सा.का.नि. 13.- रेल दावा अधिकरण अधिनियम , 1987 ( 87 का अधिनियम सं. 54 ) की धारा ( 6 ) की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार श्री आर. सी. यदुवंशी , उपाध्यक्ष, रेल दावा अधिकरण पीठ, मुंबई को उनके कार्यालय में ऐसी रिक्ति के भरे जाने तक रेल दावा अधिकरण अधिनियम के उपबंधों के अनुसरण में नए अध्यक्ष की नियुक्ति होने की तारीख तकं रेल दावा अधिकरण के अध्यक्ष के रूप में कार्य करने के लिए एत‌द्वारा प्राधिकृत करती है।

सा.का.नि. 14. केंद्रीय सरकार , रेल संरक्षण बल अधिनियम , 1957 ( 1957 का 23 , की धारा 21 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , रेल संरक्षण बल नियम , 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:

1. ( 1 ) इन नियमों का संक्षिप्त नाम रेल संरक्षण बल (संशोधन ) नियम, 2006 है ।

(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे । 2. अध्याय 6 के नियम 78.1 में , उपशीर्षक " अभ्यावेशित बल सदस्य" के अधीन पहली दो प्रविष्टि " निरीक्षक ( श्रेणी -1 ) और निरीक्षक ( श्रेणी- II ) " के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्ः- "निरीक्षक : 6500-200-10,500 रु . "

3. अनुसूची IV में- रेल संरक्षण बल नियम, 1987 की अनुसूची IV के अधीन वर्णित " निरीक्षक , श्रेणी I" के पदों के लिए नियुक्तियां और प्रोन्नतियां नियमों को हटा दिया जाएगा ।

4. अनुसूची IV में:-

(क) " निरीक्षक श्रेणी- I " और उसके अधीन तत्स्थायी प्रविष्टियों का लोप किया जाएगा ।

( ख ) " निरीक्षक श्रेणी- II " शीर्ष के स्थान पर " निरीक्षक" शीर्षक रखा जाएगा ।

5. रेल सरंक्षण बल नियम , 1987 की अनुसची IV के अधीन वर्णित " निरीक्षक श्रेणी- II " शब्दों के स्थान पर " निरीक्षक " शब्द रखा जाएगा ।

G.S.R. 14. In exercise of the powers conferred by Section 21 of the Railway Protection Force Act , 1957 (Act 23 of 1957) , the CentralGovernment , hereby makes the following rules further to amend the Railway Protection Force Rules 1987 , namely :-

1. (1 ) These rules may be called the Railway Protection Force (Amendment) Rules , 2006 .

(2) They shall come into force from the date of their publication in the official Gazette .

2. In chapter VI , in rule 78.1 , under the sub -heading "Enrolled Members of the Force , " for the first two entries relating to "Inspector (Grade - I ) and Inspector (Grade - II )" , the following entry shall be substituted , namely : ----

"Inspector : Rs . 6500-200-10,500 " 3. In schedule IV :-

The appointment and promotion rules for the posts of " Inspector Gr . - I " appearing under Schedule IV to the Railway Protection Force Rules, 1987 shall stand deleted. 4. In schedule IV:---

(a) The heading " Inspector Gr - I " and the corresponding entries thereunder shall be omitted.

(b) For the heading " Inspector Gr . - II " , substitute the heading " Inspector " .

5. The word " Inspector Gr.II " appearing under Schedule IV to the Railway Protection Force Rules, 1987 shall be substituted by the word " Inspector " ..

भारतीय पुरातत्व सर्वेक्षण

सा.का.नि. 15.- भारतीय विमानपत्तन प्राधिकरण अधिनियम , 1994 ( 1994 का 55 ) की धारा 41 की उपधारा ( 2 ) के खण्ड (छ VI ) . द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा भारतीय विमानपत्तन अपील अधिकरण ( अध्यक्ष का वेतन , भत्ते और सेवा के अन्य निबंधन और शर्तें) नियम , 2004 में निम्नलिखित संशोधन किया जाता है, यथा :-

(1 ) इन नियमों को भारतीय विमानपत्तन अपील अधिकरण अध्यक्ष का वेतन , भत्ते और सेवा के अन्य निबंधन और शर्तें ( संशोधन ) नियम, 2006 कहा जाएगा ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय विमानपत्तन अपील अधिकरण ( अध्यक्ष का वेतन , भत्ते और सेवा के अन्य निबंधन और शर्तें) नियम 14 में इनमें से किसी भी नियम शब्दों के पश्चात लिखित रूप में कारण रिकार्ड करा कर शब्द शामिल किए जाएं ।

सा.का.नि. 16. - राष्ट्रपति , संविधान के अनुच्छेद 399 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय पुरातत्व सर्वेक्षण ( वर्ग -1 और वर्ग-2 राजपत्रित पद ) भर्ती नियम , 1967 को, जहां तक उनका संबंध निदेशक ( विज्ञान ) , अधीक्षण पुरातत्व रसायनज्ञ तथा उपाधीक्षण पुरातत्व रसायनज्ञ ( भूकालानुक्रम ) और मानव संसाधन विकास मंत्रालय , संस्कृति विभाग , भारतीय पुरातत्वं सर्वेक्षण , उपाधीक्षण, पुरातत्व रसायनज्ञ , समूह ' क ' पद भर्ती नियम, 1996 से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्वकिया गया है , या करने का लोप किया गया है , भारतीय पुरातत्व सर्वेक्षण, संस्कृति विभाग में निदेशक ( विज्ञान ) , अधीक्षण पुरातत्व रसायनज्ञ तथा उपाधीक्षण पुरातत्व रसायनज्ञ के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय पुरातत्व सर्वेक्षण , निदेशक ( विज्ञान ) , अधीक्षण पुरातत्व रसायनज्ञ तथा उपाधीक्षण पुरातत्व रसायनज्ञ समूह ' क ' पद भर्ती नियम, 2006 है ।

टिप्पणीः प्रधान नियम , भारत के राजपत्र के भाग- II , खण्ड-3 , उपखण्ड ( ii ) में दिनांक 11 अक्तूबर, 2004 सां.आ. 1126 के तहत प्रकाशित किया गया था ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 88

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

2. लागू होना : ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 4. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि. - उक्त पद पर भर्ती की पद्धति , आयु- सीमा और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ (14) में विनिर्दिष्ट हैं ।

6. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

5. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या

( ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा

प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति:

प्रोन्नति , जिसके न हो सकने पर प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) द्वारा ।

10000-15200 रुपए के वेतनमान में ऐसा अधीक्षण पुरातत्व रसायनज्ञ , जिसने उस श्रेणी में पांच वर्ष नियमित सेवा की है और किसी मान्यताप्राप्त विश्वविद्यालय से रसायन में मास्टर डिग्री या समतुल्य है।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा , अपेक्षित अर्हक़/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) : - केन्द्रीय सरकार/ राज्य सरकारों/संघ राज्य क्षेत्रों/विश्वविद्यालयों/मान्यताप्राप्त अनुसंधान संस्थाओं के अधीन ऐसे अधिकारी :

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii ) जिन्होंने मूल काडर/विभाग में 10000-15200 रुपए या समतुल्य वेतनमान में नियमित आधार पर उस पद पर नियुक्तिके पश्चात् उस श्रेणी में पांच वर्ष की सेवा हो , और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं तथा अनुभव हैं:-

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से रसायन में मास्टर डिग्री या समतुल्य;

(ii ) मिश्र धातुओं, कीटनाशियों, धूमकंतत्वों और प्लास्टिक के विश्लेषण तथा अनुप्रयोजन में सात वर्ष का अनुभव ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने केपात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) पर नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा , अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

( क) ( i ) जो मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी. पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 16. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in the Supersession of the Archaeological Survey of India (Class I and Class II gazetted posts ) Recruitment Rules , 1967 in so far as they relate to the posts of Director (Science ) , Superintending Archaeological Chemist and Deputy Superintending Archaeological Chemist (Geochronology ) and the Ministry of Human Resource Development, Department of Culture , Archaeological Survey of India, Deputy Superintending Archaeological Chemist, Group' A' post Recruitment Rules, 1996 , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Director (Science ) , Superintending Archaeological Chemist and Deputy Superintending Archaeological Chemist in Archaeological Survey of India, Department of Culture , namely:-

1. Short title and commencement.( 1 ) These rules may be called the , Archaeological Survey of India , Director ( Science) , Superintending Archaeological Chemist and Deputy Superintending Archaeological Chemist, Group ' A' posts Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application. These rules shall apply to posts specified in columns 1 of the Schedule annexed to these rules .

3. Number ofposts , classification and scale of pay. The number of said posts, their classification and scale of pay attached thereto shall be specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment, age limit , qualifications , etc. The method of recruitment age limit, qualifications and other matters relating thereto shall be specified in columns 5 to 14 of the aforesaid Schedule .

5. Disqualification.--No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule.

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit , and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा०का ० नि० 17.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय पुरातत्व सर्वेक्षण के ( वर्ग -1 और वर्ग -2 राजपत्रित पद ) भर्ती नियम , 1967 , भारतीय पुरातत्व सर्वेक्षण ( वर्ग -3 , अराजपत्रित पद ) भर्ती नियम , 1968 और भारतीय पुरातत्व सर्वेक्षण ( वर्ग -2 , अराजपत्रित पद ) भर्ती नियम , 1973 को, जहां तक उनका संबंध सहायक अधीक्षण पुरातत्व रसायनज्ञ , रसायन सहायक (सहायक पुरातत्व रसायनज्ञ के रूप में पुनः पदनामित ) एवं वरिष्ठ रसायन सहायक ( सहायक पुरातत्व रसायनज्ञ के रूप से पुनः पदनामित ) है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है , या करने का लोप किया गया है , भारतीय पुरातत्व सर्वेक्षण, संस्कृति विभाग में सहायक अधीक्षण पुरातत्व रसायनज्ञ तथा सहायक पुरातत्व रसायनज्ञ ( वरिष्ठ रसायन सहायक तथा रसायन सहायक संवर्ग का विलय किया गया तथा सहायक पुरातत्व रसायनज्ञ के रूप में पुनः पदनामित किया गया ) के पदों की भर्ती की पद्धति का विनियमन करते हुए, निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय पुरातत्व सर्वेक्षण , सहायक अधीक्षण पुरातत्व रसायनज्ञ तथा सहायक पुरातत्व रसायनज्ञ , समूह ' ख ' राजपत्रित तथा अराजपत्रित पद भर्ती नियम , 2006 है ।

( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.- ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु-सीमा तथा अन्य अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति , आयु- सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

5. निरर्हताएं. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्तिः- जहां केन्द्रीय सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी। 7. व्यावृत्ति. -इन नियमों की कोई भी बात ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के लिए उपबन्ध करना अपेक्षित है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा कीगई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति: (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) केन्द्रीय सरकार/ राज्य सरकारों/संघ राज्य क्षेत्रों/विश्वविद्यालयों/मान्यताप्राप्त अनुसंधान संस्थाओं के अधीन ऐसे अधिकारी:

(क) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं; या

(ii ) जिन्होंने मूल काडर/ विभाग में 5500-9000 रु. या समतुल्य वेतनमान या समतुल्य वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में 3 वर्ष की सेवा की हो; और

(ख ) जिनके पास निम्नलिखित शैक्षिक अर्हताएं तथा अनुभव हैं :-

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से रसायन विज्ञान में मास्टर डिग्री या समतुल्य;

(ii ) मिश्र धातुओं, सिलिकेट , कीटनाशियों और प्लास्टिक के विश्लेषण तथा अनुप्रयोजन का 2 वर्ष का अनुभव ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि है, साधारणतया 3 वर्ष से अधिक नहीं होगी ।

लम्बीबीमारी या अध्ययन छुट्टी अथवा अन्य परिस्थितियों में एक वर्ष या इससे अधिक की अवधि तक बाहर रहने के कारण रिक्त हुए पदों को केन्द्रीय सरकार के निम्न अधिकारियों में से प्रतिनियुक्ति के आधार पर भरा जाएगा :-

(क ) ( 1 ) मूल संवर्ग/विभाग में नियमित आधार पर समकक्ष पदधारी अथवा

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Archaeological Survey of India (Class I and Class II Gazetted posts ) Recruitment Rules , 1967 , the Archaeological Survey of India (Class III , Non -Gazetted posts ) , Recruitment Rules , 1968 and also , the Archaeological Survey of India Class II , (Non- Gazetted posts ) Recruitment Rules , 1973 in so far as they respectively relate to the posts of Assistant Superintending Archaeological Chemist, Chemical Assistant (re - designated as Assistant Archaeological Chemist) and Senior Chemical Assistant (redesignated as Assistant Archaeological Chemist ) excepts as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Superintending Archaeological Chemist and Assistant Archaeological Chemist (cadre of Senior Chemical Assistant and Chemical Assistant were merged and re - designated as Assistant Archaeological Chemist) in Archaeological Survey of India, Department of Culture , namely: --

1. Short title and commencement.-( 1 ) These rules may be called the Archaeological Survey of India, Assistant Superintending Archaeological Chemist and Assistant Archaeological Chemist, Group " B" Gazetted and Non-Gazetted posts , Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application.-These rules shall apply to posts specified in column 1 of the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in Colunins 2 to 4 of the said Schedule.

4.Method of recruitment, age limit, qualifications etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be specified in columns 5 to 14 of the aforesaid Schedule .

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any personfrom the operation of this rule .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Ex - servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा०का ० नि० 18.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय पुरातत्व सर्वेक्षण ( सहायक अधीक्षण पुरालेखविद्) भर्ती नियम , 1955 और भारतीय पुरातत्व सर्वेक्षण अधीक्षण , ज्येष्ठ पुरालेख सहायक ( द्रविड़ , संस्कृत , अरबी और फारसी, समूह ' ख ' ) भर्ती नियम , 1996 को , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है, संस्कृति मंत्रालय , भारतीय पुरातत्व सर्वेक्षण में सहायक अधीक्षण पुरालेखविद् और सहायक पुरालेखविद्, ( द्रविड़ , संस्कृत, अरबी और फारसी अभिलेख ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय पुरातत्व सर्वेक्षण सहायक अधीक्षण पुरालेखविद् ( द्रविड़ , संस्कृत , अरबी और फारसी अभिलेख ) समूह ' ख ' पद भर्ती नियम , 2006 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना- ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ । में विनिर्दिष्ट पदों पर लागू होंगे।

3. पद- संख्या , वर्गीकरण और वेतनमान से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं । उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगें , जो इन नियमों 4. भर्ती की पद्धति, आयु- सीमा तथा अन्य अर्हताएं आदि- उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता-वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है , या (ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्तिका पात्र नहीं होगा :

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

(ii ) संबद्ध विद्याओं में प्राचीन या मध्यकालीन अभिलेखों की प्रतिलिपी बनाने या गूढ़लिपि का अर्थ निकालने और संपादन में पांच वर्ष का अनुभव।

टिप्पण 2 : प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि है , साधारणतया 3 वर्ष से अधिक नहीं होगी ।

किसी मान्यताप्राप्त विश्वविद्यालय से इतिहास में स्नातकोत्तर डिग्री जिसमें प्राचीन भारतीय इतिहास एक विषय के रूप में रहा हो और डिग्री स्तर पर तमिल/मलयालय/तेलगु कन्नड़ एक विषय के रूप में रहा हो या समतुल्य;

( ii ) संबद्ध विद्याओं में प्राचीन या मध्यकालीन अभिलेखों की प्रतिलिपि बनाने या गूढ़लिपि का अर्थ निकालने और संपादन में पांच वर्ष का अनुभव।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 18. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Archaeological Survey of India (Assistant Superintending Epigraphists ) Recruitment Rules , 1995 and the Archaeological Survey of India, Senior Epigraphical Assistants (Dravidian , Sanskrit, Arabic and Persian, Group ' B ' ) Recruitment Rules , 1996 except as respects things done or omitted to be done before such suppression, the president hereby makes the following rules regulating the method of recruitment to the posts of Assistant Superintending Epigraphists and Assistant Epigraphists , (Sanskrit, Dravidian and Arabic and Persian Inscriptions) in Archaeological Survey of India, Ministry of Culture, namely:--

1. Short title and commencement .-( 1 ) These rules may be called the Archaeological Survey of IndiaAssistant Superintending Epigraphists and Assistant Epigraphists ( Sanskrit, Dravidian and Arabic and Persian Inscriptions ) , Group 'B'posts , Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application.-- These rules shall apply to posts specified in column ( 1 ) of the schedule annexed to these rules .

3. Number of posts , classification and scale of pay.-The number of the said posts , their classification and scale of pay attached thereto shall be as specified in Columns 2 to 4 of the said Schedule .

4.Method of recruitment, age limit and other qualifications etc.-The method of recruitment age limit, qualifications and other matters relating thereto shall be as specified in Columns 5 to 14 of the said Schedule .

5. Disqualification . No person,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other partyto the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

सा०का०नि० 19.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय पुरातत्व सर्वेक्षण के ( वर्ग -1 और वर्ग -2 राजपत्रित पद ) भर्ती नियम , 1967 को, जहां तक उनका संबंध भारतीय पुरातत्त्व सर्वेक्षण में निदेशक ( पुरालेख विद्या ) के पद और भारतीय पुरातत्त्व सर्वेक्षण अधीक्षण पुरालेखविद् नियम , 1995 और भारतीय पुरातत्त्व सर्वेक्षण ( उप अधीक्षण पुरालेखविद्) भर्ती नियम , 1995 से है , उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है, संस्कृति मंत्रालय , भारतीय पुरातत्त्व सर्वेक्षण में पुरालेखविद् काडर के कतिपय समूह ' क ' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय पुरातत्त्व सर्वेक्षण , निदेशक पुरालेखविद् ( संस्कृत और द्रविड़ , तथा अरबी और फारसी अभिलेख ) और अधीक्षण पुरालेखविद् और उप-अधीक्षण पुरालेखविद् ( संस्कृत और द्रविड़, तथा अरबी और फारसी अभिलेख ) ( समूह ' क ' पद ) भर्ती नियम , 2006 है ।

(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना : -ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे।

3. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता: -वह व्यक्ति-

(क ) जिसने किसी ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

7. व्यावृति: - इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के लिए उपबन्ध करना अपेक्षित है ।

2. 10000-15200 रुपए के वेतनमान में ऐसा विभागीय अधीक्षण पुरालेखविद् (संस्कृत अभिलेख ) /अधीक्षण पुरालेखविद् ( द्रविड़ अभिलेख ) पर भी , जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की है, बाहरी व्यक्तियों के साथ विचार किया जाएगा । यदि पद पर नियुक्ति के लिए उनका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

( ii ) संबद्ध विद्याओं में प्राचीन या मध्यकालीन अभिलेखों की प्रतिलिपि बनाने या गूढ़लिपि का अर्थ निकालने और संपादन में दस वर्ष का अनुभव ।

2. ऐसा विभागीय उप अधीक्षण पुरालेखविद् ( संस्कृत अभिलेख ) और उप अधीक्षण पुरालेखविद् ( मुद्राशास्त्र ) पर भी, जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की है , बाहरी व्यक्तियों के साथ विचार किया जाएंगा । यदि पद पर नियुक्ति के लिए उनका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रान्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 4 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता

सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/ पात्रता सेवा , अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

( 2 ) ऐसा विभागीय उप अधीक्षण पुरालेखविद् ( द्रविड़ अभिलेख ) जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की है , जिसके न हो सकने पर उप अधीक्षण पुरालेखविद् ( द्रविड़ अभिलेख ) जिन्होने उप अधीक्षण पुरालेखविद् ( द्रविड़ अभिलेख ) और सहायक अधीक्षण पुरालेखविद् ( द्रविड़ अभिलेख ) की श्रेणी में आठ वर्ष की सम्मिलित नियमित सेवा की है , पर भी बाहरी व्यक्तियों के साथ विचार किया जाएगा । यदि पद पर नियुक्ति के लिए उनका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक /पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जन्न कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किंए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 3 : प्रतिनियुक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) की अवधि है , साधारणतया चार वर्ष से अधिक नहीं होगी ।

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से फारसी/ अरबी में स्नातकोत्तर डिग्री जिसमें डिग्री स्तर पर मध्यकालीन भारतीय इतिहास एक विषय के रूप में रहा हो या समतुल्य; या

( ii ) संबद्ध विद्याओं में प्राचीन या मध्यकालीन अभिलेखों की प्रतिलिपि बनाने या गूढलिपि का अर्थ निकालने और संपादन में सात वर्ष का अनुभव ।

G.S.R. 19. In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Archaeological Survey of India ( Class I and Class II Gazetted posts ) Recruitment Rules , 1967 insofar as they relate to the post of Director (Epigraphy) and the Archacological Survey of India Superintending Epigraphist Rules , 1995 and Archaeological Survey of India (Deputy Superintending Epigraphists ) Recruitment Rules , 1995 in the Archaeological Survey of India, except as respects things done or omitted to be done before such suppression, the President hereby makes the following rules regulating the method of recruitmentto certain Group ' A' posts of Epigraphy cadre in Archaeological Survey of India, Ministry of Culture , namely:-

1. Short title and commencement.-( 1 ) These rules may be called the , Archaeological Survey of India, Directors Epigraphy (Sanskrit and Dravidian , and Arabic and Persian Inscriptions ) ; Superintending Epigraphists and Deputy Superintending Epigraphists ( Sanskrit, Dravidian , and Arabic and Persian Inscriptions ) Group ' A' Posts , Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of said posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment, age limit , qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the above said Schedule .

5. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

6. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do, it may , by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
