सा.का.नि. 307.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और संघ लोक सेवा आयोग , सहायक निदेशक ( अ.भा.से. ) समूह ' क ' पद भर्ती नियम , 1999 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व लिया गया है या करने से लोप किया गया है , संघ लोक सेवा आयोग के कार्यालय में उप निदेशक ( अखिल भारतीय सेवाएं) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम संघ लोक सेवा आयोग उप निदेशक ( अखिल भारतीय सेवाएं ) समूह ' क' पद भर्ती नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतनमान. - उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु सीमा और अर्हताएं , आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी , जो उक्त अनुसूची के स्तम्भ ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति, -

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

बशर्ते कि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यंक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति: - इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

रुपए के या समतुल्य वेतनमान में नियमित आधार पर

उस पद पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष की नियमित सेवा की है ; और 1751 [ भाग II- खण्ड 3 (i) ]

(ख ) जो चयन समिति की बैठकें और विभागीय प्रोन्नति समिति की बैठकें आयोजित कराने का पांच वर्ष का अनुभव रखते हैं जिसमें उससे संपृक्त मुकदमा संबंधी विषयों पर कार्रवाई करने , शपथ पत्रों के उत्तर , रिट्याचिकाओं का प्रारूप तथा विशेष अनुमति याचिका तैयार करने का अनुभव भीशामिल है ।

(प्रतिनियुक्तिकी अवधि, केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य संवर्ग बाह्य पद पर प्रतिनियुक्ति की अवधि सहित , साधारणतया तीन वर्ष से अधिक नहीं होगी । )

प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 307.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supercession of the Union Public Service Commission, Assistant Director ( AIS ) Group 'A ' post Recruitment Rules , 1999 except as respect of things done or omitted to be done before such supercession the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Director (All India Services ) in the Office of Union Public Service Commission, namely :--

1. Short title and commencement.-( 1 ) These Rules may be called the Union Public Service Commission , Deputy Director (All India Services ) Group ' A' Post Recruitment Rules, 2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of the post , its classification and the scale of pay. The number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to the rules .

3.Method of recruitment, age limit, and qualifications etc. ,-The method of recruitment, age limit, qualifications and other matters relating to the post shall be as specified in columns ( 5) to ( 14) of the said Schedule .

4. Disqualification.-No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment of the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5.Power to relax -Where the Central Government is of the opinion that it is necessary or expedient so to do, it máy, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect of any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons. in accordance with the orders issued by the Central Government from time to time in this regard .

टिप्पण 2: अनुभव संबंधी अर्हता (अर्हताएं) संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जन- जातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है ( हैं ) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहींहै।

टिप्पण : -जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो. वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक या दो वर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति: -

केन्द्रीय सरकार या राज्य सरकार संघ राज्य क्षेत्र के अधीन ऐसे अधिकारी :-

(क) ( i ) जो मूल कॉडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii) जिन्होंने मूल कॉडर/ विभाग में 5500-9000 रु. केया समतुल्य वेतनमान नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष नियमित सेवा कीहै; और

(ख) जिनके पास स्तंभ 8 में सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं और अनुभव है। 1756

टिप्पण: - पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी।

प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Central Water Commission (Group ' A' and Group 'B ' Scientific) posts Recruitment Rules , 2003 in so far as they relate to the posts of Assistant Research Officer , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Research Officer in the Central Water Commission under the Ministry of Water Resources , namely : --

1. Short title and commencement .-( 1 ) These Rules may be called the Central Water Commission ( Assistant Research Officer ) Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of the said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications etc.- The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule .

4. Disqualification . No person,-

(a)who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment of the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing , exempt any persons from the operation of this rule .

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 309.- केन्द्रीय सरकार , ऊर्जा दक्षता अधिनियम , 2001 ( 2001 का 52 ) की धारा 14 के खंड ( 5 ) और धारा 56 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ऊर्जा दक्षता ब्यूरो के परामर्श से अधिनियम की धारा 14 के खंड ( 1 ) के अधीन पदाभिहित या नियुक्त ऊर्जा प्रबन्धक के लिए न्यूनतम अर्हता विहित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम ऊर्जा संरक्षण ( ऊर्जा प्रबन्धकों के लिए न्यूनतम अर्हता ) नियम , 2006है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं ( 1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो , -

(क) " अधिनियम" से ऊर्जा संरक्षण अधिनियम , 2001 ( 2001 का 52 ) अभिप्रेत है ;

(ख) " अभिकरण " से ऊर्जा प्रबन्धकों के प्रमाणीकरण के लिए राष्ट्रीय परीक्षा संचालित करने के प्रयोजन के लिए ब्यूरो द्वारा नियुक्त कोई अभिकरण अभिप्रेत है;

(ग) " प्रमाणपत्र " से ऊर्जा प्रबन्धक के प्रमाणौकरण के समर्थन में ब्यूरो या ब्यूरो द्वारा अधिसूचित अभिकरण द्वारा राष्ट्रीय परीक्षा में सफल घोषित होने पर जारी प्रमाणपत्र अभिप्रेत है;

(घ) " डिप्लोमा इंजीनियर " से ऐसा कोई व्यक्ति अभिप्रेत है जिसने किसी विश्वविद्यालय या बोर्ड या केन्द्रीय या राज्य विधानमंडल के अधिनियम द्वारा निगमित संस्थान या संसद् के किसी अधिनियम द्वारा स्थापित अन्य शैक्षणिक संस्था से इंजीनियरी में डिप्लोमा या अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा यथा समकक्ष मान्यताप्राप्त कोई डिप्लोमा प्राप्त किया है या केन्द्रीय सरकार द्वारा मान्यताप्राप्त ऐसे विदेशी विश्वविद्यालय या महाविद्यालय या संस्था से और ऐसी शर्तों के अधीन रहते हुए जो समय- समय पर इस प्रयोजन के लिए अधिकथित की जाएं, इंजीनियरी में डिप्लोमा प्राप्त किया हो;

(ङ ) किसी अर्हता के संबंध में " समतुल्य " से ऐसी शैक्षिक अर्हताएं अभिप्रेत हैं जो भारत में विधि द्वारा गठित किसी परीक्षा निकाय द्वारा संचालित परीक्षा या केन्द्रीय सरकार या राज्य सरकार या अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा मान्यताप्राप्त उसके समतुल्य कोई परीक्षा उत्तीर्ण कर अर्जित की गई हो;

(च) " स्नातक इंजीनियर " से ऐसा व्यक्ति अभिप्रेत है , जिसने भारत में केन्द्रीय या राज्य विधानमंडल के अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संसद् के किसी अधिनियम द्वारा स्थापित अन्य शैक्षणिक संस्थाओं या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अधीन सम विश्वविद्यालयों के रूप में घोषित अन्य शैक्षिक संस्थाओं से इंजीनियरी में स्नातक डिग्री या अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा मान्यताप्राप्त कोई समतुल्य डिग्री प्राप्त की हो , या केन्द्रीय सरकार द्वारा मान्यताप्राप्त ऐसे विदेशी विश्वविद्यालय या महाविद्यालय या संस्था से और ऐसी शर्तों के अधीन रहते हुए जो समय - समय पर इस प्रयोजन के लिए यथा अधिकथित की जाएं, इंजीनियरी में डिग्री प्राप्त की है ; :

( छ) " राष्ट्रीय परीक्षा " से ऊर्जा प्रबन्धकों के प्रमाणीकरण के लिए ब्यूरो या ब्यूरो द्वारा नियुक्त अभिकरण द्वारा संचालित परीक्षा अभिप्रेत है ।

(ज ) " इंजीनिरी में स्नातकोत्तर " से ऐसा कोई व्यक्ति अभिप्रेत है , जिसने भारत में केन्द्रीय या राज्य विधानमंडल के किसी अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संसद् के किसी अधिनियम द्वारा स्थापित अन्य शैक्षणिक संस्थाओं या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अधीन सम विश्वविद्यालयों के रूप में घोषित शैक्षिक संस्थाओं से इंजीनियरी में स्नातकोत्तर डिग्री या अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा मान्यताप्राप्त कोई डिग्री प्राप्त की हो या केन्द्रीय सरकार द्वारा मान्यताप्राप्त ऐसे विदेशी विश्वविद्यालय या महाविद्यालय या संस्था से और ऐसी शर्तों के अधीन रहते हुए, जो समय-समय पर इस प्रयोजन के लिए अधिकथित की जाएं , इंजीनियरी में स्नातकोत्तर डिग्री प्राप्त की हो;

(झ) " स्नातकोत्तर " से भारत में केन्द्रीय या राज्य विधानमंडल के किसी अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संस्था के किसी अधिनियम द्वारा स्थापित अन्य शैक्षणिक संस्थाओं से या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अधीन सम विश्वविद्यालयों के रूप में घोषित शैक्षिक संस्थाओं से कोई स्नातकोत्तर डिग्री या अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा मान्यताप्राप्त समतुल्य डिग्री प्राप्त की हो , या केन्द्रीय सरकार द्वारा मान्यताप्राप्त ऐसे विदेशी विश्वविद्यालय या महाविद्यालय या संस्था से और ऐसी शर्तों के अधीन रहते हुए , जो समय - समय पर इस प्रयोजन के लिए अधिकथित की जाएं , इंजीनियरी में स्नातकोत्तर डिग्री प्राप्त की हो;

( 2 ) उन शब्दों और पदों के, जो इस नियम में प्रयुक्त हुए हैं, किन्तु परिभाषित नहीं हैं, वही अर्थ हैं जो क्रमशः अधिनियम में हैं । 1760

3. ऊर्जा प्रबन्धकों के प्रमाणीकरण की अर्हता: -

( 1 ) कोई व्यक्ति प्रमाणित ऊर्जा प्रबन्धक होने के लिए अर्हक होगा , यदि उसने-

(i ) ब्यूरो के तत्वाधान में आयोजित ऊर्जा प्रबन्धक या ऊर्जा संपरीक्षक के लिए राष्ट्रीय परीक्षा उत्तीर्ण की है; और (ii ) उसको ब्यूरो द्वारा इस प्रभाव का प्रमाणपत्र जारी किया गया है ।

(2) कोई अभ्यर्थी राष्ट्रीय परीक्षा में बैठने के लिए तब तक पात्र नहीं होगा जब तक वह-

(क) प्रचालन , रखरखाव , योजना इत्यादि में ऊर्जा के प्रयोग में तीन वर्ष के कार्य अनुभव सहित स्नातक इंजीनियर या समतुल्य न हो,

(ख ) प्रचालन, रखरखाव , योजना इत्यादि में ऊर्जा के प्रयोग में दो वर्ष के कार्य अनुभव सहित स्नातकोत्तर इंजीनियर या समतुल्य न हो,

(ग) प्रचालन , रखरखाव , योजना उत्पादन में ऊर्जा के प्रयोग में दो वर्ष के कार्य अनुभव सहित प्रबन्धन में स्नातकोत्तर डिग्री सहित स्नातक इंजीनियर न हो ,

(घ) प्रचालन , रखरखाव , योजना इत्यादि में ऊर्जा के प्रयोग में छह वर्ष के कार्य अनुभव सहित डिप्लोमा इंजीनियर या समतुल्य नहो,

(ङ) प्रचालन , रखरखाव , योजना इत्यादि में ऊर्जा के प्रयोग में तीन वर्ष के कार्य अनुभव सहित भौतिक विज्ञान या इलैक्ट्रानिकस या रसायन ( स्नातक स्तर पर भौतिकी और गणित सहित ) स्नातकोत्तर डिग्री न रखता हो , (3) राष्ट्रीय परीक्षा में बैठने वाला अभ्यर्थी उक्त परीक्षा में सफल घोषित होने पर प्रमाणपत्र प्राप्त करने के लिए योग्य होगा । (4 ) इन नियमों की अधिसूचना के पूर्व ब्यूरो द्वारा ऊर्जा प्रबन्धक या ऊर्जा संपरीक्षक के प्रमाणीकरण के लिए आयोजित किसी राष्ट्रीय परीक्षा को इन नियमों के अधीन आयोजित हुई समझा जाएगा ।

In exercise of the powers conferred by clause ( m) of Section 14 and sub - section (2) of Section 56 of the Energy Conservation Act, 2001 (52 of 2001 ) , the Central Government, in consultation with the Bureau of Energy Efficiency, hereby makes the following rules to prescribe minimum qualification for energy managers designated or appointed under clause ( 1 ) of Section 14 of the Act , namely :-

1. Short title and Commencement.- ( i) These rules may be called the Energy Conservation (Minimum Qualification, for Energy Managers ) Rules , 2006.

(ii) They shall come into force on the date of their publication in the Official Gazette .

2. Definitions .-( 1 ) In these rules, unless the context otherwise required,

(a) "Act" means the Energy Conservation Act, 2001 (52 of2001);

(b) " agency" means an agency appointed by the Bureau for the purpose of holding National Examination for certification of energy managers ;

(c) " certificate" means the certificate issued , on being declared successful in the National Examination , by the Bureau or the agency notified by the Bureau in support of certification of energy manager;

(d) "diploma Engineer " means a person who has obtained a diploma in Engineering from a University or Board or Institution incorporated by an Act of the Central or State Legislature in India or other educational institutions stablished by an Act of Parliament or any diploma recognized by All India Council for Technical Education as equivalent or has obtained a diploma in Engineering from such foreign University or College or Institution recognized by the Central Government, and under such conditions as may be laid down for the purpose , from timeto time;

(e) " equivalent" in relation to any qualification means educational qualifications acquired by passing an examination conducted by an examining body constituted by law in India or an examination recognized by the Central Government or State Governments or All India Council for Technical Education as equivalent thereto;

(f) "graduate Engineer" means a person who has obtained a graduation degree in Engineering from a University incorporated by an Act of the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be deemed as Universities under Section 3 of the University Grants CommissionAct , 1956 or any degree recognized by All India Council for Technical Education as equivalent or has obtained a graduation degree in Engineering from such foreign University or College or Institution recognized by the Central Government, and under such conditions as may be laid down for the purpose, from timetotime;

(g) "National Examination " means the examination conducted by the Bureau or the agency appointed by the Bureau for certification of energy managers ;

(h) "post-graduate in Engineering" means a person who has obtained a postgraduate degree in Engineering from aUniversity incorporated by an Act of the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be deemed as Universities under Section 3 of the University Grants Commission Act, 1956 or any degree recognized by All India Council for Technical Education as equivalent or has obtained a post - graduate degree in Engineering from such foreign University or College or Institution recognized by the Central Government , and under such conditions as may be laid down for the purpose, fromtime to time;

(i) "post-graduate " means a post - graduate of a University incorporated by an Act of the Central or State Legislature in India or other educational institutions established by an Act of Parliament or declared to be deemed as Universities under section 3 of the University Grants Commission Act, 1956 or any degree recognized by All India Council for Technical Education as equivalent or has obtained a post - graduate degree in Engineering from such foreign University or College or Institution recognized by the Central Government , and under such conditions as may be laid down for the purpose, from time to time .

(2) Words and expressions used in these rules and not defined , but defined in the Act , shall have the meaning respectively assigned to them in the Act.

3. Qualification of Certified Energy Managers.-( 1 ) A person shall be qualified to become a certified energy manager , if he-

(i) has passed the National Examination for energy manager or energy auditor held under the aegis of the Bureau; and

(ii) has been issued a certificate by the Bureau to that effect .

(2) No candidate shall be eligible for appearing in the National Examination unless he is-

(a) a graduate Engineer or equivalent with three years of work experience involving use of energy in operation, maintenance, planning , etc .; or,

(b) a post- graduate Engineer or equivalent with two years of work experience involving use of energy in operation, maintenance, planning, etc.; or ,

(c) a graduate Engineer with post - graduate degree in Management or equivalent with two years of work experience involving use of energy in operation, maintenance , planning , etc .; or ,

(d) a diploma Engineer or equivalent with six years of work experience involving use of energy in operation, inaintenance , planning , etc .; or ,

(e) a post- graduate in Physics or Electronics or Chemistry ( with Physics and Mathematics at graduation level ) with three years of work experience involving use of energy in operation, maintenance , planning , etc. (3) A candidate appearing in the National Examination shall be eligible for award of certificate on being declared successful in the said examination .

(4) Any National Examination for certification of energy managers or energy auditors held by the Bureau prior to the notification of these rules shall be deemed to have been conducted under these rules .

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान ( अवर श्रेणी लिपिक) भर्ती नियम , 2006 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

लागू होना : ये नियम इससे उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पद/पदों को लागू होंगे

2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु - सीमा तथा अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा और अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता-वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति, इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

टंकण में 30 शब्द प्रति मिनट की गति परन्तु यह कि ऐसा व्यक्ति जिसके पास टंकण में उक्त अर्हता नहीं है , इस शर्त के अधीन रहते हुए नियुक्त किया जा सकेगा कि वह वेतनमान में वृद्धियां प्राप्त करने के लिए , अर्द्ध स्थायीत्व के लिए या उस श्रेणी में पुष्टि के लिए तब तक पात्र नहीं होगा जब तक वह टंकण में 30 शब्द प्रति मिनट की गति अर्जित नहीं कर लेता है यह कि शारीरिक रूप से असुविधाग्रस्त व्यक्ति जो अन्यथा लिपिकीय पद धारण करने के लिए अर्हित है किन्तु टंकण में उक्त अर्हता नहीं रखता है तो उसे इस शर्त के अधीन नियुक्त किया जा सकेगा कि असुविधाग्रस्त व्यक्ति के लिए विशेष रोजगार कार्यालय से संलग्न चिकित्सा बोर्ड या जहां ऐसा चिकित्सा बोर्ड नहीं है वहां सिविल सर्जन यह प्रमाणित करता है कि उक्त असुवधिाग्रस्त व्यक्ति ऐसी उपयुक्त अवस्था में नहीं है कि वह टंकण करने योग्य हो । 1764

टिप्पण 2 : अनुभव संबंधी अर्हता ( अर्हताएं) संघ लोक सेवा

आयोग /सक्षम प्राधिकारी / कर्मचारी चयन आयोग के विवेकानुसार , अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है (हैं ) जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग/सक्षम प्राधिकारी /कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है ।

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति

प्रोन्नति/प्रतिनियुक्ति/ आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

100% सीधी भर्ती द्वारा ( 90 % रिक्तियां सीधी भर्ती द्वारा भरी जाएंगी और 10 % रिक्तियां उसी कार्यालय में कार्यरत ऐसे समूह " घ " कर्मचारियों में से भरी जाएंगी जो मैट्रिकुलेट हैं और जिनके पास समतुल्य अर्हता है और जिन्होंने प्रतियोगी परीक्षा के आधार पर समूह " घ " में 5 वर्ष नियमित सेवा की है । परीक्षा की पात्रता के लिए अधिकतम आयु सीमा 45 वर्ष ( अनुसूचित जाति/ अनुसूचित जनजाति के कर्मचारियों के लिए 50 वर्ष) है परन्तु इस पद्धति के माध्यम से भर्ती किए जाने वाले व्यक्तियों की अधिकतम संख्या किसी वर्ष में रिक्तियों के 10 % तक सीमित हो सकेगी और न भरी गई रिक्तियां अग्रनीत नहीं की जाएंगी ।

supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Lower Division Clerk in the Central Institute of Coastal Engineering for Fishery , Bangalore under the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries ) , namely :-

1. Short title and commencement ( 1 ) These rules may be called the Central Institute of Coastal Engineering for Fishery (Lower Division Clerk) Recruitment Rules , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette .

4. Method of recruitment, age - limit , and other qualifications . The method of recruitment to the said post, age limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the Schedule .

5. Disqualification .--No person,-

(i) who has entered into or contracted a marriage with a person having a spouse living ; or

(ii) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointmentto the said posts :

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 :Qualifications are relaxable at the discretion of the Staff Selection Commission in the case of candidates otherwise well qualified.
