सं. 5-29/2005-- केन्द्रीय कृषि विश्वविद्यालय, इम्फाल की संविधियों में प्रथम संशोधन जो 8.9.2005 को हुई प्रबंध बोर्ड की बैठक में अनुमोदित तथा कृषि मंत्रालय , कृषि अनुसंधान व शिक्षा विभाग के पत्र संख्या - 5-29/ 2005 - सीएयूदिनांक 14.3.2006 द्वारा विश्वविद्यालय के कुलाध्यक्ष द्वारा स्वीकृत हो गये हैं तथा सूचना एवं आवश्यक कार्यवाही हेतु अधिसूचित किये जाते हैं ।

1. खंड

2(2) खंड ( 1 ) में निर्दिष्ट समिति में कुलाध्यक्ष के एक नामित भारतीय कृषि अनुसंधान परिषद् के महानिदेशक और पूर्वोत्तर परिषद् अधिनियम, 1971 ( 1971 का 84) की धारा 3 के अंतर्गत स्थापित पूर्वोत्तर परिषद् के सचिव शामिल होंगे और कुलाध्यक्ष का नामित इस समिति का संयोजक होगा ।

2(2)( 1 ) खंड 2( 1 ) में निर्दिष्ट समिति में निम्नलिखित सदस्य होंगेंः अध्यक्ष ( i ) सचिव , कृषि अनुसंधान व शिक्षा विभाग , भारत सरकार - ( ii ) पूर्वोत्तर परिषद् अधिनियम, 1971 (1971 का 84 ) की धारा 3 के अंतर्गत स्थापित पूर्वोत्तर परिषद् के सचिव - सदस्य (iii) कुलाध्यक्ष का नामित व्यक्ति इस समिति कासंयोजक होगा

2. 2(4) कुलपति अपना पद ग्रहण करने की तारीख से पाँच वर्ष की अवधि तक या पैसठ वर्ष की आयु होने तक, जो भी पहले हो , पद धारण करेगा और वह पुनर्नियुक्ति का पात्र नहीं होगाः

2(4) कुलपति अपना पद ग्रहण करने की तारीख से पाँच वर्ष की अवधि तक या पैंसठ वर्ष की आयु प्राप्त करने तक, जो भी पहले हो, पद धारण करेगा और वह आगे पाँच वर्ष की अवधि तक पुनर्नियुक्ति का पात्र होगा या पैसठ वर्ष की आयु प्राप्त करने तक, जो भी पहले हो 2 (4) पैरा 3 हटा दिया गया

बशर्ते इसके कि कुलाध्यक्ष किसी भी कुलपति को उसकी सेवा अवधि पूरी होने के बाद भी अपने पद पर बने रहने का निर्देश दे सकता है किंतु यह अवधि एक वर्ष से अधिक नहीं होगी 1009 भाग -खण्ड2]

3. (5) कुलपति की परिलब्धियाँ और सेवा की अन्य शर्ते निम्नलिखित होंगी:-

(iii ) कुलपति ऐसी दरों पर जो बोर्ड द्वारा नियत की जाए , यात्रा भत्ते का हकदार होगा ।

2 ( 5 ) (iii) कुलपति ऐसी दरों से जो भारत सरकार द्वारा सचिव भारत सरकार के समकक्ष अधिकारी के लिये नियत की जाए , यात्रा और अन्य भत्ते का हकदार होगा ।इसके अलावा सेवा में आने तथा त्यागने समय वह भारत सरकार के सचिव स्तर के समकक्ष अधिकारी के लिये अनुमत्य दरों से स्थानांतरण यात्रा भत्ता तथा अन्य भत्तों का हकदार होगा ।

2(5 )(vi ) नया प्रावधान

2(5) ( vi ) कुलपति भारत सरकार के नियमों के अनुसार छुट्टी यात्रा रियायत एवं गृह यात्रा रियायत के हकदार होंगे ।

2(5)(vii ) नया प्रावधान

2(5) (vii ) कुलपति भारत सरकार के नियमों के अनुसार कार्यलय छोड़ने के समय छुट्टी नकदीकरण के लाभ का हकदार होगा । 6. 3 ( 1 ) कुलपति के अधिकार एवं कर्तव्य कुलपति, बोर्ड, विद्या परिषद् और वित्त समिति का पदेन अध्यक्ष होगा और कुलाधिपति की अनुपस्थिति में उपाधियाँ प्रदान करने के लिए अयोजित दीक्षांत समारोहों की अध्यक्षता करेगा ।

3( 1 ) कुलपति, बोर्ड ,विद्या परिषद् वित्त समिति , अनुसंधान परिषद और विस्तार शिक्षा परिषद का पदेन अध्यक्ष होगा और कुलाधिपति की अनुपस्थिति में उपाधियाँ प्रदान करने के लिए अयोजित दीक्षांत समारोहों की अध्यक्षता करेगा ।

7. 3 (6) कुलपति को बोर्ड , विद्या परिषद् और वित्त समिति की बैठकें बुलाने या बुलवाने का अधिकार होगा ।

3 (6) कुलपति को बोर्ड ,विद्या परिषद् अनुसंधान परिषद विस्तार शिक्षा परिषद और वित्त समिति की बैठकें बुलाने या बुलवाने का अधिकार होगा ।

कालेजों /संकायों के अध्यक्ष खंड 4(1 ) नया प्रावधान

प्रत्येक संकाय का एक अध्यक्ष होगा जो संबंधित कालेज का भी अध्यक्ष होगा । तथापि किसी संकाय में एक से अधिक कालेज हो तो कुलपति किसी एक अध्यक्ष को संकायाध्यक्ष नामांकित कर सकते हैं । 1010

खंड

महाविद्यालय के प्रत्येक संकायाध्यक्ष की 4( 1 ) नियुक्ति कुलपति द्वारा महाविद्यालय के प्रोफेसरों में से पाँच वर्ष की अवधि के लिए की जाएगी और वह पुनर्नियुक्ति का पात्र होगा:

4(1 ) महाविद्यालय के प्रत्येक संकायाध्यक्ष की नियुक्ति बोर्ड द्वारा संविधियों के खंड 18 के अनुसार इस उद्देश्य के लिये गठित चयन समिति की अनुशंसा पर की जाएगी और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा ।

नया प्रावधान

10.

संकायाध्यक्ष किराया मुक्त एवं असज्जित आवास के हकदार होंगे ।

परन्तु संकायाध्यक्ष साठ वर्ष की आयु होने पर उस पद पर नहीं रहेगा

4( 1 ) पैरा 2 परन्तु संकायाध्यक्ष्क्ष बासठ वर्ष की आयु प्राप्त कर लेने पर उस पद पर नहीं रहेगा

नया प्रावधान

11.

4(1) संकायाध्यक्ष पाँच वर्षों की अवधि तक पद पर बने रहेंगे और पुनर्नियुक्ति के हकदार होंगे बशर्ते कि संकाय अध्यक्ष 62 वर्ष की आयु पूरी होने पर पद छोड़ देंगे ।

12. 4(3) संकायाध्यक्ष, महाविद्यालय का अध्यक्ष होगा और महाविद्यालय में अध्यापन और अनुसंधान के संचालन तथा उनका स्तर बनाए रखने के लिए उत्तरदायी होगा और उसके ऐसे अन्य कार्य भी होगे जो अध्यादेशों द्वारा निर्धारित किये जा सकते हैं ।

।कायाध्यक्ष , महाविद्यालय में अध्यापन और अनुसंधान के संचालन तथा उनका स्तर बनाए रखने के लिए कुलपति के प्रति उत्तरदायी होगा और वहे ऐसे अन्य कार्य भी करेगा जो अध्यादेशों द्वारा निर्धारित किये जा सकते हैं ।

4(4) संकायाध्यक्ष संकाय के अध्ययन बोर्ड का पदेन अध्यक्ष एवं विश्वविद्यालय के विद्या परिषद , अनुसंधान परिषद और विस्तार शिक्षा परिषद का सदस्य होगा ।

संकायाध्यक्ष को, यथास्थिति ,अध्ययन बोर्डो या महाविद्यालय की समितियों की किसी बैठक में उपस्थित होने और बोलने का अधिकार होगा जैसा भी मामला हो किन्तु जब तक उसका सदस्य नहीं है तब तक उसे मत देने का अधिकार नही होगा ।

15. 5(2 ) निदेशक शिक्षा पाँच वर्ष की अवधि के लिये पद पर बना रहेगा और वह पुनर्नियुक्ति का पात्र होगा:

5 ( 2 ) निदेशक शिक्षा पाँच वर्ष की अवधि के लिये पद पर बना रहेगा और वह पुनर्नियुक्ति कापात्र होगा:

परन्तु निदेशक, शिक्षा साठ वर्ष की आयु प्राप्त कर लेने पर उस पद पर नहीं रहेगा ।

परन्तु निदेशक शिक्षा बासठ वर्ष की आयु प्राप्त कर लेने पर उस पद पर नहीं रहेगा ।

निदेशक अनुसंधान

6(1 ) पैरा 2 निदेशक, अनुसंधान किराया मुक्त एवं असज्जितआवास के हकदार होंगे । 17. 6(3 ) निदेशक, अनुसंधान विश्वविद्यालय के अनुसंधान कार्यक्रमों के पर्यवेक्षण समन्वय के लिए उत्तरदायी होगा । और

6(3 ) निदेशक , अनुसंधान विश्वविद्यालय के सभी अनुसंधान कार्यक्रमों के पर्यवेक्षण और समन्वय के लिए उत्तरदायी होगा और अपने कार्य के निष्पादन के लिए कुलपति के प्रति उत्तरदायी होगा ।

6(4) निदेशक, अनुसंधान विश्वविद्यालय की अनुसंधान समिति के पदेन सदस्य- सचिव होंगे

7(1 ) पैरा 2 निदेशक, विस्तार शिक्षा किराया मुक्त एवं असज्जित आवास के हकदार होंगे । 20. 7(2) निदेशक विस्तार शिक्षा पाँच वर्ष की अवधि के लिए पद पर बने रहेंगे और वो पुनर्नियुक्ति के पात्र होंगे ।

7 (2) निदेशक, विस्तार शिक्षा पाँच वर्ष की अवधि के लिए पद धारण करेगा और वह पुनर्नियुक्तिका पात्र होगा ।

परन्तु विस्तार शिक्षा निदेशक साठ वर्ष की आयु प्राप्त कर लेने पर उस पद पर नहीं रहेंगे ।

परन्तु विस्तार शिक्षा निदेशक बासठ वर्ष की आयु प्राप्त कर लेने पर उस पद पर नहीं रहेंगे ।

21. 7(3) निदेशक ,विस्तार शिक्षा विश्वविद्यालय के सभी विस्तार शिक्षा कार्यक्रमों के पर्यवेक्षण और समन्वय के लिए उत्तरदायी होगा ।

7 (3 ) निदेशक, विस्तार शिक्षा विश्वविद्यालय के सभी विस्तार शिक्षा कार्यक्रमों के पर्यवेक्षण और समन्वय के लिए उत्तरदायी होगा और अपने कार्य के निष्पादन के लिए कुलपति के प्रति उत्तरदायी होगा

23. खंड 8(1) कुलसचिव की नियुक्ति इस प्रयोजन के लिए गठित चयन समिति की सिफारिश पर बोर्ड द्वारा की जाएगी और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा ।

8 ( 1 ) कुलसचिव की नियुक्ति संविधियों के खंड 18 के अंतर्गत यथावत गठित चयन समिति की सिफारिश पर बोर्ड द्वारा की जाएगी और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा । वह अपने कार्य के लिए कुलपति के प्रति उत्तरदायी होगा नया प्रावधान

8(2 ) पैरा 2 उसे अधिकतम पाँच वर्षों के लिये प्रतिनियुक्ति पर भी नियुक्त किया जा सकता है।

बशर्ते इसके कि कुलसचिव साठ वर्ष की आयु प्राप्त कर लेने पर भी पद पर तब तक बना रहेगा जब तक उसका उत्तरवर्ती नियुक्त नहीं किया जाता और वह अपना पद ग्रहण नही कर लेता या एक वर्ष की अवधि समाप्त नही हो जाती , इनमें से जो भी पहले हो ।

8 (3) पैरा 4 किसी व्यक्ति को प्रतिनियुक्ति पर नियुक्त करने की स्थिति में उसका कार्यकाल, परिलब्धियाँ एवं अन्य सेवा शर्ते प्रतिनियुक्ति की शर्तों के अनुसार होगा ।

9(1 ) पैरा 2 नियंत्रक को भी अधिकतम पाँच वर्षो की निर्धारित अवधि के लिये प्रतिनियुक्ति पर भी नियुक्तकिया जा सकता है ।

नियंत्रक की परिलब्धियां तथा सेवा के अन्य निबंधन और शर्ते ऐसी होंगी जो अध्यदेशों द्वारा निर्धारित की जायेंगी ।

9(3) पैरा 1 नियंत्रक की परिलब्धियां तथा सेवा के अन्य निबंधन और शर्ते ऐसी होंगी जो अध्यदेशों द्वारा निर्धारित की जायें । यदि किसी व्यक्ति की प्रतिनियुक्ति पर नियुक्ति की जाती है तो उसकी सेवावधि, परिलब्धियां और अन्य शर्ते प्रतिनियुक्ति की मानक शर्तों के अनुसार होंगी ।

परन्तु यह और कि नियंत्रक, साठ वर्ष की आयु प्राप्त कर लेने पर भी पद पर तब तक बना रहेगा जब तक उसक उत्तरवर्ती नियुक्त नहीं किया जाता है और वह अपना पद धारण नहीं कर लेता है या एक वर्ष की अवधि समाप्त नहीं हो जाती है , इनमें से जो भी पहले हो ।

ख) ऐसे अन्य वित्तीय कार्यों का पालन करेगा जो उसे बोर्ड द्वारा सौपे जा सकते हैं जो संविधियों या अध्यादेशों द्वारा निर्धारित किए जासकते हैं ।

ख ) ऐसे अन्य वित्तीय कार्यों का पालन करेगा जो उसे बोर्ड द्वारा सौपे जा सकते हैं जो संविधियों या अध्यादेशों द्वारा निर्धारित किए जा सकते हैं या उसे बोर्ड या कुलपति द्वारा समय समय पर सौपे जाए ।

10( 1 ) पैरा 1 प्रत्येक विभाग का एक अध्यक्ष होगा जिसकी नियुक्ति कुलपति द्वारा की प्रत्येक विभाग का एक अध्यक्ष होगा जो एसोसिएट प्रोफेसर के पद से नीचे का नहीं होगा तथ जिसके कर्तव्य और कार्य तथा 1014

नियुक्ति के निबंधन और शर्ते अध्यादेशों द्वारा निर्धारित किए जाऐंगे ।

जायेगी , जो एसोसिएट प्रोफेसर के पद से नीचे का नही होगा तथा जिसके कर्तव्य और कार्य तथा नियुक्ति के निबंधन और शर्ते अध्यादेशों द्वारा निर्धारित किए जाऐंगे ।

वह अध्ययन के लिये संकायाध्यक्ष , अनुसंधान के लिये अनुसंधान निदेशक ,विस्तार शिक्षा के लिये विस्तार शिक्षा निदेशक के प्रति उत्तरदायी होगा । तथापि संकायाध्यक्ष संबंधित कालेजों के विभागाध्यक्षों का प्रशासनिक नियंत्रण अधिकारी होगा । 34. 10( 1 )

10 ( 1 ) पैरा 2 परन्तु यदि किसी विभाग में एक से अधिक प्रोफेसर है तो विभागाध्यक्ष प्रोफेसरों में से कुलपति द्वारा नियुक्त किया जाएगा:

10( 1 ) पैरा 3 बशर्ते इसके कि ऐसे विभाग के मामले में, जहां केवल एक प्रोफेसर है` कुलपति को प्रोफेसर को या एसोसिएट प्रोफेसर को विभागाध्यक्ष के रूप में नियुक्त करने का विकल्प होगा ।

बशर्ते इसके कि ऐसे विभाग के मामले में , जहां केवल एक प्रोफेसर है बोर्ड को कुलपति की सिफारिश पर प्रोफेसर को या एसोसिएट प्रोफेसर को विभागाध्यक्ष के रूप में नियुक्त करने का विकल्प होगा ।

प्रोफेसर या रीडर नहीं है तो संबद्ध महाविद्यालय का संकायाध्यक्ष, विभागाध्यक्ष के रूप में कार्य करेगा ।

10 ( 1 ) पैरा 5 बशर्ते इसके कि यदि किसी विभाग में कोई प्रोफेसर या एसोसिएट प्रोफेसर नहीं है तो संबद्ध महाविद्यालय का संकायाध्यक्ष, विभागाध्यक्ष के रूप में कार्य करेगा या कुलपति के अनुमोदन से महाविद्यालय में किसी विभागाध्यक्ष को कार्यभार सौंपा जायेगा । 1015 भाग 1-खण्ड 2]

39. खंड 11 (1) पुस्तकालय अध्यक्ष की नियुक्ति बोर्ड द्वारा इस प्रयोजन के लिए गठित चयन समिति की सिफारिश पर की जाएगी और वह विश्वविद्यालय का पूर्णकालिक अधिकारी होगा ।

11 ( 1 ) पुस्तकालय अध्यक्ष की नियुक्ति बोर्ड द्वारा संविधियों के खंड 18 के अनुसार इस प्रयोजन के लिए गठित चयन समिति की सिफारिश पर की जाएगी और वह विश्वविद्यालय का पूर्णकालिक वैतनिक अधिकारी होगा ।

11 (2) पुस्तकालय अध्यक्ष, ऐसी शक्तियों का प्रयोग और ऐसे कर्तव्यों का पालन करेगा जो उसे कुलपति द्वारा सौपे जाएं ।

11 (2) प्रत्येक पुस्तकालय अध्यक्ष,ऐसी शक्तियों का प्रयोग और ऐसे कर्तव्यों का पालन करेगा जो उसे बोर्ड द्वारा सौपे जाएं । बोर्ड का गठन , अधिकार एवं कार्य

41. 12( 1 ) ( ii) पूर्वोत्तर क्षेत्र में राज्य के कृषि और वन विभागों के प्रभारी सचिवों में से दो सचिव जो उस राज्य का प्रतिनिधित्व करने के लिए वर्णानुक्रम द्वारा कुलाध्यक्ष द्वारा किए जाएंगे ;

71 . 18 (3 ) कुलपति या उसकी अनुपस्थिति में उसका नामनिर्दिष्ट चयन समिति की बैठकों की अध्यक्षता करेगा

बशर्ते कि चयन समिति की बैठकें कुलाध्यक्ष के नामनिर्देशिती से पहले से बातचीत करके बुलाई जाऐंगी ।

बशर्ते इसके कि चयन समिति की कार्यवाही तब तक मान्य नहीं होंगी जब तक कि विश्वविद्यालय के बाहर के कम से कम दो व्यक्ति बैठक में उपस्थित न हों ।

बशर्ते कि चयन समिति की बैठकें कुलाध्यक्ष के नामनिर्देशिती और खंड (2) के अधीन बोर्ड द्वारा नामनिर्दिष्ट व्यक्तियों की सुविधानुसार पूर्व परामर्श के उपरान्त ही बुलाई जाऐंगी:

बशर्ते कि चयन समिति की कार्यवाही तब तक मान्य नहीं होंगी जब तकः-

18 (5) सिफारिशें करने में चयन समिति द्वारा अनुसरण की जाने वाली प्रक्रिया साक्षात्कार से पहले समिति द्वारा निर्धारित की जाएगी सिफारिशें करने में चयन समिति द्वारा अनुसरण की जाने वाली प्रक्रिया अध्यादेशों में दीजाएगी ।

73. 18 ( 7 )

18 (7 ) (i) बोर्ड के अनुमोदन से कुलपति को किसी व्यक्ति को अस्थायी रूप से 6 माह के लिये फिर 6 माह आगे विस्तार देने का अधिकार होगा ।

( i ) यदि अस्थायी रिक्ति एक शैक्षणिक सत्र से अधिक लंबी अवधि के लिए है तो यह आगे आने वाले खंडों में दी गई प्रक्रिया के अनुसार चयन समिति की सलाह से भरी जाएगी: बशर्ते कि कुलपति इससे विश्वस्त हैं कि कार्य के हित में रिक्ति को भरना आवश्यक है तो उपखंड (ii ) में निर्दिष्ट स्थायी समिति द्वारा पूर्णतः अस्थायी आधार पर छह मास की 1023 भाग I-खण्ड 2 ]

अवधि के लिए नियुक्ति की जा सकेगी ।

(ii) यदि अस्थायी रिक्ति एक वर्ष की अवधि से कम के लिए है तो वह रिक्ति स्थानीय चयन समिति की सिफारिश से भरी जाएगी जिरा में संबद्ध महाविद्यालय का संकायाध्यक्ष, विभागाध्यक्ष और कुलपति का एक नानिर्देशिती होगा:

बशर्ते इसके कि एक ही व्यक्ति संकायाध्यक्ष और विभागाध्यक्ष का पद धारण करता है तो चयन समिति में कुलपति के दो नामनिर्देशिती होसकेगे:

परस्तु यह और कि मृत्यु या अन्य किसी कारण से अध्यापान पदों की अचानक आकस्मिक रिक्तियों के मामले में संकायाध्यक्ष, संबधित विभागाध्यक्ष से परामर्श के पश्चात् एक मास के लिए अस्थायी नियुक्ति कर सकेगा और ऐसी नियुक्ति की रिपोर्ट कुलपति और कुलसचिव को देगा ।

(iii ) किसी भी स्थिति में अस्थायी रूप मे नियुक्ति किया गया कोई भी अध्यापक , यदि इन संविधियों के अंतर्गत उसकी नियुक्ति की एक नियमित चयन समिति द्वारा सिफारिश नहीं की गई है , ऐसे अस्थायी नियोजन पर सेवा में तब तक बना रहेगा या जब तक कि उसे अस्थायी या स्थायी नियुक्ति के लिए तदनंतर स्थानीय चयन समिति या नियमित चयन समिति द्वारा बाद में चयन नहीं कर लिया जाता, जैसा भी मामला हो ।

21 ( 1 ) क) विभिन्न संकायों और अनुसंधान में उनके समकक्ष या विस्तार शिक्षा के निदेशक , संकायाध्यक्ष, प्रोफेसर,एसोसिएट प्रोफेसर , सहायक प्रोफेसर की अर्हताए ऐसी होंगी जैसी अध्यादेशों द्वारा विहित की जाऐंगी ।

ख) अशैक्षनिक कर्मचारी की अर्हताए ऐसी होंगी जैसी अध्यादेशों द्वारा विहित की जाए 76. 21

विद्या परिषद् उपस्थित और मतदान करने वाले सदस्यों के कम से कम दो तिहाई से अनधिक बहुमत द्वारा पारित एक विशेष संकल्प द्वारा शिक्षक से मान्यता वापस ले सकती है ।

बशर्ते कोई संकल्प तब तक पारित नही किया जाएगा जब तक संबंधित व्यक्ति का निर्धारित अवधि के भीतर लिखित रूप में कारण बताओ नोटिस न दिया गया हो और जब तक उसके 1025 भाग I-खण्ड 2 ]

विश्वविद्यालय के शिक्षको तथा अन्य शैक्षिक कर्मचारियों के अलावा विश्वविद्यालय के सभी कर्मचारी तत्प्रतिकूल किसी संविदा के अभाव में संविधियों , अध्यादेशों और विनियमों में विनिर्दिष्ट सेवा के निबंधनों और शर्तों तथा आचार संहिता से शासित होंगे ।

24) विश्वविद्यालय के सभी गैरशैक्षिक कर्मचारी तत्प्रतिकूल किसी संविधा के अभाव में संविधियों, समय समय पर बनाये गये अध्यादेशों और विनियमों में विनिर्दिष्ट सेवा के निबंधनों और शर्तों तथा आचार संहिता से शासित होंगे ।

26(2 ) कर्मचारियों की नियुक्ति की संविदा के निबंधनों में या सेवा के अन्य निबंधनों और शर्तों में किसी बात के होते हुए भी , शिक्षकों और अन्य शैक्षिक कर्मचारियों के संबंध में बोर्ड, और अन्य कर्मचारियों के संबंध में नियुक्ति प्राधिकारी को , शिक्षक को या शैक्षिक स्टाफ के सदस्य को अथवा अन्य कर्मचारी को जैसा भी मामला हो कदाचार के आधार पर हटाने कीशक्तिहोगी ।

कर्मचारियों की नियुक्ति की सविदा के निबंधनों में या सेवा के अन्य निबंधनों और शर्तों में किसी बात के होते हुए भी, शिक्षकों और अन्य शैक्षिक कर्मचारियों के संबंध में बोर्ड , और अन्य कर्मचारियों के संबंध में नियुक्ति प्राधिकारी को, शिक्षक को या शैक्षिक स्टाफ के सदस्य को अथवा जैसा भी मामला हो अथवा अन्य कर्मचारी को कदाचार के आधार पर हटाने की शक्ति होगी ।

हो नियुक्ति प्राधिकारी किसी शिक्षक , शैक्षिक स्टाफ के सदस्य या अन्य कर्मचारी को हटाने के लिए तभी हकदार होगा जब उसके लिए उचित कारण हो , और उसे तीन मास की सूचना दे दी गई हो या सूचना के बदले तीन मास के वेतन का भुगतान किया गया हो ।

परन्तु ऐसा त्यागपत्र केवल उस तारीख से प्रभावी होगा जिसको बोर्ड या नियुक्ति प्राधिकारी जैसा भी मामला हो द्वारा वह त्यागपत्र स्वीकार किया जाता है ।

परन्तु ऐसा त्यागपत्र केवल उस तारीख को प्रभावी होगा जिस तारीख को बोर्ड या नियुक्ति प्राधिकारी जैसा भी मामला हो द्वारा वह त्यागपत्र स्वीकार किया जाता है ।

खंड 31 विश्वविद्यालय द्वारा चलाए जा रहे प्रत्येक महाविद्यालय या संस्था की एक सलाहकार समिति होगी जिसमें पंद्रह से अधिक व्यक्ति नहीं होंगे जिनमें अन्य व्यक्तियों के अतिरिक्त तीन शिक्षक होंगे जिनमें महाविद्यालय या संस्था का संकायाध्यक्ष भी है , और बोर्ड द्वारा नामनिर्दिष्ट विश्वविद्यालय के दो शिक्षक होंगे कार्यकारी अध्यक्ष

33. जहां विश्वविद्यालय की किसी समिति की बैठक में अध्यक्षता करने के लिए किसी सभापति का प्रावधान न हो अथवा जब सभापति अनुपस्थित हो या कुलपति ने लिखित में कोई व्यवस्था नहीं की हो तो उपस्थित सदस्य ऐसी बैठक की अध्यक्षता जहां विश्वविद्यालय के किसी प्राधिकरण या ऐसे प्राधिकरण की किसी समिति द्वारा बैठक में अध्यक्षता करने के लिए किसी सभापति का प्रावधान न किया गया हो अथवा जब सभापति के लिए इस प्रकार का प्रावधान हो किंतु वह अनुपस्थित हो तो उपस्थित सदस्य ऐसे बैठक 1027 भाग -खण्ड 2]

87. 36.

36.इन परिनियमों में किसी बात के होते हुए जो भी, कोई व्यक्ति जो मामूली तौर पर भारत में निवासी न हो विश्वविद्यालय का अधिकारी या विश्वविद्यालय के किसी प्राधिकरण का सदस्य होने का पात्र नहीं होगा ।

इन संविधियों में किसी बात के अन्यथा होते हुए भी, जो भी कोई व्यक्ति जो सामानयतः भारत का निवासी न हो विश्वविद्यालय का अधिकारी या विश्वविद्यालय के किसी प्राधिकरण का सदस्य होने का पात्र होगा ।

छात्र परिषद्

88. खंड विश्वविद्यालय के महाविद्यालय में प्रत्येक

39(1) शैक्षिक वर्ष के लिए एक छात्र परिषद् गठित की जाएगी जिसमें निम्नलिखित होंगे ।

(1) निदेशक शिक्षा, जो छात्र परिषद् का अध्यक्ष होगा;

39(1 ) विश्वविद्यालय में प्रत्येक महाविद्यालय में प्रत्येक शैक्षणिक वर्ष के लिये एक छात्र परिषद् होगी जो विश्वविद्यालय के प्राधिकारियों को खेलकूद, नाटक, सांस्कृतिक कार्यक्रम बादविवाद आदि सहित छात्र कल्याण से संबंधित विभिन्न कार्य कलापों के संबंध में सिफारिश करेगी और उसमें निम्नलिखित अधिकारी होंगेंः

i) कालेज का संकायाध्यक्ष

ii) सभी छात्रावास वार्डेन

iii ) कैंपस संपदा अधिकारी

(ii) वे सभी छात्र जिन्होंने पूर्ववर्ती शैक्षिक वर्ष के दौरान अध्ययन , ललित कला , क्रीड़ा और विस्तार कार्य के क्षेत्रों में पुस्रकार प्राप्त किए है (iii)अध्ययन, क्रीड़ा और व्यक्तिव के सवर्तोन्मुखी विकास में प्रतिभा के आधार पर विद्या परिषद् द्वारा नामनिर्दिष्ट किए जाने वाल बीस छात्र

iv) संकायाध्यक्ष द्वारा नामित पाँच

विभागाध्यक्ष

v) छात्रावास प्रीफेक्ट

vi ) प्रत्येक कक्षा से पूर्व शैक्षणिक सत्र में सर्वाधिक ओ जी पी ए अंक पाने वाला छात्र

vii ) छात्र कल्याण अधिकारी सदस्य – सचिव बशर्ते इसके कि विश्वविद्यालय के किसी भी छात्र को विश्वविद्यालय से संबंधित कोई विषय छात्र परिषद् के समक्ष लाने का अधिकार होगा , यदि अध्यक्ष द्वारा इस प्रकार अनुमति प्रदान की जाए , और उसे ऐसी किसी भी बैठक के दौरान विचार-विमर्श में भाग लेने का अधिकार होगा, जब भी वह मामला विचरार्थ लिया जाता है ।

90. 39( 3 ) सुझाव सर्वसम्मति से दिए जाएंगे

छात्र परिषद् शैक्षिक वर्ष में कम से कम एक 39 (3 ) छात्र परिषद् कम से कम प्रत्येक बार अधिमानताः उस वर्ष के प्रारम्भ में अपनी सेमेस्टर में अपनी बैठक करेगी । बैठक करेगी ।

91. 43 . अन्य संस्थानों एवं संगठनों से सहयोग नया प्रावधान

43. विश्वविद्यालय को भारतीय कृषि अनुसंधान परिषद के पूर्वोत्तर पर्वतीय क्षेत्र के क्षेत्रीय परिसर , बारापानी ,मेघालय को सम्मिलित करते हुये किसी भी शैक्षणिक और अनुसंधान में उच्च शिक्षा के संस्थान के साथ विश्वविद्यालय को अपने स्नातकोत्तर व पी एच डी डिग्री प्रदान करने के आंशिक अपेक्षाओं को पूरा करने हेतु स्नातकोत्तर अनुसंधान सहयोगात्मक कार्यक्रम चलाने के लिये समझौता ज्ञापन के द्वारा अनुबंध करने का अधिकार होगा ।

अनुसंधान परिषद का गठन व कार्य 92. 44(1) नया प्रावधान

44( 1 ) कृषि व संबद्ध क्षेत्रों में विश्वविद्यालय की अनुसंधान नीतियों एवं कार्यक्रम के सामान्य पर्यवेक्षण हेतु विश्वविद्यालय में एक अनुसंधान परिषद होगी । अनुसंधान परिषद में निम्नलिखित सदस्य होंगें

अध्यक्ष

i)कुलपति

ii) निदेशक विस्तार शिक्षा सदस्य

iii) निदेशक , शिक्षा सदस्य

vii) निदेशक अनुसंधान सदस्यसचिव

44(2) अनुसंधान परिषद साल में एक बार कम से कम बैठक करेगी ।

44(3)अनुसंधान परिषद की बैठक म अनुसंधान परिषद के एक तिहाइ सदस्य गणपूर्ति करेंगे ।

यदि त्यागपत्र या अन्य कारणों से रिक्ति उत्पन्न होती है तो बाकी समय के लिये उसे भर दिया जायेगा ।

विस्तार शिक्षा परिषद का गठन व कार्य

93. 45(1) नया प्रावधान

45(1 ) कृषि व संबद्ध क्षेत्रों में विश्वविद्यालय की विस्तार शिक्षा नीतियों एवं कार्यक्रम के सामान्य पर्यवेक्षण हेतु विश्वविद्यालय में एक विस्तार शिक्षा परिषद होगी । विस्तार शिक्षा परिषद में निम्नलिखित सदस्य होंगें

i) कुलपति अध्यक्ष

ii) निदेशक अनुसंधान सदस्य

iii )निदेशक शिक्षा सदस्य

iv) विश्वविद्यालय के महाविद्यालय के संकायाध्यक्ष सदस्य [भाग 1-खण्ड 2 1030

46(1) नया प्रावधान

46(1) पेंशन, उपदान एवं सामान्य भविष्यनिधि देने के संबंध में केंद्रीय कृषि विश्वविद्यालय के सभी नियमित कर्मचारी केंद्रीय सिविल सेवा ( पेंशन ) नियम 1972 तथा सामान्य भविष्यनिधि ( केंद्रीय सेवायें ) नियम 1960 के प्रावधानों से नियंत्रित होंगे ।

46(2 ) केंद्रीय सिविल सेवा ( पेंशन ) नियम 1972 तथा सामान्य भविष्यनिधि ( केंद्रीय सेवायें ) नियम 1960 में भारत सरकार द्वारा किया गया कोई भी परिवर्तन केंद्रीय कृषि विश्वविद्यालय के कर्मचारियों पर भी लागू होगा ।

46(3 ) पेंशन विनियम ( कम्यूटेशन ) के संबंध में केन्द्रीय सिविल सेवा ( पेंशन विनियम ) नियम 1981 लागू होगा ।

46( 4 ) कुलपति, केंद्रीय कृषि विश्वविद्यालय पेंशन संस्वीकृति अधिकारी तथा ( 2 ) पेंशन प्राधिकरण अधिकारी होंगे ।

46( 5 ) पेंशन अदायगी नियंत्रक कार्यालय में केंद्रीकृत और नियंत्रित होगी ।

46( 1 ) All regular employees of Central Agricultural University shall be governed by the provisions of " Central Civil Services ( Pension) Rules 1972 " and "General Provident Fund (Central Services) Rules 1960 " , in respect of grant of Pension and Gratuity and G.P. Fund .

46(2) Any change incorporated by Government of India in " Central Civil Services ( Pension ) Rules 1972 " and " General Provident Fund ( Central Services ) Rules 1960 ", shall also be applicable to employees of Central Agricultural University .
