सा. का. नि. 155.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आय- कर अपील अधिकरण (ज्येष्ठ निजी सचिव ) भर्ती नियम , 2006 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. ( i) इन नियमों का संक्षिप्त नाम आय - कर अपील अधिकरण (ज्येष्ठ निजी सचिव ) भर्ती संशोधन नियम, 2007 है । ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. आय-कर अपील अधिकरण (ज्येष्ठ निजी सचिव ) भर्ती नियम, 2006 की अनुसूची में,-

( 1 ) स्तंभ 7 के टिप्पण में, " विज्ञापन के अनुसार आयु सीमा अवधारित करने के लिए निर्णायक तारीख आवेदन प्राप्त करने के लिए अंतिम तारीख होगी" शब्दोंके स्थान पर, " आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए 3217 GI/2007

G. S. R. 155. In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Income-Tax Appellate Tribunal (Private Secretaries) Recruitment Rules, 2006, namely :-

1. (i) These rules may be called the Income - Tax Appellate Tribunal (Private Secretaries ) Recruitment Amendment Rules, 2007.

(ii ) They shall come into force from the date of their publication in the Official Gazette .

2. In the Schedule to the Income- Tax Appellate Tribunal (Private Secretaries ) Recruitment Rules , 2006,- (1) in column7 , in the Note , for the words " The crucial date for determining the age limit shall be the last date for receipt of application as per advertisement" , the words "The crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram , Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of J & K State, Lahaul & Spiti districts and Pangi Sub Division of Chamba district of Himachal Pradesh, Andaman & Nicobar Islands or Lakshadweep) shall be substituted;

(2) in column 13 , for the entry, the following entry shall be substituted, namely :-

"1. Vice President, Income Tax Appellate Tribunal-Chairman

2. One Member of Income Tax Appellate Tribunal-Member

3. Registrar, Income Tax Appellate Tribunal Member."

"स्टाफ कार ड्राइवर श्रेणी- II में छह वर्ष की नियमित सेवा या श्रेणी- II और साधारण श्रेणी में एक साथ मिलकर 15 वर्ष की सम्मिलित सेवा की हो।"

G. S. R. 156. In exercise ofthe powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Income-Tax Department (Group " C' ) Recruitment Rules, 2003, namely:-

1. (i) These rules may be called the Income- Tax Department (Group ' C') Recruitment (Amendment) Rules, 2007.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Income-Tax Department (Group 'C' ) Recruitment Rules, 2003, against serial No. 6 relating to the post of Staff Car Driver (Grade I), in Column 12, for the entry, the following entry shall be substituted, namely:-

"Six years of regular service as Staff Car Driver Grade II or a combined 15 years service in Grade II and Ordinary Grade put together.".

लघु उद्योग मंत्रालय

सा. का. नि. 157.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियोंशक्तियों काकाप्रयोग करते हुए, लघु उद्योग मंत्रालय, लघु उद्योग विकास संगठन, लघु उद्योग संवर्धन अधिकारी ( आर्थिक अन्वेषण ) समूह ' ख ' पद भर्ती नियम, 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. (i ) इन नियमों का संक्षिप्त नाम लघु उद्योग मंत्रालय, लघु उद्योग विकास संगठन, लघु उद्योग संवर्धन अधिकारी ( आर्थिक अन्वेषण ) ( समूह ' ख ' ) भर्ती ( संशोधन ) नियम, 2007 है ।

(ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लघु उद्योग मंत्रालय , लघु उद्योग विकास संगठन, लघु उद्योग संवर्धन अधिकारी ( आर्थिक अन्वेषण ) समूह ' ख ' पद भर्ती नियम, 2004 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) की प्रस्तावना में " लघु उक्तेग संवर्धन अधिकारी ( आर्थिक अन्वेषण ) " शब्दों के स्थान पर " सहायक निदेशक श्रेणी-2 ( आर्थिक अन्वेषण ) " शब्द रखे जाएंगे ।

3. उक्त नियम के नियम 1 के उपनियम ( 1 ) में, " लघु उद्योग संवर्धन अधिकारी ( आर्थिक अन्वेषण ) " शब्दों के स्थान पर सहायक निदेशक श्रेणी 2 ( आर्थिक अन्वेषण ) " शब्द रखे जाएंगे ।

4. उक्त नियम की अनुसूची में स्तंभ 8 के अधीन आवश्यक शीर्ष के अधीन, पैरा ( ii ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:-

" लघु उद्योगों संबंधी अन्वेषण/सर्वेक्षण/अनुसंधान संचालित करने तथा उनका मार्गदर्शन करने का दो वर्ष का अनुभव" ?

R. 157.-In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Ministry of Small Scale Industries, Small Industries Development Organisation , Small Industry Promotion Officer ( Economic Investigation ) Group B Post , Recruitment Rules . 2004 , namely:-

(1) These rules may be called the Ministry of Small Scale Industries, Small industries Development Organisation . Small Industry Promotion Officer ( Economic Investigation) Group ' B ' Post, Recruitment ( Amendment ) Rules, 2007 .

(2) They shall come into force from the date of their publication in the official Gazette.

2.In theMinistry of Small Scale Industries , Smail Industries Development Organisation , Small Industry Promotion Officer(Economic Investigation) Group ' B' Post , Recruitment Rules , 2004 (hereinafter referred as the said rules ) , in the preamble for the words " Small Industry Promotion Officer (Economic Investigation) " the words "Assistant Director Grade II Economic Investigation) " shall be substituted

3.In the said rules, in rule 1 , in sub -rule ( 1) for the words "Small Industry Promotion Officer (Economic Investigation) the words "Assistant Director Grade II (Economic Investigation ) " shall be substituted.

in the said rules, in the Schedule under column 8, under heading Essential for paragraph ( ii ), the following shall be substituted namely :--

Tiwo years' experience in conducting and guiding investigation/Surveys /Research relating to Small Scale Industries".

सा. का. नि. 158. राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय खान ब्यूरो समूह ' ग' (अननुसचिवीय पद ) भर्ती नियम, 1990 को, जहां तक उनका संबंध कनिष्ठ तकनीकी सहायक ( सर्वेक्षण ) , और कनिष्ठ सर्वेक्षक के पदोंसे हैं, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है , भारतीय खान ब्यूरो 785 भारत का राजपत्र अगस्त 4, 2007/ श्रावण 13, 1929

[ भाग II- खंड 3(i) ]

में कनिष्ठ तकनीकी सहायक ( सर्वेक्षण ) , और कनिष्ठ सर्वेक्षक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय खान ब्यूरो [ कनिष्ठ तकनीकी सहायक ( सर्वेक्षण ) , और कनिष्ठ सर्वेक्षक समूह ' ग ', अराजपत्रित ( अननुसचिवीय ) भर्ती नियम, 2007 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा, अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु - सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता: वह व्यक्ति :-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 5. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

18 से 30 वर्ष के बीच

आवश्यक:

1. मैट्रिकुलेशन परीक्षा या समतुल्य ।

2. धातुमय खान विनियम , 1961 के अधीन खान सर्वेक्षक सक्षमता प्रमाणपत्र

या

खनन परीक्षा बोर्ड, धनवाद द्वारा प्रदान किया गया विनिमय प्रमाणपत्र

या

(केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार ऐसे सरकारी सेवकों के लिए, जिन्होंने उसी पंक्ति या सहायक केडर में 3 वर्ष की निरंतर सेवा की है, सामान्य अभ्यर्थियों की दशा में 40 वर्ष तक तथा अनुसूचित जाति और अनुसूचित जनजाति के अभ्यर्थियों की दशा में 45 वर्ष तक शिथिल की जा सकती है । )

टिप्पण: आयु सीमा अवधारित करने के लिए निर्णायक

राज्य तकनीकी शिक्षा बोर्ड द्वारा जारी किया गया खान और खान ( सर्वेक्षण करना ) ( मैट्रिकुलेशन के पश्चात् तीन वर्षीय पाठ्यक्रम ) में डिप्लोमा

या

किसी सरकारी औद्योगिक प्रशिक्षण संस्थान से सर्वेक्षण में दो वर्षीय पाठ्यक्रम का डिप्लोमा ।

तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय , अरुणाचल प्रदेश , मिजोरम, मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित कीगई है । )

3. खान सर्वेक्षक सक्षमता प्रमाण- पत्र प्राप्त करने के पश्चात् खान सर्वेक्षक के रूप में 2 वर्ष का अनुभव, जिसके साथ डिप्लोमा प्राप्त करनेके पश्चात् सर्वेक्षण में कम से कम 3 वर्ष का अनुभव भी हो।

वांछनीय : राष्ट्रीय कैडेट कोर प्रशिक्षण का ' ख ' प्रमाणपत्र और ' ग ' प्रमाणपत्र धारी हो ।

टिप्पण:

1. अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती है ।

2. अनुभव संबंधी अर्हता ( अहंताएं ) कर्मचारी चयन आयोग/सक्षम प्रधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग/सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा

In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Indian Bureau of Mines Group ' C ' (Non - Ministerial Posts ) Recruitment Rules , 1990, in so far as they relate to the post of Junior Technical Assistant ( Survey ) , and Junior Surveyor, except respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the postof Junior Technical Assistant ( Survey) and Junior Surveyor in Indian Bureau of Mines, namely :-

Short title and commencement.- ( 1 ) These rules may be called the Indian Bureau of Mines [ Junior Technical Assistant ( Survey ) , and Junior Surveyor ] Group ' C ' Non - Gazetted (Non - Ministerial ) Recruitment Rules , 2007 .

(2) They shall come into force from the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay. The number of posts , their classification and the scales of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

3.Method of recruitment , age limit , qualifications , etc .--The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualification.-No person,--

(a) who has entered into or contracted a marriage with a persori having a spouse living, or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, itmay, by order and for reasons to be recorded in writing , and in consultation with the Union Public Service Commission , relax any of the provisions of these rules, with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard :

सा. का. नि. 159.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारतीय खान ब्यूरो कनिष्ठ तकनीकी सहायक ( ड्राइंग ) भर्ती नियम, 2000 और भारतीय खान ब्यूरो नक्शानवीस भर्ती नियम , 2000 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, भारतीय खान ब्यूरो में कनिष्ठ तकनीकी सहायक ( ड्राइंग ) और नक्शानवीस के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

3. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय खान ब्यूरो [ कनिष्ठ तकनीकी सहायक ( ड्राइंग ) और नक्शानवीस ] समूह ' ग ' पद भर्ती नियम, 2007 है ।

( 2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना: ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ 1 में विनिर्दिष्ट पदों पर लागू होंगे ।

3. पद- संख्या , वर्गीकरण और वेतनमान: उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता: वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :

परस्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( iii ) कलात्मक आरेखन, मूल मानचित्रों के स्वच्छ आरेखन, मापमानों के मानचित्रों के विस्तारण और लघुकरण , प्रदर्शनी के लिए भौगोलिक मानचित्रों और आरेखन रेखालेख अभिन्यास, के अक्षरांकण और रंजन का दो वर्ष का व्यावहारिक अनुभव स्थल परत और भौगोलिक मानचित्रों के भंडारकरण और रख- रखाव का ज्ञान ।

टिप्पण : अनुभव संबंधी अर्हता ( अर्हताएं) सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है ।

New Delhi , the 20th July, 2007

G.S.R. 159.--In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Indian Bureau of Mines Junior Technical Assistant (Drawing ) Recruitment Rules 2000 and the Indian Bureau of Mines Draftsman Recruitment Rules , 2000, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Junior Technical Assistant (Drawing) and Draftsman in Indian Bureau of Mines , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Indian Bureau of Mines [Junior Technical Assistant (Drawing) and Draftsman] , Group ' C' Posts Recruitment Rules, 2007.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. These rules shall apply to posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts , classification and scale of pay. The number of said posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

4. Method of recruitment , age limit , qualifications , etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Disqualification . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse.living, or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

6. Power to relax.--Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, ex-servicemen and other special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard.
