भारत सरकार के मंत्रालयों ( रक्षा मंत्रालय को छोड़कर ) और केन्द्रीय अधिकारियों ( संघ राज्य क्षेत्र प्रशासनों को छोड़कर ) द्वारा विधि के अंतर्गत बनाए और जारी किए गए साधारण सांविधिक नियम ( जिनमें साधारण प्रकार के आदेश , उप-नियम आदि सम्मिलित हैं )

General Statutory Rules ( Including Orders , Bye- laws etc. of a general character ) issued by the Ministries of the Government of Ludia ( other than the Ministry of Defence ) and by the Central Authorities (other than the Administrations of Union Territories)

सा.का.नि. 64.-केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम , 1968 ( 1968 का 47 ) की धारा 141 की उप धारा ( 2 ) के खंड (ख ) और खंड ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और सीमा सुरक्षा बल ( नक्शानवीस और स्थापत्य सहायक ) भर्ती नियम , 1996 को उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐस अधिक्रमण से पहले किया गया है या करने से लोप किया गया है,

1. संक्षिप्त नाम और प्रारंभ.- ( 1 ) इन नियमों का संक्षिप्त नाम गृह मंत्रालय सीमा सुरक्षा बल, नक्शानवीस समूह " ख " और समूह " ग " पद ( योद्धक ) भर्ती नियम , 2007 हैं ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होनाः- ये नियम इससे उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पद/पदों को लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य 4. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि. 'बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं।

[PART II-SEC . 3 (i) ] 5. निरर्हता, वह व्यक्ति, -

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. अधिवर्षिताः-( 1 ) इन नियमों के उपबंधों के अधीन नियुक्त कोई व्यक्ति उस मास के अन्तिम दिन के अपराह्न को सेवानिवृत्त हो जाएगा जिसमें वह सत्तावन वर्ष की आयु पूरी करता है:

परन्तु ऐसा व्यक्ति जिसकी जन्म की तारीख किसी मास की पहली तारीख है वह सत्तावन वर्ष की आयु पूरी करने पर पूर्ववर्ती मास के अन्तिम दिन के अपराहन को सेवानिवृत्त हो जाएगा।

(2 ) किसी भी व्यक्ति को उप नियम ( 1 ) में यथा विनिर्दिष्ट सेवानिवृत्ति की आयु से परे सेवा में विस्तार प्रदान नहीं किया जाएगा । 7. चिकित्सक दृष्टत्ता योग्यताः-( 1 ) इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी , केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप- I में है , इन नियमों के उपबन्धों के अधीन नियुक्ति के लिए पात्र होंगे ।

स्पष्टीकरण : इन नियमों के प्रयोजन के लिए , " शेप " पद निम्नवत् परिभाषित हैं :

(i ) दिए गए कारकों के अधीन अधिकारी की योग्यता का निर्धारण करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा, वर्गीकरण जिसे कूट अक्षर एस एच ए पी ई द्वारा उपदर्शित किया गया है , निम्नलिखित कृत्य को व्यपदिष्ट करता है: - मनोवैज्ञानिक

( ii ) प्रत्येक कारक के अधीन किसी अधिकारी की कार्यशील क्षमता प्रत्येक कूट अक्षर के सामने अंक 1 से 5 तक द्वारा गिरती हुई कार्यशील दक्षता को उपदर्शित करते हुए संदान किया जाएगा । अंक , सिवाय वहां के जहां कोई अधिकारी सभी कारकों में श्रेणी I में हैं, कूट अक्षर से आगे लिखे जाएंगे , उसका प्रवर्ग एस -1 एच 1 ए-1 पी -1 ई -1 लिखने के बाजाय शेप -1 लिखकर संदान किया जा सकेगा । इन अंकों का साधारण मूल्यांकन निम्नवत् है:-

(क) कहीं भी सभी कर्तव्यों के लिए योग्य।

( ख ) सभी कर्तव्यों के लिए योग्य किन्तु कर्तव्य तथा नियोजनीयता के क्षेत्रों के प्रकारों के बारे में सीमाएं इस पर निर्भर करते हुए हो सकेगी कि कर्तव्यों में तीव्र स्वराधात अंतर्वलित है या दोनों कानों/ आंखों के श्रवण गोचरता/दृष्टि की तीक्ष्णता की आवश्यकता है। (ग ) " एस " कारक के सिवाय, नैत्यिक या घात में बैठकर करने वाले कर्तव्यों के लिए योग्य हों किन्तु उच्च स्थान ( 2,700 मीटर से ऊपर ) अति ठण्डे क्षेत्र का पहाड़ी भू भाग पर और दीर्घ कालिक समनुदेशनों के लिए नियोजनीयता की सीमाएं हो सकेगी। ( घ ) चिकित्सालय सावधि या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रूप में अयोग्य।

( ङ ) कर्तव्यों के लिए स्थायी रूप से अयोग्य।

8. वर्दी और आधारित प्रशिक्षण :-इन नियमों के उपबंधों के अधीन नियुक्त व्यक्तियों को वर्दी पहननी होगी और सिविल पदों से नियुक्त व्यक्तियों को , उस विषय पर जो महानिदेशक द्वारा समय - समय पर विनिर्दिष्ट किया जाए , उनकी आरंभिक नियुक्ति कर नौ सप्ताह का आधारिक प्रशिक्षण सफलतापूर्वक पूरा करना होगा ।

9. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 10. व्यावृत्ति, - इन नियमों की कोई भी बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों लिए उपबंध करना अपेक्षित है । भारत का राजपत्र : अप्रैल 21 , 2007/वैशाख 1 , 1929

केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारियों में से :

(i) जो नियमित आधार पर सदृश पद धारण किए हुए हैं, या

(ii ) जिन्होंने 5500-9000 रु. की श्रेणी में तीन वर्ष नियमित सेवा की है और जिसके पास सिविल या यांत्रिकी इंजीनियरी में डिप्लोमा सहित तीन वर्ष का अनुभव है,

(iii ) जिन्होंने 5000-8000 रु. की श्रेणी में छह वर्ष नियमित सेवा की है ।.

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहींहोगी।

टिप्पण 3 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी । 380

साधारण केन्द्रीय सेवा , समूह ' ग ' , अराजपत्रित , अनुसचिवीय (योद्धक )

18 से 25 वर्ष के बीच (केन्द्रीय सरकार द्वारा समय समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों, या अनुसूचित जातियों या अनुसूचित जनजातियों लिए 5 वर्ष तथा अन्य पिछड़ें वर्गों के लिए तीन वर्ष तक शिथिल की जा सकती है । टिप्पण 1 : आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से जो ( अंदमान और निकाबोर द्वीप तथा लक्षद्वीप में के है ) से भिन्न अभ्यर्थियों से प्राप्त करने के लिए अन्तिम तारीख होगी । टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की -जाने वाली भर्ती की दशा में , आयु सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

ऊंचाई : 167.5 सें. मी.

सीना : 80 सें.मी. ( फुलाने के पश्चात् 85 सें.मी. )

वजन : ऊंचाई के तत्समान ।

टिप्पण : ( 1 ) न्यूनतम मापदंड, जहां तक इसका संबंध उंचाई से है , उन व्यक्तियों जो गढ़वाली , कुमाऊं, गोरखा , डोगरा , मराठा, सिक्किमीजैसे मूल वंशों के हैं , लेह और ल‌द्दाख, कश्मीर घाटी उत्तरपूर्वी राज्यों तथा हिमाचल प्रदेश राज्य के व्यक्तियों की बाबत 165 सें.मी. तक शिथिल किया जा सकता है ।

(2) न्यूनतम मापदंड , जहां तक इसका संबंध ऊंचाई से है , आदिवासियों या जनजातियों जिनमें मिजो तथा नागा है, की बावत 162.5 सें.मी. तक शिथिल किया जा सकता है ।

(3 ) न्यूनतम मापदंड, जहां तक इसका संबंध सीना के माप से है , आदिवासियों या जनजातियों के लिए क्रमशः 80 से. मी. बिना फुलाए तथा 85 सें.मी. फुलाकर को 78 सें.मी. बिना फुलाए और 83 सें.मी. फुलाकर तक शिथिल किया जा सकता है ।

( घ ) महिलाओं के लिए शारीरिक मापदंड :

ऊंचाई : 157 में. मी.

सीना : सुविकसित होना चाहिए

वजन : ऊंचाई के तत्समान

टिप्पण: ( 1 ) न्यूनतम मापदंड , जहां तक इसका संबंध उंचाई से है , उन व्यक्तियों को गढ़वाली , कुमाऊं , गोरखा , डोगरा , मराठा ,सिक्किमी जैसे मूल वंशों के है , लेह और लद्दाख, कश्मीर घाटी उत्तरपूर्वी राज्यों तथा हिमाचल प्रदेश राज्य के व्यक्तियों की बाबत 155 सें.मी. तक शिथिल किया जा सकता है ।

( 2) न्यूनतम मापदंड , जहां तक इसका संबंध ऊंचाई से है , आदिवासियों या जनजातियों जिनमे मिजो तथा नागा है , की बाबत 152.5 सें.मी. तक शिथिल किया जा सकता है ।

( ङ) सभी प्रकार के चिकित्सीय दृष्टि से उपयुक्त होना चाहिए (ऑख दृष्टि 6/6 और आँखों की 6/9 बिना सुधार अर्थात् बिना चश्मे या लैंस पहने ) ।

( च ) शारीरिक दक्षता परीक्षण , लिखित परीक्षा , व्यवसाय परीक्षा और साक्षात्कार में अर्हित होना चाहिए ।

G.S.R. 64. In exercise of the powers conferred by clauses (b) and (c) of sub -section (2 ) of Section 141 of the Border Security Force Act, 1968 (47 of 1968 ) , and in supersession of the Border Security Force (Draftsman and Architectural Assistant) Recruitment Rules , 1996, except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules , namely :-

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Home Affairs , Border Security Force Draftsman Group 'B ' and Group ' C ' Post (Combatised) recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application . These rules shall apply to the posts specified in column 1 of the schedule annexed to these rules.

3. Number of posts , classification and scale of pay. The number of posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule .

4. Method of recruitment , age limit , qualifications etc. The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns 5 to 14 of the aforesaid Schedule .

5. Disqualification . No person,--

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and there are other grounds for so doing , exempt any person from the operation of this rule. 6. Superannuation. ( 1) The person appointed under these rules shall retire from service on the afternoon of the last day of the months in which he attains the age of fifty seven years :

Provided that the person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty seven years .

(2) No persons shall be granted extension in service beyond the age of superannuation as specified in sub- rule(1).

7. Medical Fitness .-Notwithstanding anything contained in these rules , only persons who are in medical category SHAPE- I, shall be eligible for appointment under the provisions of these rules .

Explanation . For the purpose of these rules , the term SHAPE - I is defined as under :

(i) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function :

S-Psychological

H--Hearing

A--Appendages

P-Physical Capacity

E--Eye-Sight

(ii) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter indicating declining functional efficiency. The numerals will be written next to the code letter , except that where an officer is in Grade - I in all factors , his category may be denoted by writing SHAPE- I instead of writing SH, APE , General evaluation of these numerals is as under:

(a) Fit for all duties anywhere .

(b) Fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing/vision of both ears or eyes .

(c) Excepting "S" factor , fit for routine or sedentary duties but may have limitations of employability at high altitude ( above 2,700 meters ) extreme cold areas or hilly terrain and for long assignments .

(d) Temporarily unfit for duties on account of hospitalization or sick leave.

(e) Permanently unfit for duties .

Uniform and basic training .-Persons appointed under the provisions of these rules shall have to wear the uniform and the persons appointed from the civil posts shall have to complete successfully nine weeks basic training on their initial appointment on subject as may be specified, from time to time , by the Director General .

9. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect of any class or category of persons .

10. Saving . Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , Ex - Servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 65.- केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम, 1968 ( 1968 का 47 ) की धारा 141 की उपधारा ( 2 ) के खंड ( ख ) और खंड ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सीमा सुरक्षा बल में कांस्टेबल ( दफ्तरी ) के योधक पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल , योधक कांस्टेबल ( दफ्तरी ) समूह ' ग ' भर्ती नियम, 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान, उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति , आयु-सीमा और अन्य अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति. - इन नियमों की कोई बात, ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , अन्य पिछड़े वर्गों भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by clauses (b) and ( c) of sub - section (2) of Section 141 of the Border Security Force Act , 1968 (47 of 1968 ) , the Central Government hereby makes the following rules , regulating the method of recruitment to the combatised posts of Constable ( Daftry ) in the Border Security Force , namely :-- 1. Short title and commencement .-( 1 ) These rules may be called the Border Secutiry Force , Combatised Constable (Daftry ) Group ' C ' post Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts, classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns ( 2 ) to ( 4 ) of the Schedule annexed hereto .

3. Method of recruitment , age limit , qualifications , etc. The method of recruitment , to the said post age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5 ) to (14 ) of the said schedule .

4. Initial Constitution.-Persons holding the posts in the cadre as Constable (Daftry ) on regular basis immediately before commencement of these rules , shall be deemed to have been appointed in accordance with the provisions of these rules and the regular and continuous service of such personnel held immediately before comemncement of these rules shall be counted for the purspose of probation period , confirmation and pension in the service .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons .

7. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes Ex - Servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. लागू होना, - ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं।

In exercise of the powers conferred by proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to Group ' C ' and Group ' D ' posts in the Ministry ofFinance , Department of Revenue , Financial Intellegence Unit- India (FIU - IND ) , namely :---

1. Short title and commencement. ( 1 ) These rules may be called the Financial Intellegence Unit-India (Group 'C' and Group ' D ' Posts) Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. Thsese rules shall apply to the posts specified in column ( 1 ) of the Schedule annexed to these rules .

3. Number of posts , classification and scale of pay. The number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .

4. Method of recruitment , age limit and other qualifications etc. The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the aforesaid Schedule .

5. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
