सा.का.नि. 154.- केन्द्रीय सरकार , राष्ट्रीय सुरक्षक अधिनियम , 1986 ( 1986का 47 ) की धारा 139 की उप - धारा ( 1 ) और उप- धारा ( 2 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रीय सुरक्षक ( समूह ' ख ' अराजपत्रित पद) भर्ती नियम , 2003 में और संशोधन करने के लिए निम्नलिखित नियम बताती है, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षित नाम राष्ट्रीय सुरक्षक ( समूह ' ख ' अराजपत्रित पद ) भर्ती संशोधन नियम , 2006 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. राष्ट्रीय सुरक्षक ( समूह ' ख ' अराजपत्रित पद ) भर्ती नियम , 2003 की अनुसूची के क्रम सं. 8 से 17 तक का लोप किया जाएगा ।

In exercise of the powers conferred by sub - section ( 1 ) and clause (a ) of sub - section (2 ) of Section 139 the National Security Guard Act, 1986 (47 of 1986 ), the Central Government hereby makes the following rules further to amend the National Security Guard (Group ' B ' Non - Gazetted Posts) Recruitntent Rules , 2003 namely:---

1. ( 1 ) These rules may be called the National Security Guard (Group ' B ' Non - Gazetted Posts ) Recruitment Amendment Rules , 2006 ,

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the National Security Guard (Group ' B ' Non- Gazetted Posts ) Recruitment Rules , 2003 , in the Schedule , serial numbers 8 to 17 shall be omitted,

सा.का.नि. 155.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और योजना आयोग (ज्येष्ठ कलाकार ) भर्ती नियम , 1985 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , योजना आयोग में ज्येष्ठ कलाकार के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम योजना आयोग ज्येष्ठ कलाकार भर्ती नियम , 2006 है । (2 ) ये राजपत्त्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद - संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि. - उक्त पद पर भर्ती की पद्धति , आयु सीमा और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हेंलेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । 709 [ भाग II- खण्ड 3 ( i) ]

अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है ।

प्रतिनियुक्ति:

केन्द्रीय सरकार के अधीन ऐसे अधिकारी:

(क ) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश्य पद धारण किए हुए हैं; या (ii ) जिन्होंने मूल काडर या विभाग में 4500-7000 रु. के या समतुल्य वेतनमान में नियमित आधार पर उस श्रेणी में नियुक्ति के पश्चात् छह वर्ष सेवा की है, और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं :-

(i ) मान्यता प्राप्त बोर्ड या विश्वविद्यालय से मेट्रीकुलेशन या समतुल्य;

(ii ) किसी मान्यता प्राप्त बोर्ड या विश्वविद्यालय से नक्शानवीसी या इंजीनियरी या कला या वाणिज्यिक कला या वास्तुकला में डिप्लोमा या समतुल्य;

( iii ) उपरोक्त ( ख ) ( i ) और ( ii ) में वर्णित शैक्षिक अर्हताओं को प्राप्त करने के पश्चात् किसी सरकारी कार्यालय में नक्शानवीस के रूप में तीन वर्ष का अनुभव।

वांछनीय : लेखाचित्रण सहित कम्प्यूटर अनुप्रयोग के पैकेजों से सुपरिचित।

पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होगें । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

[ प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है जो साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रति- नियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ]

PLANNING COMMISSION

New Delhi , the 22nd June, 2006

G.S.R. 155. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Planning Commission (Senior Artist) Recruitment Rules , 1985 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules , regulating the method of recruitment to the post of Senior Artist in the Planning Commission ; namely:-

1, Short title and commencement ( 1 ) These rules may be called the Planning Commission, Senior Artist Recruitment Rules, 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of Post, Classification and Scale of Pay. The number of the post, its classification and the scales ofpay attached thereto shall be as specified in columns (2) to(4) of the Schedule, annexed hereto.

3. Method of recruitment , age- limit qualifications , etc. The method of recruitment , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14 ) of the said Schedule .

4. Disqualifications . No persons ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who , having a spouse living, has entered into or contracted a marriage with any other person ,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.

5. Power to relax. -Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , the Other Backward Classes , ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard..

(ii)Diploma in Draughtsmanship or Engineering or Arts or Commercial ArtorArchitecture or equivalent from a recognized Board or University;

(iii) Three years ' experience as a Drauglitsman in a Government office after obtaining the educational qualifications at (b ) ( i ) and ( ii ) above.

Desirable : Familiar with packges for Computer applications including

graphics.

The departmental officers in the feeder category who are in the direct line ofpromotion shall not be eligible for consideration for appointment on deputation . Similarly deputationst shall not be eligible for consideration for appointment by promotion .

[Period of deputation including period of deputation in another ex- cadre postheld immediately preceding this appointment in the sameor some other Organisation/Department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of applications . ]

राष्ट्रीय जैव विविधता प्राधिकरण

सा.का.नि. 156.-राष्ट्रीय , जैव विविधता प्राधिकरण , जैव विविधता अधिनियम, 2002 ( 2003 का 18 ) की धारा 14 और धारा 64 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार के पूर्व अनुमोदन से अपने अधिकारियों और अन्य कर्मचारियों की भर्ती की पद्धित और सेवा की शर्तों का विनियमन करने के निम्नलिखित विनियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन विनियमों का संक्षिप्त नाम राष्ट्रीय जैव विविधता प्राधिकरण ( अधिकारियों और अन्य कर्मचारियों की भर्ती और सेवा शर्तें ) विनियम , 2006 है।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. राष्ट्रीय जैव-विविधता प्राधिकरण के कर्मचारिवृन्द - राष्ट्रीय जैव विविधता प्राधिकरण के अधिकारियों और अन्य कर्मचारियों केपदों का नाम , उनकी संख्या वर्गीकरण और वेतनमान वह होगा जो इन विनियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा , और अन्य अर्हताएं आदि. उक्त पदों के लिए भर्ती की पद्धति, आयु सीमा , शैक्षक अर्हताएं और अन्य संबंधित विषय वे होंगे जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं।

4. निरर्हता.-वह व्यक्ति

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है , या

(ख ) जिसने अपने पत्नि या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

बशर्ते कि राष्ट्रीय जैव विविधता प्राधिकरण केन्द्रीय सरकार के परामर्श से यदि संतुष्ट हो कि ऐसे विवाह की व्यक्तिगत कानून के अंतर्गत उस व्यक्ति को अनुमति है और यह कि ऐसा करने के अन्य आधार भी हैं तो इस नियम से किसी को छूट दी जा सकती है ।

5. सेवा शर्तें : राष्ट्रीय जैव विविधता प्राधिकरण के अधिकारयों और कर्मचारियों को भत्ते , छुटिट्यों, भविष्य निधि, अधिवर्षिता आयु, पेंशन और सेवानिवृत्ति कामदो , चिकित्सा सुविधाओं और सेवा की अन्य शर्तों के विषय को तत्समय के लिए उन स्थानों पर नियुक्त उसी वेतनमान में केन्द्रीय सरकार के यथास्थिति समूह क , समूह ख , समूह ग और समूह घ के अधिकारियों और कर्मचारियों, पर लागू ऐसे नियमों और विनियमों के अनुसार विनियमित किया जाएगा।

6.नियुक्ति प्राधिकारी. - ( 1 ) समूह क और समूह " ख " पदों की सभी नियुक्तियां राष्ट्रीय जैव विविधता प्राधिकरण के अध्यक्ष द्वारा की जाएंगी । ( 2 ) " समूह ग " और " समूह घ " पदों पर सभी नियुक्तियां राष्ट्रीय जैव विविधता प्राधिकारण के सचिव द्वारा की जाएंगी। 7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

In exercise of the powers conferred by sub - section (2) of Section 14 and Section 64 of the Biological Diversity Act , 2002 ( 18 of 2003 ) , the National Biodiversity Authority with the previous approval of the Central Government, hereby makes the following regulations regulating the method of recruitment and conditions of service of its officers and other employees , namely :-

1. Short title and commencement .-( 1 ) These regulations may be called the National Biodiversity Authority (Recruitment and Conditions of Service of Officer, and other employees) Regulations, 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Staff of the National Biodiversity Authority. The name of the posts of the Officers and other employees of the National Biodiversity Authority, their number, classification and the scale of pay attached thereto shall be as specified in Columns 1 to 4 of the Schedule appended to these regulations .

3. Method of recruitment , age- limit and qualifications , etc. The inethod of recruitment, to the said post, age limit, qualifications , and other matters relating thereto , shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the National Biodiversity Anthority may in cosultation with the Central Government, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Conditions of Service. The conditions of service of the officers and other employees of the National Biodiversity Authority in matters of Allowances , Leave, Provident Fund , age of superannuation, pension and retirement benefits , medical facilities and other conditions of service , shall be regulated in accordance with such rules and regulations as are for the time being applicable to the officers and employee of the Central Government belonging to Group A, Group B,Group C and Group D posts , as the case may be , of the corresponding scales of pay stationed at those places.

6. Appointing Authority.- ( 1 ) All appointment to Group ' A ' and Group ' B ' posts shall be made by the Chairperson of the National Biodiversity Authority.

(2) All appointments to Group ' C ' and Group ' D' posts shall be made by the Secretary ofthe National Biodiversity Authority.

7. Power to relax.- Where the National Biodiversity Authority is of the opinion that it is necessary or expedient so to do, it may, by order, for reason to be recorded in writing, and in consultation with the Central Government , relax any of the provisions of these rules with respect to any class or category of persons .

8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Schedule Tribes , the other Backward Classes , Ex- servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.
