का. नि. आ. 44. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा मंत्रालय ( वित्त ) के अनुभाग अधिकारी और सहायक ( केन्द्रीय सचिवालय सेवा से बाह्य ) भर्ती नियम , 2004 के प्रतिस्थापन में, जहां तक ये सहायक के पदों ( केन्द्रीय सचिवालय सेवा से ब्राह्य ) से संबंधित हैं, ऐसे प्रतिस्थापन से पूर्व किए गए कोई परिवर्तन अथवा किए जाने वाले विलोपन को छोड़कर रक्षा मंत्रालय (वित्त ) में अनुभाग अधिकारी और सहायक ( केन्द्रीय सचिवालय सेवा से बाह्य ) के पदों की भर्ती पद्धति को विनियमित करने हेतु निम्नलिखित नियमों को बनाते हैं :-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का नाम रक्षा मंत्रालय ( वित्त ) सहायक ( केन्द्रीय सचिवालय सेवा से बाह्य ) समूह ' ख' पदों के भर्ती नियम , 2007 होगा ।
(2) ये नियम , सरकारी राजपत्र में प्रकाशित होने की तारीख को लागू होंगे ।
2. अनुप्रयोग.- ये नियम , इन नियमों के साथ संलग्न अनुसूची के कॉलम ( 1 ) में विनिर्दिष्ट पदों पर लागू होंगे ।
3. पदों की संख्या , वर्गीकरण व वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण तथा उनका वेतनमान उक्त अनुसूची के कालम ( 2 ) और ( 4 ) में विनिर्दिष्ट नियमों के अनुसार होगा ।
4. भर्ती की पद्धति, आयु सीमा और अर्हताएं आदि. उक्त पदों से संबंधित भर्ती पद्धति , आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें उक्त अनुसूची के कालम ( 5 ) से कालम ( 14 ) में विनिर्दिष्ट होंगी ।
5. अपात्रता, वह व्यक्ति,-
(क ) जिसने ऐसे व्यक्ति से जिसका पहले से पति/पत्नी जीवित है, विवाह किया है; या

( ख ) जिसने अपने पति/पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पदों पर नियुक्ति के लिए पात्र नहीं होगा :
[PART II-SEC. 4] बशर्ते कि केन्द्रीय सरकार संतुष्ट हो कि ऐसा विवाह, ऐसे व्यक्ति तथा विवाह के पक्षकार को लागू स्वीय विधि के अधीन अनुमेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस निर्णय के प्रवर्तन से छूट दे सकती है ।
6. नियमों में छूट देने की शक्ति. जहां केन्द्रीय सरकार का मत हो कि किसी व्यक्तियों के वर्ग अथवा श्रेणी के बारे में इन नियमों के परन्तुकों में किसी प्रकार की छूट देने की आवश्यकता है अथवा ऐसा करना अनिवार्य है तो सरकार संघ लोक सेवा आयोग के परामर्श से और इसके लिए कारणों को लेखबद्ध करके आदेश जारी कर सकती है । 7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्र सरकार द्वारा इस संबंध में समय - समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़ा वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

(i ) केन्द्रीय सचिवालय लिपिकीय सेवा के 4000-100-6000 रुपए के वेतनमान में उच्च श्रेणी लिपिक जिन्होंने 10 वर्ष की नियमित सेवा पूरी कर ली है और जिन्होंने सविचालय प्रशिक्षण और प्रबंधन संस्थान से रोकड़ एवं लेखा में प्रशिक्षण प्राप्त किया हो अथवा किसी अन्य प्रशिक्षण संस्थान द्वारा संचालित समकक्ष प्रशिक्षण पाठ्यक्रम पूरा किया हो और रोकड़ , लेखा और बजट कार्य में 3 वर्ष का अनुभव रखते हों । 217 भारत का राजपत्र : अगस्त 25 , 2007/ भाद्र 3 , 1929

(ii ) रक्षा लेखा विभाग के 5500-175-9000 रुपए के वेतनमान में वरिष्ठ लेखापरीक्षक ।
(iii ) रक्षा लेखा विभाग के 4500-125-7000 रुपए के वेतनमान में लेखापरीक्षक जिन्होंने इस ग्रेड में 6 वर्ष की नियमित सेवा की हो ।
टिप्पणी I प्रतिनियुक्ति की अवधि जिसमें इसी अथवा किसी अन्य संगठन/केन्द्रीय सरकार के विभाग में इस नियुक्ति के ठीक पूर्ववर्ती अन्य बाह्य संवर्ग पद में प्रतिनियुक्ति की अवधि भी शामिल है, 3 वर्ष से अधिक नहीं होनी चाहिए ।
टिप्पणी II : प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा, आवेदन प्राप्त करने की अंतिम तिथि पर 56 वर्ष से अधिक नहीं होनी चाहिए ।
यदि विभागीय पदोन्नति समिति विद्यमान है , तो उसका संघटन

S.R.O. 44. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence ( Finance) Section Officer and Assistant (Excluded from the Central Secretariat Services) Recruitment Rules, 2004, in so far as they relate to the posts of Assistant ( Excluded from Central Secretariat Services ) except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant (Excluded from the Central Secretariat Service), in the Ministry of Defence (Finance ) namely :-
1.Short title and commencement. ( 1) These rules may be called the Ministry of Defence (Finance ) Assistant (Excluded from the Central Secretariat Service ) Group ' B ' Posts Recruitment Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette.
rules. 2. Application. These rules shall apply to the posts specified in column 1 of the Schedule annexed to these 3. Number of post, classification and scale ofpay. The number of the said posts, their classification and the scale of pay attached thereto , shallbe specified in columns (2) to (4) of the said Schedule .
4. Method of recruitment, age limit , qualifications etc. The method of recruitment, age limit , qualifications and other matters relating to the said posts shallbe specified in columns (5) to ( 14) ofthe said Schedule.
5. Disqualification.-No person,
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person , shall be eligible for appointment to the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any personfrom the operation of this rule .

का. नि. आ. 45.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा वैमानिकी क्वालिटी आश्वासन सेवा नियम , 2005 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -
1. ( 1 ) इन नियमों का संक्षिप्त नाम रक्षा वैमानिकी क्वालिटी आश्वासन सेवा संशोधन नियम , 2007 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत होंगे ।
2. रक्षा वैमानिकी क्वालिटी आश्वासन सेवा नियम, 2005 में:-
( i ) अनुसूची 1 में क्रम सं. 5 के पद के सामने स्तम्भ 5 के अधीन प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
" ऐसाज्येष्ठ वैज्ञानिक अधिकारी श्रेणी 2 जिसने उस श्रेणी में 8000-13500 रुपए के बेतनमान में पांच वर्ष नियमित सेवा की हो और जिसके पास इंजीनियरी या प्रौद्योगिकी या धातुकर्म या विज्ञान में मास्टर डिग्री या समतुल्य हो ।
टिप्पण: -इन नियमों की अधिसूचना की तारीख को नियमित आधार पर ज्येष्ठ वैज्ञानिक अधिकारी श्रेणी II के पद धारण करने वाले विद्यमान पदधारी ऊपर उपदर्शित अर्हताओं को रखने से छूट प्राप्त होंगे । "
( ii ) अनुसूची 3 में " आवश्यक " उपशीर्ष के अधीन ( 1 ) के पश्चात् निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , अर्थात्: - "टिप्पण:-विनिर्दिष्ट विधा जिसमें इंजीनियरी में डिग्री या वे विषय जिनमें विज्ञान में मास्टर डिग्री अभ्यर्थी के पास होनी चाहिए, प्रत्येक भर्ती के समय उपदर्शित की जाएंगी ।"

S.R.O. 45. In exercise of the powers conferred by the proviso to article 309 of the Constitution the President hereby makes the following rules to amend the Defence Aeronautical Quality Assurance Service Rules , namely 2005 :-
1. (1) These rules mey be called the Defence Aeronautical Quality Assurance Service Amendment Rules , 2007 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Defence Aeronautical Quality Assurance Service Rules, 2005 :---
(i) in Schedule - I , against the post at Sl . No. 5, for the entries under column 5 , the following entries shall be substituted namely :-
"Senior Scientific Officer Grade - II in the pay scale ofRs . 8000-13500 with five years regular service in the grade and possessing degree in Engineering or Technology or Metallurgy or Masters Degree in Science or equivalent qualifications.
Note : The existing incumbents holding the post of Senior Scientific Officer grade- II on regular basis on the date of notification of these rules , shall be exempted from possessing the qualifications indicated above. " (ii) in the Schedule - III, under the sub heading "Essential " , after ( i ) , the following Note shall be inserted, namely:-
"Note: The specific discipline in which Degree in Engineering or subjects in which Master's Degree in Science , to be possessed by the candidates shall be indicated at the time of each recruitment . "

का. नि. आ. 46.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा सेवाओं में सिविलियन ( वर्ग 3 और वर्ग 4 पद ) भर्ती नियम , 1971 को , जहां तक उनका संबंध ( 1 ) भंडारी श्रेणी 1 , ( 2 ) भंडारी श्रेणी 2 , ( 3 ) अनुदेशक फोरमैन , ( 4 ) सिविलियन व्यवसाय अनुदेशक ( 5 ) नौकानिर्माता या पोतकार , ( 6 ) पुस्तकालयाध्यक्ष , ( 7 ) सिनेमा प्रेक्षक श्रेणी 3 , ( 8 ) टाइप राइटर मैकेनिक ( 9 ) पोस्टर चित्रकार के पदों से है उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , तीन इंजीनियर समूहों और केन्द्रों में समूह ' ग ' ( औद्योगिक और अनौद्योगिक ) के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: .
1. सक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सेना समूह ' ग ' ( औद्योगिक और अनौद्योगिक ) असैनिक इंजीनियरी सेवा भर्ती नियम , 2007 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना.-ये नियम तीन इंजीनियर समूहों और केन्द्रों, अर्थात्: ( i ) मद्रास इंजीनियर समूह और केन्द्र , बंगलौर ( ii ) बंगाल इंजीनियर समूह और केन्द्र , रुड़की ( iii ) बम्बई इंजीनियर समूह और केन्द्र किड़की , में इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 1 में विनिर्दिष्ट पदों को लागू होंगे परन्तु प्रत्येक काडर की ज्येष्ठता और प्रोन्नति का रखरखाव पृथक रूप से किया जाएगा ।
3. पद-संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति , आयु-सीमा , अन्य अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति , आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
5. निरर्हता.- वह व्यक्ति,-
( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या
( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, भारत का राजपत्र अगस्त 25, 2007/ भाद्र 3 , .1929.

उक्त पद पर नियुक्तिः का पात्र नहीं होगा :
221 परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृति. - इन नियमों की कोई बात , ऐसें आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

S.R.O. 46. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Civilian in Defence Services (Class III and Class IV posts ) Recruitment Rules, 1971 in so far as they relate to the posts of :---

(b) Storekeeper Grade - II ,
(c) Instructor Foreman ,
(d) Civilian Trade Instructor ,
(e) Boat Builder or Ship Wright ,
(f) Librarian ,
(g) Cinema Projectionist Grade - II , (h) Typewriter Mechanic ,

except as respectsthings done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post ofGroup ' C' (Industrial and Non - Industrial) in the three Engineer Groups and Centres , namely :-
1. Short Title and Commencement.-( 1 ) These rules may be called the Army Group ' C ' (Industrial andNon- Industrial) Non-Military Engineering Service Recruitment Rules, 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application . These rules shall apply to the posts specified on column (1) of the Schedule annexed to these rules in the three Engineer Groups and Centres namely:---
(i) Madras Engineer Group and Centre , Bangalore ( ii) Bengal Engineer Group and Centre , Roorkee (iii) Bombay Engineer Group and Centre , Kirkee, but the maintenance of seniority and promotion of each cadre shall be done separately.
3. Number of post, classification and scale of pay. The number of said posts , its classification and the scale ofpay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .
4. Method of recruitment, age limit , other qualification etc. The method of recruitment, age limit , qualification and other matters relating to the said post, shall be as specified in columns (5) to ( 14) of the said Schedule aforesaid.
5. Disqualification.--No person, - (a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to any of the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds so doing , exempt any person from the operation ofthis rule .
6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , other special categories of persons in accordance with the orders issued by the Central Government from this regard .
