सा.का.नि. 89.-- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए असम राइफल्स ( समूह'ग ' योधक पद ) भर्ती नियम , 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है अर्थात

1. ( 1 ) इन नियमों का संक्षिप्त नाम असम राइफल्स ( समूह ' ग ' योद्यक पद ) भर्ती नियम, 2006 है ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. असम राइफल्स ( समूह ' ग ' योधक पद ) भर्ती नियम , 2000 की अनुसूची में नायब सुबेदार क्लर्क के पद से संबंधित कम संख्यांक 10 के सामने स्तंभ ( 12 ) के अधीन विद्यमान प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-

" असम राइफल्स के ऐसे सदस्यों में से प्रोन्नति द्वारा , जिन्होंने कुल 18 वर्ष की सेवा की है , जिसके अन्तर्गत हवलदार ( क्लर्क ) के रूप में की गई पांच वर्ष से अन्यून सेवा भी है। " real e टिप्पण : - जब तक बल में विद्यमान वारंट अफसर ( क्लर्क ) पदोन्नत या वेस्ट आउट नहीं हो जाते तब तक हवलदार और वारंट अफसर (क्लर्क ) दोनों ग्रेडों में मिलाकर रेजीडेन्सी सेवा कम - से- कम पांच वर्ष होनी चाहिए।

G.S.R. 89.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Assam Rifles (Group ' C ' Combatised posts ) Recruitment Rules , 2000,namely:-

1. (1 ) These rules may be called the Assam, Rifles (Group ' C' Combatised posts ), Recruitment Rules , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Assam Rifles (Group ' C' Combatised posts ) Recruitment Rules , 2000, in the Schedule, against serial number 10 relating to the post ofNaib Subedar Clerk , under column ( 12) , for the existing entry, the following entry shall be substituted namely :-

"Promotion from amongst the member of Assam Rifles having a total period of 18 years of service including not less than five years service as Havildar (Clerk) . "

Note:-Till the Warrant Officer (Clerks ) existing in the Force are promoted or wasted out, the residency service in both grades ofHavildar Clerk and Warrant Officer ( Clerk) together should be a minimum of five years .

सा.का. नि. 90. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विधि, न्याय और कंपनी कार्य मंत्रालय, विधायी विभाग , विधि साहित्य प्रकाशन ( समूह ' घ' पद ) भर्ती नियम, 1982 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है, विधि साहित्य प्रकाशन , विधायी विभाग , विधि और न्याय मंत्रालय में समूह ' घ ' के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( i ) इन नियमों का संक्षिप्त नाम विधि और न्याय मंत्रालय , विधायी विभाग , विधि साहित्य प्रकाशन समूह ' घ ' पद भर्ती नियम , 2005 है।

(ii ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. लागू होना - ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों को लागू होंगे।

3. पद-संख्या , वर्गीकरण और वेतनमान : उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं।

4. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं।

5. निरर्हता: यह व्यक्ति ,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र महीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो यह किसी व्यक्तिको इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह सय है कि ऐसा करना आवश्यक या समचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 417 [भाग II- खण्ड 3(i) ]

7. व्यावृत्ति : इन नियमों की कोई बात , ऐसे आरक्षण, आयु -सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise ofthe powers conferred by the proviso to article 309 ofthe Constitution and in supersession of the Ministry of Law, Justice and Company Affairs, Legislative Department, Vidhi Sahitya Prakashan (Group ' D' Posts ) Recruitment Rules , 1982, except as respects this done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group ' D'D ' posts in the Vidhi Sahitya Prakashan, Legislative Department, Ministry of Law and Justice, namely:---

1. Short title and commencement .-( 1 ) These rules may be called the Ministry ofLaw and Justice , Legislative Department, Vidhi Sahitya Prakashan, Group ' D ' Posts Recruitment Rules, 2005.

(2) They shall come into force on the date of their publication in the Official Gazette.

Application. These rules shall apply to posts specified in column 1 ofthe Schedule annexed to these rules .

2. 3. Number of Posts, Classification and Scale of Pay. The number of said posts , their classification and scale ofpayattached thereto shall be as specified in columns (2) to (4) of the said Schedule .

4.Method of recruitment , age-limit, qualificationsetc. The method of recruitment etc. age - limit , qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 14) of the aforesaid Schedule.

5. Disqualification.-No person,-

[PART II-SBC. 3 (1) ] (a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation ofthis rule.

6. Power to relax.---Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category ofpersons.

7. Saving. Nothing in these rules shall effect reservations, relaxation of age -limit and other concessions required tobeprovided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories ofpersons in accordance withthe orders issued by the Central Government from time to time in this regard.

सा.का.नि. 91.- संविधान के अनुच्छेद 148 के खण्ड ( 5 ) के साथ पठित अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्ति का प्रयोग करते हुए तथा भारतीय लेखा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखापरीक्षक से परामर्श करने के उपरांत, राष्ट्रपति, केन्द्रीय सिविल सेवा ( छुट्टी ) नियम , 1972 को और आगे संशोधित करने की दृष्टि से निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का नाम केन्द्रीय सिविल सेवा ( छुट्टी ) संशोधन नियम , 2006 कहा जाए।

(2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे।

2. केन्द्रीय सिविल सेवा ( छुट्टी ) नियम , 1972 में नियम 43 ख को निम्नलिखित से प्रतिस्थापित किया जाएगा , अर्थात्:-

43 -ख बाल दत्तक ग्रहण अवकाश ( 1 ) दो जीवित बच्चों से कम संतान वाली कोई महिला सरकारी कर्मचारी को एक वर्ष से कम आयु के बालक को वैध रूप से गोद लेने पर, उसे वैध रूप से गोद लेने की तारीख के तुरन्त बाद , छु‌ट्टी प्रदान करने के लिए सक्षम प्राधिकारी द्वारा 135 दिन की अवधि के लिए छुट्टी प्रदान की जाए ।

(2) बाल दत्तक ग्रहण अवकाश अवधि के दौरान , उसे छुट्टी पर जाने से तुरंत पहले लिए गए वेतन के बराबर छुट्टी वेतन दिया जाएगा। (3 ) ( क) बाल दत्तक ग्रहण अवकाश अन्य किसी भी तरह की छुट्टी के साथ मिलाकर लिया जा सकता है ।

(ख) उप- नियम ( 1 ) के अंतर्गत प्रदान किए गए बाल 'दत्तक ग्रहण अवकाश के क्रम में , ( i ) किसी महिला सरकारी कर्मचारी को वैध रूप से शिशु गोद लेने पर , आवेदन किए जाने पर, ( चिकित्सा प्रमाण- पत्र प्रस्तुत किए बगैर अधिकतम 60 दिन की अदेय छुट्टी और परिवर्तित छुट्टी सहित ) एक वर्ष तक की अवधि की देय और ग्राह्य प्रकृति की छुट्टी, वैध रूप से बाल दत्तक ग्रहण करने की तारीख को दत्तक शिशु की आयु से कम करते हुए बाल दत्तक ग्रहण अवकाश पर ध्यान दिए बिना भी प्रदान की जा सकती है। परंतु यह कि यह सुविधा शिशु के दत्तक ग्रहण के समय महिला के पहले से ही दो जीवित संतान होने की स्थिति में उसे ग्राह्य नहीं होगी।

(4) बाल दत्तक ग्रहण अवकाश की छुट्टी खाते से कटौती नहीं की जाएगी।

G.S.R. 91. In exercise of the powers conferred by the proviso to article 309 read with clause (5 ) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the IndianAudit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely :-

1. (1 ) These rules may be called the Central Civil Services (Leave) Amendment Rules, 2006.

(2) They shall come into force on the date of their publicatiort in the Official Gazette.

2. In the Central Civil Services (Leave) Rules, 1972, for rule 43 -B, the following shall be substituted, namely:-

43 -B. ChildAdoption Leave ( 1 ) A female Government servant, with fewer than two surviving children, on valid adoptionofachild below the age of orie year may be granted child adoption leave , by an authority competent to grant leave, foraperiod of 135 days immediately after the date of valid adoption100

[PART II-SEC . 3 (i )] (2) During the period of child adoption leave , she shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

(3 ) (a) Child adoption leave may be combined with leave of any other kind .

(b) In continuation of the child adoption leave granted under sub - rule ( 1 ) , a female Government servant on valid adoption of a child may also be granted, if applied for, leave of the kind due and admissible (including leave not due and commuted leave not exceeding 60 days without production of medical certificate ) for a period upto one year reducedby the age of the adopted child on the date ofvalid adoption, without taking into account child adoption leave . Provided that this facility shall not be admissible in case she is already having two surviving children at the time of adoption.

(4) Child adoption leave shall not be debited against the leave account .

सा.का. नि. 93.--राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा, प्रदत्त शक्तियों का प्रयोग करते हुए, और जवाहर लाल स्नातकोत्तर चिकित्सा शिक्षा तथा अनुसंधान संस्थान , पांडिचेरी ( समूह ' ग ' पद ) भर्ती नियम 1981 जहां तक उसका संबंध चिकित्सा अभिलेख पर्यवेक्षक के पद से है को , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , जवाहर लाल स्नातकोत्तर, चिकित्सा शिक्षा तथा अनुसंधान संस्थान , पांडिचेरी में चिकित्सा अभिलेख पर्यवेक्षक और चिकित्सा अभिलेख तकनीकी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ (1) इन नियमों का संक्षिप्त नाम जवाहर लाल स्नातकोत्तर, चिकित्सा शिक्षा तथा अनुसंधान संस्थान, पांडिचेरी, चिकित्सा अभिलेख पर्यवेक्षक और चिकित्सा अभिलेख तकनीकी ( समूह ' ग ' पद) भर्ती नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2 2. पद-संख्या , वर्गीकरण और वेतनमान : उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वही होंगे , जो इन नियमों से उपाबद्व अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा , और अर्हता और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता : वह व्यक्ति-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तुयदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति : केन्द्रीय या राज्य सरकार के अधीन ऐसे अधिकारियों मेंसे ;

(क) ( i ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ii) जिन्होंने 4000-6000 रुपए के वेतनमान के पदों पर पांच वर्ष नियमित सेवा की है; और

(ख ) जिनके पास निम्नलिखित शैक्षिक अर्हता और अनुभव है:-

(i ) किसी मान्यताप्राप्त विश्वविद्यालय या बोर्ड से 10+2

(ii ) किसी मान्यताप्राप्त अस्पताल या चिकित्सा संस्थान से चिकित्सा अभलेख तकनीशियन पाठ्यक्रम सफलतापूर्वक पूर्ण किया हो ।

(iii ) किसी अस्पताल या चिकित्सा संस्थान से स्वास्थय सांख्यिकी के संकलन में तीन वर्ष का अनुभव पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

(प्रतिनियुक्तिकी अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाहय पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ) ।

G.S.R. 93. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Jawaharlal Institute ofPost Graduate Medical Education and Research, Pondicherry (Group 'C' Posts) Recruitment Rules, 1981, in so far as it relates to the post of Medical Records Supervisor , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post ofMedical Records Supervisor and Medical Records Technician in the Jawaharlal Institute ofPost GraduateMedical Education and Research, Pondicherry namely:-

1. Short title and commencement. ( 1 ) These rules may be called the Jawaharlal Institute of Post Graduate Medical Education and Research, Pondicherry , Medical Records Supervisor and Medical Records Technician (Group ' C ' posts)Recruitment Rules, 2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts , classification and scale of pay. The number of the said posts, their classification and the scaleofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit, qualifications , etc.-The method ofrecruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualifications-No person,-

(a) who, has entered into or contracted a marriage with a person having a spouse living , or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shallbe eligible for appointment to the said posts :

Providedthatthe Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for sò doing , exempt any person from the operation of this rule.

5. Powerto relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may,by order and for reasons to be recorded in writing in relax any of the provisions ofthese rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required tobe provided for the candidates belonging to Scheduled Castes, the Scheduled Tribes , Ex- serviceman and other special categories of persons , in accordance with the orders issued by the Central Government from time to time inthis regard.

(2) वे शासकीय गजट में प्रकाशित होने की तिथि से प्रभाषी होंगे ।

4. अनार्हता. ऐसा कोई व्यक्ति,-

(क) जो किसी ऐसे व्यक्ति से विवाह करता है अथवा विवाह का करार करता है जिसके पति/पत्नी जीवित हैं अथवा (ख) जो पति/पत्नी के जीवित रहते दूसरे व्यक्ति से विवाह करता है अथवा विवाह का करार करता है , उक्त पद के लिए पात्र नहीं होगा :

बशर्ते कि केन्द्र सरकार यदि इस बात से संतुष्ट है कि उक्त व्यक्ति एवं अन्य पक्ष को लागू संबंधित व्यक्तिगत कानून के द्वारा ऐसे विवाह करने की छूट मिली हो और कि ऐसा करने के और अन्य कारण भी हैं , तो सरकार ऐसे व्यक्ति को उक्त नियम में छूट दे सकती है।

5. छूट देने का अधिकार, जहां केन्द्र सरकार का यह विचार हो कि ऐसा करना आवश्यक अथवा उचित है तो लिखित में कारण का उल्लेख करते हुए , आदेश के माध्यम से इन नियमों के किसी भी उपबंधों से किसी भी श्रेणी के किसी भी व्यक्ति को छूट प्रदान कर सकती है।

6. अपवाद. इन नियमों से इस संबंध में समय - समय पर केन्द्र सरकार द्वारा पारित आदेशों जिनमें आरक्षण , आयु सीमा में छूट एवं अनुसूचित जाति, जनजाति अन्य पिछड़े वर्ग , भूतपूर्व सैनिक , अन्य विशेष श्रेणी के व्यक्ति को दी जाने वाली अन्य रियायतें प्रभावित नहीं होंगी।
