सा.का.नि. 147.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कार्मिक , लोक शिकायत और पेंशन मंत्रालय , ( कार्मिक और प्रशिक्षण विभाग ) , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी ज्येष्ठ कार्यक्रमक, कार्यक्रमक ( रिप्रोग्राफिक ) और आंकड़ा प्रक्रमण सहायक श्रेणी ' क' भर्ती नियम , 2003 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1.-( 1 ) इन नियमों का संक्षिप्त नाम कार्मिक , लोक शिकायत और पेंशन मंत्रालय , ( कार्मिक और प्रशिक्षण विभाग ) , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी ज्येष्ठ कार्यक्रमक , कार्यक्रमक ( रिप्रोग्राफिक ) और आंकड़ा प्रक्रमण सहायक श्रेणी ' क ' भर्ती (संशोधान ) नियम, 2007 है ।

(2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. कार्मिक , लोक शिकायत और पेंशन मंत्रालय, ( कार्मिक और प्रशिक्षण विभाग ) , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी ज्येष्ठ कार्यक्रमक , कार्यक्रमक ( रिप्रोग्राफिक ) और आंकड़ा प्रक्रमण सहायक श्रेणी ' क ' भर्ती नियम , 2003 में,-

(i ) नियम 6 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्:-

"6. शिथिल करने की शक्ति : जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जोकारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेंगी ।"

[PART II-SEC . 3 ( i )] ( ii ) अनुसूची में , आंकड़ा प्रक्रमण सहायक श्रेणी ' क ' के पद के लिए स्तंभ 11 की विद्यमान प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: --

" प्रोन्नति, जिसके न हो सकने पर प्रतिनियुक्ति द्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

टिप्पण: -आंकड़ा प्रक्रमण सहायक श्रेणी ' क ' पद के नियमित पदधारी की, 1600-2660 रुपए के पूर्व पुनरीक्षित वेतनमान के इस पद के 5500-9000 रुपए ( पुनरीक्षित ) के उन्नयन से पूर्व , उन्नत पद पर नियुक्ति के लिए उपयुक्ता सक्षम प्राधिकारी द्वारा जांची जाएगी । यदि ' उपयुक्त पाया जाता है तो वह प्रारंभिक गठन पर पद पर नियुक्त किया गया समझा जाएगा । यदि उन्नत वेतनमान पर नियुक्ति के लिए ' उपयुक्त नहीं' पाया जाता है तो वह 5000-8000 रुपए के पुनरीक्षित वेतनमान में बना रहेगा और उसके मामले का प्रत्येक वर्ष पुनर्विलोकन किया जाएगा।

G.S.R. 147. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Ministry of Personnel , Public Grievances and Pensions , (Department of Personnel and Training ) , Lal Bahadur Shastri National Academy of Administration Senior Programmer , Programmer (Reprographic) and Data Processing Assistant Grade ' A' Recruitment Rules , 2003 , namely: ---

1. (1 ) These rules maybe called the Ministry of Personnel , Public Grievances and Pensions , ( Department of Personnel and Training ) , Lal Bahadur Shastri National Academy of Administration Senior Programmer , Programmer (Reprographic) and Data Processing Assistant Grade ' A' Recruitment (Amendment ) Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Personnel , Public Grievances and Pensions ( Department of Personnel and Training ) , Lal Bahadur Shastri National Academy of Administration , Senior Programmer , Programmer ( Reprographic ) and Data Processing AssistantGrade ' A' Recruitment Rules , 2003,-

(i) for rule6, the following rule shall be substituted , namely: -

"6. Power to Relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , itmay by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission . relax any of the provisions of these rules with respect to any class or category of persons ".

(ii ) in the Schedule , for the post of Data Processing Assistant Grade ' A' , in column 11 , for the entry , the following entry shall be substituted , namely :-

"Promotion failing which by deputation failing both by direct recruitment .

Note: The suitability of the regular holder of the post of Data Processing Assistant Grade ' A' in the pre - revised scale of Rs.1600-2660 prior to upgradation of this post in the scale of Rs . 5500-9000X ) ( revised) will be initially assessed for appointment to the upgraded post . If assessed ' suitable ' , he shall be deemed to have been appointed to the post at the initial constitution . If assessed ' Not suitable ' for appointment to the upgraded scale of pay he shall continue to be in the revised scale of Rs . 5000-8000 and his case would be reviewed every year . "

सा.का.नि. 148.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी कार्यालय स्थापन समूह ग और समूह घ पद भर्ती नियम, 2001 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकादमी कार्यालय स्थापन समूह ग और समूह घ पद भर्ती संशोधन नियम , 2007 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे । [भाग II-खण्ड 3 ( i) ]

2. लाल बहादुर शास्त्री राष्ट्रीय प्रशासन अकाद‌मी कार्यालय स्थापन समूह ग और समूह घ पद भर्ती नियम , 2001 की अनुसूची में, क्रम संख्यांक 16 के सामने , नर्स पद के लिए-

(i ) स्तंभ 5 में, विद्यमान प्रविष्टि के स्थान पर, निम्नलिखित रखा जाएगा , अर्थात्:-

"लागू नहीं होता " ।

( ii ) स्तंभ 11 में , विद्यमान प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है )/आमेलन, जिसके न हो सकने पर सीधी भर्ती द्वारा ।

टिप्पण: -

1. आमेलन केवल केंद्रीय और राज्य सरकार पदधारियों के लिए अनुज्ञेय होगा ।

2. अनुभव संबंधी अर्हता ( अर्हताएं ) सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है । "

( iii ) स्तंभ 12 में , विद्यमान प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" केन्द्रीय या राज्य सरकार या स्थानीय प्राधिकारी या पब्लिक सेक्टर उपक्रमों के अधिकारी , जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ है या 4500-7000 रुपए के वेतनमान में तीन वर्ष नियमित सेवा की है और स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित शैक्षिक अर्हताएं रखते हों । ( प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति: प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

G.S.R. 148. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Lal Bahadur Shastri National Academy of Administration, Office Establishment Group C and D posts Recruitment Rules , 2001, namely:

1. ( i) These rules may be called the Lal Bahadur Shastri National Academy of Administration, Office Establishment Group C and D posts Amendment Rules , 2007.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the scheduleto the Lal Bahadur Shastri National Academy of Administration , Office Establishment Group C and D posts Recruitment Rules , 2001 , against serial number 16, for the post ofNurse:

(i) in column5 for the existing entry , the following entry shall be substituted, namely: - " Not applicable" .

(ii) in column 11 for the existing entries , the following entries shall be substituted, namely :

"By deputation ( including short term contract)/ absorption failing which by direct recruitment .

Note:

1.Absorption will be permissible only to Central and State Government Officials .

2. The qualification (s ) regarding experience is/are relaxable at the discretion of the competent authority in the case of candidates belonging to Scheduled Caste and the Scheduled Tribes , if at any stage of selection competent authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them",

(iii) in column 12 for the existing entries , the following entries shall be substituted, namely:

"Officers of the Central or State Government or local authority or Public Sector undertaking holding analogous posts on regular basis or with 3 years regular service in the scale of Rs.4500-7000 and having qualifications prescribed for direct recruitment in colurnn 8 (The period of deputation including the period ofdeputation in other ex -cadre posts preceding this appointment in the same or some other organization shall not ordinarily exceed 3 years) Deputation: The maximum age limit for appointment on deputation shall not exceed 56 years as on the closing date of receipt of applications" .

सा.का.नि. 149.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रीय सत्रुक्षा परिषद् सचिवालय समूह ' ग ' पद ( भर्ती ) नियम 2005 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय सुरक्षा परिषद् सचिवालय , समूह ' ग ' ( भर्ती ) संशोधन नियम , 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. राष्ट्रीय सुरक्षा परिषद् सचिवालय , समूह ' ग ' ( भर्ती ) नियम , 2005 की अनुसूची में, --

( स्तंभ 8 , में , स्टाफ कार ड्राइवर ( सामान्य श्रेणी ) के पद से संबंधित क्रम संख्यांक 5 के सामने , मद ( iv ) में, प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: -

"सरकारी/पब्लिकसेक्टर उपक्रम/प्राइवेट संगठन में मोटर कार चलाने का कम से कम तीन वर्ष का अनुभव "

(2) स्तंभ 8 में, सवार हरकारा के पद से संबंधित क्रम संख्याक 6 के सामने , मद ( ii ) में , प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टिरखी जाएगी , अर्थात्ः-

" सरकारी/पब्लिक सेक्टर उपक्रम/प्राइ‌वेट संगठन में मोटर साइकिल/आटो रिक्शा चलाने का दो वर्ष का अनुभव "।

1. (1) These rules may be called the National Security Council Secretariat , Group ' C ' ( Recruitment) Amendment Rules, 2007..

(2) They shall come into force from the date of their publication in the Official Gazette.

2. In the Schedule to the National Security Council Secretariat , Group ' C ' posts (Recruitment ) Rules , 2005, -- (1) In column8 , against serial number 5 relating to the post of Staff Car Driver ( Ordinary Grade) , in item ( iv ) , for the entry the following entry shall be substituted , namely:-

"Experience of driving a Motor Car at least for three years in Government/Public Sector Undertaking/Private Organisation" ;

(2) In column8 , against serial number 6 relating to the post of Despatch Rider , in item ( ii ), for the entry the following entry shall be substituted , namely:-

""Two years experience in driving Motor Cycle/Autorickshaw in Government/Public Sector Undertaking/Private Organisation".

सा.का.नि 150.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वित्त मंत्रालय , व्यय विभाग ( वेतन अनुसंधान एकक ) भर्ती नियम, 1969 को, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है , वित्त मंत्रालय के व्यय विभाग में अनुसंधान सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थातः-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम वित्त मंत्रालय , व्यय विभाग वेतन अनुसंधान एकक , ( अनुसंधान सहायक ) भर्ती नियम , 2007 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनमान : उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । [ भाग II- खण्ड 3 ( i ) ]

3. भर्ती की पद्धति , आयु सीमा , अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता:- वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(केन्द्रीय सरकार द्वारा समय-समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों के लिए 5 वर्ष तक शिथिल की जा सकती है । अनुसूचित जाति/अनुसूचित जनजाति के अभ्यर्थियों के लिए केन्द्रीय सरकार के अनुदेशों के अनुसार शिथिल की जा सकती है। )

टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । (न कि वह अंतिम तारीख जो असम , मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर , नागालैंड , त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड , हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है। ) 742

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से सांख्यिकी/संक्रिया अनुसंधान या गणित/अर्थशास्त्र/वाणिज्य ( सांख्यिकी सहित ) में स्नातकोत्तर डिग्री या समतुल्य ।

( ii ) सांख्यिकी आंकड़ों से संग्रहण , संकलन, विश्लेषण और निर्वचन संबंधी कार्य का 2 वर्ष का अनुभव।

टिप्पण 1: -अर्हता , अन्यथा सुअर्हित अभ्यर्थियों की दशा में कर्मचारी चयन आयोग के विवोकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2:-अनुभव संबंधी अर्हता ( अर्हताएं ) कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब 'चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों को पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है।

वांछनीय :

( i ) बड़े पैमाने पर सांख्यिकीय आंकड़ों के संग्रहण के लिए उपयुक्त अनुसूचियां बनाने और तैयार करने का अनुभव ।

( ii ) संगणना संबंधी कार्य करने का अनुभव ।

(iii ) नमूना सर्वेक्षणों के माध्यम से सांख्यिकीय कार्य का अनुभव ।

भर्ती की पद्धति : मर्ती सीधे होगी या प्रोन्नति

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/ आमेलन किया जाएगा

द्वारा या प्रतिनियुक्तिआमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नति: ऐसे कनिष्ठ अनुसंधान सहायक , जिन्होंने 5000-8000 रुपए वेतनमान में छह वर्ष नियमित सेवा की है ।

(i ) 50 % प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्तिद्वारा , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।

( ii ) 50% सीधी भर्ती द्वारा ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा , अपेक्षित अर्हक/ पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

उपयुक्तता खंड: अनुसंधान सहायक पद के नियमित पद्धारी की , अनुसंधान सहायक के 6500-10500 रुपए के उन्नत पद पर नियुक्ति के लिए उपयुक्तता सक्षम प्राधिकारी द्वारा जांची जाएगी । यदि उपयुक्त पाया जाता है तो वह प्रारंभिक गठन पर पद पर नियुक्तकिया गया समझा जाएगा । यदि उन्नत वेतनमान पर नियुक्ति के लिए उपयुक्त नहीं पाया जाता है तो वह 5500-9000 रुपए के पुनरीक्षित वेतनमान में बना रहेगा और उसके मामलों का प्रत्येक वर्ष पुनर्विलोकन किया जाएगा । 743 [ भाग II- खण्ड 3 (i ) ]

प्रतिनियुक्ति: (क ) केंद्रीय सरकार या 'राज्य सरकारों या संघ राज्य क्षेत्रों के अधीन

ऐसे अधिकारी-

( i ) जिन्होंने मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किया हुआ है;या

( ii ) जिन्होंने मूल काडर या विभाग में 5500-9000 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् तीन वर्ष सेवा की हो; बा

( iii ) जिन्होंने मूल काडर या विभाग में 5000-8000 रुपए या समतुल्य के वेतनमान में नियमित आधार पर उस पद पर नियुक्ति के पश्चात् छह वर्ष सेवा की हो; और

(ख ) स्तंभ 8 के अधीन सीधी भर्ती के लिए विहित किए गए अनुभव और शैक्षिक अर्हताएं रखता हो ।

टिप्पण 1: - पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। टिप्पण 2: - प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी । टिप्पण 3: - प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

GSR. 150--In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession ofthe Ministry of Finance, Department of Expenditure (Pay Research Unit) Recruitment Rules , 1969, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Research Assistant in the Ministry of Finance , Department of Expenditure , namely :--

1. Short title and commencement ( 1 ) These rules may be called the Ministry of Finance , Department of Expenditure, Pay Research Unit (Research Assistant ) Recruitment Rules , 2007 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification and scale of pay-The number of post , its classification and the scale ofpay attached thereto , shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

[PART II-SEC . 3 (i ) ) 3. MethodofRecruitment, age limit, qualifications etc. The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4.Disqualification-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or ,

(b) who, having a spouse living has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may,by order and for reasons to be recorded in writing , and in consultation with Union Service Commmission relax any ofthe provisions of these rules with respect to any class or category of persons .

6. Saving-Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.

of such qualifying/eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/ eligibility service.

Suitability Clause : The suitability of the regular holder of the post of Research Assistant will be initially assessed by the competent authority for appointment tothe upgraded post of Research Assistant in the scale of Rs . 6500-200-10500. If assessed ' suitable ' , he shall be deemed to have been appointed to the post at the initial constitution. If assessed ' not suitable ' for appointment to the upgraded scale ofpay he shall continue to be in the revised scale of Rs . 5500-175-9000 and his case would be reviewed every year .

Deputation:

Officers under the Central Government or State Governments or Union Territories:

(a)( i ) holding analogous post on regular basis in the parent cadre/department ; or

( ii ) with three years ' service in the grade rendered after appointment thereto on as regular basis in the scale of pay of Rs . 5500-9000 or equivalent in the parent cadre/department; or

(iii) with six years ' service in the grade rendered after appointment thereto on as regular basis in the scale of pay of Rs . 5000-8000 or equivalent in the parent cadre/department; and

(b) possessing the educational qualifications and experience prescribed for direct recruits under column 8 .

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation . Similarly deputationist shall not be eligible for consideration for appointment by promotion.

Note2 : The period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not exceed three years .

सा.का.नि. 151. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , स्वास्थ्य और परिवार कल्याण मंत्रालय में सवार हरकारा समूह ' ग ' पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-- 1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्रालय , सवार हरकारा समूह ' ग ' पद भर्ती नियम , 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद- संख्या, वर्गीकरण और वेतनमान: उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. आरंभिक गठन : इन नियमों के प्रारंभ पर नियुक्त ऐसे सभी व्यक्ति जिन्होंने नियमित आधार पर इससे उपाबद्ध अनुसूची में विनिर्दिष्ट पद धारण किया हुआ है । इन नियमों के अधीन उस रूप में सम्यकतः नियुक्त किए गए समझे जाएंगे । इन नियमों से पूर्व उनके द्वारा ली गई सेवा उनकी अगली अपनी अपनी श्रेणियों में प्रोन्नति आदि के लिए पात्रता विनिश्चित करने के लिए ली जाए ।

4. भर्ती की पद्धति, आयु- सीमा, अहंताएं आदि उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट है ।

5. निरर्हता: वह व्यक्ति--

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

6. शिथिल करने की शक्ति:

जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति

इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

' घ ' कर्मचारी जिनके पास स्तंभ 8 में सीधी भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हता और अनुभव है ।

भूतपूर्व सैनिकों के लिए प्रतिनियुक्ति/पुनर्नियोजन पर अन्तरण

सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिज़र्व में स्थानांतरित किए जाने वाले हैं और .जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है ; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है। (प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले भारित किसी अन्य काडर बाड़ा पद पर प्रतिनियुक्तिकी अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी ।

G.S.R. 151. In exercise of the powers conferredby the proviso to article 309 of the Constitution, thePresi- dent hereby makes the following rules regulating the method of recruitment to the post of Dispatch Rider, Group 'C' Post in the Ministry ofHealth and Family Welfare , namely:-

1. Short title and commencement---( 1 ) These rules may be called the Ministry of Health and FamilyWelfare, Dispatch Rider, Group ' C' Post Recruitment Rules 2007.

(2) They shall come into force on the date oftheir publication in the Official Gazette.

2. Number ofpost, classification and scale of pay-The number of the post, its classification and scale of pay attached thereto shall be specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Initial Constitution-All persons appointed at the commencement of these rules holding the post specified in the Schedule annexed hereto on regular basis shall be deemed to have been duly appointed as such under these rules . The service rendered by them before the commencement of these rules shall be taken into account for deciding the eligibility for promotion, etc. to the next respective grades.

4. Method ofRecruitment, age limit, qualificattion etc. The method of recruitment to the said post, age limit qualifications and other matters relating threto shall be as specified in columns 5 to 14 of the said, Schedule.

5. Disqualification-No Person-

(a) who has entered into or contracted a marriage with a person having a spouse living; or, 750

(b) who , having a spouse living has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving-Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note: The qualifications regarding experience are relaxable atthe discretion of the competent authority for reasons tobe recorded in writing in the case of candidates belonging to Scheduled Castes and the Scheduled Tribes if at any stage of selection the competent Authority is of the opinion that sufficient number of candidates possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

TheArmed Forces personnel due to retire or who are to be transferred to reserve within period of one year and having the requisite experience and educational qualification prescribed for direct recruits shall also be considered. Such persons wouldbe givendeputation terms upto the date on which they are due for release fromthearmed forces; thereafter they may be continued on re-employment.

(Theperiod ofdeputation including the period of deputation in another ex -cadre post held immediatley preceeding this appointment in the same or some other organization/Department of the Central Govt. shall ordinarily not exceedthree years).

सा.का.नि. 152. राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भूतल परिवहन मंत्रालय ( सड़क खंड) ( समूह ' ग ' और ' घ ' पद ) भर्ती नियम , 1994 को अधिक्रांत करते हुए, पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय, के सड़क परिवहन और राजमार्ग विभाग में पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , आर्थात्ः-- 1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय , सड़क परिवहन और राजमार्ग ( समूह ' ग ' और ' घ ' पद ) भर्ती नियम , 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना-ये नियम , इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद-संख्या , वर्गीकरण और वेतनमान उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु-सीमा , अर्हताएं आदि- उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति:-इन नियमों की कोई बात ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1- प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है , साधारणतया तीन वर्ष से अधिक नहींहोगी।

प्रोन्नति: पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय के सड़क परिवहन और राजमार्ग विभाग के क्षेत्रीय कार्यालयों या इंजीनियर संपर्क कार्यालयों में कार्यरत ऐसे श्रेणी ' घ ' कर्मचारियों में से , जो मैट्रिकुलेशन या समतुल्य अर्हता रखते हैं और जिन्होंने उस श्रेणी में 10 वर्ष नियमित सेवा की है।

टिप्पण 1 : प्रोन्नति पर सभी नियुक्तियां इस शर्त के अधीन होगी कि अभ्यर्थी को पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय के सड़क परिवहन और राजमार्ग विभाग द्वारा आयोजित अंग्रेजी या हिंदी टंकण परीक्षा उत्तीर्ण करनी होगी । उसे ऐसी परीक्षा अपनी नियुक्ति की तारीख से एक वर्ष की अवधि के भीतर अंग्रेजी टंकण में 30 शब्द प्रति मिनट या हिंदी टंकण में 25 शब्द प्रति मिनट की न्यूनतम गति से उत्तीर्ण करनी होगी , जिसके न हो सकने पर उसे तब तक कोई वेतनवृद्धि अनुज्ञात नहीं की जाएगी , जब तक वह उक्त परीक्षा उत्तीर्ण नहीं कर लेता है ।

टिप्पण 2 : यदि कोई अभ्यर्थी परिवीक्षा अवधि के भीतर उक्त टंकण परीक्षा उत्तीर्ण नहीं कर लेता है तो वह अपनी अधिष्ठायी नियुक्ति पर या निचली श्रेणी में अपनी नियुक्तिसे पहले धारित अस्थायी पद पर प्रतिवर्तित हो जाएगा ।

In exercise of the powers conferredby the proviso to article 309 of the Constitution, and in supersessionofthe Ministry of Surface Transport (Roads Wing) (Group ' C' and ' D' Post) Recruitment Rules , 1994, the Presidenthereby makes the following rules regulating the method of recruitment to the posts in the Ministry of Shipping, Road Transport and Highways , Department of Road Transport and Highways , namely:-

1. Short title and commencement-( 1 ) These rules maybe called the Ministry of Shipping, Road Transport andHighways, Department of Road Transport and Highways (Group ' C' and ' D' Posts ) Recruitment Rules 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

5. Disqualification-No Person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or ,

(b) who , having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any personfrom the operation of this rule.

6. Powerto relax-Where the Central Government is of the opinion that it is necessary or expedient so todo, it may,by order, for reasons to be recorded in writing , relax any of the provisions ofthese rules with respect of any class or category ofpersons or posts.

7. Saving-Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes, Ex -servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 153.-शिकांकाई श्रेणीकरण और चिह्नांकन नियम , 2007 का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार , कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3. द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और शिकाकाई पाउडर श्रेणीकरण और चिह्नांकन नियम , 1973 को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया था या करने का लोप किया गया है , बनाने का प्रस्ताव करती है , उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने कीसंभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर , उस तारीख से , जिसको इस अधिसूचना से युक्त भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं , पैंतालिस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;

उक्त प्रारूप नियमों के संबंध में कोई सुझाव या आक्षेप करने का इच्छुक कोई व्यक्ति के ऊपर विनिर्दिष्ट अवधि के भीतर कृषि विपणन सलाहकार, भारत सरकार, विपणन और निरीक्षण निदेशालय , प्रधान कार्यालय एनएच- IV , फरीदाबाद-121001 को उसे केन्द्रीय सरकार के विचार के लिए अग्रेषित कर सकेगा ।

प्रारूप नियम

1. संक्षिप्त नाम , लागू होना और प्रारंभः-

( 1) इन नियमों का संक्षिप्त नाम शिकाकाई श्रेणीकरण और चिह्नांकन नियम , 2007 है ।

(2) ये शिकाकाई फलियों और भारत में तैयार एकासिया कोनसिना डी. सी. [ एकासिया सिनोट ( लोअर ) मेरिल सिन ] की फलियों से अभिप्राप्त पाउडर को लागू होंगे ।

(3) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(i ) " प्राधिकृत पैकर " से ऐसा कोई व्यक्ति या व्यक्ति- निकाय अभिप्रेत है , जिसे इन नियमों के अधीन विहित श्रेणी मानकों और प्रक्रिया के अनुसार शिकाकाई फलियों और शिकाकाई पाउडर के श्रेणीकरण और चिह्नांकन के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया जाए;

(ii ) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है ;

(iii) " प्राधिकार प्रमाणपत्र " से साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के उपबंधों के अधीन जारी प्रामाणपत्र अभिप्रेत है , जो किसी व्यक्ति या व्यक्ति- निकाय को श्रेणी अभिधान और चिह्नांकन से शिकाकाई फलियों और शिकाकाई पाउडर के श्रेणीकरण और चिन्हांकन का प्रधिकार देता है;

(iv) " साधारण श्रेणीकरण और चिह्नांकन नियम " से कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम , 1937 ( 19371 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 अभिप्रेत है ;

( v) " श्रेणी अभिधान " से शिकाकाई फलियों और शिकाकाई पाउडर की क्वालिटी उपदर्शित करने वाला कोई विहित अभिधान अभिप्रेत है वह ऐसा होगा जो अनुसूची 2 और 3 के स्तंभ 1 में उपवर्णित होगा;

(vi ) " श्रेणी अभिधान चिह्न ' से नियम 3 में निर्दिष्ट " एगमार्क प्रतीक " अभिप्रेत है;

(vii) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

(

viii ) " शिकाकाई फलियों " से एकासिया कोनसिना डी. सी. [ एकासिया सिनोट ( लोअर ) मेरिल सिन ] से अभिप्राप्त फलियां अभिप्रेत हैं;

(ix ) " शिकाकाई पाउडर " से एकासिया कोनसिना डी. सी. [ एकासिया सिनोट ( लोअर ) मेरिल सिन ] की फलियों को पीस कर अभिप्राप्त किया गया उत्पाद अभिप्रेत है ।

3. श्रेणी अभिधान चिह्न:- श्रेणी अभिधान चिह्न में प्राधिकार प्रामणपत्र संख्यांक, " एगमार्क " शब्द, वस्तु का नाम और अनुसूची 1 में यथा उपवर्णित के सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक " होगा । 4. क्वालिटी: - शिकाकाई फलियों और शिकाकाई पाउडर की क्वालिटी वह होगी जो अनुसूची 2 और अनुसूची 3 में उपवर्णित होगी । [भाग II- खण्ड 3 ( i ) ]

5. पैकिंग की पद्धतिः-

( 1 ) शिकाकाई फलियों और शिकाकाई पाउडर को कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा सम्यक् रूप से अनुमोदित जूट के बने ठोस , स्वच्छ एवं सुष्क आधानों में , गत्ते के कार्टमों में, कपड़े के थैलों , लैमिनेटिड पॉलीथिलिन या पॉलीप्रोपिलीन या उच्च सघनता वाले पॉलीथिलीन के भैलों , पाठचों या किसी अन्य पैकेजिंग सामग्री में ही पैक किया जाएगा;

(2) आधान किसी कीट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीय या असहनीय गंध से भी मुक्त होगा;

(3) शिकाकाई फलियों और पाउडर को ऐसी रीति में पैक किया जाएगा ताकि उत्पाद की उचित रूप से संरक्षा हो सके । आधान को सुरक्षित रूप से बंद किया जाएगा और ऐसी रीति में बंद किया जाएगा जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधि- कृत किसी अधिकारी द्वारा अनुमोदित हो;

(4) पैकेज के अंदर प्रयुक्त सामग्री नई , स्वच्छ और ऐसी क्वालिटी की होनी चाहिए जिससे कि उत्पाद को कोई क्षतिकारिश होने से बचाया जासके;

(5 ) सामग्री विशिष्ट रूप से कागज या व्यापार विनिर्देशों वाली स्टेम्पों का उपयोग अनुज्ञात किया जाता है बशर्ते कि मुद्रण और लेबल अविषैली स्याही या ग्लु से लगाया गया है;

(6) प्रत्येक पैकेज में केवल एक ही श्रेणी अभिधान की फलियां या पाउडर होगा । उसी लाट/ बैच की श्रेणीकृत सामग्री वाले शिकाकाई फलियों या पाउडर की उपयुक्त संख्या या छोटे पैकेट जूट की थैली , लकड़ी के बक्सों , गत्तों के कार्टनों आदि जैसे मास्टर आधानों में उनसे संबंधित ब्यौरों सहित पैक किए जा सकेंगे ।

(7) शिकाकाई फलियों और पाउडर को, समय - समय पर कृषि विपणन सलाहकार द्वारा जारी किए गए अनुदेशों के अनुसार पैकेटों के आकारों में पैक किया जाएगा ।

6. चिह्नांकन की पद्धतिः -

( 1 ) श्रेणी अभिधान चिह्न प्रत्येक पैकेज पर ऐसी रीति से सुरक्षित रूप से लगाया जाएगा या मुद्रित होगा , जो साधारण श्रेणीकरण और चिह्नांकन नियम, 1988 के नियम 11 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित किया जाए ।

( 2 ) प्रत्येक पैकेज पर श्रेणी अभिधान चिह्न के अतिरिक्त, निम्नलिखित विशिष्टियां स्पष्ट और पठनीय रूप से चिह्नांकित होंगी , अर्थात्: - (क) वस्तुका नाम;

(ख) किस्म;

(ग) श्रेणी अभिधान;

(घ) आकार कोड (यदि विहित हो) ;

(ङ) पैकर का नाम और पता;

(च) शुद्ध भार/ यूनिट की संख्या;

(छ) भंडारणस्थिति , यदि कोई हो;

(ज) उद्गम का देश;

(झ ) पैकिंग की तारीख *;

(ञ) के पूर्व उपभोग सर्वोत्तम ( जहां भी लागू हो ) ;

(ट) लाट/बैच संख्या;

(क) पैकिंग/विनिर्माण का स्थान;

(क ) कोई अन्य विशिष्टियां जो कृषि विपणन सलाहकारं द्वारा विनिर्दिष्ट की जाएं ।

( 3 ) पैकेजों पर चिह्नांकन के लिए प्रयुक्त स्याही ऐसी क्वालिटी की होगी जो उत्पाद को संदूषित न करे ।

(4 ) प्राधिकृत पैकर, कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात् श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिह्न या व्यापार ब्रांड लगा सकेगा परंतु वह इन नियमों के अनुसार श्रेणीकृत पैकेजों पर लगाए गए श्रेणी अभिधान चिह्न द्वारा उपदर्शित क्वालिटी से भिन्न क्वालिटी उपदर्शित न करता हो ।

7. शिकाकाई फलियों और शिकाकाई पाउडर को निर्यात के लिए क्रेता की अपेक्षाओं के अनुसार श्रेणीकृत और चिह्नांकित किया जा सकेगा परंतु वह सुसंगत अनुसूची में विनिर्दिष्ट न्यूनतम अपेक्षाओं को पूरा करता हो ।

8. प्राधिकार प्रमाणपत्र को अनुदत्त करने के लिए विशेष शर्तें : -

साधारण श्रेणीकरण और चिह्नांकन नियम , 1988 के नियम 3 के उपनियम ( 8 ) के अधीन विनिर्दिष्ट शर्तों के अतिरिक्त इन नियमों के प्रयोजनों के लिए जारी किए गए प्रत्येक प्राधिकार प्रमाणपत्र की विशेष शर्तें निम्नलिखित होंगी :-

(1 ) प्राधिकृत पैकर शिकाकाई फलियों और पाउडर की क्वालिटी का परीक्षण करने के लिए साधारण श्रेणीकरण और चिह्नांकन नियम 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित अर्हित रसायनज्ञ द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या उस प्रयोजन के लिए अनुमोदित राज्य श्रेणीकरण प्रयोगशाला या निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा;

(2) परिसरों को स्वास्थ्यप्रद और स्वच्छता की दशाओं में रखा जाएगा जिनमें उचित संवातन और अच्छे प्रकाश की व्यवस्था होगी । इन संक्रियाओं में लगे हुए कार्मिकों का अच्छा स्वास्थ्य होगा और वे किसी संसर्गण , संक्रामक या संचारी रोग से मुक्त होंगे ;

(3) परिसरों में पर्याप्त भंडारण सुविधाएं होंगी जिनका पक्का फर्श होगा तथा कृन्तक और कीटों के आकीर्णन से मुक्त होंगे ;

(4) प्राधिकृत पैकर और अनुमोदित रसायनज्ञ परीक्षण , श्रेणीकरण , पैकिंग , चिह्नांकन , सीलबंद करने और अभिलेखों के रखे जाने से संबंधित ऐसे सभी अनुदेशों का पालन करेंगे जो समय - समय पर कृषि विपणन सलाहकार या इस निमित्त समय - समय पर उसके द्वारा प्राधिकृत किसी अन्य अधिकारी द्वारा जारी किए जाएं ।

(i ) शिकाकाई फलियां:

(क) अविकल और ठोस होंगी ;

(ख) स्वच्छ; अच्छी तरह सुखाई हुई होंगी ।

(ग) रंग , रूप और आकार में एक समान होंगीं;

(घ ) किसी दृश्य बाह्य पदार्थ से मुक्त होंगी;

(ङ) कीट संदूषण , जीवित कीटाणु , मृत कीटाणुओं, कीट गंध , फफूंदी/दमड़ी , लारवा से मुक्त होंगी;

(च) खमीर और पुरानी महक से मुक्त होंगी;

शिकाकाई पाउडर की श्रेणी अभिधान और क्वालिटी

1. शिकाकाई पाउडर को एकासिया कोनसिना डी. सी. [ एकासिया सिनोट ( लोअर ) मेरिल सिन. ] की किस्मों की स्वच्छ अच्छी तरह सुखाई हुई पकी हुई फलियों को यथोचित साधनों से पाउडर बनाकर अभिप्राप्त किया जाएगा ।

2. न्यूनतम अपेक्षाएं: -

(i ) शिकाकाई पाउडर :

( क ) स्वच्छ, अच्छी तरह सुखाया हुआ होगा;

(ख ) समान रंग में होगा;

(ग ) किसी दृश्य बाह्य पदार्थ से मुक्त होगा;

( घ ) कीट संदूषण जीवित कीटाणु, मृत कीटाणुओं , कीट गंध , फफूंदी , दमड़ी, लारवा , कृतंक रोम मल - मूत्र से मुक्त होगा;

( ङ) खमीर और पुरानी महक से मुक्त होगा;

( च ) धूल , बाह्य पदार्थ और ऐसे ही मिलाए गए रंजक पदार्थ और अन्य प्रकार के अपद्रव्यों से मुक्त होगा;

(छ ) फफूंदी से मुक्त होगा ।

The following draft of the Sheekakai Grading and Marking Rules , 2007 which the Central Govern- mentproposes to make in exercise of the powers conferred by Section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937 ( 1 of 1937 ) , and in supersession of Sheekakai Powder Grading and Marking Rules , 1973 except as respects things done or omitted to be done before such supersession , is hereby publishsed as required by the said section , for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consider- ation after the expiry of a period of forty - five days from the date on which copies of the Gazette of India containing this notification are made available to the public;

Any person desirous to make any suggestions or objections in respect of the said draft rules may forward the same for consideration of the Central Government within the period specified above , to the Agricultural Marketing Adviser to the Govt . of India , Directorate of Marketing and Inspection, Head Office , N.H. DRAFT RULES

1. Short title, application and commencement :-

(1) These rules may be called the Sheekakai Grading and Marking Rules, 2007.

(2) They shall apply to Sheekakai Pods and Sheekakai Powder obtained from pods of Acacia concinna D.C. [Acacia sinuate (Lour) Merrylsyn] prepared in India .

(3) They shall come into force on the date of their final publication in the Official Gazette.

2. Definitions :-In these rules , unles the context otherwise requires :-

(i) "Authorised packer" means a person or body of persons who has been granted the certificate of authorization to grade andmark Sheekakai pods and Sheekakai powder in accordance with the grade standards and proce- dureprescribed under these rules ;

(ii) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;

(ii) certificate of Authorisation" means a certificate issued under the provisions of General Grading and Marking Rules , 1988 authorizing a person or a body of persons to grade and mark Sheekakai pods and Sheekakai powder with the grade designation mark;

(iv) "General Grading and Marking Rules" means the General Grading and Marking Rules , 1988 made under section 3 of the Agricultural Produce ( Grading and Marking) Act , 1937 ( 1 of 1937) ;

(v) "Grade Designation " means a designation prescribed as indicative of the quality of Sheekakai pods and Sheekakai powder shall be as set out in column in 1 of schedules II and III,

(vi) "Grade designation mark" means the "Agmark Insignia " referred to in rule 3;

(vii ) "Schedule" means a Schedule appended to these rules .

(viii) " Sheekakai pods" mean pods obtained from Acacia concinna DC [ Acacia sinuate ( lour) Merryl syn . ] ;

(ix) "Sheekakai powder" means the produce obtained by grinding pods of Acacia concinna DC [ Acacia sinuate (lour) Merryl syn. ] ;

3. Grade designation mark :-

Thegrade designation mark shall consist of "AGMARK INSIGNIA " consisting of a design incorporating the certificateof authorization number , the word " AGMARK" , name of commodity and grade designation resembling the one as set out in Schedule I.

4.Quality:--

The quality of Sheekakai Pods and Sheekakai Powder shall be as set out in schedule II and III .

5.Methodofpacking: ---

( 1) Sheekakai pods and Sheekakai powder shall be packed only in sound, clean and dry containers made ofjute , cardboard cartons , cloth bags, laminated polyethylene or poly propylene or high density polyethylene bags , pouches or any other packaging material duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf;

(2) The container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell;

(3) Sheekakai pods or powder shall be packed in such a way as to protect the produce properly. The container shall be securely closed and sealed in a manner approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf;

(4) The materials used inside the package must be new , clean and of such a quality as to avoid causing any damage to the produce;

(5) The use of materials particularly of paper or stamps bearing trade specifications is permitted provided the printing or labeling has been done with non toxic ink or glue;

(6) Each package shall contain Sheekakai pods or powder of one grade designation only. Suitable number or small packets of Sheekakai pods or powder containing graded material of the same lot/batch and grade desingation may be packed in a master container such as jute bags , wooden cases, cardboard cartons etc. , with details on master containers;

(7) The Sheekakai pods and powder shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time to time .

6. Method of Marking:--

(1 ) The grade designation mark shall be securely affixed to or printed on each packages in manner approved by theAgricultural Marketing Adviser or an officer authorized by him in this behalf in accordance with rule 11 of theGeneral Grading and Marking Rules , 1988 .

(2) In addition to the grade designation mark , the following particulars shall be clearly and indelibly marked on each package, namely ;

(a) Name of the commodity;

(b) Variety;

(d) Size code (if prescribed);

(e) Name and address of the packer;

(f) Net weight/No . of unit ;

(g) Storage condition, if any;

(h) Country of origin;

(1) Date of packing; *

(0) Bestbefore date ( wherever applicable) ;

(k) Lot/Batch number ,

11) Maximum retail price (inclusive of all taxes) ;

(m) Place of packing/manufacturing:

(n ) Any other particulars as may be specified by the Agricultural Marking Adviser.

(3) The ink used for marking on packages shall be of such quality which may not contaminate the product.

(4) The authorized packer , may , after obtaining prior approval of the Agriculture Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark of trade brand on the graded packages provided that the same do not indicate quality other than that indicating by the grade designation mark affixed to the graded packages in accordance with these rules.

7. Sheekakai Pods and Sheekakai Powder may be graded and marked as per buyer's requirements for export provided minimum requirements specified in the relevant schedule are met.

8. Special condition for grant of certificate of authorization : In addition to the conditions specified under the sub- rule (8) of rule 3 of the General Grading and Marking Rules , 1988 , the following shall be the special conditions of every certificate of authorization issued for the purpose of these rules :---

(1) The authorized packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf in accordance with rule 9of the General Grading and Marking Rules , 1988 for testing the quality or Sheekakai pods and powder or have access to the State Grading Laboratory or Private Commercial Laboratory approved for the purpose ;

(2) The premises shall be maintained in hygienic and sanitary conditions with proper ventilations and well lighted arrangement . The personnel engaged in these operations shall be in sound health and free from any infec- tious , contagious or communicable diseases;

(3) The premises shall have adequate storage facilities with pucca floor and free from rodent and insect infestation;

(4) The authorized and the approved chemist shall observe all instructions regarding testing , grading , packing , marking, sealing and maintenance of records which may be issued from time to time by the Agricultural Marketing Adviser or any other officer authorized by him in this behalf from time to time .

The date of packing shall be the date of completion of the analysis of the sample .

Explanations:

[PART II SEC. 3 (i )] (a) 'Damaged and insect bored pods" includes pods which are damaged or which have been bored or attacked by weevils or other insects;

(b) Inoragnic extraneous matter " includes dust , stones , earth or any other inorganic foreign matter ;

4.Other Requirements :

The development and condition of the Sheekakai pods shall be such as to enable them :

to withstand transport and handling and to arrive in satisfactory condition at the place of destination.

Grade designation and quality of Sheekakai Powder

1. Sheekakai powder shall be obtained from clean , well dried and wrinkled pods of varieties Acacia concinna D.C. [Acacia sinuate ( lour ) m Merryl syn ] by powdering through suitable means .

2. MINIMUM REQUIREMENTS:

Sheekakai Powder shall be--

(a) clean; welldried;

(b) uniform in colour ;

(d) free from insect infestations , live insect , dead insects; insect fragments , mould , mites , larvae , rodent hair and excreta ;

(e) free from fermented and musty odours;

(f) free from dirt , estraneous matter like added colouring matter and other type of adulterants ;

(g) free from fungus;
