सं. डीएनबीएस -186 /सीजीएम( पीके ) -2006-- भारतीय रिज़र्व बैंक जनहित में इसे आवश्यक मान कर और इस बात से संतुष्ट होकर कि अवशिष्ट गैर बैंकिंग कंपनी ( रिज़र्व बैंक ) निदेश , 1987 में संशोधन करना आवश्यक है, भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 1934 का 2 ) की धारा 45ञ, 45ञक , 45ट और 45 ठ द्वारा प्रदत्त अधिकारों का तथा इस संबंध में सभी समर्थकारी अधिकारों का प्रयोग करते हुए एतद्वारा यह निदेश देता है कि दिनांक 15 मई 1987 की अधिसूचना सं. डीएफसी. 55/डीजी ( ओ ) -87 में अंतर्विष्ट उक्त निदेश तत्काल प्रभाव से निम्नलिखित रूप में संशोधित हो जाएंगे , अर्थात्:--

1. पैराग्राफ ८ का उप पैराग्राफ ( 1 ) निम्नलिखित उप पैराग्राफ से प्रतिस्थापित होगा , अर्थात्--

" 6. 1 अप्रैल 2006 को और तद दिनांक से,

( 1 ) प्रत्येक अवशिष्ट गैर बैंकिंग कंपनी , भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 1934 का 2 ) की धारा 45 झ ख के अंतर्गत आस्तियों मैं निवेश की गई राशि सहित , उन प्रतिभूतियों में या अन्य प्रकार के लिखतों में , जो भार रहित हों और जिनका मूल्यांकन चालू बाजार मूल्य से अधिक न किया जाए, एक धनराशि, जो 31 दिसंबर 2005 को समाप्त तिमाही के किसी दिन और उसके बाद प्रत्येक तिमाही के किसी दिन, दूसरी पूर्वगामी तिमाही के अंतिम कार्य दिवस को कारोबार की समाप्ति पर जमाकर्ताओं के प्रति बकाया देयताओं की कुल राशि (चाहे ऐसी राशियां देय हो गई हों अथवा नहीं ) से कम नहीं होगी , निम्न प्रकार से निवेश करेगी और करना जारी रखेगी , अर्थात्,-- (क ) जमाकर्ताओं के प्रति देयताओं की कुल राशि का न्यूनतम 10 प्रतिशत अनुसूचित वाणिज्य बैंकों की मियादी जमाराशियों/जमा प्रमाणपत्रों में ; अथवा विनिर्दिष्ट वित्तीय संस्थाओं के जमा प्रमाणपत्रों में बशर्ते उक्त जमा प्रमाणपत्रों का किसी अनुमोदित साख निर्धारण एजेंसी द्वारा ए ए रूप में या उसके समकक्ष साख निर्धारण किया गया हो या आंशिक रूप से इन मियादी जमाराशियों/इस प्रकार साख निर्धारित जमा प्रमाण पत्रों में से किसी में ;

(ख ) जमाकर्ताओं के प्रति देयताओं की कुल राशि का न्यूनतम 75 प्रतिशत अपने बाजार उधारी कार्यक्रम के दौरान किसी राज्य सरकार या केंद्र सरकार द्वारा जारी की गई प्रतिभूतियों में ; या कंपनी अधिनियम, 1956 ( 1956 का 1 ) के अंतर्गत निगमित किसी अन्य कंपनी के बांडों या डिबेंचरों ( किसी अनुमोदित साख निर्धारण एजेंसी द्वारा न्यूनतम ए ए + रूप में या उसके समकक्ष साख निर्धारित और किसी मान्यता प्राप्त स्टॉक एक्सचेंज में सूचीबध्द ) में या खंड ( क ) में उल्लिखित रूप में या म्युचुअल फंडों की ऋण उन्मुख योजनाओं में ; परंतु यह निवेश इन शर्तों के अंतर्मत किया जाएगा कि -

(i) जमाकर्ताओं के प्रति देयताओं की कुल राशि का न्यूनतम 15 प्रतिशत बाजार उधारी कार्यक्रम के दौरान जारी की गई किसी राज्य सरकार या केंद्र सरकार की प्रतिभूतियों में निवेश किया जाएगा ;

(ii) जमाकर्ताओं के प्रति देयताओं की कुल राशि के 2 प्रतिशत से अनधिक किसी एक ऋण उन्मुख म्युचुअल फंड में निवेश किया जाएगा, जो भारतीय प्रतिभूति और एक्सचेंज बोर्ड ( म्युचुअल फंड ) नियमावली , 1996 द्वारा नियंत्रित हो तथा ऐसा कुल निवेश जमाकर्ताओं के प्रति देयताओं की कुल राशि के 10 प्रतिशत से अधिक नहीं होगा:

बशर्ते कि कोई अवशिष्ट गैर बैंकिंग कंपनी जो 1 अप्रैल 2006 को और से उपर्युक्त अपेक्षा को पूरा नहीं करती हो, वह जब तक इस श्रेणी के निवेशों में कमी को पूरा न कर ले तब तक अन्य प्रतिभूतियों में निवेश नहीं करेगी :

बशर्तें कि किसी बांड या डिबेंचर का साख निर्धारण निर्धारित से निम्न श्रेणी में आ जाने की स्थिति में उक्त बांड या डिबेंचर उपर्युक्त अपेक्षा का अनुपालन करने के लिए अपात्र हो जाएगा और साख के इस प्रकार निम्न श्रेणी में आ जा जाने के कारण उपर्युक्त पैराग्राफ के अनुपालन में यदि कोई कमी हो तो खंड (ग ) या ( घ ) में उपबंधित प्रतिभूतियों में आगे कोई निवेश करने से पूर्व उसे पूरा किया जाएगा । ":

परंतु शर्त यह है कि नियंत्रक कंपनी / सहायक कंपनी / एक ही समूह की कंपनी द्वारा जारी किए गए डिबेंचर / बांड ऐसे निवेश के लिए अर्ह नहीं होंगे ।

(ग ) 1 अप्रैल 2006 को और से जमाकर्ताओं के प्रति देयताओं की कुल राशि का अधिकतम 5 प्रतिशत या उक्त कंपनी की निवल स्वाधिकृत निधि का एक गुना, जो भी कम हो, उस प्रकार से निवेश किया जा सकता है, जो कंपनी के निदेशक मंडल के अनुमोदन के अनुसार कंपनी की राय में सुरक्षित हो;

( घ ) 31 दिसंबर 2005 को जमाकर्ताओं के प्रति देयताओं की कुल राशि के अधिकतम स्तर से जमाकर्ताओं के प्रति वृद्धिशील देयताओं को 1 जुलाई 2006 को और उस दिनांक से उपरिलिखित उप पैराग्राफ ( क ) या उप पैराग्रफ ( ख ) के अनुसार ही निवेश किया जाएगा ;

(ङ ) 1 अप्रैल 2007 को और उस दिनांक से जमाकर्ताओं के प्रति गत दूसरी तिमाही के अंतिम कार्यदिवस को देयताओं की कुल राशि केवल उप पैराग्राफ ( क ) या उप पैर। ग्राफ ( ख ) के अनुसार निवेश की जाएगी । "

स्पष्टीकरण

खण्ड ' घ ' के प्रयोजनार्थ " जमाकर्ताओं के प्रति वृद्धिशील देयताओं " का तात्पर्य है 31 दिसंबर 2005 को जमाकर्ताओं के प्रति देयताओं की कुल राशि से जमाकर्ताओं के प्रति बेशी देयताएं ।

कर्मचारी राज्य बीमा ( सामान्य) विनियम , 1950 के विनियम 95 - क के साथ पठित कर्मचारी राज्य बीमा अधिनियम 1948 ( 1948 का 34 ) की धारा-46 (2 ) द्वारा प्रदत्त शक्तियों के अनुसरण में महानिदेशक ने 01 फरवरी , 2006 ऐसी तारीख के रूप में निश्चित की है जिससे उक्त विनियम 95- क तथा आन्ध्र प्रदेश कर्मचारी राज्य बीमा नियम-1955 में निर्दिष्ट चिकित्सा हितलाभ आन्ध्रा प्रदेश राज्य में निम्नलिखित क्षेत्रों में बीमांकित व्यक्तियों के परिवारों पर लागू किए जाऐंगे , अर्थात: -

"जिला तथा तालुक पलक्कड़ के राजस्व ग्राम मनकरां के अधीन आने वाले क्षेत्र । "

" आन्ध्र प्रदेश - पश्चिम गोदावरी जिले के अन्तर्गत पालकोल्लू नगरपालिका एवं राजस्व ग्राम की सीमा में आने वाले सभी क्षेत्रः लंकला , कोडेरू , भग्गेश्वरम, पूलालपल्ली, उल्लमंपर्क, चिंतपर्क दिगमर्रु , चिट्टवरम , पेदमामिडिपल्ली , वरिधानम , चंदपर्छ, गोरिंटयड़ा दग्गुलूरू , बल्लिपाडु, कापवरम , पालकोल्लु मण्डल/ ग्राम पंचायत के एस. चिक्काला तथा पोडुरू मंडल के राजस्व गाँव- मट्टपर्रु जिन्नेरू , वेदंगी और पेनुमादम तथा यलमंचिली मंडल के अडविपालेम और मेड़पाडु राजस्व ग्राम ।"

संख्याः रासविनिः 1-1 /88- प्रशा० निगम के प्रबंध मंडल ने दिनांक 07.03.2006 को आयोजित अपनी बैठक में राष्ट्रीय सहकारी विकास निगम सेवा विनियमावली , 1967 के नियम संख्या: 7-क के तहत प्राप्त शक्तियों का प्रयोग करते हुए भर्ती नियमों में निम्न प्रकार संशोधन का अनुमोदन किया है: -

(i) कि सहायक निदेशक के पद हेतु भर्ती नियमों के लिये कालम 5 और 6 में क्रमशः 'आयु सीमा' और ' शैक्षिक तथा अन्य योग्यताओं' के संबंध में सीधी भर्ती हेतु मौजूदा प्रावधानों की जगह निम्न प्रकार प्रतिस्थापन किया जायेः-

योग्यता उपरांत विंडोज एन०टी०, यूनिक्स, जावा, आर०डी०बी०एम०एस०, जी० यू०आई० जैसे प्रचालन सिस्टमों में या यथाउल्लिखित अन्य ऑपरेटिंग सिस्टमों में सिस्टम विश्लेषण/डाटा प्रबंधन/ आवश्यकता आधारित सॉफ्टवेयर के विकास के क्षेत्र में 2 वर्ष का अनुभव । किसी बैंक /वित्तीय संस्थान में उल्लिखित कार्य के अनुभव को वरीयता प्रदान की जायेगी ।

विकल्प ( iii ) विधि में स्नातक डिग्री तथा अधिवक्ता के रूप में बार काउंसिल की सदस्यता ।

योग्यता उपरांत विधि/ वित्तीय प्नलेखन , रेहन, गारण्टियों, बंधन, वसूली विवादों/दावों आदि तथा विभिन्न न्यायालयों/न्यायाधिकरणों में मुकदमों से संबंधित मामलों के क्षेत्र में 2 वर्ष का अनुभव । किसी बैंक/वित्तीय संस्थान में उल्लिखित कार्य अनुभव को वरीयता प्रदान की जाएगी तथा कम्प्यूटर एवं संबंधित सॉफ्टवेयर के प्रयोग की जानकारी होनी चाहिए ।

विकल्प ( iv) अभियांत्रिकी /प्रौद्योगिकी के क्षेत्र (जैसे कृषि प्रसंस्करण, खाद्य प्रसंस्करण , प्रशीतन, सिविल, डेरी , वस्त्र तथा अन्य ऐसे क्षेत्र जो निगम के अधिदेश में शामिल हों) में स्नातकोत्तर अथवा स्नातक (बी.ई/ बी.टेक) डिग्री ।

योग्यता उपरांत उल्लिखित क्षेत्रों की इकाइयों के क्रियान्वयन/प्रचालन/ अनुरक्षण/ गुणवत्ता नियंत्रण आदि में 2 वर्ष का अनुभव तथा कम्प्यूटर एवं संबंधित सॉफ्टवेयर के प्रयोग की जानकारी ।

( ii) कि सहायक निदेशक (तक०) , सहायक निदेशक (लेखा) , सहायक निदेशक (सांख्यिकी) , सहायक निदेशक(टॉपिंक) और सहायक निदेशक (एम०आई०एस०) के पद हेतु कालम 5 और 6 में क्रमशः 'आयु सीमा' और ' शैक्षिक तथा अन्य योग्यताओं' के संबंध में ' सीधी भर्ती' हेतु मौजूदा प्रावधान आगे से लागू नहीं होंगे और इन श्रेणियों में सीधी भर्ती के अंतर्गत खाली होने वाली रिक्तियाँ सहायक निदेशक के पद के भर्ती नियमों की शर्तों के अनुसार भरी जायेंगी । [ भाग III-खण्ड 4 1258

योग्यता उपरांत किसी बैंक /वित्तीय /विकासात्मक संस्थान में वित्त, लेखा, कॉस्टिंग, कराधान, जोखिम मूल्यांकन, लेखा परीक्षा , संसाधन प्रबंधन, परियोजना आंकलन, वित्त पोषण, मॉनीटरिंग , मूल्यांकन तथा संबद्ध कार्यों में 5 वर्ष का अनुभव जिसमें से कम से कम 2 वर्ष का अनुभव कार्यपालक की क्षमता में होना चाहिए तथा कम्प्यूटर और संबंधित सॉफ्टवेयर के प्रयोग की जानकारी होनी चाहिए ।

विकल्प ( ii) कम्प्यूटर विज्ञान/इलैक्ट्रॉनिक्स/संचार में बी.ई./बी.टेक, अथवा एम.सी.ए. , अथवा कम्प्यूटर विज्ञान में एम.एस.सी. ।

योग्यता उपरांत विधि/वित्तीय प्रलेखन, रेहन, गारण्टियों, बंधन, वसूली विवादों /दावों आदि तथा विभिन्न न्यायालयों/न्यायाधिकरणों में मुकदमों से संबंधित मामलों के क्षेत्रों में 5 वर्ष का योग्यता उपरांत अनुभव जिसमें से कम से कम 2 वर्ष का अनुभव कार्यपालक की क्षमता में होना चाहिए और कम्प्यूटर एवं संबंधित सॉफ्टवेयर के प्रयोग की जानकारी होनी चाहिए । किसी बैंक/वित्तीय संस्थान में उल्लिखित कार्य अनुभव तथा सहकारी विधान के अंतर्गत मामलों को निपटाने के ज्ञान और अनुभव को वरीयता प्रदान की जायेगी ।

विकल्प (iv) अभियांत्रिकी/प्रौद्योगिकी के क्षेत्र (जैसे कृषि प्रसंस्करण, खाद्य प्रसंस्करण, प्रशीतन, सिविल, डेरी , वस्त्र तथा अन्य ऐसे क्षेत्र जो निगम के अधिदेश में शामिल हो) में स्नातकोत्तर अथवा स्नातक (बी.ई/बी.टेक) डिग्री ।

योग्यता उपरांत किसी बैंक/वित्तीय /विकासात्मक संस्थान में वित्तीय प्रबंधन, परियोजना वित्तपोषण , बजट एवं लागत प्रबंधन, कर योजना, वित्तीय विश्लेषण , जोखिम प्रबंधन, तकनीकी एवं आर्थिक आंकलन, क्रियान्वयन, मॉनीटरिंग , मूल्यांकन तथा संबद्ध कार्यों में 8 वर्ष का अनुभव जिसमें से कम से कम 4 वर्ष का अनुभव कार्यपालक की क्षमता में होना चाहिये तथा किसी कम्प्यूटरीकृत वातावरण में कार्य करने का अनुभव होना चाहिए। विकल्प ( ii) विधि में स्नातक डिग्री तथा अधिवक्ता के रूप में बार काउंसिल की सदस्यता ।

योग्यता उपरांत वाणिज्यिक/कंपनी कानूनों, अनुबन्ध कानूनों तथा संपत्ति स्थानांतरण के कानूनों, कानूनी प्रलेखन, रेहन, गारण्टियों, बंधन, वसूली के विवादों/दावों आदि से संबंधित कानूनों तथा विभिन्न न्यायालयों/ न्यायाधिकरणों में मुकदमों से संबंधित मामलों के क्षेत्रों में 8 वर्ष का अनुभव जिसमें से कम से कम 4 वर्ष का अनुभव कार्यपालक की क्षमता में होना चाहिए । सहकारी विधान की जानकारी , उपर्युक्त क्षेत्रों में किसी बैंक अथवा वित्तीय संस्थान में कार्य करने का अनुभव रखने तथा किसी कम्प्यूटरीकृत वातावरण में कार्य करने के अनुभव को वरीयता प्रदान की जायेगी । 1261 भाग III- खण्ड 4]

(vii) कि सहायक निदेशक/ सहायक निदेशक(लेखा) / सहायक निदेशक (सांख्यिकी) /सहायक निदेशक (टॉपिंक) , उप निदेशक/उप निदेशक (लेखा)/उप निदेशक (ई ० एडं एस ०)/उप निदेशक (टॉपिंक) /उप निदेशक (प्रशिक्षण) , निदेशक/निदेशक (वित्त) /निदेशक (ई० एडं एस०) , निदेशक (प्रशिक्षण) के पद हेतु कालम 8 में प्रतिनियुक्ति से संबंधित मौजूदा प्रावधानों कां निम्न द्वारा प्प्रतिस्थापन किया जायेः-

The Reserve Bank of India, having considered it necessary in the public interest andbeing satisfied it is necessary to amend the Residuary Non -Banking Companies (Reserve Bank) Directions , 1987, hereby, in exercise of the powers conferred by Sections 45J , 45JA, 45K and 45L of the Reserve Bank of India Act , 1934 (2 of 1934) and all the powers enabling it in this behalf, directs that the said Directions contained in Notification No.DFC.55/DG( 0) -87 dated the 15th May 1987 shall , with immediate effect , be amended as follows , namely: -

1. Forsub- paragraph ( 1 ) of paragraph 6, the following sub - paragraph shall be substituted , namely , -

"6. Onandfrom April 1 , 2006 ,

(1) every residuary non - banking company shall invest and continue to invest anamount including the amount invested in assets under Section 45 -IB of the Reserve Bank of India Act , 1934 ( 2 of 1934), which at the close of business on any day of the quarter ending December 31 , 2005 and thereafter, on any day of each quarter shall not be less than the aggregate amounts of the liabilities to the depositors , outstanding at the close of business on the last working day of the second preceding quarter ( whether or not such amounts have become payable ) in securities or in other types of investments which are unencumbered and valued at a price not exceeding the current market price , in the following manner. namely, -

(a) not less than 10 percent of the aggregate amount of liabilities to depositors in fixed deposits/ certificates of deposit of scheduled commercial banks; or in certificates of deposit of specified financial institutions , provided the certificates.are rated not less than AA + or its equivalent by an approved credit rating agency , or partly in any of these Fixed Deposits/Certificates of Deposit so rated;

(b) not less than 75 percent of the aggregate amount of liabilities to depositors in securities of any State Government or Central Government issued by them in the course of their market borrowing programme , or in bonds or debentures (rated not less than AA + or equivalent by an approved credit rating agency and listed on a recognized stock exchange ) of any other company incorporated under the Companies Act , 1956 ( 1 of 1956) or in the manner at clause (a) or in the debt oriented schemes of mutual funds subject , however , to the conditions that

(i) not less than 15 per cent of the aggregate amount of the liabilities to the depositors shall be invested in any securities of any State Government or Central Government issued in the course of market borrowing programme ;

(ii) not more than two percent of the aggregate amount of the liabilities to the depositors shall be invested in any one debt oriented Mutual Fund which is governed by the Securities and Exchange Board of India (Mutual Funds) Regulations, 1996 and the aggregate of such investment shall not exceed ten per cent of the aggregate amount of liabilities to the depositors:

Provided that on and from April 1 , 2006 , a residuary non -banking company which does not comply with the above requirement , shall not make any investment in other securities till the shortfall in this category of investments is made good :

Provided that in the event of downgrading of credit rating below the prescribed grade of any bond or debenture , the bond or debenture shall become ineligible for compliance with the above requirement and shortfall , if any, in the compliance with the above paragraph arising from such downgrading of the rating shall be made good before making any further investments in the securities as provided for in clause ( c) or ( d) .:

Provided that debenture/bonds issued by holding company/subsidiary company/company in the same group shall not qualify for such investment;

(c) on and from April 1 , 2006 , not more than 5 percent of the aggregate amount of liabilities to the depositors or one time the net owned fund of the company, whichever is less , may be invested in any manner which in the opinion of the company is safe as per the approval of the board of directors of the company;

(d) on and from July 1 , 2006 , the incremental liabilities to the depositors above the level of aggregate amount of the liabilities to the depositors as on December 31 , 2005 shall be invested in accordance with sub - paragraph ( a ) or sub- paragraph ( b) only;

(e)on and from April 1 , 2007 , the aggregate amount of liabilities to the depositors as at end of last working day of second preceding quarter shall be invested in accordance with sub - paragraph ( a ) or sub - paragraph ( b) only.

Explanation:

For the purpose of clause (d ) , " incremental liabilities to the depositors " means liabilities to the depositors exceeding the aggregate amount of the liabilities to the depositors as on 31 December, 2005.

(vii) that the existing provisions relating to ' Deputation ' in Column 8 of the Recruitment Rules for the post of Asstt . Director / Asstt. Director(A/ cs ) / Asstt . Director (Stats ) / Asstt . Director(TOPIC) , Deputy Director/ Dy.Director (A/ cs) / Dy.Director(E&S ) / Dy.Director (TOPIC ) / Dy.Director(Trg) and Director / Director (Fin)/ Director(E&S)/Director (Trg. ) be substituted by the following: -

"Persons working in Central/ State Govt . Deptts, public undertakings, autonomous/ statutory bodies , semi - govt . institutions, banks and financial/ developmental institutions, govt . companies or cooperative institutions , fulfilling the eligibility criteriae of educational qualifications and experience as prescribed for Direct Recruitment for the given post will be eligible . "

2. The above amendments will be effective from 7th March, 2006 .
