General Statutory Rules (Including Orders , Bye- laws etc. of a general character) issued by the Ministries of the Government of India (other than the Ministry of Defence) and by the Central Authorities (other than the Administrations of Union Territories)

सा.का.नि. 149. संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रपति , एतद्वारा पूर्वोत्तर परिषद सचिवालय , शिलांग में सलाहकार ( स्वास्थ्य) के पद पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते है, नामत:

1.संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों को पूर्वोत्तर परिषद सचिवालय , शिलांग , सलाहकार ( स्वास्थ्य ) वर्ग ' क' पद भर्ती नियम , 2006 कहा जाएगा ।

(2 ) ये भर्ती नियम शासकीय राजपत्र में प्रकाशन होने के दिन से प्रवृत होंगे ।

2. पद की संख्या , वर्गीकरण और वेतनमान पद की संख्या , उसका वर्गीकरण और उससे संबंधित वेतनमान , इन नियमों के साथ संलग्न अनुसूची के कालम ( 2 ) से ( 4 ) में यथाविनिर्दिष्ट के अनुसार होंगे।

3. भर्ती प्रणाली , आयु सीमा , अर्हता आदि - उक्त पद की भर्ती प्रणाली , आयु सीमा, अर्हता तथा उनसे संबंधित अन्य बातें पूर्वोक्त अनुसूची के कालम ( 5 ) से ( 14 ) में विनिर्दिष्ट के अनुसार होंगी।

4. निरर्हता- जिसने

(क) किसी ऐसी महिला/पुरुष से विवाह किया हो जिसके पति/पत्नी जीवित हों या.

(ख ) पति/पत्नी के जीवित रहते हुए किसी से विवाह किया हो

वह उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यह और भी कि केन्द्र सरकार इस बात से संतुष्ट होकर कि ऐसे व्यक्ति और दूसरे पक्ष पर लागू होने वाली स्वीय विधि में इस प्रकार का विवाह अनुज्ञेय है, इस नियम के प्रवर्तन से छूट दे सकती है।

5. शिथिल करने की शक्ति जहां केन्द्र सरकार के मत के अनुसार ऐसा किया जाना आवश्यक और समीचीन है, वहां लिखित रूप में रिकार्ड किए जाने वाले कारणों से और संघ लोक सेवा आयोग के परामर्श से केन्द्र सरकार व्यक्तियों के किसी वर्ग और श्रेणी के संबंध में इन नियमों के किसी उपबंध को शिथिल कर सकती है ।

6. व्यावृत्ति- इन नियमों से केन्द्र सरकार द्वारा समय - समय पर जारी आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों तथा विशेष श्रेणी के अन्य व्यक्तियों को दिए जाने वाले आरक्षण , आयु सीमा में छूट तथा अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

(क) (i ) पैतृक संवर्ग या विभाग में नियमित आधार पर सदृश पदधारी हों; या

( ii ) पैतृक संवर्ग या विभाग में रु. 14300-18300 के वेतनमान वाले पदों या समकक्ष पदों पर नियमित आधार पर नियुक्ति के बाद उस ग्रेड में तीन वर्ष कीसेवा कर चुके हों; या

(iii) पैतृक संवर्ग या विभाग में रू. 12000-16500 के वेतनमान वाले पदों या समकक्ष पदों पर नियमित आधार पर नियुक्ति के बाद उस ग्रेड में आठ वर्ष की सेवा कर चुके हों; और

( iv ) पैतृक संवर्ग या विभाग में रु. 10000-15200 के वेतनमान वाले पदों या समकक्ष पदों पर नियमित आधार पर नियुक्ति के बाद उस ग्रेड में तेरह वर्ष की सेवा कर चुके हों; और

( ख ) निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों :

अनिवार्य:

( i ) भारतीय आयुर्विज्ञान परिषद अधिनियम , 1956 ( 1956 का 102 ) की पहली अनुसूची में , दूसरी अनुसूची में , या तीसरी अनुसूची के भाग II में शामिल की गई मान्यताप्राप्त ( लाइसेंसिएट योग्यताओं को छोड़कर) चिकित्सा योग्यताएँ, तीसरी अनुसूची के भाग- II में शामिल की गई शैक्षिक योग्यताओं के धारको को भारतीय आयुर्विज्ञान परिषद अधिनियम , 1956 ( 1956 का 102) के खंड 13 के उपखंड ( 3 ) में अनुबद्व शतों को भी पूरा करना चाहिए।

( ii ) केन्द्रीय स्वास्थ्य सेवा की अनुसूची VI में उल्लिखित पोस्ट ग्रेजुएट डिग्री या डिप्लोमा या समकक्ष।

( iii ) चिकित्सा व्यवसाय में 16 वर्षों से कार्यरत जिसमें पांच वर्ष का प्रशासनिक अनुभव शामिल हो।

( केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में नियुक्ति के तत्काल पहले अन्य निःसंवर्गीय पद पर प्रतिनियुक्ति या अनुबंध की अवधि सामान्यतः चार वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति ( अल्पकालिक अनुबंध सहित ) पर नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन पत्र प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। )

यदि कोई विभागीय प्रोन्नति समिति है तो उसकी संरचना क्याहैं

जिन परिस्थितियों में भर्ती के संबंध में संघ लोक सेवा आयोग से परामर्श किया जाएगा

G.S.R. 149. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution , the President hereby makes the following rules , for regulating the method of recruitmentto the post of Adviser (Health) in the office of the North Eastern Council Secretariat, Shillong , namely : -

1. Short title and commencement .-( 1 ) These rules may be called the North Eastern Council Secretariat, Shillong, Adviser(Health) Group ' A' Post Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of Post , Classification and Scale of Pay. The number posts , its classification and the scale of pay attached thereto shall be as specified in columns (2 ) to (4) of the said Schedule , annexed to these rules .

3. Method of recruitment, age - limit qualifications etc. The method of recruitment, to the said posts , age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14 ) of the aforesaid Schedule.

4. Disqualifications . No persons ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing exempt any person from the operation ofthis rule.

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.-Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , and Ex - Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

(i)Recognised medical qualifications included in the First Schedule or Second Schedule or Part II of the Third schedule (other than licenciate qualifications) to the Indian Medical Council Act, 1956 (102 of 1956). Holders of educational qualifications included in Part - II of the Third schedule should also fulfill the conditions stipulated in sub - section (3 ) ofSection 13 of the Indian Medical Council Act, 1956 ( 102 of 1956 ) .

(ii) Post Graduate Degree or Diploma mentioned in Schedule VI of Central Health Service or equivalent;

(iii) 16 years' standing in medical profession including five years ' administrative experience.

(Period of deputation or contract including period of deputation or contract in another ex - cadre post held immediatly preceding this appointment in the same or some other organisation or Department of the Central Government, shall ordinarily not exceed five years .

Themaximum age limit for appointment by deputation ( including short term contract) shall be not exceeding fifty- six years as on the closing dateofreceipt of applications) .

सा.का.नि. 150.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए डा. राम मनोहर लोहिया अस्पताल , नई दिल्ली, केन्द्रीय निर्जीवाणुकरण पूर्ति सहायक भर्ती नियम , 1987 को , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, डा. राम मनोहर लोहिया अस्पताल , नई दिल्ली में केन्द्रीय निर्जीवाणुकरण पूर्ति सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम डा. राम मनोहर लोहिया अस्पताल , नई दिल्ली ( केन्द्रीय निर्जीवाणुकरण पूर्ति सहायक ) समूह ' ग ' पद भर्ती नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं-उक्त पद पर भर्ती की पद्धति , आयु सीमा, अर्हता और उससे संबंधित अन्य बातें वे होंगी , जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता , कोई व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी। 6. व्यावृत्ति. - इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण-अनुभव संबंधी अर्हताएं सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहींहै।

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए दो वर्ष

G.S.R. 150.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Dr. Ram Manohar Lohia Hospital, New Delhi Central Sterilization Services Assistant, Recruitment Rules , 1987 except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Central Sterilization Services Assistant in the Dr. Ram Manohar Lohia Hospital , New Delhi , namely: ----

1. Short title and Commencement .-( 1 ) These rules may be called the Dr. Ram Manohar Lohia Hospital , New Delhi ( Central Sterilization Services Assistant) Group ' C ' Post, Recruitment Rules, 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay . The number of said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule , annexed to these rules .

3. Method of recruitment, age -limit qualifications etc. The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualifications . No persons,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living , has entered into or contracted a marriage with any person,

shall be cligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.--Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - Servicemen and other special categories of person, in accordance with the orders issued by the Central Government from time to time in this regard .

सा.का.नि. 151. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान ( सहायक निदेशक , अर्थशास्त्री) , भर्ती नियम , 1986 को जहां तक उनका संबंध सहायक निदेशक ( अर्थशास्त्री ) के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया है , कृषि मंत्रालय , पशुपालन, डेयरी और मत्स्यपालन विभाग के अधीन केन्द्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान ( सी आई सी ई एफ ) , बंगलौर में सहायक निदेशक ( अर्थशास्त्र ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान ( सी आई सी ई एफ ) सहायक निदेशक ( अर्थशास्त्री) भर्ती नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 695 [ भाग II- खण्ड 3 (i) ]

2. पद की संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति आयु सीमा , और अन्य अर्हता आदि. - उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं।

4. निरर्हता. वह व्यक्ति

( क ) जिसने ऐसी व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति- इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंधा करना अपेक्षित है ।

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं।

आवश्यक :

सीधी भर्ती किए जाने वाले व्यक्तियों केलिए एक वर्ष। ( 1 ) किसी मान्यता प्राप्त विश्वविद्यालय से सांख्यिकी के साथ अर्थशास्त्र/सांख्यिकी के साथ वाणिज्य में मास्टर डिग्री या समतुल्य।

शैक्षिक अर्हताएं : नहीं (किन्तु किसी मान्यताप्राप्त विश्व- विद्यालय से एक चयनित विषय के रूप में सांख्यिकीय के साथ वाणिज्य में डिग्री रखनी चाहिए।

(2 ) कृषि के प्राथमिक उद्योग के क्षेत्र में सर्वेक्षण अनुसंधान में तीन वर्ष का अनुभव।

टिप्पणी 1 : अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है।

टिप्पणी 2 : अनुभव संबंधी अर्हता ( अर्हताएं ) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है ( हैं) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है।

टिप्पण: 6,500-10,500 रुपए के वेतनमान में ऐसे विभागीय ज्येष्ठ आर्थिक अन्वेषक , जिसके उस श्रेणी में नियमित आधार पर नियुक्ति के पश्चात् 5 वर्ष नियमित सेवा की है पर भी विचार किया जाएगा। यदि वह चयनित कर लिया गया है तो पद को प्रोन्नति द्वारा भरा गया माना जाएगा।

सा.का.नि. 152.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और खान विभाग ( समूह ' क' तकनीकी पद) भर्ती नियम , 1980 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , खान मंत्रालय में कनिष्ठ वैज्ञानिक अधिकारी ( जे.एस.ओ. ) के पद पर भर्ती की पद्धति का विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:--

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम खान मंत्रालय ( समूह ' क' तकनीकी पद ) भर्ती नियम , 2006 है । ( 2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों संख्या , वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उससे सम्बद्ध वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं आदि उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता: -वह व्यक्ति,-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

1 परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति : -इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों अन्य पिछड़े वर्गों भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 701 [ भाग II- खण्ड 3(i) ]

टिप्पण: -

अर्हताएं अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

2. अनुभव संबंधी अर्हताएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों अथवा अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं, जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले इन समुदायों के अभ्यर्थी पर्याप्त संख्या में उपलब्ध नहीं हो सकेंगे ।

G.S.R. 152. In exercise of the powers conferred by the proviso to article 309 and in supersession of the Department of Mines (Group " A" Technical Post) Recruitment Rules, 1980, except as respects things done or omitted tobe done before such supersession , the President thereby makes the following rules regulating the method of recruitment to thepost of Junior Scientific Officer ( JSO) , Ministry ofMines , namely :-

1. Short title and commencement . ( 1 ) These Rules may be called the Ministry of Mines (Group "A " Technical Post) Recruitment Rules , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay. The number ofthe said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule) annexed to these rules.

3. Method of recruitment , age - limit , qualifications etc. The method ofrecruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. No persons ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , the Ex- servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.
