परिवार कल्याण मंत्रालय , क्षेत्रीय कुष्ठ प्रशिक्षण और अनुसंधान संस्थान, रायपुर में प्रयोगशाला परिचर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्रालय, क्षेत्रीय कुष्ठ प्रशिक्षण और अनुसंधान संस्थान, रायपुर ( प्रयोगशाला परिचर ) भर्ती नियम, 2006 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. आरंभिक गठन: - अनुसूची में दर्शित पदधारी को, जो इन नियमों के प्रारंभ की तारीख से पूर्व पद पर नियुक्त किया गया था, इन नियमों के अधीन नियमित आधार पर नियुक्त किया गया समझा जाएगा और उक्त प्रारंभ से पूर्व उसके द्वारा उस पद पर की गई सेवाएं, परिवीक्षा, पुष्टि, आदिके लिए परिवीक्षा अवधि अर्हक सेवा के प्रयोजनों के लिए गणना में ली जाएंगी ।

3. पद-संख्या, वर्गीकरण और वेतनमान:- उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

' 4. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता :-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति:-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति: -इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 28. In exercise of the powers conferredby the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Laboratory Attendant in the Ministry ofHealth and Family Welfare , Regional Leprosy Training and Research Institute , Raipur, namely :----

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Health and Family Welfare, Regional Leprosy Training and Research Institute , Raipur (Laboratory Attendant) Recruitment Rules , 2006.

(2) They shall come into force on the date oftheir publication in the Official Gazette .

2. Initial Constitution. The incumbent of the post shown in the schedule who was appointed to the post before the date of commencement of these rules shall be deemed to have been appointed under these rules on regular basis and the services rendered by him in the post before the said commencement shall be taken into account for the purposes of probation period , qualifying service for probation , confirmation etc.

3. Number of post , classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed thereto .

4. Method of recruitment, age limit, qualifications etc. The method ofrecruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

5. Disqualification . No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Caste, the Scheduled Tribes , Ex - Servicemen , the Backward classes and other special categories of persons in accordance with the order issued by the Central Government from time to time in this regard .

परन्तु यदिकेन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. प्रारम्भिक गठन:- क्षेत्रीय कुष्ठ प्रशिक्षण और अनुसंधान संस्थान, रायपुर में इन नियमों के प्रारम्भ की तारीख को नियमित आधार पर चौकीदार का पद धारण करने वाले व्यक्ति इन नियमों के उपबन्धों के अनुसार उस पद पर नियुक्त किए गए समझे जाएंगे और ऐसे प्रारम्भ से पूर्व उनके द्वारा की गई नियमित सेवा को परिवीक्षा अवधि, प्रोन्नति, पुष्टि और पेंशन के लिए अर्हक सेवा के प्रयोजन के लिए गणना में लिया जाएगा । 6. शिथिल करने की शक्ति: जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृति: - इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concession required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - serviceman , other special categories of persons in accordance with the order issued by the Central Government from time to time in this regard .
