सां. का.पि. 199, केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम, 191968 (1968 का 47) की धारा 141 की उप धाराउपधारा (2) के खंड (ख) और खंड (ग ) द्वारा प्रदत रमित का प्रयोग करते हुए सीमा सुरका दल जल स्कंध ( समूह ' ख ' बोधक तकनीकी स्टाफ ) भर्ती नियम 2005 का संशोधन करने के लिए निम्नलिखित नियम बनाते है वर्षद

1. (1 ) इन नियमों का संक्षिप्त नामसीलस्सी पसंतोषन ) नियम , 2006 है । (2) ये राजपाल में प्रकाशनको रीसे प्रकृत

G.S.R. 199.- In exercise of the powers conferred by clauses (b) and (c) of sub- section (2) ofSection 141 ofthe BorderSecurityForce Act, 1968 (47 of 1968 ), the Central Government hereby makes the following rules to amend the BorderSecurityForce Water Wing ( Group 'B' Combatised Technical Staff) Recruitment Rules, 2005, namely:-

1.(1 ) These rules may be called the Border Security Force, Water Wing (Group ' B ' Combatised Technical Staff) Recruitment (Amendment) Rules,2006.

(2) They shall come into force on the date ofpublication in the Official Gazette.

2. IntheBorder Security Force Water Wing (Group 'B' Combatised Technical Staff) Recruitment Rules, 2005, after rule4, the following rule shall be inserted, namely :-

"4A. Absorption in Water Wing Cadre.--Officers already working in Water Wing shall exercise their irrevocable option for absorption in Water WingCadre."

वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्धन विधार्ग ) (केन्द्रीय बॉयलर बोर्ड )

सा.का. नि. 200.- भारतीय बॉयलर विनियमावली , 1950 में आगे संशोधन करने हेतु, जिसे भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय बॉयलर बोर्ड द्वारा किये जाने का प्रस्ताव है , कुछ विनियमों से संबंधित निम्नलिखित मसौदा एतद्द्वारा उन सभी व्यक्तियों के सूचनार्थ प्रकाशित किया जाता है , जिनकी इससे प्रभावित होने की संभावना है , जैसा कि उक्त अधिनियम की धारा 31 की उप- धारा ( 1 ) के तहत अपेक्षित है और, एत‌द्वारा नोटिस दिया जाता है कि उक्त मसौदे पर उस तारीख से पैंतालीस दिन बीत जाने के बाद विचार किया जाएगा , जिस तारीख को इस अधिसूचना के प्रकाशन वाला राजपत्र जनता को उपलब्ध कराया जाएगा ।

2. उक्त मसौदे संबंधित समस्त आपत्तियों अथवा सुझावों पर जो विनिर्दिष्ट की गई अवधि के भीतर किसी भी व्यक्ति से प्राप्त होंगे केंद्रीय बॉयलर बोर्ड विचार करेगा ।

3. आपत्तियां और सुझाव , यदि कोई हों, सचिव , केंद्रीय बॉयलर बोर्ड , वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) , उद्योग भवन , नई दिल्ली -110011 को मेने जाएं ।

मसौदा विनियम

1. (1 ) इन विनियमों को भारतीय बॉक्सर (द्वितीय संशोधन) विनियम, 2006 कहा जाए ।

(2 ) ये शासकीय राजपत्र में अंतिम रण से प्रकाशन के पश्चात् लागू हो जाएंगे ।

2. भारतीय बॉयलर विनियमावली, 1950 में (इसके पश्चात् इसे यहां उक्त विनियमावली कहा जाएगा) , विनियम 376 में खंड (च च) के पश्चात् निम्नलिखित जोड़ा जाएगा , नामत :

" ( चचच ) अनन्य रूप से निरंतर प्रक्रिया अोिं में प्रयोग किए जाने वाले आंतिरिक बॉयलरों और वेस्ट हीट बॉयलरों (फायर्ड और अनफायर्ड) के लिए परिशिष्ट अ ख के जनों के अनुसार निरीक्षण किया जाएगा । क्षयकारी वातावरण , जैसे कि गंधक के अम्ल के संयंत्रों, में प्रयोग किए आने वाले बॉयलों को रिशष्ट व ख के उपबंधों में शामिल नहीं किया जाएगा ।"

3. उक्त विनियमावली में विनियिम 377 के रत्वात् खंड (ख) के पश्चात् निम्नलिखित खंड जोड़ा आएगा नामतः : - " (ग) अनन्य रूप से निरंतर प्रक्रिया संबंधों में प्रयोग किए जाने वाले ऑतिरिक बॉयलरों और वेस्ट हीट बॉयलरों ( फायर्ड और अनफायर्ड) को प्रतिवर्ष प्रमाणपत्र जारी करने के लिए डाइड्रोलिक रूप से जांचने की आवश्यकता नहीं है । "

बशर्ते ऐसे बॉयलरों का निरीक्षण विनियम 376 के उपबंधों के अनुसार किया जाए । [ भाग II-खण्ड 3 (i ) ]

919 4. उक्त विनियमावली में फार्म XIX में, " परिशिष्ट ' जेए ' के तहत प्रमाणन के बारह माह पश्चात् बॉयलरों के निरीक्षण हेतु आवेदन के साथ ब्यौरे प्रस्तुत किए जाएंगे शब्दों और अक्षरों के स्थान पर ये शब्द और अक्षर प्रतिस्थापित किए जाएंगे " परिशिष्ट "" जेए' और परिशिष्ट ' जेबी' के तहत प्रमाणन के बारह माह पश्चात् बॉयलरों के निरीक्षण हेतु आवेदन के साथ ब्यौरे प्रस्तुत किए जाएंगे ।"

5. उक्त विनियमावली में, विनियम 385 में निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामतः

" 385 पंजीकरण शुल्क. अधिनियम की धारा 7 की उप - धारा ( 1 ) के अंतर्गत प्रार्थना- पत्र के साथ दिया जाने वाला शुल्क इस प्रकार होगा :-

बायलर रेटिंग 10 वर्ग मीटर से अधिक नहीं

720रुपये

बायलर रेटिंग 10 वर्ग मीटर से अधिक परन्तु 30 वर्ग मीटर से अधिक नहीं

960रुपये

बायलर रेटिंग 30 वर्ग मीटर से अधिक परन्तु 50 वर्ग मीटर से अधिक नहीं

1080रुपये

1320 रुपये

बायलर रेटिंग 50 वर्ग मीटर से अधिक परन्तु 70 वर्ग मीटर से अधिक नहीं

3000 वर्ग मीटर से अधिक , प्रत्येक 200 या उसके भाग पर, 240 रुपये अतिरिक्त शुल्क देन होगी ।

" बरातें , मुख्य निरीक्षक यह निर्देश दे कि अधिनियम की धारा 14 की उप- धारा ( 2 ) के अनुसरण में किए गए गए आवेदन के संबंध में कोई शुल्क देय नहीं होगा,"

6. उक्त नियमावली में विनियम 395 में खंड (ख) के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाएगा मामवः-

(ख) ( 1 ) स्टीम पाहनों का विनिर्माण शुरू करने से पहले, सामग्री , डिलाइन और स्टीम पाइपों की योजना एवं विवरणों की जांच शुल्क 30 मीटर पाइपिंग का उसके हिस्से के लिए 40 रुपये की दर से होंगे , किस पर 60/- रुपये की न्यूनतम शर्त लागू होगी और इसमें डी-सुपरहीटर्स, स्टीम रिसीवर , फौड हीटर और सैपरेटली फायर्ड हीटर्स जैसी फिटिंग्स को छोड़कर सभी फिटिंग्स शामिल होंगी । डी-सुपखीटर्स, स्टीम रिसीवर , सैपरेटर और फूसँग जैसी सभी फिटिंग्स के लिए सुल्क ऐसी समान फिटिंग्स की प्रत्येक श्रेणी हेतु 180/- चिका रुपये होगा ।

(ii ) स्टीम पाइपों की से आउट योजना हेतु जांच का शुल्क प्रति 30 मीटर पाइपिंग या उसके किस्से हेतु 30/- रुपये होगा ,जिस पर 60/- रुपने मयूराराम की शर्त लागू होगी और इसमें की-सुपरहीटर्स, स्टीम रिसीवर, फीड हीटर और सैपीटली फावर्ड सुपर हीटर्स जैसी फिटिंग्स को ओड़कर सभी फिटिंग्स समिती ही पक्षीटर्स, स्टीम रिसीवर, और सैपरेटर जैसी फिटिंगा के लिए शुल्क ऐसी प्रत्येक फिटिंग्स के लिए 180 /- रुपये होगा । 920

[PART I-SEC. 3 (1)] 7. उक्त रेगूलेशन में रेगूलेशन 395 ए में,

(i ) उप- रेगूलेशन (3 ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थातः

" ( 3 ) ट्यूब व पाईप के निरीक्षण के लिये, 180/-रुपये प्रति मीटरिक टन व उसके अंश की दर से शुल्क लगाई जायेगी। " (ii) उप- रेगूलेशन (6 ) के स्थान पर निम्नलिखित उप - रेगूलेशन प्रतिस्थापित किया जायेगा , अर्थात :-

" (6) फोर्ज पाईप फिटिंग के अतिरिक्त अन्य पाईप फिटिंग के लिये निम्नलिखित शुल्क लगाई जायेगी :-

60/-रुपये

(अ) 50 मि.मी. तक के, 100 कि. किग्रा या उसका अंशः

300/-रुपये

(ब) 50 मि.मी. से अधिक व 100 मि.मी. तक, 450 कि.ग्रा. या उसका अंश :

600/रुपये

(स) 100 मि.मी. से अधिक 900 कि. ग्राम या उसका अंशः

8. उक्त रेगूलेशन 395 मी के स्थान पर , निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात्:-

" 395 बी-पाइयों की निरीक्षण शुल्क:-

(अ) 100 मि.मी. नॉमीनल बोर से अधिक नहीं वाले पाईप , डी-सुपरहीटर्स, स्टीम रिसीवर, फीड हीटर और सैपरेटली फायर्ड सुपरहीटर जैसी फिटिंग्स के अतिरिक्त अन्य सभी फिटिंग्स सहित , 30 मीटर पाईप या उसके अंश के लिये, शुल्क 250/- रुपये देय होगी । (ब) 100 मि.मी. नॉमीनल बोर से अधिक वाले पाईप , डी- सुपरहीटर्स, स्टीम रिसीवर , फीड हीटर व सैपरेटली फायर्ड सुपर- हीटर के अतिरिक्त अन्य सभी फिटिंग्स सहित , 3 मीटर पाईप व उसके अंश के लिये, शुल्क 600/ -रुपये देय होगी ।

(स) फीड वाटर हीटर, डी- सुपरहीटर्स, स्टीम रिसीवर , सैपेरेटर व सैपरेटली फायर्ड सुपर हीटर जैसी फिटिंग्स के लिये , प्रत्येक ऐसी फिटिंग के लिये शुल्क 600/-रुपये देय होगी ।

9. उक्त रेगूलेशन में, रेगूलेशन 395 सी के स्थान पर. निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात्:-

" 395 सी वाल्व के निरीक्षण के लिये शुल्क वाल्व के निरीक्षण के लिए निम्न प्रकार से लगाई जायेगी:

(1 ) वाल्वों के प्रति निरीक्षण की शुल्क न्यूनतम 600 रुपये होते हुए, निरीक्षण शुल्क निम्न प्रकार से लगाई जायेगी:-

(अ) 25 मि.मी. तक

10 रुपये प्रति नग

30 रुपये प्रति नग

(ब) 25 मि.मी. से अधिक व 100 मि.मी. तक

(स) 100 मि.मी. से अधिक व 250 मि.मी. तक

180 रुपये प्रति नग

(द) 250 मि.मी. से अधिक

480 रुपये प्रति नग

(2) फ्लेजों की निरीक्षण शुल्क निम्न रूप से लगाई जायेगी:-

(i) फोर्ज व कास्ट फ्लेंज

150/- रुपये

(अ) 25 मि.मी. तक , 50 फ्लॅजों की खेप या उसके भाग के लिए

260/- रुपये

(आ) 25 मि.मी. तक , 100 फ्लेंजों की खेप या उसके भाग के लिए

290/-रुपये

(इ) 25 मि.मी. से अधिक व 50 मि.मी. तक 50 फ्लॅजों की खेप या उसके भाग के लिए

(ई) 50 मि.मी. से अधिक व 100 मि.मी. तक 25 फ्लेंजों की खेप या उसके भाग के लिए 290/- रुपये

(उ) 100 मि.मी. से अधिक व 250 मि.मी. तक 10 पलेंजों की खेप या उसके भाग के लिए 310/- रुपये

(ऊ ) 250 मि.मी. से अधिक 5 पलेंओं की खेप यां उसके भाग के लिए

360/-रुपये

(ii ) प्लेट फ्लॅज

शुल्क फोर्ज व कास्ट पलेंजों पर लगाये जाने वाले शुल्क से आधी दर पर लगाई आयेगी" ,

10. उक्त रेगूलेशन में, रेगूलेशन 395 जी के स्थान पर, निम्नलिखित प्रतिस्थापित किया जायेगा , अर्थात्:

"395 जी- स्पेयर व स्कैटरिंग की निरीक्षण शुल्क:-

(i ) स्पेयर- हर प्रकार की कॉयल, जैसे इकोनोमाइजर कॉयल, सुपरहीटर कॉयल , रीहीटर कॉयल , निरीक्षण शुल्क तल बेलफल के आधार पर रैगूलेशन 385 के अनुसार लगाई जायेगी । 921 [भाग 11- खण्ड 3( i ) ]

(2) स्कैंटलिंग- स्कैंटलिंग की निरीक्षण शुल्क निम्न प्रकार से लगाई जायेगी :- ::

(अ) बाह्य तल क्षेत्रफल 1 वर्ग मीटर से अधिक नहीं

600 रुपये

720रुपये

(आ ) बाह्य तल क्षेत्रफल 1 वर्ग मीटर से अधिक परन्तु 3 वर्ग मीटर से अधिक नहीं

840 रुपये

(इ ) बाह्य तल क्षेत्रफल 3 वर्ग मीटर से अधिक परन्तु 5 वर्ग मीटर से अधिक नहीं

1200 रुपये

( ई ) बाह्य तल क्षेत्रफल 5 वर्ग मीटर से अधिक परन्तु 7 वर्ग मीटर से अधिक नहीं

1440रुपये

(उ) बाह्य तल क्षेत्रफल 7 वर्ग मीटर से अधिक परन्तु 9 वर्ग मीटर से अधिक नहीं

1800 रुपये

(ऊ) बाह्य तल क्षेत्रफल 9 वर्ग मीटर से अधिक परन्तु 11 वर्ग मीटर से अधिक नहीं

बाह्य तल क्षेत्रफल 11 वर्ग मीटर से अधिक होने पर, प्रत्येक 2 वर्ग मीटर या उसके भाग के लिये , 60 रुपये शुल्क देय होगा जो अधिकतम 6000 रुपये तक सीमित होगा ।

11. उक्त रेगूलेशन में , विनियम 438 से 499 ( दोनों सम्मिलित ) तक हटा दिये जायेंगे ।

: 12. उक्त रेगूलेशन में , रेगूलेशन 533 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जायेगा , अर्थात्: -

533 पंजीकरण शुल्क- इकोनोमाइजर के पंजीकरण हेतु प्रार्थना पत्र के साथ नीचे दिये हुये के अनुसार उपयुक्त शुल्क देय होगी :-- इकोनोमाइजर रेटिंग 50 वर्ग मीटर से अधिक नहीं

600 रुपये

720रुपये

इकोनोमाइजर रेटिंग 50 वर्ग मीटर से अधिक परन्तु 100 वर्ग मीटर से अधिक नहीं

840 रुपये

इकोनोमाइजर रेटिंग 100 वर्ग मीटर से अधिक परन्तु 150 वर्ग मीटर से अधिक नहीं

960रुपये

इकोनोमाइज़र रेटिंग 150 वर्ग मीटर से अधिक परन्तु 200 वर्ग मीटर से अधिक नहीं

इकोनोमाइज़र रेटिंग 900 वर्ग मीटर से अधिक परन्तु 1000 वर्ग मीटर से अधिक नहीं

1000 से अधिक , प्रत्येक 200 वर्गमीटर या उसके अंश पर, 120 रुपये अतिरिक्त शुल्क लगाई जायेगी ।"

13. उक्त रेगूलेशन में , परिशिष्ट जे ए के पश्चात् निम्नलिखित परिशिष्ट जोड़ा जाएगा , अर्थात्:--

"परिशिष्ट जेबी

क. निरन्तर प्रक्रिया संयंत्र में विशेष रूप से प्रयोग किये जा रहे 50 कि.ग्रा. /वर्ग से.मी. तक के दबाव पर तथा 20 वर्ष की अवधि तक काम कर रहे वेस्ट हीट बॉयलर ( फायर्ड )/सह -बॉयलरों के लिए

(1) वेस्ट हीट बॉयलर (फायर्ड) /सह - बॉयलर , जो विशेष रूप से सतत् प्रक्रिया संयंत्र में 50 कि.ग्रा. /वर्ग से.मी. तक के दबाव पर तथा 20 वर्ष की अवधि तक कार्य कर रहे हैं, संबंधित राज्य के बॉयलर निरीक्षक द्वारा निरीक्षण तथा फिटनेस प्रमाण - पत्र दिये जाने की तारीख से 12 महीने की अवधि समाप्त हो जाने पर कार्यसाधक दबाव के समतुल्य दबाव पर हाइड्रोलिक परीक्षण के अधीन होंगे और नीचे दिये गये रिकाडों के अनुसार संचालन ( आपरेशन ) से सन्तुष्ट हो जाने की शर्त पर बॉयलर को आगे और 12 महीने की अवधि के लिए काम करने की अनुमति दी जासकती है:

(क) डेटा एक्वीजीशन सिस्टम (डीएएस ) के आउटपुट से सुपरहीटर और रीहीटर तापमान अनियमितताओं के लिए संचालन आंकड़े ।

[PART II-SEC. 3 (1) ] (ख) पिछले वर्षों के दौरान हुए शट डाउन का इतिहास उनके कारणों तथा की गई कार्रवाई के साथ ।

(ग) वर्ष के दौरान बॉयलर दाब हिस्सों पर किए गए किसी भी अविध्वंसक परीक्षण के रिकार्ड ।

(घ ) बॉयलर की जरूरत के अनुसार उसके लिए जल की गुणवत्ता बनाए रखी जाए और डेटा एक्वीजीशन सिस्टम (डीएएस ) के जरिए गुणवत्ता के आंकड़े ऑनलाइन उपलब्ध कराए जाएं ।

(ङ) बॉयलर की नली फेल होने के रिकार्ड ( स्थान , मरम्मत की गई/बदली गई नलियों की संख्या)

(2 ) चौबीस माह की अवधि समाप्त होने पर संबंधित बॉयलर निरीक्षक द्वारा निरीक्षण किया जाना चाहिए । तथापि, यदि सर्टिफिकेट प्रदान करने की अवधि के समाप्त होने से पहले और सर्टिफिकेट प्रदान करने के छः माह बाद किसी भी समय पंद्रह दिन अथवा उससे अधिक की अवधिके लिए शटडाउन की योजना बनाई गई है , तो ऐसे मामले में बॉयलर निरीक्षक को उचित रूप से सूचित किया जाना चाहिए , ताकि उक्त शटडाउन की अवधि के दौरान निरीक्षण की योजना बनाई जा सके ।

ख. विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किये गये 50 कि.ग्रा. /वर्ग से.मी. तक के दबाव पर कार्य करने वाले तथा 20 वर्ष से अधिक तक कार्य करने वाले वेस्ट हीट बॉयलर ( फायर्ड तथा अनफायर्ड ) सह बायॅलर

50 कि.ग्रा. /वर्ग से.मी. तक के दबाव पर तथा 20 वर्ष से भी अधिक से कार्य कर रहे बॉयलरों का बॉयलर निरीक्षक की सन्तुष्टि होने तक हर वर्ष पूर्ण निरीक्षण किया जाना जारी रहेगा । फिर भी भारतीय बॉयलर नियमावली, 1950 के उपबंधों के अनुसार यदि रेमनांट लाइफ असेसमेंट (आरएलए ) बॉयलरों पर किया जाता है तो उपर्युक्त पैराग्राफ ' क ' पर दी गई प्रक्रिया लागू होगी ।

ग. विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किये गये 50 कि.ग्रा./वर्ग से.मी. तक के दबाव और 20 वर्ष तक कार्य करने वाले वेस्ट हीट बॉयलर ( अनफायर्ड )

( 1) विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किंये गये वेस्ट हीट बॉयलरों का जो 50 कि.ग्रा./वर्ग से.मी. तक के दबाव पर तथा 20 वर्ष तक की अवधि से काम कर रहे हैं , पूर्ण निरीक्षण संबंधित राज्य में बॉयलर निरीक्षक द्वारा फिटनेस सर्टिफिकेट प्राप्त होने की तारीख से चौबीस माह की अवधि समाप्त होने पर कार्य करने वाले दबाव के समतुल्य दबाव पर हाइड्रोलिक परीक्षण किया जाना चाहिए और पैराग्राफ क में दिए गए संचालन रिकार्ड से सन्तुष्ट हो जाने पर , उन्हें आगे बारह माह की अवधि तक और काम करने की अनुमति प्रदान की जानी चाहिए ।

(2 ) चौबीस माह की अवधि समाप्त होने पर संबंधित बॉयलर निरीक्षक द्वारा निरीक्षण किया जाना चाहिए । तथापि , यदि सर्टिफिकेट प्रदान करने की अवधि के समाप्त होने के पहले और सर्टिफिकेट प्रदान करने के छः माह बाद किसी भी समय पंद्रह दिन अथवा उससे अधिक की अवधि के लिए शटडाउन की योजना बनाई गई है , तो बॉयलर निरीक्षक को इसकी उचित रूप से सूचना दी जानी चाहिए , ताकि उक्त शटडाउन की अवधि के दौरान निरीक्षण की योजना बनाई जा सके ।

( घ ) विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किये गये 50 कि.ग्रा./वर्ग से.मी. से अधिक दबाव पर तथा 20 वर्ष तक कार्य करने वाले केप्टिव बॉयलर/वेस्ट हीट बॉयलर ( फायर्ड )/एचआरएसजीएस

( 1 ) विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किये गये उप केप्टिव बॉयलर वेस्ट हीट बॉयलर ( फायर्ड )/एचआरएसजीएस , जो 50 कि.ग्रा. / वर्ग से. मी. अथवा इससे अधिक दबाव पर और 20 वर्ष से कार्य कर रहे हैं का निरीक्षण राज्य में संबंधित बॉयलर निरीक्षक द्वारा पूर्ण निरीक्षण की तारीख से बारह महीने की अवधि के समाप्त होने के बाद निम्नानुसार विवरण के अनुसार किया जायेगा और निम्नलिखित रिकार्ड की जांच के जरिये फिटनेस प्रमाण- पत्र जारी किया जायेगा जो संचालन प्रमाण- पत्र की समाप्ति से कम से कम 30 दिन पूर्व बॉयलर के निरीक्षक को उपलब्ध कराया जायेगा बशर्ते वह इस बात से सन्तुष्ट है कि बॉयलर को आगे और 12 महीने की अवधि के लिए प्रयोग किये जाने की अनुमति दी जा सकती है ।

(ख ) पिछले वर्षों के दौरान हुए शट डाउन का इतिहास उनके कारणों तथा की गई कार्रवाई के साथ ।

(ग ) वर्ष के दौरान बॉयलर दाब हिस्सों पर किए गए किसी भी अविध्वंसक परीक्षण के रिकार्ड ।

( घ) बॉयलर की जरूरत के अनुसार उसके लिए बल की गुणवत्ता बनाए रखी जाए और डेटा एक्वीजीशन सिस्टम (डीएएस ) के जरिए गुणवत्ता के आंकड़े ऑनलाइन उपलब्ध कराए जाएं ।

(ङ) बॉयलर की नली फेल होने के रिकार्ड (स्थान , मरम्मत की गई/बदली गई नलियों की संख्या )

(2) विनियम 390 की व्यवस्था के अनुसार 24 महीनों की अवधि समाप्त हो जाने पर बॉयलरों के निरीक्षक द्वारा निरीक्षण किया जायेगा । फिर भी , यदि सर्टिफिकेट प्रदान करने की अवधि के समाप्त होने से पहले और सर्टिफिकेट प्रदान किये जाने के 6 माह बाद किसी भी समय 923 भारत का राजपत्र अगस्त 12, 2006/ श्रावण 21 , 1928

15 दिन अथवा उससे अधिक की अवधि के लिए शट डाउन की योजना बनाई गई है तो ऐसे मामले में बॉयलर निरीक्षक के उचित रूप से सूचित किया जाना चाहिए ताकि उक्त शट डाउन की अवधि के दौरान पूर्ण निरीक्षण की योजना बनाई जा सके ।

(ङ ) विशेष रूप से सतत् प्रक्रिया संयंत्र में प्रयोग किये गये 50 कि.ग्रा. वर्ग से.मी. से अधिक दबाव पर तथा 20 वर्ष से भी ज्यादा अवधि से कार्य करने वाले केप्टिव बॉयलर/बेस्ट हीट बॉयलर ( फायर्ड )/एचआरएसजीएस

50 कि.ग्रा. /वर्ग से.मी. से भी अधिक दबाव पर तथा 20 वर्ष की अवधि से ज्यादा अवधि से कार्य करने वाले बॉयलरों का प्रत्येक वर्ष बॉयलर निरीक्षक की संतुष्टि के अनुसार निरीक्षण किया जाना जारी रहेगा । फिर भी , यदि भारतीय बॉयलर नियमावली, 1950 के उपबंधों के अनुसार यदि रेमनांट लाइफ असेसमेंट ( आरएलए) बॉयलरों पर किया जाता है तो उपर्युक्त पैराग्राफ ' क ' पर दी गई प्रक्रिया लागू होगी ।

G.S.R. 200.- The following draft of certain regulations further to amend the Indian Boiler Regulations , 1950, which the Central Boilers Board proposes to make in exercise ofthe powers conferred by Section 28 of the Indian Boilers Act, 1923 ( 5 of 1923) , is hereby published, as required by sub - section ( 1) of Section 31 ofthe said Act, for the information ofall persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after the expiry of a period of forty - five days from the date the Gazette containing the publication of this notification is made available to the public.

2. Any objections or suggestions which may be received from any person with respect to the said draft within the period so specified will be considered by the Central Boilers Board.

3. Objections or suggestions, if any, may be addressed to the Secretary, Central Doilers Doard, Ministry of Commerce and Industry (Department of Industrial Policy and Promotion), Udyog Bhavan , New Delhi - 110011 ,

DRAFT REGULATIONS

1. (1 ) These rules may be called the Indian Boiler ( Second Amendment ) Regulations , 2006.

(2) They shall come into force after final publication in the Official Gazette.

2. In the Indian Boiler Regulations, 1950 (hereinafter referred to as the said regulations) , in regulation 376, after clause (ff) the following clause shall be inserted, namely :-

"( fff) For Captive Boilers and Waste Heat Boilers (Fired and Unfired) used exclusively in continuous process plants, the inspection shall be carried out in accordance with the provisions of Appendix JB. The boilers used in corrosive environment such as Sulphuric acid plants shall not be covered under the provisions of Appendix JB. " .

3. In the said regulations , in regulation 377 , after clause (b ), the following clause shall be inserted, namely :-

"(c) Captive Boilers and Waste Heat Boilers (Fired and Unfired) used exclusively in continuous process plants need not be hydraulically tested for issue of certificate every year. "

Provided that the inspection of such boilers is carried out as per the provisions of regulation 376.

4. In the said regulations, in Form XIX, for the words and letters " DETAILS TO BE FURNISHED ALONGWITH APPLICATION FOR INSPECTION OF BOILER AFTER TWELVE MONTHS OF THE CERTIFICATION UNDER APPENDIX 'JA' , the words and letters " Details to be furnished alongwith application for Inspection of Boiler after twelve months of the certificationunder Appendix JA and Appendix JB " shall be substituted;"

5. In the said regulations , in regulation 385, the following regulation shall be substituted, namely :-

" 385 Registration fee . The required fee to accompany an application under sub- section ( 1) of Section 7 ofthe Actshall be :-

6. In the said regulations , in regulation 395, for clause (b) , the following clause shall be substituted, namely :-

(b) ( i) The fees for examination of plans and the particulars of materials, design and construction of steam pipes before the commencement ofmanufacture of the steam pipes shall be at the rate ofRs . 40/- for 30 meters of piping or part thereof, subject to a minimum of Rs . 60/-, inclusive of all fittings excepting the fittings like de-superheaters , steam receivers, feedheaters and separately fired superheaters . For any fittings like de-superheaters, steam receivers separators and flanges, the fee shall be Rs . 180/- for each category of such identical fittings.

(ii) The fees for examination of lay out plans of steam pipes shall be Rs . 30/- per 30 metres ofpiping or part thereof, subject to a minimum ofRs . 60/-, inclusive ofall fittings , except fittings like de-superheaters steam receivers, feed heaters and separately fired superheaters . For any fittings like de-superheaters , steam receivers and separators , the fee shall be Rs . 180/- for each such fittings;

7. In the said regulations, in regulation 395 A,-

(1) for sub -regulation (3 ) , the following sub -regulation shall be substituted, namely:-

"(3) For inspection of tubes and pipes , the fee shall be charged at the rate of Rs. 180/- per metric tonne or a fraction thereof.";

(ii) for sub-regulation (6) , the following sub-regulation shall be substituted, namely:

(6) For inspection ofpipe fittings other than forged pipe fittings, the fees shall be charged as under:-

(a) up to and including 50mm, for 100 kg. or a fraction thereof: Rs .60/-

(b) over 50mm and up to and including 100mm for 450 kg. or fraction thereof: Rs. 300/-

8. In the said regulations, for regulation 395 B, the following regulation shall be substituted, namely:-

"395B Fees for inspection ofpipes.

[PART II -SEC . 3(i)] (a) for the pipes of nominal bore not exceeding 100mm inclusive of all fittings excepting fittings like de-superheaters , steam-receivers , feed heaters and separately fired super-heaters Rs.250/- for 30 metres of pipes or part thereof;

(b) for pipes of nominal bore exceeding 100mm inclusive of all fittings excepting fittings like desuperheaters, steam receivers , feed heaters and separately fired superheaters Rs.600/- for 30 metres or part thereof, (c) fee for inspection of fittings like feed water heater , de - superheater, steam receiver, separators and separately fired superheaters Rs.600/- for each such fitting" ;

9. Inthe said regulations, for regulation 395 C, the following regulation shall be substituted, namely :---

"395 C Fee for inspection of valves-Fees for inspection of valves shall be charged as under :-

(1) Subject to a minimum inspection fee of Rs.600/- per inspection for the valves , the inspection fee shall be charged as under:---

(a) upto25mm

Rs.10 per piece

(b) above 25mm and upto 100mm

Rs.30 perpiece

Rs . 180 per piece

(d) above 250mm

Rs.480 per piece

(2) Fees for inspection of flanges shall be charged as under:-

(i) for forged and cast flanges :

Rs. 150

(a) upto and including 25mm for a batch of 50 or part thereof:

Rs. 260

(b) upto and including 25mm for a batch of 100 or part thereof:

Rs. 290

Rs.290

(d) over 50mm upto and including 100mm for a batch of25 or part thereof:

Rs. 310

(e) over 100mm upto and including 250mm for a batch of 10 orpart thereof:

(f) over250mm for a batch of 5 or part thereof:

The fees shall be charged at half the rate as charged for forged and cast flanges . " ;

10. In the said regulations , for regulation 395 G , the following regulation shall be substituted , namely:---

"395 G. Fee for inspection of spares and scantlings:

(1) Spares- For all types of coils , namely, economiser coils, superheater coils, reheater coils, the fee for inspection shall be charged on the basis of surface area as provided in Regulation 385 .

(ii) Scantlings - The fee for inspection of scantlings shall be charged as under :-

Rs.600

(a) for outside surface area not exceeding 1 sq . metre

Rs . 720

(b) for outside surface area exceeding 1 sq . metre but not exceeding 3 sq . metres

Rs.840

Rs. 1200

(d) for OSA exceeding 5 sq. metres but not exceeding 7sq. metres

Rs. 1440

(e) for OSA exceeding 7 sq. metres but not exceeding 9 sq. metres

Rs.1800

For outside surface area exceeding 11 sq. metres a fee of Rs.60 shall be charged for every 2 sq . metres or part thereofsubject to a maximum ofRs . 6000";

11. In the said regulations, the regulations 438 to 499 (both inclusive) shall be omitted.

12. In the said regulations, for regulation 533 , the following regulation shall be substituted, namely :-

"533.Registration fee-An application for registration ofEconomiser shall be accompanied by appropriate fee as specified below :-

For economiser rating not exceeding 50 sq. mtrs Rs . 600

Foreconomiser rating exceeding 50 sq. mtrs but not exceeding 100 sq . mtrs Rs . 720

Foreconomiser rating exceeding 100 sq. mtrs but not exceeding 150 sq. intrs Rs . 840

For economiser rating exceeding 150 sq. mtrs but not exceeding 200 sq . mtrs Rs . 960

13. In the said regulations, after Appendix JA, the following Appendix shall be inserted, namely:

"APPENDIX JB

[Seeregulation 376 ( fff)]

A WasteHeatBoilers (Fired)/CO- Boilers working at a pressure upto 50 Kgs./sq . cm & upto 20 years ofage used exclusively in continuous processplant.

(1) For Waste Heat Boilers (Fired)/CO-Boilers working at a pressure upto 50 Kgs./sq.cm & upto 20 years of age used exclusively in continuous process plant shall be subjected to Hydraulic Test at pressure equivalent to the working pressure at the expiry of twelve months from the date of inspection and certification of fitness by the concerned Inspector ofBoilers in the State, and having satisfied with the operation records as given below, shall be allowed for running for another period oftwelve months:

(a) Operation data for superheater and reheater temperature excursions from the output of Data Acquisition System(DAS) .

(b) History of shut downs during the previous year with their causes and actions taken.

(d) Water quality to the boiler is maintained as per the requirement of such boilers and on line data ofthe quality be provided through Data Acquisition System (DAS) .

(e) Boiler tube failure record (location , number oftubes repaired/replaced).

(2) Inspection shall be carried out by the concerned Inspector of Boilers at the expiry of twenty-four months. However, if shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months ofthe certification, Inspector ofBoilers shall be duly informed so that inspection can be scheduled during the said shut down period.

Boiler working at a pressure up to 50 kg/ cm² and more than 20 years of age shall continue to be subjected to full inspection every year to the satisfaction of Boiler Inspector . However, if Remnant Life Assessment (RLA) as per the provisions of Indian Boiler Regulations, 1950 is carried out on the boiler, than procedure as given at paragraph ' A' above would be applicable..

C WasteHeat Boilers (Unfired) working at a pressure upto 50 Kgs./sq.cm & up to 20 years ofage used exclusively incontinuous process plant.

(1) For Waste Heat Boilers (Unfired) working at a pressure upto 50 Kgs./sq.cm & upto 20 years of age used exclusively in continuous process plant shall be subjected to Hydraulic Test at pressure equivalent to the working pressure at the expiry of twenty four months from the date of full inspection and certification of fitness by the concerned Inspector ofBoilers in the State , and having satisfied with the operation records as at paragraph A, shall be allowed for running for another period of twelve months:

(2) Inspection shall be carried out by the concerned Inspector of Boilers at the expiry of twenty- four months .

However, if shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months of the certification, Inspector ofBoilers shall be duly informed so that inspection can be scheduled during the said shutdown period.

D. CaptiveBoilers/Waste Heat Boilers (Fired)/HRSGs working at a pressure more than 50 Kgs./sq.cm & upto20 years of age used exclusively in continuous process plant.

(1) The Captive Boilers/Waste Heat Boilers (Fired) /HRSGs working at a pressure 50 kg/cm² or more and up to 20 years of age, used exclusively in continuous process plant shall be inspected as detailed below after the expiry of twelve months from the date of full inspection and certification of fitness shall be issued by the concerned Inspector of Boilers in State, through inspection of the following records which shall be made available to the Inspector of Roilers at least thirty days before the expiry of the operating certificate, provided he is satisfied that the boiler can be allowed to be operated for a further period oftwelve montis.

(a) Operation data for superheater and reheater temperature excursions from the output of Data Acquisition System (DAS) .

(b) History of shut downs during the previous year with their causes and actions taken.

(d) Water quality to the boiler is maintained as per the requirement of such boilers and on line data of the quality be provided through Data Acquisition System (DAS ).

(2) Inspection shall be carried out by the Inspector of Boilers at the expiry of twenty four months as provided in regulation 390. However, in case shutdown of fifteen days or more is planned any time before expiry of the certification periodand after six months of the certification , the Inspector of Boilers shall be duly informed so that complete inspection canbe scheduled during the said shut down period.

E. CaptiveBoilers/Waste Heat Boilers (Fired)/HRSGs working at a pressure more than 50 Kgs. /sq.cm & more than20 years of age used exclusively in continuous process plant.

Boiler working at a pressure of more than 50 kg/ cm² and more than 20 years of age shall continue to be subjectedto inspection every year to the satisfaction of Boiler Inspector. However, if Remnant Life Assessment (RLA) as per the provisions of Indian Boiler Regulations , 1950 is carried out on the boiler, than procedure as given at paragraph ' A' above wouldbe applicable. सा.का. नि. 201.-यतः वाणिज्य और उद्योग मंत्रालय (केन्द्रीय बायलर बोर्ड) भारत सरकार के दिनांक 10 अप्रैल , 2006 की अधिसूचना संख्या सा. का. नि. 81 के साथ इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव , उक्त राजपत्र अधिसूचना की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने से पहले मांगने के लिए भारतीय बॉयलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 31 की उप- धारा ( 1 ) जो दिनांक 15 अप्रैल , 2006 के भारत के राजपत्र के भाग II , खंड 3 , उपखंड ( i ) में है , द्वारा यथा अपेक्षित भारतीय बॉयलर अधिनियम , 1950 में और संशोधन करने के लिए कुछ विनियमों के मसौदे प्रकाशित किये गये थे;

और जबकि उक्त राजपत्र की प्रतियां आम जनता को 4 मई, 2006 को उपलब्ध करा दी गयी थी; 23305706-4 930

[PART II-SEC. 3 (i)] नहीं हुए थे ; और जबकि उक्त मसौदे में विनिर्दिष्ट अवधि के भीतर किसी भी व्यक्ति से ऐसे मसौदों के संबंध में कोई आपत्तियां अथवा सुझाव प्राप्त अतः अब भारतीय बॉयलर अधिनियम, 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बायलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय बॉयलर बोर्ड एतद्वारा भारतीय बॉयलर अधिनियम , 1950 मे आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है , नामतः :-

1. ( 1 ) इन विनियमों को भारतीय बॉयलर ( द्वितीय संशोधन ) विनियम , 2006 कहा जायेगा ।

(2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बॉयलर विनियम , 1950 ( जिन्हें इसमें इसके पश्चात् उक्त विनियम कहा गया है ) , के विनियम 4 , खंड (ग ) में उपखंड (vi ) के बाद निम्नलिखित उप-खंड को सम्मिलित किया जायेगा , नामतः:

" ( vii ) ऐसे बॉयलरों के लिए जिनकी क्षमता 20 टन प्रति घंटा और अधिक है जिन्हें स्थापना स्थल पर ही संयोजित किया जाना है, के लिए मढ़ाई की आपूर्ति अलग से की जाए । 20 टन प्रति घंटा से कम क्षमता के सभी बॉयलरों के साथ बॉयलरों के विनिर्माण के समय फार्म 111 में उल्लिखित विवरण सहित संबंधित फार्मों में जारी किए गए मढ़ाई ( माउंटिंग ) अथवा फिटिंग के सभी प्रमाण- पत्र होंगे । " 3. उक्त विनियमों में विनियम 4 घ में , " तीन वर्ष " शब्दों के स्थान पर " पांच वर्ष " शब्द प्रतिस्थापित किए जायेंगे । 2. उक्त विनियमों में विनियम 154 में , खंड ( क ) के उपखंड ( i ) में अंत में निम्नलिखित टिप्पणी सम्मिलित की जायेगी, नामत :

" टिप्पणी. कार्बन स्टील सामग्री जिसमें कार्बन का अंश अधिकतम 0.25 % है के लिए हैडर के साथ वैल्ड की गयी ट्यूबों के संबंध में पोस्ट वैल्ड हीट ट्रीटमेंन्ट की आवश्यकता अनिवार्य नहीं है, बशर्ते कि निम्नलिखित शर्तें पूरी की गई हों, नामतः :

(क ) ट्यूब का बाहरी व्यास ( ओडी ) 51 मि.मी. से अधिक न हों :

(ख ) हैडर का बाहरी व्यास 219.1 मि.मी. से अधिक न हो:

(ग ) हैडर की मोटाई 13 मि.मी. से अधिक न हो :

(घ ) न्यूनतम 100° से. पूर्व ताप का अनुप्रयोग किया गया हो । "

3. उक्त विनियमों में विनियम 166 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जायेगा नामतः:-

" आंतरिक द्वार: - आंतरिक द्वार अध्याय II के अनुसार पिटवां इस्पात के होंगे और निम्नलिखित के अनुसार निर्मित होंगे :-

(क) द्वारों को आंतरिक जोड़ पर निकटता से जोड़ने के लिए तैयार किया जायेगा और इनमें स्टड , नट तथा क्रासबार लगे होने चाहिए , (ख ) 250 मि.मी. से अधिक के गोलाकार स्थान अथवा 250 मि.मी. x 175 मि.मी. से बड़े अंडाकार आयताकार स्थान के द्वारों में दो स्टड किन्तु 250 मि.मी. x 170 मि.मी. अथवा इससे कम स्थान के द्वारों में केवल एक स्टड लगाया जायेगा । 123 मि.मी. x 90 मि.मी. तक के स्थानों के द्वारों पर द्वार के साथ गढ़े गए स्टड होंगे ,

( ग ) द्वारों के स्टड वैल्डिंग योग्य इस्पात के होंगे जिनकी न्यूनतम विनिर्दिष्ट तनाव शक्ति 360 एन/ एमएम से कम नहीं होगी और मेनहोल के लिए 30 मि.मी. से कम नहीं होगी ,"

इन्हें निम्नलिखित में से किसी एक प्रकार से लगाया जायेगा:-

( i ) प्लेट में पेंच कसा जायेगा तथा अंदर फिलेट पर वैल्डिंग की जायेगी ,

(ii ) प्लेट के दोनों तरफ फिलेट.पर वैल्डिंग की जायेगी जिसकी लंम्बाई 10 मि.मी. से कम नहीं होगी ,

(iii ) द्वार पर एक मध्यस्थ प्लेट अथवा प्लग जुड़ा होगा ताकि अटैचमेंट की शक्ति स्टड की शक्ति से कम न हो और स्टड को मोड़ने से बचाया जा सके , अथवा

(iv ) एक एकीकृत कोलर उपलब्ध कराया जायेगा तथा द्वार की प्लेट पर रिवट अथवा पेंच कसा जायेगा और इसे मोड़ने से बचाया जायेगा और इस स्थिति में अटैचमेंट की शक्ति स्टड की शक्ति से कम नहीं होगी

(घ ) जब द्वार केन्द्रीय स्थिति में होगा तब द्वार की डाट सब तरफ से लगभग 105 मि.मी. निर्बाध होगी और किसी भी स्थान पर निर्बाधता 3 मि.मी. से अधिक नहीं होगी । डाट की गहराई गेस्केट को फंसाने के लिए पर्याप्त होगी ,

(ङ) नट उपयुक्त सामग्री से बनाये जाएंगे जो बौल्टों की सामग्री के अनुरूप हों और उन्हें सीटिंग सर्फेस पर लगाया जाएगा, (च) क्रास बारें उपयुक्त अनुपातों की होंगी और वे नरम या रौट स्टील की होंगी

नोट: - स्टड के बजाय डोर प्लेट पर उपयुक्त लेग के आई वोल्ट या डोर प्लेट पर छिद्रयुक्त भागों से जुड़ने वाले हैडेड बोल्ट प्रयोग किए . जा सकते हैं । 931 भारत का राजपत्र अगस्त 12, 2006/ श्रावण 21, 1928

7. उक्त विनियमों में, विनियम 278 के पश्चात् निम्नलिखित विनियम डाला जाएगा , नामतः

नोट : 300°C या इससे कम डिजाइन तापमान के लिए कार्बन स्टील के बोल्टों हेतु 50 N/मि.मी. मान का डिजाइन तनाव प्रयोग किया जाए । 8. उक्तविनियमों में विनियम 337 में उपविनियम ( जी ) के बाद निम्नलिखित उप नियम सम्मिलित किया जायेगा:

" (एच ) ट्यूबों की फाइनिंग निरीक्षण प्राधिकारी द्वारा विधिवत् रूप से अनुमोदित किसी भी पद्धति द्वारा और तत्पश्चात् उनके द्वारा निरीक्षण की गई तथा प्रमाणित की गई स्वीकार की जायेगी " ।

9. उक्त विनियमों में विनियम 385 में अंत में निम्नलिखित को जोड़ा जाएगा, नामतः:-

" सुपर हीटर , री हीटर तथा फीड वॉटर हीटर के लिए निरीक्षण शुल्क, रजिस्ट्रेशन फीस के अनुसार उसी दर पर किया जायेगा । सुपर हीटर तथा री हीटर का सफेंस एरिया केवल फीस लेने के प्रयोजनार्थ बॉयलर के सर्फेस क्षेत्र में शामिल किया जायेगा " । 10. उक्त विनियमों में विनियम 392 में खण्ड ( पी ) के बाद निम्नलिखित धारा शामिल की जायेगी, नामतः:-

"रिपेयरकर्ताओं का वर्गीकरण ।

(i) III वर्ग < 17.5 कि.ग्रा. /सें.मी. 2 बॉयलर प्रेशर

( ii) II वर्ग > 17.5 कि.ग्रा. /सें.मी. 2 < 40 कि.ग्रा. /सें.मी. 2 तक बॉयलर प्रेशर

11. उक्त विनियमों में विनियम 554 के लिए निम्नलिखित विनियम से प्रतिस्थापित किया जायेगा, नामतः :-

" मेनहोल फ्रेम्स, माउथपीसिज तथा डोर्स- मेनहोल फ्रेम्स, माउथपीसिज तथा डोर्स अथवा कवर प्लेट माइल्ड स्टील की होंगी । फ्रेम अण्डाकार होंगे और जहां शैल के पास बेड तक फ्लेंज्ड टाइप बनाया जायेगा और डोर तक फ्लैट ज्वायंटिंग सर्फेस प्रदान की जायेगी । परिवर्तन के रूप में उभरे हुए (रेजड ) माउथपीसिज को बाहर लगाया जा सकता है और जहां फ्लेंज्ड टाइप शैल के पास बेडिड होगी । जहां व्यवहार्य हो फ्रेम शैल के अन्दर की ओर छोटे समानांतर एक्सेस से बॉयलर की लोंगीट्यूडनल सेंटर लाइन तक लगाया जायेगा । सभी मामलों में जहां शैल की मोटाई 9/16 इंच से अधिक है अंडाकार फ्रेम अथवा सर्कुलर माउथपीसिज फिट किये जाएंगे । अण्डाकार फ्रेम्स अथवा बाहरी उभरे हुए माउथपीसिज निम्न में से कोई एक होंगे :-

(क) वेल्ड के बिना एक पीस में बना हुआ ।

( ख) उपयुक्त रोल्ड सेक्शन तथा फोर्ज वेल्डिड अथवा फ्यूजन वेल्डिग द्वारा फेब्रिकेटिड से बना हुआ बशर्ते वे वेल्डिंग के बाद हीट ट्रीटमेंट द्वारा स्ट्रेस मुक्त तथा बॉयलर को लगाने से पूर्व जब तक कि पूरा होने पर पूरा बॉयलर हीट ट्रीटमेंट से संबंधित होगा ।

वेल्ड इस प्रकार बैठाए जाने चाहिएं, ताकि वे बॉयलर की आड़े किनारे की केन्द्रीय रेखा पर आ सकें ( देखें विनियम 556 ) । माउथपीसों और कंवरों के जोड़ने वाले कोर बोल्टों के सामने वाले भाग , उनके किनारों तथा बियरिंग सर्फेस पर लगाए जाने चाहिएं । बोल्ट और नट लगाए जाने चाहिएं जिनमें कोरों के विकृत होने की संभावना से बचने की दृष्टि से बोल्टों की पिच लाइन अथवा पिच सर्कल के अन्दर तथा बाहर कोरों तथा जोड़ों को आपस में मिला देना चाहिए । कवर प्लेटों को फ्रेम के आन्तरिक व्यास के लगभग 1/8 भाग की गहराई तक बाहर की ओर लगाया जाना चाहिए ।

सभी किनारों पर मशीन चलाई जानी चाहिए अथवा मशीन से उन्हें फ्रेम- कट किया जाना चाहिए ( देखें विनियम 541 ) । फार्म अथवा मैनहोल फ्रेम एवं सम्बद्ध सामग्री चित्र XII/52, XII/ 53 , XII / 54, XII/55 और XII/56 में दिखाए गए हैं ।

12. उक्तविनियमों में विनियम 554 के बाद निम्नलिखित विनियम शामिल किए जाने चाहिएं, नामतः :-

" 554क " आंतरिक द्वार:- आंतरिक द्वार अध्याय II के अनुसार पिटवां इस्पात के होंगे और निम्नलिखित के अनुसार निर्मित होंगे :-

( क ) द्वारों को आंतरिक जोड़ पर निकटता से जोड़ने के लिए तैयार किया जायेगा और इनमें स्टड , नट तथा क्रासबार लगे होने चाहिएं; (ख) 250 मि.मी. से अधिक के गोलाकार स्थान अथवा 250 मि.मी. 175 मि.मी. से बड़े अंडाकार/ आयताकार स्थान के द्वारों में दो स्टड किन्तु 250 मि.मी. × 170 मि.मी. अथवा इससे कम स्थान के द्वारों में केवल एक स्टड लगाया जायेगा । 123 मि.मी. × 90 मि.मी. तक के स्थानों के द्वारों पर द्वार के साथ गढ़े गए स्टड होंगे ;

( ग ) द्वारों के स्टड वैल्डिंग योग्य इस्पात के होंगे जिनकी न्यूनतम विनिर्दिष्ट तनाव शक्ति 360 एन /एमएम' से कम नहीं होगी और मेनहोल के लिए 30 मि.मी. से कम नहीं होगी;

इन्हें निम्नलिखित में से किसी एक प्रकार से लगाया जायेगा : -

(ix) प्लेट में पेच कसा जायेगा तथा अंदर फिलेट पर वैल्डिंग की जायेगी;

(x) प्लेट के दोनों तरफ फिलेट पर वैल्डिंग की जायेगी जिसकी लंबाई 10 मि.मी. से कम नहीं होगी;

(xi ) द्वार पर एक मध्यस्थ प्लेट अथवा प्लग जुड़ा होगा ताकि अटैचमेंट की शक्ति स्टड की शक्ति से कम न हो और स्टड को मोड़ने से बचाया जा सके; अथवा

( xii ) एक एकीकृत कोलर उपलब्ध कराया जायेगा तथा द्वार की प्लेट पर रिवट अथवा पेच कसा जायेगा और इसे मोड़ने से बचाया जायेगा और इस स्थिति में अटैचमेंट की शक्ति स्टड की शक्ति से कम नहीं होगी ।

( घ) जब द्वार केन्द्रीय स्थिति में होगा तब द्वार की डाट सब तरफ से लगभग 105 मि.मी. निर्बाध होगी और किसी भी स्थान पर निर्बाधता 3 मि.मी. से अधिक नहीं होगी । डाट की गहराई गेस्केट को फंसाने के लिए पर्याप्त होगी;

(ङ) नट उपयुक्त सामग्री से बनाये जाएंगे जो बोल्टों की सामग्री के अनुरूप हों और उन्हें सीटिंग सर्फेस पर लगाया जाएगा , (च ) क्रास बारें उपयुक्तं अनुपातों की होंगी और वे नरम या रौट स्टील की होंगी ।

नोट : स्टड के बजाय डोर प्लेट पर उपयुक्त लेग के आई वोल्ट या डोर प्लेट पर छिद्रयुक्त भागों से जुड़ने वाले हैडेड बोल्ट प्रयोग किए जा सकते हैं ।

G.S.R. 201.-Whereas the draft regulations further to amend the Indian Boiler Regulations , 1950 were published, asrequiredby Sub - section ( 1 ) of Section 31 of the Indian Boilers Act, 1923 ( 5 of 1923 ) , in Part II , Section 3 , Sub-section (i) oftheGazette of India dated the 15th April, 2006, vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) (Central Boilers Board) , number G.S.R. 81 ,dated the 10th April , 2006 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period offorty- five days from the date on which the copies of the said Gazette notification were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 4th May, 2006;

And whereas no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

Now, therefore , in exercise of the powers conferred by section 28 of the Indian Boilers Act, 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , nameley:-

1. (1 ) These regulations may be called the Indian Boiler ( Second Amendment) Regulations , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2.In the Indian Boiler Regulations , 1950 (hereinafter referred to as the said regulations) , in regulation 4, in clause (c) , after sub - clause ( vi ), the following sub - clause shall be inserted, namely: -

" (vii ) For such boilers having a capacity of 20 Tons per hour and above which are required to be assembled at site, the mountings may be supplied separately. All boilers of capacity less than 20 Tons per hour shall carry all the 937 [भाग II- खण्ड 3(i)]

mountings or fittings certificates in respective forms with details mentioned in Form III, issued at the time ofmanufacture ofboilers .";

3.Inthe said regulations , in regulation 4D, for the words " three years " , the words "five years " shall be substituted.

4. In the said regulations , in regulation 154, in sub-clause ( i) of clause ( a), the following Note shall be inserted at the end , namely:-

"Note : For Carbon Steel material having a maximum Carbon content of 0.25 % , the Post held Heat Treatment requirement for tubes weided to Header is not mandatory when all the following conditions are fulfilled, namely:-- (a) The outer diameter (OD) of tubes is not more than 51 MM;

(b) The outer diameter of the Header is not inore than 219.1 MM;

(d) A minimum pre-heat of 100 °C is applied.";

5. In the said regulations, for regulation 166 , the following regulation shall be substituted, namely:-

" Internal doors : Internal doors shall be of wrought steel in accordance with Chapter II and constructed in accordance with the following:--

(a) doors shall be formed to fit closely to the internal joint surface and should be fitted with studs , nuts and crossbars;

(b) doors for circular opening larger than 250mm or elliptical /rectangular opening larger than 250mm × 175mm shall have two studs but for opening of 250mm × 170mm or less only one stud may be fitted. Doors for opening not larger than 123mm× 90mm inay have the stud forged integrally with door;

(c) doors studs shall be of welding quality steel having a minimum specified tensile strength of not less than 360N/mm² and those for nanholes shall be not less than 30mm;

They shall be fixed in any ofthe following way:--

(1) screwed through the plate and fillet welded on inside;

(2) fillet welded each side of the plate with a leg length of not less than 10mm;

(3) attached to the door by an intermediate plate or lugs so that the strength of the attachment is not less than the strength of the studs and the studs are prevented from turning ; or

(4) provided with an integrated collar and be riveted or screwed onto the door plate and be prevented from turning in which case the strength of the attachment shall be not less than the strength of the studs ;

(d) door spigot when the door is in the central position shall have a clearance of approximately 105mm all around and at no point shall the clearance exceed 3mm . The spigot depth shall be sufficient to trap the gasket; ' (e) the nuts shall be of appropriate material compatible to that of bolts and be placed on the seating surface ;

(f) the cross -bars shall be of substantial proportions and of mild or wrought steel .

Note : Eye bolts of suitable legs on the door plate or headed bolts engaging with slotted sections on the door plate may be sued instead of studs .

The minimum calculated thickness of the door of the flat plat construction (i.e. unstiffened made froin one plate shall be not less than that determined by the following formula :-

7. In the said regulations , after regulation 278 , the following regulation shall be inserted, namely:-

8. In the said regualtions , in regulation 337 , after sub -regulation (g ), the following sub regulation shall be inserted, namely:-

" (h ) The finning of the tubes by any method duly approved by the Inspecting Authority and subsequently inspected and certified by them shall be accepted. ".

9. In the said regulations , in regulation 385 , the following shall be added at the end, namely :-

" Inspection fee for Super-heater, Re -heater and Feed water heater shall be charged at the same rate as the registration fee .

The surface area of Super heater and Re -heater shall be included in the surface area ofthe Boiler for the pupose of charging the fee only. " ;

10. In the said regulations , in regulation 392, after clause (p) , the following clause shall be inserted, namely :---

" (q) Categorisation of the Repairers .

The categorisation of the Repairer shall be as follows :

(i) IIIrd class < Boiler Pressure 17.5kg/ cm²

(ii) IInd class > Boiler Pressure 17.5kg/ cm² to < 40kg/cm²

(iii) Ist class > Boiler Pressure 40kg/ cm² to < 100kg/ cm²

(iv) Special class > Boiler Pressure 100kg/ cm²

11. In the said regulations , for regulation 554, the following regulation shall be substituted, namely:-

"Manhole frames , mouthpieces and doors . Manhole frames , mouthpieces , doors or cover plates shall be of mild steel . Frames shall be oval and where of the flanged type shall be formed to bed closely to the shell and provide a flat jointing surface to the door. Alternatively, raised circular mouthpieces may be fitted externally and where ofthe flanged type shall be bedded closely to the shell.

Wherever practicable, the frame shall be attached to the inside of the shell with the shorter axis parallel to the longitudinal centre line of the boiler. In all cases where the shell thickness exceeds 9/16 inch , oval frames or circular mouthpieces shall be fitted .

Oval frames and externally raised circular mouthpieces shall be either:

(a) Formed in one piece without weld, or

(b) Formed from a suitable rolled section and forge - welded, or fabricated by fusion welding , provided they are stress - relieved by heat-treatment after welding and before attaching to the boiler unless the whole boiler is to be subjected to heat-treatment on completion .

Welds shall be positioned so that they are located on the transverse centre line of the boiler. ( see Regulation 556).

The joining flanges of mouthpieces and covers shall be machined on the face and edges and on the bearing surface for the bolts . Bolts and nuts shall be machined where in contact with the flanges and the joints should be formed inside and outside the pitch line or pitch circle ofthe bolts to preclude the possibility of flange distortion. Cover plates shall be dished outwards to a depth of approximately one- eighth of the internal diameter of the frame.

All edges shall be machined or flame -cut by machine (See Regulation 541 ) .

Forms or manhole frames and attachments are shown in Figures XII/52, XII/53 , XII/54, XII/ 55 andXII/56. " ;

12. In the said regulations , after regulation 554, the following regulation shall be inserted, namely:-- "554A. "Internal doors :---Internal doors shall be of wrought steel in accordance with Chapter II and constructed inaccordancewith the following :

(a) doors shall be formed to fit closely to the internal joint surface and should be fitted with studs , nuts and crossbars;

(b) doors for circular opening larger than 250mm or elliptical/rectangular opening larger than 250mm × 175mm shall have two studs but for opening of 250mm × 170mm, or less only one stud may be fitted. Doors for opening not larger than 123mm × 90mm may have the stud forged integrally with door;

(c) doors studs shall be of welding quality steel having a minimum specified tensile strength of not less than 360N/mm² and those for manholes shall be not less than 30mm;

They shall be fixed in any of the followingway:

1. screwed through the plate and fillet welded on inside;

2. fillet welded each side of the plate with a leg length of not less than 10mm;

3. attached to the door by an intermediate plate or lugs so that the strength of the attachment is not less than the strength of the studs and the studs are prevented from turning; or

4. providedwith an integrated collar and be riveted or screwed onto the door plate and be prevented from turning in which case the strength of the attachment shall be not less than the strength of the studs ;

(e) the nuts shall be of appropriate material compatible to that of bolts and be placed on the seating surface;

(f) the cross -bars shall be of substantial proportions and of mild or wrought steel .

Note:-Eye bolts of suitable legs on the door plate or headed bolts engaging with slotted sections on the door plate may be used instead of studs .

The minimum calculated thickness ofthe door ofthe flat plate construction ( i.e, unstiffened made from one plate shall be not less than that determined by the following formula:

सा.का.नि. 202.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रीय क्षयरोग संस्थान बंगलौर में समूह ' ग ' पद की भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय क्षयरोग संस्थान , बंगलौर ( प्रयोगशाला सहायक ) , समूह ' ग ' पद भर्ती नियम, 2006 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अहंताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने किसी ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. आरम्भिक गठन : राष्ट्रीय क्षयरोग संस्थान बंगलौर में ऊपर दर्शित पद में इन नियमों की प्रारम्भ की तारीख को नियमित आधार पर उक्त पद धारण करने वाले व्यक्ति इन नियमों के उपबन्धों के अनुसार उस पद पर नियुक्त किए गए समझे जाएंगे और ऐसे प्रारम्भ से पूर्व उनके द्वारा की गई नियमित सेवा को परिवीक्षा अवधि, पुष्टि और पेंशन के लिए अर्हक सेवा के प्रयोजन के लिए गणना में लिया जाएगा । 6. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृति. - इन नियमों की कोई बात ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

G.S.R. 202.In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to Group ' C' post in the National Tuberculosis Institute, Bangalore , namely

1. Short Title and commencement.--( 1 ) These rules may be called the National Tuberculosis Institute, Bangalore (LaboratoryAssistant) , Group, ' C' Post Recruitment Rules ,2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay.--The number of said post, its classification and scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method ofrecruitment, age- limit, qualifications, etc. The method of recruitment, age- limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification .-No person,-

(a) who, has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

7. Savings . Nothing in these rules shall affect reservations , relaxation of age - limit, and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

However, rule comes into force from retrospective effect with a view to regularize the services of existing incumbents . It is certified that by giving retrospective effect to rule, the interest ofexisting incumbents are not likely to be adversely affected .
