का.नि.आ. 41.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रक्षा उत्पादन और आपूर्ति विभाग , क्वालिटी आश्वासन महानिदेशक समूह ' ग ' और समूह ' घ ' अराजपत्रित अननुसचिवीय ( अग्नि शमन कर्मचारिवृंद ) भर्ती नियम , 2000 का संशोधन करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभः-( 1 ) इन नियमों का संक्षिप्त नाम रक्षा उत्पादन विभाग , क्वालिटी आश्वासन महानिदेशक समूह ' ग ' और समूह ' घ ' अराजपत्रित , अननुसचिवीय ( अग्निशमन कर्मचारिवृंद ) भर्ती ( संशोधन ) नियम, 2006 है । (2) ये प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. रक्षा उत्पादन विभाग , क्वालिटी आश्वासन महानिदेशक समूह ' ग ' और समूह ' घ ' अराजपत्रित , अननुसचिवीय ( अग्निशमन कर्मचारिवृंद ) भर्ती नियम , 2000 की अनुसूची में , -

(क) अग्नि पर्यवेक्षक के पद से संबंधित क्रम सं. 1 के सामने , स्तंभ ( 12 ) के अधीन विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: -

"प्रोन्नति:

ऐसे लीडिंग हैंड फायर जिन्होंने किसी नियमित अग्निशमन सेवा में कम से कम छह वर्ष सेवा की है जिसमें से तीन वर्ष नियमित सेवा लीडिंग हैंड फायर की श्रेणी में की हो । "

(ख ) दमकल चालक के पद से संबंधित क्रम सं. 3 का लोप किया जायेगा ।

S.R.O. 41. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Department of Defence Production and Supplies, Director General ofQuality Assurance, Group ' C ' and D ' Non- Gazetted , Non -Ministerial ( Fire Fighting Staff) Recruitment Rules , 2000, namely :---

1. Short title and commencement. ( 1 ) These rules may be called the Department of Defence Production , Director General of Quality Assurance Group ' C ' and ' D ' Non - Gazetted, Non - Ministerial (Fire Fighting Staff) Recruitment (Amendment ) Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Schedule to the Department of Defence Production . Director General of Quality Assurance ,Group ' C' and ' D ' Non - Gazetted, Non- Ministerial (Fire Fighting Staff) Recruitment Rules, 2000 ,-

(a) against serial No. 1 relating to the post of Supervisor Fire under column ( 12 ) , for the existing entries , the following entries shall be substituted, namely:-

"Promotion:

Leading Hand Fire with at least six years service in a regular Fire Brigade out of which three years service in the grade ofLeading Hand Fire ."

(b) Serial number 3 relating to the post of Fire Engine Driver shall be omitted.

का.नि.आ. 42. राष्ट्रीय कैडेट कोर अधिनियम , 1948 ( 1948 का 31 ) की धारा 12 की उप - धारा ( 1 ) और ( 1 ए ) द्वारा प्रदत्त शक्तियों काप्रयोग करते हुए केन्द्रीय सरकार एतद्वारा डॉ. ( कर्नल ) धनी राम शान्डिल तथा विजेयन्द्र पाल सिंह, लोक सभा के सांसद की नियुक्ति राष्ट्रीय कैडेट कोर की केन्द्रीय सलाहकार समिति के सदस्यों के रूप में अधिसूचित करती है तथा इसके लिए भारत सरकार , रक्षा मंत्रालय की समय- समय पर यथा संशोधित अधिसूचना सं. का.नि.आ. 76- ई, दिनांक 10-10-1983 में निम्नलिखित संशोधन करती है, अर्थात्: -

उपर्युक्त अधिसूचना में " धारा 12 की उप- धारा ( 1 ) के खण्ड ( 1 ) के तहत " शीर्षक के अधीन ( 14 ) तथा ( 15 ) प्रविष्टियों के लिए. निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी; नामतः :--

In exercise of the powers conferred by sub -section ( 1 ) and ( 1A) of Section 12 ofthe National Cadet Corps Act. 1948 (31 of 1948) , the Central Government hereby notifies the appointment of Dr. (Col. ) Dhani Ram Shandil and Shri Vijayendra Pal Singh, Members of the Lok Sabha as Members of the Central Advisory Committee for the National Cadet Corps and for that purpose amends the notification of the Government of India in the Ministry of Defence No. S.R.O. 76 (E) dated the 10th October, 1983 , as amended from time to time, as follows , namely:---

का.नि.आ. 43.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा मंत्रालय , परिवार कल्याण संगठन , महिला चिकित्सा अधिकारी ( परिवार कल्याण ) भर्ती नियम , 1983 , सशस्त्र बल आयुर्विज्ञान महाविद्यालय, पुणे ( चिकित्सा अधिकारी ) , भर्ती नियम, 1985 और रक्षा मंत्रालय , परिवार कल्याण संगठन चिकित्सा अधिकारी ( परिवार कल्याण ) भर्ती नियम, 1988 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है रक्षा मंत्रालय के अधीन महिला चिकित्सा अधिकारी ( परिवार कल्याण ) , चिकित्सा अधिकारी , ज्येष्ठ चिकित्सा अधिकारी , मुख्य चिकित्सा अधिकारी और मुख्य चिकित्सा अधिकारी ( क्षेत्रीय परिवार कल्याण चिकित्सा अधिकारी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: - 1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय , परिवार कल्याण कार्यक्रम, समूह ' क ' पद, भर्ती नियम, 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.- ये नियम इन नियमों से उपाबद्ध अनुसूची ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो उक्त अनुसूची केस्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट है ।

4. भर्ती की पद्धति, आयु सीमा और अन्य अर्हताएं, आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय. है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 184

[PART II- SEC . 4] 7. व्यावृति.- इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेप प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( ii ) ऐसा मुख्य चिकित्सा अधिकारी समूह ' क ' जिसने चौदह वर्ष सेवा के साथ 12000-375-16500 रुपए के वेतनमान में कम से कम दो वर्ष नियमित सेवा की हो ।

टिप्पण :-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अहंक सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियोंके संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक सेवा , अपेक्षित अर्हक सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधिसफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक सेवा पहले ही पूरी करली है । [ भाग II- खण्ड 4 ]

समूह 'क' विभागीय प्रोन्नति समिति ( प्रोन्नति पर विचार करनेके लिए ) निम्नलिखित में मिलकर बनेगी:

इन भर्ती नियमों के किसी उपबंध को संशोधन करने या उसे शिथिल करने के लिए संघ लोक सेवा आयोग से परामर्श करना आवश्यक है ।

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Defence , Family Welfare Programme. Group ' A' Posts , Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette.

5. Disqualification.-No person,-

(a) who has entered into or contracted a marriage , with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so , exempt any. person from the operation of this rule .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order . for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other Special categories of persons , in accordance with the orders issued by the Central Government from time to time in this regard.

[PART II- SEC . 4 ] 2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, and in supersession of the Army Medical Corps Civilian (Group ' C ' Para- Medical ) posts Recruitment Rules, 1983 in so far as they relate to the post of Accountant, Cinema Operator Gde - I , Radio Mechanic, Watch Repairer and Electrical Wireman except as respects things done or omitted to be done , the President hereby makes the following rules regulating the method of recruitment to certain Group ' C ' posts in the Army Medical Corps , namely:--

1. Short title and commencement.-( 1 ) These rules may be called the Army Medical Corps ( Civilian Group ' C' Accountant, Cinema Operator Gde - 1 , Radio Mechanic , Watch Repairer , and Electrical Wireman) Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay.--The number of post , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule aforesaid.

3. Method of recruitment , age limit and other qualifications ,etc. The method of recruitment , age limit, qualifications, and other matters relating to the said posts shall be as specified in colunins 5 to 14 of the Schedule aforesaid.

4. Disqualification . No person,-

( a) who has entered into or contracted a marriage with a person having a spouse living ; or

shall be eligible for appointment to the said posts:

Provided that the Central Government , may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex -Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
