सा.का.नि. 41. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , वित्त मंत्रालय, आर्थिक कार्य विभाग समूह - ग पदों, ऑफसेट मशीनमैन ( ग्रेड- II ) भर्ती नियम, 2006 में संशोधन हेतु निम्नांकित नियम बनाते हैं :

जाएगा । 1. ( i ) इन नियमों को वित्त मंत्रालय , आर्थिक कार्य विभाग समूह - ग पद, ऑफसेट मशीनमैन ( ग्रेड- II ) भर्ती संशोधन नियम , 2007 कहा (ii ) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. वित्त मंत्रालय , आर्थिक कार्य विभाग समूह - ग पद , ऑफसेट मशीनमैन ( ग्रेड- II ) भर्ती नियम , 2006 , में नियम 5 के स्थान पर निम्नांकित नियम प्रतिस्थापित किया जाएगा नामत :

" 5 छूट देने का अधिकार: जब केन्द्र सरकार का यह मत हो कि ऐसा करना आवश्यक या समीचीन है तो वह उन कारणों से जिन्हें लिखित में दर्ज किया जाएगा , आदेश द्वारा व्यक्तियों के किसी भी वर्ग या श्रेणी के संबंध में इन नियमों के प्रावधानों में से किसी में भी छूट दे सकती है।"

G.S.R. 41. In exercise of the powers conferred by the proviso to article 309 of the constitution, the President hereby makes the following rules to amend the Ministry of Finance , Department of Economic Affairs , Group- C posts , Offset Machineman (Grade - II ) Recruitment Rules . 2006, namely:

1.(i) these rules may be called the Ministry of Finance , Department of Economic Affairs , Group- C posts , Offset Machineman, (Grade - II ) Recruitment (Amendment ) Rules , 2007 .

(ii) they shall come into force on the date of their publication in the Official Gazette .

2. In the Ministry of Finance , Department of Economic Affairs ,Group-C posts , Offset Machineman (Grade - II ) , Recruitment rules , 2006 , for rule 5, the following rules shall be substituted, namely :

"5 Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons . "

सा.का.नि. 42. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , स्वास्थ्य विभाग , होम्योपैथिक भेषज संहिता प्रयोगशाला , गाजियाबाद , वरिष्ठ वैज्ञानिक सहायक ( रसायन ) भर्ती नियम , 1992 का संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्:

[भाग II--खण्ड 3 ( i) ]

सा.का.नि. 43. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और डा. राम मनोहर लोहिया अस्पताल ( आशुलिपिक ग्रेड- II ) भर्ती नियम , 1984 और विलिंगडन अस्पताल और नर्सिंग होम ( तृतीय श्रेणी पद ) भर्ती नियम , 1973 को, जहां तक उनका संबंध आशुलिपिकों के पद से है , उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , डा. राम मनोहर लोहिया अस्पताल , नई दिल्ली में आशुलिपिक ग्रेड- II तथा आशुलिपिक के पदों पर भर्ती की पद्धति काविनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम डा. राम मनोहर लोहिया अस्पताल , नई दिल्ली , ( आशुलिपिक श्रेणी- II और आशुलिपिक ) समूह ' ग' भर्ती नियम , 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विन्नाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जोकारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. - इन नियमों की कोई बात , ऐसे आरक्षण , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए, उपबंध करना अपेक्षित है।

प्रोन्नति : 4000-6000 रु. के वेतनमान में ऐसे आशु लिपिकों में से प्रोन्नति द्वारा जिन्होंने उस श्रेणी में आठ वर्ष सेवा की है ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/ पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलता- पूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति: केन्द्रीय सरकार के ऐसे अधिकारी :

( i) जो नियमित आधार पर सदृश पद धारण किए हुए हैं , या

( ii ) जिन्होंने 4000-6000 रु. या समतुल्य के वेतनमान में आशुलिपिक के रूप में आठ वर्ष नियमित सेवा कीहै ।

टिप्पण 1 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । टिप्पण 2 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Dr. Ram Manohar Lohia Hospital , New Delhi ( Stenographer Grade II ) Recruitment Rules , 1984 and the Willingdon Hospital and Nursing Home (Class III posts ) Recruitment Rules , 1973 in so far as it relates to post of Stenographers , except as respects things done or omitted to be done before such supersession , the president hereby makes the following rules regulating the method of recruitment to the posts of Stenographer Grade II and Stenographer in the Dr. Ram Manohar Lohia Hospital, New Delhi namely : --

1. Short title and commencement . ( 1 ) These rules may be called the Dr. Ram Manohar Lohia Hospital , New Delhi , ) ( Stenographer Grade II and Stenographer ) Group ' C ' posts , Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay. The number of said posts their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications etc. The method of recruitment , age limit , qualifications and other matters relatingto the said posts shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person.-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living . has entered into or contracted a marriage with any person ,

shall be eligible for appointment to any of the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do, itmay, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex - servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard .

Note 2 : The departmental officers in the feeder category- who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

In exercise of the powers conferred by the proviso to article 309 of the constitution , the President hereby makes the following rules to amend the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute , Raipur, Group ' C' posts (Laboratory Assistant), Recruitment Rules, 2005 , namely :-

1. ( 1) These rules may be called the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute, Raipur , Group ' C ' posts ( Laboratory Assistant) , Recruitment (Amendment ) Rules , 2007,

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute , Raipur , Group 'C' posts ( Laboratory Assistant) , Recruitment Rules , 2005-

(a) InRule 1, Sub -rule ( 1 ) , for the figure ' 2005 ' , the figure ' 2006 ' shall be substituted .

(b) In Schedule, in column 2, for the figure ' 2005 ' , the figure ' 2006 ' shall be substituted .

सा.का.नि. 45.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और आर्थिक सलाहकार का कार्यालय वर्ग " ग " पद ( कनिष्ठ अन्वेषक ) भर्ती नियम, 1979 को, जबकि मूल नियमों का संक्षिप्त नाम आर्थिक सलाहकार का कार्यालय वर्ग " ग " पद ( कनिष्ठ अन्वेषक ) भर्ती ( संशोधन ) नियम , 1979 के रूप में प्रकाशित किया गया था , उन बातों के सिवाय अधिकान्त करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , वाणिज्य और उद्योग मंत्रालय में आर्थिक सलाहकार के कार्यालय में कनिष्ठ अन्वेषक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम आर्थिक सलाहकार ( कनिष्ठ अन्वेषक ) का कार्यालय वर्ग " ग " पद भर्ती ( संशोधन ) नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या , उसका वर्गीकरण और उसका उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु - सीमा और अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु - सीमा और अन्य अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त/ उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जोकारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. - इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट, और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्यं पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण-1- आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । न कि वह अंतिम तारीख जो असम , मेघालय , अरुणाचल प्रदेश , मिजोरम , मणिपुर , नागालैंड , त्रिपुरा , सिक्किम , जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उप - खंड , अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ।

G.S.R. 45. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Office of Economic Adviser , Group ' C ' posts (Junior Investigator ) Recruitment Rules , 1979 , whereas the short title ofthe principal rules was published as the Office of Economic Adviser, Group ' C ' posts (Junior Investigator) Recruitment (Amendment) Rules , 1979 , except as respect things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Investigation in the Office ofthe Economic Adviser , Ministry of Commerce and Industry, namely: ----

1. Short Title and Commencement.- (1) These Rules may be called the Office of the Economic Adviser, ( Junior Investigator) Group ' C ' posts , Recruitment Rules , 2006.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay . The number of posts its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limits and other qualifications etc .---The method of recruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification . No person .

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules in respect of any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions requiredto be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 46.-यतः वाणिज्य और उद्योग मंत्रालय ( केन्द्रीय बायलर बोर्ड ) भारत सरकार के दिनांक 30 अक्तूबर , 2006 की अधिसूचना संख्या सा.का.नि. 274 के साथ इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव , उक्त राजपत्र अधिसूचना की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त हाने से पहले मांगने के लिए भारतीय बायलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 31 की उप - धारा ( 1 ) जो दिनांक 11 नवम्बर , 2006 के भारत के राजपत्र के भाग 2 , खंड 3 , उपखंड ( 1 ) में है, द्वारा यथा अपेक्षित भारतीय बॉयलर अधिनियम , 1950 में और संशोधन करने के लिए कुछ विनियमों के मसौदे प्रकाशित किये गये थे ;

और जबकि उक्त राजपत्र की प्रतियां आम जनता को 28 नवम्बर , 2006 को उपलब्ध करा दी गयी क्षी;

नहीं हुए थे; और जबकि उक्त मसौदे में विनिर्दिष्ट अवधि के भीतर किसी भी व्यक्ति से ऐसे मसौदों के संबंध में कोई आपत्तियां अथवा सुझाव प्राप्त अतः अब भारतीय बायलर अधिनियम, 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड एतद्वारा भारतीय बॉयलर विनियम , 1950 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है , नामत :-

1. ( 1 ) इन विनियमों को भारतीय बॉयलर ( चतुर्थ संशोधन ) विनियम , 2006 कहा जायेगा।

(2 ) ये विनियम सरकारी राजपत्र में प्रकाान की तारीख से प्रभावी होंगे

2. भारतीय बॉयलर विनियमावली , 1950 में ( जिन्हें इसमें इसके पश्चात् उक्त विनियम कहा गया है ) के विनियम 4 , खंड ( ग ) के उपखंड ( iii ) में निम्नलिखित सम्मिलित किया जाएगा , नामत :

" नोट : दाब भागों 200MW और अधिक बॉयलर क्षमता की असेंबली ड्राइंग के लिए , ड्रम हेतु 1 : 50 तथा सामान्य असेंबली ड्रांइग हेतु 1 : 100 पैमाने का प्रयोग किया जाएगा । "

3. उक्त विनियमों के विनियम 39 के लिए निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , नामतः

"39. फ्लैटनिंग टेस्ट

( 1 ) नीचे दिए गए सूत्र से गणना करके, बिना दरार या कमी के लक्षण दिखाये ट्यूब के एक खंड को जो 63 मिमी से छोटा न हो , दो समानांतर चपटी सतहों के बीच गणना की गई दूरी पर प्लेटों के बीच चपटा किया जाएगा ।

( 2 ) ( क ) प्रथम चरण के दौरान, जो कि तन्यता का परीक्षण है नीचे 39 ( 5 ) में दिये गये के अलावा , जोड़ रहित ट्यूब के अंदर, बाहर या सिरों की सतह पर या वेल्ड की गई ट्यूबों की भीतरी या बाहरी कोई भी दरार या टूटन नहीं होनी चाहिए। ( ख ) द्वितीय चरण के दौरान , जो अकाट्यता का परीक्षण है , तब तक चपटा करने का काम किया जाएगा जब तक नमूना टूटं नहीं जाता या ट्यूब की विपरीत दीवारें मिल नहीं जातीं । संपूर्ण फ्‌लैटनिंग टेस्ट के दौरान लैमिनेटिड या अकाट्यता रहित पदार्थ का प्रमाण या अपूर्ण वेल्ड का पता चलना अस्वीकार किए जाने का कारण बनेगा ।

(3 ) चपटा करने से पहले परीक्षण नमूने में सतह की अपूर्णताएं, लेकिन प्लैटनिंग टेस्ट के प्रथम चरण में पता चलने पर तैयार अपेक्षाओं के अनुसार आंकी जाएंगी।

(4) सतह अपूर्णताओं के कृत्रिम फटन अस्वीकार करने का कारण नहीं होंगे ।

(5) जब कम D- टू-१ अनुपात ट्यूबुलर उत्पादों का परीक्षण हो , तो क्योंकि छः और बारह बजने के स्थानों पर आंतरिक सतह पर ज्यामिति के कारण डाला गया तनाव अत्यधिक होता है , अतः यदि D- टू-1 अनुपात 10 से कम हो पदार्थ का कार्बन तत्व 0.25% से अधिक हो , तो इन स्थानों पर दरारें अस्वीकार करने का कारण नहीं बनेंगी। " :

4. उक्त विनियमों के विनियम 260 हेतु , निम्नलिखित प्रतिस्थापित किया जाएगा, नामतः " 260. तन्यप्ता परीक्षण "

(क) पदार्थ के विभिन्न ग्रेडों के लिए तन्यता- शक्ति विनियम 9 के खंड ( घ ) में विनिर्दिष्ट सीमाओं के भीतर होगी।

(ख) कमरे के तापमान पर , अपर यील्ड प्वाइंट , कमरे के तापमान पर विनिर्दिष्ट न्यूनतम तन्यता शक्ति के 50 % से कम नहीं होगा । (ग ) टूट दीर्धीकरण प्रतिशत में ( M-Rm ) /c से कम नहीं होगा । जहां Rm = कमरे के तापमान पर तन्यता शक्ति kgf/mm² जहां Lo N = 50 मिमी से अधिक प्लेट मोटाई के लिए 95 अथवा 50 मिमी तक की प्लेट मोटाई के लिए 100 का गुणवत्ता सूचकांक C = 2.2 केवल गेज लंबाइयों L = 5 d या L = 5.65/✓A के लिए = गेज लम्बाई A = आयताकार टेस्ट पीस का मूल क्रॉस सेक्शन d = गोल टेस्ट पीस का मूल व्यास नोट : C = परिशिष्ट- ख की टेस्ट पीस हेतु 4V A, की गेज लम्बाई के लिए 1.9 ।

(घ ) उन्नत तापमान ( Et ) पर 0.2% की प्रूफ सीमा पर दबाव की न्यूनतम मूल्य को नीचे दी गई तालिका में दिये अनुसार कमरे के तापमान ( R ) पर न्यूनतम विनिर्दिष्ट तनाव स्ट्रेंथ को अनुपात के मूल्य ( Et/R20 ) द्वारा गुणा करके गणना किया जा सकता है :-

*स्वीकृति प्रयोजनार्थ अपेक्षित कोई भी परीक्षण 300 °C से कम के तापमान के लिए 300 ° C पर किया जायेगा ( इन तापमानों पर पहले के परीक्षणों के रिकाडों की अनुपस्थिति में ) जिसमें प्रूफ दबाब का मामला कमरे के तापमान पर विनिर्दिष्ट न्यूनतम तनाव स्ट्रेंथ से गणना द्वारा प्राप्त मूल्य से कम तथा 300 ° C के लिए 0.36 प्रूफ अनुपात से ज्यादा नहीं होगा ।

5. उक्त विनियमों के विनियम 376 में खण्ड ( ff ) के लिए निम्नलिखित खण्ड को प्रतिस्थापित किया जाएगा , नामतः

" ( ff ) विशेष रूप से विद्युत ऊर्जा सृजन के लिए प्रयोग किये गये बायलरों हेतु निरीक्षण परिशिष्ट JA के उपबंधों के अनुसार किया जाएगा । "

6. ठक्त विनियमों के विनियम 520 में, निम्नलिखित को सम्मिलित किया जाएगा, नामतः

"नोट : 100 कि. ग्रा. /से.मी. तथा इससे अधिक के कार्यशील दाब पर संचालित बायलरों के लिए इकोनोमाइजर बिना फीड वाटर सिस्टम के लिए फीड वाटर डिस्चार्ज पाइपिंग इंलेट आइसोलेटिंग वाल्व को मैकेनिकल रिलीफ डिवाइस के उपबंध के साथ बायलर डिजाइन प्रेसर के आधार पर डिजाइन किया जा सकता है ताकि पाइपिंग सिस्टम को संप्रेषित किया जा रहा बॉयलर फीड पंप ( बीएफपी ) शट ऑफ प्रेसर को रोका जा सके और ऐसा फीड वाटर सिस्टम के साथ बॉयलर का फ़ीड वाटर लाइन में पिछले आइसोलेशन वाल्व हाइड्रो परीक्षण किया जाएगा । "

7. उक्त विनियमों के परिशिष्ट JA हेतु निम्नलिखितं परिशिष्ट प्रतिस्थापित किया जाएंगा , नामतः

" परिशिष्ट JA"

क. 50 कि.ग्रा. /से.मी. अथवा इससे अधिक दबाद पर कार्य करने वाले और 20 वर्ष तक पुराने विद्युत उपयोगिता बॉयलर ( 1 ) 50 कि.ग्रा./से.मी अथवा इससे अधिक दबाव पर कार्य करने वाले और 20 वर्ष तक पुराने बॉयलर , जो विद्युत सृजन हेतु भाप बना रहे हैं, का निरीक्षण विनियम 390 में दी गयी प्रक्रिया के अनुसार किये गये निरीक्षण की तारीख 12 महीने की अवधि समाप्त होने के बाद नीचे दिये गये विवरण के अनुसार किया जाएगा और राज्य में संबंधित बॉयलरों के निरीक्षक द्वारा निम्नलिखित रिकार्ड, जो कि संबंधित निरीक्षक को 272

क्रियाशील प्रमाणपत्र की अवधि के समाप्त होने के कम से कम 30 दिन पूर्व उपलब्ध कराया जायेगा , के निरीक्षण के जरिये फिटनेस प्रमाणपत्र जारी किया जाएगा बशर्ते वह सन्तुष्ट हो कि बॉयलर को 12 महीने की अवधि के लिए और आगे चलाने की अनुमति दी जा सकती है। ( क ) सुपर हीटर तथा रीहीटर के लिए आपरेशन आंकड़े डाटा अधिग्रहण प्रणाली ( डीएएस ) के उत्पादन से अप्रासंगिक होते हैं। ( ख ) पिछले वर्ष के दौरान बन्द किये जाने के कारणों सहित बन्द किये जाने तथा की गई कार्रवाई का इतिहास। ( ग ) वर्ष के दौरान बॉयलर प्रेसर पुजों पर किये गये किसी गैर -विधवंसकारी परीक्षण का रिकार्ड।

( घ ) बॉयलर की जल की गुणवत्ता ऐसे बॉयलरों की जरूरत के अनुसार रखी जानी चाहिए और ऑन लाइन गुणवत्ता के आंकड़े प्रस्तुत किये जाने चाहिए ।

( ङ ) बॉयलर टयूब के असफल होने का रिकार्ड ( स्थापना स्थल , मरम्मत की गई/ बदली गई ट्यूबों की संख्या ) । (2) विनियम 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा । फिर भी, यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्द किये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके ।

ख. 50 कि.ग्रा./से.मी. के दबाव ( प्रेसर ) तथा 20 वर्ष तक कार्य करने वाले बॉयलर :

( 1 ) विद्युत जनित्रण हेतु भाप सृजन करने वाले 50 कि.ग्रा. /से.मी. के दबाव पर कार्य करने वाले तथा 20 वर्ष तक पुराने बॉयलर विनियम 390 में दी गई प्रक्रिया के अनुसार किये गये निरीक्षण की तारीख से 12 माह की समाप्ति पर कार्यशील दबाव के समतुल्य दबाव पर हाइड्रोलिक परीक्षण के अध्यधीन होंगे और राज्य में संबंधित बॉयलरों के निरीक्षक द्वारा फिटनेस प्रमाणपत्र जारी किया जायेगा और पैराग्राफ क पर आपरेशन रिकार्ड से सन्तुष्ट हो जाने पर वह 12 महीने की दूसरी अवधि के लिए चलाये जाने की अनुमति देगा।

(2) विनिमय 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा । फिर भी , यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्द किये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके।

ग. 50 कि.ग्रा. /से.मी. अथवा उससे अधिक दबाव पर काम करने वाले , एवं 20 वर्ष से अधिक पुराने बॉयलर :

( 1 ) विद्युत उत्पादन के लिए भाप का सृजन करने वाले वे बॉयलर जो 50 कि.ग्रा . /से.मी. अथवा उससे अधिक दबाव पर कार्य कर रहे हों तथा 20 वर्ष से अधिक पुराने हों, विनियम 390 में किए गए प्रावधान के अनुसार निरीक्षण की तारीख से बारह माह की अवधि समाप्त हो जाने पर कार्य करने वाले दबाव से 1.25 गुना अधिक दबाव पर हाईड्रोलिक परीक्षण से गुजरने और राज्य के संबंधित बॉयलर निरीक्षक से फिटनेस प्रमाणीकरण प्राप्त करने की शर्त के अधीन होंगे, और पैरा संख्या क में दी गई स्थितियों और अपेक्षाओं को पूरा करने पर उन्हें आगे और बारह माह की अवधि के लिए काम करने की अनुमति दी जाएगी।

(2) विनियम 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा। फिर भी यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्द किये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके।

ख. 50 कि.ग्रा. /से.मी. तक के दबाव पर काम करने वाले और 20 वर्ष से अधिक पुराने बॉयलर :

50 कि.ग्रा. /से.मी . तक के दबाव पर काम करने वाले और 20 वर्ष से अधिक पुराने बॉयलरों का विनियम 390 में किए गए प्रावधान के अनुसार प्रति वर्ष निरीक्षण के अधीन होना जारी रहेगा ।

G.S.R. 46. Whereas certain draft regulations further to amend the Indian Boiler Regulations 1950 were published , as required by sub -section ( 1) of Section 31 of the Indian Boilers Act, 1923 (5 of 1923 ), in Part - II , Section 3, sub - section (i ) of the Gazette of India dated the 11th November , 2006, vide notification of the Government of India in the Ministry of Commerce and Industry ( Department of Industrial Policy and Promotion) (Central Boilers Board) , number G.S.R. 274, dated the 30th October, 2006 for inviting objections and suggestions from all persons likelyto be affected thereby till the expiry of the period of forty -five days from the date on which the copies of the said Gazette notification were made available to the public;

2006; And whereas the copies of the said Gazette were made available to the public on the 28th November , And whereas no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification ;

Now, therefore , in exercise of the powers conferred by Section 28 of the Indian Boilers Act 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations, 1950, namely:--

1. (1) These regulations may be called the Indian Boiler (Amendment) Regulations , 2007 .

(2) They shall come into force on the date of the publication in the Official Gazette .

2. In the Indian Boiler Regulations, 1950 (hereinafter referred to as the said regulations) , in regulation 4 in sub - clause (iii) of clause (c) , the following shall be inserted,, namely :-

"Note :-For pressure parts, assembly drawings of Boiler capacity 200 MW and above, the scale to be used is 1: 50 for drum and 1 : 100 for General Assembly drawing" .

3. For regulation 39 of the said regulations , the following regulations shall be substituted , namely :---

"39. FLATTENING TEST....

(1) A section of the tubes not less than 63 mm in length shall be flattened cold between two parallel flat surfaces to a distance between the plates ( H ) as calculated by the formula given below, without showing any sign of a crack or flaw.

Where t = specified thickness of tube (mm)

D = specified outside dia of the tube (mm)

e = a constant , as given below

c = 0.07 for carbon steel with max specified carbon above 0.18 % .

e = 0.09 for carbon steel with max specified carbon 0.18 % or less

(2) (a) During, the first step, which is a test for ductility , no crack or break , except as provided for in 39 (5 ) below , shall occur on the inside , outside , or end surfaces in seamless tubes or on the inside or outside surfaces of welded tubes .

(b) During the second step which is a test for soundness , the flattening shall be continued until the specimen breaks or the opposite walls of the tube mect . Evidence of laminated or unsound material , or of incomplete weld that is revealed during the entire flattening test shall be cause for rejection .

(3) Surface imperfections in the test specimen before flattening, but revealed during the first step of the flattening test , shall be judged in accordance with the finished requirements .

(4) Superficial ruptures resulting from surface imperfection shall not be cause for rejection.

(5) When low D-to- t ratio tubular products are tested because the strain imposed due to geometry is unreasonably high on the inside surface at the six and twelve O ' clock location , cracks at these locations shall not be cause for rejection if the D to t ratio is less than 10 and the carbon content of the material is more than 0.25% ." .

1 4. For regulation 260 of the said regulations , the following regulations shall be substituted, namely : --- "260 . TensileTest...

(a) The tensile strength of different grades of material shall be within the limits specified in clause (d) of regulation 9 .

(b) The upper yield point at room temperature shall be not less than 50 % of the specified minimum tensile strength at room temperature .

*Fortemperatures lower than 300 ° C any test required for acceptance purposes (in the absence of records of previous tests at these temperatures ) shall be made at 300 °C , in which case the proof stress shall be not less than value obtained by calculation from the specified minimum tensile strength at room temperature and the above proof- ratio of 0.36 for 300 °C. " .

5. In regulation 376 of the said regulations , for clause ( ff) , the following clause shall be substituted, namely:---

"(ff) For boilers used exclusively for electric power generation , the inspection shall be carried out in accordance with the provision of Appendix JA. "

6. In regulation 520 of the said regulations , the following shall be inserted, namely :

"Note. For boilers operating at working pressure 100 kg . sq.cm. and above , feed water discharge piping for feed water system without enconomizer inlet isolating valve can be designed based on boiler design pressure with provision of mechanical relief device, to prevent Boiler Feed Pump (BFP) shut off pressure being communicated to the piping system and with such a feed water system, boiler shall be hydro tested upto the last isolation valve in the feed water line . " .

7. For Appendix JA to the said regulations , the following appendix shall be substituted, namely : --

"APPENDIX JA

[see regulation 376 ( ff) ]

A. Power Utility boilers working at a pressure 50 kg/ cm² or more and upto 20 years of age

(1) The boilers working at a pressure 50 kg/ cm² or more and up to 20 years of age, generating steam for power generation shall be inspected as detailed below after the expiry of twelve months from the date of inspection carried out in accordance with the procedure provided in regulation 390 and certification of fitness shall be issued by the concerned Inspector of Boilers in the State , through inspection of the following records which shall be made available to the concerned Inspector of Boilers at least thirty days before the expiry of the operating certificate, provided he is satisfied that the boiler can be allowed to be operated for a further period of twelve months.

(a) Operation data for superheater and reheater temperature excursions from the output of Data Acquisition System (DAS) ..

(b) History of shut downs during the previous year with their causes and actions taken .

(d) Water quality to the boiler is maintained up to the requirement of such boilers and on line data of the quality be provided.

(e) Boiler tube failure record (location, number of tubes repaired/replaced).

(2) Inspection shall be carried out by the concerned Inspector of boilers at the expiry of twenty- four months as provided in regulation 390. However , in case shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months of the certification, the Inspector of Boilers shall be duly informed so that complete inspection can be scheduled during the said shut down period.

B. Boiler working at a pressure up to 50 kg/ cm² and up to 20 years of age.

(1) The boilers working at a pressure up to 50 kg/ cm² and up to 20 years of age generating steam for power generation shall be subjected to Hydraulic Test at pressure equivalent to the working pressure at the expiry of twelve months from the date of inspection carried out in accordance with the procedure' provided in regulation 390 and certification offitness by the concerned Inspector of boilers in the State , and having satisfied with the operation records as at paragraph A, shall be allowed for running for another period of twelve months .

(2) Inspection shall be carried out by concerned Inspector of Boilers at the expiry of twenty- four months as provided in regulation 390. However, if shutdown of fifteen days or more is planned any time before expiry of the certification period and after six months of the certification , Inspector of Boilers shall be duly informed so that inspection can be scheduled during the said shut down period.

C Boilers working at a pressure 50 kg/ cm² or more, and more than 20 years of age .

(1) Boiler working at a pressure 50 kg/ cm² or more and more than 20 years of age , generating steam for power generation, shall be subjected to Hydraulic test at a pressure 1.25 times the working pressure at the expiry of twelve months from the date of inspection as provided in regulation 390 and certification of fitness by the concerned inspector of Boilers in the State, and having satisfied the conditions and requirements as at paragraph A, shall be allowed running for another period of twelve months .

(2) inspection shall be carried out by the concerned Inspector of boilers at the expiry of twenty- four months as provided in regulation 390. सा.का.नि. 47. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और फोटो प्रभाग सूचना और प्रसारण मंत्रालय ( समूह ' क' और समूह ' ख ' पद ) भर्ती नियम, 1982 को, जहां तक उनका संबंध निदेशक फोटो प्रभाग के पद से हैं, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिकमण से पूर्व किया गया है , या करने का लोप किया गया है , सूचना और प्रसारण मंत्रालय के फोटो प्रभाग में निदेशक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सूचना और प्रसारण मंत्रालय, फोटो प्रभाग , निदेशक , समूह ' क ' पद भर्ती नियम , 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद- संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति , आयु सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता, वह व्यक्ति,-

क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

( (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. - इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

II. 10000-15200 रु. के पुनरीक्षित वेतनमान में ऐसा विभागीय उप निदेशक जिसने उस श्रेणी में पांच वर्ष नियमित सेवा की है , पर भी प्रतिनियुक्ति पर नियुक्ति किए जाने वाले व्यक्तियों के साथ विचार किया जाएगा और यदि पद पर उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

टिप्पण ( 1 ) : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति ( जिससे अतंर्गत अल्पकालिक संविदा भी है ) पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Photo Division , Ministry of Information and Broadcasting ( Group ' A' and ' B ' posts) , Recruitment Rules , 1982, in so far as it relates to the post of Director , Photo Division , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director in the Ministry of Information and Broadcasting in the Photo Division, namely:---

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Information and Broadcasting, Photo Division , Director , Group ' A ' Post Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , classification and scale of pay. The number of post, its classification and scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to the rules .

3. Method of recruitment , age limit and qualifications , etc. The method of recruitment , age limit, qualifications and other matters relating to the said post shall be as specified in columns ( 5) to ( 14) of the said Schedule .

परन्तु यह कि महा समादेष्टा होम गार्ड, प्रशिक्षण के दौरान किसी व्यक्ति द्वारा प्राप्त प्रशिक्षण के निष्पादन और स्तर को ध्यान में रखते हुए , जो कारण है उन्हें लेखबद्ध करके , ऐसी अवधि को दो वर्ष तक घटा सकेगा ।

G.S.R. 48. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the then Ministry of Surface Transport ( Group ' D ' posts ) Recruitment Rules , 1994 , except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recuitment to the Group I ) posts in the Ministry of Shipping , Road Transport and Highways :---

1. Short Title and commencement.- (i) These Rules may be called the Ministry of Shipping, Road Transport and Highways (Group ' D ' posts ) Recruitment Rules , 2007 .

(ii ) They shall come into force on the date of their publication in the Official Gazette .

2. Application . - These rules shall apply to the posts in the Ministry of Shipping , Road Transport and Highways specified in column 1 of the Schedule annexed to these rules .

3. Number of post , classification and scale of pay . The number of said posts , their classification and the scale of pay attached thereto, shall be as specified in columns 2 to 4 of the aforesaid Schedule .

4. Method of recruitment , age limit , qualifications etc. The method of recruitment , age limit , qualifications and other matters relating to the said posts shall be as specified in columns 5 to 14 of the aforesaid Schedule .

5. Disqualification . No person.---

(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing , exempt any person from the operation of this rule .

6. Liability of persons appointed as Peons to undergo Training in Home Guards . Not withstanding anything contained in these rules , every person appointed as a Peon under these rules , excepting those who are physically handicapped shall undergo training as a Home Guard for a period of three years :

Provided that the Commandant General Home Guards , may having regard to the performance of and standrad of training achieved by any person during the period of training reduce such period to two years for reasons to be recorded inwriting.

7. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect of any class or category of persons or posts .

8. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , the Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issuedby the Central Government from time to time in this regard .

(2 ) ये एक अनाज या मिलेट से या उनके संयोजन से विनिर्मित सत्तु को लागू होंगे ।

(क ) " कृषि विपणन सहलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है;

(ख) " प्राधिकृत पैकर " से ऐसा कोई व्यक्ति या व्यक्ति- निकाय प्रभिप्रेत है , जिसे इन नियमों में विनिर्दिष्ट श्रेणी मानकों और प्रक्रिया के अनुसार सत्तु के श्रेणीकरण और चिह्नांकन के लिए प्राधिकारं प्रमाणप्रत्र अनुदत्त किया गया है;

(ग ) " प्राधिकार प्रमाणपत्र " से साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के उपबंधों के अधीन जारी प्रमाणपत्र अभिप्रेत है , जो किसी व्यक्ति या व्यक्ति - निकाय को श्रेणी अभिधान चिह्नाकन से सत्तु के श्रेणीकरण और चिह्नांकन का प्राधिकार देता है;

( घ ) " साधारण श्रेणीकरण और चिह्नांकन नियम" से कृषि उपज ( श्रेणीकरण और चिह्नांकन) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 की के अधीन बनाए गए साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 अभिप्रेत है;

(ङ) " अनुसूची" से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

गयाहै । 3. श्रेणी अभिधान: - सत्तु की क्वालिटी उपदर्शित करने के लिए श्रेणी अभिधान वह होगा , जो अनुसूची 2 के स्तंभ 1 में वर्णित किया क्वालिटी की परिभाषा:-संबंधित श्रेणी अभिधानों द्वारा उपदर्शित क्वालिटी अनुसूची 2 में उल्लिखित किए गए अनुसार होगी । 4.

5. श्रेणी अभिधान चिह्न श्रेणी अभिधान चिह्न में प्राधिकरण प्रमाणपत्र संख्यांक, " एगमार्क " शब्द, वस्तु का नाम और अनुसूची । में यथावर्णित से सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक " होगा ।

6. चिह्नांकन और लेबल लगाने की पद्धति ( 1 ) श्रेणी अभिधान चिह्न प्रत्येक आधान पर ऐसी रीति में सुरक्षित रूप से लगाया जाएगा या स्पष्ट रूप से और पठनीय रूप में मुद्रित होगा , जो कृषि विपणन सहलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी प्राधिकारी द्वारा अनुमोदित किया जाए ।

(2) प्रत्येक आधान पर श्रेणी अभिधान चिह्न के अतिरिक्त , निम्नलिखित विशिष्टियां स्पष्ट और पठनीय रूप से चिह्नांकित होंगी, अर्थात्:-

(क) पैकर का नाम और पता;

(ख ) पैकिंग या विनिर्माण का स्थान;

(ग ) पैकिंग की तारीख*;

(घ) के पूर्व सर्वोत्तम;

(ङ) बैच सं.;

(च) श्रेणी;

(छ ) शुद्ध भार;

*पैकिंग की तारीख नमूने के विश्लेषण के पूरा होने की तारीख होगी । 292

( झ ) अवरोधी क्रम में भार/ भार में प्रयुक्त संघटकः

(ञ ) ऐसी अन्य विशिष्टियां , जो कृषि विपणन सलाहकार द्वारा विनिष्टि की जाएं;

(ट) खाद्य अपमिश्रण निवारण नियम , 1955 की कोई अन्य अपेक्षा; और

( ठ ) भंडारण स्थिति , यदि कोई हो ।

( 3 ) पैकेजों पर चिह्नांकन के लिए प्रयोग स्याही ऐसी क्वालिटी की होगी , जो उत्पाद को संदूषित न करे ।

(4 ) प्राधिकृत पैकर , कृषि विपणन सलाहकार या इस निमित्त या उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात्, श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिन्ह या व्यापार ब्रांड लगा सकेगा; परन्तु वह इन नियमों के अनुसार आधान में लगाए गए श्रेणी अभिधान चिन्ह द्वारा उपदर्शित क्वालिटी से भिन्न क्वालिटी उपदर्शित न करता हो । 7. पैकिंग की पद्धतिः-( 1 ) सत्तु को कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा सम्यक् रूप से अनुमोदित जूट के बने ठोस , स्वच्छ एवं शुष्क आधानों में, कपड़े के थैलों , लेमिनेटिड पोलीथीलिन या पोली प्रोपीलीन या उच्छ सघनता वाले पोलीथिलीन के थैलों, पाऊचों , जलरोधी थैलों, या किसी अन्य खाद्य श्रेणी सामग्री में ही पैक किया जाएगा ।

(2 ) आधान किसी किट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीय या असहनीय गंध से भी मुक्त होगा। (3 ) आधान को सुरक्षित रूप से बंद किया जाएगा और ऐसी रीति में सीलबंद किया जाएगा , जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित हो।

( 4) प्रत्येक पैकेज में केवल एक श्रेणी अभिधान का सत्तु होगा । एक ही बैच और श्रेणी अभिधान की श्रेणीकृत सामग्री वाले सत्तु की उपयुक्त संख्या या छोटे पैकेज जूट की थैली , लकड़ी के बक्सों, गत्तों के कार्टनों जैसे मास्टर आधान में और उसी प्रकार , मास्टर आधानों में संबंधित ब्यौरे सहित पैक किए जा सकेंगे ।

(5 ) सत्तु को , समय - समय पर , कृषि विपणन सलाहकार द्वारा जारी किए गए निदेशों के अनुसार पैकेटों के आकारों में पैक किया जाएगा।

8. प्राधिकरण प्रमाण पत्र के अनुदान के लिए विशेष शर्तें:- प्रत्येक प्राधिकृत पैकर , साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के नियम ( 3 ) के उप - नियम ( 8 ) में विनिर्दिष्ट साधारण शर्तों के अतिरिक्त, समय - समय पर, कृषि विपणन सलाहकार द्वारा विहित किए गए निम्नलिखित निदेशों का भी पालन करेगा , अर्थात्ः-

( 1 ) प्राधिकृत पैकर सत्तु की गुणवत्ता के परीक्षण के लिए साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित कैमिस्ट द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या राज्य श्रेणीकरण प्रयोगशाला या इस प्रयोजन के लिए अनुमोदित निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा ।

( 2 ) प्रसंस्करण , श्रेणीकरण , संभलाई और पैकिंग के लिए परिसर को पूर्णतः स्वास्थ्यकर और स्वच्छ दशाओं में रखा जाएगा । परिसर में पक्के फ्लोर , प्रकाश और वायु की अच्छी निकास व्यवस्था जैसी पर्याप्त भंडारण सुविधाएं होंगी और वह कृतंक और कीट संदूषण से मुक्त होगा।

(3 ) प्राधिकृत पैकर और अनुमोदित कैमिस्ट परीक्षण, श्रेणीकरण , पैकिंग , चिन्हांकन , सीलबंदी और अभिलेख के रखे जाने से संबंधित ऐसे सभी निदेशों का पालन करेगा , जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा जारी किया जाएगा।

अनुसूची-2

(नियम 3 और 4 देखिए ) सत्तु का श्रेणी अभिधान और क्वालिटी

1. सत्तु मक्का ( जिया मेयज लिन्न ) , चना ( साइसर एग्रीटीनम ) , जौ ( होड्रियम वलगेय या होड्रियम दिस्ताकोन ) , गेहूं ( ट्रिटिकम एयस्टीवम लिन्न या ट्रिटिकम वलगेयर या ट्रिटिकम देरूम देस्फ ) के साफ , धुले हुए, शुष्कित , ठोस , अनाज दाने से पृथक या कतिपय अनुपात में संयोजन से भुने हुए और पीसे हुए रूप में दलने के पश्चात् व्युत्पन्न किया जाएगा।

2. न्यूनतम अपेक्षाएं: -

(i ) सत्तु वांछित उत्कृष्टता से कूटने के पश्चात् चने , मक्के , जौ और गेहूं के स्वच्छ, धुले हुए, शुष्कित और जीवाणु ( श्रुषा) , दानों से चौकर और ठीक ऊपर के छिलके को ( मक्के की दशा में ) हटाकर तैयार किया जाएगा।

यह ,-

(क) एक समान रंग और आकार का होगा;

( ख ) उत्पाद से सहयुक्त विशिष्ट स्वाद की गंध और फ्लेवर से युक्त होगा;

( ग ) कीट संदूषक, जीवित कीटाणु , मृत कीटाणुओं, कीट गंध, फफूंदी या दमड़ी या लाखा से मुक्त होगा;

(घ ) कृतक बाल और उत्सर्ग से मुक्त होगा;

(ङ) खमीर और पुरानी महक , सीलन या किसी आक्षेपन्नीय महक से मुक्त होगा;

( च ) धूल , बाह्य पदार्थ ( जिसके अंतर्गत मिलावटी रंग भी है ) या किसी अन्य मिलावटी पदार्थों से मुक्त होगा;

(छ ) किसी फफूंदी या जीवाणु संदूषण से मुक्त होगा;

(ज ) परिरक्षित, सुगंधित अभिक्रमकों और अन्य खाद्य संयोजनों से मुक्त होगा।

(ii ) सत्तु में प्रयुक्त सभी संघटक खाद्य अपमिश्रण निवारण नियम , 1955 के उपबंधों के अधीन अनिवार्य अपेक्षाओं के अनुरूप होंगे।

(iii ) सत्तु क्रोटोलेरिया , कोरन कोकल , कोसटर बीनस , जीमसन सीडस , आरगेमोन मैक्सीकाना , खेसरी दाल और अन्य ऐसे बीजों से मुक्त होगा , जो सामान्य रूप से स्वास्थ्य के लिए हानिकारक माने जाते हैं।

(iv ) सत्तु में यूरिक ऐसिड और एफ्लाटोक्सीन क्रमशः 100 मिलीग्राम और 30 मिलीग्राम प्रति किलोग्राम से अधिक नहीं होगा । ( v ) सत्तु स्टार्च कणों के माइक्रोस्कोपिक, परीक्षण पर विशिष्ट स्टार्च संरचना प्रदर्श करेगा ।

(vi ) सत्तु विषैली धातुओं ( नियम 57 ) , फसल संदूषणों ( नियम 57क ) , प्राकृतिक रूप से उत्पन्न विषैले पदार्थों ( नियम 57ख ) कीटनाशकों और जीवनाशी अवशेषों ( नियम 65 ) और ऐसी अन्य खाद्य सुरक्षा अपेक्षाओं के, जो खाद्य अपमिश्रण निवारण नियम , 1955 के अधीन की जाएं, अवशिष्ट स्तर के भी अनुरूप होगा।

G.S.R. 49. The following draf: of certain rules called the Sattu Grading and Marking Rules, 2006, which the Central Government proposes to make in exercise of the powers conferred by Section 3 of the Agricultural Produce (Grading and Marking) Act , 1937 (1 of 1937 ), is hereby published for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of forty five days from the date on which the copies of Gazette of India containing this notification are made available to the public;

2.Any person desiring to make any suggestions or objections in respect of the said draft rules may be addressed to theAgricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, N. H. IV , Faridabad- 121001 .

3.All objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into consideration by the Central Government.

DRAFT RULES

1. Short title, application and commencement.---( 1 ) These rules may be called the Sattu Grading and Marking Rules,2006.

(2) They shall apply to Sattu manufactured from single Cereal or Millet or in combination.

(3) They shall come into force on the date of their final publication in the Official Gazette .

2. Definitions . In these rules , unless the context otherwise requires :----

(a) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India:

(b) "Authorised packer " means a person or body of persons , who has been granted the certificate of authorization to grade and mark Sattu in accordance with the grade standards and procedure as specified in these rules:

( c) " Certificate of Authorisation " means a certificate issued under the provisions of General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Sattu with the grade designation mark;

(d) "General Grading and Marking Rules " means the General Grading and Marking Rules, 1988 made under Section 3 of the Agricultural Produce ( Grading and Marking) Act, 1937 ( 1 of 1937) ;

(e ) " Schedule " means a Schedule appended to these rules .

3.Grade designation . The grade designation to indicate the quality of the Sattu shall be as set out in column 1 ofSchedule II .

4. Definition of quality.--The quality indicated by the respective grade designations shall be as mentioned in Schedule 11 .

5. Grade designation mark.- The grade designation mark shall consist of " AGMARK INSIGNIA " consisting of the design incorporating the certificate of authorization number , the word "AGMARK " , name of the commodity and grade designation resembling the one as set out in Schedule I.

6. Method of marking and labeling . ( 1) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each container in such manner as approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf.

(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked on each container ,

(a) Name and address of the packer;

(b) Place ofpacking or Manufacturing;

(d) Best before ...... ;

(e) Batch number ;

(f) Grade;

(g) Net weight ;

(h) Maximum retail price (inclusive ofall taxes) ;

(1) Ingredients used in descending order weight/weight ;

(0) Such other particulars as may be specified by the Agricultural Marketing Adviser ;

(k) Any other requirement of Prevention of Food Adulteration Rules ; 1955 and

(1) Storage condition, if any.

(3) The ink used for marking on packages shall be of the quality which may not contaminate the product .

(4)The authorized packer may , after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same does not indicate quality other than that indicated by the grade designation mark affixed to the container in accordance with these rules.

7. Method of packing (1 ) Sattu shall be packed only in sound, clean and dry containers made of jute , cloth bags , laminated polyethylene or poly propylene or high density polyethylene bags, pouches , water proof bags or any other food grade material duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf.

(2) the container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell . The container and packaging material shall be made of substances which are safe and suitable for their intended use.

(3) the container shall be securely closed and sealed in such manner as approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf.

*The date of packing shall be the date of completion of the analysis of the sample .

(4) each package shall contain Sattu of one grade designation only . Suitable number or small packets of Sattu containing graded material of the same batch and grade designation may be packed in a master container such as jute bags , wooden cases , cardboard cartons and the like with details on master containers .

In addition to the conditions specified in sub -rule (8) of rule 3 of the General Grading and Marking Rules, 1988 , every authorized packer shall follow the following instructions prescribed by Agricultural Marketing Adviser from time to time :----

(1) The authorized packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural marketing Adviser or an officer authorized by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules , 1988 for testing the quality of Sattu or have access to the State Grading 718 G1/ 07-11 296

Laboratory or Private Commercial Laboratory approved for the purpose;.

(2) The premises for processing , grading , handling and packing shall be maintained in perfect hygienic and sanitary conditions . The premises shall have adequate storage facilities with pucca floor , good ventilation for light and air and free from rodent and insect infestation ; and

(3) The authorized packer and the approved chemist shall observe all instructions regarding testing , grading , packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing Adviser or any other officer authorized by him in this behalf.

Grade designation and quality of Sattu

1. Sattu shall be derived from clean , washed , dried and sound grains of Maize ( Zea mays Linn ) , Gram (Cicer arietinum) , Barley ( Hordeum vulgare or Hordeum distichon)Wheat ( Triticum aestivum Linn or Triticum vulgare or Triticum durum Desf.) after grinding of roasted and puffed form either single or in combination in certain ratio.

2. Minimum requirements : ---

(1) Sattu shall be derived from clean , washed dried and removal of germ ( embryo ) , bran and tip cap ( in case of Maize) grains of Gram , Maize , Barley and Wheat after milling to the desired fineness .

Itshall be :-

(a) of uniform color and size ;

(b) having characteristic taste , smell and flavour associated with the product;

(d) free from rodent hair and excreta:

(e) free from fermented and musty odour , rancidity or any objectionable odour ;

(f) free from dirt, extraneous matter ( including added colours) or any other adulterants ;

(g) free from any fungal or bacteria contamination ; and

(h) free from preservatives , flavoring agents and other food additives :

(i) All ingredients used in Sattu shall conform to the mandatory requirements under the provisions of भारत का राजपत्र : मार्च 17 , 2007/फाल्गुन 26 , 1928

Prevention of Food Adulteration Rules , 1955 .

297 (iii) Sattu shall be free from toxic or noxious seeds namely Crotolaria , Corn cockle , Castor beans , Jimson seeds , argemon maxicana , Khesari dal and other seeds that are commonly recognized as harmful to health.

(iv) Sattu shall not have Uric acid and aflatoxin more than 100 milligrams and 30 micrograms per kilograms respectively.

(v) On microscopic examination of starch particles, Sattu shall exhibit characteristic starch structure.

(vi) Sattu shall also comply with the residual level of Poisonous Metals (rule 57), crop contaminants (rule 57-A) , naturally occurring toxic substances (rule 57 -B) , Insecticides and Pesticides residues (rule 65) and other food safety requirements as laid down under the provisions of Prevention of Food Adulteration Rules , 1955 .

5. Provisions concerning sizing:

Fine: Not less than 98 % ( by weight) of Sattu shall pass through 500 micron IS- sieve .

Coarse : Not less than 98 % ( by weight ) of Sattu shall pass through 1000 micron IS- sieve.
