सा.का.नि. 110. - राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत के महारजिस्ट्रार एवं पदेन जनगणना आयुक्त का कार्यालय में उप महारजिस्ट्रार ( भाषा ) भर्ती नियम , 1982 का अधिक्रमण करते हुए , ऐसे अधिक्रमण से पहले की गई अथवा लोप की जाने वाली कार्यवाही को छोड़कर , भारत के महारजिस्ट्रार का कार्यालय में सहायक महारजिस्ट्रार ( भाषा ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का नाम भारत के महारजिस्ट्रार का कार्यालय सहायक महारजिस्ट्रार ( भाषा ) समूह ' क' पद भर्ती नियम , 2007 होगा ।

( 2 ) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण और वेतनमान : इस पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से 4 में विनिर्दिष्ट है ।

3. भर्ती की पद्धति , आयु सीमा, शैक्षणिक अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, शैक्षणिक अर्हताएं और उक्त पद से सम्बन्धित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से 14 में विनिर्दिष्ट हैं ।

4. मिरर्हताएं : वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से , जिसका पति या पत्नी जीवित है , विवाह किया है , या

[PART II-SEC . 3( i ) ] (ख ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी अन्य व्यक्ति से विवाह किया है, उक्त पर पर नियुक्ति का पात्र नहीं होगा :

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन , है वहां वह , उसके लिए जो कारण हैं उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों के बारे में , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति : इन नियमों की कोई भी बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस सम्बन्ध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

अनिवार्य :

(i ) किसी मान्यताप्राप्त विश्वविद्यालय से भाषा विज्ञान में स्नातकोत्तर डिग्री अथवा समकक्ष ( ii ) भाषा विज्ञान के क्षेत्र में अनुसंधान का दस वर्ष का अनुभव ।

टिप्पणी 1 : आवेदक को अन्यथा सुअर्ह होनें की दशा में संघ लोक सेवा आयोग के विवेकानुसार अर्हताओं में छूट दी जा सकती है ।

टिप्पणी 2 : यदि चयन के किसी स्तर पर संघ लोक सेवा आयोग की यह राय है कि अ. जा. अथवा अ.ज.जा. के लिए आरक्षित पदों को भरने के लिए अपेक्षित अनुभव रखने वाले इन समुदायों के आवेदक पर्याप्त संख्या में उपलब्ध नहीं हैं तो संघ लोक सेवा आयोग लिखित में कारण दर्ज करते हुए विवेकानुसार ऐसे आवेदकों के मामले में अनुभव संबंधी अर्हता में छूट दे सकता है । [ भाग II- खण्ड 3 (i) ]

वांछनीय: (i ) किसी मान्यता प्राप्त विश्वविद्यालय से एक विषय के रूप आवेदक की मातृभाषा से अलग भारत के संविधान की आठवीं अनुसूची में विनिर्दिष्ट किसी भाषा सहित स्नातक डिग्री अथवा समकक्ष ।

(ii ) किसी मान्यता प्राप्त संस्थान से चीनी/फ्रेंच/स्पेनिश/ जापानी/रूसी भाषा में डिप्लोमा अथवा समकक्ष । (iii ) समाजशास्त्र/नृविज्ञान अनुसंधान में एक वर्ष का अनुभव ।

( iv) तीन वर्ष का प्रशासनिक अनुभव ।

भर्ती की पद्धति भर्ती सीधे होगी या प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा और विभिन्न पद्धतियों के आधार पर भरी जाने वाली रिक्तियों की प्रतिशतता

1. भारत के महारजिस्ट्रार

I. केन्द्रीय सरकार/राज्य सरकार/संघ राज्यक्षेत्र/ विश्वविद्यालय/मान्यता प्राप्त अनुसंधान संस्थान/ लोक उद्यम/अर्ध सरकारी /सांविधिक अथवा स्वायत संगठन के अन्तर्गत ऐसे अधिकारी :

(क) ( i ) जो अपने मूल संवर्ग/विभाग में नियमित आधार पर सदृश पद धारण किए हों; अथवा ( ii ) जिन्होंने अपने मूल संवर्ग/विभाग में 10000- 15200/- रुपए या समकक्ष वेतनमान में पद पर नियमित आधार पर नियुक्ति के बाद पांच वर्ष की सेवा की हो;

(ख) जो कालम 8 में सीधी भर्ती के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों ।

II . बाह्य आवेदकों के साथ - साथ ग्रेड में पांच वर्ष की नियमित सेवा विभागीय वरिष्ठ अनुसंधान अधिकारी ( भाषा ) भी नियुक्ति के लिए विचार किए जाने के पात्र होंगे । यदि ऐसे व्यक्तियों का पद पर नुियक्ति के लिए चयन हो जाता है तो इसे प्रोन्नति द्वारा भरा हुआ माना जाएगा ।

प्रत्येक अवसर पर संघ लोक सेवा आयोग से परामर्श करना आवश्यक है ।

फीडर वर्ग में विभागीय अधिकारी जो प्रोन्नति की सीधी लाइन में हैं वे प्रतिनियुक्ति पर नियुक्ति के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्ति पर नियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के पात्र नहीं होंगे ।

केन्द्रीय सरकार के उसी या अन्य संगठन/विभाग में इस नियुक्ति से तुरंत पहले धारित किसी अन्य संवर्ग बाह्य पद पर प्रतिनियुक्ति की अवधि (अल्पावधि संविदा सहित ) सहित प्रतिनियुक्ति की अवधि (अल्पावधि संविदा सहित ) सामान्यतः तीन वर्ष से अधिक नहीं होगी ।

प्रतिनियुक्ति (अल्पावधि संविदा सहित ) द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन पत्र प्राप्त होने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होनी चाहिए ।

G.S.R. 110. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in super- session of the office of the Registrar General , and ex - officio Census Commissioner for India Deputy Registrar General (Language) Recruitment Rules , 1982, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Registrar General (Language) in the Office of the Registrar General , India , namely :-

1. Short title and commencement .-( 1 ) These rules may be called the Office of the Registrar General , India , Assistant Registrar General (Language) Group ' A' Post Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and scale of pay. The number of post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit, educational qualifications ,etc. The method of recruitment, age limit , educational qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification.-No person , .-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex - Servicemen , and other Special Categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

II : The departmental Senior Research Officer (Language ) with five years ' regular service in the grade shall also be considered along with outsiders and in case he is slected for appointment to the post the same shall be deemed to have beenfilledby promotion .

(The departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly , deputationists shall not be eligible for consideration for appointment by promotion .

Periodofdeputation ( including short -term contract) including period of deputation (includaiy short-term contract ) in another ex-cadrepost held immediately preceeding this appointment in the same or some other Organisation/Department of the Central Government shall ordinarily not exceed three years .

2. पद-संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ (4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी। 6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के अन्य मंत्रालय/ विभागों/राज्य सरकारों/केन्द्रीय पुलिस संगठनों में ऐसे स्टाफ कार चालक :-

(i ) जिन्होंने मूल काडर/ विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है; या

(ii ) मूल काडर/विभाग में ऐसे स्टाफ कार चालक श्रेणी -1 , जिन्होंने 3050-4590 रुपए या समतुल्य को वेतनमान की उस श्रेणी में नियमित आधार पर नियुक्ति के पश्चात् तीन वर्ष सेवा की हो; और

जो निम्नलिखित शैक्षिक अर्हताएं और अनुभव रखते हों :-

( i ) केन्द्रीय सरकार/ राज्य सरकारों/केन्द्रीय पुलिस संगठनों में अति विशिष्ट व्यक्तियों के साथ बुलेट प्रूफ कार चलाने का दो वर्ष का अनुभव; और

(ii ) जिन्होंने विशेष संरक्षा ग्रुप के अधीन छह माह का कमांडो प्रशिक्षण लिया है और निम्नलिखित उत्तीर्ण किया है : -

(क) उक्त प्रयोजन के लिए संचालित व्यवसाय प्रशिक्षण , जिसका पाठ्यक्रम निम्नानुसार होगा:

( i ) अंग्रेजी संख्यांक और अंकों को पढ़ने में समर्थ हो;

(ii ) यातायात विनियमों का संपूर्ण ज्ञान रखता हो ;

( iii ) बुलेट प्रूफ कारों के कार्यकरण का अच्छा ज्ञान रखता हो और दोषों को ढूंढने तथा लघु परिचालन संबंधी त्रुटियों का सुधार करने में समर्थ हो;

(iv ) कारबोरेटर प्लग आदि को साफ करने में समर्थ हो;

(v) उपरोक्त ( i ) से ( iv ) पर आधारित व्यावहारिक प्रशिक्षण । 575 [ भाग II- खण्ड 3 ( i ) ]

टिप्पण 1 : प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहींहोगी ।

G.S. R. 111. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Staff Car Driver (Bullet Proof) in the office of Union Public Service Commission , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Union Public Service Commission Staff CarDriver (Bullet Proof) Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay . The number of post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment, age limit, qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 14) of the said Schedule .

4. Disqualification. No person,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

5. Powerto relax . Where the Central Government is of opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Schedulred Castes , Scheduled Tribes , the ex - servicemen and other special categories of . persons in accordance with the orders issued by the Central Government from time to time in this regard.

(i) must be able to read the English numerals and figures;

(ii) must have a thorough knowledge of traffic regulations;

(iii) must have good knowledge of working of Bullet Proof Cars and should be able to locate faults and rectify minor running defects;

(iv) must be able to clear carburetor , plug etc. and

(b) practical test based on ( i) to ( iv) above .

/सा.का.नि. 113. - राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और चिकित्सा महाविद्यालय , पांडिचेरी ( वर्ग 3 और वर्ग 4 पद ) भर्ती नियम , 1959 को, जहां तक उनका संबंध प्रयोगशाला सहायक के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, जवाहर लाल स्नातकोत्तर चिकित्सा शिक्षा एवं अनुसंधान संस्थान , पांडिचेरी में प्रयोगशाला सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभः ( 1 ) इन नियमों का संक्षिप्त नाम जवाहर लाल स्नातकोत्तर चिकित्सा शिक्षा एवं अनुसंधान संस्थान , पांडिचेरी में ( प्रयोगशाला सहायक ) 'समूह ' ग ' पद भर्ती नियम , 2007 है ।

( 2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण और वेतनमानः उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट है ।

3. भर्ती की पद्धति , आयु सीमा, अर्हताएं आदिः उक्त पद पर भर्ती की पद्धति, आयु- सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए, किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.- इन नियमों की कोई बात , ऐसे आरक्षण , आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

सा.का.नि. 114.- केन्द्रीय सरकार , रेल संरक्षण बल अधिनियम , 1957 ( 1957 का 23 ) , की धारा 21 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेल संरक्षण बल नियम , 1987 का , उन बातों के सिवाय , जो ऐसे संशोधन से पूर्व की गई थी या किए जाने से लोप किया गया था, संशोध न करने के लिए , निम्नलिखित नियम बनाती है , अर्थात्:-

( 1 ) इन नियमों का संक्षिप्त नाम रेल संरक्षण बल ( संशोधन ) नियम , 2007 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । [ भाग II- खण्ड 3 (i ) ]

2. रेल संरक्षण बल नियम , 1987 में नियम 49 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्ः-

"49. भर्ती की प्रक्रिया

49.1 उपनिरीक्षकों के पदों के लिए सीधी भर्ती के लिए चयन , रेल संरक्षण बल या रेल संरक्षण विशेष बल के महानिरीक्षक या अपर महानिरीक्षक , उप महानिरीक्षक का पद धारण कर रहे ऐसे चार व्यक्तियों की एक विभागीय समिति द्वारा किया जाएगा जो महानिदेशक द्वारा नामनिर्दिष्ट होंगे और जहां ऐसे चयन में अनुसूचित जातियों/ अनुसूचित जनजातियों/पिछड़े वर्गों के लिए आरक्षित पदों के लिए चयन सम्मिलित है, वहां यथास्थिति , अनुसूचित जातियों या अनुसूचित जनजातियों, या पिछड़े वर्गों के एक ऐसे अधिकारी को, जो उक्त पदों में से कोई पद धारण कर रहा हो , महानिदेशक द्वारा ऐसी समिति में से एक सदस्य के रूप में नामनिर्दिष्ट किया जाएगा ।

49.2 कांस्टेबल के पदों के लिए सीधी भर्ती के लिए चयन , क्षेत्रीय रेलवे या रेल संरक्षण विशेष बल के महानिरीक्षक/उपमहानिरीक्षक द्वारा नामनिर्देशित कमांडेंट या वरिष्ठ कमांडेंट के पदधारण कर रहे चार व्यक्तियों की विभागीय समिति द्वारा किया जाएगा , और जहां ऐसे चयन में अनुसूचित जातियों/ अनुसूचित जनजातियों/पिछड़े वर्गों के लिए आरक्षित पदों के लिए चयन शामिल है , वहां यथास्थिति , अनुसूचित जातियों/अनुसूचित जनजातियों/पिछड़े वर्गों के एक ऐसे अधिकारी को , 'जो उक्त पदों में से कोई पद धारण कर रहा हो , महानिरीक्षक/उप महानिरीक्षक द्वारा ऐसी समिति में एक सदस्य के रूप में नामनिर्दिष्ट किया जाएगा। 49.3 चयन करने के लिए स्थान इस प्रकार नियत किए जाएंगे जिससे यथास्थिति , विभिन्न क्षेत्रों या राज्यों से सर्वोत्तम प्रतिभावान व्यक्ति आकर्षित किए जा सकें और चयन केवल उन आवेदकों तक सीमित नहीं होगा जिनके नाम रोजगार कार्यालयों या अन्य ऐसे सरकारी अभिकरणों द्वारा भेजे जाते हैं ।

49.4चयन की प्रक्रिया इस प्रकार तैयार की जाएगी जिससे :-

(क) प्रतिरूपण होने की संभावनाएं कम की जा सकें;

(ख ) प्रारंभिक अवस्था में ऐसे सभी अभ्यर्थियों को हटाया जा सके जो विचार किए जाने के अनुपयुक्त हैं ।

अंतिम चयन , परीक्षण के एक समान मानकों के आधार पर किया जाएगा, जिसके लिए मार्गदर्शक सिद्धांत महानिदेशक द्वारा विहित किए जाएंगे । "

G.S.R. 114. In exercise of the powers conferred by Section 21 of the Railway Protection Force Act, 1957 (23 of 1957) , the Central Government hereby makes the following rules further to amend the Railway Protection Force Rules , 1987 , except as respect things done or omitted to be done before such amendment , namely :-

1. ( 1 ) These rules may be called the Railway Protection Force (Amendment) Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Railway Protection Force Rules , 1987 , for rule 49 the following rule shall be substituted , namely:-

"49. Procedure of recruitment :

49.1 Selection for direct recruitment to the posts of Sub - Inspectors shall be made by a departmental committee of four persons holding the post of Inspector General or Additional Inspector General , Deputy Inspector General of Railway Protection Force or Railway Protection Special Force who shall be nominated by the Director General and where such selection includes the selection for reserved posts for the Scheduled Castes/ Scheduled Tribes or the Backward Classes , one Officer holding any of the said posts and belonging to the Schedule Castes or the Scheduled Tribes or the Backward Classes , as the case may be , shall also be nominated by the Director General to be a member in such committee.

49.2 Selection for direct recruitment to the posts of Constables shall be made by a departmental committee of four persons holding the post of Commandant or Senior Commandant nominated by the Inspector General /Deputy Inspector General of the Zonal Railway or Railway Protection Special Force and where such selection includes the selection for reserved posts for the Scheduled Castes/ Scheduled Tribes or the Backward Classes , one officer holding any of the said posts and belonging to the Scheduled Castes / Scheduled Tribes or the Backward Classes , as the case may be , shall also be nominated by the Inspector General/Deputy Inspector General to be a member in such committee.

49.3 Places for holding selections shall be so fixed as to attract best talents from various regions

[PART II-SEC . 3 (i ) ] or States , as the case may be , and need not be restricted merely to the applicants sponsored by the employment exchange or other such Government agencies .

49.4 Procedure of selection shall be so evolved as to:-

(a) reduce the chances of impersonation;

(b) eliminate at the initial stage all such candidates who are unfit for consideration; and

Final selection shall be based on uniform standards of tests for which guidelines shall be prescribed by the Director General" .

सा.का.नि. 115.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय परीक्षणशाला , मुख्यालय और क्षेत्रीय कार्यालय ( समूह ' घ ' पद ) भर्ती नियम , 1991 को, जहां तक उनका संबंध प्रयोगशाला परिचर , श्रेणी -2 से है , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने से लोप किया गया है , राष्ट्रीय परीक्षणशाला , उपभोक्ता मामले विभाग , कोलकाता में प्रयोगशाला परिचर श्रेणी-2 के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. -( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय परीक्षणशाला , मुख्यालय और क्षेत्रीय कार्यालय प्रयोगशाला परिचर श्रेणी-2 ( समूह ' घ ' पद) भर्ती नियम , 2007 है । (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति , आयु- सीमा , और अन्य अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु- सीमा अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति, -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

(ख ) जिसने , अपने पति या अपनी पत्नी के जीवित रहते हुए, किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

1. परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the National Test House , Headquarters and Regional Offices (Group 'D' posts) Recruitment Rules , 1991 in so far as they relate to the post of Laboratory Attendant Grade - II , except as respects things done or omitted to have been done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Laboratory Assistant Grade - II , in the National Test House , Department of Consumer Affairs , Kolkata, namely :-

1. Short title and commencement. ( 1 ) These rules may be called the National Test House , Headquarters and Regional Offices , Laboratory Attendant Grade - II ( Group 'D' Posts ) , Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number of posts, classification and scale of pay.-The number of the said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of recruitment, age limit, and other qualifications etc. The methodof recruitment , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.

4. Disqualification.-No person ,- (a) who has entered into or contracted a marriage with a person having a spouse living ; οι

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satified that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds , for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, any for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex -Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
